truth about the 2022 election, which of course makes donald trump mad. we begin with the coronavirus and a look at new actions and a new tone from the biden white house. covid infections up about 30% this week and deaths up 40%. the omicron variant driving the current case count, now with 150,000 new cases per day. they said the omicron variant should peak in a few weeks. they are driving some new actions as well, including today's announcement from the white house. the government is buying a half million courses of covid treatment from astrazeneca. the pre dr. fauci did backing them up and saying, live with it. >> everyone is likely to get exposed and likely infected. if you're vaccinated and boosted, the chances of you getting sick are very, very low. >> let's get more on the white house message from our chief correspondent, phil mattingly. phil? >> reporter: this is the reality. they're looking at the case counts. they're watching the surge. there is no question about it. a purely preventative posture, a just get vaccinated and everything will be fine posture isn't enough anymore. make no mistake about it, vaccinations and boosters are still the primary component that health officials want the country to focus on. but i was struck multiple times as the top covid advisor said the medicine cabinet has never been more full. he was citing those treatment options from astrazeneca that the administration purchased today, between those types of treatment options, monoclonal treatment options as well, the administration as more of an ability right now to handle what's happening from a purely medical basis than they ever have before. that's the message they want to get out as there is this recognition that even if you're vaccinated, even if you've received a booster, breakthrough cases are not some small thing anymore. they are absolutely prevalent and happening around the country. but they also make clear that in the academic studies they're seeing up to this point, the public research they're looking at, everything is showing that omicron is not nearly as deadly or potentially problematic as delta was. and because of those treatment options that they have, they believe there is a very real opportunity to address this even as the case counts soar. this has been an issue the white house has obviously been grappling with since thanksgiving, trying to get in front of this, trying to address this, trying to figure out the concerns. that to many points have led to concerns over messaging, confusion over messaging as well. we've seen holdups and partsticking points when it comes to testing. the administration has addressed that as well. they plan to send 500,000 covid tests to try to help schools. schools and parents are critical here, because maybe the deaths aren't as high as with past variants, but the systemic issues as to how the country can operate with so many people getting sick, that's what they're trying to address at the moment, a shifting message over the course of the last several weeks. making it very clear this can be dealt with, tools are there, people just need to pay attention and use those tools. >> at the briefing, fairmount was talking about masks. was there a decision there? >> there is not going to be a mandatory use of n-95 masks, kn-95 masks, however they have a strong desire to make those masks more available. the primary message from walensky was any mask is better than no mask, but kn-95 and n-95 is far better when it comes to the variant of this transmission, john. >> let's bring in our senior medical correspondent, elizabeth cohen. elizabeth, we're at an interesting moment, if you will, in the sense that you do see in the data evidence that omicron is less severe in terms of how sick you get. but with the case count so high, there are still the challenges on the health care system. i want to look at numbers out of california. california hospitalizations, 52,000 people, omicron cases, come in. only 235 of those patients, if we can put up the graphic to help people get through it, only 235 of those patients hospitalized. even though 235 people hospitalized, none of them requiring a ventilator. you have significant stress on the hospital system, but it's a different kind of stress. >> it is a different kind of stress. so let's not forget that out of those 52,000, some of those are health care workers, right? you just don't have enough staff to take care of people in the hospital, whether they're there for covid or for anything else. so the fact that this is a mild illness and that a relatively small number of people are ending up in the hospital and an even smaller number ending up on ventilators, it is still a stress on the hospital. you still have people coming in to the emergency room, some of them just to get a test which, of course, is not great, but that's a stress on the emergency room. you still have people getting sick, because even a small percentage of a large number can still be a large number, and, and i think this may be the most important factor, your staff is so stressed out. these are people who are getting sick from omicron themselves, they probably have family members who may be sick, they're exhausted after two years of dealing with this, and so that's the kind of stress that we are seeing on the health care system. that's why it's so important to get vaccinated. we have seen this in hospital system after hospital system, the folks who were filling up the covid beds are largely unvaccinated. they are doing such a disservice to the people who they want to be taking care of them. it's hard to even fathom how a human being could do that to another human being. john? >> it is. when you look at these numbers again, 750,000 new infections every day, hospitalizations are up, deaths are up. the cdc predicts deaths will stay up for the next couple weeks. most of the numbers are quite sad and sober. we look for more evidence there will be better days ahead. dr. walensky talks about the peak she thinks should be coming in the next couple weeks. look at these numbers from the d.c. health department. cases down 37.7% from the peak just a week ago. here's what it looks like if you lay out the case count from the last couple weeks, you see the giant spike in september. that's omicron and then it levels out a bit. elizabeth, you do see it start to coming down. is that a helpful nugget for those in the omicron surge. we've seen it in the u.k., now we're seeing it in d.c. and new york. lasts a couple weeks and then