a very good friday morning to you. i'm jim sciutto. >> i'm bianna golodryga. the big story we're following this morning the world's number-one-ranked men'sen the nis player, novak djokovic, will be detained tomorrow in australia before a hearing before a federal judge. he is appealing after his visa was revoked for a second time over his covid-19 vaccination status. >> cnn's sports correspondent andy scholes has been covering this story. he has more on djokovic's fate. andy, is this largely a done deal at this point or is it still an opening? >> i'm no expert in australian law, jim, but, you know, it certainly seems like novak djokovic and his lawyers are climbing an uphill battle right now. he'll be interviewed by the australian force at a secret location and escorted to his lawyer's offices and then back into that detention hotel while his case is heard in the federal court. this comes as alex hawks said friday he used his ministerial discretion to cancel djokovic's visa saying, quote, it was -- djokovic's attorneys argued hawk's decision was not based on the health risks that djokovic might pose by not being vaccinated but on how he might be perceived by anti-vaxxers. the australian open has not yet commented on the ongoing saga, but three-time grand slam champion andy murray says there's no winner this standoff. >> just wanted obviously to get it resolved. i think it would be good for everyone if that was the case. it just seems like it's dragged on for quite a long time now and, yeah, not great for the tennis, not great for the australian open, not great for novak. yeah, obviously a lot of people have criticized obviously the government here as well. so it's, yeah, not been good. >> yeah. it was announced earlier that djokovic's first-round match is scheduled to take place on monday, so again, guys, his attorneys are hoping that they're going to have this appeal heard on sunday and that he could have his visa returned in time to play on monday. but, you know, that doesn't seem like a likely scenario at this point. >> yeah. fast-moving story. andy scholes, thank you. for the first time in the january 6th investigation the justice department has charged 11 people with seditious conspiracy including stewart rhodes, the leader of the far-right extremist group the oath keepers. >> these are significant charges, go far beyond the idea this was just a political protest that got out of hand. it speaks to conspiracy and planning. cnn correspondent josh campbell has been covering this. the oath keepers at the center of this. what more did this indictment reveal about all the planning that went in before january 6th including amassing weapons? that really caught my attention. >>. >> reporter: that's right. we're learning the about the details of january 6th and what happened in the days ahead of that, and what we're learning about this group, which is a right-wing anti-government group who was founded in 2009 by one of the defendants, stewart rhodes, they claim to have over 30,000 members. the fbi describes this group as large but loosely organized. now, associates of this group believe in a wide range of different conspiracy theories but at a foundational level they share this belief that a tyrannical federal government is oppressing citizens. indeed, the name oath keeper comes from this oath that they pledged to uphold the constitution in their words, which is somewhat ironic, because what the justice department is saying with the new sedition charges is these aren't patriots, they're criminal rebels. to give you a sense of what they believe, take a listen. this is stewart rhodes speaking with alex jones. >> you've got to declare this regime to be illegitimate because everything out of team biden's mouth is illegitimate. there are 365 million of this, we outnumber them and we're well armed. they have a problem. >> it's easy to listen to those words and see those images of people in military dress-up, you know, wearing camouflage and the urban environment, downtown washington, d.c., but what we're learning in from this latest indictment is this group was potentially very dangerous and they had engaged in this paramilitary-type training, drawing members from the law enforcement and military community. just to give you a sense of what federal prosecutors allege, reading part of the indictment, they say on january 4th, two days before january 6th, while still traveling towards the d.c. metro area, rhodes spent approximately $4500 in mississippi on fireplace arms equipment, including sights, mounts, optic plates, and as they moved on, after january 6th, this group still tried to prepare and plan for inauguration day and denying joe biden that peaceful transfer of power indicating thousands of dollars were spent between january 10th all the way up to just before inauguration day. so this is a group obviously that has these issues with the federal government. the challenge for law enforcement right now as you look at thousands of members is trying to determine what's noise and what's aspirational and who has intent and capability to cause future damage. that is the key. what we're seeing with these sedition charges is that the federal government is taking this to the next level and saying these weren't tourists, they didn't wander into the capitol, this was a conspiracy. >> alarming to reiterate how well armed they were and organized. josh campbell, thank you. >> thanks. joining us is paul callan and olivia troy, former homeland security and covid adviser to mike pence. paul, sedition conspiracy charges have difficult to prove and have been rarely used before. i'm curious what you think the message the justice department is sending with these charges as opposed to what we've seen, obstruction. >> great question. seditious conspiracy has only been charged in recent times in really two cases. one when puerto rican terrorists took over the house chamber and opened fire in congress. that was one of the instances. and the other instance was that case involving the governor of michigan, who was almost overthrown by a wild mob and those charges were brought in that case as well. it's tough case to prove seditious conspiracy because you really have to prove this the members of the group shared a common goal and that goal is to destroy and overthrow the government of the united states. they have been working on this case for a long time. and you know something? it