they are about female empowerment. they are making a lot of great strides. but there is always room for improvement, especially when you're making comment for kids. >> thank you both very much. and "new day" continues right now. ♪ welcome to our viewers in the united states and around the world. it is wednesday, january 26th. i'm brianna keilar with john berman. breaking overnight, a cnn exclusive. the justice department confirming that prosecutors are looking into a specific event from the plot to overturn the 2020 election. deputy attorney general lisa monaco tells cnn that federal prosecutors are reviewing the fake electoral college certifications from 2020 that falsely declared former president trump the winner of seven states that he lost. >> on the issue you raised in terms of fraudulent elector certifications has been reported. we've received those referrals. our prosecutors are looking at those. and i can't say anything more in ongoing investigations. but more broadly, look, the attorney general has been very, very clear. we will follow the facts and the law wherever they lead to address conduct of any kind and at any level that is part of an assault on our democracy. trump allies in nevada, arizona, new mexico, wisconsin, michigan, pennsylvania and georgia signed the fake electoral certifications claiming to be the rightful electors. and some of the bogus certifications were sent to national car kaoeufs by top state republican party officials. joining us now cnn "early start" anchor and attorney at law, laura jarrett. laura, the significance here is that you have the number two person at the department of justice acknowledging for the first time there is an active investigation into the highest levels of the trump political world. we know rudy giuliani, among others, was involved in this. >> this is really major news. for the better part of a year, we have been operating in the dog, not knowing what doj prosecutors were up to when it comes to this attempted coup. even perez got to be sit down with lisa monaco, the person who supervises the u.s. attorneys around the country. no better person to speak to what is happening in that building. and he got her to say there is an ongoing investigation. she said she can't comment on the ongoing investigation. but we at least now know prosecutors are actually looking into the referrals that they got from the state officials around the country and lawmakers who were concerned about these phony slates of electors being sent to the national archives. >> what do you think they are investigating specifically? >> we are still operating in a little bit a vacuum. there is still meat on the bones. there is a conspiracy against the united states, mail fraud. what the whole scheme here is there were actually phony slates of electors signing the certificates, saying trump was actually elected in states that he wasn't. meaning essentially trying to usurp the will of the voters in places where they had elected biden as president. they wanted to toss out the votes. they wanted to send the dualing slates of electors to give vice president mike pence the pretext to say, wait a minute, there seem to be objections. thankfully, mike pence upheld the duties that he had and didn't go along with that scheme. but that appears to be what the whole goal was here, we know based off our great reporting was cooked up by rudy giuliani and others who say this was a misguided effort to, again, usurp the election. >> again, this is the first public acknowledgment we have. an investigation into the highest levels specifically of what went on there. laura jarrett, thank you very much. sure. the justice department released new video of the attack on the capitol. two clips are noteworthy. one shows the initial breach of the east rotunda doors. look at the man in the green backpack helping rioters into the building. by the way, he is an active duty marine -- was at the time of the insurrection. he is charged with several crimes related to the riot, including assaulting a police officer. he has pleaded guilty. and in this clip, a rioter is seen inside the capitol building violently throwing a police officer to the ground. another officer quickly runs to help his colleague, pushing rioters away while more pour into the capitol. the officer helps his fellow officer up up and they are able to leave the area. this is very key, berman. we had heard from the lawyer for one of the folks who has been indicted in all of this saying, you know, these eastern doors, they were just opened up, sort of creating this idea that police just let people into the building. what we are seeing here, very clear they did not. >> no. there was violence. so as donald trump and his loyalists continue to peddle the big lie, confidence in america's elections continues to erode. i want to bring in cnn's donie o'sullivan. donie, you have been talking to people all over the spectrum here about really the undermining of trust in the system. >> reporter: that's right, john. we have spoken to hundreds of trump supporters over the past year. and one thing is becoming very, very clear. many of them no longer have trust in the american election process because of course they have been fed the big lie, conspiracy theories. we took a look at what this all might mean for the future of american democracy. >> what you're seeing and what year reading is not what's happening. >> reporter: former president trump's truth has ruined elections. >> you don't trust election officials. >> no. >> there you don't trust the fbi. >> no. >> you don't trust the courts. >> no. >> who do you trust. >> trump, his supporters, and anybody that when i listen to them talk they don't turn my stomach with the disin gen genui genuineness. >> do you have faith in american elections? >> i think whoever wins, win. he will win if he win runs again. people are saying i don't want to vote because it will happen again. >> because it will happen again. >> what is your reaction to hearing from an american like that? >> well, 10 years ago, it would have been shock and disbelief. i would have thought she is an out hraoeur and not anything more than a fringe movement maybe. but that's not the case any more. >> reporter: barbara studied civil conflict for years, from yugoslavia to northern ireland. >> experts who study wars and study the warning signs have been talking about them. but nobody wanted to