on the boat dog. why the whole country seems to be talking about what happened when a black co-captain standing on that dog, pre faced an unprovoked attack by a mob of white folks for asking them to move their pontoon boat, please say. >> as the co-captain approached the dock and attempted to peacefully move the boat over, just so that they could park, the owners of the boat confront them in a hostile manner. there were words exchanged and then it turned into the combat that you have all seen. so the co-captain was doing his job. >> now we have an interview with the montgomery police chief in a bit and we will -- will more charges becoming, or talk about it ahead. but let's begin with our breaking news this hour. cnn projects that voters in ohio have rejected a measure that is seen as a proxy in the battle over abortion rights. they voted down in effort to make it harder to amend the state constitution. the head of november referendum on whether to constitutionally guaranteed abortion rights in that state. it sounds a bit confusing but we are going to explain it all, at least we have people who can do that for me. tonight we have cnn political commentator jeff duncan, the former republican lieutenant governor of georgia, and harry enten, cnn's senior data reporter and lauren leader cofounder and ceo of all in together. plus, cnn political analyst coleman hughes, host of the podcast conversations with coleman. all right, here we go. so let me first ask you, harry, about what this vote meant because it was a vote no, but it meant that you have a yes when it comes to abortion rights. >> very bizarre, right? confusing all around, but i'll explain it this way. pro abortion rights advocates got a ballot measure on the ballot this upcoming november in which a yes vote which essentially mean that abortion rights would be legalized in the state of ohio. at this point, the law is that you need 50% plus one for a ballot measure to pass, so tonight, what happened was that republicans, conservatives, decided to put a ballot measure on the ballot in which they tried to say no, it is not 50% plus one that you need, it is 60 plus one that you need. so all of a sudden they were like okay we want to raise that bar for that abortion measure come november. so, in this particular case the no vote was saying no we want to keep it at 50% plus one and what we saw was overwhelmingly the voters in fact -- >> so a simple majority versus a supermajority. >> exactly right. >> what did the numbers look like? how big did this go towards saying we want to keep the constitution the same? >> it was a double digit blowout. right now you can see that what we are looking at, essentially, is a 13 point margin at this particular point and keep in mind that donald trump won in the state of ohio by eight points. so all of the sudden you had a really red state, in ohio, that voted for donald trump by eight points saying no by about 13 points and no one in this particular case is a proxy for saying that abortion rights in the state of ohio are popular by 13 points. >> there is a lot of money spent to try to show voters what this really meant, because it is a bit confusing. lauren, i want to ask you what the thoughts are on how potent this issue is. what does this tell us about how important this issue is to americans? >> over and over again we have been hearing -- since the dobbs decision saying that this issue is going to fade into the background, it's the economy, and other issues. we heard that going into 2022 midterms, they've been wrong again and again. this is the most salient, galvanizing, political issue for women on the left, but also increasingly from our poles, for independent women, which is why it is so powerful in states like ohio. what we saw in kansas, every single place in the country where we have had a ballot measures since dobbs, asking voters what they want in terms of abortion rights. they voted in favor of abortion rights. and the fact that otin ohio is such a blowout, to your point, it was not even close. in an august of the cycle, single vote election, which was intentionally held in an off time when peop on vacation to try to kee away from the polls and yet, folks turned out. i think that when we get into the data and we start seeing what that looks like and the exit polls, we'll get a better sense of it. but there is no question, in our polling, poll after poll, abortion and guns are the two top issues for women voters going into this election. and the last thing that i will say on this is that there may be annex of suspected consequence of dobbs is the extent that voters are paying attention to state politics. ohio has been a place where democracy has been dying in darkness for years there. a lot of gerrymandering, gamesmanship in the state legislature. suddenly, since dobbs, there and states around the country you are seeing voters hyper focused on statewide elections that is going to rewrite the map in a lot of ways for years to come. >> i'm curious, jeff, about what you think about this. is this a mistake for republicans to focus on abortion because of some of the numbers that you have seen a year? i do want to throw up a full screen to give you an idea of some recent polling that we have done. 64% of americans disapprove the overturning of roe v. wade. when you look at those numbers it is democrat and independent voters who seem to be the ones who are up for grabs, if you will, on this issue. they are saying, look, this is important to, us we really, really are going to pay attention to