That trump is expected to surrender on thursday or friday. He and 18 codefendants are charged with plotting to subvert the 2020 Election Results in georgia. Local officials have said they will treat the former president like any other defendant. Sources tell cnn that trumps team has been in contact with the District Attorneys Office about the conditions and logistics for his surrender. Cnns ryan young has our report. Reporter we continue to try and get a sense of whats next as we continue to watch developments. Thats after trump and 18 others were indicted on monday. From a security standpoint, we know theres been heightened watch and security outside the courthouse and the jail. In fact, you can no longer just drive up to the jail where the former president is expected to turn himself in. Two deputies sit at the end of the driveway, limiting access. Weve also learned the Secret Service has visited the Fulton County jail to work with Sheriffs Department officials to get an valuation of the current Security Situation and determine what needs to be done to protect the former president. Jail insiders believe the process for donald trump will clearly be shorter than what a normal person would go through in the process. As of right now, checking the jail website, none of the names of the people indicted have been included. Obviously next week will be very busy. Theres a belief from some Law Enforcement officials that the end of the week is when we could see former President Trump show up at the jail to be booked in. Ryan young, thank you so much. Joining me to talk more about trumps surrender and indictment is brian kelley, a former federal prosecutor who tried james whitey bulger. Lets talk first about this news that trump is expected to surrender thursday or friday in Fulton County. The sheriff says he will be treated like any other defendant. Hes the foreman pmer president to Secret Service detail. How do you think his booking will set a tone for the trial . Well, thanks for having me. I dont think his booking will have any affect on the trial. The jury who decides this is not going to be shown or exposed to anything from the booking process. If we can reflect on what youve been accustomed to while prosecuting the case against mo mobster whitey bulger, you said he was trying to manipulate the system so he was never brought to trial for his role in the 19 murders and he was trying to slow down the trial. Do you see there might be any similarities in this trump case or the approach his attorneys might have while facing these charges . I think in every case its to the defendants advantage to slow things down, because typically the evidence does not get better for the prosecution as time goes by. Sometimes witnesses memories lapse or sometimes witnesses are no longer interested in participating and have to be forced to participate. The more time the defense has, the more time they can find the weaknesses in the state or federal governments case. I think in any criminal case, the defense is probably going to be playing for a little bit more time than the government wants. At the time, bulgers attorney said the volume of evidence from prosecutors was so enormous and they needed more time to go through it. Well, that sounds very familiar. Is theis a common defense that gets any serious consideration from the judge . I think most fairminded judges will listen to that, especially here. Unlike the bulger trial, which was just one defendant, theres now 19 defendants in this case, which is frankly an extraordinary number. I dont see how the d. A. Is going to get all 19 in the courtroom. It seems physically impossible. Theyll have to split the case up. Theyll have to what they call sever different groups into different trials. Just logistically 19 people in one courtroom with one juror with all these different Defense Lawyers is impossible. So the state is going to have to at some point soon figure out how they want to proceed, who goes first and im sure everyone is going to be fighting to go last. If you dont go first, you can see the states case, you can see how the witnesses perform, you can get to know the weaknesses of the other side. Given that it would be a challenge to have all of the defendants in the courtroom at once, is it your feeling that the d. A. s office is hoping some of those codefendants are going to want to plead so there would never be a case for all of them . Yes, i think thats always the prosecutors hope that the case gets simplified when numerous defendants plead guilty or reach a Plea Agreement with the state or federal government. That simplifies it. Youll notice that in the federal charges out of d. C. , theres only four charges. Here theres multiple charges, including a massive Rico Conspiracy charge, which is pretty complicated. I dont think they want 19 people. Theyll probably all have at least two lawyers. They dont need all these lawyers throwing rocks at their case. Its a major headache. Lets talk about whats at the core of this case, of the indictment. Trump is facing 13 charges on this georgia indictment. Perhaps the biggest threat he faces is the racketeering or rico charges. This was a law originally intended to fight Organized Crime and mobsters. You prosecute d several rico cases. Tell us why it is being used in this case