championship banner for the most solo performances at la's staples center. very heartwarming. the news continues and the new with caitlin collins starts now. >> tonight, straight from the source. from court 's recording support. donald trump back on the campaign trail tonight after pleading not guilty for the second time within 24 hours also now pleading to the supreme court for help. plus a new sentence for move only. prudence nemesis. she was handed a life sentence behind bars by a russian leader bent on silencing his critics. a free be free for all social media stars giveaway start calls complete chaos in new york city sparking massive mayhem and his arrest. i'm caitlin collins and this is the source.[music] >> tonight, the thrice indicted former president is in alabama at a republican state dinner seeking support of his mounting legal problems. once again ããattacking the special prosecutor overseeing his latest two federal charges and making more while making claims. >> they waited right to the middle of an election and they waited until he became the dominant force in the polls. the file the mall. everyone of them. all their essentially onetime including local das and ag's and even other cases right in the middle of the campaign. every time they file an indictment we go way up in the polls. we need one more indictment to close out this election. one more indictment at this election as closed out. nobody has even a chance. referring to the deranged jack smith ããis not only going to have to just bulldozed through the first amendment, his can have the borders through a line of cases by the supreme court of the united states. in other words, this is an absolute case of prosecutorial misconduct. the only civil rights that have been violent in this matter are my civil rights. >> i should note that he is once again attacking jack smith here after we've even heard from his own attorney general this week defending the special counsel. those comments come entered yet another pocket deeply. that was in response to this really charges that were brought against him in the superseding indictment in the classified documents case last week. that is numb to not guilty pleas and spend less than 24 hours. former president clearly feels legal pressure and asking the supreme court to intervene via social media. lamenting the time and money that his legal troubles accosting him. actually he's not really asking. he says the court at his view quote must intercede. he also put that this cryptic post earlier in all capitals. if you go after me ããi'm coming after you. i'm joined now by a pair of former federal prosecutors, jennifer rogers and shane will. thank you both for being here. jennifer, mr. with you and just the comment that trump made there. not calling jack smith directly what he's been doing essentially nonstop. but saying that the only civil rights that are being violated are mine. clearly a reference to one of the charges in this january 6 case. >> yes, i mean listen he's obviously attacking with everything he's got here to try and distract from we also all in the 45 page indictment that was issued recently. this is his play, right? civil rights, talking that we are in the middle of an election. so ãthis is election interference. it's prosecutorial misconduct. he references supreme court precedent ããi would love to hear him talk about what supreme court cases he thinks these are. ããthis is just his playbook. we can expect a lot more as the case moves along. >> shannon, i think when you hear people constantly attacking jack smith something we made a point of pointing out simply because it gets close over and it's just so remarkable in of itself that he's constantly attacking a prosecutor. but i think some people would look at that and say does this want a gag order? how does that work given that he's on the campaign trail and is making these comments. he's running. >> it's difficult to do an actual gag order although it was a little bit unusual when he was arraigned that the magistrate gave the particular warning about not doing anything which might interfere with a jurors in particular. so ããyou can make the argument that comments like this could influence the jury that way. that could be a problem for him down the road. that would set up a first amendment class right before they get to trial. >> and jennifer, he's also saying tonight what he would make clear what he would do if you get that second term in office and not just talk about his priorities, but appointing a special counsel to investigate the biden family. i talked to his attorney general, bill barr, who was certainly loyal to him when he was in the administration and asked him if he was worried that trump will try to weapon eyes the justice department but this is what he said. >> the word that he would weapon isaac if he was back in office?>> absolutely. >> he's making clear their that he would. >> he is. it's a little bit rich coming from bill barr, who frankly was one of the instruments of the weaponization in the first time around in the trump administration. but i think we all can see that a second trump administration would be even worse in this regard because he's just openly saying it. you know? his goal would be to put in people who are loyal to him. above all else. and to use the office in the powers of the justice department to go after his political opponents. i mean, there is no mystery as to what he would do. not as a legal question in the sense that there's nothing really legally that can be done about that. but the real problem certainly voters should be paying attention to that. >> even try to do it when he was at the end of his term try to put jeffrey clark and. somebody that was trying to draft letters to brian kemp of georgia about fraud that didn't exist. the other thing that trump is assigned today is about the supreme court asking them to get involved here. talking about the time that it's going to take for these trials to potentially play out, but also the cost of these. i