today an "inside politics," tick tock, a lawyer and a bail bondsman, the first two co-con spear tors turn themselves in in fulton county. plus, the quiet game. a georgia judge challenges the former president to obey the golden rule warning any threats against the community will come with legal whiplash. milwaukee pits eight candidates against each other in a showdown to survive while fox news hangs the non-welcome sign. i'm dana bash. let's go behind the head leans and "inside politics." it begins with the architect of the conspiracy, inmate p 0115732. today the first two of the trump 19 surrender in georgia. this morning in fulton county, one of the big-named defendants, john eastman, the lawyer who concocted the legal theories at the center of the 2020 plot was booked and released on charges in the sweeping election subversion case. a largely unknown character, scott hall, who allegedly helped break into voting systems was the first known trump co-conspirator to turn himself in. a bail bondsman, he's accused of trial to steal election data in coffee county. he was seen on video arriving the day of the breach, january 7, 2021. the former president listed at the top of the indictment, donald trump, says he'll make another trip into history. that will be on thursday. we'll start our coverage where he will go. that, of course, is atlanta. that's where katelyn polantz is. walk us through the developments we've already seen this morning. >> reporter: dana, there are things happening both here and at the courthouse as these 19 defendants, one by one, send lawyers in to negotiate their bond agreements and head over to the jail to be arrested. in response to the criminal charges from the fulton county, georgia, district attorney's office related to what they did for trump around the election. donald trump has his bond negotiated now. that bond is stricter than anything we've seen in any of the other cases he's facing as a defendant. he has a specific outline that he can't intimidate any witnesses or defendants including on social media. that's spelled out in the agreement, and he's posting $200,000 bond, meaning that, if he violates that bond, he has to pay the amount if he doesn't show up or he can be sent to jail if he doesn't follow the terms of release. by my count, there are still 12 other defendants in this racketeering case in georgia that have to start working through their bond and go be arrested and go to the jail to be processed as criminal defendants who are in custody of the sheriff's office. we only know of two so far that have been in custody so far, have reported over there. we just saw one person leave, john eastman, the prominent attorney from right wing circles who was working for donald trump after the election. >> katelyn, john eastman also released a statement. what did he say? >> reporter: he did. he essentially said in his statement that this is a shame, being criminalized for being an attorney. he also spoke to two of our reporters outside of the jail, jake cohen and nick valencia spoke with john eastman. he said he's not talked to donald trump, first an foremost, that he's paying his own legal bills. that donald trump isn't helping him with that. and also, dana, he has no regrets representing donald trump after the 2020 election, that what he did he believes in. >> you and our colleagues are all over it there. i'm sure we're going to hear from john eastman soon. one other thing. you just saw emotion from jeffrey clark. what do his lawyers want? remind our viewers who jeffrey clark is. we have a lot of characters in what we're seeing here. >> reporter: 19. yes, jeffrey clark is one of the people who was in the administration at the time -- at the end of the trump presidency and at the time of the election and was essentially wanting to become attorney general or donald trump wanted to install him as attorney general so trump could use the justice department to either pressure or overturn election results in different states, specifically in georgia. jeffrey clark had plans to try and mount the legislator in georgia to overturn what the popular vote was in this state. that's what he's accused of doing. the georgia d.a. says that's a crime. he's also a co-con spear tore in the case that the federal authorities have brought alone in federal court in washington, d.c. here in this case, because jeffrey clark was a federal official at that time working within the justice department, even if he's being accused of a crime, he's arguing his case should have to move out of state court to federal court where there are no cameras. a bit of a different environment there for capturing what those proceedings would be like. he'll be able to race additional constitutional arguments there. another hearing set monday for another defendant, mark meadows, who has also tried to move his case to federal court, arguing something very similar. people are doing all kinds of things in the legal system. we'll have to watch and see exactly how they play out here, dana. it is notable if that case were to move. >> no question. a head spinning number of developments. it will only continue as the day continues, as the week continues, and frankly, as the month continues. katelyn, fantastic reporting to you and the team. we'll talk to reporters here, legal analysts cara cordero and also evan perez, our senior justice correspondent. also in atlanta, former u.s. attorney michael morse. michael morse, let me start with you since you are there in georgia. what do you make of the developments we've seen so far and paint a picture of what it looks like down in georgia as all of these co-conspirators and as we see the big defendant come down on thursday? >> good morning. glad to be with all of you. it's unique here in the state right now, security is obviously at an all-time high. the secret service has been on the ground for some period of time in coordinating and preparing ultimately for the former president to surrender himself. to