for children under 5. we begin with stunning new details of donald trump's effort to ignore democracy and to keep power. just a few of the new headlines trump advisers drafted more than one executive order to seize voting machines. mike pence's former chief of staff testifies in the house january 6th investigation and some trump white house records handed over to that committee we are now told had been ripped up. two big takeaways from all of this. one is the alarming depth and scope of the effort to find a way to ignore the election, stage a coup, yes, a coup, to hold power. two is the remarkable progress the committee is making in building the historical record. new testimony from key trump insiders and those new white house records including some that the national archives says were reassembled like puzzle pieces after being torn to shreds. let's get straight to capitol hill and ryan noble. tell us more. >> so much that happened just in the last 24 hours, john. let's talk about this new revelation that there was a second draft executive order that was attempting to empower federal agencies to seize voting machines to try and investigate these unfounded claims of fraud. we are now learning that there was a long cast of characters that were directly involved with white house officials, trying to come up with some sort of legal reasoning as to why either the department of homeland security or the department of defense could go in and take these voting machines from these key swing states where trump was hoping to change the election results. and this group is someone -- this group continues to be the same group of people that we're talking about as this investigation has unfolded. rudy giuliani, the president's personal lawyer at the time who seems to have been the ringleader of all of this effort. sidney powell, a conservative lawyer who was feeding trump and his allies with questionable legal theorys about the ability of the vice president to overturn this election. and bernard kerik who is cooperating with the committee and has held an extensive interview with them who is also a key player in all of this. so, john, this is just an example of the information that the committee continues to uncover about this plot and all the many different ways that trump and his associates were trying to find some sort of path to overturn the will of the american voters. and this wasn't just some symbolic effort. they truly wanted to make this happen and there were people that stood in the way, including the former attorney general bill barr who "the new york times" is reporting was presented with one of these options and turned it down immediately saying it was just not something that was feasible. >> ryan, let's focus a bit here and help me understand the importance of a mark short, chief of staff to then vice president mike pence but also the former trump legislative director. so someone at the vice president's side consistently from election day up to january 6th, when trump wanted mike pence to help him cheat, but also somebody who was wired throughout the west wing. he knows what's happening in that building. >> i don't think there's any doubt about that. and the way you have to view mark short is he's a firsthand witness. he was somebody that was in the room where it happened. he was there on january 4th during a key meeting where trump and his allies were trying pressure mike pence to take that unprecedented step of using this fictional power to overturn the election results. he was by pence's side during awl all the chaos january 6th when pence was evacuated out of the capitol and maintains a close relationship with the former vice president. he was subpoenaed and compelled. the fact he didn't fight that subpoena shows on some level pence has given tacit approval for him and others to talk to the committee. now the committee still wants to talk to mike pence but even if they don't get that opportunity, the fact that they have someone like marc short at their disposal, someone that give them this much information is a key part of this investigation. >> put together that critical timeline. ryan nobles, thanks. with me, the former federal prosecutor shan wu, dana bash, eva mccann and laura barron-lopez. some people out there saying, let it go. let it go. it was more than a year ago. why do you keep talking about this. look at the fabulous new cnn reporting and i'm going to add this from "the new york times." mr. trump was more directly involved than previously known in exploring proposals to use his national security agencies to seize voting machines as he grasped unsuccessfully for evidence of fraud that would help him reverse his defeat in the 2020 election according to people familiar with the episodes. it's to use his national security agencies to seize voting machines. it's critical because he's planning a comeback and this is a president who, by all accounts in this reporting, was more involved than we previously knew and tried to keep power to say democracy doesn't matter. i'm saying. >> that's exactly right. this isn't just knowing what happened for history's sake, which is very important. but it's also knowing what happened because he's still very much a player in the republican party right now gearing up for the midterms and potentially for his own future. the fact that the committee is painting such a robust picture based on firsthand accounts, like ryan was just talking about and documents they are seizing is very telling. and i just want to underscore