so much news this morning. that's why we are glad you are with us. good morning, everyone. hours from now, former president trump is set to head to georgia to be arrested for the fourth time. sources tell cnn is planning to turn himself in tonight at the fulton county jail to face another round of felony charges. trump and 18 co-defendants accused of engaging in a criminal enterprise to overturn his election loss. >> the deadline is noon eastern tomorrow. half of trump's alleged co-conspirators have turned themselves in. these are the mugshots, including trump's long-time ally rudy giuliani, who was once known as america's mayor. a former u.s. attorney who prosecuted mafia bosses. the sheriff says giuliani was booked and fingerprinted at the jail just like everybody else. >> full team coverage. sara murray is outside the fulton county jail. katelyn polantz at the fulton county courthouse. kristen holmes is in bedminster, new jersey, where trump is now before he heads to georgia. you have news breaking on trump's legal team there? >> reporter: that's right. trump right ahead of this surrender has his top georgia lawyer. now they have brought on a new atlanta-based criminal defense attorney, stephen sadow. he said i have been retained to represent president trump in the fulton county, georgia, case. the president should never have been indicted. he innocent of all the charges brought against him. he continues and says, we look forward to the case dobeing dismissed or a jury finding the president not guilty. this is a last-minute switch-up of his georgia legal team hours before he is set to go to that jail to surrender, to be processed. and it really goes to show that they are trying to take this seriously. we though this is something that donald trump has been fixated on. this case in particular. these charges in particular. him talking about this publicly and privately. now, i spoke to a number of trump course sources who said this was not about behavior in any way, his performance. they noted that he is the best criminal defense attorney in atlanta. of course, this is still a breaking story and we are trying to get the details how this came to be. >> thank you for the breaking news. >> joining us now sara murray outside the fulton county jail and katelyn polantz outside the fulton county courthouse. sara, starting with you. historic day. another one. what are you seeing outside the jail? >> reporter: it is an historic day. this is going to be the first time that donald trump actually has to turn himself in to a jail. in the past, we have seen him processed in the courthouse facilities. this will be different. we have seen a couple trump supporters out here with flags this morning. as we get closer to this evening when donald trump is expected appear, there will be a lockdown at the jail. we will see more security around here. we are expecting he is going to get the full security treatment, ferrying him from the airport to this jail where he will be processed. again, for a normal defendant here at the fulton county jail this is a process that could take hours. that is, of course, not expected to be the case for the former president. normal defendants are searched. they go through a medical screening. they are fingerprinted. they have a mugshot taken. it's not clear that donald trump is going to have to go through all of those steps. there are high-profile defendants, for instance, who don't get searched. even though the sheriff said all of the defendants hwill be treated the same, get a mugshot, be fingerprinted, trump has not had had a mugshot in three previous arrests. of course, we are waiting to see if that's how this plays out here today, guys. >> kaitlan at the courthouse, there are 18 co-defendants there in georgia. what do we know about the others who have surrendered and who is still out there? >> reporter: we are still waiting to see more of these defendants. there are a lot of people in this case. about half have turned themselves in to the jail by this point to be arrested, to be processed, to have the mugshots taken. the three yesterday that were quite notable and recognizable to many in the american public because they had been out there sewing disinformation, rudy giuliani, sidney powell, jenna ellis, they have their mugshots taken, they have been arrested, fingerprinted. they have their bond agreements, rudy giuliani actually yesterday went to a boil bondsman, sew lengths i, to get the loan to put up his bond terms for the court system. so he was able to be released. they have all been released. as we await donald trump to come into town and to also be arrested, we are waiting for two other very recognizable figures in american politics. jeffrey clark, the justice department official, who had been wanting to -- or had been considered by donald trump to become the attorney general, to try to overturn the georgia vote, the popular vote after the election, he has not had his bond terms released if he had them negotiated, he has not been arrested yet. mark meadows, the chief of staff from the white house. they were trying to hold off their arrests and a judge yesterday came in and said, no, that's not going to be possible. your date, your deadline to surrender is noon on friday. so we are waiting to see what happens with those two figures. >> kaittelyn polantz at the courthouse, sara murray at the jail. thank you. >> happy to be joined by cnn anchor and chief national correspondent john king, cnn senior analyst former attorney, elie honig, and john miller and last, but never least, cnn political analyst and "new york times" national politics reporter -- she is in division -- >> good morning, guys. >> john, your whole project the next 18 months is all over the map. you are talking to voters. what are voters going to think today when they watch trump walk into that jail? >> yet another example of the great american divide if you are talking about voters at large, you know, a lot of democrats would say we