Attacked a black dock worker. Authorities are about to update us on their investigation and we are live in montgomery next. Also happening this hour, biden is expected to announce is new National Monument at the grand canyon that will block, among other things, uranium mining. We are going to tell you whats behind the slow progress on the battlefield. We are following major developing stories and many more all coming in right here to Cnn News Central. Here in moments we are going to hear from Law Enforcement in montgomery, alabama, for an update on their investigation into that ugly Waterfront Brawl that went viral on social media. It started on saturday when a group of white boaters appeared to attack a black dock worker over a boat, their boat, that was parked in the wrong place. And this led to a huge fight there on the dock, disturbing footage of the incident like the video that youre seeing quickly spreading online and Police Issued multiple Arrest Warrants following that. We have cnns ryan young at the News Conference which is going to begin any moment. Hes joining us now on the phone. Ryan, any idea what we are about to hear . Reporter yeah, any moment now the mayor and the police chief will be stepping to that podium right there to have that News Conference. They will be addressing all the rumors that have been out and about on social media. They also had the help of the fbi as well in this case. In fact, they are walking toward that podium even as i speak. Were hoping to learn from their investigation exactly what they were able to learn the last few days and the arrests they expect to make. In fact, the mayor just stepped up to the podium, i will let him take over at this point. All right. Mayor steven reed. Lets listen in to this. Good afternoon. Im glad all of you are here today to join us. I want to thank all the members of the city of montgomery, Montgomery Police department, Montgomery Fire and rescue, all of our employees, as well as everyone in our community that has been so helpful regarding the situation that brings us here today. As you all know we had an unfortunate event to take place over the weekend downtown montgomery on our riverfront, something that was brought on by reckless individuals who did not use good judgment and caused an event that certainly was avoidable. That said, the Police Department reacted very swiftly, very intentionally to address the matter, as did other citizens in the community. And so at this time we wanted to bring forth some information that we did not have as our Investigation Continues to report to the public. So i have with me chief Darryl Albert, the chief of the Montgomery Police department, who will update you on the status of this event and how things are going in the investigation at this point. But, again, we want to thank all the members of the public, all of our first responders, everyone who has been helpful, witnesses, in bringing forth the information that we have. So at this time i will turn it over to chief albert. Chief . Good afternoon. Again, chief Darryl Albert, Montgomery Police department. Now, i will kind of lay out the facts as we know them now regarding the incident that took place on saturday, august 5th, 2023 at 7 00 p. M. There were several events taking place on our historic riverfront. Positive feedback regarding a school event hosted by montgomery Public Schools was taking place at the amphitheater and nearby train shed. The Harriet Ii River Cruise Ship was fully operational, operating from a designated docking space along the river. The harriet takes passengers on twohour tours up and along the Alabama River throughout the day. On this day there were 227 passengers aboard that vessel. The incident occurred between the cocaptain of the Harriet Ii Vessel and the private boat owner and his family. As the harriet attempted to dock in its designated space, designated and reserved due to the gangway access as well as the mooring requirements, the private boat was docked in its space, prohibiting safe docking of the harriet. The captain of the hairier repaired away from the dock for nearly 40 to 45 minutes as he attempted to contact the operators of the private dock via pa system. They were only responded to with obscene gestures, curse words and taunting. The cocaptain was then picked up by a separate vessel and brought to the pier in an attempt to have a conversation with the private boat owners and or have those boats moved so that the harriet could dock. A confrontation ensued between the cocaptain and mr. Picket, the cocaptain, being attacked by several members of the private boat. Several members of the harriet ii came to mr. Pickets defense, engaging in what we all have seen since on social media. I will give you a timeline as to when the calls came in and the Montgomery Police departments response. The original call came in at 7 00 p. M. As a typical disturbance. The caller who was the captain of the harriet was very calm and not in distress. As additional calls were received, at 7 15 p. M. The call was dispatched to the Montgomery Police department. 