from fox hosts, others from republican lawmakers. one text said quote the president needs to stop this asap. another pleads quote mark, protesters are literally storming the capitol, breaking windows, and doors, rushing in. is trump going to say something? cnn senior legal affairs correspondent paula reid is here. obviously these new texts reveal so much aor newly released text reveal so much. what's the legal argument. >> look, you have handed over 9,000 pages of records, clearly you didn't think those were covered by privilege, and if you did, you waived it. come in and answer questions about the materials you handed us. if you are concerned about any question asked or issue that you think may be covered by executive privilege, raise is there to that question. that's the way this usually works. meadows now after cooperating for some time, being engaged, willing to sit for an interview, he's stopped cooperating with the committee, refusing to comply with the subpoena, and the committee vice chairwoman, liz cheney laid out other things they would like to talk to meadows about this morning. let's listen. >> what were his discussions with a member of this body about making jeffrey clark attorney general. why did they want to make jeffrey clark attorney general, what did he think about the letter that jeffrey clark cwas proposing to send to state legislators in georgia. why were fox news hosts texting him telling him that they needed to get the president out to stop this. why did they think the president was those who could stop this. many of those people are saying, gosh, this was just tourists. or this was a false flag operation, another person on fox news has claimed. >> clearly they have a lot of questions for the former chief of staff, and if he was to cooperate or continue to engage, he would be such a critical witness for their investigation. but they continue to proceed with this criminal contempt. it's unlikely that they will hear from mark meadows. the other outstanding question is whether this goes to the justice department, if attorney general merrick garland will proceed with the prosecution against meadows. they have of course been prosecuting another trump ally, steve bannon. this case is different for several reasons. meadows was a top official at the white house on january 6th, and he did for a full-time like we reported, he did engage with the committee, turned over thousands of pages of records, and as we see here, he has provided them with incredible evidence. now, in his objections to this subpoena, meadows makes two arguments, the first is he argues that he does not want to violate executive privilege. he questions the authority of this committee to conduct this investigation. now, those two issues have come up in separate litigation by former president trump, and now at two levels, the federal court has rejected those arguments so far, but the former president still has the right to appeal these larger questions about his rights to keep his records, his white house records secret from the committee, questions about the power of this particular committee to conduct this investigation. he has the right to appeal to the supreme court. he's expected to do that. it's unlikely if the justice department were to proceed, it's unlikely they would do so before that litigation is resolved. alisyn, victor. >> paula reid, thank you, let's bring in cnn chief white house kaitlan collins, charlie dent, gloria borger, let me start with you. it's been decades since a white house chief of staff has been considered for criminal charges before steve bannon, decades since someone has been charged with contempt of congress. the historical framework as this debate and vote happen this afternoon. >> it's quite remarkable and while it's political in many ways, it's a solemn moment for the country, i believe. we all witnessed what occurred on january 6th, and as you saw from the committee hearing last night, it could not be more serious, and more important to the country, and so i think when you have these texts and you have these e-mails on mark -- to mark meadows, what you have laid out before us are the receipts here for lack of a better word. you have the receipts that show that mark meadows knew how serious this was, that the president of the united states was being implored to do something. mark meadows telling donald trump jr., you know, i'm trying to get to the president. you know the president's family knew. you know that republican lawmakers knew. all the way up and down the line. people were aware. fox news anchors knew. up and down the line, people knew how serious, what was going on at the capitol was, and yet, there are those who still have refused to publicly come out and say it, and who are double dealing publicly, quite frankly. >> absolutely. charlie, it's so remarkable to read these texts in realtime. as gloria says, they knew the danger was unfolding, how deadly it could be. they knew what real leadership should look like. they knew trump wasn't stepping up to call off the mob. lives were depending on it. that's what you see in the urgency of the texts. when you see the lawmakers, i wish we knew the names of the lawmakers. for whatever reason they haven't released them, and i want to ask you about that, but we don't know who. yesterday was a terrible day, we tried everything we could in our objections to the six states. i'm sorry, nothing worked. apologizing that they weren't able to overturn a free and fair election but still, call off the mob, if you would. what do you see in all of this, charlie? >> the whole situation is utterly shameful. to