tonight. there's a big lineup of news tonight with smart voices on a scary assassination threat. more indictments coming. a republican loyalty pledge. an alleged racist slur in that brawl, you know the one i'm talking about. also a serial killer suspects dna. and the fires burning maui. first, everyone, the threat of political violence against public officials taking now a very deadly turn. a accused of threatening to assassinate the president of the united states and other lawmakers walled by fbi agents attempting to arrest m. more on that in just a moment. we're learning the man also threatened some of the people who were prosecuting donald trump. he was also seen in public wearing a trump hat. to be clear, this investigation is ongoing, and there is no evidence that we know of to suggest that he was either inspired by trump's rhetoric or directed in any way. full stop. but it would be irresponsible if we did not identify the noteworthiness of this moment. the threats that donald trump has been accused of making, the intense attacks, and of course a conversation for so many. and he has consistently railed against people that have now been included in those threats made by the person who was killed today. >> these prosecutors are vicious, horrible people. they are racists, and they're very sick, they're mentally sick. they're going after me without any protection of any rights by the supreme court or most other courts. in reality, they're not after me, they're after you. beginning with the radical left, george soros-backed prosecutor alvin bragg of new york. [ boos ] who campaigned on the fact that he would get president trump. they've got a local racist democrat district attorney in atlanta. they say there's a young woman, a young racist in atlanta who is doing everything in her power to indict me over an absolutely perfect phone call. this lunatic special prosecutor named jack smith. then you have a radical left lunatic known as a bomb-thrower who is harassing hundreds of my people. >> when threatening and undermining the rule of law, it's not just actually the prosecutors that are actually noteworthy here. you realize that the former president does have a long history of going against and going after the judges by name in speeches. you've seen the tweets, you've seen the truth social poitss. trump has questioned their credentials, call them racist, political hacks, and disgraceful. >> i have a trump-hating judge with a trump-hating wife and family. >> at least two of these officials have had to have their security increased in recent days. the difference now, of course, between all that you've just seen and the way the compilation, and of course there's more, that is trump is now a criminal defendant. multiply that by three, of course. and as you know, words may have consequences in the courtroom, and there's still a protective order matter looming before at least one judge that has had an increase in security. let's begin now with that fbi raid and cnn's senior legal affairs correspondent paula reid. paula, i'm so glad you're here tonight. listen, i need you to walk us through what we know about why prosecutors were even looking to arrest this man. what's the story? >> he was allegedly making threats against president biden ahead of his visit to the state. he also allegedly made threats against democratic politicians and investigators working on the cases related to former president trump. he was facing three charges, including threats against the president, interstate threats, and this charge of influencing, impeding, or retaliating against federal law enforcement agents by threat. when s.w.a.t. agents were big him commands, he allegedly pointed a gun at them. >> paula, stand by for a moment. i want to talk about this with our panel right now. joining me is former federal prosecutor gene rossi, former head of intelligence in the homeland security d.c. department who warned about january 6th. and republican strategist michael singleton. by what paula described and what we know about what's happened so far, we know about the homeland security and how there has been bulletin after bulletin at this point cautioning people about one of the biggest threats facing the united states right now, domestic. it's about political grievance being aired in the form of violence. you're seeing this right now. you have warned about this. you have read the tea leaves more than once. what does it say that this just happened in utah? >> well, we don't have all the facts, as you mentioned. but quite frankly, i think that -- it pains me to say this -- maga is becoming a rest stop on the long, dark road to extremism. everything you saw the former president do in the previous clips is very systematic. what you need to do in order to mobilize to violence is you need to "otherize" people, dehumanize them. all these words they're using really lowers the threshold of the barriers to commit interpersonal violence. >> you mean "otherize," the person, make the person you hate or disagree with, now they're somebody who's not worthy of your respect? >> yeah, and once you do that, you lower those thresholds. someone is motivated to commit violence on those individuals. we call that schotastic terrorism. when you demonize an opponent, a group, an individual, and