what people are saying about this issue. should republicans be pushing this issue if they are running for state office? if they're running for federal office? >> i think it's important to recognize that democracy was put on display here. the supreme court to push this back to the state and each state is going to have their own personality, their own leans towards policies one way or another. oh hines spoke and they spoke loudly, with which direction they want to go in. also, these constitutional questions are really, really confusing's. when the most confusing that i dealt with in state government is how you actually write the question, are you present double negatives, how it is delivered out to the populace. from a republican standpoint i feel like this issue, we need to do a better job of being empathetic. we need to do a better job, regardless of pro-life or pro-choice, we need to understand that single teenage girl who is pregnant and worried, we need to be empathetic and understand rather than just trying to preach, we need to understand. i look at georgia. we passed a heartbeat bill, stacey abrams use that as her cornerstone issued beat ryan camp because it was not trying to go out and point fingers and make a point out of it, he was simply trying to pass foster care legislation to make things easier for the adoptive process. >> coleman, every state in the country, that was before dobbs. and i think the rules have been completely written and across the board this is an absolutely -- for republican and you look at like what a liability is becoming for people like ron desantis's who are committed that they were not change the laws in the state of georgia. then against the will for the vast majority of them voters in the state of florida it passed an extraordinarily restrictive bill. and that is what we are seeing, where it is passing it to passing against the will of the majority of folks in that state and even some republican lawmakers, especially women lawmakers, are saying that this is a loser for republicans. americans don't want this and it is hard, i think, for republican legislatures to catch up to how much the national sentiment has changed since dobbs. it is a totally different world from a year ago, the politics have shifted. >> coleman, do you think that this is going to continue to be the thing that propels people to go to the polls. one of the big issues that they are going to be concerned about when it comes to 2024,? even >> i think that if we learn anything tonight it is that there are a lot of independents and even some republicans who, they like republicans on crime, and on immigration, but on abortion they really prefer the compromise position that abortion should be safe, legal, and rare, and legal throughout the first trimester. so i think we are going to keep seeing these people and their vote mattering in certain instances and, like you said, this could become a losing issue for republicans. >> you did see some people pulling back from that, harry i want to talk to you about what ed since the supreme court overturned dobbs. what has been happening across the country? how many places have come up with a trying to change things in their state legislatures and rules and have been knocked out? >> yeah, we have had six ballot measures since roe v. wade was overturned and when it came to abortion sentiment. and every, single one of those instances the pro-abortion rights side one. and we're not just talking about blue states like vermont and california, we're talking about red states. we're talking about places like kansas, places like the dakotas. we have seen montana, all of this type of stuff where we have seen clear instances in which abortion has been put on the ballot and, in those particular cases, what we have seen is the pro-abortion rights side has one and another little nugget that i will drop in here is that i was looking at the polling and i was looking at the voters who voted for barack obama in 2012, and then voted for trump in 2020. those voters who are key to trump's coalition, come next year, or actually more in favor of abortion rights and against them. it's something to keep in mind. >> that's fascinating. i want to keep the conversation going. however, we are getting this new information about georgia and the potential that there may be another case coming down the pipe for fulton county and the dea there. this has been talked about by donald trump ad nauseam, there is some fallout from the beginning, how are you feeling about all of this? do you think she is going to bring charges in this case? >> well, certainly, the news broke yesterday that i actually did receive a subpoena for the additional grand jury that is going there, so i am eliminating want to speak about. but certainly, it is turning that direction. it is certainly that duffy's had months if not years to pull all of this together. i think it is not only going to be when but who, and all of those details around it. so much of this as we unpack this, it just solutions and sort of problem that started in the oval office. i mean, that is really what this is all about. dream up some crazy concocted idea and then go try to find micro points and facts and descended tweets and create a ground scurry. that is what we saw play out and it literally captured the attention of an entire party and even in years removed were still affected by it. >> i'm curious, are you talking about donald trump doing it or are you talking about the biden administration doing that? >> i'm talking