hear these trump allies in realtime, i'm talking about the fox news hosts and his son, and the others who were trying, you know, telling the president to do something, or encouraging meadows to do something, understanding the magnitude of what was happening, and then they've got on to whitewash this thing and to minimize it publicly, it really speaks to the sickness in our political system that they would actually stoop to the level. to the member you just referred to who apologizes, who apologizes because they didn't stop the peaceful transfer of power. i mean, i wouldn't want to be that member of congress, how do you ever explain that at home in good conscience. i mean, i just -- it's utterly shameful, there's no way else to say this. this is a massive crime scene, and congress has every right to hold people accountable and get answers from people like mark meadows, 1 foot in, 1 foot out, i'll talk about it in my book, but i won't talk about it with you congress. this is simply incredible. i think meadows is in a predicament now. if he tells the truth, he'll upset donald trump, and he's smart enough to know he can't lie. he's in a no man's land. this is kind of unprecedented, and i expect he's going to be held in contempt shortly. >> kaitlan, you know, we have read through these descriptions of books that have come out recently about what the president was doing at that time, we now have a clear picture of the people reaping out to him because they knew he was probably the only person who could get people out of that building. >> and he was one of the few people who actually was around the president that day, because a lot of people in the west wing that we talked to that day were steering clear of the value office, knowing regardless before this happened, it wasn't going to be a day where the former president was very happy, but mark meadows was one of the people who was around him. i think there are a few questions about this, one, who are the lawmakers who sent the message. they did not reveal that last night. >> do we know why they're not revealing that? >> they say because the investigation is ongoing. they reveal the fox news anchors. i suspect they will do this at some point. what time were the terxts donal trump jr. sent is a big question, and one mark meadows could answer but is not going to be is what did he do with these messages? did he go to the former president with this or did he kind of keep it to himself, and then try to get the president to issue a statement? those are big questions. i can't imagine that trump is very happy with this because we should remind people, mark meadows is saying these are selectively leaked. turning these over to the committee. he is the reason that liz cheney was able to read the texts aloud from donald trump jr. r from the normal allies at fox news of the former president, and given the committee a fresh burst of momentum. they had kind of been interviewing people behind the scenes. no one eweknew what their work do was doing from an outside perspective. and mitch mcconnell, he's also interested to see who is involved in all of this. >> how about liz cheney, having to be this not lone voice but pretty close to lone voice in the woods there, and reading her colleagues, her republican colleagues text messages outloud to make the case that they have to hold meadows in contempt, i mean, she has shown that she has a steely spine, but it can't be easy to do all of this. >> i don't think it's busy, but she's all in. stealy is the way to describe it, and it could cost her her congressional seat. there's no pretending that's not a problem for her, but she's made a decision which is that the country is more important to her than her congressional seat. i think you're going to continue to see liz cheney lead, and i think one of the reasons they're not giving all of these names out as you were just talking to kaitlan out is this did give them a little bit of momentum, and you want to dribble information out. it's probably strategic to a degree because these people know who they are who are texting meadows, and liz cheney has them in her back pocket, and maybe they don't know all the names of people yet because they have to match phone numbers to people. they weren't given a list of names of people. but cheney is really really leading the pack here, and i think she's decided to stake her entire career on it because she's made a choice about what's important to her and she's picked the country. >> congressman, if the bannon debate, the debate over his criminal referral is any guide, we're likely to hear from kevin mccarthy in this debate, and i just want to remind people what he described happened that afternoon in his communication with the president in what he says happened afterward, let's watch that. >> i was the first person to contact him when the riot was going on, he didn't' it. he ended the call telling me he'll put something out to make sure so stop this, and that's what he did, he put a video out later. >> that is a broad brush whitewash over what happened that day, but i just want to remind people, congressman, and you can speak to it. there are members who are speak today who have a vested interest in all of this information about the exchanges with the president that day, they are some of the congressmen who sent these texts. they don't want that to be part of the conversation. >> look, again, every one of those members, i suspect on the republican side knew how serious that situation was in realtime. they were concerned for their safety, their personal safety. they knew the severity and the magnitude of