you talk about them, words have meaning. what's interesting, i wrote an op-ed in "politico" about this this weekend, the amount of individuals that have trump that have no previous criminal records that are mobilizing to violence, they're giving up their marriages, lifestyles, going to jail to commit acts of political violence. it's normalized acts of political violence. what we haven't seen is any prominent republican speak out. before we came on, i was searching the republican and right-leaning websites. everything you see is, fbi fake. nobody's coming out and saying this is bad. >> well, you know, at first we know that this is ongoing. we don't have all the possession. all the information. i don't want to accuse the former president, donald trump, of having instructed or inspired in any way what happened in utah. taking a step back, this idea of the "otherization" as you're speaking about, the idea of demonizing, the idea of essentially identifying one's political enemy, then hoping to capitalize or act on that, that's growing in our culture in our rhetoric. >> it is. >> to his point, he's saying there's no republicans speaking out about this. what's the rhyme or reason, and is that true? >> i think most of the republicans are going to look at the evidence, see what comes out over the next couple of days. i think it would be premature to make any statement if i were working for a member until we know all that occurred. >> the delay would not be in trying to call out the problem of trying to assassinate the president? that doesn't take any research. >> no, it doesn't, but i think many republican members are looking at the angst and anger within the republican party, which you sort of talked a little bit about, and i think this is part are of the course for an extreme form of tribalism. i think this is what happens when, in the past you could look at individuals who had disparate ideological beliefs and say, okay, maybe they're a political adversary somewhat, we'll have those debates, but for the most part we'll beg to differ where necessary, move forward, work on the things we can. that's no longer the case. i think many people on the fringes -- i don't think this is representative of most americans, but i think those on the fringes view those who are ideologically opposed as being a threat to their very existence. once individuals reach that pinnacle in their beliefs, in their values, it's very, very hard to stop it. it's almost unimaginable what individuals are willing to do, how far they're willing to go when they fear my life, my existence is at risk. >> you know, none of what you said to me means that people should be quiet about even the prospects. the idea of having to sort of get yourself up to that level of saying, this is a problem. look, as a prosecutor, a as lawyer, you see this. i'm sure there are arguments being made to both points about ideologies, about the no longer agreeing, disagree. but some of this is criminal. the idea of trying to assassinate the president, criminal behavior. indisputably so. what do you make about the fact that there is increased security now for people -- i mean, they're doing their jobs. if you're the assigned prosecutor who is overseeing an investigation and a grand jury yields an indictment, my language is precise for a reason. a judge overseeing a case who's been assigned that case. the fact that increased security is happening is highly problematic. >> absolutely. when i was a prosecutor, i had a case in which i had some violent defendants. and one of them said that he was going to kill me. and he was in jail. and the u.s. marshal put security on me. i had a neighbor who did something that was very odd and exotic and put in a security system for a year in my home. so this is personal to me. but what i want to say is this. i go back to 1950. george clo joe mccarthy had four or five years where he was spouting off things sort of like donald trump, accusing the opponents of vile character flaws, saying things that just were over the top for 1950. then there came a point, a fork in the road, when the party of mccarthy came out and said, enough is enough, and censured him. i predict that the republicans are going to have an epiphany. it may take another year. but i predict they're going to have an epiphany. the way donald trump is acting towards the federal judiciary and prosecutors is unprecedented. he is reminding me of other leaders during another part of our history in the 1930s and '40s. they are engaging in jingoism and propaganda and are taking advantage of people who believe in him. those people who do violent acts, especially on january 6th, they believed in donald trump. they drank the kool-aid. i represented one of them. >> i remember. >> so he knows that. and i said this on your show about a week ago. the evil genius of donald trump is he knows how to push the buttons of his followers. and he knows the dog whistles. and that's the evil genius of this man. >> well, listen. while we wait for the epiphany that you seem to be waiting on with bated breath, and i will be glass half empty in that moment, but i'm going to fuel my optimism through paula reid. stand by. i want to go back to paula reid and talk more about this. sources are telling cnn tonight that fulton county d.a. fani