could be today, could be tomorrow, but it is going to be before noon friday. we could see former president donald trump or one of the 18 co-defendants surrender at the fulton county jail as they face criminal charges in the georgia election probe. a muddy mess. a new look at the aftermath of the historic storm that hit california where it is going next and how much strength does it have left? >> this hour, president biden is headed to maui to see the devastation left from wildfire and still over 800 people are unaccounted for. a local official telling us last hour that she hopes that biden is going to be bringing good news in the hope of more funding when he arrives. we will see. i'm kate bolduan with sara sidner and john berman, and this is cnn "news central." this is the week when a former president will go to jail to be booked and processed on state racketeering charges. when will he show up is still pending b one thing is really clear, the former president's legal troubles and campaign are colliding. we know that donald trump will not show up on the gop debate stage in milwaukee this wednesday when his 2024 challengers do. trump has confirmed that, but will he show up in the atlanta area jail today? he and the 18 accused co-conspirators have until friday at noon to be booked on criminal charges there. and at this point, all 19 will be fingerprinted and have a mug shot taken inside of that jail. we are going to katelyn polantz at the courthouse outside atlanta. what are you finding? >> this is where the d.a. works and we have seenm so of the prosecutors on the team for this caseworking under d.a. fani willis to prosecute donald trump and these others gathering here, because think have work to do before these defendants are arrested and brought into the jail potentially fingerprinted to have their mug shots taken, and searched even, and all of that is very likely at least for donald trump to happen before the end of the week, and before that, there is a negotiation taking place, and we are waiting to see exactly how that plays out today and in the coming days, and in a negotiation that is going to allow some of the people, the defendants to have their defense lawyers to work with the d.a.'s office to make sure that the arrest and processing at the jail is going smoothly to have bail terms set before any one turns themselves in at the jail. but there is 19 defendants here, har hard to keep track of, and we have a large team here at the courthouse as well as at the jail, and we have not seen any of the defendants or the lawyers yet, but it is very likely to see a couple of steps in the process potentially as soon as today and in the coming days of this bail determination process as well as people being booked at the fulton county jail. >> and katelyn, we are looking at the plethora of people who are charged in the case. who else among those who have been charged are important to watch? what movements are being made by some of these defendants? >> well, sara, some of the people are the most recognizable lawyers in america. rudy giuliani is one of the other defendants in this case. and he, too, is going to have to show up and be arrest and have the bail term set just like donald trump. other very infamous lawyers who worked with donald trump after the election ken tisbro, and sidney powell, and john eastman and additional lawyers and also, another attorney who said he wants his case moved from state court to federal court, and he wants the charges dismiss and making the argument to attack the case in court aggressively and whether or not donald trump is going with him, he is saying that he is worksrking at the bet of the president. >> mark meadows is working to jump out in front to get his case dismissed. thank you, katelyn polantz. she is there in atlanta for us. and now, sticking and the point of the moves being made by mark med dose and the legal team, and taking nit pieces, because it is fascinating, and part of the filing they brite this -- stripped of the state's gloss, the underlying facts detail the underlying duties of the chief of state and contacting the state officials on the president's behalf, visiting a government building or setting up a phone call for the president with a state official and only by the virtue of the state of chief of staff rule was he charge and put another way, it is but for the cause of his alleged involvement because of his position. what do you think of that? strong point? >> well, on the surface, it is a strong point, but it is falling apart on inspection. but for the fact that i was working for a drug kingpin, i would not have been selling drugs on the street. so it is to a point excusable, but to the point, prosecutors are saying that they crossed line for normal and legal and part of the process, and plotting to do things like sending in fake slates of electors to the national archives of congress, and that is not part of the normal part, and so the judge is going to have to look at the they crossed line and was that part of his job, and which of course it was not, and ultimately after getting through all of that, the motions will be denied. >> another part of, this meadow's attorney