told you so. this is why we wanted him not there. the challenge is for the republicans. can donald trump be beat in the republican primaries and caucuses. there is a split but it's overwhelmingly pro-trump. he is at 57%. he has gone up with each indictment. that's counterintuitive, but we live -- the political world of donald trump has been upside down from the beginning. what people at the table might think history will hurt him, forget history. it tends to help him. a debate last night, did anybody make gains against donald trump? they were debating like we were going to be the republican nominee instead of focusing on him. will there be a point? when did this conversation start? is there a day or thing that opens the trapdoor for donald trump? maybe. i think people who put that money on the table have lost. you place that bet, you have lost. >> how many people says the "access hollywood" tape would be that point? >> yes. >> aging me. >> elie, help us understand the news that happened -- we reported moment ago, a lawyer swap for trump. >> yeah, so it's a smart move. you need a local lawyer. this case is going to play out in georgia. it's smart to get someone who knows the court system and who can relate to the jury. juries look for that. they can sense is this person from here? are we going to belief them? that's a factor. donald trump has to make sure -- he has four pending cases. he has to get his legal team in order. you can't shuffle out lawyers on each case on a whim, you know, the way some white house staff were shuffled in and out on a whim. >> this is different. those lawyers will spend hundreds, thousands of hours getting to know the nuances of this case. if you just cashier one to another, you are setting yourself up for failure. if i was advising him, pick your lead guy on each case, stick with him, let him do thinks job. >> john miller, to you. i think oning that's interesting, trump will be the focus today. mark meadows has to turn himself in because a judge said, no, no, no, you're not special and you don't get special treatment here and same with the doj official jeffrey clark. >> we will have a very interesting day as the parade of co-defendants have come through. some people just go in, go out unseen. as much as they can be. what we saw with rudy giuliani yesterday was, you know, he came out, did his defiant press conference, and they got back on a private plane. what will be interesting today with mark meadows, i think we will see the low-profile approach when that happens. but donald trump is going to be the critical one today because when he goes in there, we are in the face of a judge's admonishment about making statements that could be considered threatening to witnesses, co-defendants, so on, which is a habit of his. they are talking about whether to have a press pool in the moder cade going to the jail. talking about doing a statement at the airport on the way back. so the question today will be, is there a shift in tone? is there an adjustment in his rhetoric based on the judge's order and the urging of his lawyers, which donald trump will -- >> we are going to go into this with potentially a mugshot coming out of it and both sides are going to hold that up to show to their supporters. it will be on t-shirts of maga supporters, those who support democrats, and we are on a day where an american president gets a mugshot and everybody is going to use it as a meme. >> absolutely. without question. that's speaks to the uniqueness of this moment. before that maga base, this has been -- they have been careening -- i remember after the first indictment i was outside the courthouse in new york city and trump supporters were expected three to four indictments, to help him rise in the polls. i mean, look back to the debate last night. one of the things the candidates agree on is weaponization of the doj being a kind of calling card for this version of the gop. it's being a rallying cry for base republicans. i think that mugshot, i think that photo, i think this case specifically will continue in that vain. we have seen over and over and over base republicans rally around him. even the ones who think he may not be the best candidate for the pofuture will say i don't think these things should go on. that's been ingrained in the republican base here. the stakes of this, legally and politically, couldn't be higher because it actually fuels the reason donald trump feels like he can get back to the white house. the political strategy is the legal strategy. >> yeah. again, another historic day -- >> the polarization and intensification of the polarization worries me as a prosecutor. if people feel stronger and stron stronger both ways, that's your jury pool ultimately. you get one person moved by that image the wrong way, that's a tough break for a prosecutor. >> gentlemen, stay -- >> to john's point, the money comes in every time one of these things happen. do you think desantis is calling the head of the florida state police can i get a mugshot without getting arrested? >> not really, mike. we are going to have fun tonight. >> some tense moments on the stage during last night's first gop debate, including that back and forth between mike pence and vivek ramaswamy, the former vice president pulling no punches as he hopes to boost his poll numbers out of the single digits. and the former president vice president mike pence joins me now. sir, good to have you. i assume you think you did well. you think you did well enough to break out of this pack and get into double digits? >> well, we have been encouraged by the response. frankly, i was honored to be on that stage, to be able to talk about the fact that i really believe with all humility, based on my years as leader in the congress, leading the state of indiana as governor and my years as the leading conservative in the trump/pence administration i am the most qualified, most tested, most proven conservative in this race, and the opportunity to take that