roads leaving no way in or out across much of southern california. hilary is the first tropical storm in more than 25 years to move through the state breaking all kinds of records. los angeles recorded the rainy summer day in at least 150 years. palm springs got a full year's worth of rain in 24 hours. the 911 system is still down. there were mudslides in the san bernardino mountains and look at that. now the storm that did this, it is moving north. cnn's stephanie elam is joining us from cathedral city, which is west of palm spring, and what a muddy and icky mess behind you. >> i have a nice pun behind me, john. a meeting of the muds. it is believe it or not a major road going in and out of the palm springs area here. this is what is going on and they are starting to clean it up now that the sun has come out, but look, there are two cars stuck since we have been here in darkness. now you can see how high the mud sup on the wheels, and then over to the right, there is a little volkswagen and some respectful and thoughtful individual just went flying through the mud on the wrong side of the road to get on to this side and completely splashed our photo journalist mike love and covered him in mud, but that is as far as she got. but that is why the schools are closed, because people cannot get in and around palm spring, because out in distance there, and i walked up there, that is towards interstate 10, there are mac trucks and cars twisted off to the side up the road there, and it is come meetly blocked right now with the vehicles, mud, running water that is still finding its way off of the road and down off into the wash. all of the washes are full. when you looking at this now that the sun has come up, it is almost unbelievable how much of a mess is out here. when you put your foot into some of the mud, they came through and plowed here, so it is not as sticky, but, you know, a couple of times i thought that i would lose my boot, because it is so sticky, and that what is trapping the cars out here, and think about it, they were doing this in the darkness. you can see it up there what mess it has been left behind. i sent in the video to show you how bad it is out here, and it is unbelievable now that the sun sup here is up here, john. >> it is gross. and now, looking at the snowplows, but i have not seen mud plows there before, and it is mud plowing, steph. >> also, mud plowing in august. just think about that. this is the rainest day they have erhad in one day in palm springs for 100 years' records. it is odd to have that much rain in southern california, let alone in august. >> all right. stephanie elam, keep the boots on, and my suggestion is duct tape if you need it. it works wonders for reporting. >> you would know. >> and now the latest from cathedral city. and the fire chief michael con contraryes is joining us, and what are your crews seeing out there besides that muddy mess? >> yes, we are right in the middle of that right now, and in all areas of the muddy area, and the intersection right there that had a combination of what we call the debris flow. so a large amount of the mud and sand moving into that area which is what trapped the cars there. we were able to extricate and rescue seven people there. now, we are going to go house-to-house and making sure that the people who want to get out can get out. we have called in a dozer, or bulldozer, and they are going to go to clear the neighborhoods so that the people can get out. right now, they are trapped for all intents and purposes. >> talk to me about that, because the mayor of palm springs, which is nearish by said that they don't even have access in and out of palm springs, and it is completely blocked right now. what -- how would you describe the situation as, as the storm itself has moved past, what is left behind that you are seeing in cathedral city? >> yeah, there's a lot of destruction, right. mother nature clearly put her mark on us over the last 48 hours. that is what you are seeing with the combination of mud and sand and it is making it hard to get through, and the water for the most part has dissipated and it is drained off and moved out into the drains, but what we are really dealing with is the excess mud that is a lot like qu quicksand. it is heavy and takes a lot of effort. so if you are elderly or a young person, it is really hard to get through that. that is the main focus right now is to clear the roads, and right now, we have the i-10 freeway which is the main thoroughfare through palm springs and cathedral city. the off ramps are on both theirs and ours are limited because of the mud. so it is really about clearing the roads and getting the access and then assisting caltrans with getting the i-10 open in both directions. >> absolutely. and chief, we had seen reports that the 911 phone lines were down in your city. is that still the case? what is happening? >> no, you know, what happened there is that there was no 911 calls missed. there was with the carrier, and they had an issue with flooding, but we prepare for this all of the times both fire and police, and we were able to transition, and we sent that out, and we moved the lines over to what we call the business lines. it is a different number, but it is still coming through the 911 system. again, we were prepared for it. we do routinely