It Carlos De Oliveira is facing four charges including conspiracy to obstruct justice, and making false statements to the fbi. The Justice Department is unfortunately decided to bring these charges [inaudible] put their money where their mouth. This according to the federal indictment, de oliveira allegedly asked the maralago security worker about how long Security Footage remained in the server. He said that, quote, the boss wanted the server deleted. An apparent reference to donald trump, who remains defiant on the campaign trail. You know, theyre not indicting me, theyre indicting you. I just happen to be standing in their way. That is all that is. To people close to the investigation identified the i. T. Worker as useful tavares, who told Carlos De Oliveira he did not believe he had the right to delete the footage. That is according to the indictment which is not indicate the footage was ever deleted. It is unclear if tavares is cooperating with the Special Counsel, but sources tell cnn that the new allegations resulted in at least part from Information Taveras provided to investigators. Carlos de oliveira has not yet entered a plea. We try tracking him down after his court date in palm beach florida, about 20 minutes north of trumps nobody onto the door. But, Carlos De Oliveira landlord agreed speaking by phone, he said hes not in 30 years and described him as a good friend and the guy. He also told me, if de oliveira knows anything, he says he, should, quote, come clean. De oliveira has worked at maralago for about 20 years his landlord said, starting out as a valet and then holding various maintenance jobs before becoming the clubs property manager. This neighbor of Carlos De Oliveira said he knew him for a few years. When asked about the federal indictment, this was his response. Anybody that gets involved with donald trump, hes trained work. Anybody that gets involved donald trump ends up somewhere in a bad place. I do not think that guy had any knowledge of what he was doing. Those closest to Carlos De Oliveira see that as a portuguese immigrant unfamiliar with the u. S. Legal system, he may not have understood the consequences of what trump allegedly told him to do. One relative telling cnn the family feels like he got trapped. Why didnt he enter a plea today . Carlos de oliveira didnt have an attorney with him, he needs an attorney who was bared for duncan actually practice law in florida in order to enter that plea he was here in court today with eight Washington Post estate tourney. So now, he will have his official arraignment next week on august 10th where he is expected to enter a plea. For now, anderson, he is out on this 100,000 dollar bond, but it is not without restrictions, he has to turn his passport within the next 48 hours. He also cannot discuss the case with any potential government witnesses. His travel is also restricted. He cannot leave South Florida without first getting permission. It is also, Anderson Worth noting just very quickly, that this delay in his arraignment and his plea may have an impact on the trial for donald trump in this case, on Donald Trumps trial. There is a lot of questions still about whether or not that trial will be able to take place before the president ial election, anderson. Randi, thank you very much. We mentioned the top in the development in the court file today from Special Counsel jack smith, indicating that Video Surveillance footage obtained after the initial indictment, quote, pertains the new obstruction allegations. And the superseding charges involving among others, mr. De oliveira. Theyre also the new information about the individual described in the Eye Champlain ember for, and his possible role in the case. Were going to get some perspective from cnn legal analyst elie, we saw walt nauta didnt have before the base attorney. Now, this guy doesnt. It is a strategy to just delay wherever they can, or is this legit . It certainly seems that way to me. It is not unusual, but it is not ideal to show up for Court Without a lawyer. The reason i say its on unusual, is he was indicted in fairness late thursday, so that really give him one business day. But, the bigger issue here is that we have now three defense in this case, all of them have the exact same extensive to delay at every single term. We saw it will not having allure, we saw with Carlos De Oliveira. We should point out his attorney in washington base has been paid for a packed former president. Also very significant which will make it very difficult for Carlos De Oliveira to flip. Not impossible, very difficult. If you had three defendants and they are taking every opportunity a day here, a couple days here week there, that is all going to add up and make it really difficult for doj to get this child an inmate as it is currently struggle. Andrew, if youre this new defendants, and you are now seeing the inside of a Federal Courtroom, are you thinking of cooperating with the doj . Has that ship already sailed . Well, the ship wasnt sailed, but they are pulling up the anchor and getting ready to go. It is not optimal to try and cooperate after hes been indicted, but it is also not impossible. What it would require is four Carlos De Oliveira to decide he is going to part ways with the former president , and then to the gnocchi with doj, the progress some sort of, deal which would invariably require him to plead to some