believe it. and january 6th made it impossible to deny and ignore that there really was this cancer growing in our own country. there was a threat that was mobilizing. >> reporter: she warns right wing media, social media, and from trump himself has put the united states on a perilous path. >> citizens do believe what they are hearing. if they hear it long enough, consistently enough, and if that's all they hear, they absolutely don't think it's a lie. they think it's the truth. >> will you trust the next election? >> probably not. >> or that's a terrible thing, right? >> yeah, it's a terrible thing. >> you can't trust our government anymore. it's sad, but i really don't think you can. >> we can believe when you vote for somebody that person is going to get your vote. >> you know, they're good people. they are trying to do what they think is right. it's the leadership that's cynical. it's the leadership that knows better who is feeding them lies consistently. >> they always talk about the big lie. they're the big lie. >> reporter: while just 30% of americans think there is solid evidence of widespread fraud in the 2020 election, 62% of republicans say so. looking to the 22 midterm elections, some say they are very confident the results will be counted accurately, 42%. >> they are priming supporters to believe that democracy isn't worth defending about us they don't want democracy anymore. >> reporter: john, of course, everybody has individual responsibility into what they believe and don't believe and falling for b.s. as barbara walter, the expert in that piece, made the point if people are being fed this from all sides from their media, social media, and from trump himself, the most powerful person in the republican party, it's kind of easy then to see how people can fall into this trap of deception. >> look, if you destroy the concept of truth, then you can operate with impunity. that's one of the things happening here. terrific reporting as always. thank you. the white house calling an invasion by russia imminent. american troops have been placed on high alert in a show of reassurance. president biden said he would consider personally sanctionsing russian president vladimir putin if russia invades ukraine. it is very significant. cnn has reporters in both russia and ukraine with the very latest. >> reporter: i'm matthew chance in kyiv. ukrainian officials are push back that a russian invasion is imminent, telling cnn they are not yet seeing russian forces positioning themselves for an attack. one official said it could take one or two weeks for that to happen, if any order to invade is given. the assessment is at odds with the white house assessment of the threat, which it says is imminent. the ukrainian officials that we have spoken to say they are extremely happy with the stepping up of u.s. intervention and u.s. support during this crisis. but there is some frustration behind the scenes at the kind of messaging that's coming from the white house compared to what the ukrainian governments see as the real situation. >> reporter: i'm nic robertson in moscow where president putin's spokesman said president biden's possible personal sanctions on putin would not be painful. but he said they would be politically destructive. meanwhile, russia's foreign minister sergey lavrov got a big round of plaza when he said if the west does not respond to us constructively, if it continues its aggressive line, then we will revert to other means. he didn't say that the country was going to war. but in the past, the statements have implied they would turn to military alternatives. >> later in the show we will speak to the ukrainian ambassador to the united nations. and illegal partying that went on during the uk's strict covid lockdown. the report could be released any moment, so we are waiting for that. plus, who is behind the hundreds of disturbing anti spheplic flyers being disbursed across several american cities? are they willing to use a weapon? >> reporter: we heard reports out of fort lauderdale involving these flyers. they have located the rental car they believe to be involved. the mayor says they have solid leads. >> let's hope there's justice here. it is disgusting. leyla santiago, thank you so much for bringing that to us. house speaker nancy pelosi announces she will run for re-election. what are the implications of this and what does it mean for house leadership? what didn't she say, and what does it all mean? >> yeah. well, we don't agonize. we organize is a nancy pelosi ism for we have a tough road ahead. they have they have a very pitched battle for the house of representatives. and nancy pelosi knows she is the general and she cannot leave the fight in the middle of the battle. so it is important for her to announce she is going to stay on in part because this cycle, 29 other democrats have already said they are going to retire or not run for re-election. that is almost a high watermark in recent history when rank and file members know this is going to be tough. many headed for the exits. democrats are trying to hold on to as many seats as possible. >> there is always this calculation, abby, when a speaker or leader is thinking about, you know, what does the future hold for me. who would replace them? i don't know how clear that is for nancy pelosi. >> reporter: i don't know if there has been a speaker in recent history who has been as difficult to replace as nancy pelosi and perhaps the subject of this much speculation. there are a lot of democrats, especially the younger ones, the progressive ones who want fresh blood in that position. but i think a lot of democrats in the house right now agree that it's really hard to replace nancy pelosi. democrats believe she has been largely effective. she has held this very kind of unwieldy caucus together in difficult times. and so we don't know, though, whether or not it's the same thing to say nancy pelosi is running for re-election and also to say nancy pelosi is running to be speaker of the house again. democrats are having a hard time figuring out, okay, who is going to replace her if she doesn't run again for speaker. she is in her 80s. this is not the beginning of her career. it's very much the end. it is a question of how long will she want to stay holding onto her power. >> she did not say she is running to remain as speaker or democratic leader. she should be asked will you vow