our viewers in the united states and around the world. i'm danny freeman. we begin this morning in atlanta with the prosecutor there fani willis having set the date she wants to start the georgia election interference trial of donald trump and his 18 co-defendants and already there is a significant conflict with the political calendar. willis has asked the judge to start the trial march 4, 2024 just one day before trump would compete in the super tuesday primary contest. that is when more than a dozen states including california and texas go to the polls. and as you can see, the former president will also have to prepare for the trial in the midst of four early state nominating contests in iowa, new hampshire, nevada and south carolina. paula reid has more from washington. >> reporter: fani willis just making a request, a proposal to have her trial begin the first week of march 2024. it is highly unlikely that this request will be granted because six months is a very tight time line for a rico case. they are notoriously complicated and tend to get drawn out. and here she has 19 different defendants. three of them expected or have already challenged the jurisdiction trying to move the case from the state to the federal level. but we know she is also competing for increasingly scarce space on an increasingly crowded calendar where the president has not only likely a few trials that have been scheduled, but also he has election events, things that he would likely have to participate in as a candidate for the presidency. so that is likely part of why she wants to get the discussion going and why she is proposing such an aggressive time line. paula reid, cnn, washington. meanwhile sources close to former president trump tell cnn that he is considering counter programming next week's republican presidential debate on fox news instead of participating in it. the sources say he has not done any prep for the milwaukee debate though some suggest that he doesn't need prep. they stay trump could decide to participate at the 11th hour, but instead they say trump has been throwing out ideas for his own counter programming including possibly doing an interview with tucker carlson. we want to turn now to the wildfire disaster in hawaii. maui county officials announcing overnight that the death toll has risen again to 111. a total of nine bodies have been identified and of those the names of five have now been made public. governor josh green though says more than 1,000 people still remain unaccounted for. the police chief became emotional when asked about the relatively low official death toll. >> with all due respect, i'm not going to say how we found people when i haven't even told their families. how do i do that? you know, have we found remains that are maybe smaller than other remains? i'm not going to sit here and sensationalize that. but the answer to that is yes. but you want to talk about the children. okay? so we're going to do this right. >> billing weir is on the grou with more. >> reporter: with an up country fire not fully contained, maui's fire department stretched painfully thin and winds kicking up once again, some residents on could you could kuna are using sprinklers and hoses to protect their homes and trying to knock down hot spots with bottled water. >> you can feel the hit. just needs a good wind to get it going. by the time we got there, it was already flaming. started off with just a little smoke and then we said let's get some water and haul it over there. by the time we got over there, it started are spotted by a helicopter dropping water scooped from swimming pools and finally get the help they need. and they wonder why more skilled firefighters aren't being brought over from oahu. >> my mind is blown. what is even happening. this whole road should be blocked off and firemen should just be all here hands on deck. i mean, obviously there are people on oahu, but they have the personnel. >> i stayed up until 2:00 in the morning watching because i knew the gas station was going off and the propane tanks and, you know, my favorite store that i used to go get for gardening supplies, it is gone. and people that lost their homes, i was watching that. >> reporter: brenda's 83-year-old mother-in-law was in her lahaina home on the day of the firestorm and her husband was among the first to provide a dna sample. so now they are in grieving limbo. >> has he accepted the idea that she's gone, does he have to get confirmation before he can -- >> mine the truth about it, we accepted it on the day that we saw that there is no house. but you never give up hope. so it is both. we check in on each other and we say how are you doing. mentally. spiritually. physically. emotionally. and we take time after each to check and answer and my husband was saying i'm okay, okay, and i told him no, you're not. and the people asking are you okay, no, you're not. the word is i'm concerned. >> reporter: there are so many concerns on so much levels. the mental health, physical health, water supply, shelter. we're hearing that number of displaced residents are finding hotel rooms. that is good news. but they are also of course identifying more bodies and that number expected to go up with the governor saying more than 1,000 still missing. bill weir, cnn, maui. and president biden and first lady jill biden will travel to hawaii on monday. the white house says they will see the impact of the disaster firsthand and meet with first responders and survivors as well as federal, state and local officials. the visit comes with mounting pressure on the president who signed a federal disaster declaration last week, but otherwise has said little about the devastation there. swimminga federal appeals c overturned a lower court ruling that would have taken mifepristone off the market. but