breaking news out of fulton county, georgia. donald trump's attorneys are set to meet with the district attorney and negotiate his surrender on rico charges tied to his efforts to overturn the 2020 election. a short time ago, john eastman, a former president trump lawyer and a primary architect, agreed to $100,000 bond and pro-trump poll watcher agreed to a $10,000 bond. eastman, obviously, one of the biggest names of the 19 defendants not including donald trump. what is the latest that you're learning about what is happening at the courthouse behind you? >> reporter: what we're learning now at the courthouse from our own zach cohen and kaitlan collins, donald trump's lawyers are here doing negotiations for his own bond terms. donald trump being one of the 19 defendants in this criminal case. there are several different lawyers negotiating terms just like john eastman who has that $100,000 bond set. another defendant in this case who was accused of trying to access the tabulating machines in coffee county, georgia. he has a $10,000 bond. the big question of the afternoon and throughout the rest of the week is going to be exactly how is donald trump treated here compared to the other defendants in this case, and then defendants in the state of georgia in fulton county who are being accused of white collar crime or racketeering charges. does he have some sort of bail term that is set is very similar to these other defendants? is he treated the chafe as other defendants? we won't know that until we see what the agreement is that his lawyers reach with the prosecutor's office here and a judge signs off on it. once we get that, that is what we're looking for. once that document is in the system, along with the documents for these other 18 defendants alongside trump, they then all have to turn themselves in. they have to be arraigned. they have to visit the jail. and they will have to enter their pleadings of not guilty. so that arrest process, that arraignment process, that is what is teed up for the rest of the week. perhaps arraignments going into next week. we'll be watching all of that play out as donald trump and others working around him, including people who were closely affiliated with his campaign, people who were lawyers for him as they run through the criminal justice system defendants being accused of taking actions illegal in the state of georgia after the 2020 election to help the former president trump maintain power even though he lose this state and others across the nation. >> let's zero in on the john eastman agreement. take us through the details of that. >> reporter: there are a couple pieces of this that are quite important. one is that this eastman agreement is one of the 19 defendants. one of the terms is that john eastman cannot communicate with other defendants in this case. he also can't communicate with other witnesses in this case about the facts of the case. and so that means he's not going to personally be able to coordinate with other lawyers he might know and have quite a long history with, who he was working with, alongside trump after the election. he won't be able to talk to trump himself about this case. they'll have to talk through their lawyers or somehow through mediation in some informal sense if they do want to coordinate their legal defenses in some way. that's a pretty strict term. if you do violate it, you could be in violation of your bond terms meaning you might have to go back to jail. the other thing about this is that $100,000 bond, that doesn't mean you write a check for $100,000, although i guess you can. it means you are assuring that you're going to keep showing up and that you would owe that money if you don't show up for future proceedings if you were to an skonld, if you don't show up for trial, something like that. but it is still something that puts you in the court system as a criminal defendants and makes sure, it is the guarantee to the court that you as a defendant will see this through and they'll be able to try a case against you in the state of georgia. >> the first day of a big week ahead. >> we're joined by the fulton county correspondent, anna bowers has been following this case since the beginning. good to have you on. with trump's lawyers there now, based on the way other cases have been negotiated, is it likely that an agreement would come today for his surrender arrangement or might this drag on? ever i think it depends what's on the table. i think it is likely that we see an agreement on the standard conditions entered on the consent bonds in john eastman's case and scott hall as well. that includes things like not intimidating witnesses, not contacting co-defendants except through counsel. those are things are pretty standard conditions that i think will be easily resolved and agreed to. the big questions will be whether they come to an agreement about the bond amount and then also whether they come to an agreement about the terms of surrender that is due to happen by friday. while that is usually in the realm of decision making with the sheriff's office as to how to handle it, that's things like whether or not the defendant has a mug shot taken. those things usually are decided by the sheriff's office. the sheriff has said also he hears other wiss, he will treat trump and other defendants the way they would be treated like every other defendant. i think that means the district attorney does have some decision-making here about how to approach it. we will see whether or not trump will be booked and have his mug shot taken like every other defendant. >> the previous indictments trump has faced, he has not had to post bond. is it more likely based on how we know fulton county runs? by the way, the first time fulton county has seen an indicted president walk through those doors. based on the way they typically handle things like that, is it more likely than not he would have to post bond here