7 18 the first units, four Montgomery Police department officers, arrived on scene with three shortly thereafter. 13 individuals were detained and brought to Police Headquarters for questioning and interviews. Those interviews lasted several hours. At that time all parties involved were released pending further investigation, but were all given instructions on how to secure warrants on combatants. We have since consulted with and are continuing to work with the alabama Law Enforcement agency, our state police agency, the montgomery das office and the local office of the fbi. This investigation is ongoing and more charges are likely. We encourage to public to continue to send us additional videos or evidence relating to this case. Those can be sent to star center at montgomery al. Gov or at our secret witness 3346254000. The victims in this case, the cocaptain, mr. Damien picket, black male, and a 16yearold white male juvenile who was struck by the owners and operators of the private boat. The suspects thus far have been identified as richard roberts, white male, 48 years old, with two outstanding warrants for assault, third degree. Allen todd, white male, 23 years old, one warrant for assault, third degree. And zachary shipman, white male, 25 years old, one warrant for assault, third degree. We have instructed those individuals to turn themselves into Law Enforcement and at this time one is secured and in custody, The Other Two are set to turn themselves in within the next hour. We are also asking for mr. Reggie gray, the black male, 42 years old, who was seen wielding that Folding Chair to contact the Moebt Ntgomery Police Depart for further interviews and as part of this investigation. As the man said a minute ago, this investigation is ongoing and more charges are likely. We want to thank the public and the media for supplying the much needed evidence and Video Surveillance that we have received and that helped us to determine the facts as they happened. Keep in mind, when the incident took place, when it initially took place, the Police Department didnt have the luxury of the videos that we all have seen now. The Police Department was acting on statements and witness statements that occurred as we arrived. Now that we have more information, again, more charges are pending. I am available to answer your questions, but that sums up where we are at this time. Sir . Can you identify who has turned themselves in . Not at this time. We know one individual was turned himself in, he is in the custody of the selma Police Department. Again, i have worked with the selma Police Department and we have been working very closely with the chief over there and the chief contacted me just prior to this Press Conference and said one individual was turned himself in and The Other Two are set to turn themselves in a little bit later. Now, the issue is we had multiple addresses in selma and in orange beach. So locating these individuals were a little bit challenging, but now we have made contact, we should be and will be bringing those individuals here for justice. Sir . Saturday night there was some video that showed some individuals being led away in handcuffs. Were those folks detained . Were they released a little later . So on the night of the incident the Montgomery Police department detained 13 individuals for questioning and for further investigations. Those individuals were transported to Police Headquarters and which at that time we were able to gain the much needed information we needed and provide them with information on how to secure warrants for the information and for the acts that you saw live on tv. [ Inaudible Question ] can you identify yourself . Reporter ryan young, cnn. Thank you. The cocaptain, again, as the cocaptain approached the dock and attempted to peacefully move the boat over just enough so that the harriet could park the owners of the boat confronted them in a very hostile manner, there was words exchanged and it turned into the encounter that you all have seen. The cocontain was doing his job, trying to move the boat just enough to where the cruise ship could park safely in its identified location, however, it quickly escalated into a fist [ Inaudible Question ] so as it relates to racial epithets in conversation and names being called, while the harriet was still out in the water there was a lot of obscene finger gestures and comments and innuendos made at a distance. Of course, when the cocaptain approached that continued, but, again, working with the local fbi, we did examine if there was enough to file Hate Crimes Charges on this case and, again, we rely heavily on advice from the fbi. Weve also looked at what it takes to elevate this to a riot or inciting a riot. Weve worked with our local District Attorney and it didnt fit the criteria for that. The charges that we have pending assault third are appropriate charges for what weve seen and the behavior weve seen on social media. [ Inaudible Question ] the four parents we secured are all members president pontoon boat and the attack on the cocaptain and there was an attack on a 