the court upheld parts of the ruling that may eventually make it harder to gain access to the drug. jessica stchneider has more. >> reporter: right now no immediate impact of this fifth circuit court decision because the decision was pre-elemptivel blomed by the supreme court until the justices decide if they will even hear an appeal. so practically mifepristone remains widely available meaning it can still be prescribed by a nonphysician. you don't need to go to your doctor's i have to get the prescription, if can all be done via telehealth, you can get it by mail and you can still get it up to ten weeks pregnant. but this decision on wednesday by the conservative federal appeals court, it really says that all of those rules put into effect by the fda between 2016 and 2022, the court saying that they should be blocked, that ease of access should be rolled back. and this is significant because this is the second conservative court to rule this way. so it is possible that when it does get to the supreme court, the dogs has said that they will appeal, we could see a similar ruling given that the conservative makeup of this nation's highest court has already made some major decisions including overturning roe v. wade which eliminated the constitutional right to an abortion. but again, even though the fifth circuit said that the recent rules making it easier to get the abortion drug mifepristone should be blocked, nothing the lower courts decide at this point will actually take effect until the supreme court decides whether to step in. so the takeaway, for now mifepristone will remain on the market, it will remain widely and easily available even though the lower courts are consistently ruling against certain aspects of accessing the drug. jessica schneider, cnn, washington. turning now to the war in ukraine. the country's military says it is not expecting for receive american-made f-16 fighter jet this is year and will make due without them, but ukraine's air force says it is making progress on training pilots to fly the u.s.-made planes once they do arrive. nada bashir is following this story from london. how much does ukraine actually need the f-16s and what will it do if it can't get them this year? >> reporter: in terms of the need, the hope from the ukrainian side is that these f-16s would provide the much needed boost for ukraine's ongoing counteroffensive, something that president zelenskyy has been pushing for since the early stages of russia's invasion of ukraine. after more than a year, we saw the turnaround from president biden in may endorsing the training of ukrainian pilots in congress junction with eu partners on these u.s. gsh-made fighter jets. this is a blow to the ongoing counteroffensives the fact they won't have these jets or be able to operate them over the coming months particularly over the harsh winter months. earlier this month we did hear from officials familiar with this matter in the u.s. that there had been some holdup when it came to the training program there, waiting for the exact details to be put forward by eu partners. but we with are hearing some positive indications. we heard from the ukrainian air force spokesperson who has said that they are making progress, they are pushing forward with these plans for a training program and they are expecting a group of ukrainian pilots to be trained on these f-16s in the coming months. but of course with no fighter jets until his electronic records, a $57,000 judgment against his company for unpaid phone bills. and a fine of $89,000 for fr a judge in a defamation case. and all of that is separate from the legal fees that giuliani owes. >> the amount of money it costs to fight a lawsuit let alone almost a dozen lawsuits over the last two years is, it is really mind boggling. >> reporter: in court giuliani's attorney says he is facing 11 lawsuits and investigations. he has also been criminally indicted in georgia related to the efforts by him, donald trump and others to overturn the 2020 election results. and he could face criminal case and he is basing disbarment in new york and washington. >> he is attacked both in his professional arena, in the civil court and now in the criminal court as well. and that is a heavy load to carry. >> reporter: and giuliani admits that he is not carrying it. at least not financially. his lawyer telling a judge these are a lot of bills that he is not paying. i think this is very humbling for mr. giuliani. to deal with the money crunch, giuliani appears to be selling his three bedroom manhattan apartment for $6.5 million. and he is offering to record video greetings for strangers for $325 a pop on the website cameo. >> i can do a happy birthday greeting. >> he's always loved opera, but this is a tragic opera and self-inflicted at this stage. heartbreaking to see. >> reporter: the man who as a prosecutor took down the new york mafia, who turned around new york city's fortunes as mayor. and who did at one time hold considerable personal wealth seems to have squandered it all for one man. >> he has destroyed his reputation and his independent financial foundation. all to help donald trump lie about an election. he threw it all away. >> reporter: following the statements in court by his attorneys regarding his finances, rudy giuliani's lawyers have not provided additional comment to cnn. giuliani has called his criminal indictment in the georgia case an affront to american democracy. in the civil lawsuits against him, giuliani has in at least one of them conceded in court that he made false and defamatory statements but he's still involved in litigating those cases. brian todd, cnn, washington. for more, let's bring in a criminal defense attorney and former federal prosecutor. katie, i want to get right into this. no one has been more loyal to trump