the event that they were witnessing. what's so alarming and disturbing is the attempts to whitewash. some of them are just treating it as a political issue. got to move on, time to talk about other things. some are vulnerable, legally and politically, some of the roles that some of them may have played. not those that are concerned, those that were upset, you know, that the coup didn't come off. so bottom line is i think everybody knows, and we're getting the truth. we know what happened, everybody agrees about the severity of the situation. the harsh reality is it's so discourage to go see people trying to rewrite history and talk about it in a way that really minimizes what occurred . >> in terms of needing to move on, i was watching the news hour of fox, and the story they want to talk about is how the vice president had driven an electric car, test driven an electric car. they didn't like how she had test driven it. that's more important than a threat to democracy, and trying to overturn an election. just throwing that out there for their choices. kaitlan collins, gloria borger, charlie dent, thank you very much. now to kentucky, >> reporter: yeah, alisyn and victor, the recovery effort is still in effect. the rescue effort and really the clean up. when you look at the area just around us, i mean, there is so much to do. i got to tell you, there are so many people here on the ground from the national guard to fema to volunteers out of state here to help. there is a need for power, which we are seeing electric companies. there is a need for water. there is a need for food. the need is huge, and then we got a sombering update from the governor this afternoon about the death toll in kentucky alone. as you mentioned, 74 dead, but he also said there are so many people still missing. take a listen. >> we still definitely are in rescue and recovery. we have people missing. still expect that we will find at least some more bodies. there is just so much destruction. i hope that that's not the case, but it's still an expectation. and we could still lose people to injuries like we did that baby and in hopkins county. you want to know how mean this thing is. >> and yeah, you really can tell how mean this storm was when you look at the devastation. among those killed in these storms, from dawson springs, a 2-month-old named oakland kune was with her family in their trailer home when this storm ripped through and that little girl has died we have confirmed. so much loss here. there's so much resiliency and hope, certainly when the president comes around this part of western kentucky, it's going to give a lot of people a lot more hope for this path forward. guys. >> brynn gingras thank you for the reporting. kentucky's first lady, britney breshear, thank you for being here. the youngest victim 2 months old, the oldest 98. tell us about the conversation, when you talk to people who have lost, as i said, every tangible thing that they have. >> this storm, this tornado, tragedy doesn't begin to describe the absolute obliteration of towns and communities in western kentucky. people are grieving. they are shell shocked. they're looking for pieces of their life in rubble that it's just not there. and there's a lot of sadness, but kentuckians are strong and resilient, and we will bounce back from this. >> i know that your work there, you focused on the children across the state. your husband had a moment where he broke down. you had one as well. he had to come out and finish a statement there. when you think about what the kids in your state have had to face during the pandemic, and then there was the flooding in the southeast part of the state as well. now, this, i mean, what goes through your mind? >> it's devastating. children need to feel safe, and they need to feel secure, especially in their homes. and that's been taken away from them through the flooding and now the tornadoes. those pieces of security and innocence are gone, and it's going to take a long process to help these children sort of, you know, process what has happened to them and hopefully get them on a path of resilience. >> we are, what, ten days out now from christmas eve, and for parents who are trying to secure a place to live to get utilities on, a car, maybe their workplace has been damaged or destroyed, getting christmas presents is really kind of low on the list, and i know you're working to try to help those kids. tell me about it. >> yeah, so as you mentioned, the most important thing after the tornado just ravage western kentucky was search and rescue, getting water, shelter, food, you know, it's middle of december here, it's cold, and so those immediate needs absolutely need to be met, but we're also just shy of two weeks from christmas, and there are children who were looking forward to that visit from santa, and they've lost their homes. thaich lost they've lost their family, they have lost their community, they have lost that sense of community. look at my own two children, timmy, what was able to do was to set up this toy drive in order to hopefully bring some joy into a time of severe sadness to the children of western kentucky and their families and hopefully just for a moment things will feel a little bit more normal. >> yeah, i know that a lot of people want to send bags of clothes, they want to send baby clothes or t-shirts, you're not asking for that. how can people -- because we know our viewers always want to support, how can they help, and what do you need? >> so victor, i think it's early to be making final determinations about what omicron actually is. we have information from