16yearold employee of the smaller vessel that took the cocaptain from the hairier to the dock. That 16yearold was assaulted by one of the members of that pontoon boat. His mother went and signed warrants on one of those individuals. That individual was a 16yearold white male employee of the smaller vessel that was operating in the river at that time as well. [ Inaudible Question ] yes. So assault third is Misdemeanor Charges by statute and the names of the individuals thats wanted is richard roberts, roberts, a white male, 48 years old, he has two parents pending for assault third. Allen todd, todd, 23yearold white male, has one warrant pending. And zachary shipman, shipman, white male, 25 years old, he has one warrant pending. Reporter also weve been hearing that there was also possible previous incidents with these boaters. To your knowledge was there any previous incidents with these boaters and the Riverboat Crew . We have no knowledge at this time that this was something that was continued from prior incidents. This was a standalone incident, again, that was brought to our attention and we acted on information we had. [ Inaudible Question ] i can tell you we looked at every avenue. There was no stone unturned. We examined this over a period of time not only that night, but since that night. At this time based on where the statutes read and the way the laws are crafted, we were unable to present inciting a riot or racially biased charges at this time. [ Inaudible Question ] im sorry . Okay, the smaller vessel which i mentioned in which the cocaptain was moved from the harrier harriet to the dock was moved by a smaller vessel, a smaller vessel operated independently in the river was able to pick up the cocaptain and bring him to the dock so that he could work on moving the boats that were impeding the docking of the harharriet. [ Inaudible Question ] i do not have the information on the defendant that turned himself in. We do know that one has since then taken into custody by selma pd and The Other Two are in Route To Selma now to turn themselves in and of course the Montgomery Police department will do that transfer of those suspects to be transported here to the city of montgomery. Can you describe the signage at the dock there . So there was no signage at the time, however, the mooring area for the harriet is welldefined by the dock itself, the area thats cordoned off, as well as the large poles that the boat ties off to. And, you know, what we do is the harrier is parked there all the time, that boat is out there all the time, the individuals that utilize that river and that dock are very familiar with where that larger vessel is required to dock because of the mooring thats set up, as well as the Gangplank Areas that needs to be utilized to get those passengers on and off the vessel. All right. Youre listening there to police chief Darryl Albert talking about this brawl that we saw happen in montgomery, alabama, there on the dock and explaining what had happened which has now been pretty wellreported but this is really the beginning of the violence of it. These are private boat owners and their Family Members attacking a boat cocaptain. This was a boat cocaptain who had gone from a steamboat that is normally parked there and traverses the Alabama River frequently. We did learn, though, jim, that there are no hate crimes at this point that they are pursuing. Three men charged with assault, no hate crimes, and also he said it did not meet the standard for that is correct the threshold nor for incitement to riot, which were other charges that they considered. Lets bring in joey jackson our legal analyst to talk about this. Joey, what did you think . Yeah, i thought that the police apparently are at the initial stages in my view of investigating and making assessments as to whats what. I glean that from the notion, brianna and jim, that theyre asking if there are additional videos or any other information out there. At that time they will assess based upon the videos and what they show in terms of conduct whether anyone else should be brought to justice. Ive also gleaned from it that there are three people being charged with assault in the third degree. What does that mean . In alabama, like many other states, you rate the degree of assault predicated upon the conduct shown. As the Police Captain noted, brianna and jim, what had occurred with the assault three is that assault three is a misdemeanor, that means its punishable by up to six months in jail, generally an assault three means there are no weapons involved, but you do intend to cause physical injury and physical injury indeed has been caused. And so i think at this point they also alluded, my third take away, is what you both spoke about and that is not no hate crime at this point in order obviously for there to be a Hate Crime Determination it would mean that they were able to assess that this was motivated by some type of hate based on race. Right . That would be a critical component. They have not yet made that assessment. As it relates of course to the issue of not only