than rudy giuliani, about you could these reported financial issues and legal bills make him more likely to cooperate? >> well, it is possible that could be a motivation, but certainly if somebody can demonstrate that they are financially insolvent, they could potentially be entitled to court a pointed counsel of some sort. so i'm not sure if mr. giuliani's case is at that point yet, but there are certainly avenues that the court can look into to appoint counsel if need be. >> and the thought of rudy giuliani having court a pointed counsel is one that i don't think a lot of us would be at this point. fani willis is aiming for a march 4 trial date for this georgia election sub version case. does trump's legal team have a valid argument that this is too early? >> there is no practical way that this case is going to go in the next six months. it is a very complicated case and we have to remember that speedy trial right is primarily a defendant's right. prosecutors obviously want to go quickly to trial, but the government has been investigating these cases for many years. there are significant amounts of discovery and documentation that each of the defense teams have to go through so i don't feel that that is a realistic time line whatsoever particularly in a case with this many defendants and under such a novel legal theory. >> does or even should the presidential campaign schedule though factor into the judge's decision on the trial date? >> well, i think that that is certainly the -- the judge should take that into account, but even more than that, just the shear amount of time that it will take defense counsel to review the documentation and discovery in this case is going to push this trial out for a long period of time in my opinion. >> and to that point, in addition to the logistical time and place issues, you still have a case with 18 co-defendants and the president. is it any clearer how the defendants or prosecutors will navigate such a massive legal case? >> at this point it is not clear. there is still the possibility that some decide to flip and cooperate so the number could reduce or change. but logistically speaking, it is really a nightmare in terms of managing the court schedule and all of the attorneys for each of the individual defendants that will be involved. so certainly i think this is a very long term case on the way to trial. it should be pushed out probably well after the election just realistically speaking. >> and we heard the d.a. said in an ideal world she would want to try all these defendants together. do you think that we're actually going to see that picture of a chaotic full courtroom of 19 people all trying to make their case? >> again, this is such unprecedented territory here and the logistics of that alone are hard to imagine. the judge is going to have to think hard about how that would even play out, how the attorneys would be able to interact with one another. and so certainly i guess that is a theoretical possibility, but i don't know how that would look. >> and again all of this will be on camera this time. katie, thank you so much for your time. really appreciate it. now >> reporter: everybody is the answer senator tim scott and his campaign are looking for this week in iowa. campaigning hand to hand flip to french fry. but the main political attraction during scott's visit to the famed state fair tuesday was news of frontrunner donald trump's fourth criminal indictment. >> continue to say that we see the legal system being weaponized against political phones, that is unamerican and unacceptable. >> reporter: scott attacking the legal process instead of the former president zelenskyy trying to keep his campaign positive. and showing little appetite to take on any candidate even trump despite mounting legal woes. >> his lead insurmountable? >> no, of course not. i believe that my optimistic positive message is rooted in iowa and that frankly our poll numbers continue to go up. >> reporter: that optimism comes as some iowans tell cnn they are sick of trump who still holds a dominant lead. >> i'm considering other people that i think would also do the job maybe without some of the conflict that president trump has with all the lawsuits. >> i kind of wish that trump would just fade to be honest with you. >> reporter: scott and his supporters have blanketed iowa and new hampshire with more than $10 million worth of ads. at an event in cambridge, iowa, he saw the payoff firsthand. >> i say in my commercials, if you take out a loan, you pay it back. hallelujah, this is great, man. love it. y'all are starting to see the commercials. this is good news. i was wondering if they were buying anything with all that money i was spending. >> reporter: in the hawkeye state, a whopping 69% of likely caucusgoers say they have a favorable view of scott according to a recent poll. his pursuits of momentum will have to carry into next week's debate. a crucial test and opportunity with florida governor ron desantis seeking to reboot his campaign and trump's appearance on the stage very much in doubt, scott is convinced he is compete. >> i'll continue to run this race for one objective, and it is to be the president of the united states. >> reporter: his campaign just releasing this video. >> you get in the race for president to win. >> what is your campaign strategy to gain momentum between now and the debate? >> well, good news is we'll continue do what we have been doing which is focusing on the optimistic positive message anchored in conservative with a backbone. >> reporter: and he could face attacks from his rivals on the debate stage given his relative momentum. his team tells us that he is prepared and engaging in the traditional debate prep but they tell him no matter what happens, remain optimistic because it is that