To the extent that former President Trump has First Amendment rights in play here, i think the first test of people come in the context of this protective order, where i expect judge chutkan issue a protective order that will limit what former President Trump cant say or tweet or comments publicly about this case, including whether he can make reference to specific documents, specific pieces of evidence, specific pieces of grand jury testimony. I think that is the first test, as it were, for judge chutkan and how tightly she will run this case. In the second test will come in the nottoodistant future when former President Trump in all likelihood will violate the protective order by tweeting out something that he should not. What happens then . Per guy well , at that point, the judge has a whole bunch of things in play. One thing she can do that judges often do if literally bring the defendant into court and read them the riot act, say you look like you violated my order. Dont do it again. They can also post consequences. The consequences and sanctions could involve, for instance, revoking bail, Revoking Conditions of release, putting and imprisoning a criminal defendant. I dont think were at that point yet, but that is something that a judge can do if she is faced with significant recalcitrance on the part of the defendant who civilly refuses to obey court orders.