hate crime, but the issue of inciting a riot, the final piece of this, is that theyve made an assessment that no one at this point engaged in conduct that showed that they were intending for people to get involved in a situation that would involve grave danger to others, that is, there is not a ring leader they can point to at this time that had the purpose and the objective of causing that. So at this point they have the people in custody that they do, i assume they will conduct a further investigation and if theres any other people that need to be brought to justice in conjunction with the Prosecutors Office they will bring those people to justice and charge them appropriately with facts that fit the crimes. The police chief, albert, of Montgomery Police indicated one of the suspects that was turning themselves in, if you were representing these people would you recommend, i imagine, that they would turn themselves in . Well, i will tell you why thats important, jim, its important because it goes to the issue of bail. You know, in a case like this certainly if they are Misdemeanor Charges you are not going to generally be held on a significant amount of bail or bail at all, but if you are wanted and you are a fugitive from justice you would give yourself an opportunity to turn yourselves in. You cannot argue if you do not turn yourselves in and the police have to get you that you are not a flight risk. I think that charges you always when you turn yourself in have the ability to hire counsel, have the ability to move forward with the charges and make whatever defenses you think are appropriate including selfdefense or anything else. I think its important to face the charges headon and our courts in any state, this being alabama, entitle anyone to due process and that due process is indicated in a court of law. Reporter yeah, House Speaker Kevin Mccarthy has gone to Great Lengths publicly to make it clear he has not announced an Impeachment Inquiry into President Joe Biden just yet, but he has walked right up to that Line A Number of times and Behind Closed Doors a number of republicans are telling cnn that they expect this is inevitable. One republican saying, quote, once the barn doors are open, so to speak, the horses are out. Here is the challenge, though, for Republican Leaders over the course of the next several weeks, they have to convince a number of their members who won in districts that biden won back in 2020 that this is a smart electoral move for them because usually when you open an Impeachment Inquiry, you have a vote on the house floor into that matter, and House Republicans have just a narrow majority which means mccarthy is going to have to convince his members to get behind this push. One of those members who won in a biden distri back in 2020 don bacon had this to say. Quote, did the president commit High Crimes And Misdemeanors . The committees need to do more dig to go clarify this. Theres tons of smoke but lets verify whats beneath it all. Many House Republicans who support this effort say opening an Impeachment Inquiry gives you more tools to get documents, to get witnesses, to get information where they will try to directly tie President Joe Biden to his son Hunter Bidens Business Dealings abroad. So far both investigations in the oversight and judiciary committees have not been able to find that direct link, but their argument is an Impeachment Inquiry gives you more power to do that. Whether or not that is a convincing argument for some of those more moderate members that remains to be seen. How many moderate members are we talking about here who are considered swing votes on this among republicans . Reporter well, the number of swing votes varies but there are 18 House Republicans who won in districts that biden won in 2020. So that gives you a sense of how many members might be really thinking through this decision of whether or not they want to vote for that Impeachment Inquiry to be opened up. Jim . Com the federal grand jury that issued the most recent indictment against former President Donald Trump reconvened today. That indictment of course covered the investigation into efforts to overturn the 2020 election, and its the first time that this panel has met since last week when the former president was officially charged with allegedly plotting to undermine the election. Well, now theres a legal dispute on that case over evidence sharing. The two sides have about 40 minutes left to let judge Tanya Chutkan know when they can present their sides to her. Special counsel jack smith is trying to block trump from disclosing evidence publicly before trial. Hes accusing trump and his team of wanting to try the case in the media instead of the courtroom, but trumps lawyers say smith is trying to restrict his free speech. Lets turn now to cnns Senior Legal Affairs correspondent paula reid. First, what do you know about The Grand Jury meeting today . Their work continues. Thats right. The special counsel said the Investigation Continues so not a big surprise to see them show up. We know they typically meet on tuesdays