sunny optimism that seems to be gaining him the attention of some voters. eva mckend , cnn, des moines. >> makes me miss the state fair so much. for more, let's bring in tia mitchell, washington correspondent for the journal constitution. we heard there that senator scott has made some progress in iowa. but there is new polling out that trump's lead is still dominant. so i want your perspective. what is the strategy for the rest of the gop field? >> well, for people like tim scott the strategy is remain likeable, drum up support and hope that at some point voters, republican primary voters, start looking for an alternative to trump. for desantis and some of the other, they are trying to create the message that they are just as trumpy as trump, maybe even more conservative, but they are not trump. and also looking to be an alternative should voters start looking else where. and so those are kind of the two approaches we're seeing among the other republican presidential candidates. but so far what we're seeing in the polls from the voters are that they are not yet most of them at least half are not yet looking for an alternative to donald trump. >> and i want to look ahead to next week because the time to pitch one's self as an alternative is debate stage. but sources are telling cnn that likely trump won't attend the debate next week. and trump maybe having a counter program. but the rnc won't be happy if that happens. so what do you think the game plan is here from trump's perspective and also the gop candidate perspective if he is not on that stage? >> from trump's perspective, he is not seeing much up side to sharing a stage with us his opponents and that is an approach of his throughout this campaign. you don't see him for example attending the cattle call events where all the other candidates will be there. he just doesn't share the stage as a policy. so for him, it doesn't make sense to do this debate where he could say something that offends people or he could be on the stage and all the other candidates just spend the whole time attacking him which is what usually happens to the frontrunner. so for him there is no up side. but for the other candidates, they wish they did have the opportunity to take trump on face-to-face. they know that they can get a lot of earned media by getting a good sound bite or a good jab at trump on a debate stage. so now they have to focus on the others. for example everyone has been talking about tim scott, how likeable he is. how he could be an alternative if trump falters. i could see some of the g candidates looking to bring tim scott down a bit and sullying that good reputation he's been building. and also with desantis, if trump is not on the stage, desantis is the one polling highest and therefore you would expect he would get that frontrunner treatment in the absence of the true frontrunner. that could mean a lot of attacks coming desantis' way as well. >> and one more question on that because we saw trump do this in 2016, try to avoid one primary debate, have this counter programming, but it didn't really work out for him as much then. i'm curious if you think that the former president would rather actually show up than be called out over and over again as maybe a coward for not taking the stage. what do you think? >> well, it is different. 2016 it was an open seat and trump was unknown. in a lot of ways he couldn't avoid the stage. i think that trump and his advisers believe that he is in a much different quite frankly much stronger position. he is polling again around 50% in most polls. second place is desantis and he's way behind. i think trump and his advisers believe that there is not the up side to debating because he is a known entity now and quite frankly he has a lot of support right now debate or no debate. >> tia mitchell, thank you so much for sharing your perspective. really appreciate it. we'll talk soon. and to this now, tropical storm hillary that formed southwest of mexico could strengthen to a category 3 hurricane near mexico's baja peninsula this week. heavy rain is on track for the west as well. let's go to derek van dam. tell us, how strong is this system as it is traveling north? >> good morning, danny. look, this system is really off to the races. it is currently a strong tropical storm but likely and this is explicit language from the national hurricane center latest update issued about 15 minutes ago -- rather, 45 minutes ago, this storm expected to become a hurricane within the coming hours and then a major hurricane potentially by later tonight. and why do we care about this storm in the eastern pacific? >> two members of the group are not there. they are safe but say fellow surfer elliott foote paddled away from the group to try to find help, and just two of the three members of the indonesian boat crew have been found. we drifted away very far they explain from safety of the rescue boat. it felt we were circling around the area and it was totally dark. at home in sydney, australia elliott's father anxiously waits. then a text message comes through. elliott's alive. >> we got everyone! >> everyone! right before super tuesday among other important dates. and no-show strategy, the republican frontrunner could skip next week's debate but it doesn't mean he won't be on tv. good morning, welcome to our viewers in the united states and around the world. i'm danny freeman. we begin this morning in atlanta with the prosecutor there fani willis having set the date she wants to start the georgia election interference trial of donald trump and his 18 co-defendants and already there is a significant conflict with the political calendar. willis has asked the judge to start the trial march 4, 2024 just one day before trump would compete in the super tuesday primary contest. that is when more than