case to the american and to have an energetic debate with others on the stage was something that i relished and i am grateful for. >> energetic is one way to describe what happened. you mixed it up with vivek ramaswamy. i want to play a bit of your criticism of him and then ask about it on the other side. >> now is not the time for on-the-job training. we don't need to bring in a rookie, people without experience -- >> you say he is a rookie, on-the-job training. your last boss was a rookie. he had on-the-job training, a businessman who had never been elected, had no foreign policy experience. why is it disqualifying for vivek ramaswamy and not for donald trump in 2016? >> well, i think it's -- we live in a different time. i mean, president joe biden has weakened this country at home and abroad. the disasters from afghanistan has emboldened the enemies of freedom, wars in europe, and here at home the runaway spending under the biden administration launched the worst inflation in 40 years. the war on energy has gasoline prices still up 60%. open border policies created the worst border crisis in history. i wanted people to understand i believe this is a time for proven and experienced leadership in washington, d.c. i know how to get things done in congress. i know the role of states, the vital role our states play ap-i know how an administration works. and bringing all of that experience to bear, frankly, it's the reason why my wife and i stepped into the race. it's because we believe that to whom much is given, much will be required. we have been blessed with opportunities to serve this country. we felt really a duty, victor, to step forward and offer our experience to meet the challenges following the failed policies of joe biden and the democrats in washington. >> let me play what you told my colleague dana bash about the former president who is not on the stage last night, donald trump, and if he should be president again. watch. >> aim running for president in part because i think anyone who puts themselves over the constitution should never be president of the united states. >> never be president of the united states. however, when you were asked last night if you would vote for former president trump even if he is convicted for president, you raised your hand. reconcile those two. >> well, look, every one of us on the stage signed a pledge to support the republican nominee. and, frankly, my hand was raised in that spirit, just in keeping my word. but i really do believe more after last night that donald trump is not going to be the republican nominee. i know that many of you in the media think this is already a rematch between trump and biden. i don't see that. i think last night the american people saw hopefully -- hopefully, they got a better sense of me and my role as a leader over the last 20 years. also, i think they got a better sense of what a deep bench the republican party has and that we have better choices for 2024 for our party. so i am more confident than ever that our party is going to give us a standard bear fit to the times, someone to lead us to victory in 2024 and i will work my heart out to make sure that's me. >> a few days ago, laurence tribe, a judge, lewd ig, wrote an article. the former president's efforts to overturn the 2020 presidential election and resulting attack on the u.s. capitol placed him within disqualification clause and, therefore, ineligible to serve as president ever again. we are talking about the 14th amendment here. you consulted the judge when you were given the advice by john eastman and others that you had the power to reject slates on january 6th. do you agree with his con solution that because of the president's actions before and on january 6th that he is disqualified from holding presidential -- the office again? >> well, i really can't comment on his -- >> yes, you can. >> his legal theory. i made it clear last night that i hope that it didn't come to this. i hope the judgments over the president's action around january 6th had been left to the american people. i don't know whether the 14th amendment applies. i read an article the other day that in the justice department's pleading they didn't even reference that kind of a charge. so i'm skeptical about that. but, look, we'll make sure the president has his presumption of innocence. no to one is above the law. what i welcomed last night, and it took a little while for some people, was for every aspir ant to acknowledge on january 6th i did my dut ity under the constitution of the united states. frankly, for me over the last two and a half years to have donald trump and his allies continuing to repeat the falsehood that i had the right to reject or return votes that no vice president in american history had ever claimed or ever should claim, i think it's really misled a great number of americans. so having all of the candidates on the field affirm that that, recognize, because i want people to know that on that fateful day, whatever the process of these various cases will be, is that president trump asked me to put him over my oath but i chose the constitution and i always will. >> former vice president mike pence, thank you for waking up early and speaking with us. thanks so much. >> thank you, victor. >> where do we start? first of all, that was really a brilliant question -- >> thank you. >> on rookie? and he didn't answer it. >> if it's disqualifying for vivek ramaswamy, donald trump he said ready on day one. >> a rookie in the same one. so interesting. and the last question about the 14th amendment and this argument from a renowned legal scholar that pence relied on on january 6th. >> textbook examples of how the candidates feel like they are put in a straitjacket by the fact that they don't like donald trump, don't believe donald trump should be president again, and many don't -- back here think he is eligible to be president again, but only way they improve their numbers are to draw supporters away from