lesser charge or one of the charges on the indictment. Then, he would have to provide Witness Testimony and evidence, you know testify trial, those sorts of things. Hes already hurt his opportunity to do that by being caught lying by the fbi. So, one of the charges against him is 1001, that is false statements to federal officials. So, hes already somewhat damage as a potential witness. So, the chances of him putting all this together and cooperating successfully is getting more remote this time goes by, but it is not quite impossible yet. Carey, about leading the footage received a target letter, but is so far not been charged. What does that indicate to you . This certainly seems like there were transcripts of conversation. It seem like they came from i wouldnt some before. Yeah, so i would interpret that to mean that that individual is in a dialogue with the Justice Department about cooperating, about potentially answering into a plea deal, and so that individual, i would intervene it has made a decision. That ongoing conversation, that that person is having, and the question will be whether that person is represented by counsel, represented by independent counsel, not connected to any of the other defendants at this time. If that were the case, then the might help the persons ability to negotiate with the Justice Department. It is very easy from the outside to say, look, oliveira should get his own attorney and cooperates. He would lose a job, i assume, in maralago. Former president go after him as era. Public, who knows what kind of public intention discard begetting until that would impact the rest of his life. And, they would be your markedly costly. I do not know that Carlos De Oliveira has the decision of whether to cooperate or not at one of the most decisions that any person can ever make, it is a uniquely personal decision and it brings together financial considerations, loyalty considerations, familial considerations. And so i dont think we should ever say somebody ought to cooperate, i think its really up to that individual. But i think i agree with andy, all indications are that de oliveira have not cooperated now and all the indicators are pointing to that being very unlikely. Andrew the Special Counsel team indicated in a court filing that investigators obtained footage in recent weeks are relating to the that was obtained after the initial indictment was handed off. In general, how active is a federal investigation after an indictment . Does it surprise you that they would be turning up new evidence like this . It really doesnt surprise me, anderson, because we have seen witnesses paraded into this grand jury for the leaks over the last several weeks, even after the initial indictment. So we knew that they were pursuing something. We have also seen several signs that indicated that the prosecutors were not comfortable with a sort of response that they have gotten for theirs quest for the Video Surveillance. We know they had served additional subpoenas on technical companies, at least one company that was supposedly involved in potentially maintaining your backing up the servers from maralago, so that is indicative of a persistent concern on their part that they didnt get everything they had asked for, and they are going to stay on top of that until they have squeezed every possible opportunity to render the entirety of that footage in a way that they can then compare it to what they received from the trump organization. That really makes the case for obstruction. If there are differences there and what was turned over for what the original shows, that could be very very damaging to the defendant. Terry, the indictment did not indicate whether the Security Footage in question was actually deleted. Does that actually matter when you are talking about alleged obstruction. Is there a difference between if destroying evidence and requesting evidence be destroyed . Well, i think evidence that was actually destroyed would only make the case stronger. However, the way that the facts have been laid out in the indictment of the superseding indictments so far, would, in my judgment, meet the elements of what the Justice Department would be needing to prove in terms of obstruction. It would match other types of cases that are based on obstruction. Presumably, they wouldnt be putting all of the examples that they had given for the indictment didnt think they could prove each of those in court if they actually go to trial. I mean, with they really do have a number of witnesses and i think part of the difference of overtime to maybe the first and the second superseding indictment is that more information seems to be coming forward. Whether it is evidentiary information, or witnesses testimony, or maybe it is when individuals received a target letter, and then that is an insensitive for them to engage in providing more information to the Justice Department. Ali, do you think it is possible prosecutors are sending a message to other potential witnesses with the superseding indictment . Sure. I think the message is when we say the investigation is ongoing, we mean it. Look, prosecutors to give people ultimatums, essentially and, i think one was given here. Either you come in and talk to, us or you find yourself a defendant, and i think based on all the indicators of carlos yellow vera declined the, now he finds over the find, it employee for took