a dozen states including california and texas go to the polls. and as you can see, the former president will also have to prepare for the trial in the midst of four early state nominating contests in iowa, new hampshire, nevada and south carolina. paula reid has more from washington. >> reporter: fani willis just making a request, a proposal to have her trial begin the first week of march 2024. it is highly unlikely that this request will be granted because six months is a very tight time line for a rico case. they are notoriously complicated and tend to get drawn out. and here she has 19 different defendants. three of them expected or have already challenged the jurisdiction trying to move the case from the state to the federal level. but we know she is also competing for increasingly scarce space on an increasingly crowded calendar where the president has not only likely a few trials that have been scheduled, but also he has election events, things that he would likely have to participate in as a candidate for the presidency. so that is likely part of why she wants to get the discussion going and why she is proposing such an aggressive time line. paula reid, cnn, washington. meanwhile sources close to former president trump tell cnn that he is considering counter programming next week's republican presidential debate on fox news instead of participating in it. the sources say he has not done any prep for the milwaukee debate though some suggest that he doesn't need prep. they stay trump could decide to participate at the 11th hour, but instead they say trump has been throwing out ideas for his own counter programming including possibly doing an interview with tucker carlson. we want to turn now to the wildfire disaster in hawaii. maui county officials announcing overnight that the death toll has risen again to 111. a total of nine bodies have been identified and of those the names of five have now been made public. governor josh green though says more than 1,000 people still remain unaccounted for. the police chief became emotional when asked about the relatively low official death toll. >> with all due respect, i'm not going to say how we found people when i haven't even told their families. how do i do that? you know, have we found remains that are maybe smaller than other remains? i'm not going to sit here and sensationalize that. but the answer to that is yes. but you want to talk about the children. okay? so we're going to do this right. >> billing weir is on the grou with more. >> reporter: with an up country fire not fully contained, maui's fire department stretched painfully thin and winds kicking up once again, some residents on could you could kuna are using sprinklers and hoses to protect their homes and trying to knock down hot spots with bottled water. >> you can feel the hit. just needs a good wind to get it going. by the time we got there, it was already flaming. started off with just a little smoke and then we said let's get some water and haul it over there. by the time we got over there, it started flaming already. so we'll go back and put more water on it. >> in this smoky brush, one wrong step means a burned foot. >> soot is so deep, you can't get through it. >> but they stay at it until they are spotted by a helicopter dropping water scooped from swimming pools and finally get the help they need. and they wonder why more skilled firefighters aren't being brought over from oahu. >> my mind is blown. what is even happening. this whole road should be blocked off and firemen should just be all here hands on deck. i mean, obviously there are people on oahu, but they have the personnel. >> i stayed up until 2:00 in the morning watching because i knew the gas station was going off and the propane tanks and, you know, my favorite store that i used to go get for gardening supplies, it is gone. and people that lost their homes, i was watching that. >> reporter: brenda's 83-year-old mother-in-law was in her lahaina home on the day of the firestorm and her husband was among the first to provide a dna sample. so now they are in grieving limbo. >> has he accepted the idea that she's gone, does he have to get confirmation before he can -- >> mine the truth about it, we accepted it on the day that we saw that there is no house. but you never give up hope. so it is both. we check in on each other and we say how are you doing. mentally. spiritually. physically. emotionally. and we take time after each to check and answer and my husband was saying i'm okay, okay, and i told him no, you're not. and the people asking are you okay, no, you're not. the word is i'm concerned. >> reporter: there are so many concerns on so much levels. the mental health, physical health, water supply, shelter. we're hearing that number of displaced residents are finding hotel rooms. that is good news. but they are also of course identifying more bodies and that number expected to go up with the governor saying more than 1,000 still missing. bill weir, cnn, maui. and president biden and first lady jill biden will travel to hawaii on monday. the white house says they will see the impact of the disaster firsthand and meet with first responders and survivors as well as federal, state and local officials. the visit comes with mounting pressure on the president who signed a federal disaster declaration last week, but otherwise has said little about the devastation there. swimminga federal appeals c overturned a lower court ruling that would have taken mifepristone off the market. but the court upheld parts of the ruling that may eventually make it harder to gain access to the drug. jessica stchneider has more. >> reporter: right now no immediate impact of this fifth circuit court decision because the decision was pre-elemptivel blomed by the supreme court until the justices