note in the filing that he is not accused of violating any federal law in the special counsel's federal indictment against trump nor alluded to as a coco-conspcoco-conskco-conspira and does that carry any weight to dropping the charges? >> well, it does in the contestation of the federal law here, and not really the federal law as part of the statue, but part of the federal duties, and did you act outside of the bounds of the federal law. so it does carry some weight, but it is, again, it is going to be an issue about how far they went and whether it was too far. it is an interesting point that he wasn't named in the federal indictment, and that is going to tell us 100% if we were still skeptical before that he is not cooperating with any authorities, including federal authorities at this point, but it is not going to get him so far that the federal authorities made a strategic decision to charge donald trump and not to expand beyond that in the interest of time, and so it is not going to carry any weight that is put into indictment. >> that is interesting, and does this request coming from the state's attorney that he is making into the filing, does it in any way do anything to implicate that med dose believes trump acted illegally here? does it confirm or acknowledge that they believe that illegal activity took place? >> no, it doesn't. i mean, what he is saying is that he didn't do anything illegal. if anything, it is suggesting that he is saying that nothing that was happening was illegal. but what it is really telling us more than anything else is that meadows is out for himself, and making a greeing aggressive mov wants to get out ahead of this and capable attorney, and if everybody else behaves this way, that is when you will see the cooperators coming in and the case getting stronger. >> jennifer, you are noting how quickly this move is coming from mark meameadows, and what does t suggest for you? >> well, they have to do the removal motion within 30 days, so it is not such a surprise, but the day after is still very fast, but what it is telling me is that they are not waiting for donald trump, and oftentimes the defendants lower down in indictment will take the strategy from the lead defendant and his team. in this case, that not what is happening, mark meadows is moving quickly and to move to dismiss at this stage before the removal has been decided is showing again that he is very anxious to get out in front of this, and he wants to be the lead on his own case, and he is not following donald trump or anyone else, and he wants to be in front of this asap. >> thank you, jennifer rodgers. john? >> we know at this point that donald trump is going to jail. he is. he is going to the jail in fulton county, but he is not going to the first republican presidential debate. he announced he not going to attend the milwaukee event wednesday night. and kristen holmes is going to join us now with that announcement. kristen? >> we had antic tis pate -- anticipated this, and he had been looking to the polls and rallying cries from the supporters, and now i have gotten off of the phone with several trump advisers who say that it did really play a big part of the decision of not participating in the debate and looking at the commanding lead. even if there is a breakout star, an one of the candidates comes forward and does a good job, and has a viral moment as usual in the debates that they don't believe it can actually make up for that gap in the polling. the other thing they pointed to was whether or not donald trump being there or not would make him the punching bag. they expect that trump is going to be taking up a lot of oxygen in the room even if he is not on the stage, but they believe it is better for the former president not to be there as the attacks are happening. also, hoping, these advisers that some of it is going to shift to ron desantis who is a second-place there behind donald trump even if it by a large margin. something that we want to be watching closely. part of this is going to be really how these other candidates differentiate themselves from donald trump. how do they get away from the shadow of the former president who has sucked up most of the oxygen in the race, and whether it is politically with his base or because of all of the legal issues. it is unclear how is it going the look, and some of the candidates have made a lot of the candidacy, if you are looking at chris christie of hitting donald trump, so where does he pivot to when the debate happens, and that is what we are all waiting to see how this plays out. >> any idea of what he is going to be doing the debate of the night itself, and live tweeting or live xing? is he is going to be live xing in the debate, kristen? >> right now, nothing on the calendar, but i don't know about xing, and we will be seeing the truth social posts, and we have reported that trump expects to air an interview with former fox news host tucker carlson on wednesday, and unclear when it is taped, and not taped wednesday and whether or not that has happened, and we are looking into that as to getting the feel of exactly what he is going to be saying as the debate is happening. >> the