south africa. we have information from the u.k. as well that suggests that it's really rapidly spreading, but we also have early signs that it may not cause severe disease, so more people are getting sick but they're not necessarily ending up in the hospital or dying at this point. but we know that there's some challenges, too, in terms of making judgments too early because there are often lags with hospitalizations, lags with deaths as well, and so i think we really have to be careful about making any real final determinations about how bad omicron actually is. >> there still also seems to be a debate about what fully vaccinated means. at first we thought it was two doses, now it seems you'll need a booster. why don't we just change our definition and say this is a three-dose regimen. this is a three dose vaccine, and we should all get that. >> based on my past experience as a pediatrician, also as a person who sat on the advisory committee to the cdc on immunization practices i know that the vaccine recommendations evolves as the science evolves, and at this point what we're saying is that we know fully vaccinated really includes people who have had the full series of two doses, the pfizer or moderna, one dose of the j&j, and the boosters are necessary as well. the definitions for fully vaccinated will involve over time, and may include booster doses as well. >> you're saying we're not there yet. when will we know what the actual definition is? >> so i think what happens is the cdc will review the data that are available regarding vaccine effectiveness, how well the booster doses are working, those kinds of things will all come into play as we make decisions, and keeping in mind, what is the predominant strain and how effective is the vaccine against that predominant strain. those things will help us define what the actual fully vaccinated really means. >> doctor walensky says that omicron is now 3% of the cases that are sequenced in this country higher in new york and new jersey, interestingly. but omicron's dominant in south africa, could be dominant in the next 24 hours or so in the u.k. different vaccine picture, different vaccines in use, but do you expect that it will be dominant here soon? >> so the speed at which this vaccine is doubling is really remarkable, and so what we're seeing play out in south africa and the u.k. is dramatic. i think it's likely that this omicron virus variant will spread rapidly through the united states, and then we'll just have to monitor over time, i'm not sure it will be exactly the same experience they're having in south africa or the u.k. but we'll definitely have to keep our eyes on it and watch it closely. in the meantime, things in place right now in the united states are helpful in buying us some time until we understand more about the variant. so find people who have disease, making sure we're isolating them with identifying their contacts and quarantine the contacts, all of those things can help limit the spread of the virus, while we're understanding more about it. >> there is more seeming good news today, and that is that pfizer says that its pill, its covid pill cuts the risk of hospitalization and death by 89% if given to high risk adults within a few days of their symptoms. is that a game changer? >> it's a wonderful tool to have in the tool box. i think about influenza virus, we have tamiflu and antiviral agents that can be used to limit the impact of infections if we take them early in the course of a disease. if we have one for covid, that can help. the key from my perspective is we have the results that the manufacturer is describing but they have to be reviewed by the fda before they're actually approved by the fda and available for us to use. >> i wonder if you see if that good news could cut both ways, if there's a pill 89% chance of keeping me out of the hospital, maybe if i'm an unvaccinated person i don't get the vaccine, i just wait for the pill if i need it. >> yeah, see i think from my perspective, i wouldn't want that to happen, the same with influenza vaccine, i would recommend that people get the vaccines first and foremost because we know they're highly effective in preventing disease, preventing hospitalization, and preventing death, especially since we know it works against the delta variant, people that aren't vaccinated need to get vaccinated because delta is predominant now. and that can work for people advanta unvaccinated and vaccinated but getting vaccinated should be the top priority right now. >> doctor, thank you so much. >> thank you. president biden is expected to speak again with senator joe manchin about the build back better package but the white house says that when it comes to a deal they're not there yet. will this get done before christmas? [daughter] slurping don't pay for water. pay for clean. it's got to be tide. 11 days until christmas. >> i have got to do some shopping. >> different context here. democrats are trying to pass the president's landmark economic spending bill before the holiday break. >> senator joe manchin a key vote to passing the build back better bill remains a question mark for democrats. manchin says he expects to have more talks with the president today. let's bring in our chief congressional correspondent manu raju on capitol hill. you have a lot of talks with senator manchin, where do things stand today? >> he's just not there yet. he wants a number of changes in this bill, and that really has not been any different than where he's been for the past several months, because he has a number of philosophical concerns with this plan, roughly $2 