something that you talked about with ryan about marc short. there is nobody who is closer to the former vice president than marc short. i know from my reporting at the time and even now today, he was in every meeting on almost every phone call with mike pence relating to everything, but especially this push by the president to overturn the election and use mike pence to do that. now whether or not marc short gave any -- what may be considered privileged information, executive information about those conversations to the committee is unclear. i know that he is somebody who kind of abides by the notion that conversations with the president when you are working for the president should remain confidential. but there's no question that he had a lot of information to give. >> and so shan, as a former federal prosecutor, you see the extensive meticulous work the committee is doing, but when you see these new details and try to press the justice department. will you seize voting machines? no, that didn't work. what about the department of homeland security? can they go out and seize the voting machines? that is corrupt. is it criminal? >> i think it is criminal. i mean, certainly deserving of a criminal investigation at this point. i mean, intent is always the key here and that's what this evidence is about. intent. it's hard to record a person's thoughts, but the next best thing is written material. so these drafts really showed there was no mistake and also the circumstances show there is no good-faith basis for this. it's a naked attempt to seize and retain their power. >> and so laura barron-lopez, details in the last 24 hours, let alone the last 12 months. but donald trump saying i might pardon, i'm inclined to pardon people convicted of the january 6th insurrection. these new details about donald trump in the oval office trying to concoct any means necessary to hold power. if i can't get a secretary of state in georgia to help me cheat, maybe we'll have the pentagon seize voting machines and yet, and yet john thune, republican senate leader just said the system worked. they shrug it off. the system worked and trump wasn't able to keep power. kevin kramer telling cnn, if he feels like there were people unjustly detained, wrongfully detained, he has every right in the world to do that. to pardon them if he wants. we have a president in the white house trying to change the subject to joe biden. why is it that even after learning all of this that the leader of their party is anti-democratic, that the leader of their party, given power again, would try to do it again. they all just say hohum. >> yeah, john, it shouldn't really be surprising at this point, i guess, but it still is frankly stunning. and really it comes down to political calculation for republicans, which is that they think that their best bet to regain power and to hold power is alongside trump is with trump. and so that's why you see so many republicans across the country, be it national ones like you just quoted, but also local state electors who are trying to outcompete each other to be as trumpy as they can be. and by that i mean you see republican state electeds in wisconsin saying -- encouraging their fellow republicans to cheat in order to win elections. you are hearing that from the former president himself who has said in recent rallies in arizona, as well as before pennsylvania republicans that republicans should tinker with elections that they should, you know, just cheat brazenly. so trump isn't hiding the ball about what's to come in 2024. >> and you make a critical point there because often, we can roll back the tape, and there are people out there who have ideas out on the fringe and we ignore them. people who propose things and we ignore them because they're on the fringe. trump brought these anti-democratic fringe ideas into the mainstream to wit, mike detmer is running for the michigan state senate. he says if things don't go our way, people listen. >> the american people at some point in time, if we can't change the tide, and we believe we can, we need to be prepared a lot more. so you ask, what can we do? show up armed. >> again to those who say why do you keep looking at this and exploring the historical record and holding trump accountable for this. the seeds have been planted for a new jeneration of this. if the election is not going our way, show up armed? >> yeah, there it is, john. there is an increasing group within the republican party that is growing more radical. and the question is, are there going to be republican members that get back to what the republican party is supposed to stand for, right? lower taxes, i think, is something that they once used to run on, but now it's trumpism or nothing. i mean, what is -- what are they going to be running on in 2022? are they championing conservative policies? or is it solely about the politics of personality and this one man? there are adults in the room. who are the republicans, i think, is what we're all watching now. are they going to emerge to really stand up against this because it is alarming. >> they would have to push him to the sidelines, which they refuse to do, to have conversations about the many other important issues that would be great to have a campaign about. but he is back in the public in ukraine and the standoff with nato and the united states since late december. let's get straight to the white house and kaitlan collins. if you're looking for a diplomatic off ramp that does not leave you optimistic. >> no