guy loving to watch tv, so you can imagine he is going to be watching. >> yes. >> and xing, is that what we call it? even a term policy! find out if you're sitting on a goldmine. call coventry direct today at the number on your screen, or visit coventrydirect.com. we have learned that firefighters are going door-to-door in one southern california community as many are assessing damage left behind by the major storm that blew through. this is the muddy mess that you can see that the people are waking up to in cathedral city which is 100 miles east of los angeles. i spoke with the city fire chief who said earlier that the rain may have passed, but now they have a whole lot of work to do. >> there's a lot of destruction, right, and mother nature clearly put her mark on us over the last 48 hours. that is what you are seeing with that mud and a combination of mud an sand that makes it really hard to get through. the water for the most part, it has dissipated, but what we are really dealing with is the excess mud that is a lot like quicksand. it is really heavy and takes a lot of effort. >> that is in cathedral city. in palm spring, take a look at this. they got a full year's worth of rain in 24 hours, and far from the only broken record. los angeles recorded the ra rainiest day in years. and kyung lah is in san diego joining us now. and kyung, that is a mess there. >> yes, this is, kate. on this street, at least, this road did floodover overnight. and there were people rescued because they were driving around the barriers, and what they were doing today in san diego is trying to mop up a little bit, and this, the city says, it is really not that bad considering how historic in nature this storm was, because it is unheard of to have this type of weather. as you were talking about some of the statistics, in san diego, this was the first time that, this is the most rain they got in 170 years, and the first time in los angeles that there were any measurable rain on august 20th. it was in cathedral city and in palm springs, and in the entire area to the north and west of us that saw the heaviest impacts, and flooding in the streets and rescues of the people in the cars. it did get the most amount of rain in 24 hours, and the rainiest day ever recorded in the summer. kate, as far as any power outages, there are spotty outages a few hundred people here and there, and but overall, it is a lot of cleanup here in the san diego area. >> and getting an assessments of what everyone is dealing with this morning. thank you, kyung lah. and now, in palm springs, california, the city coordinator is joining us and i know it is a busy time for you, and overnight, the 911 system was not function, and can you tell us if it has been sorted out, and if not, what people should do if they have an emergency. >> yeah, sara. so it was not just the palm springs 911 system that went down. it was really coachella valley-wide outage, and frontier is working on it. overnight, we had staff that was able to get it functional, and so if anybody in the area does call 911, it is going to be routed to dispatchers through the nonemergency number, and temporary fix while we sort out the actual solution with frontier. >> okay. so now, if you are calling 911, it is going to go somewhere, and not in the normal place, but it is going through the dispapers to get service, and it is going through the nonemergency first. thank you for that, and a lot of people need to understand that we are looking at the pictures of palm springs right now where there is gushing water and mud just coming at people. what can you tell us that you are seeing as far as the damage this morning as you are seeing thebr daybreak, and the surroundings. >> well, the damage assessments have recently started and we have waited for daylight to see the water to make sure that the crews were safe out there on the road. you have seen the damage that we have water flowing over the top of roads, mud and debris in a lot of places. so, road clearing is already beginning, and we have shutdown more roads in palm springs than we ever have before, and we have started to open them. we had a lot of help from caltrans out here early, and our own street crews, and big concerns though is that we have major section of i-10 that is closed. >> whenever there is a major freeway closed in anywhere in california, it causes huge backups, so a portion of i-10 is closed and people should know that. and are you telling people, look, stay home for right now, and there are roads closed and issues that we are trying to sort out or are people starting to go out and about? >> we are absolutely telling people that if they don't have to be out, stay in their homes. one, the roads we are still assessing damage in the places where there is still water and mud over the roads, and we don't know how safe those are, and the second part of that is that with all of the road closures, people are going to be sitting in traffic, and so really just encouraging people if they don't have to be out to stay in their houses, and we are working as quickly and safely as we can to get everything back up and running. >> we wanted people to look at the