trillion to put money into a whole bunch of issues whether it's health care, education, housing, child care and the like. he is concerned about how a number of the programs are temporary. he believes that it does not provide the true cost of the bill. he raised concerns about inflationary pressures, exacerbating inflation, rejecting the white house argument that it does the come s -- opposite. and that is essential here. we are in a 50/50 senate. one democratic senator who votes now is enough to stall or completely derail this entire effort. the talks between the president and joe manchin are continuing, but in addition to that, there are issues with the procedural aspects of this bill. in order to move it through the senate, through a process that allows them to pass along straight party lines, needs to adhere to strict senate budget rules, and it's going through the parliamentarian process to ensure it does meet that test, and that is not done yet. that could take several days, go into next week. so in addition to the parliamentary issues as well as trying to get the actual final bill drafted, getting joe manchin on board, behind the key sticking points, and other points that exist for senators, particularly on tax issues, that's why there's some major questions. about when they can get the bill done, a lot of skepticism getting done before christmas, and chuck schumer the majority leader told reporters, he is pushing to get it done by christmas, despite all of these factors lining up against him. >> let's talk about another deadline coming up on for the debt ceiling. their procedural vote today to advance the bill to raise the debt limit to avoid default. what do you know? >> roughly $2.5 trillion, that is the increase in which they will vote to raise the national debt ceiling. the hope is to avoid, and push this off, basically until 2023. now, this will pass, it was a procedural vote that advanced along party lines this afternoon. we expect it to pass the senate in the next hour. it will go over to the house where it will pass along strict party lines. this came as a result of a deal that was reached between mitch mcconnell the republican leader and chuck schumer, the senate democratic leader to expedite this process, allow them to raise the debt ceiling along straight party lines, which is why this is happening with just democratic votes alone. but they are kicking this again to 2023, the question will be 2023, there's a very good chance republicans could be in the majority, in the house, maybe even the senate, joe biden will still be president then. that's going to be a big problem for another day. they don't want to vote to raise the debt ceiling, that's going to be a problem for another day, guys. >> manu raju, thank you! thanks. now to thris, the former police officer convicted of killing george floyd will be back in court tomorrow andments to change his fleaplea in a civ rights case. that's next. hey google. ♪ ♪ ♪ ♪ ♪ ♪ football, is a game of inches. but it's also a game, of information. because the nfl is connected. and at any moment, the fate of the season can come down to this. billions of secure connections, per second. when the game is on the line and the game is always on the line touchdown! the nfl relies on cisco. 1, 2, 3... yay! ♪ “i got you babe” by etta james ♪ ♪ wait hold up, here it comes! alright, everybody stand up straight. okay now let me flip it. ♪ ♪ ♪ ♪ (chloe) wireless family plans save you money, but then you have to deal with family. so i got visible. get unlimited data for as low as $25 a month. no family needed. >> well, this is a big development. it shows us that he's not going to fight these federal charges. the legal woes that this former minneapolis police officer has faced, he was convicted on state charges in the murder of george floyd but as is so often the case, the federal government came in and looked at the situation. any time there's an officer use of force, they'll determine whether or not there are federal charges. they determined that, yes, derek chauvin in their view violated george floyd's civil rights during that incursion. i'll read you part of the indictment. the federal government alleges that chauvin willfully deprived george floyd of the right, security protected by the constitution, laws of the united states to be free from an unreasonable seizure which includes the right to be trooi free from the use of unreasonable force by a police officer. again, the big development here is that although chauvin had originally pleaded not guilty to that charge, we now expect tomorrow he will change that plea to guilty. what's so fascinating, here where i'm standing outside the minneapolis courthouse in june, just prior to derek chauvin being sentenced on state murder charges, he made comments deemed by many to be somewhat cryptic. people didn't understand what he was saying. we now appear to get insight into what he was referring to. take a listen to that moment. >> my condolences to the floyd family. there's going to be some other information in the future that would be of interest, and i hope things will give you some peace of mind. thank you. >> so it's possible that other information he was talking about was a potential change in a plea to guilty. of course, it's worth noting this is not the only charge that chauvin faces federally. there's a whole separate case against him. federal prosecutors allege back in 2017, he choked and assaulted a 14-year-old. they've also filed charges in that case. victor, alisyn. >> josh, there are three other officers who face charges. what's this mean for them, if anything?