to serve a complete term? i want to shift gears to ohio republican senate hopeful j.d. vance, who was endorsed by marjorie taylor greene and j.d. vance is actually proud about that. he said honored to have marjorie's endorsement. we're going to win this thing and take the country back from the scumbags. what does this all mean? >> reporter: pretty amazing. look, i don't think there's been a candidate thus far, this cycle who has worked as hard as j.d. vance to remake himself into a trumpian figure. i mean, this is someone who a couple of years ago we were at the same as salesperson institute panel. he is a venture capitalist who is running now fighting against corporate oligarchs. that's what greene used? her announcement. a lot of people in washington find it funny, or repulsive or whatever it is. i'm not so sure that voters in ohio care one way or the other. they are waiting in that race, republican voters are waiting in that race for the trump endorsement. but i think you could argue it is a precursor to that. that's why it is somewhat notable in addition to what a lot of people see as hypocrisy from j.d. vance. he was widely viewed as almost like a moderate, you know, corporateist figure who turned himself into a populist in the mold of trump. we will see if ohio voters believe that by the time they have a chance to cast a ballot. >> abby phillip, thank you for being with us this morning. >> reporter: thanks, guys. a young father who needs a heart transplant denied the procedure because he is unvaccinated. why both he and the hospital are not backing down. and just announced, how the epa plans to take action on pollution that is wreaking havoc on the american south. like in louisiana's so-called cancer alley. because it is killing people. but, you know, ratings and that is the ultimate moral crime. >> it's a choice, a clear choice. a 31-year-old man in need of a heart transplant is no longer eligible for the procedure because he refuses to get the covid vaccine. brigham hospital in boston say it is one of several vaccines required for transplant candidates in the mass general brigham system in order to create both the best chance for a successful operation and also the patient's survival after transplantation. candidates must receive the hepatitis b and flu vaccines, follow other healthy behaviors and demonstrate they can commit to taking the required medications following transplant. now here's what the man's father says explaining why his son refuses to get vaccinated. >> my son is on the edge of death. >> he is sticking to his guns. his heart has deteriorated so much to the point where it won't work. it is kind of against his basic principles. he doesn't really believe in it. it's his body. it's his choice. >> joining us now is the director of medical act eubgs professor arthur caplan. thank you for being with us. i think you need to explain to people so they understand what the procedures are for who gets organ transplants. how does it work and what are the requirements? >> good morning, john. what we have is transplant centers make decisions about who to admit to the transplant programs. each transplant center has rules, has criteria for saying you can come in. we think you really are in need of a transplant. then once they're in a hospital, there is a national system that takes all the people that have been admitted to individual transplant centers and, if you will, ranks them, assigns them, they know what their blood type is, their antibody type is, whether they need a large heart or a small heart. and so the distribution then moves around the country, say, of hearts. no heart eligible from a donor is likely to go to waste. the argument is who to give it to, who has the best chance to survive with this scarce resource. >> there are a finite number of hearts and organs available. and who gets them depends who has the best chance of surviving and who needs it most? >> correct. >> we need more organs. we have been pursuing at nyu, maryland, other programs that try to engineer animals to try to get more organs. the pig heart experiments we have been seeing to try and fill the gap. every day many will die because there aren't enough organs to give them. the transplant teams do their best figuring out how to use them most effectiveively, the scarce supply they've got. . >> and if you haven't taken the covid vaccine, you are not a good candidate for the finite resource, they say. what do you say to the supporters of this man who say he is being punished? >> well, look, there is a big battle out there. we just heard of that. do you use covid vaccinations to prevent getting covid? this is not discrimination. this is not bias. what's going on here is the trance plant team is saying if you catch covid before we can transplant you, you will never get a transplant. you will be too sick. whatever the risks are, they are hugely outweighed by catching a case of covid, being in the icu and falling off the list. post-transplant, we have to fine-tune your immune system. we give you drugs so you don't reject the heart. it would be easier to do that if you didn't have the flu, if you didn't have covid, pneumonia, many other viral diseases. you need to take this so that you maximize your chances of success. and if you won't do it, then others who will do it are going to get priority because we don't have enough hearts to give to everybody. >> again, it's important to note other vaccines are required as well. we're dealing with a phi fight resource here. professor arthur caplan, thank you for being with us. >> my pleasure. just announced, the epa ramping up pollution monitoring and enforcement to help communities in the south facing the most harmful impacts, including louisiana's cancer alley. cnn's rene marsh traveled there last year. rene, tell us about this. >> reporter: yeah, we were there last year with the epa administrator, brianna. good morning. and this was one of the most toxic area codes in america, some of the highest cancer rates. we met with people, spoke with people breathing this toxic air for decades. now this morning the epa announcing a slew of new policies targeting this toxic care in places like cancer alley in louisiana. some of those new policies include special aircraft top fly over these areas, to monitor the emissions coming from the many metro chemical plants in the area. they will have air monitoring on the ground. they