The Special Counsel charges donald trump with conspireing to shatter the american experiment. The ha 45page indictment nar tat rates a plot to stay in power after losing an election. And it does so with some new evidence, including realtime notes from then Vice President mike pence. The politics, the third Trump Indictment slipped the field into familiar camps. The charges will also test joe bidens resolve to do what is sometimes unnatural. Stay quiet. The consequences, how the prosecution plays out in court may determine the future of both donald trump and american democracy. Im dana bash. Lets go behind the headlines and inside politics. Tomorrow a court date for the former president here in washington. Today the country gets a line by line look at The Plot Against America and the alleged crimes of donald trump. Central to the indictment is the Special Counsels assertion that trump knew that he lost the election and pushed lies to stay in office any way. Describe d in the indictment it was fuelled by lies. Lies by the defendant, targeted at obstructing a Bedrock Function of the u. S. Government and a a nations process of collecting, counting and certifying the results of the president ial election. We start our coverage with Katelyn Polantz at the federal court, which is your home away from home at this point. What do we know about what to expect in the next 24 to 36 hours . Reporter we do expect donald trump to have to come to washington, d. C. , again to face these charges for the first time. We him to be here for that initial appearance tomorrow at 4 00 p. M. Before a Magistrate Judge in this court, before he then goes on to have his case sheparded by Federal District judge through to trial. Its notable to see donald trump arrive here back at this court tomorrow, which we are expecting because we are not very far from the u. S. Capitol itself. These judges after the Capitol Attack were in this building behind me. They could see out their window barricades and militarize d presence on the streets protecting the u. S. Capitol after that riot. These judges have had to make sure they are overseeing Hundreds Of Rioter prosecutors, getting those people through the system, looking at those prosecutions, sentencing many of those convicted rioter def defendants from january 6th. Now they turn to this additional case against donald trump himself. So really just a notable scene that were going to have to tomorrow. And when you step back for a second and look at this, this is really a case that boils down of everything the Justice Department had been looking into, everything that congress had been looking into with the house select committee. Now putting it together for a case against donald trump, a conspiracy to defraud voters, to defraud the Electoral College process to certificy the vote a the conspiracy to defraud the u. S. Government itself and the transfer of power. Thank you so much. I havent even thought about that point that you made at the beginning that where youre stand ing is really almost a stones throw from the u. S. Capitol. You walk out the door and turn left and you can see it. It really is a powerful thought and an. Appreciate it. Now a very active morninfor the former president on his social media company. The indictment is fresh fuel for his stream of consciousness rants. He calls the indictment unprecedented and a wakeup call to the world. Kristen holmes joins us live from near the former president s club in bedminster, new jersey. Reporter dana, it is unprecedented. You have to give him that. This is a former president and a current candidate for the presidency in 2024, who is being indicted with his third indictment. Heard the same playbook that we have heard. This is political. This is because of the corrupt doj, the corrupt fbi, this is all because he appears to be poised to be the front runner or republican candidate in 2024. But whats really interesting to point out in this case is that they are trying to completely flip the script. The current president is being charged with attacking democracy and yet they are saying that these attacks on him are somethinthat would come from a dictatorship. I wantad the statement they put out yesterday. The lawlessness of these Pe Persecutions of President Trump and his supporters is rem any sent of nazi germany in the 1 1930s. The former soviet union and other authoritarian regimes. So clearly here, trying to flip the script. The question is whether or not this is going to resinate with donors. And the big question here is whats going to happen tomorrow. We have not gotten confirmation from the trump team on what their lances are, if they are going to show up in person or not to the courthouse, although we do anticipate he will be there in person. Flip the script is a very diplomatic way to put an allegation or an illusion to nazi germany given what we had seen. Here to share their reporting is paula reid, evan perez and cary cardaro. I want to set the table of this conversation from the heart of the indictment at the beginning. It reads these claims were false and the defendant knew they were false. Tified repeatedly his claims we urue, often by the people on whom he relier candid advice on important matters and who were best positioned to know the facts and he deliberately disregarded the truth. This gets into the former president s state of mind. Its something youre going to hear from the lawyers over the last 12 hours