looks like they have the elements here. they've got speeches by rhodes urging the fact that there has to be a revolution and talking about, you know, his group being heavily armed. and i think the government is confident they can go forward with this case. >> olivia troy, one defense you've heard not only from republican lawmakers, former trump administration officials, but allies in the right-wing media has been to date, prior to yesterday, that the charges have not i believe colluded things such as seditious conspiracy and therefore this wasn't an insurrection. now, it does. and by the way, it's not just those words but it is the evidence behind those charging documents as paul referenced. you have someone like the leader of the oath keepers saying in december we're going -- we have to have a bloody revolution here. you have hard facts like them storing weapons for their own quick reaction force, normally a military term. does this move republicans on this issue? >> well, i think it goes a long way in factually defusing this their they've they continue to push. now you have official charges. this is a significant development i would say and i think it's going to be hard. how do you continue to whitewash this event? i think this is significant. i think it's more significant because the reality is the words of these republican leaders matter. they continue to be used to recruit in these types of groups. these groups are out there still recruiting because of the big lie, because of what these people are saying, because they continue to spend these narratives. they get disinformation pushed at them every single day. and these groups are using that to recruit their ranks. it's concerning. they're recruiting from military ranks, former military members, veterans, so that is why this is significant. >> paul, how high up do you think this investigation could lead? realtor.com to each their home. right now, the u.s. is averaging twice as many new covid cases every day as daily vaccinations. officials still pushing to get more shots in arms as the number of people hospitalized is at record highs and intensive care units are trending towards capacity in 19 states. >> more than 15,000 national guard members have been deployed. in all but one state. health care systems in many areas face critical staffing shortages amid the surge. joining us to discuss, dr. jonathan rider. good to have you back. i also do my best to be a glass half full guy. when you look at the data in a police like d.c. and new york, where omicron hit first, the surge is already tailing off. it's coming down and burning fast like we saw in other places like south africa. as you look at the data in your view, has the surge already peaked in some parts of the country? >> well, in d.c., we were among the first to see omicron, and if you look at daily cases are now clearly beginning to drop in the district of columbia and in northern virginia and maryland. the problem is that hospitalizations lag several days behind case counts so our hospitals are still packed. and we are super short on staff both from the chronic staffing shortages that we've seen over the last few years during the pandemic and preceding the pandemic and now exacerbated by staff illness, by staff getting covid and having to isolate for ten days. so our hospitals are still under great pressure right now. i'm very encouraged that case counts are dropping now in this area unmistakably. >> that is a positive sign. i'll preface this question by noting the obvious, and that is that i don't believe you are a legal analyst, but you are a health expert. from that perspective, i'd love to get your reaction to what we heard from the supreme court yesterday blocking the administration's mandate for businesses, large businesses to impose vaccines and testing but allowing them for some hospitals to provide medicare and medicaid help. i'm curious, did that ruling make sense from your perspective and what's your take on it? >> no. i mean, i thought that the obvious political leanings of the court were shown in that decision. and i'll -- i was also struck by the astonishing lack of information as evidenced by some of the questions posed by some of the justices, particularly justice thomas, completely misquoting data and misunderstanding how this virus is spread. the court's decision, which basically said that workplaces by and large are not risky. so the court has cloaked themselves in protections that most workplaces don't have, yet they would withhold that from, you know, millions of workers -- >> justices themselves vaccinated. i want to ask you about the administration's testing response here. senate democrats have sent a letter to the white house asking why the administration didn't do this more quickly. and i wonder, by the time all these tests get out to people, and granted, it's a big effort, perhaps a billion tests being sent, will it be too late to have an effect on the omicron surge? >> yes. the short answer to that is yes. so first of all, there's no website up and running yet to order a test. this whole business of even paying for tests for people is so layered and cumbersome, having to get your insurance company to pay for it is unhelpful. this administration placed all of their eggs in vaccination, and the problem is that i don't think at the outset they understood how recalcitrant almost a quarter of the population of this country would be to getting vaccinated. and then when this surge hit, when the new variant hit, we desperately needed rapid tests. we just didn't have them. so, yeah, there will be more rapid tests on the market, more rapid tests available, hopefully free or less expensive. but it will come at the end of omicron. >> yeah. more masks will be sent out as well. but as you said, probably a bit too late at this point. doctor, thank you as always. have a great weekend. >> my pleasure. you too. we are following breaking news this hour. a u.s. official tells cnn that intelligence indicates russia has positioned a group of operatives set to conduct a false flag operation as it's known in eastern ukraine, all of this in an attempt to create a pretext for a potential invasion of that country. >> cnn white house reporter natasha bertrand is following this. this is what many experts had been warning about over the past few weeks. and here we are. what more details do you know? >> reporter: that's right, bianna. this