have this number of defendants in this type of case, these sort of high-profile, vip defendants is a little unusual. it's not the only time it's happened in fulton county. they're reporting to a jail which is not at the height of its game, if you will. it's not a place where you'd want to be. there have been a number of problems there it's probably a humbling experience as they come in. typically they'll turn themselves in, give some biographic information, go through a general security screening, be fingerprinted, have a mugshot typically and move forward. i think this is a little different, really, if you think about, primarily because the former president, as he is planning to turn himself in. there will be really strict coordination with secret service who are as their job has control of his body, if you will, as opposed to just the process. the idea of taking a picture or doing fingerprints, that's the process. searching and coming in, put in an orange jumpsuit. he'll have a standard processing at that point. >> evan, we know that john eastman, who is the most high-profile, most well-known and maybe most important character in this -- i keep saying this drama, because there's really no other way to look at it. i want to show our viewers what a booking sheet looks like and what the booking sheet specifically looks like for john eastman. and then as we continue to talk about him in particular, let's look at the part of the indictment that came out last week. there are a lot of counts he's being charged with. one of them, on or about the 3rd day of december, 2020 rudolph giuliani, eastman, jenna ellis, ray smith committed the felony offense of solicitation of violation of oath by public officer. >> yeah. john eastman and all of these characters were -- he had his finger in a lot of the parts of this. one of the things that he's arguing in his defense is that he was giving just legal advice to the former president. so one of the things that is problematic for him is that there's testimony by greg jacob and others around mike pence when eastman was trying to persuade everybody that the vice president had the power to reject unilaterally the election results of georgia and from other states. one of the problems is that craig jacobs says that eastman knew that the supreme court was going to -- >> craig joiacobs -- >> pence's former general counsel. knew this would be rejected by the supreme court. yet he kept pushing forward, partly because thait wanted the chaos. they wanted enough time to be able to get the political actors to come in and essentially overturn the election results. so that's part of what you see in the georgia election there -- i'm sorry -- in the georgia charges is this idea that they were pressuring people in georgia, legislators. they were trying to get access to voting machines. they were doing all kinds of things, all in the pursuit of buying time so that then the political actors could take over and sway the election to the former president that he had lost. >> this role of the lawyers and the fact they've been charged with this case really goes to the crux of what a major portion of what the prosecutors are going to have to prove and what the defendants are going to assert, really functioning on the role of the lawyers and whether or not the advice they were giving to the former president fell into the scope of legal advice or whether it constitutes criminal behavior. it's a really important issue, because lawyers make arguments all the time. they make arguments in the interest of their clients that they think is a plausible reading of the law. it doesn't necessarily have to be the best reading of the law. as a lawyer, that's what you want to do. sometimes a lawyer will make what is a plausible argument. i think the fact that eastman has been charged, giuliani, mr. chesebro, all of them are going to argue in this case that what they were doing is providing legal advice. people can disagree with it. people can think that it's wrong, but it's not criminal behavior. as it comes to the former president and those who relied on that advice, they're going to flip that argument to their benefit and say, well, i was relying on this legal advice -- >> the question is where you draw the line. >> -- even if it turned out to be wrong. >> whether it's reasonable to think that legal advice was actually something that was legit or whether it was just -- >> what they're going to argue is this potentially is the criminalization of legal practice. so i think lawyers and the bars are going to be looking at this case to understand where these prosecutions end up on where that line is. >> michael moore, let me bring you back in here, and let's look at the big defendant, the former president, and just remind our viewers what he agreed to in his bond deal yesterday. $200,000, no direct communication with co-defendants, no direct communication with witnesses, bars direct or indirect threats on social media. you know the legal community there. how serious do you think that the judge will take those specific bans on communications, but also the social media threats? >> i think he'll look at them pretty seriously. he'll enforce that. the problem is he's going to have to balance trump's first amendment right as he's engaging in this campaign. one of the witness ps in the case against him is his former vice president who is also a candidate for the office he, too, seeks. so this political back and forth, you don't want to interpret it as a threat. that's the risk. so how will those things be seen? this case is going to be full of these lines that people have to decide what crosses the line as we go forward. the court is going to have to do that as relates to political speech, social media posting and that type of thing. i want to tell you, too, remember they're going to have to get into trump's state of mind. this idea about getting legal advice. you don't want to criminalize legal tactics, but the issue they