whereas he has not in previous cases? >> certainly think that it will be likely that he will post bond. that is very common in fulton county. i think that will occur here, especially now that we've seen john eastman has a bond of $100,000. as kaitlan mentioned, that is not the actual amount you have to pay. you usually pay about 10% and the rest of it is more like an assurance that you will pay it. so i don't -- i think what we will see is that trump will have a bond that is higher than eastman's. it seems to be the case that what we're seeing here is a higher amount based on the involvement or alleged involvement in the conspiracy. so i would think that trump, out of all the defendants, might have the highest bond set. >> regardless of whether he has to, the former president, take a mug shot, give his fingerprints, those scenes we've seen so others for others go into a process like that. he will still have to walk through the doors of the fulton county jail, walk through rooms that other lower level offenders must walk through every day. can you describe what that looks like? what he will certainly have to face with questions that are still there at this moment. >> the facility where trump is likely to be booked, although nothing is set in stone is what is known in atlanta as the rice street facility. it is an infamous facility in the atlanta area. it has been the subject of numerous lawsuits for inhumane treatment and conditions of individuals who are incarcerated there. most recently, it was the subject of national headlines when it was alleged that an incarcerated person died there as a result of a bed bug infestation. so it is a place that certainly no one wants to end up and trump will have to walk through that facility and, like any other defendant, spend some time there. how long, it is unclear. he certainly will be treated like other defendants in that respect. >> a remarkable scene to imagine. thanks so much. appreciate it. >> as we are following all these breaking details, you can't deny this is a big week for the gop. bill cassidy is a republican who voted to convict trump in his second impeachment trial. he told cnn that trump should drop out of the race. here it is. >> i think the charge that seems most likely, seems almost a slam-dunk is the one related to mishandling of classified documents. if that is proven, we may have a candidate for president who has been convicted of a crime. >> joining us now is cnn special correspondent jamie gangel. we hear cassidy there. i guess the question there is, does it make a difference? does that have an impact? >> probably a lot of republicans who would also like donald trump to drop out. i think what was notable about what he said, so many other elected officials are silent, right? but the reality is, we look at the polls. donald trump is far and away the leader. that said, could that change this week? will these debates make a difference? will someone rise to the top? until we see that happen, he's still the front runner. >> does it create challenges for other candidates that trump is not showing up? or does it create opportunity or both? >> i think the challenge is, how do you differentiate yourself? how do you take on someone when they're not on the stage with you? but there are always surprises in debates. something happens. there is a moment where someone may rise to the top. i think one question will be how do they attack trump? do they say he was a coward for not showing up? do they try to take him on policy when they agree with a lot of the policies? but no one should challenge not having him there. >> trump may not like that. someone saying he's a coward for not showing up. that might be a button of his that could be pressed there. does he have anything to lose by not showing up? >> so political consultants, i think, will tell you by and large, hey, you're this far ahead. why show up with these guys who were at 1% or 2%? that said, i'm told that, so trump aides have been trying to convince him to debate for dave reason. if he is the nominee, he wants to debate joe biden. and if he doesn't show up for these debates, it hurts the argument that biden has to show up to debate him. >> that's a really interesting point. jamie gangel, as always, thank you for being with us. boris? >> reporter: well, jim, we are still waiting to see where exactly they go. they do appear to be here on the grounds of the government center around the courthouse for fulton county, georgia. we're watching very closely trump's lawyers today. today is the day that they come in and they make some sort of agreement with prosecutors from the district attorney's office about the terms that donald trump must abide by if he's going to not be in jail as he awaits trial in georgia for that indictment. i believe it is 13 counts that he faces for what he was trying to do to hold on to the presidency after the election and specifically the steps he took in georgia. he is accused of rookt every racketeering and several other conspiracy and additional offenses, making some false statements as well. what we're watching as we wait to see what the terms are that his team comes, gets together with the prosecutors, we're seeing others in his case. some of the 18 other defendants. the lawyers are arriving or departing. and we are seeing what is called a consent bond. an agreement signed off by a judge so that the arrest can go smoothly and the person can be released from jail. we just saw some of the court documents for two different defendants who have not yet entered their pleadings. one is john eastman, the very prominent attorney working for donald trump after the election. his bond is $100,000. a promise that if he doesn't show up for trial, he'll have to pay that amount. >> thanks so much. hurricane hilary has weakened. it is now a post tropical cyclone as it moves north. i it is still posing a threat across parts of the west and now another