decide if they will even hear an appeal. so practically mifepristone remains widely available meaning it can still be prescribed by a nonphysician. you don't need to go to your doctor's i have to get the prescription, if can all be done via telehealth, you can get it by mail and you can still get it up to ten weeks pregnant. but this decision on wednesday by the conservative federal appeals court, it really says that all of those rules put into effect by the fda between 2016 and 2022, the court saying that they should be blocked, that ease of access should be rolled back. and this is significant because this is the second conservative court to rule this way. so it is possible that when it does get to the supreme court, the dogs has said that they will appeal, we could see a similar ruling given that the conservative makeup of this nation's highest court has already made some major decisions including overturning roe v. wade which eliminated the constitutional right to an abortion. but again, even though the fifth circuit said that the recent rules making it easier to get the abortion drug mifepristone should be blocked, nothing the lower courts decide at this point they do arrive. nada bashir is following this story from london. how much does ukraine actually need the f-16s and what will it do if it can't get them this year? >> reporter: in terms of the need, the hope from the ukrainian side is that these f-16s would provide the much needed boost for ukraine's ongoing counteroffensive, something that president zelenskyy has been pushing for since the early stages of russia's invasion of ukraine. after more than a year, we saw the turnaround from president biden in may endorsing the training of ukrainian pilots in congress junction with eu partners on these u.s. gsh-made fighter jets. this is a blow to the ongoing counteroffensives the fact they won't have these jets or be able to operate them over the coming months particularly over the harsh winter months. earlier this month we did hear from officials familiar with this matter in the u.s. that there had been some holdup when it came to the training program there, waiting for the exact details to be put forward by eu partners. but we with are hearing some positive indications. we heard from the ukrainian air force spokesperson who has said that they are making progress, they are pushing forward with these plans for a training program and they are expecting a group of ukrainian pilots to be trained on these f-16s in the coming months. but of course with no fighter jets until litigating those cases. brian todd, cnn, washington. for more, let's bring in a criminal defense attorney and former federal prosecutor. katie, i want to get right into this. no one has been more loyal to trump than rudy giuliani, about you could these reported financial issues and legal bills make him more likely to cooperate? >> well, it is possible that could be a motivation, but certainly if somebody can demonstrate that they are financially insolvent, they could potentially be entitled to court a pointed counsel of some sort. so i'm not sure if mr. giuliani's case is at that point yet, but there are certainly avenues that the court can look into to appoint counsel if need be. >> and the thought of rudy giuliani having court a pointed counsel is one that i don't think a lot of us would be at this point. fani willis is aiming for a march 4 trial date for this georgia election sub version case. does trump's legal team have a valid argument that this is too early? >> there is no practical way that this case is going to go in the next six months. it is a very complicated case and we have to remember that speedy trial right is primarily a defendant's right. prosecutors obviously want to go quickly to trial, but the government has been investigating these cases for many years. there are significant amounts of discovery and documentation that each of the defense teams have to go through so i don't feel that that is a realistic time line whatsoever particularly in a case with this many defendants and under such a novel legal theory. >> does or even should the presidential campaign schedule though factor into the judge's decision on the trial date? >> well, i think that that is certainly the -- the judge should take that into account, but even more than that, just the shear amount of time that it will take defense counsel to review the documentation and discovery in this case is going to push this trial out for a long period of time in my opinion. >> and to that point, in addition to the logistical time and place issues, you still have a case with 18 co-defendants and the president. is it any clearer how the defendants or prosecutors will navigate such a massive legal case? >> at this point it is not clear. there is still the possibility that some decide to flip and cooperate so the number could reduce or change. but logistically speaking, it is really a nightmare in terms of managing the court schedule and all of the attorneys for each of the individual defendants that will be involved. so certainly i think this is a very long term case on the way to trial. it should be pushed out probably well after the election just realistically speaking. >> and we heard the d.a. said in an ideal world she would want to try all these defendants together. do you think that we're actually going to see that picture of a chaotic full courtroom of 19 people all trying to make their case? >> again, this is such unprecedented territory here and the logistics of that alone are hard to imagine. the judge is going to have to think hard about how that would even play out, how the attorneys would be able to interact with one another. and so certainly i guess that is a theoretical possibility, but i don't know how that would look. >> and again all of this