Were learning about what should have happened when former President Trump surrenders to officials at the Fulton County jail in georgia. Former President Trump has less than a week to turn himself in to the Fulton County jail in georgia. He and his 18 codefendants are charged with noting to subvert the 2020 Election Results in that state. Fani willis has set august 25th, next friday, as the deadline for them to surrender. His arrest will likely look different from trumps previous three criminal cases. Local Officials Say theyll treat the former president like any other defendant, but sources tell cnn trumps team has been in contact with the da ooegs office about the conditions and logistics for his surrender. Cnns ryan young has more. Reporter yeah, victor and amara, we try to get a hook at roys next as we look at the former president turning himself in. Thats after trump and 18 others were indicted by a Fulton County grand jury on monday. From a security standpoint, we know theres been a heightened level of watch outside the courthouse and the jail. In fact, you can no longer drive up to the jail where the former president is expected to turn himself in. Two deputies are sitting at the end of the drive way limiting access. We also learned Secret Service has visited the Fulton County jail to work with Sheriff Department officials to get an evaluation of the Current Situation and determine what needs to be done to protect the former president. They believe the process for donald trump will clearly be different than what a normal person would go through in the process, and as of right now in checking the jail website, up in of the names of the people indict vd been included in the names of people who have been booked. Obviously next week will be busy. Theres belief by some officials that at the end of the week, we could see former President Donald Trump show up at the jail to be booked in. Joining me now is clark cunningham, a Constitutional Law Professor at Georgia State university. Thank you so much for coming in, sir. I appreciate your time. Youre quite convinced former President Trump is going to have his lawyers try to get the criminal case moved to Federal Court. Thats right. Do you expect that to be successful . Not at in the long term, but i think its very possible its going to tie the case up maybe even for a year before that issue gets resolved. What arguments would they make to try to get this its called removal, right . Right. Theres a feddal law thats been around for a long time that says someone whos even a former federal fishlg like the former president is prosecuted in state court, that federal official can ask for the criminal case to be moved to Federal Court on the argument that the crimes he is charged with were done while he was a federal official under the color of law as part of his official duties. Thats an almost automatic procedure. So mark meadows has done this. What would the implications be for the other 18 codefendants . Thats a good question. Ive been talking to others and were kind of in unchartedterritory. It may be the whole case will move to another court or one defendant at a time, or it may be up to the District Attorney fani willis, does she want even moved at once. I do believe the president s trial will be moved back to Fulton County, but theres going to be a process to consider his process and claims that it should be in Federal Court. For those watching at home, oh, well, knew indictment, its Fulton County, why is it important, what would you high light about this indictment . There are a number of things that are very important. In my mind its really important that 18 other people are indicted, and it may be that the former president never goes to trial, but i think the other 18 or so, 17 or so defendants, many of them will plead guilty and cooperate and provide information about whats alleged in a really fast conspiracy. Some of them will go to trial. So this is very different than the federal cases that really just focus on trump. Here were trying to the District Attorney is trying to bring in everybody who was involved in making what she alleges to be a criminal enterprise to really undermine democracy. Because this is a state trial and because theres a conviction, this is something the president cannot pardon, right . Right. Think theys something that keeps trump up at night right now. Hes hoping if hes elected president again he can derail any federal prosecution and he probably can, but he cant derail the state case and unlike the federal system, not only can he not pardon himself as president , but pardon is very limited in georgia. If hes convicted and sentenced to jail, hell probably do some jail time. Youre a Constitutional Law Professor. From your perspective, what are you thinking about as we head into 2024 . Were in the middle of a president ial election. Trump is at the head of the republican ticket at least right now in the primaries. At what point do you see the country facing a constitutional crisis if there is one . Well, i think we are facing one if donald trump is elected president again, and as i would expect the Fulton County indictment doesnt go to trial. Were go tong have a sitting president with a criminal trial going on in state court and i think we know enough about donald trump that hes going to use all the powers of the presidency to try to derail that stat