potential tropical storm is heading for the united states. a warning now being issued for south texas as a new disturbance gathers strength in the gulf. let's first get the latest on hilary from stephanie. it looks like a giant mud pool behind you in cathedral city. >> reporter: yeah. this is what hurricanes are like in florida? you would know. >> no, no. >> reporter: this was a tropical storm when i got here. not the mud. look at this mess. water is receding. we're seeing it go down. water has been running off here. look at how thick this is. this is like an inch thick. and you see a different mud on top. when you get further out, it gets much deeper and that is why there are still cars trapped out here. you can see an officer is talking to the person who has been sitting. in car for about six hours after they got stuck here. it is still a mess. we know that some of the roads in and out of all that springs are open. however, several of the major roads remain closed at this time. 911 communications are back up. the reason why is this is one way to get to the interstate here and it remains closed here as you can see. perhaps in the distance. there are some cars, some semitrucks still blocking the road but there is some construction, movement of large vehicles trying to clear the road. trying to get this mud out of the way. this is why schools were closed today and why many businesses remain closed today as well. the roads are still very much impassable in much of the coachella valley. >> a lot of work still ahead for cathedral city. briana? >> we have some breaking news having to do with donald trump. i know there is some new information about the bond that he negotiated by his lawyers has agreed to pay walong with other conditions. >> reporter: pretty strict terms. for him to be released from jail, to not have to be in jail as he awaits trial here for that indictment last week in fulton county related to the 2020 election, and the top lights are a few. $200,000 is the bond that donald trump will have to promise essentially that he will pay if he doesn't end up showing up for his proceedings and for his trial. on top of that, there are some pretty strict regulations. from what i can see so far in the court document, that would be describing what the bond is. one of the regulations is he won't be able to talk to defendants or witnesses in the case about the case and also not able to intimidate anyone. that is explicitly spelled out here. one of the provisions says it should include posts on social media or reposts of posts made about another individual on social media. so donald trump is not going to be able to intimidate any person known to him as a co-defendant or a witness in that case. just think for a second how wide a scope of people that is. that would include someone like mike pence. someone he's running against for the presidency right now who is clearly one of the people who would be and that racketeering bond that donald trump has here, it is $80,000. so that is steeper than what we have seen the bond agreement for the other co-defendants in this case so far. we've only seen a couple others, but those are some of the terms that are right now being set for donald trump and this process then will move forward for the former president to be arrested here in the state of georgia. and you will have to be processed at the jail now that we have this bond agreement that appears to be going through the system and going to be signed off from the judge if it hasn't been already. >> we'll be looking for confirmation of that. katelyn polantz following everything and has been all day for us outside of the courthouse there in atlanta. i want to bring in anna bower, fulton county correspondent for law fair. what do you think about these conditions that have been put in place? along with the $200,000 bond. but these other parameters as well. >> right. i think that the $200,000 bond, while steep, it was expected that trump being, you know, the alleged top co-conspiracy ton would be someone who would be saddled with a pretty steep bond. as far as these other conditions, some of them are pretty standard and it is standard to include things like refraining from intimidating witnesses in conditions of release, what is really remarkable here is as caitlin laid out, the specificity of what is included here in terms of what trump cannot do. so he cannot directly or indirectly intimidate witnesses through social media posts. that certainly i think is a direct reaction to the some of the inflammatory rhetoric that trump has been using on his social media posts posin terms what he has been saying about fani willis and about grand jurors. so i think that that is a direct reaction to this and it seems that it will be very difficult for trump if the past is telling, it will be very difficult for him to abide by these conditions. so we will see what happens in the future with this. >> yeah, let's talk about that because it is going to be difficult for him. and if we've seen his behavior in the past, you know, the indication is that he very well may violate some of these parameters. so then what does the judge do, what are the options? >> right. so if he violates these parameters, it could be that he would be subject to having ris rel his release revoked. he could be put into custody. i'm a bit doubtful that that will happen because of the unique situation here with trump being a presidential candidate. i think that the judge would have to weigh that consideration as well as some of the security situation. but it certainly would be the case that like any other defendant, he would be subject to having his release revoked. so that is certainly something to watch for in the future. >> knowing that, that it seems unlikely the judge might actually detain the former president, maybe, i don't know, might be more likely to pursue something like a financial penalty or some other kind of penalty, in