are also going to be providing a $20 million grant to communities so they can apply for the monies to have these air monitors within their neighborhoods. because for far too long, many of these communities had no idea what they were even breathing in. they just knew their family members, sisters, mothers, brothers, were being diagnosed with cancer, having respiratory issues. and the epa has linked a lot of chemicals coming from these chemical plants to cancer. the epa is stepping up, putting action behind that tour they had this past november and say they will be keeping the chemical companies on their toes. aside from the air monitoring they have announced this morning, they are also going to be doing unannounced checks where they will just show up at many of these companies to make sure they are staying within the epa regulations and controlling their emissions. but, again, brianna, this is welcomed news for many of the people i spoke to while there in november who just felt this issue has been ignored for decades. they've lost way too many family members to things like cancer as a result of this. and so there is this sigh of relief to at least hear now the beginning stages, this action that the epa is saying they will take to make sure they better understand what's in the air in places like louisiana, cancer alley. >> yeah. and, look, they will keep paying the price in decades to come. but they have a chance to turn things around. rene, thank you for your reporting. >> sure. coming up, would i 18-year-olds in wisconsin could soon legally be allowed to bring guns onto school property. you heard that right. plus -- >> you have been selected to the national baseball hall of frame. >> big papi where he belongs, elected to the baseball hall of fame, and it was good. however, huge controversy about barry bonds and roger clemens, two stars linked to steroids kept out. just or unjust? >> i think it is horrifying. we have seen a massive rise in gun violence in our country over the past couple of years. and we know that our country deals with an exceptionally high level of gun violence in comparison to other high income countries. this is not because kids at schools here necessarily are -- have guns or because there aren't enough police officers on campuses, it is because in those other countries, they choose, unlike us, to protect children, and their right to exist in their schools and in their front yards and communities free of gun violence instead of guns in the first place. so it is horrifying to me. >> these laws will go from the republican assembly to the senate, ultimately, though, they're expected to be vetoed as you're aware because the governor is a democrat. what do you say to people who say, well, it is not going to become law, why do you think they should still pay attention to moves like this? >> it could become law if just after in an upcoming election or two, you know, the balance of power in the state changes and we don't want to be this close to 18-year-olds being able to bring guns to campus in the first place. we need people in wisconsin and every state across the country to mobilize at the state level to go and lobby and show up when the nra shows up and say, no, we don't want our kids to have -- we don't want our kids' right to exist in school free of gun violence to be compromised by the nra death agenda of pushing guns on everyone in our society so that they can continue to foment this insane narrative that we have in this country that guns make us safer and having all these individuals out there with guns in our society make us safer with the reality being that if guns made us safer, as the only country -- one of the few countries in the world where we have more guns than people i wouldn't be talking to you right now. shooting in parkland would have never happened, the shooting in all these other places that we see time and time and time again in the news wouldn't have happened in the first place. we need everyday americans across the country, all ages, to go to their state legislatures and show up when the nra shows up. because they are going to continue. and we need to show up to oppose them. >> what do you say, if you look at a recent -- somewhat recent gallup poll, you'll see there is actually less favor for gun restrictions than there was several years ago. what do you make of that? >> it comes down to the state of our country. people are terrified about the political climate we're in right now. it comes down to irresponsible leadership in our country. and people turning on each other unfortunately, americans turning on each other and believing that we are best armed with a bullet to settle our differences between each other, rather than working together to overcome and combat the sources of evil, poverty, militarism and racism as dr. king talked about throughout time. and i think the reality of the situation is that people are terrified. in part because gun violence is so bad, but the reality is adding more guns to address gun violence is like pouring g gasoline to put out a fire. with gun sales going through the roof, in 2020, there has been a corresponding major rise in gun deaths where when i started doing this work, there were on average 40,000 people dying every year from gun deaths in this country. now there are 45,000. >> what do you make, david, of what we're seeing in san jose where the city council has voted to institute -- really a first -- a $25 annual fee and then it requires liability insurance for gun owners, the premiums would cost less if they do things like classes for gun safety or they have locks on guns or gun safe, that kind of thing. this would be going into effect in august or it is supposed to, it seems. what do you make of this? >> i think it is a good step forward. there are other countries similar to the united states that have guns as a major part of their culture. it is an undeniable fact they are part of our culture in history, in this country. in those countries such as switzerland, they have strong regulations around those guns in the first place, so their gun death rate is much lower than ours in the first place. i think if we think about guns as the dangerous objects that they are, obviously, i think no responsible gun owner would have an issue with something like a background check or needing to have liability insurance in the first place. i think ultimately the