prosecution, and its unprecedented. Its likely to be a constitutional issue at that point. Do you have any concerns about how it will be handled in terms of someone being in office or a nominee for the Republican Party . Well, i think its really troubling. Of course, a lot of opponents are arguing the only reason hes running again is to stay out of jail, which is not a great reason to run for president. So, yeah, i think District Attorney willis is proceeding on the assumption shes got a job to do, which is to go after people who committed crimes in georgia, and if one of those people happens to be running for office, so what. The judge slated Jury Selection for one week behalf the trial is set to start in october, saying he expects to bring in potentially a thousand jurors at this point, and that may not even be enough. One of the key issues discussed during that Pretry Hearing was kohbergers alibi. His defense team says he likes to take long drives during the night and thats what they say he was doing the night of the murders. Now the witness list is too long and that theres not enough time for the state to prepare for crossexamination before the trial. The judge ruled that Bryan Kohberger has until the beginning of sect to present witnesses for an alibi if he has any. There were always other procedural items brought up. The Defense Attorneys want more information on how they came to the Conclusion Kohberger is the suspect in the case based on dna. They brought in expert witnesses. A judge did not make a decision regarding that motion, but, victor, amara, it does appear that this is moving very quickly toward a trial, which is set to start on october 2nd, and very important to remember, this is a Death Penalty case. When you have the president and the administration going to all of these districts and communities talking about the billions of dollars of investments going into the communities, people are going to start to feel it. And you point to republicans who are taking credit for the type of money that they voted against, thats a huge contrast that i think is going to work very well for bind in the coming euro. He was hoping the fate would be decided by the voters, but it is what is it is. Hell stalk about economy, inflation, security. And as much as my dear friend maria wants to talk about economy, its not going whelm when you have Approval Ratings across the board at 35 handing handling of the economy, thats not good. So until that reality changes, what we have is joe biden whos going to be the democratic nominee, and i believe hes going to be a strong democratic nominee with an economy thats strong. Theres over a year until the election and those numbers are going to start singing in. Let me start off by giving you a little bit of a snapshot of whats happening here in the United States and preface by saying as you well know theres not as much testing going on, so its hard to get an idea how much covid is out there. One authentic people will do is Test Wastewater around the country to get an idea how much covid is actually in the environment. What we really want to know is it transmitting and making people sick . This gives you a snapshot of time of how many Hospital Admissions there are from covid. If you see the darker colors, the orange and red, thats places where the numbers have been going up in the past week. Yellow is more flat, more sustaining the same. Theres a couple of states where the numbers are actually going down. We know as we get into the cooler and drier weather, the numbers are going to go up. Thats the bad news. The good news is were at a very low level right now. Let me show you this trend graph over the last couple of years. At the far right of the screen is where we are now. You can see the numbers start to tick up a bit in terms of Hospital Admissions, but compared to last august, for example, were about a quarter of where we were at that time. That big spike in the middle incidentally, thats omicron and the spike before that, that was delta. Again, no one anticipates were going to get those kinds of spikes again, but weve got to keep an eye on the numbers as they start to tick up just a little by. One of the questions i get more than any ois what should you do if you are sick. The advice really is the same even before the pandemic, which is if youre sick, you should stay home. We know with covid in particular its the first five days youre most likely to spread the virus. As a general rule, theres five days of isolation. Five days after you test positive or develop symptoms. Say you develop symptoms and two days later you test yourself. Your isolation would have begun two days earlier er. Thats how you get to the fiveday mar. Theres no testing to come out of isolation, but if you do test yourself and you have two negative tests over 48 hours, you dont need to wear a mask and youre good to go. But, again, if youre sick, you should stay home, no matter where youre at in the whole process i described. The other thing is were going to the season of flu and covid rsv. I will tell you there are vaccines now available now. Over the age of 60, under the age of 0. Really before halloween for flu shot for both groups. For covid, theres going to be a new booster thats expected to come out by the end of september. Its not a Perfect Match for the variant currently dominant in country, but its a pretty good match.