or so from them that how do they know that he didnt believe this fraud. Hes continued to make the claim that there was fraud in the 2020 election. Its probably one of the best things he has done for himself frankly. Hes stuck to that script. And it is a challenge. It is going to be a challenge for prosecutors. What they are going to do is what you saw in that indictment, where they describe and literally list all of the different people at the former president has relied on that he picked, Vice President pence, his intelligence, all the people in the intelligence community, his former attorney general, his acting attorney general, his white house counsel, his Chief Of Staff, everybody was telling him what was true, and he chose to listen to lets just say another group of people. Who were not experts. And so what the prosecutors are going to make the claim or going to draw a picture for a future jury is that he should have known because he was being told by all of the people that he relied on for all other matters of National Security importance. When it came to the time he didnt like the results of the election, he decided to listen to Rudy Giuliani and some of these other people. You said that the former president has stuck to this script that he won the election. It still happens every single time he goes out on the Campaign Trail and any chance he gets. What was really note worth any was that his attorney last night didnt make that argument. Lets listen to a little bit about what he told kaitlan collins. The government has had three years to investigate this. Now they want to rush this to trial in the middle of a political season. What does that tell you . Our focus is on the fact this is an attack on free speech. And theres nothing thats more protected under the First Amendment than political speech. So its the timing. Its free speech, and i just before i bring you in, im really curious to know your take on this, lets hear from one of the, what we believe to be one of the unindictmented Cocon Spoor Torts on this same topic. Thats Rudy Giuliani. Violating the right of free speech of an american citizen, never mind whether he was president or not. It could be anybody. He could be a homeless person wp you dont get to violate peoples First Amendment rights no matter who you are or how sick you are with trump derangement syndrome. This isnt the first time you have acted like an unearth kl lawyer. It should be the last. What is missing from all of that is a defense that is donald trump won the election. They are even going there on the election lie. What does that tell you . These are arguments in the court of Public Opinion. Rudy giuliani is yell about his First Amendment being infringed about while hes posting on social media and appearing on tv. No one is infringing on your First Amendment. You have multiple platforms to say whatever you want, including that the election was stolen, but you cant use that as a basis to go and try to actually steal it. Im not saying were not going to hear from maybe not the president s lawyer, but others. But in the immediate aftermath of this indictment coming out, that was notably absent from their defense. And i think its their playing to the court of Public Opinion. This is an extremely dense indictment. Where you see photographs of the documents and it cuts through this. Theres not a the lot of new information. These appear to be not so much legal arguments as just ar arguments to the general public. The government is attacking me. They are infringing on my freedom of speech. They address that in the indictment. You are absolutely entitled to lie, but you cant engage in what they say is an unlawful scheme to steal the election yourself. Heres how i think the indictment is trying to navigate this First Amendment line and the allegations that its based on First Amendment tuft. So what the indictment says is the former president was free to say things. He was free to say he didnt believe the outcome of the election. Whether or not that was true or not or whether or not he believed it to be true or not, hes free to say it. With the indictment alleges is that hes tried to corrupt the institutions of government in order to overturn the election. Then they lay out the facts for how he tried to do that. So he tried to do that through trying to corrupt the institution of the Justice Department, to try to get the Justice Department to take official actions that would undermine the Election Outcome. Try to get State Legislatures to take actual actions, use their authority as Government Actors to overturn the Election Outcome and try to use the authority of the institution of the Vice President of the United States to overturn the rightful outcome of the election. So what they do and what they dont charge is they dont charge incitement. Im glad you brought that up. Its a very astute point. Lets look at more of the issues thate been out there that are notably absent. Incitement is one of them. This is part of organizing and fuinof the january 6th rally. Planning to seize voting machines. Any link between donald trump and the extremist groups, those that attack the capitol and whole of that reporting and questions about that chaotic meeting at the willard hotel, which is right next to the white house, between a lot of the trump even some of the trump cosconspirators. One of the key witnesses is coming in next week to speak with investigators. Not going