mean ãjust the idea that the supreme court is going to get involved in these 78 criminal charges ãthat is all seem likely to you? >> they're not just going to suddenly reach out and do something about it ããhe would have to find some vehicle to get there and in criminal trials, it's pretty hard to do that. once it gets going, it's not easy to find an issue disorder stops the case. if there was a motion to suppress, which might be something like that could move up. that is not happening here.so think again that's mostly his >> but it is when it comes to how much time this is gonna take up after careful there is a point where he's facing property even just in one of these cases alone. it's a significant amount of time and amount of effort and resources to fight something like this. when you look at the calendar of what this is going to be ãã the public and debate the first one is coming up very soon. he has got his hearing on the january 6 case right after that in january of the aging carol defamation case. and then his new york case just a few weeks after super tuesday. and then of course the documents and what is going to look like in those big questions. i mean, is there test test will they in any way be able to effectively argue that the timing affects is campaigning? >> it's not so much about the campaign.i knew for him it's a practical matter it is. but as far as the judges are concerned ããeven if you just take out everything other than the three criminal cases ãas we listen to before, it's really hard to see how they are going to fit in the calendar for all of them. you need at least six months to prepare for any of these criminal trials and yet we have six months takes us beyond the end of the year. with the march trial in may trial.then you had the 69 day period where doj will not do anything over that might impact the election. so i don't know what they gonna do ããbut it's really hard to see how they fit all this and without even really thinking too much frankly about the campaign. >> and they might be setting a trial date by the end of this month. at least an initial one. the other thing that has been a subject of discussion is trump's attorneys are in favor of this is our house democrats. i think the circles where the interests overlap is probably pretty small. the cameras in the courtroom. they both are advocating for this. it's going to be one of the biggest if not the biggest trials in this nation's history. but it seems like there is no chance that that would happen. >> no chance. i mean.>> even to both advocate for? >> right, because this is really gonna be up to the judges. the federal judiciary is looking at 19th century and some members of the supreme court might be in the 17th or 18th century. they are not going to put cameras and particularly i think this seems perverse in psychology. but particularly because it's a case of such notoriety and there's some of public interest. that's exactly what they don't want the cameras in the courtroom. [laughter] >> how does that? that seems not a lawyer here, but that seems like when it's the most interest ããthat's when people want to be able to watch it once and be able to see and judge for themselves on this.we told junior six congressional hearings. >> i would say that there is zero chance justice roberts could do tomorrow. this is the policy. it's not a law. and over covid they did start putting out audio streams of the arguments and so ããi don't know if they taken tiny baby steps just as i'll be surprised if it happened and i wouldn't say it's impossible to. >> essentially, it would have to be chief justice john roberts or congress passing along? >> i don't know what would happen if congress passed along. the policy.s.so congress passed along g from it's actually an interesting g legal question. shannonon and i will discuss it after break. >> did administration for the judiciary 㦠>> for now we are relying on bill hennessey sportscasters? thank you both returningn friday night. general rogers shannon will. meanwhile secret service agents of course follow former presidents wherever th go. there has never been a former president facing a potential real threat of prison time before. so there is a looming question. what would happen to trump security detail if he does ever get locked up?plus the jail of lexi [indiscernible] 19 years have been added to his fence.harsh condemnation everyone including the semi government. will move all the ever see freedom again? we will speak to someone who knows him very well next. [music] >> tonight, after trying to poison him to death ããdidn't work ããvladimir putin's arch nemesis has been sentenced to an additional 19 years in one of russia's most brutal penal qualities. alexi tebaldi was convicted on charges so-called extremism which relates to his years long effort to root out pollution in russia and exposed putting in his lies. he did go to court and less a defiant smile today as he learned his fate today. all in an effort meant to silence the fiercest political opponent that the russian leader has ever faced. after the hearing, tebaldi released a statement to those supporters saying 19 years in a special regime colony. the number does not matter. and the verdict is not for me. it is for you. they want to frighten. you may recall russian agents attempting to kill alexi tebaldi by poisoning his underwear with him legal nerve agent. despite that attack on his life, he returned to moscow. but before he left, he issued a plea to the russian people should he be silenced perhaps forever. [music] >> that clip is from the oscar-winning film documenting tebaldi and the director of the documentary, one of the people that doesn't tebaldi very well, dan newell for knows him very well for daniel, last time we talked is when you got that oscar and in this was this jubilant time bringing attention on what tebaldi has been through. i wonder what went through your mind when you saw him in his court today in court today and how he looked. >> caleb, thank you for having me on