willis is expected so seek more than a dozen indictments next week as a part of her overall investigation into the efforts of donald trump and his allies to overturn the state's 2020 election. paula, what are we going to expect to see, what should we expect to see next week in fulton county? >> as you know, the district attorney fani willis has had this long-running investigation into efforts to overturn the election results in georgia. she's interviewed over 75 witnesses. this is all expected to come to a head next week. we expect that over the course of about two days, she will present a case to a grand jury with the expectation that they will vote to return indictments. they're expecting over a dozen indictments, charges including conspiracy, racketeering, rico charges. the biggest question a lot of people have, though, is will former president trump be charged? although we can't say for sure, even his own lawyers have said that they expect he will be charged in georgia. >> paula reid, thank you so much. back to the table here. look, we've been here before. there's a bit of deja vu happening. there are a lot of accusations that have been leveled against the former president of the united states, particularly with respect to the possibility of the alleged allegations of overturning the election. we know there are people who are closing down certain streets around the courthouse. there's security measures in place to figure out in anticipation. what can we expect to see from that end? >> they have a blueprint with new york city, miami, washington, d.c. last week. once again, when he's calling the prosecutor, the lead prosecutor, a racist, saying horrible things, they really can't take any chances. so they're going to -- if this is true, they're going to make sure that that courthouse is secured. it's a state, so it's not a federal issue. >> meaning what? who are the people that are going to carry out -- >> you're not going to have the u.s. marshals involved. you're not necessarily going to have the fbi. this is a state issue. they're going to have to use state resources and state law enforcement. again, they have a blueprint. they can contact officials in new york, washington, d.c., to do all this safely. i think we've seen that the crowds haven't really amassed as anticipated. >> i was going to say, the blueprint also includes there has not been the violence. there's been anticipation of crowd control, but you really -- remember in miami, there was the guy, sort of the jail bird monopoly outfit, pinstripes. he was taken away because he approached the vehicle too closely. we haven't seen much more than that. but this is georgia, shermichael. i point that out because georgia is unique in that these are republicans he was going against. brian kemp. you're talking about the attorney general, you're talking about secretary of state raffensperger. this is a unique situation because essentially, these are people on his team. yet a different scenario. >> yeah, i mean, i think about florida. trump resides in florida. he has greater approvals in the state than the sitting governor, ron desantis. the republican turnout, to your point, it was very small. when i travel the country and talk to maga-supporting republicans who support trump, many of them look at what happened january 6th and realize, people are getting real jail sentences. while there are some who just do not care, there are a whole lot more who worry about their families, their grandkids. they have to work, they have mort mortgages, rent. >> what does this mean politically? >> politically, yeah, we'll vote for him but i'm not risking jail because i have responsibilities that i know the former president probably isn't going to stand by me. people aren't as naive as i think we think they are. >> you represented clients in this business who were part of january 6th. is the 9087 day, was it a shockwaves in terms of deterrent for future people? >> you mean the convictions and prosecutions? >> and the sentences, which of course judge chutkan went above and beyond even with the prosecutors in some cases. >> i represented one client, and i still represent him. and i can say this. that they ate a lot of humble pie. they realized -- a lot of humble pie. they realized that what happened on january 6th -- and i go back to what i said. they believed in donald trump. they really did. and the ones i've talked to -- not my client but others -- they now realize that, i made a mistake. i put my faith in a man who took advantage of me. and now look where i am. i am about ready to go into a jail cell, or i'm in a jail cell. so i think a lot of the people who were prosecuted by the justice department for january 6th are feeling that, maybe donald trump should be the person who should be in jail, not them. >> we'll see how it foreshadows the indictments that are already there right now. there are a number of codefendants and unnamed, unindicted coconspirators who didn't necessarily enter the capitol per se, but there are issues in other cases. everyone, thank you so much for joining. there's a new development in that massive dock brawl. you know the one i'm talking about. you see it right now, you've seen it over social media. and there is something that's being told to investigators that one witness