a way it is sort of special treatment. he is not necessarily going to be treated like just any other defendant that we are seeing in this case. and if he knows that, anna, you know, isn't that something that works to his advantage where he can sort of push the boundary here? >> it is something that works to his advantage. and i think that it is unfortunate that he seems to know that. he has pushed the boundary time and time again. we have seen it with the rhetoric that he has used in his other cases that has been brought by the federal government as well as by the prosecutor in new york, alvin bragg. and so far he's gotten away with it. so i think that we are coming to a head here in terms of how far he can push the boundary. and the fact is that these other conditions of release for example in the federal cases, you know, the language there was a little bit more ambiguous in terms of influencing and intimidating witnesses. but here fani willis has taken steps to very carefully layout what would violate these conditions and trump has agreed to abide by this. so i think that in fulton county, he certainly has some additional risk to watch for if he violates these conditions. >> very good point. anna bower, great to have you on again. thank you so much for being with us. jim, over to you. evan perez is joining us. you look at this deal, bond twice as much as for instance john eastman agreed to earlier in the day, $200,000, but the other arrangements about not intimidating or attacking witnesses or even speaking to witnesses in the case, are they particular to trump? >> they appear to be. they specify to the former president because for obvious reasons, right? he is someone who does a lot of inflammatory rhetoric on social media. and certainly compared to his three other previous arrests and processing that we've gone through already, jim, youis the actually specifies that he can't be making any such threats over social media, over his social media platforms which is his preferred way of doing this type of thing. now, look, the inherent -- it was implimplied, right some whee judge here in washington just a couple weeks ago told him from the bench that you can't be making threats at people who are witnesses in this case, and she made him when he didn't speak, she repeated it and made him say, yes, i understand. and so that judge handled it that way. in this case it appears the judge overseeing this case has written it into this agreement and the former president and his lawyers have signed on to it. and so this really does emphasize that if the former president goes ahead and makes these types of things, that he tries do sometimes, he will be in trouble with the georgia state court judge and possibly federal judges in washington and perhaps elsewhere as well. >> and would the penalty be, if he sends a tweet out to say mike pence who happens to be a witness in this case, right, is the penalty just losing that bond of $200,000 or are there other potential penalties? >> potentially he could lose his freedom and he could end up obviously if it is seen so severe the judge could say you don't have the right to be free on bond anymore. but obviously there is a lot of distance between here and there. and in most cases what happens is if a judge believes that there is some kind of violation, they will bring you in and they will talk to you, give you a warning. we certainly have seen that in federal court multiple times where witnesses have gone right up to the line and judges have given them very district warnings and stern warnings telling them to make sure that they abide by the terms. >> you and i have discussed and our colleagues have discussed many remarkable legal events involving the former president in recent days and weeks and months. do we have any sense now of these surrender conditions by the end of the week, when the former president as required must show up at the fulton county jail? >> right, well, we don't -- this document doesn't specify when he has to show up, these are simply the terms under which he will show up and then will be released very quickly we presume. so what we expect is that in the next couple of days, the former president will come down with his secret service detail, with all of the, you know, the traffic stopping by the atlanta police and sheriff there to make sure that he can get in and out safely. if you talk to people around him, political people, you know, the greatest impact for him to do that would be probably thursday. which is right after the debate, right after whoever is on the stage there is going to -- would normally get all the attention and the former president could swoop right in and take all of that attention away from them. so certainly from a political standpoint, thursday makes a lot of sense. but of course he has until midday on friday to turn himself in. right now the security people are hoping that it happens sooner rather than later and they are certainly ready at any point. >> listen, we have seen the former president make decisions based on his perceived sense of impact, political impact, public impact. evan perez, thanks so much. quite remarkable events in recent hours and more to come this week. >> yeah, we've just learned that president trump is actually already pre-taped the interview with tucker carlson the former fox news anchor that is set to air the night of the debate, some counter programming. >> he may be at home watching that debate even as his interview is going to be airing. >> might be at home, might be preparing for turning up at that fulton county jail. breaking news coverage of donald trump's legal team's bond agreement in fulton county continues in just a moment. "the lead" with jake tapper starts in a few seconds. president trump's bond has just been set. "the lead" starts right now. former president trump's attorneys just negotiated bond terms with fulton county district attorney fani