specifically about the 2020 election cycle and donald trump in the oval office. in his administration, to watch that continue to stir the pot and put us in such a bad political position where we are today. it should be the easiest election cycles for republicans to win the white house, statistically speaking. it should be a layup for us, but we continue to put the weakest person, in my opinion, on the top of the list. but we still have time and there is a lot of work to be done. >> do you think he has any chance of winning if he becomes the nominee? >> i do not. i think it would be the biggest gift ever, every dollar written to donald trump goes, in my opinion, directly to joe biden's campaign. >> jeff? >> diminishing returns on donald trump for years and he is not gaining the electorate in any of this. you could talk all day long about why corbin maga voters are unperturbed by these indictments, but fundamentally he cannot grow a share of the electorate and that's why i think anyone who looks at the numbers the says that there is no universe in which donald trump can beat joe biden. but something that decide, georgia is really interesting. so much of what the president has been claiming is that he can't get a fair trial and grand jury in the washington d.c. because it is a blue city. now he is potentially the case going before a georgia grand jury. completely different political landscape, it is a purple state, democrats narrowly run this state. it is going to be very hard for him to make this, but it will be very hard. and ultimately, this is a jury that will decide this. fani willis is serving the people of georgia who faced the disenfranchisement of their vote. >> i have something stuck in my throat. lauren coleman, harry, jeff, i think i got it all right. thank you so much of that for that great discussion. i'll try to stop choking on myself. i appreciate you guys having that discussion, just ahead, the montgomery alabama riverside doc brawl. the video has gone viral and people across the country are talking about it. up next, a one-on-one interview with montgomery's police chief. we will hear directly also from an eyewitness who shot kyiv idiot of that melee. ♪ (upbeat music) ♪ ( ♪ ) constant contact's advanced automation lets you send the right message at the rightime, evertime. >> well, i tell you, we looked at it internally. we looked at the entire case in it's totality and we looked at the merits of the case and we not only talked about these internally, but we have reached out to a local state and federal partners to say that we are heading down the right path, that we are a prying appropriate charges and based on the matrix for hate crimes, it just did not meet that threshold. i will say that this investigation is ongoing. i know you heard that, and the community has heard that over and over again, but it is ongoing. as new developments come forward we will and then charges as necessary, or as needed. so we continue to ask the public to provide those pieces of video, surveillance tools to come forward, and be good witnesses for elsa so that we can continue this investigation and let it go whatever path it takes. if it rises to the level of hate crimes, then it rises to the level of inciting a riot, or whatever that look like. we will do just that. so, hats off to the community, hats off to everyone who participated and got themselves involved and talked to the montgomery police department and gave that much needed video and witness statements to help us properly charge at this time. >> i want to ask you about that. had that video not surfaced, had that not been the start of what appeared to be the start of it, and how it all began, do you think the police would have had the tools to arrest of the right folks and all of this? >> well, you know, what we did was detained 13 individuals on the spot. those 13 individuals were brought over to police headquarters and interviews went on for hours and hours. at the time we did not have the luxury of all the videos that we have seen now that even i have all seen and that the world has seen. basically what we had was witness statements and he said she said. so our police officers and detectives had to decipher all of that and then apply the procreate charges at that time. again, as we gained more information and get more video, as we talked more individuals as charges to be amended then they will be amended appropriately as necessary to make the final judgment on this case. but, again, that is not indicative of what we are here in the city of montgomery. we strive hard to be a fun community city and we just love all of the things that we have going on in the city at this time. there is a lot of growth, there is a lot of visitors coming here to see what the city asked offer and this is not going to set us back. this is something that will help us get through this and move forward, move forward as a city, move forward as a group of people that is here to help each other and love and learn and enjoy our city. we welcome folks to come, montgomery's open. this was an isolated incident and again we are going to move forward from this. >> can you tell, me, sir where arrests might happen? because it is terrifying for a lot of people going into the, water especially after the movie jaws in the 70s. we all had this sort of real fear of sharks especially -- even because doesn't have not often. >> sarah, it's a great observation. first of all, when peter ventrally wrote jaws, which was a huge commercial hit and of course the movie was even