donald trump and they don't want to insult and challenge those voters. so the vice president just said there, again, donald trump asked me to break the law and i wouldn't do it. he doesn't say it that plainly. if you translate, that's what he said. donald trump sasked me to break the law and break my oath and i wouldn't do it. then he won't say this man shouldn't be near the white house. his only chance is iowa. ten years ago, he is a textbook iowa candidate. mid-western governor, mid-western governor, evangelical christian. the party has changed so much, they need those votes and all of these candidates are wrestling how do i convince the voters loyal to donald trump give it up. >> puts you at a political ceiling in the republican electorate. there is a question can he break out to get to double digits. if you are branded against the trump movement and lack of fact in that january 6th moment set in for 30, 40% of that electorate, that makes it harder to cobble together a coalition. i think pence did himself a lot of favors, his legacy favors, it this kind of message favors, that k-9 kind of clarity of voice is helpful. the clarity of voice is at odds with the motivating factor of a large section of the republican base. someone like ramaswamy with inexperience, is still speaking in the wink of that base. when i am on the road, when you talk to the trump supporters they sound more like ramaswamy than mike pence. >> i can't make sense of mike pence. i didn't mean for that to rhyme. he stood strong on january 6th, did the right thing against so much pressure applied to him and now he is saying even if donald trump is convicted i would still support him? mike pence is a victim in that case. they were chanting to hang mike pence. the court will consider mike pence a victim if it comes time for sentencing. i guess i get it now. our political experts make perfect sense why he is trying to thread in impossible needle. >> and walking this impossible line. one of the most gracious people in politics, we saw some of that last night. i briefed him on trifrm matters when he cake to new york and i was at the nypd. when you look at this impossible line, he starts with indictments by saying no one is above the law. but donald trump shouldn't have been indicted. he last night was saying, you know, pushing back against trump but then taking credit for the trump/pence administration accomplishments. he is trying to thread a needle where you are going to get stuck at some point. >> gentlemen, thank you. >> thanks, guys. one of the moderators of last night's debate called former president trump the elephant not in the room. did any of the candidates do enough to cut into trump's strong support? please raise your hand if you would. just hold on. >> as you saw there, most of the republican candidates on that stage in the debate in milwaukee last night vowing to support president trump even if he's a convicted felon, despite trump's absence, there was no way for his republican rivals to ignore that strong support despite the legal troubles. the melee in milwaukee was like a prizefight that lacked the reigning champion. at best the debate turned into an audition in second place on a race that looks likely to catapult trump to his third conservative republican nomination zchlt any of the candidates do anything last night to slow him down? let's see what new hampshire's republican governor chris sununu thinks. he joins us at the table. would you have raised your hand to that question? >> look, i think what we saw last night was the republican party without donald trump. first time in six years. >> i know, but i asked you, governor, would you raise your hand? >> look, he is not going to be the nominee. i mean, that's -- >> why won't anyone answer this question? >> because it's 18 months away. what is going to happen with the indictments, with trump, with biden? i don't think either will be on the ticket. i think biden is less likely to be on the ticket than trump. trump is in trouble. i heard people say trump won last night. not even close. for the first t13 candidates to eight or nine. he wasn't mentioned. i guarantee that drove him nuts. again, it had been flat, if they said a lot, trump would have won. anyone looking for a clear frontrunner with eight people on the stage wasn't going to happen. you saw three, four, five candidates show energy, show a future of the party without trump and people liked it. >> the person who at least according to our focus group thought won the debate was vivek ramaswamy and essentially he was defending trump, calling him the best president of the 21st century, he would pardon him. what gives you the confidence that anything is going to change? you've got these eight who are huddled around, you know, anywhere from a 1 to 15 points and trump above 50. >> because it won't be very long. it will winnow down to five or six before iowa and i think three or four before new hampshire. and one-on-one -- remember, trump's ceiling is 47, 48% at most, iowa, new hampshire, 42, 43%. so where the conversation is happening, trump's in trouble. and last night the conversation started to happen -- >> this sounds like everything said in 2016 and it never collapsed, sounds like everything that was said after the first indictment and the second indictment and third indictment and none of it -- >> it doesn't matter with the republican base. it's not going to matter. what matters is we have options. nikki haley showed some fire. pence showed fire. sparked up their campaign -- >> that was interesting, the pence tone to me. >> yeah, something we haven't seen before. those campaigns have been quiet for a while. wow, there is energy here. ramaswamy didn't win but he is being talked about. that's what you want. he didn't fall apart. and he was fairly unknown. now people are taking a look. he did what he need to do. and desantis did well. >> you think so? >> no one attacked him. >> he got to look in the camera, make a strong case, do what