is saying, that there were racial slurs. i'll talk to the police chief. plus breaking news tonight out of ecuador. a presidential candidate has been assassinated at a rally just ten days before the election. next, cnn is live in hawaii where fires are so catastrophic that some are jumping into the ocean to try to escape the flames. >> lahaina is on fire. oh my god. ♪ (upbeat music) ♪ ( ♪ ) ( ♪ ) ( ♪ ) -awww. -awww. -awww. -nope. >> reporter: the attack happened right after the presidential candidate had finished a rally at a school in quito, ecuador's capital. all of a sudden a burst of gunfire was heard as he was getting into a waiting vehicle. several people were hit by the bullets, including fernando villavicencio, a 59-year-old activist, journalist, and politician running in the presidential elections to be held in less than two weeks, august 20th. current ecuadoran president guillermo lasso said on the social media platform formerly known as twitter that he is outraged and shocked. he called the attack an assassination. lasso expressed solidarity and sent his condolences to villa vee sense i don't's wife and sars. he vowed this crime will not go unpunished. lasso head the security cabinet was about to meet at the presidential palace. lasso acknowledged organized crime has come a long way, but at the same time he promised the full weight of the law will fall on them, meaning the criminals. >> rafael romo, devastating news. thank you so much. now hawaii where devastating and deadly wildfires are sweeping across maui. the normally beautiful island of maui now looking like a hellscape. winds from hurricane dora are helping to fuel those flames, which by the way are still not contained. the damage so far, it looks catastrophic. the hawaii resident who filmed this drone video saying, this has been the worst day in maui eshistory. it is so severe, officials are monitoring for possible riots. i want to bring in cnn's veronica miracle on the island of maui. at least six have died so far. what is going on to get these fires under control? >> reporter: laura, absolutely devastating. there are three fires that are burning right now. officials, first responders contending with so much, especially because right now there are still search and rescue efforts under way. six people have died, but there are still others that are unaccounted for. thousands of people are trapped in lahaina. i want to show you one of the three fires that are burning. it's hard to tell from here. usually what you'd see is the beautiful mountainside. now it is covered in smoke. that's one of the fires that are burning. 30 minutes from where i am this way, that is where lahaina is, that's where some of the most severe damage and destruction have taken place early this morning. an entire front stretch historic area had been destroyed. there's one road in, one road out. that road is shut down, only for emergency vehicles, which we've heard sirens throughout the afternoon, as well as people bringing in supplies. the other way you can get there is by sea. you can see exactly how choppy, windy it is here. some excursion boats, boats that normally take people whale watching, they have been loading up with supplies. volunteers, local businesses have been bringing food and other necessities and loading those boats, and those boats have been going out all afternoon. they can't even dock in lahaina because of the fires, the dock apparently damaged by fires. they have to go around and have smaller boats meet them to pass off supplies. that's just one way that local community members are trying to help. you mentioned concern as they're trying to bring in resources, that there might be issues. however, what we have seen here on the other side of the island where people are not trapped, of course, there has been so much outpouring of support and random people trying to go what they can to get anything that they can over to those people that are trapped. tourists, residents, get them what they need so they are able to survive and also hopefully potentially get back to the other side of the island very soon. >> veronica miracle, please stay safe. that is terrifying, the pictures and images coming in. keep us posted. there's a new twist in that massive brawl on a dock in alabama. a witness is now telling police racist slurs were used. i'll talk to the police chief about all of it next. plus only two candidates have actually signed that new gop loyalty pledge. what about canned did it will hurd? tonight there's a witness. the mother of a 16-year-old white victim tells police in a sworn statement that, quote, you could hear men yelling "f that "n" word" as the black captain of the riverboat tried to move the private pontoon boat. she alleged that one of the men arrested punched her son in the chest as he attempted to pull people off the captain and that another man in the group said that he was, quote, getting his gun. three white men have been charged. i want to bring in montgomery police chief darrell albert. chief albert, thank you for joining us. we'll are captivated by what happened and the footage that has come out in this. some have gone to the extreme of caricaturizing it and creating memes. this is no laughing matter for those on the ground and who were watching this. are you hearing