the program and was happy to be here to talk about alexi. as that is the situation might be.today we saw devonian corporate he looked gaunt ãã but it's clear that his spirit is intact. is a remarkably resilient man. and in spite of this new sentence that he's facing ãã it is clear that this regime has not broken his spirit. his humor, his optimism, and his perseverance and that is something that really matters to me. >> that's always something that comes through when he speaks of social media. i know concern is that presence may be limited or eliminated because of this and just for people at home ããthe special regime is in colonies are usually reserved for russia's worst criminals. this is clearly a scare tactic from putin. the question is will it work? >> well, it's a very complex question because the contemporary landscape of russian politics is very complex. will it work? will it silenced not only? never. he'll never be silenced. he's proven as much. he could've gone back in but an exiled state outside the country for he chose to go back. you want to be the moral leader of the nation. some people call it savior complex. some people think it was foolish to go back. but whether you criticized the decision or not, you cannot help but admire his courage and the courage of his convictions. they are trying to silence all opposition, not just the balmy, but everybody who follows him and everybody who believes in a free democratic russia. the beautiful plush of tomorrow is the balmy calls it. but so often reminded of that old adage the night is darkest just before the dawn. and we can only hope that a new date lingers around the corner that not only courage will inspire others. >> i cannot even imagine the impact this is having on his family. his parents were barred from attending the hearing. forced to watch it on a video that they can barely hear and obviously russian officials are trying to make this as difficult and as painful as possible. and they've been in touch with his family. what they told you? >> you know, it's incredibly difficult. what is there to say? the husband and father is behind bars for nothing. imagine how painful it must be for tosha, his daughter, zohar, his wife. russia is a country where i think it was just last month that jennifer kosher marched his army with an hundred and 50 miles of moscow and killed 11 russian servicemembers. great havoc and it was a military coup or so we thought. and meanwhile ããnot only is the one who is convicted of extremism and on trial for terrorism and things like this. it's absurd.if it wasn't so sad, we would laugh about it. it seems like some weird bizarre satire. but it's all very real and at the center of it is this man, who is sacrificing so much for his country and for what he believes in. i think his family is in lockstep with him. they remarkable courage as well and i think so much of his courage is fathered by his family and their support of him. yes, i mean i was just thinking today with all the talk of political prosecution here that has been happening in the last 48 hours ããthis is what this actually looks like. the conditions that he's in, russian guards supposedly make him sick. the lights are constantly on. even at night. they teach conventional food that his daughter has sent him and then take it away. this is just imagine his daughter and am glad you brought this up. this is something she said recently to cnn. >> there are no calls, visits. no human conditions. is allowed to ride 35 minutes per day with a pen and paper and is allowed to have two books. these actions are clearly an open strategy to destroy my father's physical health and may be mental too. >> how worried are you about him? [music] >> florida governor, rhonda santos taking baby steps away from donald trump today after he was asked about the former presidents repeated lies with the 2020 election when it was stolen. >> it was not election that was conducted the way i think we wanted it to. but it's different than saying like maduro still votes or something like that. and i think those theories proved to be on substantiated. >> it may not seem like much, but those comments from the santos are actually some of the most direct that he is made about the former presidents defeat in 2020. previously when he was asked about those claims test test the claims that are not true about protesters he dodged the question usually would pivot other topics. these comments from the santos come just one day after trump pleaded not guilty to those charges. related to his alleged plot to overturn the 2020 election. would be to discuss this to me. democratic strategist charis finney and republican congressman of pennsylvania, charlie dent. why now? [laughter] >> yes, why now? that was a start. i suspect that maybe trump has gotten under his skin. i think he's called rhonda santos about every name under the book from meatball to the scientist to the sanctimonious. trump is wheeling on him all the time and so he took a little step here. and he's gonna have to be much more aggressive than he has been if he wants to defeat trumpeter primary. but i guess better late than never. this is a small step. >> is assigned to his comments to be trump's legal exposure are trying to take advantage of it or does he not go far enough for you? >> seemed like he was trying to split the difference between closed and that sort of the party that is with donald trump and believes still believes 2020 was not legit and those who don't because as we saw earlier this week and that time paul test is the national version of that pole is so slim. he's got to pick off just a little bit of those folks that went over a portion of t.and repu primary electorate the is over it. so it seems like you're trying to have it both ways there. >> id you brought that polep because that was a natioll. the new york times released in cnn released version of the iowa pulpit trump is still ahead of the santos. not as common as the national poll, but trump 44 percent of republicans in iowa to 20 