he needed to do. i think he shored up his conservative credentials, if you will. he looked presidential. >> what changes the narrative? the two who split center, desantis' campaign is on the descent and you look at vivek ramaswamy, the opposite direction. did desantis do anything to change the trajectory? >> yeah, i think desantis has been -- the campaign's been quiet, shifting, as it should, right, as you get in debate mode, hit the ground in iowa, new hampshire, your campaign changes a little bit. vivek is the new name. what is this about? that gets people excited. governor desantis reaffirmed where his -- why he was so popular, you know, a little bit ago, what can come back and the opportunity for republican party without trump and i think a lot of people went, oh, yeah, we got great options here. there is a real bench here. i think asa and doug burgum, i love them, they are wonderful, they have been desquekted -- even tim scott should have dejected themselves into the conversation a little more. no one had over 12 minutes. you won't get a frontrunner. you got energy. you got a little back and forth. we did get energy. i was glad there were policy questions there. you made everyone talk with this op-ed, folks got to get out earlier than they might want to get out. who -- the next debate is september 27. should doug burgum, governor burgum, governor hutchinson, for example, be on the stage? oh, yeah, sure. the. >> i think the west winnowing will be around thanksgiving. if you are in the low single digits, if anyone is around thanksgiving, you probably have to go. that gets it to five or six candidates by iowa. a few will do well in iowa. few won't. three or four by new hampshire. you get to one-on-one, trump's in trouble. trump saw the field narrow for the first time. he saw options for the republican party that weren't led by him for the first time. if i'm donald trump, i am not thrilled. >> we had chris christie on and he bullish on his prospect in your state, new hampshire. do you think chris christie takes new hampshire? >> he is putting everything into new hampshire. again, i -- i think chris -- he hammers trump hard, which i am not going to complain about. i think all the candidates -- this the opportunity to go bigger, right? vivek, he is anti-woke. go big. talk about your business background. if you are on the social conservative side, talk about face cal discipline and limited government and how you are going to get there. don't talk about the problems. talk about the solutions. >> we are out of time. thank you, governor sununu. two months after leading a filed mutiny against russia, wagner chief yevgeny prigozhin presumed dead in plane crash. what ukrainian president volodymr zelenskyy is saying this morning. and a mass shooting at a popular biker bar in orange county, california. three dead, six injured. police say the suspected shooter was also killed. a source tells cnn the suspect was a former law enforcement officer. so far, no details on a motive. when you smell the amazing scent of gain flings... time stops. >> you know, i don't see that there is really anybody else who, you know, realistically would have had a great interest in this. i am curious to see how the kremlin is going to pspin it. i think it's interesting in the 24-hour cycle since it happened, all we saw was putin making a speech at the brics conference remotely. it's interesting that they are keeping a heads-down approach right now, of course under the theory which is nothing more than theory, that there is some sort of investigation going on. if there is any investigation going on in russia, it's very strongly and directly controlled by the kremlin. so it will be interesting to see how they spin this. looks like zelenskyy has taken away a possible option, which is to say that the ukrainians did it. i think they will come up with other things so they have deniability. >> steve, prigozhin was presumed dead by most folks in 2019 and he was very much alive. is there reason to believe that couldn't be the case this time? will we have a definitive answer on that ever if it's only russia investigating? >> the short answer is, if it's only russia investigating, which it almost certainly will be in these circumstances, i don't think we will truly know. there are some sort of weird stories out there where perhaps his death was, for some reason, faked and he has been spirited off someplace? yeah, that's possible. but i think it's much more likely that what happened was putin decided to wait two months before resolving this problem of one of his senior guys essentially conducting a mutiny which could have turned into a coup. i think it's more likely that putin decided, yeah, we need to move that piece off the chess board and needed to wait a bit to do it. >> do these reported deaths and video we are looking at now of the fiery crash, do those end any of the residual impacts orbit of vulnerability that putin faced with prigozhin living his life for months after that, or is there some of that still out there? >> you know, it mitigates it. i think it makes a little bit less. if putin has essentially removed prigozhin from the playing field. there is no doubt in my mind that the regime is much more brittle than it has ever been in the past 20 years. i mean, the idea that prigozhin could have done what he did to begin with shows a significant chink in putin's armor. and i think what is happening is the elites are looking the putin and saying how much weakness are we willing to tolerate and will something like this happen again. if that's possible, how do we make sure that doesn't happen again. putin is in a much worse situation regardless whether or not prigozhin is still alive. >> steve hall, former cia chief of russia operations, really important perspective. thanks very much. so, last night eight republican candidates took the debate stage trying to narrow that very large gap between them and former president trump. did it resonate with voters?
