joe biden putting it all out there today, making a last ditch push for voting rights, telling the senate it's time to change the filibuster. it's a move against solid gop opposition, not to mention two members of his own party. >> today, we call on congress to get done what history will judge, pass the freedom to vote act. pass it now! >> also ahead, the january 6th committee saying it wants information from rudy giuliani at some point, as they release more subpoenas today. and was he lying? whether novak djokovic lied to enter the country. joining me now, jessica dean and john. we will talk about what the president did today, john. president biden making a major push for the two voting rights bills, comparing it to be on the side of dr. king, john lewis, he is putting it on the line now. what happens if it doesn't work? no voting rights? no build back better? >> well, that certainly could be one result, don. both are difficult. i think the white house is more confident that -- and democratic leaders are confident they can get something done on build back better. but this is a consequence of what happened when you have zero margin for error in the senate. you have 50 senators. you have all of them, and one of them happens to come from a state that donald trump won by 39% in the last election. the fact that joe manchin is a problem on both, it didn't make a difference if they did voting rights first, and build back better second, and it's going to be difficult either way. the other thing that is an explanation for why they waited to try to do this later rather than earlier is that's there's no stronger pitch to someone that is reluctant to change the filibuster than to say to them, they are filibustering your bill that you try to get republicans to sign on to. and they couldn't. this is what happens when you don't have room for era in the senate. >> the president tried, pressured, negotiations, allowing manchin to craft his own bill. but that failed. today he turned to shaming the senators. how sis it playing on the hill? >> we have been where we have been all along. the fact remains the bills do not have the votes to pass, and that the democrats don't have the support, as john just laid out to make the rule changes in order to move forward on any of this. so that's kind of the state of play as things are right now. we do know the senate majority leader chuck schumer has promised to bring them back for a vote by martin luther king jr. day, in a few days, and not that long from now. and the rule changes. he won't say what the rule changes might be, and we did hear from democrat senators that have been hesitant to talk about the filibuster, and blowing it up for this. they -- people like john hester or king talked about how they are moving closer to that. there still remains a direct opposition to any changes of the filibuster from joe manchin. manchin said he is open to rules changes. but the question is, what is that exactly and how do they move forward? are and we end up right back where the circle began. >> john, president biden linked the whole idea of voting rights to the insurrection. watch this. >> today, we come to atlanta, the cradle of civil rights to make clear what must come after that dreadful day when a dagger was literally held at the throat of american democracy. that is why we're here to value power over principle. forces that attempted a coup against the will of the american people by sowing doubt and vending charges of fraud and seeking to steal the 2020 election from the people. they want chaos to reign. we want the people to rule. >> so he is casting the fight for voting rights as a response to january 6th. if you put together the two speeches in the last week, does it mark a new approach for president biden? i know i asked that the night he gave that speech on january 6th. what do you think? >> well, i think for a couple reasons. first, they are directly linked. the voting rights bill is to stop actions by republicans around the country that are a direct outgrowth of the effort in 2020 to subvert the will of the people in the election, first with political pressure and with bogus legal challenges and finally can physical intimidation with members of congress. it didn't work. and what legislators are trying to do is change the rule so the next time, that i can succeed where trump failed. so that is a reason to have a sharp tone on both issues, both for the senators to fame the chase. john lewis versus be conner choice, and the reason for the harsher tone toward trump. the other factor is, we are turning to 2020. you have an election, joe biden's numbers are low. the picture for democrats is not looking good at the moment. they have taken a lot of punches and the only way they are going to try to get competitive as we move to november is to punch back, and try to create a contrast. not just a portrait of a president and a congress struggling to enact an agenda, but a contrast to what republicans would do if they got in power in. is typically a president's recover, and joe biden and democratic leaders are going to try to engender that in the 2020 midterms. >> thank you. more now on president bi biden's tight to voting rights. suzanne malveaux. >> reporter: i sat down on the home where martin luther king jr. was born with his son martin iii, his wife, and the president of the national urban league to get their team. your father believed in a fierce urgency of now. do you think the president has been urgent enough in pushing for voting rights? >> what i will say is that today the president showed us of his del delibrativeness, to see how he is going to go back to the rest of the week. senator schumer has set the date for the king holiday, and we will not be satisfied, any of us, in a number of communities, but until we have john lewis will as well as the freedom to vote bill passed. >> reporter: the three for instrumental in bringing biden to atlanta and pushed back on civil rights leaders who boycotted the president's event. >> i think some see georgia and atlanta as ground zero. when it comes to the victory of the president having a majority in the senate, the last election was here in georgia. why shouldn't the president come to the front lines of the battle? not operate simply in the rose garden or the oval office, to demonstrate for the american people. >> reporter: but it was this line for the gnat captured the shared conversation. >> i have been having the quiet conversations with members of congress for the last few months. i'm tired of being quiet. >> reporter: the president today said he is tired of being quiet. do you share that sentiment? he spoke today but he said he is tired of being quiet. >> yeah, he's been quiet, and i'm aware of the fact that he's spent many, many months in private consolations, in persuasion sessions with members