percent. i mean ããdo you see any kind of acknowledgment from the santos that he needs to do something different here with his campaign? >> i don't know if he sees it or not. but if he needs other candidates to break through ãã they're going to have to tear the bark off of donald trump. they cannot wait for jack smith to do it. they are hoping the legal system will take him down. other than chris christie, it will hurt asa hutchinson. all the rest of them are either basically reinforcing trump's message that he is a victim of a witchhunt of a deep state of a corrupt justice system. they are reinforcing trump by doing that even those who are struggling also reinforcing trump. and that's the reason why trump i believe is still so strong. get 10 or 11 candidates out there ããjust savaging trump everyday over these indictments explaining why he has such a great risk to the country. >> you don't think that would just boost trump? >> if enough people are yelling and screaming, it takes leadership. republicans have to understand to take down donald trump, will have to be done politically but they are hoping the legal system has appeared or does it, but if he gets convicted, he will still be running. >> charlie, they're not going to do it.again, half the poll showed us that 37 percent republican primary electorate ã ãthey are with him. so ããthat says to me that kevin mccarthy is not going to change his rhetoric anytime soon. and then it's going to continue to put that pressure on their fractured republican party where there is some core ready to move on and some who don't. the iowa version of the poll is interesting because for i iowans ããsample size. i think we should be careful. it said i think almost 50 percent said they are open to voting for somebody else. the question in iowa is consummately tim scott, where she got a little bump got a little bump in new hampshire ã ãhe's three times and i will what he is nationally. >> exactly! [laughter] people seem to like him, right? if people can kind of creep up and let trump and desantis to get out ããmaybe that is another pathway.>> in which two donors saying this?robert bigelow who is the biggest hotel entrepreneur.the biggest individual donor to desantis. so far he is telling roy christian at the is academic more money until he sees him shift to moderate. he says he's gonna lose if he stays with the extremist and essentially needs to see them generating more interest from other donors. he's clearly the perception and that's the concern we've heard from other donors per. >> that donor identify the problem that rhonda santos has prevent the santos is trying to be trump.he will be trump without all the drama. but he's also finding out that by taking that campaign to the extent of grievance politics and disney and transgender and abortion. he's finding out that a lot of the non-trump voters don't want that. they don't want that. so ããbasically desantis is trying to figure out a way to unite the non-trump voters. he's not very good at it because he's really playing hard to the trump in wing of the party. while as this donor acknowledges, not plan to a significant number of republicans were being turned off by the desantis message. so ããhope more donors speak up like that because this is a problem for the whole republican party. look at the state committees all over the country in pennsylvania and michigan, these parties are struggling because the wacko fringe has taken over the party and serious people will not send money. >> karen and i have a take on this because yes. we will and on that note. >> desantis has made this promise of downsizing federal agencies a staple on the campaign trail. he essentially talks about everywhere. a lot of republicans do, but it has been his think that he's clarifying comments on his thing and what he would do on day one when it came to the federal government in office. >> and then on bureaucracy ãã we're going to have all of these the state people, we're going to start slitting throats on day one.>> you guys know why. the ããit's a figure of speech with that. but it should be taken to mean that we want accountability. >> he's such a jerk [laughter] is such a bully and a jerk and he's such a lack of awareness that particularly coming from him because he does a lot of this macho tough guy speak. that when you talk about undergoing their slit throats ã ãpeople are thinking that's just is not that they literally think that they're going to slit throats, but the ticket is more than just a figure of speech. the other thing about this that i always hate is that it's so duplicitous because anybody who's ever been in washington knows what it would take to actually get rid of the federal workforce. it's not going to happen. so ããit's like a great thing to beat up on. but it would practically it's ridiculous per. >> the idea that some people would be open to the idea of you not minimizing some of the agencies and making agencies not as bloated as it is, but it's the way that he says it. we have some people saying that they're gonna get rid of the fbi and you know 㦠>> again, it was a figure of speech. but it was a dumb thing for him to do. and you know ããin fact, he's had another bad moment.just last week i think he said that he would consider appointing robert f kennedy junior to lead the centers for disease control and the fda for drug administration. >> he also talked back. >> but in what world? those organizations are led by distinguished doctors and life scientists and people with phd's. that's what it's about. i mean, this to put the crack in there? this is crazy. [laughter] he said that plus the slavery issue. >> your words, not mine. >> well ããfirst off it's good leadership. you know? this is the thing when it comes to foreign policy. you can't ããleaders have to lead on that. they have to explain what america's interest is. they have to explain the fact that for instance in this case that ukraine is doing the fighting otherwise we would have to do. it's the most this way to keep american