of people are under a flood threat across the west, with california feeling the brunt of mother nature's fury. we're talking about heavy rains, severe wind, even an earthquake, and cnn is on the ground. plus, we're live outside fulton county jail in georgia where any day now, donald trump or any of his 18 accused co-conspirators could surrender on criminal charges. that's coming at a critical time in the race for the white house as trump's competition gathers for the first presidential debate without the former president and frontrunner on stage. face to face with tragedy. right now, president biden is traveling to hawaii to see firsthand the devastation left behind by the wildfires there more than 800 people are still unaccounted for, while the island is facing a new threat. we are following these major developing stories and many more, all coming in right here to "cnn news central." from southern california to idaho, 16 million people are under flood watches this hour, as this powerful weather system moves through the western united states. just look at this video of flash floods that we could see this morning, water overtaking the streets in cathedral city, east of l.a. gas stations were submerged. in downtown san diego, so much water gushed into the sewer system it may have turned this manhole into a building-sized geyser. hilary is a post tropical is cyclone but this will unload heavy rainfall in so many areas not prepared for this much water. we have stephanie elam in cathedral city not far from palm springs where many people are dealing with this huge amount of mud, stephanie, left in hilary's wake. tell us what you're seeing. >> reporter: it's so much mud, now that we can get out here and see. i want you to see how far this spans out behind us because our todd anderson shot some beautiful drone video so you can see this road that i'm standing on, how far down the mud goes, and how there are trucks and cars, even a police vehicle down there, that are skewed and turned sideways because of how fast the water was moving overnight as hilary was making her way through there. we talked to jay who has been out all night helping rescue people because he has a jeep with a wench and snorkel and he could make it through and listen to what he saw. >> cars float big verner and monterrey and you had the power plant and people were trying to cross it. the sheriff couldn't get across, so i took them across so they could block the road off. people stuck everywhere. >> reporter: people out where they should not have been. they were telling people don't go out and you saw people stuck the their cars. the woman there in that little black car on the right she's been there since about 6:30 in the morning when she went past the police officers and came down this road on the wrong side of the road and see how far it got her. we're talking about four hours of being stuck in one place. she's still sitting in the car. this is why they don't want people out here. another car getting impounded because they didn't have a driver's license after going through there. you see this water coming down through here, this is what's happening now that the -- there's time for the sun to come in and melt things away as far as the mud and water. the water making its way out into the wash here. but what that is evening is even thicker cement like quick sand like mud that when you step into it, you can get your boot stuck an might fall. don't ask me how i know that. >> i have an idea of how you might know that, stephanie elam. that sight behind you, thank you so much for showing us what people in southern california are dealing with. we appreciate it. for more let's bring in cnn meteorologist jennifer grey. i know it's difficult for the land to swing from fire to drought to heavy rains. explain to us why california's landscape is particularly vulnerable to flooding now. >> right. especially those mudslides like we were seeing in stephanie's report. we have the wildfires that burned basically the entire landscape, all the vegetation with it, and so instead of having organic material for your soil and the vegetation that's going to hold it in place, now you have basically this material and the water is not going to penetrate through it. when you have all this rain it's going to just wash it away essentially. so you have this ash, this burnedp topsoil and so it slides off the hillsides and that's where we see these mudslides, these mud flows like you were seeing across california. we saw some in mexico, video out of it there, as well. so we are going to see the remnants of this post-tropical hilary continue to just meander to the north. we are still seeing moisture across central california and even into southern california at this hour. winds of 35 miles per hour. mount sanja sinto had about 11 inches of rain in san bernardino county, we had almost a foot of rain, so really impressive rainfall totals. some areas received well more than a year's worth of rain for this event. so palm dale airport about 3 inches of rain, daily rainfall records. downtown los angeles about 2.5 inches. and then palm springs area received about $4.3 inches of rain. that's nearly a full year's worth of rain in 24 hours. san diego had 1.82, top five rainiest day in 100 years and two times the summertime average rainfall there. los angeles about 2.5 inches. rainiest summer day on record in 150 years. this was definitely a historic event. flood alerts still in place and will be so for quite a while as this event continues throughout the day. jim? >> seems like every day, in fact, it is every day virtually we have a record-breaking something, rainfall, wildfire, you name. it good to have you on. >> temperatures. all of it. >> thanks. >> boris? >> now to the other major headline we're following today in georgia, where this week, donald trump's political and legal battles collide. the former president, one of 19 defendants who must surrender at the fulton county jail by noon on friday. we're learning that trump and