before the talking to investigators, which is one of several signals that we know to continue to collect evidence. Some of the witnesses have asked, is this grand jury still active. Are you working on an indictment. And the Special Counsel signalled yes. What the charges will be is unclear. I want to quickly ask you about your reporting and conversations that you have had about the timing of doing this now. Conversations that went on inside the office of the Special Counsel. When i say now, i mean now because of the political calendar. I think theres a lot of sensitivity to it. I think they understand the criticism, including what youre hearing from some of the political figures. Fearing with an election, you see this indictment very tight. Its very limited. All of those things are not included here. What they want is to try to get this in before. So the voters have something that is completed before. We dont know they are going to be successful, but before they cast a ballot. There is an argument to be made that they may have waited too long. But all of those things that you just listed is why it took this long. They need it to look at the financial aspects. They need to look at whether ex exists, there was any direction. They need to look at all those things before they can bring that case. That takes awhile. Maybe this is an unanswerable, but is it possible they had strings or threads on a lot of these but decided to keep it very narrow . Think there certainly would have been avenues of investigation that they would have gone down. And they would want to bring only the charges they had confidence they could actually win on. And thats the standard that the prosecutors would have to use. The biggest question to me is former president is the only one named on that indictment. And even if his conduct is its unclear if im sorry to interrupt. We have some breaking news. S. A life or death decision today from a pittsburgh jury. The jury decided if the mass shooter convicted of gunning down 11 worshippers inside a synagogue will face the ultimate punishment for his crimes. I want to get straight to Danny Freeman outside the courthouse. What do we know . Reporter dana, after a trial that spanned over nine week, more than 100 witnesses called and 5 years since that deadly attack at that pittsburgh synagogue in 2018, a jury of five men and seven women moments ago sentenced the 50yearold to death for those crimes. Now dana, we look through a lot of these jury form, Mitigating Factors and i want to explain to you some of the things that the jury clearly did not buy when it comes to the defense that bowers attorneys tried to mount. No jurors bought the alternative thesis for a motive that this was an attack about anything else other than trying to kill jewish people. Sezero jurors bought the defens that r better bowers suffered from schizophrenia and had skepticism about the childhood difficulties that the defense tried to bring up to spare his life, including attempted suicides and also the jury was skeptical when the defense said that mr. Bowers had abnormalities in the brain. All reasons the defense tried to say should spare his life, but in the end, when the jury waved those Mitigating Factors against the aggravating factors, killing 11 jewish worshippers in october of 2018, specifically because they were jewish, not only that, but showing no remorse, the prosecution argued, throughout the duration of this trial. At one point, a Defense Witness actually testified that bowers enjoyed listening through the trial to the evidence that was presented. The jury agreed with the prosecution on that front. This is the result that we are looking at that sentence of death. And you want to put this in a bit of perspective for you. Theres only been two Death Penalty cases or trials in this Biden Administration, but the prior one, the jury came back with a verdict of life in prison. This is the first Death Penalty verdict and decision and sentence in the Biden Administration so far for 50yearold robert bowers, the pittsburgh synagogue shooter. Very important context, as is the fact this was the deadliest ever attack on jewish people in the United States. It happened amid a rise that continues in antisemitic attacks across the United States. I should also note that a lot of times with Mass Shootings of any kind, you dont the families and victims dont see this kind of justice because the perpetrator ends up dying. Thats not what happened here. This has been justice in a court of law. This is the end of that judicial process. I appreciate your reporting. Thank you so much. Were going to have more news ahead. For the most part, Donald Trumps competitors for the gop president ial nomination spobded to his third indictment in such a familiar way they were probably cut and pasted from previous statements and talking points. Heres ron desantis responding for the first time on camera just moments ago. One of the reasons im running for president is to it reconstitutional liez the federal government. The agencies that have become weaponized against political opponents. A d. C. Jury would indict a ham sandwich and convict a ham sandwich if it was a republican ham sandch. Tim scott rleagainst two different tracks of justice, referring to the prosecution of President Bidens son and one call ed the indictment unamerican and said he will pardon trumpf ected. And the few who have staked their campaigns on opposing the