boots off the ground. on the broader scale ããfor like the whole country, do blame the administration for not better explain both how we are tracking the money, with this actually is, etc. on the republican side ããthey are just going to do the opposite basically of what joe biden wants. i blamed nobody except the leaders of the republican party, who have gone along with the twitter trolls out there and the tucker carlson's sadly because it seems easier at the moment. so chris christie going and doing this and mike pence rather ããit's good to see and i would love to see other candidates could do that. >> cnn has also learned that top u.s. and european officials are worried that putin is kind of factoring in the election to his were planning. basically they believe that he believes and is hoping a biden loss will lead to the u.s. curtailing export for ukraine. and would help his negotiation and position. what you make of that? >> well, it's true. and it's a sad thing that a former president, who i really feel is losing his mind is going and saying ããbut he can say things like this. people don't take what he says seriously. but it has a real impact on people's lives. i think of vladimir putin new joe biden was going to stay in supporting ukraine and that donald trump would come in and support ukraine as well ããit would be a huge motivation for him to end the war. even not on his terms. so instead what he's hoping to do, caitlin, is to spend human lives to buy time. he can throw me into the meatgrinder to buy days in the off chance that donald trump can win. this is why it's important for the biden administration not just to do the bare minimum. not just to wait for the pressure to get strong enough to send eight f-16s. they need to send everything ukraine needs now. by the way, we have great textures with great ability to track that they are using it correctly. he needs to do that now to end the work as soon as we can. >> something else that's happening tonight. senator tupper bill is in my home state introducing donald trump at a republican dinner. in montgomery. you know ããthis comes we saw secretary austin at the pentagon issued new guidance about physically held leadership roles there will be reshuffled he believes because the whole the tupper bill has on these military nominations and confirmations. look at the wall. this is the joint chief of staff. there is not another empty spot at the chief of staff of the army retired his replacement has not been confirmed. did you ever think that the defense secretary would have to issued guidance on how pentagon leadership is going to work because of a member of your party? >> no, not tell you what i never expected is that basically the democrats would be the promilitary party. and that they would almost be the more hawkish party than the republicans are. and that's what's happening. it's been this weird switch and for tommy the senator i will call him respectfully to do this ããis really damaging the military. i just in terms of the promotions. but it's politicizing the last bastion of government that should not be politicized. very politicized the supreme court. we politicize congress and the government and the presidency and the fbi now but everything is politicized except the motor and he's doing his best to do it. people like him. people like josh holly. go out and they to these ads about how great the russian army is because they have these manly ads per the russian army is getting crushed on the battlefield. my disagreements with some of the things that the pentagon does. i spent a lot of my time in the military and computer-based training that i don't need to. that doesn't mean that we are not the most lethal force and that doesn't mean that you play politics with a political issue. simply because it's gonna get you attention. >> former congressman adam can finger. thank you for your t time. >> you bet. >> it's their job to protetect the former preresident of the secret service go to court with as a criminal defendant yesterday. but what would his security detail do if he actually had to go to prison? he former agent is with me [music] >> we are now three indictments for donald trump and that means three bookings for a not so average defendant. of course test test from yesterday following list of the standard protocols. fingerprinted and entered a series of questions about his age, his date of birth, his middle name. squirted into the courtroom where he entered the guilty plea for the magistrate judge. big difference here of course is wherever the former president goes ããsecret service goes with him. raising the question of if trump got convicted and sentenced to prison ããwhat would incarceration look like for a former u.s. president. something we've never seen before and the president former secret service agent, and the pumpers. so great to have you back. this means a million caveats because obviously he has not been convicted of anything. there could be appeals, the could be please, there could be some might we don't know the punishment will look like i put the idea that this is even something that people are talking about that's just the idea of what this would look like given that they've secret service service for life ãã what would that be like for life? >> i don't think it can be that different. he's going to very secure location. depending on what prison he goes to, federal or state, because he is being charged through new york in the state, miami dc they are charging and federally per the difference between the prisons. if you go to prison? want to go to federal resin. they are safer. state prisons had more violent offenders there. that's one thing. one other thing is that they have the security setups so if you're in the presence, is a goes federal. they got the presence set up. you're actually looking at less manpower ããless resources, less money, definitely less money for taxpayers. so when i see that ããi seem going to an already secure facility. the kicker comes in and who's gonna be with?