any what was i just described from other witnesses about racial slurs having been used? >> thank you, laura. and you know, this was a devastating incident to our community and to the nation. you know, we've been conducting interviews and reviewing tons of footage submitted to us by the public, and we've watched frame by frame to make sure that we get it right. and today we actually had that victim, that cocaptain, back in our office conducting additional interviews with him. and of course, we count on what he's saying. we believe what he's saying. what he's saying is that he does not believe it was racially motivated whatsoever. but i can tell you this. the charges that we have now being misdemeanor charges doesn't mean they will stand. if more evidence comes forward, if there's more proof that this leads toward more of a hate crime, we will amend those charges and charge appropriatelily. rate new, we're confident we're heading in the right direction with this investigation. this was horrible for the city of montgomery, for the state of alabama, for our nation. we know working with our local, state, and federal partners, we must get it right. >> the fact that we're hearing this, and i'm encouraged to know that there is always going to be the very important and prudent action of taking a second look to ensure that you have fulsomely looked at these cases. i wonder, if the attack on the 16-year-old white teenager i just described, did that factor into your decision about whether this was racially motivated, on is as you said, you spoke with the captain a second time and his conclusion was this was not about race or a hate crime? >> well, you know, laura, we look at the facts for what they are. we look at the facts, and we look at what the thresholds are to charge persons with a hate crime. and again, we leaned on the federal bureau of investigation for advice on this. we've talked to our state partners and our local district attorney. so we've exhausted not only the internal measures, but we looked outside so that we can make sure we charge appropriately. as more evidence comes forward, as we interview more individuals, those charges can be amended and there will be more charges. today the two subjects that were still outstanding, that had not turned themselves over as of yesterday, they turned themselves in today. we have those individuals in custody now. there's more warrants being issued today. we'll continue this, and whatever this investigation leads to, we'll make the appropriate charges. we'll keep the public and nation informed, because again, this was a horrible incident for our city. montgomery is better than that. we are a great city. we have great things here. this is the birthplace, if you will, of civil rights. we know how contentious this was back in the '60s, '50s, the '70s. we don't want to go back to that. we're going to make sure we're going to get it right the first time. so it's going to be a slow and methodical process to enshure justice for all. >> that is what the pursuit of justice requires. chief darrell albert, thank you for joining us this evening. up next, everyone -- fox news hosts, they really, really want donald trump to show up at their debate. really, really want him to show up. we'll show you the tape in just a moment. plus presidential candidate will hurd is joining me live on whether he will sign that gop loyalty pledge that just came out. i think i might know the answer but we'll ask him nonetheless. downy protects fibers, doing more than detergent alone. see? >> it would be great to see donald trump and ron desantis and chris christie just duke it out. that's why they call it a debate. show up. debate. and shine. this is his big chance. if he's thinking he's going to get the nomination, the best thing to do is go into training. i would take the reps as much as possible. >> if you want to be president again, you've got to come out and face the debate music, haven't you? come on, donald. you know you want to secretly. >> this reminds me of how my husband and i will have a conversation, trying to convince our kids, we're talking about them in the room. we know they're listening. we want to do reverse psychology. it works in my household. will it work here? the public pleading after fox executives had dinner with trump after his third indictment, trying to convince him to join the debate. with me is one of the candidates still trying to get on that stage. former congressman and republican, 2024 presidential candidate will hurd. i'm so glad that you are here, congressman, although i will call you will at your request. but it feels wrong because you've been a member of congress. let me ask you, there's a lot happening. fox and many of your competitors, they want trump to be on that stage. do you think that there's a point to debating if the front-runner himself is not there? >> well, i think we should have a debate whether he's this. if he's too afraid to show up and answer for all his failures since 2016, he hasn't won an election since 2016, if he's too afraid to show up and talk about why he's only running for president to stay out of jail, that's up to him. i think everybody else should be there. there's one thing my 90-year-old father told me, don't be desperate. if he's too afraid to do it, then