indications the russian president is ready to back down and he seemed to be making a forceful argument for why he's amassed those over 100,000 russian forces on the ukraine border, something that's been the number one concern for the top aides here at the white house. what you heard from the russian leader is, a, significant given this is the first time we're hearing from him on this as you noted since late december. we've not had him say anything publicly this year on this as there's been a lot of dialogue back and forth. putin stayed totally silent. that's not helped people who are trying to read the tea leaves, trying to guess where his head is at on the invasion. there he was saying, yes, russia got this u.s. response last week on their security demands. we weren't expecting there to be a major breakthrough on that but all of their security concerns were basically ignored were the words he used by the united states. that is something that russia has not responded to in writing yet . we thought they responded but they have not sent their main response in. could come in the next few days, next few weeks. the other thing the russian president said was that he believes nato swindled the russians, lied to the russians about their eastward expansion, talking about what nato itself looks like and reiterating his number one demand which is that ukraine never join nato. that's something the white house has said is off the table. when it comes to the idea of de-escalating and what that looks like, that's the russian president saying that is still something he wants. we know the u.s. has said that's not an option. we'll see if diplomacy is an option. he said maybe the french president would come to russia. >> stalemate at the moment. kaitlan collins, appreciate the live update from the white house. we are told as soon as today, pfizer could ask the fda to greenlight its covid vaccine for children under 5. pfizer will seek emergency authorization. quick fda approval could mean shots in arms as soon as this month. let's bring in dr. leana wen, former baltimore city health commissioner. i want to pop the data up here. this is of concern to you. pfizer released a study, its research that says among those 6 months to 24 months, this new vaccine, the dose for young children produced similar level of immunity as 16 to 25-year-olds, which is good news. but among those aged 2 through just below 5 it produced lower levels of immunity and so they are testing a third dose to possibly add to the regimen. is this good news to get this vaccine out there as soon as possible or would you say let's wait a bit? >> well, i am ambivalent right now which is not something that i ever thought i would say about vaccines for under 5-year-olds. i'm the mom of two kids under 5. i can't wait until they're vaccinated but i would wait until we find that the vaccines are safe and effective. and i'm not sure that we can say that at the moment because we just don't have the data. now i definitely understand the urgency that many parents are feeling. and i can also understand the point of view that, hey if three doses are being studied and two le will give you some level prove techs. maybe some parents will take that choice but others want to wait until we know three doses will produce the intended effect. >> it's critical for parents watching, especially those that have watched you knowing you're one of these parents. let's listen to dr. scott gottlieb who says essentially his point is what are you looking for? here's the data. it's not perfect, but it's good. what are you looking for? >> if the goal of the vaccine is to get base line immunity in the kids to prevent really bad outcomes and not using it as a tool to prevent infection in the first place, two doses could do that. >> so the question is, does it help? i want to go through a couple of stats. fully vaccinated. we already know among those fully vaccinated we've seen hesitancy among parents with children aged 5 to 11. only 22% of those children are fully vaccinated. teenagers, 56%, adults, 74%. there's already, dr. wen, some hesitancy, reluctance to get your shots in arms for kids 5 through 11. then look at the cases, right? if you look at the cases among children, still an alarming number. 800,000. dropping but still down. and if i look at cases by age, this is what is critical. right now we know kids 0 through 4, only 3% of the cases the studies show. if you are a parent and have a kid in this age group, how are you balancing, well, my children seem to be safer than these other age groups so do i just keep them at home? i can control their movements or should i just get the vaccine for now and hope it gets better down the road? >> we're going to see a lot of people making individualized decisions for their children. by the way, the data when, let's say these vaccines get authorized by late february, if that's the case, the numbers for omicron, numbers for covid are going to look very different. we're in the middle of an omicron peak right now but that's not going to be the case for forever. and i think the decision-making is also going to look different, too. look, at any point when vaccines are first authorized for any age group there are people who are the early adopters who cannot wait and would want any level of protection. but there are others who want to wait and see and maybe they want others to go first. and then there are others who also want to know what's in it for me? what's in it for my children? when you look at the 5 to 11-year-olds, it would have made a big difference in vaccine uptake if the administration, if the cdc and others have said very clearly once your child is vaccinated, masks are optional. i think tying vaccination to an off ramp to masking is going to be really critical for increasing vaccine uptake, especially in the younger age groups. >> i think you make a lot of people said it's time for new markers from the government. new markers especially as we do. we are making substantial progress. 