Lawyers for donald trump have until 5 00 p. M. Today to respond to a protective order in relation to his efforts to overturn the 2020 election. Officials are concerned that he may leak some of the private details publicly. Trump and his team are looking to delay the trial, and he wrote if you come after me, i am coming after you. Jessica schneider is following this. And walk us through what happens after the 5 00 p. M. Deadline. Yes, omar, there are a flurry of deadlines. So first to the protective order deadline. The judge will determine whether or not to restrict trumps access to the evidence and to restrict what they are asking for. The access may be strong because of what he put on truth social this morning. He wrote Deranged Jack Smith is going before his number one draft pick, the judge of his dreams to limit my rights. And you know, he has a penchant for posting, and when they asked to restrict what he can post in the case. And so this is going to be one of the many fights that we can expect in this case. Both sides, they have to propose a starting date for this trial in the coming days to propose that, and trump team has indicated that they want to slowwalk this, and delay the start of the trial. In addition, trump and the lawyers are asking the judge to recuse herself, mostly because she has in the past referenced trump in cases for january 6th sentencing. And trump wrote over the weekend, there is no way to get a fair trial over the Fair Elections case, and the freedom of speech, and Everybody Knows that including her. And so we will be asking the judge for Change Of Venue out of d. C. And so the trump team may ask for a Change Of Venue, omar, but none of the january 6th defendants who have asked previously for a Change Of Venue out of d. C. Saying that the jury pool is biased here, and none of them have been granted, and so it would be a big ask to have this venue change granted when they ask for it, but they are priming for a fight here, and they are flooding the zone with all sorts of requests that they may be asking for the judge to change the venue, and recuse hest all at 5 00 p. M. And kate, we are talking about the trial out of washington, d. C. , here. Exactly. This is what we are looking at out of d. C. , and in atlanta, things are heating up there as well, and the streets outside of the already barricaded courthouse are now closed to traffic as another potential indictment against donald trump looms. Fani willis is indicating that her investigation into the january 6th efforts are looming. The courts website has alerted closures to the general public could happen during these dates over the next two week. You see it there circled in red. Nick valencia is joining us now. Thing there have been building up. What are you seeing . Yes, they are building up. And kate, some of that is some of the threats that have been received to d. A. Fani willis, and it has been happening over the course of the year that some of the threats have been Credible Threats so much so that she has spoken publicly about having to change her personal security and some of the rhetoric of the former president has not helped that, because he is calling willis a racist, and calling it publicly motivated. He is out on the streets with the changes of security, and the metal barricades going up, and we understand that some of the plastic barricades to stop, and this is some of the indications around the courthouse that was sent from the fulton District Attorneys Office to Law Enforcement officials that they should be ready, and an indictment could come at any time. The grand juries are being seated right now, and 24 jurors and two alternates. 12 of them have to be in agreement for decisions of indictments to be made, which as i mentioned, could come any day. So we have heard a lot from Donald Trumps lawyers in the last 48 hours, floating what could be possible legal strategies and one of them is that what trump said to overturn the election were not commands so much as aspirations. You are saying that asking is action. No, asking is aspirational, and it is core free speech is asking. What President Trump did not do is to direct Vice President pence to do is not directing, but it is asking, and that is aspirational. Joining ging us are previous attorneys, and so, is this a aspirational words a Legal Defense . I dont think so. I did a poem of the First Amendment issue is like the bank robber who goes into the bank and hands over a note and says, roses are red, and violets are blue, and hand over the money or it is curtains for you. So is that poetry aspirational . The aspirational defense is not going to fly. Michael . I am glad to be with you, and the new poet laureate. I think that it is a strong play, and good way for the Appellant Court to look at this, and deal with the case without necessarily getting all of the substantive and dirty merits of the case later on. I have no doubt they get the First Amendment claim, and a lot of it is going to be couched ins a Pir Rational Spaech and on the ellipse that day, and certainly some telephone calls. Those questions will be matters that go well beyond any type of trial and move beyond into the Appellant Court if they get a conviction, and maybe some pretrial motions and appeals. Yes, that is one fertile of mind, but there is a legitimate question of whether the aspirational part of it is making it an amendment part of it, but i suppose that is something that the Appellant Court may be something to hear, michael, yes . Well, i think that they can be different, but say that a candidate stands on the stump, and says that we have a fight against these terrible laws against the general assembly, and go show your strength, and it is political speech, and aspirational at the same time. And it is a request, because request to the president to the Vice President or the discussion to follow the lousiest legal advice in the world, but it is the question to be sprpresented all of these things will be trotted out to see how the focus group and the world of Public Opinion will decide and the defense team will put forward in a trial. And shan, what is interesting is that it going to get to the conversation or conversations that he had with mike pence. Mike pence is ultimately going to sit in a Witness Stand and be asked along the lines, what were you being asked when you were asked told to overturn the results of the election. And john lauro, who is an attorney for donald trump said that mike pence is going to be a great witness. What is your sense there . I dont think that he is going to be a great witness in the sense of giving evidence that exonerates trump. I think he does have vulnerabilities on cross, and he is trying to spint now, but you could cross pence if he is sounding negatively, and saying that he is a bias, because he is running against trump, and has bad feelings of what happened on the 6th, and there is good fodder for examining pence, but it is hard to imagine that they believe it is going to be a particularly positive for trump. Good or bad witness for the prosecution, mike pence . What do you think, Michael Moore . I think that for the prosecution, if pence will get some backbone that he could be a good witness, but he is so wishy washy, he is like trying to hold an eel. He has challenged whether or not he should testify, and he did not appear before the january 6th committee, and he has not decided to tell the whole truth, and so until then, the defense can use the refusals and the claims that he has made in the past, about private conversations, and how he has down played that. So they can use that against him in cross. Let me ask you about the georgia case, because i am so struck by closing streets of the barriers of the courthouse, and days at a time, and