is exactly what they had been fearing because it is part of russia's playbook, according to u.s. officials who told cnn that they are seeing things that are repeating themselves from the invasion of crimea in 2014, namely russia creating a pretext for an invasion by carrying out what u.s. officials say is a false flag operation in eastern ukraine using russian operatives that are trained in urban warfare and explosives to potentially carry out an attack against russian forces and then frame ukraine for that attack, thereby justifying an invasion of eastern ukraine, which, of course, the u.s. has been saying is a high possibility, especially over the last several months, even as these talks have continued in europe over the possibility of averting a war. so they're very concerned right now that russia has been planning this as a way to say they were attacked first and therefore they have a right to defend themselves and invade ukraine. this is something that jake sullivan, the national security adviser, hinted at during a briefing with reporters yesterday, said that u.s. intelligence, which had since been downgraded in classification level, indicated that this could be happening right now even as these talks have been under way, diplomatic talks have been under way. so clearly there is a lot of daylight here between what the u.s. and the russians are thinking about in terms of finding a diplomatic solution to this conflict. russia now apparently taking steps to create that pretext to launch an invasion of ukraine. they have of course been building up their force capacity on the border since late october, early november. you know, the possibility of them launching an attack on very short notice has been top of mind for u.s. officials for months now. >> natasha bertrand, thanks so much. sobering reporting there. still ahead, navigating a new reality in the middle east. foreign leaders calculating just how powerful, perhaps just how reliable an ally the u.s. can be now. the jordanian foreign minister will join me live next. these are the faces of listerine. the face of millions of germs zapped in seconds. the face of clean. the face of whoa! some are of intensity, others joy. all are of... various: ahhh... listerine. feel the whoa! >> no. they continue to to be a good friend with jordan. the cooperation of the u.s. helped uz mitigate many of the challenges we've been at the receiving end of as a result of regional crisis, so the partnership is solid, it's strong. the u.s. support to jordan is key not only in enabling us to meet those challenges but also in helping us implement the wide-ranging economic reforms that we are undertaking right now. what i meant by that statement is that we in the region need to do a lot of the heavy lifting. we cannot just rely on the u.s. to solve our problems. we have to work with the u.s. as a trusted partner moving forward. >> a are you concerned, particularly as the u.s. focuses away from the middle east and more towards its relationship with china, are you concerned about who fills the void? russia has certainly been more active in the middle east than in years past. >> look, the u.s. has always played a leading role in the region, and we do need that role. and we do work with the u.s. on ensuring that it does continue to help us grapple with all those challenges and find solutions to them. and the discussions i have had the pleasure of having with the secretary of state yesterday did indicate that we are going to continue to work together, again, from a point where we do all our bit in the region as well, whether in terms of peace process, syria, refugees, terrorism. the u.s. is a key partner for us and we continue to work together. >> you bring up the peace process. there are many in the region as you know who as a practical matter have given up on a two-state solution to the peace process between the palestinians and the israelis. you have not. why? what gives you hope? >> because we simply do not see any other alternative to the two-state solution to get us to the just and lasting peace that is a need for all of us and an incentive for regional and national security. if we undermine the two-state solution, with what's the alternativesome it's going to be the one-state reality, and that's going to be an ugly reality, not a solution if we just institutionalize and pretty much put the conflict more on an explosive course. so we will not throw the white towel in for the sake of all the peoples of the region, for the sake of peace. we have to continue working towards revitalizing peace talks that would take us toward the two-state solution. again, that is an effort that we are trying to all work on including with the u.s. and partners in the region and beyond. >> i wonder if you have seen a change in the diplomatic tone from israeli officials in terms of the relationship between israel and jordan. the settlements continue to be built in the west bank. >> and we continue to say that this should stop. we continue to convince cements as not only a violation of international law but also an impediment to the peace that we want to achieve. the previous government did a lot to make sure that nothing really worked, worked well whether bilateral relations or in the regional concept with this new government. we do talk. we have frank and open conversations. they know our position very well. we need to end this stalemate and start meaningful negotiations to achieve the peace that is being undermined day in and day out by those hurting the viability of the two-state solution. >> iraq now. of course jordan shares a border with iraq. there are more than 60,000 iraqi refugees still registered in jordan. as you know, u.s. forces announced the end of their combat role in iraq in december, though a small force remains. you saw the chaos in afghanistan after the withdrawal of the u.s. forces there. do you fear a similar future for iraq and a spillover effect for jordan? >> not in the same way -- iraq is still facing challenges but it's come a long way in terms of trying to stabilize and rebuild institutions. a key for iraqi success is for all of us to stand behind iraq and support them, respect their sovereignty and do whatever we can to make sure they continue to move towards addressing the security challenges, ensuring the improvement of the living conditions of their people. again, we have close consultation with the u.s. and we