foresident are also echoing fami refrains. Chris christie, Asa Hutchinson, trump should step away from the campaign. This guy only cares about himself, not our countrys future. Joining me now at the table is margaret tol a av, jeff zeleny and eva mckenz. Those were the predictable statements. The one that is a bit different is from mike pence, and one of the main reasons is because mike pence is so integral to this story. We saw new information from the indictment from the interview that the former Vice President did with the Special Counsel. Heres what he said in his statement after the indictment. He todays indictment serves as an important reminder anyone who puts himself over the constitution should never be president of the United States. Our country is more important than one man. Our constitution is more important than any oneans career. On january 6th, former president trp manded that i choose between him and the constitution. I chose the constitution. I always will. Look, the former Vice President has hes said that before, but hes been a bit all over the map. He knows its an uncomfortable place and opinion in the Republican Party. This is what he believes he lived it. We have to wonder if he was doubling down on that and speaking with a louder voice on that like Chris Christie and Asa Hutchinson and will hurd. Or is there simply not a lane for that. Hes kind of trying to hes been true to his position in terms of what the former president did. But he does not want to make that the center piece of his campaign. Hes giving the speech right now in indiana. Hes talking about bidenomics and the credit ratings. He wants to change the subject, but hes at the center of all of this. Host at the center of all of this. And yes, this Statement Reads a lot like the opening statement, when he opened his campaign on june 7th, i believe. It is a different tune than one that he was singing when he was on with me two sundays ago. Lets listen to that. While his words were reckless, base d on what i know im not yet convinced they were criminal. I would rather these issues and the judgment about his conduct On January 6th be left to the American People and the jump coming primaries. What his people argue is its a different tune, but its all part of the same song, which is that he believes what donald trump did was wrong, but hes not sure it is criminal. Right. For months now, we have seen the former Vice President try to have it both ways, but in sol cases be kcritical of the syste. It seems hes tracked toward a more critical position and is getting more comfortable in that space. When youre sit ting at 2 or 3 and of it is moving the needle, it gives freedom to just say what you believe and what you want to say. But what hes saying publicly in the end may be less important than those notes he kept that he took that whatever information hes already shared or provided with prosecutors. Lets just look again at the power of these indictments politically. If you look where he is in the lls, as of july, hes gone and a as his indictments have multiplied, and then his contributions. Hes already sending out tons of asks based on this indictment for more money. If you look back, you see there at the times that he has been indicted, the two times previously, its worked. And it has had this Rallying Effect when you speak to voters, some of them say they are even more inclined to support him now. Conservative voters in the wake of these doimt indictments. But the response were seeing from the field really amplifies the weakness that they have. They have to frame their candidacy around being as gracious as possible to the former president. That is limiting. We have a lot more to talk about. Up next, the chair of the House Democratic caucus and former member of the january 6th committee will be here. Donald trump is coordinating with allies in congress, the 2024 republican front runner held a Strategy Session with the House Republican conference chair. Sources tell cnn gop members have been quietly preparing a Messaging Counteroffensive for weeks. Lets get to matt rynu raju. The ones have been Koord Nalting with them behind the scenes. Trying to make the case the Justice Department was biassed for going after trump in this time of the dam campaign season, and republicans saying attempt to distract from investigations into the bidens. Thats the message from speaker carthy, who said everyone could see what could come next. The attempt to distract from the news and attack the front runner for the nomination. Now theres been few republicans who have been logged by the contents. One of them was senator rkowski. She said in statement, additional evidence presented since then including i by the January 6th Commission has only reenforced that the former president played a key role in instigating the rye kwots On January 6th. And silence still from Senate Republican leader mitch mcconnell, who has said very little about donald trump since after saying he was practically and morally responsible for the violence that day. Thank you so much for that reporting. Lets discuss with the chairman of the House Democratic caucus and former january 6th Committee Member pete aguilar. Thank you so much for joining me. As a member of the committee, you know the facts of the case better than most. Was there anything in this indictment that surprised you or that wasnt in the indictment that surprised you . I would encourage the American