and why Donald Trumps legal team should be concerned. The federal rico statute was passed in 1970. About 30 states across the country have their own state rico charges. In georgia, the rico statute is a little bit broader. It permits more crimes to be considered as part of the racketeering activity. So its concerning for any defendant, because it permits the state or the prosecution to introduce a lot of evidence that otherwise they would not be able to present, because the rico statute is so broad. It requires the state to prove there was a Racketeering Enterprise and all these people were trying to overturn the state election. Theyre going to have to prove theres a pattern of racketeering. It cant be unrelated crimes. It cant be a tax evasion and like the goal has to be the same. And smuggling or something. It has to be a pattern thats for a common goal. Since theyve charged a conspiracy, it makes it easier for the state to prove it, because all you have to show is that these people were agreed to this crime and they knew that somebody would commit two or more. They themselves do not have to commit two predicate crimes, but somebody in the conspiracy did. They have to knowingly agree this was the purpose. So the Conspiracy Charge is very broad. Frankly, its a little complicated the way theyve drafted it. Theyve included whats called overt acts in addition to Racketeering Acts. The Racketeering Acts are of the alleged crimes. Overt acts can be anything. They went and gave a speed, they went and had a meeting. So it has the risk of backfiring against the state, because if they made it so complicated and so many different overt acts, i think 160 have been thrown into the indictment, which to me seems unnecessary. They should have simplified it if they didnt want to risk the 12 jurors listening to all this evidence trying to decide who knew what when, who agreed to what, what does this overt act mean, is it racketeering, is it not. It can get very confusing. Do you see this case staying in georgia or going the way of federal court, which is what mark meadows and his attorneys want . Honestly, i havent studied that issue very much. I think theyre going to be hard pressed to get it out of the state court system. Im not sure what would give them the right to transfer it to federal court. These are state crimes charged by a State Grand Jury by a State Prosecutor regarding the state federal election. Thats probably the hook theyll try to say. But well have to see what the courts say to that. Brian kelley thank you so much. Nice to see you as well. Now to an urgent storm warning. Were starting to see North American bands begin to fill back in with convection. Youre starting to see more and more thunderstorms develop and even some of them spreading into the u. S. Already. You have thunderstorms across portions of southern california, Western Arizona and beginning to spread into extreme southern nevada. More of this is going to fill in as we go through the afternoon and the evening and overnight hours tonight, because that storm is going to continue to push north into colder water. We anticipate it to push into california as a Tropical Storm. Dont let you make that think we wont get as much rain. The Rain Forecast remains the same. The bulk of the heavy rain really sets in overnight tonight, continues all the way into the day sunday. Most of it finally wraps up by the latter half of the day monday. Youre talking a full 48hour time period where we are looking at moderate to heavy rainfall. That includes death valley, palm desert, las vegas, los angeles and san diego, all part of that moderate risk. Again, youre talking a years worth of rain in less than a day for some of these areas, widespread totals of 24 inches. Its more than they get in an entire year, in some cases multiple years worth of rain in a 24hour time period. There will be some spots that could pick up 6, 8, even 10 inches of rain in just a 48hour time period with the bulk of that falling tonight going into the day on monday. Another thing to continue too, there is a Second System that is just behind hilary expected to push on a similar track. Then we also have four other systems in the atlantic. Some of their preparation that theyre used to for winter storms, for earthquakes, for wildfires, how to evacuate, some of that does translate to this situation, but there is a lot thats unknown for them. This is the first ever Tropical Storm warning. You talk about these events changed and cancelled. We see death valley, joshua tree and Mohave National parks closed trying to discourage people from going into those heavier rain zones. If you dont need to go out, officials say, please stay home. People need to be prepared, especially if their area is prone to flooding, if theyve had mudslide and Landslide Problems in the past. Officials are also concerned about Catalina Island off the coast thats likely to get hit. They have additional personnel and extra boats positioned there. The sheriff in l. A. County says this is about striking the right balance of preparedness. I dont want people to panic. We got to find that sweet spot between overreacting and being prepared. So people are definitely learning to track that radar here. Its not something they typically do in the middle of summer in los angeles.