fox needs to go on with everybody else. >> one of the people in the debate you would want to be there is you. eight candidates have met the voting and polling thresholds for the debate. are you any closer to joining that debate stage? >> i'm closer. i'm kneeling confident. i've got one more pot to hit the polling requirements. i'm close to the 40,000 individual donors. if your viewers want to help see someone like me be on that debate stage and call donald trump out and call everybody else out for kissing donald trump's butt and being afraid to be tough with him, donate at least $1 to help me get there. i'm feeling good about getting close. this is about not being afraid of donald trump but also articulating a vision for the future. >> the latter part, there has been an overwhelming focus on donald trump and his legal woes, with good reason. you're talking about a twice-impeached, thrice-indicted former president, maybe a fourth one on the horizon out of georgia. there's been a lot of focus, but many candidate dates have not been able to fully articulate before a keenly interested audience about the policy positions that you hold and what you hope to articulate as a vision for the future. but even having said that, there is one person, the first gop candidates to sign the rnc pledge to support whoever the eventual nominee will be. this is a requirement, as you well know, for anyone who wants to be on that debate stage according to the rnc. assuming you're able to make it to the stage under the other criteria, are you willing and do you intend to sign that pledge? >> i'm not signing the pledge as is. i've said that at the very beginning. i can't lie in order to get access to a microphone. i want to hit the requirements in order to force this issue. what's fascinating about all of this is donald trump is the one that wanted this pledge because he wanted everyone else that was running for president to bend a knee to him if he was the winner. now he's saying he's not going to sign that pledge. >> i want to play that for people listening. he was just talking a short time ago about this issue. listen, and i'll have you respond. >> i wouldn't sign the pledge. why would i sign a pledge? there's people on there that i wouldn't have. i wouldn't have certain people as, you know, somebody that i'd endorse. they want you to sign a pledge. but i can name three or four people that i wouldn't support for president. so right there, there's a problem. >> what do you say to that? >> well -- this might be one of the few times that donald trump and i agree. because my issue is not with the -- not with supporting a republican nominee. my issue is with supporting donald trump. he's a national security threat. and you've talked about all the baggage. if republicans want to actually win, if we put donald trump up as our nominee, we're going to give four more years to joe biden. we need someone who's going to be able to grow the party with independents and democrats that are frustrated with the direction that joe biden has taken the democratic party. and this is what we need to be having. and if folks want to see how this unfolds, hurdforamerica.com, give at least $1. >> i am curious about your take, having been a member of the intelligence community. what happened in utah, the idea of somebody being sought to be arrested, ultimately killed in a plan it seems to try to assassinate the president of the united states. also threatening in some way those who are prosecuting the former president. what do you make of the rhetoric that may have led to this moment for this individual? >> thank you for having me. since my involvement in the case, they have not been contacted. i must note, the order that was granted today was very pro forma. i know it's being made out to be this big thing. the prosecution was gonna get this order, come heck or high water. this order was not granted, it was an immediately appealable issue. pretty standard order in any kind of dna case, where they have that kind of evidence, the defendant is required to give non testimonial evidence against himself, subject to constitutional limitations. that's what happened today. >> that's a great point, i'm glad you raised it, to make it very clear. your clients are the children of this suspect, who is presently in custody, have they consented to providing cheek swabs as well? do you find that odd? do you find an impetus behind something more of an investigation? >> i think it's more of a footnote, you could say, in that order. the order, again, criminal procedure law in the state of new york is very clear. it has to do with the defended himself, and what kind of evidence he may be required to, upon the prosecution's motion to provide. that's all the motion dealt with. they are prior consent, whether or not it was granted, whether that was taken, whether that was given, a sort of a side note. going forward, however, any such testing of any kind of blood, hair, materials, dna for my clients, would have to go through us. we don't know, as we said here today, whether not that request would be complied with, consented to, or anything else. we've never received, it when and if we'll do that, we crossed that bridge when we get there. >> have your client spoken with their fathers cinci's been in custody?