that offer and that is why he is not charged. That already, she made that pretty clear. So, according to the poll, desantis by 37. Is there any precedent for someone trailing by that much in this point and a primary season, actually catching up . Inward, no. There isnt. We can go all the way back since 1972 and look at the biggest comeback ever. They were all at about 20 points. George jimmy carter and 76, barack obama in 2008. All of them were down by about 20 points, a little bit less, and came back and won. Right now, ron desantis is trailing by over 30 points. There is no precedent, at all, for somebody in desantiss position coming back and there is no president , at all, for somebody in Donald Trumps position not becoming the republican nomination. Mitt romney a little while ago had spoken out about, at a certain point, donors should tell the lesser candidates to move aside, get out, so that the field can win out. Is there any evidence that, if the field were to win oh, what would the data show . I think ive been using the word know a lot in the segment, i dont know if youve been following me. It is awfully difficult if a guy is polling at above 50 to get everybody else, and then somehow beat that 50 because it has to add up to 100. So, if in fact, all the other candidates besides ron desantis and its just a matter between donald trump and ron desantis, guess who wins . Donald trump. Donald trump wins by over 30 points in that matchup. In this particular point, you are looking at all the data, you just have to say that donald trump is a clear favorite for the republican nomination and this is just another data point that points in that direction. Youve been steadfast and saying that former President Trump will not be the 2024 republican nominee. Do these poll numbers make you question that . No. It is a national poll, so with all due respect to the basket and montanas and even texas of the world, that is not where the discussion is happening. So where candidates are investing their money, where theyre pushing their message like iowa and New Hampshire, look at those polls. And, in New Hampshire, two of the last three polls have trump under 40. The rcep average in iowa right now is trump at 42. And what is happening i saw numbers from a university of New Hampshire that to show the former president with a 14 point lead over desantis. He has a lead, of course he has a lead, but his total, its not what he has. You have to look what he doesnt have. In places like iowa and New Hampshire he doesnt have well over 50 in some polls, over 60 of the hardcore republican base. So where the candidates are investing their money and certain candidates are starting to move, and we will see from doug burgum even, he barely shows up in a national poll, but in iowa, New Hampshire, is right at those polls. Tim scott really moving. Pence and haley not so much, but where theyre investing their money and folks are really gauging the conversation, the polls are actually really different. So with all due respect to the new york times, National Polls right now dont fill the story. Here is one that we have not even had a debate yet, we havent seen who shines, who fails, who can stick it to him, who cant. Of course he is a former president , is going to be leading in the polls,. That shouldnt surprise anybody. But, given that all the baggage that he has, the fact that candidates are really moving, there is a lot of opportunity here for somebody to really rise and shine. And then you get down to that oneonone race and trump is in trouble. You obviously know your savior well, is history showing that the debates in the republican primaries mak debatee republican primaries make a big difference . Go ask marco rubio and rick perry, i mean yeah, they matter. Herman cain, no one knew herman cains name at this point. By november he was winning in four or five National Polls simply because the debates. So people do watch, not just locally, but nationally as well. And they want to see who can give a punch, who can stand on that pit stage not just to be one of many, but to truly be a leader, to show the charisma, the inspiration that leadership. That, as the witness testified, was what these conversations and calls were about. And, on occasion, hunter biden would put his father on speaker to say hello. You know, the concept that this brand of joe biden is false, its not what the witness said. I was the only member who remained in the room when the witness clarified that the brand that he was talking about is hunters own experience as a lobbyist and lawyer in washington d. C. , combined with the by name, which of course is no different than the trump name or the clinton name, or any other big political family name. I get what youre saying that now President Biden was not involved in business calls or whatever. It seems a little shady for hunter biden, who is a grown adult, to be making his dad come on to speak or phone calls, even if it is a social dinner. It is a flex of power, isnt it . The question here is not what hunter biden did, the question is what did President Joe Biden did, if anything. He said that there is no 5 Million Dollar payment to hunter or joe that he knew about, he said that all of hunters payments from burisma went through their joint account during the time that devin archer was on the board, and he said that joe biden received no money ever from burisma.