several of his co-defendants are expected to negotiate bond terms at the d.a.'s office today. for trump, that surrender could come on thursday or friday on charges including conspiracy and racketeering tied to his efforts to overturn the 2020 election results in the peach state. take you there now with kaitlan po lantss outside the courthouse. kaitlan, bring us up to speed. what kind of activity are you seeing there today? >> reporter: boris, the culmination of what is happening this week will likely be when donald trump is arrested and turns himself in to the jail later in the week. we are already seeing a little bit of activity around here at the courthouse. a separate location where the district attorney works. that district attorney fani willis who brought the case against donald trump and 18 other defendants related to their actions after the 2020 election in the state of georgia when indicted last week, what is happening today and our team on the ground has been able to sus out is that it's likely that some of trump's lawyers and other lawyers for defendants, will be negotiating with the d.a.'s office starting today to set some bond terms, some bail terms. the terms of what happens once those people are arrested because when they are arrested they're not going to want to sit over at the jail. they're going to be wanting to have their release conditions set in advance so they can carry their papers in, go into the jail, have all of their processing done, whether that's fingerprints, mugshots, searches. we don't know how they're going to handle each of these defendants or what bond terms they're going to give them, the negotiation for how that's going to play out, that is very likely to take place starting today and we do expect some of those negotiations to begin with at least three lawyers working for donald trump who he has enlisted in the state of georgia to represent him as well as a lawyer who has essentially taken the lead on all of the criminal indictments that donald trump is facing now, and so we're waiting, we're watching for that. we haven't seen any indications yet of what those bond terms are going to be for these 19 defendants but we are waiting to see if they are going to be treated similarly to other criminal defendants in the state of georgia. >> kaitlan, what about one co-defendant of donald trump's, former white house chief of staff, mark meadows, trying to have a federal court intervene and dismiss the state charges. what's the latest on that? >> reporter: yeah. mark meadows, chief of staff to donald trump in the white house, he has already piped up in this case, the first person to try and get things moving, and what he wants to do -- we haven't seen him turn himself in for his arrest or negotiate bond terms -- he's trying to move his case into federal court and get it dismissed. that's what he has asked for. so far, the reason he says, is because everything he did after the 2020 election, he wouldn't have done if he had not been chief of staff to donald trump the president at the time, and so meadows is trying to use the constitution as his shield and get things pushed into federal court, out of state court, split off from the rest of the defendants and kicked out of the system so that he doesn't have to face charges and has pointed out already in court that if donald trump or others want to delay things, he does not want to do that. he wants to move fast and he's reminded the federal judge looking here at this case, that before a hearing next monday, they should be aware meadows was not charged with any crime in the federal case against donald trump related to january 6th nor named as a co-conspirator. he says he is absolutely innocent of any sort of violations of the law. >> we'll see if that legal strategy works for him. kaitlan po lantsz outside the courthouse. does the constitution bar donald trump from holding office again? that is what prominent legal scholars are arguing. law professor laurence tribe and retired judge j. michael ludsic say it's in the 14th amendment and write in "the atlantic" section 3 excludes from office any person who has taken an oath to support and defend our constitution and thereafter rebels against that sacred charter. they explain this on cnn's "state of the union". >> the people who wrote the 14th amendment were not fools. they realized that if those people who try to overturn the country, who try to get rid of our peaceful transitions of power, are, again, put in power, that would be the end of the nation, the end of democracy. >> all officials, federal and state, who have a responsibility to put on the ballot candidated for the presidency of the united states, for instance, they, himself or herself, are obligated under the constitution to determine whether donald trump qualifies to be put on the ballot. >> two members of the conservative federalist society echoed those points. they say that trump's january 6th speech delivered a general and specific message that the election was stolen and called on the crowd to take immediate action to block the transfer of power before falling silent for hours as the insurrection progressed. they cite lines like this from then president trump's speech. >> fight. we fight like hell, and if you don't fight like hell you're not going to have a country anymore. >> the article draws upon the amendment's creation in the wake of the civil war, noting, quote, more people died and many more were injured as a result of the january 6th, 2021 attack on the capitol than died or suffered injuries as a result of the attack on fort sumter which began the civil war. we should note advocacy groups brought up the 14th amendments when they sued marjorie taylor greene in 2022 over their vocal support for the capitol rioters. a judge has decided that neither could be disqualified. there is, though, a question, jim, of whether a 14-a lawsuit might be stronger against donald trump. >> it's interesting to see that debate carry into now nearly two weeks since flames swept through