Public to read the indictment. Its incredibly powerful, but it read a lot like the january 6th report that we put out. Over 800 pages of documents in our final product. And i thought the facts laid out in the indictment were closely aligned with the work that we did. I paid particular attention in the indictment to the mike pence portion because i chaired that panel. But just the Pressure Campaign that mike pence was under. January 6th, Christmas Day phone call that the President Put Pressure on him, january 2nd, january 3rd, january 4th, either directly the president Pressuring Pence or his advisers pressuring the Chief Of Staff to mike pence. Just an incredibly orchestrated Campaign Thatter clearly the president was the central figure in. You want to play some of what jack smith, the Special Counsel said in his statement yesterday. The attack on our capital was an unprecedented assault on the seat of american democracy. Its described in the indictment it was fuelled by lies. Lies by the defendant, targeted at obstructing a Bedrock Function of the u. S. Government. So he talked about the former president s role in the attack, but doesnt charge him for inciting violence. Your committee didnt seem to find evidence that donald trump intend ed for the violence to happen. We see the Special Counsel didnt either. What do you make of that . Think the facts are very clear. From november and december, the former president tryied to stay in power. Thats the central of what we laid out and the facts that we found once they gravitated to the rally, once they gravitated to the fake elector strategy, they decided to have that event of all of their work where the president knews he was going to out there and speak. You knew he was going to whip up the crowd and say he was going to march with them. That was the Central Point of that day was his effort to point to the capitol and tell the crowd of rioters that they needed to give some spine to the republicans. There was nothing that charges the former president with coordinating with minutes of the proud boys and oath keepers. Absolutely. And if you read the report, his role is in the Central Point of this is incredibly clear. I think these charges are very, very serious. So even though others would like more charges or different charges, i think that these are incredibly important. The Justice Department laid out the facts here, just like our Committee Work did. Now well trust the process. You were a member of this committee. You are also a politician. You are very aware of the court of Public Opinion in a lot of these matters. This trial will be held where i am in washington, d. C. 92 of the residents here in washington voted for joe biden in 2020. The judge is an obama appointee. You might have just heard ron desantis making the argument that they would potentially indict or convict a ham sandwich because of those realities here in washington. How do you convince persuadable voters that thats not relevant . This is the Justice System. There will be a process. The defendant has rights. The former president is entitled to the presumption of innocence. Hes not entitled to his own version of facts. So its going to be up to his defense attorneys, as well as prosecutors, to simply lay out the facts and to ensure that this is a jury of our peers. Thats how the Justice System works and to ensure that there arent two sets of justices. Thats what was so important about our work to chase the facts, to make sure we laid out the evidence and to ensure that ultimately accountability is held. Mitch mcconnell had talked about accountability. Now its the Justice Departments job to ensure that that happens. Congressman aguilar, who was a member of the january 6th committee, now the House Democratic caugcus chair, we appreciate your time. Thank you, dana. This isnt Donald Trumps first indictment, but its the first one that directly impacts President Biden, his election to office, his presidency and his reelection. Well talk about that nextxt. Joe biden puts protecting democracy at the heart of his political identity. Now the newest Trump Indictment charging the 45th president with try ing to keep joe biden from taking the office he legitimately won will test the 46th president s ability to remain quiet on an issue central to his reelection case. Its something biden talked about just last week saying, quote, if you just take what he said on the record, some would say its just flat seditious. Our panel is back around the table. This is really a vexing problem for the current president because part of his entire campaign in 2020 was im going to leave the Justice Department to do what they do. Im not going to do what donald trump did, which is get involved in ways that he deemed very inappropriate. Yet arguing that donald trump has no place back in the white house because of actions laid out in the indictment should be a Central Campaign theme. Right. But i think what did the president do last nugt, Dinner And A Movie with his wife, reporters shouting questions at him. At this point, his posture is to let others make that case, to let the prosecutors make the case, to let other democrats make the case, and he has been hands off. I think he is trying to figure out that messaging, but for now, if trumps a argument to the center or to the few radical persuadables is that the Biden Administration is trying to censor rivals, it makes no sense for the president to take