solution that we should be looking for as americans is something similar to what we have with cars, where if you want to get a car, you can, but you need a license and need to have it registered and need to have liability insurance that goes with it. in the instance that gun or that car is misused or harms somebody, that there is insurance there to cover it. >> yeah, look, certainly with constitutional protections, there are going to be challenges. you know there will be people who say owning a car isn't a protection under the constitution. but owning a weapon is, and so this is a conversation, david, we're going to keep on having because we know that there will be challenges to these regulations. david hogg, thank you so much. >> thank you. they are about female empowerment. they are making a lot of great strides. but there is always room for improvement, especially when you're making comment for kids. >> thank you both very much. and "new day" continues right now. ♪ welcome to our viewers in the united states and around the world. it is wednesday, january 26th. i'm brianna keilar with john berman. breaking overnight, a cnn exclusive. the justice department confirming that prosecutors are looking into a specific event from the plot to overturn the 2020 election. deputy attorney general lisa monaco tells cnn that federal prosecutors are reviewing the fake electoral college certifications from 2020 that falsely declared former president trump the winner of seven states that he lost. >> on the issue you raised in terms of fraudulent elector certifications has been reported. we've received those referrals. our prosecutors are looking at those. and i can't say anything more in ongoing investigations. but more broadly, look, the attorney general has been very, very clear. we will follow the facts and the law wherever they lead to address conduct of any kind and at any level that is part of an assault on our democracy. trump allies in nevada, arizona, new mexico, wisconsin, michigan, pennsylvania and georgia signed the fake electoral certifications claiming to be the rightful electors. and some of the bogus certifications were sent to national car kaoeufs by top state republican party officials. joining us now cnn "early start" anchor and attorney at law, laura jarrett. laura, the significance here is that you have the number two person at the department of justice acknowledging for the first time there is an active investigation into the highest levels of the trump political world. we know rudy giuliani, among others, was involved in this. >> this is really major news. for the better part of a year, we have been operating in the dog, not knowing what doj prosecutors were up to when it comes to this attempted coup. even perez got to be sit down with lisa monaco, the person who supervises the u.s. attorneys around the country. no better person to speak to what is happening in that building. and he got her to say there is an ongoing investigation. she said she can't comment on the ongoing investigation. but we at least now know prosecutors are actually looking into the referrals that they got from the state officials around the country and lawmakers who were concerned about these phony slates of electors being sent to the national archives. >> what do you think they are investigating specifically? >> we are still operating in a little bit a vacuum. there is still meat on the bones. there is a conspiracy against the united states, mail fraud. what the whole scheme here is there were actually phony slates of electors signing the certificates, saying trump was actually elected in states that he wasn't. meaning essentially trying to usurp the will of the voters in places where they had elected biden as president. they wanted to toss out the votes. they wanted to send the dualing slates of electors to give vice president mike pence the pretext to say, wait a minute, there seem to be objections. thankfully, mike pence upheld the duties that he had and didn't go along with that scheme. but that appears to be what the whole goal was here, we know based off our great reporting was cooked up by rudy giuliani and others who say this was a misguided effort to, again, usurp the election. >> again, this is the first public acknowledgment we have. an investigation into the highest levels specifically of what went on there. laura jarrett, thank you very much. sure. the justice department released new video of the attack on the capitol. two clips are noteworthy. one shows the initial breach of the east rotunda doors. look at the man in the green backpack helping rioters into the building. by the way, he is an active duty marine -- was at the time of the insurrection. he is charged with several crimes related to the riot, including assaulting a police officer. he has pleaded guilty. and in this clip, a rioter is seen inside the capitol building violently throwing a police officer to the ground. another officer quickly runs to help his colleague, pushing rioters away while more pour into the capitol. the officer helps his fellow officer up up and they are able to leave the area. this is very key, berman. we had heard from the lawyer for one of the folks who has been indicted in all of this saying, you know, these eastern doors, they were just opened up, sort of creating this idea that police just let people into the building. what we are seeing here, very clear they did not. >> no. there was violence. so as donald trump and his loyalists continue to peddle the big lie, confidence in america's elections continues to erode. i want to bring in cnn's donie o'sullivan. donie, you have been talking to people all over the spectrum here about really the undermining of trust in the system. >> reporter: that's right, john. we have spoken to hundreds of trump supporters over the past year. and one thing is becoming very, very clear. many of them no longer have trust in the american election process because of course they have been fed the big lie, conspiracy theories. we took a look at what this all might mean for the future of american democracy. >> what you're seeing and what year reading is not what's happening. >> reporter: former president trump's truth has ruined elections. >> you don't trust election officials. >> no. >> there you don't trust the fbi. >> no. >> you don't trust the courts. >> no. >> who do you trust. >> trump, his supporters, and anybody that when i