of the united states senate, which clearly were not successful. so yes, we're tired of him being quiet, as he's tired of being quiet, and it's time to elevate this battle, elevate this fight, and that is a fight for the future of the nation. >> when you look at the african american community that largely delivered for the president, the black and brown community, obviously, there are others but the black and brown delivered for the president. so obviously people want to see something immediate yat. they were told their backs are going to be covered. >> reporter: while the kings had hoped voting rights legislation could have been further along by the mlk holiday, that i are calling for americans to honor it. >> there is no better way to honor martin luther king than to get involved in the movement. >> reporter: reggie jackson also attended biden's speech. he believes the battle for the ballot will never end. >> we have an obligation to fight back. >> reporter: as the slain civil right leader's 93rd birthday approaches, they approach on what he would have been today. in the days ahead, do you think he would have been surprised, discouraged, moren 60 years out for his fight for voting rights, there is still a fight to be had. >> he never gave in and gave out. but disappointment, yes, he would be greatly disappointed and say that america, can, must and will do better. >> reporter: suzanne malveaux, cnn. >> thank you so much. what is at stake if voting rights dies and what will america become? >> there is certainly a lot to be done. there is a set of long term cures, long term work needed to repair our democracy. we also face a huge emergency, which is in the next two years, we may have elections. by the time we get to 2024, it's possible we will have a stolen election. we need to immediately address that prop in the short one. it's absolutely critical. >> steven, what do you say to senators who don't seem to understand the urgency of a threat we're up against now? >> i try to impress upon them the ur jency of a threat. we are in uncharted territory. the united states, one of the major political parties has abandoned democratic rules of the game. you cannot sustain a democratic if one of two major parties does not accept defeat. one of the parties is threatening the very constitutional order. all question do is impress upon senators that -- in effect, the house is on fire. as daniel pointed out, there are emergency measures that we have to take just to ensure that the 2024 election isn't stolen, isn't overturned. >> well, it's interesting that you say that. because i have been saying it on this program for some time, on this network. and republicans view that as partisan. i don't think it's partisan. i think one party is acting in reality. the other is not. they don't understand the threat to democracy. am i wrong to say that is not partisan? that is just reality? that's the truth? >> you know, what -- >> certainly -- >> go ahead, daniel. >> yeah, we propose a set of criteria, we are political scientists in there. are clear criteria, that all agree upon. does a political party accept election day? this is an absolutely necessary benchmark to be a democratic party? do they condone, tolerate violence or not? if a party cone donees violence, this is violating criteria. third, does main stream party associate themselves with the ext extremists? when we look at the american political scene today, sadly, one party fails that test. >> democratic meaning operating in a democratic democracy. if republicans win the house and senate come november, you have -- do you have any doubt they are weaponize to further consolidate their power? what are the tactics they will use? >> the republicans, since the rise of the tea party, have been systematically weapons the institutions. whatever they can. the basic norms of restraint in the exercise of political power that sustained our political system for a good chunk of the 20th century have thrown out the window, and there's no reason at all to expect that this round would be any different. in fact, the radicalization of the republican party has accelerated since trump's departure from office. so again, we can't predict with any serecertainty, but i think should expect hard ball politics from the republicans. >> people like to blame on this don't trumpd. it started with the tea party and accelerated under donald trump. have they become what they wanted to become? an autocattic party, that wants minority rule? >> that's a good question. i think it's both. there's no question that the seeds were already there for trump. i think you take trump out of the picture, and i don't think the radicalization would have been as acute, as rapid, but there was a lot of extremist, raw material for trump to play with. and it's predates trump, and it's something that is going to persist after trump exists the political stage, he was a catalyst, but he didn't cause this. he is more symptom than cause. >> daniel, trump has been spreading his lies about election, that he won and it was stolen from him. we know that is absolutely not true. facts and indicators show it's not. how can democracy prax when everybody doesn't have the same understanding of reality or truth? >> it's very difficult. it's very difficult. and especially when it comes to key issues like elections. elections are knowing about how to lose. democrats can't survive unless people learn how to lose elections. if you look at the transfer of power that took place in germany after merkel's years in office, they gave a first bump and that is the end of it. that is a simple process. that is necessary for democracy to survive. if you're in a situation where one party doesn't accept election results and they go after the validity, it encourages further attacks on the democracy. it makes me nervous how democrats respond in the future, if republicans win fair and square. it's bad news. >> the thing is, we have been talking about republicans. but are democrats doing enough, daniel? >> so far, i would say that democrats are working quite hard. that is especially what the two bills in front of the senate are. it passed the house. the president said he will sign them. we have 50 democratic senators who are in favor of the two bills, which would do a lot. clearly the filibuster is a problem. that's the barrier, so this is a moment of choice and a moment of division. in the life of all democrats, the there is a decision, this week. >> steven, on the anniversary of january 6th, president biden said you cannot only love your country when you win. can democracy function if one side is willing to play by the rules? look, i am afraid that we have passed the point of no return. >> i don't think we have passed the point of no return. american democracy has a no, ma'am number of things going for it as well. you're