may face as well is that the georgia legislature that came back after this election and changed the election laws in georgia because they claimed there could be problems. that's going to be interesting to see especially the republican governor try to backtrack on that. >> that is such a good point. i was down in georgia doing some stories on that. that's really interesting sub plot that we're going to see. thanks for that great discussion. we are not done. a lot [narrator] why is aaron happy? well, carvana has tens of thousands of cars under $20,000. so aaron's folks could help hook him up with a new ride. we'll drive you happy at carvana. overcrowding, inmate deaths, lice, skab byes. the fulton county jail is the site of the bookings for the former president and his co-conspirators. cnn's zach -- >> reporter: it has a reputation for troubled conditions, for inmates inside. there's been a department of justice civil rights investigation that was opened up last month into things like lack of access to health care for detainees, these troubling deaths you mentioned earlier. things like treatment between the inmates. really, really deplorable conditions all around. it's going to be the site where the former president will turn himself in and surrender to authorities in the next coming days. this site has been a problem in recent years. the deaths you mentioned before have been an issue and led to a federal investigation. we have seen two of trump's co-defendants show up today. this morning we saw one of his former attorneys, john eastman, leave the jail just moments ago. his colleague told nick valencia he was processed like any other inmate, mugshot and was searched. it appears they're not getting any type of special treatment than any other defendant who shows up here. >> zach, thank you for that reporting. how do you keep a moth from a flame? how do you keep donald trump away from his phone, a microphone or a television camera? today and every day from here until the conclusion of donald trump's election subversion trial will double as a test of impulse control. it took fewer than five hours once the judge set mr. trump's bond for him to flirt with the limits of what he can say and what qualifies as a threat meant to intimidate those involved in the georgia prosecution. he said, quote, radical left district attorney -- that's what he called fani willis last night. a judge will have to decide if that crosses the line. mr. trump has always treated lines more like suggestions, made to be trampled on. he sees men and women overseeing his four prosecutions as villains in his own story. the insults range from run-of-the-mill complaining by judge chutkan, jack smith a crack head. trump treating the georgia restrictions as rules meant to be broken risks real punishment, including more rules, revoked bond and maybe remand. but the people closest to the former president see no downside, at least not now, to saying things like this. >> i'm sorry. i won't be able to go to iowa today. i won't be able to go to new hampshire today because i'm sitting in a courtroom on bullshit -- >> deranged jack smith. >> the criminal is the district attorney because he illegally leaked massive amounts of grand jury information. >> i have a trump-hating judge with a trump-hating wife and family whose daughter worked for kamala harris. >> here with me, cnn's jeremy diamond, leigh ann caldwell of "the washington post" and zolan kanno-youngs. i know you've been covering donald trump pretty much since he came down the golden escalator in june of 2015. so knowing him the way you do from covering him for all these years, how do you think he's going to take these limits put on him from the judge in georgia? >> i think what we tend to see with donald trump is things tend to have a snowball effect rather than any kind of cooling effect. so the notion that things are going to get better from here, that he's going to be more restrained from here i think is far fetched. i think what's more likely to happen is donald trump is going to continue to test these limits of the restrictions that have been placed upon him. he's going to rival against him. the question is will he actually cross the line that will actually result in clear consequences. it's clear that the georgia case is props the one where that is most likely and where he's most likely to face consequences. i think part of that has to do with the fact that these federal cases have treated him like a former president. they recognize that notion, and i think there are fewer kid gloves perhaps in this case. >> let me give you an example, perhaps, of why the judge put these restrictions in the bond agreement. something he said on his social media account august 14th, i'm reading reports that failed former lieutenant governor of georgia geoff duncan will testify before a fulton county grand jury. he shouldn't. that looks like a threat for a witness. >> i think there's a couple things. my colleagues at "the post" are reporting it's going to be up to the judge to determine are they going to really provide trump with any repercussions on what he says and then risk making him look like a victim an being persecuted and his free speech rights being taken away. but what it seems like might happen here is that the judges will probably draw a line between attacking the judge, attacking the prosecutor and what you just read which was intimidating witnesses. so while he has gone on rampages against the prosecutors and the judges, some of the judges, we'll see what happens if and when he continues to intimidate witnesses. >> even statements like that still, there's going to be attention here. statements like intimidating witnesses or even just broadly attacking judicial systems, courts, judges, that's also part of the political strategy for the trump campaign. each time you see one of these indictments, how long does it take for comments to come out to rile his base and rile voters and say, look, this is a