images offorest falls, california, and you don't just get the mud, but the rain and mudslides, and that is incredibly powerful and dangerous. so don't go out if you don't have to and that is going to help the first responders, too. and i have to ask you, if you felt the earthquake that took place in san bernardino county? >> i personally did not feel it, and many of us were busy running around, and we did not feel it, and nobody that i have talked to actually felt the tremor. >> all right. a lot of people going what is going on in california, and all of the things are happening all at once, and good luck to you, and thank you for letting us know of the people in coachella valley knowing that the 911 systems are operating and you can actually call and get through to the dispatch. appreciate your time. john? possible that there are 850 deceased people still uniden unidentified? >> i don't want to speculate, but there is a process that we are going through with fema-led cadaver dogs through lahaina town, and there is a process then through identifying the dna sample of the identity of the deceased, but we are not done with the process yet, and we are hoping that many of the missing have simply not checked in and lack telecommunication, but we just don't know, and it is just, you know, it is not responsible to speculate, and all of us every day as the reports are coming down, we are waiting nervously for the next number, but we just don't know how high the death toll will go. >> what is it that you are hoping that president biden sees today? when he tours the island? >> the depth of the tragedy is easy to see when you see lahaina town, and it was a whaling town, a seat of the kingdom of hawaii and to see it just absolutely flattened. i think that there are no words to describe the devastation. it is really looking like a war zone. i want the president to understand that although we are very, very appreciative of fema's support and the full mobilization of the full federal government and we have got it, this is not a short-term thing. this is not a two to three-week emergency. restoring lahaina and getting the connectivity back, and kids back to school, and removing the debris and roads back and what the community wants back, it is a multi-year and multi-billion dollar process, and we want the government with us. >> and you have talked about the fema and the boots on the ground, but you heard from some of the people that we have heard from that have expressed ne more mouse frustration over the last few weeks that have said that supplies are not reaching them, and people are not hearing their calls for assistance, and what do you say to that? >> well, i think that within six hours, the president signed the major disaster declaration, and that unlocked all of fema's resources. we also have more than 500 of the national guard mobilized under a joint command with indoe paycon, but there is a lot of frustration in order to enlist. in fema, you have to present an i.d., and a lot of people don't have the i.d., because it went up in flames. so on the ground, there has been frustration in terms of the accessing all of the programs that exist, and then for a couple of days, because of lahaina town is a toxic rubble, we had difficulty securing the perimeter of the lahaina town, and people understandably wanted to get back to the properties and check it out, but it is not safe, so they cut off all of the vehicular access to all of maui which is really what exasperated the frustration, and people who did not experience the wildfires directly, and home were in tact, they were cut off from everything back in central maui, and that has been resolved, so we are on a good rhythm of allowing community to resupply itself, and start the long, long process of both grieving and trying to restore some sense of normalcy. >> senator, what do you think that the most important specifi to make sure that a tragedy of this level does not happen again? >> well, we all have to understand that severe weather events are going to be getting more frequent and more severe. hawaii is a place that is experiencing volcanic eruptions, tsunamis and hurricanes and tropical storms, and we've had a few wildfires, but nothing that threatened a whole city. nothing that flattened a whole city. so this is the new normal for not just the state of hawaii, but for the whole planet and the whole country, so as we are contending with increasing severe weather, all of the time, we are not only going to need to take action on climate, but we need to be actually prepared in terms of the emergency response at the state, local, federal level for the kind of disaster that maybe you had not contemplated before. >> senator brian schatz, thank you for speaking with us this morning, and we look forward to speaking to you again soon. >> thank you. >> kate? >> well, the challenge for the people on the debate stage is the challenge that we have been talking about since the beginning, and that is the fragmentation of the non-trump portion of the electorate. looking at the iowa survey you mentioned, and you have some 60% of the republicans not with trump right now, but if you divide it up among the