right. it's very hard to sustain democratic for long when one political party is unwilling as daniel said to accept defeat. we're in a paoint now, and democracy governments may do well, they lose popularity, and parties lose elections. so the democrats are likely to lose the midterm elections -- the next midterm election. in a democracy that's normal. the problem, is we as a democracy can't afford to lose elections because the opposition parties. that puts way too much weight on the democrats' shoulders. they're expected to win every election to safe democracy. that is a terrible place to be. >> it forces to you taking a political side. because you're rooting for democrats to win but only to save the democracy, not necessarily because you're a democrat or you believe in what the democrats believe in, except for having a democracy and a functioning republic. am i wrong? >> we should root for a broader coalition between democrats and republicans or conservatives, we are in a situation where there needs to be alliances you have never thought of before. it's about supporting small democrats across the spuk trum. >> thank you, thank you for the book, and i hope people read it. i hope people are listening to you guys. thank you. >> thanks for having us. >> joe biden did win the election. he did. why is it a shock that republicans are coming out to defend their colleague who told the truth about that? >> we need knew the outcome of election four days after the election. it was clear a couple days after the election what was going to happen. i find it extraordinary how far the republican party has fallen. the election wasn't close. 8 million popular votes. it would be like nasa launching in a debate that maybe the sun isn't the senator of the universe. it's one of the telling signs of the collapse of the party as a democratic force. >> am i just -- you know -- reaching here thinking there is something larger afoot? do you disagree with that? maybe, maybe there is someone, people are getting control of -- coming to their senses at least? >> yeah, i think you would be. >> a little naive, a little pollyannish. >> he is not up until '26, by the way. >> yeah, and senators don't lose congress. you can count them on hand world war ii, i mean, look, these politicians are an heir to the greatest generation. all they had to do is have a senate statement saying who won the presidential race in america. and they had difficulty rising to that level. it's not a very demanding task. and there are like -- fourth or fifth generation imperative wealth that is just squandering it, this is the greatest legacy in the history of democracy, and they are just burning it. >> republican senator lisa markowski sat down with media and spoke of the attack on democracy. here it is. >> the passage of time can kind of soften things. but the facts still remain the facts. there was an effort, there was a concentrated effort and we're learning more, day by day, through this commission, i wish i had been a commission that was fully sanctioned by the whole congress rather than just a majority of democrats. but we're learning more and more that this was a concerted effort to thwart an election. >> i think i know what you're answers going to be. by the way, murkowski is one of the senators who voted to impeach trump after the insurrection. the timing is curious. are they trying to stop trump or not? >> i think there's two parts to the republican party. one that realizes trump can be a weak candidate in 2024, and the over whogs are in fear of being challenged by trump. there is no reason to believe that donald trump doesn't lead the republican party now. he is the most popular television in the party. there is no anti-trump movement that is growing. how many republicans showed up in the house when they were honoring 1/6? you know, cheney and her dad. i think if you -- i'm so glad huh you had those guys on. how democracy died. >> they're so good. >> i get that book out like a watchtower. a normalization after of degrad and something that could have been inconceivable. it's not as bad as other people. all of this has happened to other countries that have lost their democracy. we have to stop thinking we're unique. >> you are talking about daniel and steven. but fareed zakaria had a special on, it's on the cnn app. this is a new interview from trump, on a conservative outlet. he is calling televisions they had the booster gutless and saying the vaccines have saved tens of millions of lives. it seems like he is fully embracing the vaccines. why now given that so much of his base is against vaccination? >> well, you know, donald trump loves nothing as much as donald trump. you actually have a curious moment where donald trump's ego has for once come together with the greater good. he wants to say this works. >> it's like the car who caught the car? >> january 6th didn't start on january 6th, and there was a long pattern of statements, meetings, communications that went back before that. rudy giuliani would have been at the center of it, and frankly, he spoke the morning of january 6th. so they have a number of thinks to ask him about beyond his personal contacts. >> giuliani's attorney is suggesting any information he has is protected by attorney-client privilege. not a very good one. he was the president's lawyer. do they have a case there? >> a little bit, don. look, he was the president's lau lawyer, and any time he was providing legal advice, the statements are protected, and that is okay. number one, he spoke on january 6th. two, he was communicating, engaging with respect to the georgia elections, allegations of fraud, and he was sued on statements he made down there. he with you sued by dominion, the voting company, based on comments he said. they were not necessarily statements he was making to the president. will is a wide -- there is an exception to attorney-client privilege called the crime fraud exception, and if someone commits a crime or covers it, it's waived, and the committee is looking into that. >> let's not forget, he was a speaker at the stop of the steal rally. is that covered -- >> again, it's public comments. any drafts, any speeches, any planning he did for that. look, if there is maybe let's be nice to rudy giuliani for a moment and think that prior to that, he was providing legal advice, it's waived when he speaks publicly into a microphone. >> the committee issues subpoenas for a white house official who helped draft a speech for the rally. are smaller fish like this going to help? >> you're not going to get everybody to cooperate. if they have telephone records from mark meadows. but they don't have mark meadows' testimony, who can fill in the gaps? and some of the names are big and high profile. but at the end of the day, the little people might fill in the rest of the report. >> sexy?