witch hunt, et cetera. so now you have warnings saying we need actually a fair judicial system to occur here which would happen for another defendant. that's going to run directly into a campaign strategy here which should raise some doubt over whether or not you actually see a more muted response going forward. >> it's such an important point. i feel like a broken record here. it's important. it's all connected. the things that he says on social media and elsewhere, it's all part of his political strategy to build himself as a martyr, to build himself as somebody who is fighting for others and to create villains on the other side of this. i just also want to play for our viewers some of the examples of what donald trump said about judges in other cases. >> somebody said i should not criticize judges. okay. i'll criticize judges. >> i think judge curio should be ashamed of himself. >> i have had horrible rulings. i've been treated very unfairly. >> what judge curio is doing is a total disgrace. >> the judge has been very unfair, has not done a very good job. he's been a very bad judge. >> yeah, this is the continuation. now the difference is he's actually an indicted defendant in these cases, so the rules of the road are different in this case. we'll see how he continues to proceed with it. certainly if past is prologue, he's going to keep it up. >> we're going to continue to watch the courthouse in georgia. we're going to continue to watch that breaking news. also just in. the debate stage is officially set. who's in the middle? >> no, no. >> do you think that the others in this case have a standing on that, people like meadows? >> -- >> did they do a mugshot and everything inside? >> no comment. >> no comment. we're going to continue to go back to our reporters as they see more activity outside the jail where all 19 defendants including the former president are expected to turn themselves in. now to the official lineup for the first republican debate. florida governor ron desantis and vivek ramaswamy will share center stage tomorrow night on milwaukee. on either side of them, mike pence and nikki haley, chris christie and tim scott will stand in the number five and six positions. on the wings, asa hutchinson and doug burgum. an interview with tucker carlson is expected to be release as trump's rivals spar for the spotlight on the conservative net network. jeff, what are you seeing and hearing there? >> reporter: all the candidates are preparing, deep in debate sessions for tomorrow night. donald trump is not going to be on stage, but he will be likely in questions and in the minds of many of these candidates. when you talk to republican voters here and republican strategists here, they believe this creates an opportunity for some of these challengers. you said right in the center stage, florida governor ron desantis. can he prove that he is the true sort of heir apparent, if you will, or the second leading candidate? we'll see tomorrow night. he's deep in debate preparation sessions as are all the other candidates. when we talk to voters -- we've been spending times in the suburbs of milwaukee, a key swing state. they're interested in hearing from all the candidates. that underscores the fact that this is the new moment of the campaign, the opening bell, if you will, for the summer primary. every candidate has an opportunity. some have morris, than others. dana -- >> opening bell. that's a great way to put it. it certainly doesn't always feel like that. it feels like it's been a long time. very important context. thanks so much, jeff. see you there tomorrow. let's talk about what we're going to see -- first let's look again at the stage. it's really interesting to see who is where given where they've come from and the experience that they have. obviously you see ron desantis there. vie wreck ramaswamy right next to him. >> it's remarkable. when he first launched, it was like, who? to see him at center stage is credit to the campaign he's run and the appeal he has with a lot of republican voters. i think what will be interesting to see tomorrow is which candidates benefit from trump being there, and which candidates suffer for it. some of them were obviously looking forward to showing how effectively they can go after him like chris christie perhaps, and doing so without trump there looks a little bit different. other candidates will be -- like ron desantis will be happy to have all the attention focused on him but also facing a lot of the attacks as a result. >> let's hear a little bit from -- you mentioned ron desantis and chris christie. let's start with ron desantis and his prepping for the debate. >> we'll get people that never voted republican to vote for us. that's what we did in florida and that's how you win big. we've been losing a lot of winnable races because we're not attracting people beyond some of our own party members. that's not good enough. >> this is really interesting. i think for a bunch of desantis' campaign so far, he's actually been playing to the right of trump. i've heard some republicans in congress and others that have actually privately wished that he would kind of stay away from the culture wars and focus criticism on the biden administration or the economy to win over some of those independents. you talk to many people following this race and they would say that desantis seems to keep the focus on trying to galvanize trump voters and trump's base rather than independents and voters in the suburbs. >> which begs the question whether or not -- how he's going to deal with the trump factor. they're all going to deal with it even though he's not there. listen to what chris christie said on that. >> for some folks they believe it's a political calculus, that somehow donald trump will be defeated by the legal process, and that when he is, if they're the ones that have said nothing bad about donald trump, that they're more likely to inherit the donald trump voters. i'll tell you