45 states now trending down. from a very high base line. it's critical to note. still have an enormous number of omicron cases. 45 states reported fewer cases this week than last. only one state reporting more infections. that's maine. so are we at this inflection point where it's time for a reset from the government to help answer all of these questions whether it's vaccines for the youngest children or when can my mask come off at other places as well? >> yes, it is. we cannot be in a perpetual state of public health emergency. that's not credible. it's also allowing many other problems to go by the wayside. and we have to give people some respite after this two-year period of ongoing restrictions. i do think that we need to wait until hospitalizations are trending down. so in places where hospitals are still overwhelmed, that's not the time to let up restrictions. but if hospitalizations are consistently down, it is time for us to remove restrictions. yes, we may have new variants, but that's why it's even more important to give >> no, he is not. and i would say what's important about this is that these comments aren't in isolation. if you speak to republican members of congress, for instance, which i have for years, and ask them about systemic racism, they don't believe it is real. racism to them is an event we've overcome. it isn't still part of reality in america today in terms of being in our institutions. so this idea that a black woman should be elevated, i think you see this kind of snarkyness and pushback because this is how they view race and racism as a whole. why are we even still talking about this? it is actually white men that are being discriminated against. that is the position i have heard from many of them for years. >> well, that's a fascinating conversation as we go forward to see how many republicans take that position. senator roger wicker over the weekend said he thought this was a quota. yesterday he said diversity is a great thing, don't get me wrong but also stands by that interview. but laura barron-lopez, this at a time when many republicans think we have the wind at our back in this election year. if the president picks somebody who is qualified, maybe we should just make this normal, make this quick and focus on all the other things. chuck grassley is the lead republican on the committee. he's going to help determine the republican strategy in those hearings. he says he's going to just go to the white house and listen. >> ought to be courteous to the president and try to answer his questions. and i don't know what those questions are going to be. but i'm going to take the approach that we need somebody that's going to interpret the law and not make law because that's congress' job. >> it's always hilarious when the roles switch. it was the democrats saying the same thing at the end there in the trump presidency. you want somebody to interpret the law, not make the law. president biden wants to seek advice from republicans. he wants this to be an old-school process. can it be? >> well, the reality is, john, is that democrats can confirm this judge without republican votes. and so even though the white house is saying that they want to seek advice from republicans, that they want them to be engaged in this process, ultimately they only need democratic votes. you are hearing a few republicans praise some of the potential names so far, including judge michelle childs of south carolina. we heard senator lindsey graham say that he thought she would be immensely qualified. and also judge brown, jackson browne. she's someone who gained some republican votes, about three republican votes when she was confirmed to the district court. so there is a potential for some republicans to support one of biden's nominees here. >> the republican who matters most here is the republican leader, mitch mcconnell, who we all know from reporting sometimes had to sit in his office and figure out what his future president cruz thinking, what is future president holley thinking. he has some republicans who are going to try to gain stature. gain profile. appeal to the base through this pick. but he controls it and listen to his words because at the moment he sounds normal. >> president biden was elected on the specific promise to govern in the middle. steward our governing institutions and unite a divided country. i suggest that president biden bear this in mind as he considers whom to nominate to our highest court. >> that's called, you know, the sphinx. it's sometimes a compliment. playing it safe speep what the president gives us. but if you're mitch mcconnell, you think in a midterm year trending in your favor you don't want anything that messes that up. >> no, absolutely. and it's always -- you said it, john. it's always almost comical. it would be actually funny if it wasn't so serious to see how different these different senators act and react when the shoe is on the other foot, meaning when they're in the minority or facing a president of the other party