the island. crews continue to search for victims. maui's mayor says 850 people remain missing. the official death toll stands at 114, as cnn's bill weir reports emotions are raw ahead of the president's trip. >> reporter: here in maui, we've had almost now two weeks of anxious anticipation for the latest announcement on the dead and the missing, but that is now sort of shifting into grim resignation that a lot of loved ones may never be found, given the temperature of the fire. governor josh green said that many of them will never be recovered, so as we stand overlooking the town, we are seeing clouds of dust coming up from the machinery and it's heartbreaking to realize that dust holds people's children and parents and neighbors and loved ones, and how do you get a sense of closure in this particular space? this will be a sacred space for so many. 3.5 miles of an area burned. this is an emotionally charged time. so many tender emotions right now, and so the president is sort of walking into that. >> what emotions, what a sense of loss there. bill weir filing that report. for more on president biden's visit, cnn white house correspondent kayla tausche, the president faced criticism. i wonder what does he hope to accomplish while he's there? >> reporter: jim, the president will witness firsthand what hawaiians have endured and to personally pledge the full resources of the federal behd t effort to an audience both of locals on the ground as well as the nation as a whole when he delivers remarks later this evening. in response to some of the criticism, the white house has defended the president and said he's been working the phones over the last two weeks despite being on vacation and that he didn't want to visit sooner because he didn't want to disrupt the effort that was under way. president biden is someone who is personally acquainted with grief, and he is said to reprise his role as consoler in chief. in a statement the president said ahead of that visit, i know how profounder loss can impact a family and a community and i know nothing can replace the loss of life. i will do everything in my power to help maui recover and rebuild from this tragedy and throughout our efforts we are focusing on resp respecting sacred lands, cultures and traditions. biden is tapping bob fenton a fema official to lead and coordinate the federal response. fenton is someone that president has leaned on frequently to serve as the chief of the administration's covid-19 vaccine distribution in its early days. he also was the lead coordinator of the monkeypox response effort in 2022 and he will be at the helm of this for the administration going forward. just a few moments ago, fema administrator deanne criswell said fema has distributed more than $8 million to residents on the island, but she reiterated that the disaster relief fund is set to enter the red at the beginning of september unless first republican primary debate of the 2024 race, and every top presidential hopeful is going to be on the stage with, of course, a glaring exception and that is the overwhelming frontrunner. donald trump confirming on his truth social platform that he will be skipping the debate on wednesday and possibly future debates as well. sources close to him say he'll sit for an interview with tumor carlson instead. we have cnn political director david chalian with us now. you have these brand new cnn polls that show trump still has a commanding lead over the rest of the field. is this just a decision on his part, if i do this debate, is it just going to hurt me? why don't i stay in a strong position? >> that is precisely the calculation. we averaged the recent national polls together, a cnn poll of polls, a national snapshot, look at this, donald trump is 40 points ahead of his closest competitor ron desantis. 57% to 17%. followed by ramaswamy and mike pence. the others are in the low single digits too, when you look at the next slide here. 3 for nikki haley, 3 for tim scott, asa hutchinson 1%. there's an opportunity for them to try to begin the process in the first big introduction to republican primary voters, many voters have not been dialed in yet, to start building a coalition of the non-trump wing of the party. is that a big enough wing? maybe 57% doesn't suggest that, but in the early states half the party looking for an alternative. having an opportunity without him on the stage to try and be the person to emerge as the guy or gal that coalesces that support is a critical test. >> can trump win without expanding? 57% is a lot, but he needs to expand beyond that as well. when you look at republicans officials, fox news exit tivgs, they have been begging him to be a part of this. i wonder what you think the relevance of this debate is going to be without him? >> i do think it's relevant because half the party is in search for a trump alternative. that's what will be on display on the stage. they will get asked about donald trump. no doubt he's going to be a character in this debate, if you will, even though he won't be there. where there is not as much value is candidates wanting to really go at donald trump. so a chris christie or an asa hutchinson may not have as much opportunity for breakout moments because their goal was to go at hem directly. for the rest of the field they have not been wanting to take him on directly so not having him there actually lets them go forward with that strategy. i would argue looking at the numbers it's not a strategy that seems to be working that well for them. >> at what point do you think that donald trump says okay, it's time for me to maybe rejoin this debate process? >> if the polls start to narrow and people are making inroads into his support in the party he may want to show up. he's had success with debates in the past so there's no doubt that there is opportunity there, but his thinks right now, why am i going to let these people who are also -- he's so far ahead take shots at me, it doesn't seem there's a percentage in that for him. i would