Cnns gabe cohen is tracking the worsening conditions. Gabe, first of all, what do you see . Reporter wolf, we just had an intense burt of rain here, intense wind blowing through the last few minutes. Its gotten darker and darker here in the district, the capitol about two blocks from behind us. You know, one of the things we have heard from officials here in the district and really across the region today has been about the precautions needed to keep people safe as a storm blows through in the next few minutes. Government buildings shut down here at 3 00 p. M. Today, the federal government telling employees to go home in order to be off the roads when these intense conditions, potential rain and flooding, blow through. The wind gusts could be hurricane strength, 70 Miles Per Hour that could cause downed trees and create dangerous conditions for people across this region. We know schools, libraries, the zoo here in d. C. , all shutting down activities outdoors or satan do you think early to make sure people were not out in the elements. Weaver also seeing ground stops coming though to say airports. Here in washington, baltimore, philadelphia, its going to be a mess for flyers in the coming hours. The worst is still to come here. One would be philadelphia. D. C. , baltimore, youre in it light now, philadelphia not yet, but its on its way, all the way down to where wind gusts have been over 75 Miles Per Hour, 6 hundred,000 households are without power, and all the way from upstate new york, pennsylvania, even toward scranton, down boo d. C. , all way down to the 75 there in atlanta, georgia. Lets zoom into a couple spots. These are brief tornado spinups, not big monsters tornadoes. It doesnt matter if its over your home. Something else im very worried about is this, right here. See whats happening to that . Its call a bow echo. The wind is coming in behind the bow echo, accelerating to 80 miles an hour. Where are you there . Philadelphia is next, those gusts could be on your doorstep. Heres the weather into d. C. , baltimore, a bit of a gap through parts the virginia, and then charlotte picking up weather, atlanta picking up the wind gusts, even the thunder and lightning over cnn center has been tremendous as soon as its gone, pretty much its gone for you, but i dont want you to go outside yet, because the lightening with this weather has been behind the storm as well. The former president and his lawyers are arguing against tighter rules regarding evidence proposed by jack smith. Give us the latest, paula. As expected, the trump team doesnt want these rules to be too restrictive, but this comes just as were seeing the first investigative step by the Special Counsel since the indictment last week. We have learned exclusively that bernie kerik has been interviewed, a close associate of Rudy Giuliani, and his lawyer confirmed to us he had a lot of question from prosecutors about Rudy Giuliani, also known as coconspirator number one. Cnn reporting tonight exclusively that former new York Police Commissioner bernie kerik talked to Special Counsel investigators. It was mostly about the effort between the election and january 6th of what the Giuliani Team was doing. Reporter this is the first Known Investigative Step since the Special Counsels office filed charges against former President Trump last week. Keriks attorney saying he doesnt think that Rudy Giuliani will be indicted. No, not a chance. Reporter also tonight, trumps lawyers arguing in a new court filing that they shouldnt be restricted from talking publicly about some evidence in the election interference probe. The press and the American People in a Campaign Season have a right to know what the evidence is in this case. Reporter while socalled protective orders arent unusual, prosecutors saying its especially important in this case because of trumps public statements and how they could have a Chilling Effect like this recent social media post that red if you go after me, im coming after you. Trump also lashing out against his former Vice President , calling him delusional and not a very good person. Pence saying he would testify if asked. People can be confident well obey the law, well respond to the call of the law if it comes, and well just tell the truth. Reporter trump even attacking jack smith at a fundraiser in South Carolina just days after his second arraignment. Hes a deranged human being. There was no fraudulent conspiracy. Thats part of the reality of the defense. Biden said in November 2022 that he wanted to see President Trump prosecuted and taken out of this race. Reporter but these defenses were quickly rebutted by some of trumps former top allies. Former attorney general bill barr drawing a line between speech and conspiracy. He can say whatever he wants, he can even lie, but that does not protect you from interinto a conspiracy. All conspiracies involve speech. Reporter the trump team also bracing for a fourth indictment in as many months, this time coming out of Fulton