do that. >> that is good to hear. you mentioned that folks are essentially trapped because of this mud-sand-mixture mess that is left behind. what the best advice for people now, and you have crews out that people need rescued today, but what is the best advice for folks? >> if they don't need anything, and let me back up. it is the same thing that we told the people coming into the storm, right. if you don't need to be on the road, don't leave your house, and get the supplies that you need and stay warm and in your house. that is kind of the same thing now. if you don't need to get out, give us some time, and we will get the tractors and the manpower, and we will clear the streets. that way, it is a lot more organized fashion. what our biggest concern is that the people are still out there from all of our city departments to public works, the facilities and the building department who may have to red tag some build, and when we are out there doing our job, and people are in a hurry, it puts us at risk. so, you know, if you k stay home, and give us a little time, and we will go from there. >> chief, thank you so much for jumping on this morning. we appreciate your time. sara? >> this morning, this road to the jail in georgia is watched closely. and well, that is not the road, but it is where donald trump and the co-conspirators will have to pass on this road to get to the courthouse. all of the defendants have by the way until noon friday to voluntarily turn themselves into the fulton county jail. we have a bit of timing on donald trump. we are told that he is expected to show up thursday or friday and a fingerprints and mug shot is expected. what should we be expecting today? are we hearing anything else about the timing? >> well, there is work to be done before donald trump turns himself over to be arrested at the jail here in fulton county, georgia, and the work to be done is likely to be occurring over here at the courthouse in fulton county, and we have seen one prosecutor working on the case with the district attorney fani willis, and he was assembling inside of the office today with some other prosecutors and so we are waiting to see if there are lawyers showing up today that represent the defendants in the case, and specifically donald trump's lawyers to try to negotiate some terms of release so that the arrest process can go smoothly. we expect it, because it is very likely that many of the people or at least some of them are high profile people in the indictment that the georgia state prosecutors have brought against donald trump and 18 others that those people are going to want to be making sure that the arrest goes very smoothly, because they have to go inside of the jail, and one that has not had a history of having the greatest conditions inside even for a jail which a tough place to be no matter what. here is retired lieutenant charles bamrambo from the fulto county jail service, and this is how this circumstance may be different from any other defendant who may be going in. >> just from my own experiences in dealing with dignitaries and high profile persons who come into the jail, it is best to just get those persons booked in as rapidly as possible and get them released, because you don't want the jail to become more of an international theater than it has become here recently. >> so that attention that the jail has garnered is because the justice department has been looking into the conditions at that jail that it may have some structural unsoundness, that there is filth and insects, and also reports of violence inside. and so, when all of these defendants including donald trump with his secret service detail go into the jail, none of them are going to want to spend that much time there, so they want to get the terms set so that the arrest can go as smoothly as possible, but there could be lines. there are 19 of them, and already 30 people who are not related to this case who have been booked into the jail this morning so far. so, we are waiting to see how the week is going to play out, and what the timing is going to be still. >> and this could be the first case of where there is a mug shot of the former president. so we will wait to see how this is going to go down, and the sheriff says he is going to be treated like everyone else, and we will watch and wait to see who the first people are who turn themselves in, and they can do it between now and noon friday. thank you, katelyn polantz. and now, one of the co-defendants mark meadows has filed a motion to have his case outright dismissed an first of all moved from state to federal court and a separate motion to have it dismissed and the theory of the case is because he was working as a federal employee when he did the actions that he is accused with that he says that he cannot be charged under state law for actions as a federal employee. how much water does that argument hold? you may have to hold up signs is, michael. we can't hear your voice. >> how about that? >> great. you don't have to use soft buckets. so, tell me about the case of mark meadows. >> well, you know, i was saying that i think that the motions go hand in hand with each other, and they are not, and nobody is surprised that they were filed, and the motion to dismiss follows motion of transferring case, and basically both of the