something, if you want to know what a failure that strategy is, talk to me or jeb bush or marco rubio. >> he's not wrong, that most of these candidates are waiting for donald trump to falter and for something to happen where he is not in the race. they are hoping they can slide by and be next in line to be that heir apparent to him. every single republican i have spoken to says that the stakes are highest for ron desantis. he has had a floundering campaign, a very tough summer. he's had a reset. donors have fled his campaign. his poll numbers have sagged. so out of all the candidates, most of them, tim scott, asa hutchinson, others, are trying to introduce themselves to voters to get more voters to know them. but for ron desantis the stakes are extremely high. >> then, of course, as i mentioned, the trump factor. rick santorum who also ran for president said the following. it's really hard to run against a martyr, all these things that these indictments bring with them are almost off limits because it looks like you're piling on. think about that, and i also want to bring in some reporting from elena treene talking about the fact that members of the trump team and surrogates, they're planning on travelling to milwaukee and working on a resolution with the network as well, the rnc, according to trump advisers, they believe they're going to get credentials after fox kicked them out of the spin room saying, if you're not going to have your candidate here, you have no reason to be inside the spin room at the debate. >> it will be really interesting to see how that ends up. fox or rnc, whoever was the decider in that initial decision has a point. if he's not going to be there, why should he be able to take advantage of the spin room after. the conversation is still going to be about trump, before the debate, during the debate, after the debate. it's going to continue. i think on the ron desantis point, the other question is which ron desantis are we going to get? >> not really. what's fascinating is that even though some of those people say things like train wreck, they still nevertheless think that he's probably the right choice headed into november, and they certainly think that he could beat joe biden. so to me that was the most surprising thing, even though not all 11 of these voters said donald trump was their first choice, not all 11 of them had all nice things to say. that nevertheless are not buying this argument that donald trump's baggage right now makes him unelectable. >> this is something that was really striking. kimberly from nevada on the question of trump's electability. all the downsides, it doesn't matter. in the position we're in right now, we need trump. it's do or die. we're right on the edge. it's not good. do you realize if biden had died in office because he's older and ailing, do you know who would be our president? kamala harris. i just realized that and i was like, oh, my god. >> this comment reflects actually something that i would hear when i was reporting on harris earlier this year, and we went around trying to assess whether she would be involved. they're saying that feeling right there is what factors into some of the criticism you hear right now, a vote for biden is a vote for harris. you're hearing that from critics of the white house and critics of the biden administration. it seems like one factor for this base here is also a little bit of, if not trump then who, and also looking at the alternative. it reminds me of some of the comments you've heard from republicans who have wanted the former president to focus more on this administration rather than talking about or attacking judicial systems or talking about the previous election here. this also reminds us that there's some subtext and maybe this is a reason why republican candidates are not talking about the indictments to trump. >> i thought you were going a different direction with the subtext. there's a lot of them. it is really interesting because you are seeing kamala harris out on the campaign trail more. we're going to see her probably even more so with a targeted message on some of the issues that she has already been talking about. we're definitely hearing a lot more of this from kimberly in nevada out of the candidates' mouths of, oh, this isn't just about joe biden, it's about kamala harris. >> this is actually the strategy, one of nikki haley's prime strategies. that's what she says on the campaign trail over and over again. she knows there are those fierce that kamala harris would be president, whether they're steeped in racism, sexism or whatever it is. >> that was sort of the subtext i was going for. >> that's a part of it, too. multiple things can be true at the same time. >> that's true. >> i would say there's also democrats who are also concerned about this. democrats you talk to privately know this could very well be an effective attack against joe biden and kamala harris even though kamala harris has actually hit a stride right now. she's had a relatively good first few months. the first couple years have soured people's opinions of her. >> i agree. i also wanted to come back to what kristen was saying about the trump comments. what struck me was how a lot of these folks who support trump seem to recognize a lot of his flaws. they're pretty clear-eyed about his flaws, his disadvantages, the baggage he carries. it doesn't change their support for him or opinion for him. back in 2016 on the campaign trail, i wish he would tweet less, but i still -- now it's, well, i wish he wasn't indicted, but still. >> republicans feel like the stakes are too high. they're willing to go with a candidate they know is not perfect because they nevertheless think that biden is weak enough that we can beat him anyways. we need someone in their view like donald trump that can really achieve the outcomes. >> fascinating. special counsel jack smith fights back against the trump team. what choice words did he have nex for them?