hopefully comes down? >> john, i'm going to borrow a term from the governor of new york. she said there is a glimmer of hope. you never want to get too excited because we've been doing this for two years now, and covid has fooled us over and over again, but there is a glimmer of hope when you see the numbers do what you just described in washington. in new york, you're starting to see a glimmer of that as well. we saw it in south africa. as quickly as it rose up, it also quickly went down. i want to add a note here, that while this is good and while the other numbers you're talking about is good news, too, that the hospital numbers are relatively low, i think we need to be thinking about the vulnerable among us, the immunocompromised, for example, for whom the vaccine might not have worked. when you decide what your behavior may be doing, think about those people as well. >> every day, every day. we could all use a little common sense and common courtesy who protects the person next to you. elizabeth cohen, thank you very much. key senate democrats meeting this morning, those democrats talking about voting rights. the majority leader chuck schumer called the discussions, quote, intense. one of the participators made a goal. they said they need not only a plan for the voting rights but a plan to change the senate rules. >> i ask every elected official in america, how do you want to be remembered? the consequential moments in history may present a choice. do you want to be on the side of dr. king or george wallace? do you want to be on the side of john lewis or bull conner? do you want to be on the side of abraham lincoln or jefferson davis? >> democratic congresswoman terry sewell of alabama joins us now. she is a lead sponsor of the john lewis voting rights advancement act. she attended the president's speech yesterday. terry, i'm grateful for your time. i know this is personal to you. you're a daughter in selma, alabama. you were a partner in pushing this legislation. let me start with the senate. they emerged from this meeting today. they've been talking a lot. i know that's frustrating to those of you in the house, the senators tend to talk, not vote. they're saying we're making progress. the talks were intense. do you have any indication that they're actually making progress or are they just in a room talking, talking, talking? >> no, i think there is every indication that they are, indeed, having intense discussions. what i hope to emerge is consensus among the senate democrats to actually do that rule change so we can pass the voting rights bills. john, nothing is more consequential than the threat to our democracy. it is a threat from within, and frankly, we've seen state legislatures across this country enact more restrictive laws. i know that many of those state legislatures are beginning to meet this january again. and we're seeing even tougher laws coming out of those state legislatures. federal oversight is only needed when states go amok, and i think all of us can agree that stopping someone from giving someone a bottle of water while they're standing in line for voting is really preposterous. i think the president made a great case yesterday. i was glad that he was emphatic, he was bold, he was uncompromising in his speech about which side of history people want to be on. and as you said, this is very personal for me. i not only represent selma in congress, i actually grew up in selma, alabama, attended brown chapel church, and this district i happen to represent is a legacy of americans, ordinary americans, willing to do extraordinary things for social change. surely our senators will step up to this moment and do what they need to do in order to pass voting rights legislation. >> i want to come back to the senators in a minute, but i want to spend a second on the president. you mentioned the president's speech was emphatic yesterday. he said pick your side in history and he laid it out in that sound that we heard. but a lot of your friends in the civil rights community. derek johnson from the naacp says, mr. president, this is a fundamental issue. where have you been for a year? >> the president is considered one of the masses of the senate. he has more experience than possibly lyndon johnson. we should have heard this a year ago, six months ago with this level of energy. >> what's your take on that? the white house would say the president has talked about this some and he's had to deal with covid, he's had to deal with other issues in the country, but is he late? is he too late to twist the arms and change the votes? >> listen, john, i think that all of us are very frustrated with what's going on, but the reality is this moment has met us right now, and we're on the eve, the cusp of the anniversary of martin luther king's birthday. i think now is an inflection point and an opportunity for our senators to choose the right side of history. i'm proud of this president for coming forward and saying emphatically that he is willing to change the filibuster rules in order to get voting rights passed. he's not prescribing how that should be done, but that it gets done. and you know what? justice delayed can be justice denied. it's time for us to do it right now. >> i want you to listen to one of your democratic colleagues, fellow african-american cory bush, one of the younger members of the house. the younger members, some of them have less patience, if you will. i'm not blaming them for that. they're thinking, let's get to it. she talks about the president, but then she gets to the senators you're talking about. >> we should expect more from our president, absolutely, absolutely. but our president is not the one who is going to vote. we need to turn focus, even more focus, to those that are standing in the way. and they're standing in the way of what's needed from people who look like me. >> that last part, congresswoman bush quite emotional, people who look like her. let me ask you bluntly, are you concerned that some of these older, white senators don't understand this issue and the urgency as they should? reporting breaking news to bring you out of orlando, florida. a key witness into the investigation of matt gaetz, that witness entering the same courthouse where the grand jury is expected to be meeting. paula, who is this witness? >> john, this woman is ro manhattanically linked to the congressman previously and she is a key witness into that the congressman may have engaged in sexual relations with an underage girl and