and thursdays and this comes just a day after we saw the special counsel interviewing bernie kerik. He is of course the former new York Police Commissioner but he is also a close associate of rudy giuliani. The big question is, well, if the Investigation Continues, who else could be charged . We know giuliani is of course identified as coconspirator number 1. We know kerik got a lot of questions about his longtime associate, the work he did for giuliani looking into these allegations of Election Fraud but he came out of the interview insisting that giuliani will not be charged. We know he was also asked about a lot of the other key players here, notably, brianna, though, today The Grand Jury didnt hear from any additional witnesses. So its possible that they were reading in the testimony from kerik or possibly getting them ready for another indictment. Its unclear. Looking at this case out of georgia, now, an indictment on Election Interference and particularly related to trumps actions and those of other folks in that state may come down soon, thats the expectation now. Talk to us a little bit about some new subpoenas in the case. Thats right. Theres been a recent flurry of subpoenas, the latest one according to our colleagues went to former republican Lieutenant Governor jeff duncan. Now, this is significant because he has long been critical of efforts to overturn the election in that state, but lets take a listen to his reaction to this investigation. Im going to certainly keep the details to myself just to protect the integrity of the investigation, but there is a very clear subpoena that was delivered to us late last week and we will certainly answer the questions that theyve got before us and answer their call to show up for The Grand Jury. And this is one of at least three subpoenas that has recently gone out in the Fulton County investigation as we wait to see if the District Attorney, fani willis, will file charges against former president trump, but as youve heard recently even trumps legal team says they expect he will be charged in georgia. Right now polls are open in ohio for a special election that puts Abortion Rights very much at center stage in that state, even though for now that measure is not on the ballot. Follow this. Amending ohios constitution is, and todays measure would change the simple majority that ohio requires to change its constitution to a higher threshold. If issue 1 passes today a 60 Super Majority would be necessary. Thats where Abortion Rights in ohio come in, because a measure to protect Abortion Rights is on the ballot there in november, a 60 Super Majority requirement would make it more difficult to pass that measure protecting Abortion Rights. Cnns jeff zeleny is in columbus. So tell us about this race here. The effort to raise the threshold to 60 is by folks who dont want a measure passed to protect Abortion Rights. Reporter thats correct, jim, and this was an effort put forward by republican legislative leaders to schedule a special election today, august 8th. Really effectively at the end of summer as families are on vacation, getting ready to go back to school, which critics say they were trying to slip through, trying to have a low turnout election, but so far at least for a special election, even going into election day today before the polls opened, nearly 700,000 people across the state voted. And there has been a steady stream of voting here at this Polling Place in columbus, but as well as at other Polling Places were told across the state. So we will see what the exact turnout is, but what today is about is writing the rules essentially for that november question. Ohio becomes the latest state it put Abortion Rights on the ballot and deciding whether to enshrine Abortion Rights into the states constitution. Right now the state has an abortion ban after six weeks. Right. That is of course in the wake of the Landmark Ruling in the Dobbs Decision last year. When they kicked it back to the states, as we know, the supreme court, this is one of the after effects of that, but an unusual special election today to make it more difficult for the abortion constitutional amendment to pass, as well as other things down the road, like minimum wage, Marijuana Legislation and perhaps some other matters as well, jim. So let me ask you this because its interesting, that 60point new proposed threshold, how does that relate to what public polling shows support is in the state of ohio for maintaining or protecting Abortion Rights . And the 60 threshold, the reason that is interesting, jim, last year we saw several states, red states and a few blue states pass Abortion Rights amendments on their own. Just about a year ago right now kansas stunned the country by passing an Abortion Rights measure that was just shy of 60 . In kentucky the same thing, just shy of 60 . So that is why the 60 threshold was decided upon here in ohio. It is a higher burden. There is no question, a higher bar of that. Polling is just under 60 . So we will have to see if this does not pass today and there is a 60 or if it does pass, excuse