County, georgia. Yes, i think we can expect it. Reporter from the former Lieutenant Governor got subpoenaed in that investigation, and District Attorney fani willis is getting ready to announce pont charges of trumps actions in the 2020 election in georgia. If someone broke the law in fulling county, georgia, i have a duty to prosecutor and thats exactly what i plan to do. Reporter cnn is observing additional security for the judge overseeing the prosecutor of former President Trump. This comes after he posted about her on social media, saying he wont be able to get a fair trial if shes overseeing the case. She also will be the one to decide on this protective order. Its unclear when her decision on that will come down. Later this hour i will speak with jeff duncan, the former republ republican Lieutenant Governor. Elliott williams, let me start with you. I want your reaction to part of at trump and his attorneys are claiming in this new filing just been released. In a trial about First Amendment rights, the government seeks to restrict firth amendment rites. Worse, it does so against the administrations primary political opponent during an election season when they have campaigned on the indictment and proliferated the false allegations. What do you make of that argument . Its an argument theyve been rolling out a lot, the idea that the president was empowered to speak and hes being prosecuted on the words he said leading up to january 6th. This whole back and forth is call a discovery dispute. Its not uncommon in trials to have one side say this is how we believe evidence should be handled and the other side disagrees. Theyll probably work it out in the end. Two big issues. What to make of Statements Trump has made in the past. He hasnt mishandled evidence yet, and the judge will have to assess what do we may of things that happened in the past. And then this idea of what is sensitive material. They go back and forth on how to handle what they deem as sensitive. We of we will find out soon. Shan wu, how do you balance with Freedom Of Speech with the harmful effects that the Special Counsel is warning about . Its actually a tough balance for her here. In some ways its less about his Free Speech Concerns and more about her making sure the protective order is narrowly tailored and reasonable form the random factor here is just how volatile trumps statements might be. Trumps team is actually already winning the fight here, because this is going to cause delays. The areas they want to fight about, for example, they want only Sensitive Information to be withheld. That immediately sets up who will define Sensitive Information. Until they resolved this, wolf, they cant even start the discovery. Thats going to be critical as well. Gloria, i want you to look at this tweet from President Biden is included in the trump filings. Trumps team writing that President Biden has likewise capitalized on the Indictment A Thinly Veiled reference to the administrations prosecution just hours before arraignment. This is quite a stretch. Hes trying to Sell Campaign paraphernalia in this ad. You can interpret it any way you want. These people are running against each other, so theyre going to criticize each other, but is it the equivalent of donald trump on truth social saying, if you come after me, i come after you, our calling jack smith deranged. I think the unknown here, as shan is saying here, donald trump himself. What will he decided to the at 3 00 in the morning if he has a document he doesnt like or that upsets him . What will he decide to do . The question is, will his lawyers have any control over him in that instance . The logical answer to that would be no, because no lawyer has ever had control over what donald trump does. So i think its a very tricky situation here, because what you have to say is the lawyers are saying one thing, but then donald trump is perfectly capable of doing something else. Good point. You know, paula, its really interesting. Do you see anything in this response from the trump team that would lead you to believe that the judge in this case is likely to rule in his favor . Its not a winner take all here. Theyre not that far apart. Its likely there would be a protective order. The question spoke how broad will it be . How restrictive will it be . Its likely the judge may err on the more restrictive. The question is what would be the broad parameters of the protective order. Im also interested to see how quickly she makes this decision. She didnt even give them an extension for this and wants a trial date says by august 28th. It appears the security around the federal judge has increased dramatically following trumps repeated attacks against her. Does that indicate how she might be likely to rule on all these sensitive issues . I dont think so. Look, judges dont have security under normal circumstances. They can get it for some reason. Federal judges like to put that stuff aside and rule, to the extent they can, on the facts and the