note, according to polls, three quarters of republicans want to see donald trump on the debate stage. they think if you qualified for the debate you should show up. if that continues, that may be pressure on trump as well throughout the season. >> that will be very interesting. and they could be taking shots at him during a critical week illeg legally for him. thank you very much. >> thank you. let's get perspective now with former illinois republican congressman adam kinzinger, a member of the january 6th select committee. thanks for sharing part of your afternoon with us. let's start with advice you might have for some of these candidates, if you're running for the white house as a republican and your name isn't donald trump, how do you win? >> well, look, i don't know how you win because i think the only guy that right now can win is donald trump, and part of that is because nobody is taking him on. look, every indictment that comes down, the republican base is looking to all these republican leaders to say, is this a big deal or not. when all of these republican leaders with a few exceptions say, no, not only is this not a big deal, this is an attack on donald trump, a violation of his rights, all that kind of stuff, of course they're going to believe that and they're going to rally around donald trump because in their mind, their leaders are telling them that this is a witch hunt against donald trump. i think the winning strategy is not necessarily for a single person on the debate stage, but if they all would actually go after donald trump, you could begin to change people's minds. they're not going to do that. what you're going to see, this is going to be funny to watch is, they will all be eager to prove how tough they are, how fierce of a debater they are and they're going to do it by debating other people on the stage and ignoring donald trump. with the exception of chris christie and asa hutchinson. it will be funny to watch it and be tough without taking on the person they need to. >> suspect it a kind of prisoner's dilemma in a sense. those that have gone after trump, like chris christie and asa hutchinson, they've been rewarded with support in the single digits. there hasn't really been a huge response from voters for those that have gone after the former president. >> well, sort of. it is a prisoner's dilemma because if you look at examples, people that have taken on the former president get shunned from the party, i'm sitting here, or they end up in single digits in the polling. if you look at the others that aren't taking on donald trump directly they're in single digit it, being shunned. same thing. the question is, are you auditioning for a role in a future trump administration in which case, my actual advice would be, drop out and endorse donald trump and try to kiss up to him even more, or are you actually running for the job of president? if you're running for the job of president you have to win. how do you win? it's not going to be by kissing unto the frontrunner. he's the frontrunner. it's going to be by taking him on, hoping some of those arguments breakthrough and ultimately we'll need some consolidation around those that are i'll call it the anti-trump candidates. >> it seems they're bolstering his argument by coming to his defense. so even if there is a huge moment after the debate, ultimately wouldn't it be overshadowed by the fact that a day or two later, donald trump is going to turn himself in in fulton county and suck up the oxygen and headlines out of the room? ultimately, are his legal battles going to be the story of the campaign season? >> oh, absolutely. absolutely going to be the story. this will be what the entire campaign not just in the primary, but in the general election, is about. he's going to use these as he does very well, but is still confusing to me why people are attracted to this, he's the biggest victory, the biggest, you know, whiner, despite having occupied the most powerful job in the world, the victim of everything, for some reason that works. again, i would argue the reason it works, is because the republican base, you get an indictment, they look to people to tell them, people they trust, to tell them is this a big deal or not. when the people they trust are saying no, not a big deal, they're going to rally around donald trump. so, yeah, it's going to be the story of the season. i think when donald trump turns himself in, that will wipe away anything talked about it at the debate. that's just the nature. i'm not sure that donald trump necessarily loves the images of him walking into the courtroom and potential mugshots but he will take over the stage for sure. >> and quickly, out of curiosity, have you spoken to any of the candidates on the debate stage about the campaign? >> i have, yeah. i've talked to a few of them. personally i like seeing what chris christie is doing. he's kind of like out of -- just telling the truth, having fun, saying what needs to be said, and i have a lot of respect for that. him, asa hutchinson, will hurd. i think if others would come forward and just tell the truth, first off, it would be liberating, it's fun to do that because you don't have to constantly worry and they may do damage to donald trump. >> former congressman adam kinzinger, thanks for the time. >> you bet. coming up next on "cnn storm hit that region in 84 years. just the latest extreme weather event to strike the planet. this month, deadly wildfires swept across hawaii killing at least 114, many hundreds still missing. in july earth recorded the hottest month ever. the string of weather-related disasters is putting a spotlight on the role that climate change is playing. daniel is a climate scientist who studies how climate change affects extreme weather events. daniel, just listen, it's difficult for folks to understand and i know that climate is not weather, however, climate certainly affects weather and we're seeing evidence of that virtually every day. can scientists like yourself doing the