he is not cooperating into those alleged crimes. keep in mind this woman was not 17 when she had sex with the congressman. this woman was linked to the congressman as far back as 2017. they are interested in this time period because that's when he allegedly had sexual contact with this teenage girl. she was expected to go and testify before the grand jury, hearing evidence about the alleged crime and the congressman and his associates. she was seen with her attorney entering the orlando courthouse where the grand jury has been meeting. at this point we are not naming this woman. she has not been accused of any crimes. she is a cooperating witness in an ongoing federal investigation. but look, john, she is a really critical witness for the justice department. we know federal investigators are looking at whether he may have had sex with this underage girl, whether he engaged in sex trafficking and whether he and his associates tried in any way to interfere in that investigation. no now, cnn has previously reported that investigators have information and want to talk to this woman about prior to 2020. that's when this federal investigation began, of course, at the time under bill barr. investigators want to know if she has any evidence related to these alleged crimes or if anyone tried to pressure her not to cooperate or not to be truthful in this ongoing investigation. now, her attorney had no comment. of course, at this point we know of course the congressman has not been charged with any wrongdoing. if prosecutors believe they have enough evidence to charge a crime, that is a decision that would likely have to go all the way to the attorney general, because, of course, charging a sitting congressman is a serious matter. at this point the congressman's attorney and his spokesman have not responded to our request for comment on this new reporting. but john, a serious signal that this investigation into the fact, soaring 70% for the last year. that's a pace of growth not seen since 1992, 35 years ago. matt is with us to break this down. what else is in this report? >> consumer prices soaring by 7% in december. that's an acceleration from november. i it's the highest 12-month gain since ronald reagan was in the white house. month over month, .5%, and that's a deceleration if you're looking for a silver lining. the price of gasoline last year, $3.30 today, $2.33 a year ago. a year ago $41,000 was the price of an average vehicle sold in 2020, today it's $47,000. everybody going to the grocery store knows food prices are up. fish and seafood at a ten-year high, bacon prices up near 90%. restaurants, those prices are up by 6.6%. that is an all-time record. this is largely covid related, we have bottlenecks and strong demand after the economy reopened, but that doesn't make it any less painful, especially for low-income families and those lifving on a fixed budget. the federal reserve is promising to get inflation under control. the question is how long that will take and whether or not it can pull off that job without doing any damage to the economy. >> we'll watch how quickly the fed decides after looking at this report to step in. matt egan, appreciate the reporting. one small piece of the economic pain. restaurants are another, the high prices, fewer staff and fewer customers is devastating. some restaurants appealing for help from the federal government. vanessa cambridge taking another look. vanessa, what are you seeing? >> john, this latest variant has wreaked havoc on an industry still struggling to come back to life. just last week, dining down 28% compared to 2020. that's according to open table. there is a restaurant app that helped to give restaurants money, $28 billion. there were about 300,000 applications. about a third were funded. so that leaves people without money. now we have the independent restaurant coalition and 30 mayors from around the country calling on congress to replenish this critical fund. >> we knew that it just was one more way, one big variant, one bad winter away from disaster for a lot of restaurants. the financial hit to the country is huge when you lose restaurants, to the neighborhood, to the community, and to the job market in general. >> now, there are two senators that are working on legislation right now trying to bring something to the floor of congress that would help these restaurants get funding, but the question is, can they get this bill to the floor in time, and then how fast does the money go out? we have lost, john, over the last two years because of this pandemic nearly 100,000 restaurants and potentially more to come. john? >> more to come. the pain of the pandemic continues. that's >> reporter: it seems there are a lot of questions of how the committee will move forward on a lot of fronts. let's first address rudy giuliani. it's been kind of surprising up to this point the committee has not asked him to appear also with the big lie and with january 6 as well. remember, he was one of the people who gave a speech on the ellipse of stop the steal rally and he was also president trump's personal lawyer. he's aon a long list of people they want to talk to, but they haven't figured out if they're going to subpoena him or ask him to come in voluntarily. his attorney already expressing doubt that giuliani will cooperate, reminding bennie thompson of attorney/client privilege given giuliani did serve as president trump's lawyer. there could be other members of congress the committee is interested in talking to. the problem is these close associates of donald trump just do not want to cooperate with the committee. what can the committee force them to do? they certainly have subpoena power, but subpoena power could be difficult when it comes to other members of congress. it's something that would be unprecedented, it's something that's really never happened before, and if they were to subpoena them, how would they enforce that subpoena? it might be difficult to just refer them for criminal contempt to the department of justice as they've done with others, so john, that's what the committee is trying to figure out, how do they get this information? that, at the end of the day, is what they're looking for. >> important crossroads. we'll see how the committee unpacks that one. john with me for his reporting. rudy giuliani would be a star witness, if you will. somebody every american knows, somebody who was at the president's side, somebody who was a daily, if not hourly, proponent of the big lie, including -- including -- roads to the january 6 rally. let's listen. >> if we are wrong, we will be made fools of. but if we're right, a lot of them will go to jail. so let's have trial by combat! >> he was, from election night to that speech right there, central to the big lies all around. the question, though, a, does he have attorney/client privilege, and b, would he tell the truth, anyway? >> these are all interesting questions. i think ultimately what the committee is trying to do is to try to get an accurate read of exactly what happened, in addition to who was responsible, but there are no doubt political calculations in all this. there is albeit a sort of political deadline in that many democrats not on this committee want everything to be wrapped up ahead of the midterms because they don't want this overhanging how voters think of which way to go. i think some of these decisions about how to carry things out depends on what is time sensitive and what can be achieved. >> what can be achieved is critical in the sense that congress has a code. they treat their own differently than they treat everybody else. the committee does know, congressman perry of pennsylvania was helping the president push the big lie, trying to challenge the results. jim jordan has been a trump ally from the very beginning. listen to a member of the committee saying, yes, it's hard, but they have important information. >> these are people who had conversations with the president, the former president, about the conspiracy theories that he continued, and those two specifically helped fan those flames, but they have key information on what the president was thinking and as in the case of my colleague mr. jordan, he admitted that he talked to the president on january 6th, which is important. >> the committee, nicholas, has surprised a lot of people with its thoroughness and aggressiveness. will that rise to the level of demanding cooperation from its own, even if you have cooperation on the floor? >> they need to meet this week to figure out what their path forward is here. no doubt they have precedent to subpoena other members of congress. it's something the house ethics committee has done before, but as mentioned, this could lead to court fines they just don't have the time for. so another recourse for the committee and for the house as a whole is to go through some sort of internal process to discipline people who don't comply with their requests. that could be docking pay or referring them to the ethics committee. we'll have to see what they do this week. >> a good investigation is like good reporting. yes, you go after the big names, so they want to talk to vice president pence at the time, they want to talk to the former chief of staff mark meadows, rudy giuliani. the worker bees know a lot. andrew surabi, most americans don't know his name. he's a donald trump jr. advisor. if you cover congress or you cover the white house, again, you want the big names. but sometimes the schedulers and the speechwriters and the staff members who are in the room and see all the paper, they can give you a lot of information, too. >> that's right, john, just because they're not household names doesn't mean they don't have key information. but what we have seen is that a lot of folks do not want to comply or feel as though this investigation is asking financial information that just goes too far and it's too evasive. ultimately the committee has to weigh the value of this. do they fight these protracted legal battles? do they subpoena former members of congress? is it worth it, or is it time to transition to another part of this phase and move forward with public hearings to show the american people what they have been able to learn, which after hundreds of interviews, i would imagine by now, is pretty substantial. >> we're told that phase should come pretty soon, at least the public hearing. we'll look forward to that. mitch mcconnell tells the truth about 2020. and, of course, donald trump gets angry. , new peppercorn ranch, new hickory-smoked bacon, new- did you just spike the footlong? >> and the flip side of that, is he, president trump, so believable? the president does have a rally in arizona, one of the states he says joe biden won fair and square. even the cyber ninjas couldn't find any fraud. the former president will be there with mike rendell, the mypillow guy, and kerry haake who is running for governor. >> yes, the former president believes this is the path to victory, to relitigate the 2020 election. the adults in the room, mitch mcconnell, deputy john thune, they don't believe it's a good strategy, relitigating. it's essentially sour grapes. but the reason we see so many republicans echo this is because they are trying to curry favor with the former president. i traveled to ohio several months ago, covered that senate republican primary. they are all vying for his endorsement, and it's hard to see how any of them get it without continuing to echo this lie that the 2020 election was somehow rigged or stolen. >> and, nicholas, if you talk to those around leader mcconnell who raises a lot of money to funnel into these senate races, who because of some disappointments in past campaigns pays very close paengs to t -- attention to the primaries and the like, and they say what could blow it, and they think trump. >> that is certainly a concern for them. look what happened in these special elections last year in georgia. republicans said if not for trump coming in and saying votes might not count in a depressing turnout, they might have won those races. yes, it is a concern for them heading into this fall where they think they can capture the majority, but as long as the election conspiracy theories continue to remain a live issue, that could cause controversy for them. >> and asmid, to the point of steve getting to the hard stuff, that's where trump gets off line right there. that's the question, right? will he stay -- it was interesting to see him come into an npr interview where we usually see him and we'll see him in a few minutes, when he comes out, he gets pressed, he gets challenged. >> it was an unfamiliar territory for him. this interview was supposed to be 15 minutes. you heard it end rather abruptly around nine minutes because the president is really unaccustomed to being challenged. one of the biggest questions for me, john, right now the president's avenues are limited because he was banned from social media format. will some of these bans be listed?