will be on camera this time. katie, thank you so much for your time. really appreciate it. now >> reporter: everybody is the answer senator tim scott and his campaign are looking for this week in iowa. campaigning hand to hand flip to french fry. but the main political attraction during scott's visit to the famed state fair tuesday was news of frontrunner donald trump's fourth criminal indictment. >> continue to say that we see the legal system being weaponized against political phones, that is unamerican and unacceptable. >> reporter: scott attacking the legal process instead of the former president zelenskyy trying to keep his campaign positive. and showing little appetite to take on any candidate even trump despite mounting legal woes. >> his lead insurmountable? >> well, good news is we'll continue do what we have been doing which is focusing on the optimistic positive message anchored in conservative with a backbone. >> reporter: and he could face attacks from his rivals on the debate stage given his relative momentum. his team tells us that he is prepared and engaging in the traditional debate prep but they tell him no matter what happens, remain optimistic because it is that sunny optimism that seems to be gaining him the attention of some voters. eva mckend , cnn, des moines. >> makes me miss the state fair so much. for more, let's bring in tia mitchell, washington correspondent for the journal constitution. we heard there that senator scott has made some progress in iowa. but there is new polling out that trump's lead is still dominant. so i want your perspective. what is the strategy for the rest of the gop field? >> well, for people like tim scott the strategy is remain likeable, drum up support and hope that at some point voters, republican primary voters, start looking for an alternative to trump. for desantis and some of the other, they are trying to create the message that they are just as trumpy as trump, maybe even more conservative, but they are not trump. and also looking to be an alternative should voters start looking else where. and so those are kind of the two approaches we're seeing among the other republican presidential candidates. but so far what we're seeing in the polls from the voters are that they are not yet most of them at least half are not yet looking for an alternative to donald trump. >> and i want to look ahead to next week because the time to pitch one's self as an alternative is debate stage. but sources are telling cnn that likely trump won't attend the debate next week. and trump maybe having a counter program. but the rnc won't be happy if that happens. so what do you think the game plan is here from trump's perspective and also the gop candidate perspective if he is not on that stage? >> from trump's perspective, he is not seeing much up side to sharing a stage with us his opponents and that is an approach of his throughout this campaign. you don't see him for example attending the cattle call events where all the other candidates will be there. he just doesn't share the stage as a policy. so for him, it doesn't make sense to do this debate where he could say something that offends people or he could be on the stage and all the other candidates just spend the whole time attacking him which is what usually happens to the frontrunner. so for him there is no up side. but for the other candidates, they wish they did have the opportunity to take trump on face-to-face. they know that they can get a lot of earned media by getting a good sound bite or a good jab at trump on a debate stage. so now they have to focus on the others. for example everyone has been talking about tim scott, how likeable he is. how he could be an alternative if trump falters. i could see some of the g candidates looking to bring tim scott down a bit and sullying that good reputation he's been building. and also with desantis, if trump is not on the stage, desantis is the one polling highest and therefore you would expect he would get that frontrunner treatment in the absence of the true frontrunner. that could mean a lot of attacks coming desantis' way as well. >> and one more question on that because we saw trump do this in 2016, try to avoid one primary debate, have this counter programming, but it didn't really work out for him as much then. i'm curious if you think that the former president would rather actually show up than be called out over and over again as maybe a coward for not taking the stage. what do you think? >> well, it is different. 2016 it was an open seat and trump was unknown. in a lot of ways he couldn't avoid the stage. i think that trump and his advisers believe that he is in a much different quite frankly much stronger position. he is polling again around 50% in most polls. second place is desantis and he's way behind. i think trump and his advisers believe that there is not the up side to debating because he is a known entity now and quite frankly he has a lot of support right now debate or no debate. >> tia mitchell, thank you so much for sharing your perspective. really appreciate it. we'll talk soon. and to this now, tropical storm hillary that formed southwest of mexico could strengthen to a category 3 hurricane near mexico's baja peninsula this week. heavy rain is on track for the west as well. let's go to derek van dam. tell us, how strong is this system as it is traveling north? >> good morning, danny. look, this system is really off to the races. it is currently a strong tropical storm but likely and this is explicit language from the national hurricane center latest update issued about 15 minutes ago -- rather, 45 minutes ago, this storm expected to become a hurricane within the coming hours and then a major hurricane potentially by later tonight. and why do we care about this storm in the eastern pacific?
