That comes as willis is facing her first big test in the entire case on monday. A hearing is going to be held over mark meadows request to move his case from a state court to a federal one. It is almost certainly going to look like a small trial before the real trial get started. Georgia secretary of state Brad Raffensperger has been subpoenaed to testify along with his former lead investigator during the 2020 election. Im glad to be with you tonight. Georgia has unique statute called the speedy trial act. It holds the prosecutors feet to the trial when a defendant asks that the case be trialed with a are indicted. They get one initial term of court. And Fulton County, an additional two months. That would place it sometime before october. The prosecutor had no choice but to schedule it. If the trial is not healed by them, the case is automatically judged an acquittal. Thats a problem for the state in this case. I dont think theres any possible way the other defendants will be ready. I think its probably smart to go ahead and move forward. I dont know how he feels about being joined with ms. Powell. Im sure there are other defendants that would be glad to have the case moved first so they can watch the case. They will learn what the witnesses say, what the evidence is. They will see what a jury reacts. They will get to hear the arguments surrounding Attorney Advice in this case. And so, those cases will go quick. They will not finish quickly. There will be a ton of issues that come up. I think what it does is it delays everything else. But of course, all of this hinges, frankly, on the hearing we see coming forth on monday, but in Federal Court where enough cases are removed. It may make some of this a moot point. , speedy trial, trumps brand new attorney, he has been on the job three days now, he says that trump is seeking to sever his face from anyone making a similar request for a quick trial. That is before we saw this move by Sydney Powell tonight. If the cases are separated, some people, like Kenneth Chesebro and Sydney Powell go in our acquitted, what does that mean for trumps case . He is going to want to delay his case, and some of the other defendants will too. I think part of what is going to happen is they are going to drama de as office in motions practice. The former president is going to do it. Some of the other lawyers are going to do it. Some are going to want to go fast. Some are going to want to go slow. I do wonder, the das office has other matters to bring. They are going to have to be doing some of the trials early comes some later. They are going to be stretched thin. At the same time, they are going to have all the resources that the former president and his team, making motions to try to delay things as long as they can. Right. They have made very clear they are going to pursue those legal maneuvers. Michael, one thing that has been questioned is whether or not trump would try to get his case moved from state court to Federal Court. One person we know seems unlikely to do so is john eastman. We were talking to his attorney last night about the prospect of how this could happen given he never worked for the federal government. He wasnt being paid by the federal government. He didnt have a taxpayer funded job. How is there any stretch of an argument that he was working on behalf of the federal government . He certainly wasnt working on behalf of the federal government. We havent made a final decision on that. He may wind up being right. We are not sure. He made the counterargument very well. He worked in the government, but so far Jeffrey Clark and mark meadows, we know they did. Is in a stronger argument for them . Much stronger. I imagine if mr. Eastman tries to have his case transferred, that clip will be played back at some point in court. The statute to remove a case are changing case to Federal Court is about having federal executives, federal employees who have criminal acts are civil actions having the right to the case moved. It talks about their duties. To talk about their job, the things they do in the normal course. They have to make a plausible argument, have a plausible claim they were doing something connected with employment. Here, you have meadows who said, i am doing the task of Chief Of Staff. I have been asked to make telephone calls, schedule meetings, do whatever the president asked me to do. That is, in fact, the job of the Chief Of Staff. The president will say, i am the president of the United States. I am required to enforce the laws of congress, things like the Voting Rights act. The General Election Commission is under my purview. The Department Of Justice. That gives him a claim. Whether or not the judge will agree with that, i dont know. But if there was ever a case that would be transferred because of an executive federal employee, is there anyone more executive than the president of the United States . These counts, 154 of the 157 acts that the prosecutor alleges in her indictment for acts committed during the time that trump was the sitting president of the United States. There will be a compelling case to be made to transfer. I dont think it will fit to everybody. The question at the end of the day, we just dont know the answer right now. Will there be an inclination by the court, by the prosecutor to ask that the whole thing be transferred so she can put the case all at one time . Given what michael just played out, monday seems to be pretty significant for the future of all of these potentially what happens and mark meadows hearing. Is the first hearing on this issue. We will see if theres more briefing requested by the federal judge or any followup hearing set they have. Its the beginning of this process as far as removal. Theres different arguments that different individuals will be able to make. We separate the former president and any potential claim he might make the removal because the executive, there is questions about whether the individual, the former president , a president would be considered for removal as a former federal officer. Theres a whole question about whether the president is an officer. I think mark meadows has the strongest claim to the extent that anybody making this claim for removal has a good claim. He probably has the strongest case for some of the reasons that michael laid out. As Chief Of Staff, i wondered whether a federal judge will want to get into the business of deciding what of the functions of a Chief Of Staff our Political Activities versus what factions are in their role as Chief Of Staff to the sitting president , as michael was describing. Jeffrey clark also will have, i think, not frivolous came given his role at the justice department. That is not to say that all of them will be successful in the removal motions, but i do think theres some serious issues at the federal judge will have to look at. His spokesman has said, its not clear whether or not putin would attend the funeral if it is confirmed that progressions body was recovered on the scene. As you pointed out, the pentagon , the British Ministry of defense, they think that prigozhin likely died aboard the plane. The pentagon says it has seen no evidence that this could have been caused by a surface to mere is still. Service to air missile. There are videos that have come out. Experts have told cnn they do not think the plane was brought down by the weather or technical malfunction. Instead, there was some kind of catastrophic incident because it looks like the plane was already blown apart as it was falling out of the sky. This only happens maybe 20 to 25 minutes after the plane took off from moscow. It was flying at an altitude of 28,000 feet. Is suddenly, at 6 1915, started plunging and rising until it made its final plunge to the ground. Flight trackers, they had seen this plane. This was known to be one of the planes that prigozhin was on to fly on. And last left, they had seen it flying back and forth between russia and belarus, periodically turning off its flight tracker. Why is that important . Because prigozhin watched this brief but deadly mutiny exactly 2 months before this fatal plane crash. There were no threat to russia from ukraine. These are all the stories that putin had told the russian people on why they were invading ukraine. And that was a challenge to him. You are right. That is exactly what he had to do. When you hear Dmitry Peskov denying that russia had anything to do with this, what is your reaction to that . We were talking earlier about the point that if this did happen and putin didnt know about it, it would similarly reveal a concern about his grip on power and what that looks like. It has been mentioned that prigozhin have a lot of following, was very popular among a lot of people both on the left and the right and in the military. There are a lot of russians who dont understand why one of their heroes, prigozhin, was killed. So, thats probably why he has to deny it. It is so wellestablished. I think there is very little doubt that putin gave the word, gave the order. It was professionally done, exactly as lukashenko said it was not. It was clearly a professional job. That was where they were going with this. It sounds like there is no doubt in your mind. There is no doubt in my mind. As you pointed out, he, putin, has lied before. Remember when they first went into crimea in 2014 . No, they were not russian soldiers. Turns out they were, of course, russian soldiers.