motions deal with whether or not he was a federal employee doing his federal job, and the motions that to dismiss that he recently filed is based on the supremacy of the constitutional clause that basically says that the state cannot prosecute a federal employee for doing their job that is outlined by federal law, and he is arguing that because i was the chief of staff for the president of the united states, there were things that i was tasked to do, like make call, set appointments, and do those types of administrative and admin stistrative acts that the court will weigh out if that is the case, and he is probably not going to see the indictment dismissed at this case, but it is an added nudge to the judge to move it on to allow the motion to transfer, because that burden of proof, that argument is simply, did he have a plausible claim that he was operating as a federal employee, and there is not anybody who cannot say that he was not operating at the chief of staff at direction of trump. so that motion has a better chance of surviving at the point, but the motion the dismiss may rear its head further into the litigation. >> but it is get into the federal split of federal employee and/or work for the political candidate, and there are laws that says hatch act what you can do as a federal employee and working on behalf of politics. so what mark meadows did as a white house chief of staff and federal government employee or what he did to make the calls as a political operative, and would the court want to make that key distinction this early in the case? because he says that voters know who he is and what he has done, and now the question remains if the other candidates will be able to capitalize on his absence, and you can maybe geta little juice from them. and now, looking at all of the candidates that are going to be, well, not all of them are going to be on the debate stage, because some of them have not qualified, but a few of them have qualified, and the most recent asa hutchinson. and now, looking at the thoughts on the poll that has come out. it is from iowa. we just had the big state fair and everyone came and tried to argue their case to the iowa voters. taking a look at the poll, donald trump is far and away, and double digits away from every single other candidate there. it seems clear that the indictments just keep fueling people's support for donald trump. why do you think that is? >> i think that the american people, and especially the republican primary voters have indictment fatigue. i think that the first indictment coming down which was the case in new york with alvin bragg was the least strong of the case, and seemed to be a little bit politically motivated, and then when the other indictments dropped, people just assumed that they were politically motivated, even though they are not, and looking at the facts of the cases, and specifically the documents case is one of the ones that is the most strong, and it is cut and dry that donald trump broke the law. he is obviously going to have his day in court, but it is hard to get past it when you hear him on the audio tape showing off a classified document to people when he knew it was not classified, but at the end of the day, it does not make a difference to republican primary voters, and he is dominant in the polls as reported in the iowa poll. >> i wanted to talk about what we heard on "state of the union" when republican bill cassidy said that in his opinion, donald trump should get out of the race, period. >> i think that the charge that is seeming most likely and almost a slam dunk is the one related to the mishandling of the classified documents. if that is proven, then maybe a candidate for president who has been convicted of a crime. >> all right. so you can hear him saying that this candidate, and maybe a real problem to be convicted of a crime, and still the american people will have to decide if they want him in office, and will the conviction have the same effect, if that is what happens as the indictments have on those in base of the republican party? >> i don't know. i think that a conviction is different than an indictment. i think that obviously, nobody wants to have a president who has been convicted of a crime such as the one outlined in the classified documents case. looking at the facts of this case. it was 100% self-inflicted on donald trump's part. obviously, him and his team is going to say it is a weaponization of the doj, but at the end of the day, if he had given the documents back, he would not find himself in this predicament, and so i agree with senator cassidy, in a perfect world, i would love for donald trump to drop out, and we have a stacked bench of candidates to roundly defeat joe biden, but the problem is that it doesn't appear that is going to happen. there is too much at stake if we nominate joe biden who has been a close race before. >> who do you think is going to come out ahead? >> i don't know. donald trump not appearing in the debate, and he is a draw for viewership, and so we will see how many americans tune n and i still believe millions of americans, but it is going to be tough for other candidates to make the case for why they should support them over donald trump when he is not there. i wish he would show up, but it appears he is too scared to defend his own