listen to them talk they don't turn my stomach with the disin gen genui genuineness. >> do you have faith in american elections? >> i think whoever wins, win. he will win if he win runs again. people are saying i don't want to vote because it will happen again. >> because it will happen again. >> what is your reaction to hearing from an american like that? >> well, 10 years ago, it would have been shock and disbelief. i would have thought she is an out hraoeur and not anything more than a fringe movement maybe. but that's not the case any more. >> reporter: barbara studied civil conflict for years, from yugoslavia to northern ireland. >> experts who study wars and study the warning signs have been talking about them. but nobody wanted to believe it. and january 6th made it impossible to deny and ignore that there really was this cancer growing in our own country. there was a threat that was mobilizing. >> reporter: she warns right wing media, social media, and from trump himself has put the united states on a perilous path. >> citizens do believe what they are hearing. if they hear it long enough, consistently enough, and if that's all they hear, they absolutely don't think it's a lie. they think it's the truth. >> will you trust the next election? >> probably not. >> or that's a terrible thing, right? >> yeah, it's a terrible thing. >> you can't trust our government anymore. it's sad, but i really don't think you can. >> we can believe when you vote for somebody that person is going to get your vote. >> you know, they're good people. they are trying to do what they think is right. it's the leadership that's cynical. it's the leadership that knows better who is feeding them lies consistently. >> they always talk about the big lie. they're the big lie. >> reporter: while just 30% of americans think there is solid evidence of widespread fraud in the 2020 election, 62% of republicans say so. looking to the 22 midterm elections, some say they are very confident the results will be counted accurately, 42%. >> they are priming supporters to believe that democracy isn't worth defending about us they don't want democracy anymore. >> reporter: john, of course, everybody has individual responsibility into what they believe and don't believe and falling for b.s. as barbara walter, the expert in that piece, made the point if people are being fed this from all sides from their media, social media, and from trump himself, the most powerful person in the republican party, it's kind of easy then to see how people can fall into this trap of deception. >> look, if you destroy the concept of truth, then you can operate with impunity. that's one of the things happening here. terrific reporting as always. thank you. the white house calling an invasion by russia imminent. american troops have been placed on high alert in a show of reassurance. president biden said he would consider personally sanctionsing russian president vladimir putin if russia invades ukraine. it is very significant. cnn has reporters in both russia and ukraine with the very latest. >> reporter: i'm matthew chance in kyiv. ukrainian officials are push back that a russian invasion is imminent, telling cnn they are not yet seeing russian forces positioning themselves for an attack. one official said it could take one or two weeks for that to happen, if any order to invade is given. the assessment is at odds with the white house assessment of the threat, which it says is imminent. the ukrainian officials that we have spoken to say they are extremely happy with the stepping up of u.s. intervention and u.s. support during this crisis. but there is some frustration behind the scenes at the kind of messaging that's coming from the white house compared to what the ukrainian governments see as the real situation. >> reporter: i'm nic robertson in moscow where president putin's spokesman said president biden's possible personal sanctions on putin would not be painful. but he said they would be politically destructive. meanwhile, russia's foreign minister sergey lavrov got a big round of plaza when he said if the west does not respond to us constructively, if it continues its aggressive line, then we will revert to other means. he didn't say that the country was going to war. but in the past, the statements have implied they would turn to military alternatives. >> later in the show we will speak to the ukrainian ambassador to the united nations. and illegal partying that went on during the uk's strict covid lockdown. the report could be released any moment, so we are waiting for that. plus, who is behind the hundreds of disturbing anti spheplic flyers being disbursed across several american cities? what didn't she say, and what does it all mean? >> yeah. well, we don't agonize. we organize is a nancy pelosi ism for we have a tough road ahead. they have they have a very pitched battle for the house of representatives. and nancy pelosi knows she is the general and she cannot leave the fight in the middle of the battle. so it is important for her to announce she is going to stay on in part because this cycle, 29 other democrats have already said they are going to retire or not run for re-election. that is almost a high watermark in recent history when rank and file members know this is going to be tough. many headed for the exits. democrats are trying to hold on to as many seats as possible. >> there is always this calculation, abby, when a speaker or leader is thinking about, you know, what does the future hold for me. who would replace them? i don't know how clear that is for nancy pelosi. >> reporter: i don't know if there has been a speaker in recent history who has been as difficult to replace as nancy pelosi and perhaps the subject of this much speculation. there are a lot of democrats, especially the younger ones, the progressive ones who want fresh blood in that position. but i think a lot of democrats in the house right now agree that it's really hard to replace nancy pelosi. democrats believe she has been largely effective. she has held this very kind of unwieldy caucus together in difficult times. and so we don't know, though, whether or not it's the same thing to say nancy pelosi is running for re-election and also to say nancy pelosi is running to be speaker of the house again. democrats are having a hard time figuring out, okay, who is going to replace her if she doesn't run again