who has a nominee in front of them. and just on that note, yes, senator mcconnell is going to kind of see how things go and let his senators who need to do what they need to do for their own politics and their own re-election have those moments. but when it comes to the absolute hypocrisy, which again, we have seen time and time again on supreme court nominees. the notion of, never mind the argument and understanding that was just talked about with regard to black women and systemic racism. let's just even broaden it out to the idea that it's offensive that a president or a candidate talks about the kind of justice they would nominate. i mean, donald trump put out a list of specific people. and he said that his -- that his absolute bottom line was that they have to overturn roe v. wade. where was the outrage on that if they wanted somebody who would just interpret the law and not make the law? get published now, call for your free publisher kit today! one total jumps out most in our new review of early midterm year political fund-raising. former president trump's organization has amassed $122 million. my panel of reporters back to discuss. that's a big chunk of money. i want to come back to that former president in a moment. dana bash, start with another former president who doesn't like donald trump. george w. bush putting his money where his mouth is, if you will. look at these contributions to liz cheney and senator lisa murkowski, probably the two republicans donald trump has vowed to defeat almost the most. i guess brian kemp, we'll get to him in a minute. we have some others. but george w. bush making a statement there. he's also held fund-raisers and green lighted all of his people to help these candidates. but liz cheney, lisa murkowski. what does that tell us about the message "w." is sending. >> he's trying to make it clear where he thinks the republican party should be, which is where those two women are. remember, the donations that he is making to those two is not because they're running against formidable or any democratic candidates. this is inside republican primaries in both of those cases. liz cheney, as you said, he held a fund-raiser for her and he's donating as well. lisa murkowski is really interesting. there's no evidence that he's given to her before, but she also has, just like liz cheney, a republican primary opponent that is aggressively backed by former president donald trump because she voted for impeachment. she has been outwardly and openly critical of the former president when she sees fit. so the fact that george w. bush, who when we covered him, we knew he was and still is an institutionalist, is making this donation but more importantly making the statement of where he wants the republican party to be, is very noteworthy. >> which reminds us, one of the big questions in the midterm election, before we get to november, is what happens in the primaries, especially some of those interesting republican primaries. let's come back to trump for a minute. $122 million. you would think if you're donald trump you could do a lot of business with that. the question is when, laura? we do see donald trump in this new ad but he didn't pay for it. >> brian kemp let us down. we can't let it happen again. david perdue is an outstanding man. he's tough, he's smart, he has my complete and total endorsement. vote for david perdue. >> i mean quickly translate there. donald trump says brian kemp let us down. brian kemp didn't help donald trump cheat is what he meant to say. the issue for me, that's paid for by the perdue campaign. trump has all this money, but the big question is does he use it to support people he likes. does he spending a lot of it, spend a little of it or save it for him in 2024? i'm betting on the latter. >> i'm betting on the latter too. trump is known to spend little on campaigns like this, on other republicans down ballot. so he's amassing this war chest for a potential 2024 run. i mean, look, trump is making clear that unless something dramatically changes, unless he's prosecuted, he plans to run again and that will ultimately be for his attempt to subvert the election, for his attempt to potentially cheat in 2024, because again, as we talked about earlier this hour, he's not hiding any of that. he's not trying to say that he isn't running and he's not -- all the indications are that he's asking republicans to help him subvert the election. >> and one question is if he's raising so much money and holding it for himself, does that eventually take money away from other republicans, if there's -- especially the small donors. people who have $25, $50 to give and decide to give it to him, might keep it out. so democrats know they have the wind in their face this year. one thing you do in a tough climate is try to outraise your opponents. in arizona, mark kelly raising a ton more money. you see him with $9 million. herschel walker, that's pretty good for a new republican candidate. he's a celebrity from football, but you see senator raphael warnock with $10 million in the bank. in nevada, the democratic candidate way ahead. that's one strategy for the democrats. it looks like in these key races we'll be watching a big deal. get as much money as you can always helps in a tough environment. >> that seems to be the strategy, it doesn't hurt. we are still several months away so we'll have to see what impact all this money has. what it does do is alleviate some pressure on the committees and the democratic party as a whole, right?