law. Guys, thank you very, very much. Reporter well, its clear that the Security Services felt they needed to make this public, but the details they put out, theres not many of them. This is a woman, an informant who worked in a military Surplus Store in a Southern City on a peni peninsula. She was being asked by presumably russian enter lo fact they have chone to put out the information, and apparently messages between her and her russian correspondent suggesting that they were asking her to specify the hospital where he may have been, take pictures, so they clearly thought this was a threat. I should point out, russia has always been trying to kill zelenskyy. A lot of this occurring inside russia, is a certain persistent threat, but this is Something Different that they felt they had to talk about. What is the latest on the ground there, nick . A lot of intense fighting, but some suggestions from western officials, as my colleague jim scuitto, that weve been seeing that a sense of some frustration among troops. Theyre not able to move forward in the way they would like. A lot of this relates to mine fields weve been seeing placed by the russians, slowing the ukrainian advance, making sometimes their advances through a matter of ten meters an hour or so. Very complex and tough work. This occurs obviously with the clipping of the clicking the ticking of the clock of fears of potentially how fast they can move before winter sets in, slowing down their advance generally. A lot of expectations here, certainly, not all of them being realized at the pace that many in nato would like to see them move. Stay safe, nick, thank you very much. Jill, how significant is this foiled plot and the silence from russia on this allegation, at least so far. As nick said, theresic a number of attempts to assassinate zelenskyy before, but there really must be something about this. I was looking at the video of the woman who was arrested. Shes dressed in civilian clothes. You cannot see her face, but its unclear. When i have to say where i figure out where her town is, its east of odesa, a russianspeaking area, if that tells us anything, but not much probably. I think the significant here is that if slerchs can i were to be killed, we all know that he is the best communicator, the person who pulls the ukrainians together. There really is nobody like zelenskyy. So having him out of the picture, eliminated by russia really would be a disaster for ukraine. It certainly would be. General clark, how do you assess the threat to zelenskyy. Look, this is an active intelligence environment. There are russian agents everywhere in ukraine. The ukrainian sbu, their intelligence cintelligence agency knows this. Theyre working continuously against it, but the agencies really come in three flavors, active, backup and sleeper agent, that you dont know anything about. The sleepers get activated when you take off the top level. Theyre three deep, at least, in every position in ukraine, in all the communities, in all the agencies theres someone there, and they are very actively going against them. They have eliminated a lot of these people so far, but the work is not done. Its a real problem, wolf. They know it. Certainly is. Jill, ukraine is increase his bringing the fight to russias. Its a little hard to tell exactly obviously what russian citizens are thinking, but you would have to say the places they have hit, like the drones, especially in moscow, that could terrify some russians who would feel in the capital, with President Putin right down the road, thing would be stable and safe, but they arent. The other part of this is the more military attacks now taking place on the bridge into crimea and a couple other bridges most recently. I think civilians generally are probably shocked that this is happening, and just distraught that the war is coming home to them. That appears to be exactly what the ukrainians want to get across. That picture was one of them, philadelphia, absolutely. Down toward annapolis and the Eastern Shore. And then down into parts of the deep south. The number that you see here are the number of Lightning Strikes that just happened over the past one minute. Its a rolling tally. But in the past one minute, 804, 791 Lightning Strikes hit the ground on this map in the last 60 seconds. Thats how dangerous it is out there for some, especially pets or people that are outside. You need to be really taking cover from this type of weather. Toward binghamton and scranton, things are calming down just a bit. Into philadelphia, that box there for king of prussia, that is still a Tornado Warning for you. It was a brief spin. Well have to see if its still spinning, i dont think so, but we still have the warning going on for the tornado thats northwest of philadelphia in the suburbs. Now we move you down across parts of the chesapeake, annapolis. I wouldnt be on the bay bridge right now all the way across the Eastern Shore and parts of georgia, South Carolina and north carolina.