feel that iraq is on the right track but it does need the support of a lot of us, and none of us in the region and beyond can afford for iraq not to succeed given the numerous challenges that will come as a result, not least of which is the threat of terrorist groups regrouping. >> isis as we know them. syria, remarkable survival story one can say regarding bashear al asad. there are flights between damascus and hamann. king abdullah has spoke within the leader. is jordan preparing normalized relations with syria? >> what we're doing is trying to make sure there is a serious political process that would result in ending that crisis. jordan as you know well, at the receiving end of that crisis, 1.3 million syrian refugees in jordan, the threat of terrorism from the border and other threats of drugs coming across the border. what we're seeing is that 11 years into the crisis we've got to do what it takes to solve it. we cannot continue to double down on approaches that did not deliver the outcome. therefore, we're trying to find a path towards a political solution with the u.s. and other partners. there are two ghengss, one bilateral and, again, as a neighboring country with 365 kilometers of border, the impact of that crisis on us has been enormous, not at least of which the burden of providing a dignified life for refugees, which unfortunately we see less and less global attention towards them. the other side of it is we need to work towards a political solution. we all agree there's no military answer, and the crisis has done so much suffering and destruction and we cannot continue with status quo politics. that's what jordan is trying to do, open the horizon for a political solution. >> jordan has had a front-row seat to so much of that disruption. before we go, a number-one talk of conversation between you and secretary of state blinken, the u.s. memorandum of understanding as it's known with jordan, u.s. assisted jordan with some $1.65 billion last year. that's going to go forward. the u.s. is going to continue that financial commitment to jordan. i wonder, though, are you concerned that in the region the u.s. will not provide the same leadership that it has in the past? >> well, i mean, first of all, we're grateful for the support that the u.s. continues to provide to jordan, the aid that is provided has been instrumental in helping us and not only meet challenges but also go ahead with reforms as i said. we and the u.s. are strong partners. we talk and do appreciate the performance of the u.s. in the region and continue to work to them to make sure the u.s. continues to play that leading role. the u.s. can also count on jordan to always be a partner for u.s. and work together towards our common objective of peace, stability, civility and prosperity. excellent talks i've had with all officials here, with the administration. i think the message or the outcome of that is that we remain solid partners, remain committed to working together, and that partnership is enduring. >> ayman safadi, we wish you safe travels home to jordan. thanks for joining us this morning. >> thank you so much, sir. >> really interesting conversation there. an important u.s. partner. still ahead, president biden says he doesn't know if democrats can get voting rights legislation done. a gigantic blow that the agenda is facing. what's the next move for white house? >> in walked the most gorgeous young girl, 20 years old. i said what's your ambition? she says to be a film star. >> and then they laid a technicolor test, which was unusual. i think they had high hopes for me. >> she was to come in, walk across the room, sit down and light a cigarette and smile. as soon as that camera started rolling, something magical happened. she has this kind of fresh-faced beauty, this kind of luminous prettiness on the screen. >> she could manifest the kind of magic she came into the world with. >> joining us now is sarah churchwell, consult progress deusser on the series, also author of "the many lives of marilyn monroe." i wonder what are people missing about monroe when they look at her purely from a standpoint of her physical beauty? >> well, they're kind of missing everything, including the totally obvious, that marilyn was an actress and this woman, this blond bombshell was a performance. we make this distinction about most movie stars but when it comes to marilyn we stop thinking. it was not only a performance, it was a comically e exaggerated performance. she was setting up the idea of the blond bombshell as much as she was representing one. one of the facts of marilyn's life is she fought her whole career to play a different part, to show she could play different roles but no one would let her. >> a sense we still don't because we only talk about her as blond bombshell. >> she was born with a different name. many people don't even realize that, norma jean. when you hear her say i think they had high hopes for me, what is it that fascinated those studio executives so early on when she first appeared before them? >> well, you know, marilyn herself made jokes about that. she had an incredibly beautiful figure and so she once joked about the fact that other actresses might have the foreground and the background, making a joke about her body, but that they didn't have what was in the middle, and by that of course she meant her brains and her talent and her ability. so i think that, you know, her beauty is undeniable. it clearly knocked people out in real life and on screen. but on screen as everybody always says she had this magic and it just comes across. >> how do you think marilyn would have played in the women's rights movements if she hadn't passed away so soon? >> she was absolutely the forerunner of what powerful women in hollywood today are doing. she blazed all the trails they're following. she set up her own production company, one of the first women to do so, so she could develop better roles for herself, fought for equal pay, for quality, and she was very much a forerunner of me-too. she spoke out early and often about sexual violence in hollywood, about the casting couch, about predatory men, and she would definitely have been speaking out. on these issues now because she was speaking about them back in the 1950s. >> when that was clearly taboo. given how much time and research you've invested into this project, what surprised you the most that you took away from it?