research connect the dots between an event like this and the changes we're seeing as a result of climate change? >> well, you're absolutely right that climate is not weather, but also weather is directly affected by climate and, therefore, by climate change. we are seeing increases in certain types of extreme weather events and a warming climate. some are more linked than others. extreme heat, of course, perhaps the most obvious link. also extreme precipitation events is the next most obvious connection, between a warming climate and extreme weather. the main impacts from this event we just saw unfold in california with this tropical storm hilary, was an extreme precipitation and flood event. >> i know from talking to our meteorologists that warming waters in the pacific help spawn a storm of this strength and send it to a place that it normally wouldn't come. does the warming planet mean that place like southern california has to brace itself for more storms like this in the future? >> that's a really interesting question that i've been getting a lot in the last few days, and the most direct answer is we don't know yet because this is not a topic that has been much received. the question is very different in california than on the eastern seaboard are hurricanes are much more common and ocean temperatures are supportive of hurricanes. we don't expect water temperatures off the coast of california will warm enough to support hurricane development, say, right off the santa monica pier, but it is possible, or at least plausible, that warming ocean temperatures will make it a little bit easier for those storms that form further south along the coast of mexico to weaken less quickly as they approach california from the south, on occasion it will still be rare, but slightly less rare, and the precipitation that might occur when we see events like this with much -- would likely be much more intense in warming climate because climate change increases all kinds of extreme precipitation events. >> one thing that i think it's hard for folks at home to understand are the massive swings. you look at a place like california, had drought, you had wildfires, and then all of a sudden the snow season was off the charts, right. you had enormous precipitation during the winter. here again, you have an area impacted by drought and now rainfall like we haven't seen in a century. can you help people understand how that swing is -- that pendulum swing as it were, is difficult for the ecosystem to handle? >> well, i think you've kind of hit the nail on the head here in terms of what we expect one of the greatest challenges to be in a warming climate in california and in some other places around the world, too. we call it increasing precipitation whiplash or increasing hydro climate whiplash. what it means we're likely to see increasingly wide swings between very wet conditions and floods on the one hand, but also, yes, very dry conditions and droughts on the other. all of this has to come down to a pretty fundamental physical principle, the water vapor holding capacity of the atmosphere, which increases exponentially in a warming climate, so that raises the ceiling not only on how intense precipitation can become, but also the ceiling on how intense evaporation can become. in other words, how thirsty the atmosphere is, how quickly it draws water out of the soil, out of vegetation, out of the landscape. so by that same fundamental mechanism, you actually can expect more intense extremes, both on the wet and dry sides of the spectrum in places like california, which really is going to be a challenge for ecosystems and water infrastructure alike. >> yeah. that answer you gave helped me understand a little bit. i think whiplash is the word, you struck on it, those swings are just remarkable. daniel, thanks so much for helping walk us straight. >> well, brianna, the governor has been practicing for this debate for weeks extensively. he has been working with one of the most experienced and respected debate coaches in the industry, which is why there are people around him who are so alarmed and confused why a super pac supporting desantis seemed to almost undermine those efforts last week by submitting some 11th hour suggestions for the governor for this debate. it included advice to, quote, hammer vivek ramaswamy in the debate as well as defend former president donald trump if he is attacked by someone like chris christie. desantis and his campaign have tried to distance themselves from this memo. take a listen to what he said over the weekend when asked about it. >> well, the memo is not mine. i haven't read it. and it's something i think we have put off to the side. but in terms of the debate, look, when you're -- i know from the military, when you're over the target that's when you're taking flak. and if you look really in the last six to nine months i've been more attacked than anybody else. biden, harris, the media, the left, other republican candidates. and there's a reason for that. because people know that i'm the biggest threat. >> as you said, brianna, desantis, put out their own debate memo from his campaign where they try to make it seem like this is a two-person race. clearly he is suggesting that he is the most viable candidate other than trump. however, when you look at the polling, it would suggest that desantis is actually much closer to the rest of the field than he is to the former president. and that might mean that there's an opportunity here for someone like tim scott or ramaswamy or whoever to have that moment and start capitalizing and seizing some of desantis's support. this is a very important moment for his campaign. i'm told by people close to him that they have eyed this on their calendar for weeks as the chance for him to really break out and start to move away from the rest of the field. we'll have to see wednesday if he's able to do that, brianna. >> and ron desantis has lost a lot of ground. so we'll certainly be watching to see what happens at