bigger, he immediately, when that movie came out, he immediately regretted writing that book and became an advocate for shark conservation because -- i remember at that time i, was a little kid when that came out, and everyone was terrified to go into the water because of this book. the other thing that you touched on, which i think is so important, is that sharks are what we call a sentinel species. they are the aquatic canary in this oceanic coal mine around us. when we see sharks they indicate, as an indicator species, that an ecosystem is healthy. when ecosystems collapse they can no longer sustain their apex predator and we lose those sharks. so it is actually a nice sign. of course, you don't want to be on the wrong end of a shark, so there are things we can do to avoid that, but having sharks around is good for our ecosystem and it tells us that things are in a good place environment really. remember this, sarah, i don't know if this gives you comfort or not, but when you are in the water, whether it is new england or new york, new jersey, and that is a nice clean, pristine beach, you are never more than 300 feet away from a shark. hopefully that will put you at ease tonight. >> this might be controversial, but i'm actually not afraid of sharks. i groping florida, different things were just interesting to me. maybe that is not good on my part. but i want to ask you, what do you do to try to not attract sharks? should you stop the splashing around? what can you do? >> it's a great question, and before i touch on that let me go back to the conference of asian story. while we are seeing an increase in shark populations. the great whites are here because of the seals and other things. around the world it is a different story. we have lost sharks because of ecosystems collapsing, and from the black market wildlife trade. last year, over 100 at 100 million sharks were killed. so what do we do? what are the chances of something going south with a shark? you have better chance of being struck by lightning twice in your life than being attacked by a shark. it is incredibly, incredibly rare, although probably in florida you have a better chance than anywhere else to be struck by lightning. so what is happening now in our environment. why could these very rare, negative moments, these encounters with sharks happening off the coast of the tri-state area? one reason is that it is the time of year. all the bait's ear. i am a voracious fishermen and i go out to look for the bait to go catch the -- antuna. those sharks argue to capitalize that on that debate and on the fish that eat the bait. also, we have had tons of thunderstorms and environmental instability that literally creates a soupy environment. so lots of washout from storm drains, low light conditions, that increases the conditions for a very rare negative encounter with a shark. so in those situations i am just very careful when i'm in the water. >> when it looks all muddy and soupy watch out, and don't swim near fishermen is what i've learned. you also might get hooked. >> and florida, that is actually very true. because there is so much competition on these fishing grounds and the shark population has exploded, the fish population is shrinking, and there is a lot of competition. you very well could catch a fish, put it in the, water and then be inside a shark. >> i'm glad i'm inside, you're talking about getting struck by lightning. it happens more than getting bitten by a shark. jeff gordon, it's always wonderful to talk to you, thank you so much for coming. on >> my pleasure. >> up next, the man who shot megan thee stallion back in 2020 is sentenced to ten years behind bars. that story, when we come back. s my third time selling to carvana. yoyou just enter your license plate or your vin, ananswer a few questions. boom, yoyou get a real offer. sell your car to carvana today. introducing the limited edition disney collection from blendjet. nine exciting designs your whole family will adore blendjet 2 is portable, which means you can blend up nutritious smoothies, protein shakes, or frozen treats, just about anywhere! recharge quickly via usb-c. it even cleans itself. order yours now from blendjet.com and bring a little disney into your life. try killing bugs the worry-free way. not the other way. zevo traps use light to attract and trap flying insects with no odor and no mess. they work continuously, so you don't have to. zevo. people-friendly. bug-deadly. recording artist tory lane the man convicted of shooting megan thee stallion in the foot in 2020 is sentenced today to ten years in prison. back in december, los angeles jury found lanes guilty of three charges, including assault with a semi automatic fire arm. the megan thee stallion accused lanes of shooting her in the foot after she exited a vehicle following an argument. megan thee stallion facing an unbelievable amount of criticism. her critics did not believe, or spread false information, attacked immersive bully even though she was the victim in the shooting. stli addressed the shooting to all makes-ing saying that as i reflect on the past three years i view myself as a survivor because i have truly survived the unimaginable. thank you so much for watching, our coverage continues. with new scope squeez mouthwash concentrate, just add water. squeez to control the strength of your mouthwash. and find a zone all your own. ♪ ♪ scope squeez. ♪ (upbeat music) ♪ ( ♪ ) constant contact's advanced automation lets you send the right message at the right time, every time.