how many days before they will issue an indictment, do you think . Well, all along, i thought that this should be sglj but this sort of dripdrip, teasetease leading up to it is not good. Like the letter published, that should have been done privately and not leaked out. It presumes that the grand jury is going to issue the indictment. That is not what our system is about. I mean, we can all talk about whether or not a prosecutor can get an indictment, but certainly in a case like this, you want to have the appearance that there is some impartiality and consideration of the water and it is august 10th, that the judge set up with the issues to deal with in the mcburney order and this is if the d. A. Has any conflict, and use the special counsel presenting with mcburney, and both parties were ordered to brief that, and a hearing scheduled. Over the weekend, ron desantis was asked if he believed that the election was stolen from donald trump, and he said that joe biden was the president. What else is he saying . I have been covering desantis going back to the 2020 election and i have never heard him say in such forceful language that trump lost that language. He has been ducking and dodging the question in the better part of three years, but in that interview he was asked about that election, and this is what he said. Yes or no, did donald trump lose the 2020 election. Whoever puts their hand on the bible on january 20th, every four year, is the winner. But respectfully, you did not clearly answer that question, and if you cant give a yes or no of whether or not trump lost of course he lost. Trump lost the 2020 election. Joe biden is the president. Joe biden is the president. It is the first time that he has so directly said that trump lost and joe biden is the president. And it is not just that he has avoided the question, but he has taken steps over the last two to three years to really embrace a more conspiratorial elements of the party. Immediately after the election, he was the first to suggest that state Election Results could be overturned. He has put the allies of those who believe that the election was stolen in his administration, and he has held me said that the staff having meetings over the voting loss in many ways to appease the people who believe that the election was stolen, and so finally to the point that yes, trump lost, and it is coming to the point where clearly, he is trying to change the nature of race a little bit, and make headway into these early voting states. If it has perked up your ears, then we are in the right space. Steve contorno, thank you very much. And now, joining us is more on this subject. And so what does this do for ron desantis this moment . Well, kate, this is the reset happening in the desantis campaign. Well have to wait a few weeks to see if it is moving any of the numbers, but he is clearly changing the strategy after more than two years of embracing the big lie, and embracing the idea that the election was stolen, and paddling around the issue without actually talking about it. It is a clear distinction in the campaign where he is trying to take trump on in a more direct way, and taking on some of the voters, and this is not supposed to be a thing of courage to say what is true, but because trumps voters are so al aligned with him, and he has to be adept at saying that trump lost, but issues with the election, because that is what the voters believe. It is what he tried to do in this interview, and not clear if he is able to shift the numbers, but it is clear that he was having an interview with cnbc news is clear that he is willing to open up to the mainstream media, and what we have seen over the first few months of the campaign is not working. And also, what he said in the interview to nbc, talou. If the referendum is over joe bidens failures, and we are presenting a referendum on the future, we will turn the country around. On the other hand, if the election is not about what document was left by the toilet of maralago or the election of 2020, then we will lose. He is leaning into the document by the toilet at maralago quite a bit, but is that enough . Where does it leave him and his campaign . It is a classic strategy to say is this election about the future or the past, and it is not going to work, because trumps voters are so connected with him, and so aligned to him, and so loyal to trump, and the Trump Movement to say that all of the past grievances dont help people moving forward not clear if it is going to work in the primary and maybe it is going to win back some of the moderates and the independents who have signed off from the Trump Movement, but winning a primary is a different strategy, and it is not clear that desantis has that strategy, but he is going to be taking on trump in a more direct way which more people are calling for, because being on the same taj as t same stage as trump, and being in the same Playing Field is not working. So we have seen trumps numbers going up, and his going down. So he wants to see if that will give him some traction. And reuters says that one of Ron Desantiss biggest donors, hotel owner ron bigelow is going to pull his support if he does not shift. Extremism is not going to get you elected, bigelow has said. I wonder how big of an issue this is for desantis, because you have to move the needle, and recent history has told us that you have to go to the extremes to win the primary, and then run in the general, anded what does a more moderate move look like for desantis now . It is very difficult. Most of the people who want an alternative to donald trump in the Republican Party are the moderate voters, and they are not extreme voters or the people who have been with trump from 2015 and 2016, and soured on him because he has been losing. I think they desantis thought that since he lost in 2020 and the losses in 2022 as well, a lot of the people with him would look for an alternative and say, even if you are more like trump, but yo can win, i will leave trump for you, but we have not seen that. And desantis voters are saying that we need to win back some of the moderate voters, because if you are only appealing to the right wing of the party, we will find ourselves in the same situation of 2020 where we have a high turnout, and strong vote among the base, but we cant win over the College Educated voters, and for that within, a number of people will win a second term if republicans cannot win back some of the voters when they decided that i were done with donald trump and after the insurrection. Yes, you have to make a shift. We will see if it sticks. It is good to see toulouse. I have not seen that quote from bigelow. I wonder what the lever would be for him to get out. Yeah. And now the u. So, i think that they are putting the elbows out, and pushing into the international waters, but territory as well. They make a statement and also being parts of some other maritime activities in the middle east and elsewhere. And how concerning if china and russia are working together even in a controlled context like this . Well, it is concerning, because it shows that while they are back and forths and the chi chinese and russia and ukraine maintain relationships and they have big Military Exercises along the border. They do their naval. They do their aircraft. So it is serious. Now, if this switches more from Demonstration Sailing next to each other, to interoperability to conducts combat drills together, which is what we are looking for, that even more concerning, but the fact that they do navigation here and other places, and you have to remember that alaska and the Aleutian Islands are basically part of the extended area of the water between what we call the Greater Eurasia and the american continent.