for speaker. she is in her 80s. this is not the beginning of her career. it's very much the end. it is a question of how long will she want to stay holding onto her power. >> she did not say she is running to remain as speaker or democratic leader. she should be asked will you vow to serve a complete term? i want to shift gears to ohio republican senate hopeful j.d. vance, who was endorsed by marjorie taylor greene and j.d. vance is actually proud about that. he said honored to have marjorie's endorsement. we're going to win this thing and take the country back from the scumbags. what does this all mean? >> reporter: pretty amazing. look, i don't think there's been a candidate thus far, this cycle who has worked as hard as j.d. vance to remake himself into a trumpian figure. i mean, this is someone who a couple of years ago we were at the same as salesperson institute panel. he is a venture capitalist who is running now fighting against corporate oligarchs. that's what greene used? because it is killing people. but, you know, ratings and that is the ultimate moral crime. >> it's a choice, a clear choice. a 31-year-old man in need of a heart transplant is no longer eligible for the procedure because he refuses to get the covid vaccine. brigham hospital in boston say it is one of several vaccines required for transplant candidates in the mass general brigham system in order to create both the best chance for a successful operation and also the patient's survival after transplantation. candidates must receive the hepatitis b and flu vaccines, follow other healthy behaviors and demonstrate they can commit to taking the required medications following transplant. now here's what the man's father says explaining why his son refuses to get vaccinated. >> my son is on the edge of death. >> he is sticking to his guns. his heart has deteriorated so much to the point where it won't work. it is kind of against his basic principles. he doesn't really believe in it. it's his body. it's his choice. >> joining us now is the director of medical act eubgs professor arthur caplan. thank you for being with us. i think you need to explain to people so they understand what the procedures are for who gets organ transplants. how does it work and what are the requirements? >> good morning, john. what we have is transplant centers make decisions about who to admit to the transplant programs. each transplant center has rules, has criteria for saying you can come in. we think you really are in need of a transplant. then once they're in a hospital, there is a national system that takes all the people that have been admitted to individual transplant centers and, if you will, ranks them, assigns them, they know what their blood type is, their antibody type is, whether they need a large heart or a small heart. and so the distribution then moves around the country, say, of hearts. no heart eligible from a donor is likely to go to waste. the argument is who to give it to, who has the best chance to survive with this scarce resource. >> there are a finite number of hearts and organs available. and who gets them depends who has the best chance of surviving and who needs it most? >> correct. >> we need more organs. we have been pursuing at nyu, maryland, other programs that try to engineer animals to try to get more organs. the pig heart experiments we have been seeing to try and fill the gap. every day many will die because there aren't enough organs to give them. the transplant teams do their best figuring out how to use them most effectiveively, the scarce supply they've got. . >> and if you haven't taken the covid vaccine, you are not a good candidate for the finite resource, they say. what do you say to the supporters of this man who say he is being punished? >> well, look, there is a big battle out there. we just heard of that. do you use covid vaccinations to prevent getting covid? this is not discrimination. this is not bias. what's going on here is the trance plant team is saying if you catch covid before we can transplant you, you will never get a transplant. you will be too sick. whatever the risks are, they are hugely outweighed by catching a case of covid, being in the icu and falling off the list. post-transplant, we have to fine-tune your immune system. we give you drugs so you don't reject the heart. it would be easier to do that if you didn't have the flu, if you didn't have covid, pneumonia, many other viral diseases. you need to take this so that you maximize your chances of success. and if you won't do it, then others who will do it are going to get priority because we don't have enough hearts to give to everybody. >> again, it's important to note other vaccines are required as well. we're dealing with a phi fight resource here. professor arthur caplan, thank you for being with us. >> my pleasure. just announced, the epa ramping up pollution monitoring and enforcement to help communities in the south facing the most harmful impacts, including louisiana's cancer alley. cnn's rene marsh traveled there last year. rene, tell us about this. >> reporter: yeah, we were there last year with the epa administrator, brianna. good morning. and this was one of the most toxic area codes in america, some of the highest cancer rates. we met with people, spoke with people breathing this toxic air for decades. now this morning the epa announcing a slew of new policies targeting this toxic care in places like cancer alley in louisiana. some of those new policies include special aircraft top fly over these areas, to monitor the emissions coming from the many metro chemical plants in the area. they will have air monitoring on the ground. they are also going to be providing a $20 million grant to communities so they can apply for the monies to have these air monitors within their neighborhoods. because for far too long, many of these communities had no idea what they were even breathing in. they just knew their family members, sisters, mothers, brothers, were being diagnosed with cancer, having respiratory issues. and the epa has linked a lot of chemicals coming from these chemical plants to cancer. the epa is stepping up, putting action behind that tour they had this past november and say they will be keeping the chemical companies on their toes. aside from the air monitoring they have announced this morning, they are also going to be doing unannounced checks where they