other people, it is hard to beat someone who has over 40% of the vote which trump does have, and the people on the stage want to supplant ron desantis as the principle choice, and the fives are going to be out for desantis, and for him, he needs a minute to reassert his dominance, and he has been at the top of the heap, but there is blood in the water, and he has faced a barrage of $20 million attack ads, and the iowa shows that the favorables are high, and he needs a narrative reset that he and not someone else is the best way to take out donald trump if that is your inclination. >> and also the cbs news poll of the likely republican primary voters said that the majorities of them are likely to support donald trump, but the majorities are saying that think are not even considering 8 of 11 trump rivals tested in the poll. i keep thinking, what can you do to change this? >> yeah, first of all, you have to carve out -- >> and what is really good -- >> hold on, scott. go ahead, jamal. >> okay. first of all, you have to carve out, and that is okay, scott. we will have enough time to get back to you. and first of all, you have to carve out a different lane here, and you can't run for president taking swipes at vivek and so trump is the on the menu, and talking about whether or not it worked and if he made the right call, and trump and maga-ism is what is on the ballot here. and there are some who say they won't definitely vote for donald trump, and 11% say they won't vote for him, and this is 64%. so if you is that number of people who vote against the republican candidate, that is a colossal failure for mayors and senators up and down the ticket. >> but jamal, that is what is on the ballot and the menu to take on in the debate stage, scott, but in trump's absence, the top target as you said is ron desantis, and his campaign put out a new debate memo or revealed, and this what he, ron desantis's campaign says about the rivals. the first debate is the biggest chance yet to grab the headlines by attacking governor, so we know they will try their best, and in contrast, governor desantis' objective is to lay out the way to beat joe biden and revive the american dream, and that memo is in stark contrast to the conversations that we have had, scott, you and i, that he needs to go after vivek ramaswamy, and is this cleanup on aisle 11? >> well, it is if you are trump, never trump, democrats or media. and everyone is piling on ron desantis, and he has faced $20 million in attack ads, and this is the first chance for him to talk about what he wants to do and why he is running in his own words and as much as he is attacking anybody else on the debate stage, that is what i would advice him, and he is getting advise from the outside h helpers, but one of the problems for him is that he is defined by everyone else, and this is a chance to define yourself which means to talk about why you are running and do it yourself. that is the best course of action. >> jamal, you are talk about trumpism and magaism is on the ba ballot, but what is the impact if trump ends up skipping all of the debates and the impact? >> reporter: it's still sinking in the mud over here, sidner, i can't lie, it's still very gross. look at this, i'm at a pretty big intersection, this would be normally a busy intersection here, you see that there's basically a little pond here and you see that that road looks like it's not a road, looks like complete mud. what we have been seeing are that people are out here thinking that it would be fun to drive through this and we did see a truck, it started to get lower, we saw a truck come through here and made it through and they were all excited except for they got down there where the police officers are and now they're sitting on the curb. so this is the reason why they don't want people out here, don't want people thinking this is fun and getting stuck because it takes resources away from people who really need it. there are a lot of people who need it. look back this way, all i have to do is turn around and i can show you there are more cars that are stuck, they're clearing out some of the road down there, but there is a police car stuck down there. i talked to one man, he has been out all night helping people get their cars out or at least save themselves, take a listen to what he told me. >> cars floating, especially up by varner and monterey and there were cars, that road is almost washed out, you have the power plant and people are trying to cross it, the sheriff couldn't get across it, i took them across so they can block the road off. there's people stuck everywhere. >> reporter: he's got a jeep with a winch and a snorkel so that he can go through that, but he was not willing to drive down this road. he said i know that will stop my car. he wasn't going to go down here. he was helping out police officers overnight. resources are thin and and they want people to stay off the road. there is a lot of work and cleaning up that needs to happen here. >> stephanie elam, john berman has something he would like to say to you. >> i'm curious, you're standing in the mud, what's the consistency of it, what does it feel like in your hands?