record against his opponents. >> thank you. john? >> well, i will be telling him that we are grateful for him and his proclamation. because of him, we have had over 1,000 federal personnel on the ground, and 10, 12 agencies represented here on maui. i think that, and i hope that he is going to give us even more good news. we are looking forward to hopefully we will continue to have this very good relationship with the federal government. >> what would good news be coming from him? >> additional fund ps. this going to be the costliest recovery of maui county, and of the this tragedy not only destroyed a whole town and community, but it destroyed part of our spirit. so, to rebuild that. it is going to affect our economy in the meantime, because jobs are lost, businesses are destroyed, and it is just a long and winding road ahead of us. >> absolutely, you said it. >>. >> we spoke with many residents and jemsz who is from lahaina and she lost her home and business, and she says that she feels let down by the government's response so far. listen to this. this is what she said. >> i think that everyone is a little bit letdown at the lack of response of the government our wal-marts and targets are empty because the people here have gone to buy sup supplies for us, and if it were not for the fema stations that were not set up, and if not for the ven mow that we have set up personally, we would not have vet ven mow -- have venmo set up. >> what do you say to her? >> well, she needs to go to maui county assistance center. luckily, we have been able to set up assistance as you have heard, and the thousands of people in the emergency shelters are no longer there, and i think that there are nine people left as of today. thousands have been moved to transitional quarters like the hotels who are taking very good care of the people, as well as individual homes, and short term rentals. so, i am sure, as you talking to various people, you will hear stories of disappointment, of course, because they have lost a lot. you know, you can't blame them for being disappointed, but there are many success stories as well. >> and we are nowhere near through it, because you 850 people still unaccounted for in the difficult arduous task continuing in middle of it. the president is going to be there today, and we will be following that when he does arrive. thank you for coming in. sara? >> well, looking at the race a few weeks ago is mirroring what we are seeing here which is that donald trump is the formidable frontrunner. and 42% in the latest poll, and ron desantis is back at 19%, and donald trump has more than double ron desantis' support, and tim scott at 9%, and nikki haley and vivek ramaswamy is at also 6% with mike pence. so looking inside of the number, it is 2/3 of the trump supporters at this stage of the game saying that they are locked in. they are not even going to move from trump or consider someone else. we see 2/3 of the likely caucus going electorate in the republican caucuses in iowa saying they don't believe that donald trump committed any serious crimes despite what we have seen in the four indictments. so we have seen donald trump at this point successfully take his legal woes, make himself sort of a victim here that has caused a rallying effect among republican primary voters. >> in fact, in the iowa poll, his numbers improved while they were conducting poll after the georgia indictments were handed up. david, what then are the stakes? for those who will be attending debate on wednesday night? >> well, wednesday night's debate is the first real opportunity for candidates not named donald trump to really introduce themselves to the republican primary voters across the country. we have some national polls as well that we are throw those up on the screen, and donald trump's lead is larger there, and if you are looking at the average of the cnn poll of polls over the national polls, he has 40-point lead over ron desantis, and 57% to 17%, and what do the candidate, what they need to doo seize the moment to build a coalition and coalescing of the piece of the republican electorate, john, that is not for trump and start building support one person that is going to need to it over the next several months if they have a real shot at taking on donald trump. >> big picture, david. thematically here, what is your opinion of whether we look at the polls whether we should consider donald trump an incumbent, and he is not the incou incumbent, and the current president of the united states, and whoa, if an incumbent is not above 50%, and they are not doing that well, but nationally, trump is over 50%, but in iowa, he is 42%. so what do you think that the right barometer is for a guy like trump? >> well, the 50% threshold is a good barometer for a one-on-one race or general threshold con context, but in a crowded field for the republicans, but as the delegate rules are set up, 42% would be quite sufficient for him. >> thank you, david chalian. sara? >> meanwhile, trump is targeting a new ad to slam president biden and the economy. it is the second trump/biden comparison ad they have put out in the last couple of week, and now, we are following this, and i'm no political director like david chalian, but why should donald trump bother when he is clear and away the republican favorite at this point?