will just show up at many of these companies to make sure they are staying within the epa regulations and controlling their emissions. but, again, brianna, this is welcomed news for many of the people i spoke to while there in november who just felt this issue has been ignored for decades. they've lost way too many family members to things like cancer as a result of this. and so there is this sigh of relief to at least hear now the beginning stages, this action that the epa is saying they will take to make sure they better understand what's in the air in places like louisiana, cancer alley. >> yeah. and, look, they will keep paying the price in decades to come. but they have a chance to turn things around. rene, thank you for your reporting. >> sure. coming up, would i 18-year-olds in wisconsin could soon legally be allowed to bring guns onto school property. you heard that right. plus -- >> you have been selected to the national baseball hall of frame. >> big papi where he belongs, elected to the baseball hall of fame, and it was good. however, huge controversy about barry bonds and roger clemens, two stars linked to steroids kept out. just or unjust? >> i think it is horrifying. we have seen a massive rise in gun violence in our country over the past couple of years. and we know that our country deals with an exceptionally high level of gun violence in comparison to other high income countries. this is not because kids at schools here necessarily are -- have guns or because there aren't enough police officers on campuses, it is because in those other countries, they choose, unlike us, to protect children, and their right to exist in their schools and in their front yards and communities free of gun violence instead of guns in the first place. so it is horrifying to me. >> these laws will go from the republican assembly to the senate, ultimately, though, they're expected to be vetoed as you're aware because the governor is a democrat. what do you say to people who say, well, it is not going to become law, why do you think they should still pay attention to moves like this? >> it could become law if just after in an upcoming election or two, you know, the balance of power in the state changes and we don't want to be this close to 18-year-olds being able to bring guns to campus in the first place. we need people in wisconsin and every state across the country to mobilize at the state level to go and lobby and show up when the nra shows up and say, no, we don't want our kids to have -- we don't want our kids' right to exist in school free of gun violence to be compromised by the nra death agenda of pushing guns on everyone in our society so that they can continue to foment this insane narrative that we have in this country that guns make us safer and having all these individuals out there with guns in our society make us safer with the reality being that if guns made us safer, as the only country -- one of the few countries in the world where we have more guns than people i wouldn't be talking to you right now. shooting in parkland would have never happened, the shooting in all these other places that we see time and time and time again in the news wouldn't have happened in the first place. we need everyday americans across the country, all ages, to go to their state legislatures and show up when the nra shows up. because they are going to continue. and we need to show up to oppose them. >> what do you say, if you look at a recent -- somewhat recent gallup poll, you'll see there is actually less favor for gun restrictions than there was several years ago. what do you make of that? >> it comes down to the state of our country. people are terrified about the political climate we're in right now. it comes down to irresponsible leadership in our country. and people turning on each other unfortunately, americans turning on each other and believing that we are best armed with a bullet to settle our differences between each other, rather than working together to overcome and combat the sources of evil, poverty, militarism and racism as dr. king talked about throughout time. and i think the reality of the situation is that people are terrified. in part because gun violence is so bad, but the reality is adding more guns to address gun violence is like pouring g gasoline to put out a fire. with gun sales going through the roof, in 2020, there has been a corresponding major rise in gun deaths where when i started doing this work, there were on average 40,000 people dying every year from gun deaths in this country. now there are 45,000. >> what do you make, david, of what we're seeing in san jose where the city council has voted to institute -- really a first -- a $25 annual fee and then it requires liability insurance for gun owners, the premiums would cost less if they do things like classes for gun safety or they have locks on guns or gun safe, that kind of thing. this would be going into effect in august or it is supposed to, it seems. what do you make of this? >> i think it is a good step forward. there are other countries similar to the united states that have guns as a major part of their culture. it is an undeniable fact they are part of our culture in history, in this country. in those countries such as switzerland, they have strong regulations around those guns in the first place, so their gun death rate is much lower than ours in the first place. i think if we think about guns as the dangerous objects that they are, obviously, i think no responsible gun owner would have an issue with something like a background check or needing to have liability insurance in the first place. i think ultimately the solution that we should be looking for as americans is something similar to what we have with cars, where if you want to get a car, you can, but you need a license and need to have it registered and need to have liability insurance that goes with it. in the instance that gun or that car is misused or harms somebody, that there is insurance there to cover it. >> yeah, look, certainly with constitutional protections, there are going to be challenges. you know there will be people who say owning a car isn't a protection under the constitution. but owning a weapon is, and so this is a conversation, david, we're going to keep on having because we know that there will be challenges to these regulations. david hogg, thank you so much. >> thank you.