me, and there is a 60 threshold this will make the november election absolutely the essential focus of the Abortion Rights fight in the states. But a twopart process here, but the idea of a sleepy Summer Election has really been anything but. Tens of thousands tens of millions of dollars, excuse me, have been spent on television ads, there have been protests, there have been very engaged electorate here. Just a short time ago, President Biden unveil something substantial funding and protections for one of the countrys most treasured natural sites, the grand canyon. The president saying that he made a commitment to the tribal communities and environmentalists who were working to protect 1 million acres of surrounding land, with a particular focus on preventing future Uranium Mines. Biden said, when he first visited the grand canyon as a young senator, an instinctive phrase came to mind. He says, he now calls the National Park gods cathedral. Preserving these lands is good, not only for arizona, but for the planet. Its good for the economy. Its good for the soul of the nation. I believe in my core, its the right thing to do. But theres more work ahead to combat the existential threat of Climate Change. And joining us is pete mcbride, hes a photographer and documentary filmmaker who notably produced the documentary Into The Canyon where he hiked the length of the grand canyon and the park and the rim. Okay. Pete, what do you think about this move . Thanks for having me. I think its great. I think its long overdue. And i think its great for two reasons, number one, it brings the native voice back to the table. This included 13 nativeamerican tribes. And secondly, i think its protective for the Fresh Water System thats already strained and stressed, part of the Colorado River system facing allot of drought, Climate Change and overpreservation. I want to show you the beautiful pictures that are yours, in your documentary, you mention the voices of local tribes. You interviewed some who would be affected by any uranium mining. I want to play this clip then talk about it. Our job at havsupai is to keep our culture and songs, because thats all we have left is indigenous people. My reservation is about 20 miles from here. And the Uranium Mines are just waiting to conname our groundwater source. And when this contamination does reach our home, there will be no more havsupai, no more of my people. Pete, obviously, a huge relief to communities like this. There are already mining sites established around the grand canyon. Talk a little bit about some of those concerns and also what these communities are dealing with. Well, the concerns are that Uranium Mines dig very deep into the ground. Roughly 2,000 to 3,000 feet deep. And the groundwater, the Groundwater Table around the grand canyon is incredibly complex. And we dont fully understand how interconnected it is to all of the springs and the and those that have shaped the grand canyon. So there are in the past, mines that hit ground award, contaminated it. And there are springs that i spent over a year hiking in that grand canyon with a colleague, and we came across it to this day because theres still radioactive and contaminated. So, theres a long legacy of problematic, contaminated Water Systems we cant afford that risk. I think a lot of the community, a. , bring the voice back to the table, have a voice at the table is incredibly inspiring. Its great to hear. Theyve been fighting for this for decades. And also, many of them live right in the grand canyon area and many of the Water Sources come from the water table. To know theres not going to be new mining is a great relief, i think. Yeah. No new mines. Grazing will be grandfathered in. Some nines will be grandfathered in. What do you say to some of the critics who, you know, the reason theyve been fighting these communities for this for decades is because theres been some opposition to them in what they want here. What do you say to the critics of what biden is doing . Ive been out with uranium miners, i understand that theres a need to find potentially Nuclear Power alternative energies in the event of Climate Change. I know we need to find power. But there is only one grand canyon that i know of, on this planet, and, of course, theres only one control river system that supplies Drinking Water to 40 million americans. And i think its too great of a risk, in we have better monitoring, better understanding of the water table to even put that at jeopardy. So, i understand peoples desire for uranium there. But in we have better knowledge, which we dont, and scientists have been working on this, Higho Hydrologists would be working on this a long time. And weve ignored the native voice. Not only that, but sacred sites in this monument. Up to 3,000. I think thats incredible legacy and incredible archaeology history of Early American grand canyon and the colorado region. No its a great point. I flew over the grand canyon last week coming from california to d. C. It never ceases to amaze. Its an unbelievable day to look at all of these beautiful pictures.