the bait. Thats right. This is a republican problem. Let the republicans answer for trumps growing indictments. And thn also President Biden has enough problems. He has to worry about consolidating the democratic base, about making sure that progressives turn out. Whats the value in him weighing in on this when you have republicans consistently arguing this is the Biden Doj Weaponizing their power against republicans. One thing that biden advisers are looking at, i was talking to one this morning s that speech that the president gave last fall in philadelphia. He went to the seat of democracy and talked about the democracy in a big picture way. So thats the needle they are going to try to thread. Well see how successful they are in doing it, talking about the need for norms and democracy and try ining to stay away frome specifics of this case. But the reality is the legal case is this president ial campaign. So be very difficult for him to not be drawn into it. Accocomplicated by hunter biden which is also going to be an issue for him. You mentioned the fact that democracy is on the ballot. Donald trump is now facing three indictments. Thats 78 criminal charges. Well, what happens to donald trump dictate what happens to america as we know it . The indictment chronicles the persistent and repeated attempts to tell mr. Trump he lost. His Vice President , his attorney general, his director of national intelligence, his top cybersecurity official, his senior white house attorneys, his seniorstaffers, legislators, the court, they all tried to communicate the trump. Mr. Trump, the Special Counsel says, knew what happened, knew the trudth, there was no electin theft,. Mr. Trump now hopes the constitution he wanted to throw away will save him. His lawyers claim it is the constitution that allowed their client to lie without care or consequence. A verdict of four more years my spare mr. Trump from a prison, but such a verdict may sentence democracy to a far less fortunate fate. And that is an important conversation to have because we understandably talk about every single new development, the new nuggets in the indictment. But we wanted to kind of take a step back and look at what this all means in totality, when you have this kind of indictment by a man who is trying to be president again. And it is one of the reasons he jumped in so early last year. So he would be a candidate when all of this was unfolding. This was clear it was potentially going this way. I think it is critical to look at these indictments separately. There could be Indictment Fatigue if you will, because it sounds like there is so much. I was in michigan yesterday talking to voters and Michigan State republican senator, who endorsed donald trump the first time around, was really dismayed by this. And he said, yes, it is empowering the former president , but he urged caution because he was talking about whats in this indictment versus the other. He believes the democracy portion of this, the january 6th portion of this is different than the others. But more than that, it is about the office. This is not just about donald trump. I was flying back to washington this morning, looking over mount vernon, tru. It is about more than donald trump. And i mean it invites questions about who we are as a nation. I think that the Republican Party very much is trying to figure out who it is, who they are. Often you hear republicans talk about a Deep Fidelity or a deep allegiance to originalism. This is a former president , as peter baker outlined in his piece, called for eliminating the constitution so it would benefit him. Thats in deep conflict with the philosophy that republicans have espoused for decades. And so these are the larger questions that we have to grapple with as a country. I think this is ultimately to some extent a test of the First Amendment and how far does political speech protect you in what you can do wrapped in the cloak of political speech. But another really important piece of this that we will be talking about and studying for decades is the role of the media. In this case, we know and we have known for years, but it has become Crystal Clear over the last couple of years that the media that People Choose and consume not only gives them comfort in the views that they already hold, but helps solidify and guide those views and when you look at that New York Times siena poll from a couple of days before yesterdays indictment, you see eight out of ten fox News Watchers saying that donald trump was exercising his right to contest the election and thats all he was doing. You see only 5 of those News Watchers saying they believe that the former president committed serious crimes. Part of the legal question is going to be decided by a jury, but the political question, you know, can actually be a trump card, pardon the pun, even if donald trump were to be convicted, he could still be reelected by people who dont believe that what he has done is criminal. And that is the ultimate test and the media plays an important role. Yeah, no, listen, all of your points are so excellent. You mentioned George Washington teaching him how to say goodbye, john adams lost and he also taught everybody when you lose, you go quietly. Really fundamental question. Thank you, all, so much. Appreciate it. And thank you for joining inside politics. Cnn news central starts after a quick break. man mm, hey, honey. Looks like my todo list grew.
