nine separate counts. cnn's national senior correspondent sara sidner is live in brunswick. sara, what can you tell us about today's request by the jury? >> reporter: it's clear that they're taking their role as jurors seriously. they want to look at the evidence. when they do that, they're talking about the very crux of what happened here in the killing of ahmaud arbery. the videos they asked for, they asked for the version of the video that is very high def, they can see everything and they asked for it to be slowed down. there was a version of the video that was slowed down. they also wanted to hear that 911 call from greg mcmichael as arbery was being chased by all three men. when you hear this from the jury, they wanted to see each of these videos three times. so clearly this is really, really important evidence to them, as you might imagine. it is the incident all pretty much caught on video. clearly they're looking at the incident itself and trying to figure out what to do. we should also mention that each of these men face several murder charges as well as aggravated assault and false imprisonment. they are accused of using their two vehicles, their two trucks and trapping basically ahmaud arbery on that day in february and then travis mcmichael shot him with his shotgun. now, the defense is saying they were trying to make a citizen's arrest. they believe arbery had committed a crime, particularly burglary, although it was pointed out by the prosecution they never saw a crime being committed by arbery on that day and that is part of what the law says you must do before you can effect a citizen's arrest. for their part they're saying this was self-defense, that there was a fight over the weapon. the prosecution saying, look, these men tried to act as police officers, as law enforcement instead of just waiting for law enforcement to show up. they took it into their own hands and did so illegally and murdered arbery. i do want to point out there has been a lot of racial over and undertones in this trial throughout, and the family really feeling that in a very strong way. we heard from al sharpton who has been in and out of brunswick and with the family. here is what he had to say about what he heard in court after a comment by one of the defense attorneys talking about ahmaud arbery's appearance, talking about his long, dirty toenails. >> they sat and heard some of the most racist statements in a court of law that i've heard in the decades i've been out here. >> amen. >> i've sat in many courtrooms. i've never sat in a courtroom where a victim was akin to an animal talking about dirty toenails, like he was not even a human. >> reporter: so the dehumanization of ahmaud arbery who was shot and killed back in february 2020 has been a real pain for the family, his mother running out of court once she heard the attorneys say those words. guys. >> we'll come back to you. sara sidner in brunswick. joining me are joey jackson as well as shan wu, a defense attorney and federal prosecutor. thank you so up many for joining me today. joey, i want to first go to you. as you heard sara saying, the jury requested to see the video, the moment that ahmaud arbery was killed. they also wanted to listen to the 911 call. what does that tell you about what this jury is thinking on this second day of deliberations? >> a couple of things, alex, it's good to be with you. when you look at the tape, what does it do? it takes you to the actual event. when you're looking at that, you're looking at the issue of self-defense. you wonder if the jurors are focusing in on whether the self-defense was justified or not. that's a major basis. when you look at that, you examine are the jurors asking, was there provocation on the part of the defendants. in the event there was provocation, you're not entitled to self-defense. were the defendants committing any felony, aggravated assault, when you use your trucks in order to assault mr. arbery, that would be a violation. therefore, you would not get the benefit of self-defense. finally, if you're the initial aggressor, you wouldn't get that. also, alex, i'm thinking if they got to the issue of self-defense, whether it means the jurors have concluded this citizen's arrest law would be applicable. the prosecutors spent a lot of time saying there's no applicability, no crime committed that they had immediate knowledge of, and certainly not one committed in their presence. it wasn't a felony which would allow them to chase him. as i assess and look at that, you have to foek wonder whether they're focusing in on that issue and when they do, last point, is it as to one particular defendant? is it at to another defendant? has they made a decision as to one and parsing out what the conduct was of the others? they're honing in on the central issue of the case, that's for sure. >> shan, the jury asking to hear part of that call made by defendant greg mcmichael. he's the father, he was in the bed of the pickup truck. the jury only wanted to hear the very beginning where the dispatcher asks what's your emergency. you can hear greg mcmichael saying, quote, there's a black male running down the street. why would they want to listen to just that part? >> that really goes to the heart of the case, doesn't it? the whole point here is what motive do they have to think there's a rhyme? what motive do they have in terms of racial. what's your emergency? black guy running down the street. not really an emergency, racial motive there. it's very important that they're looking at that. i agree with joey, it's an interesting juxtaposition. one, i don't like holiday verdicts as a prosecutor, but if i'm the prosecution here, i don't want them looking at that last moment where there's this struggle and encounter because that does go to self-defense. it want them looking at what led up to that. i would like them to review the evidence of how they followed him, how they boxed him in, the earlier encounters. that's the big picture of them being the aggressors, planning to find him, to hunt him down, trap him that way. but, on the other hand, when you juxtapose that moment, they're looking at the two crucial moments in the case. also, i would say, joey's analysis of how they're deliberating, i would concur with. it looks like they're being pretty methodical. they have to think about self-defense obviously. it might be a good sign for the prosecution that they're looking so intently at that. it may mean that obviously there's a death here or shooting death. they may have already decided they've met elements for some of those felonies and they need to dive in and see if self-defense overcomes that or not. >> joey, i want to ask you to get in the mind of these jurors. this is a complicated verdict sheet. you have these three defendants, nine counts for each defendant, three lesser charges for william bryan. they each had distinct roles in this killing. how do you think this jury is working through this very long list of charges? >> it's interesting -- great question, alex. the prosecutor really laid out the narrative that she would want them to buy into. when i say that, she was really a professor when she gave her closing argument as well as her reb rebuttal. she went through the elements, ladies and gentlemen, let me tell you what citizen's arrest means, do you see a crime? to shan's point, they're not looking at things leading up to this which leads me to wonder did they conclude that citizen's arrest was applicable here and they're honing in on self-defense? if they got to that part, you'll ask questions, at the time there was a fatal shot, was there immediate fear of death or serious bodily injury? were the shots fired proportionate to any threat posed? did the defendant at that time act reasonably under those circumstances? last point, alex, to your level of complication, even if they make those conclusions, now they have to go back and say, wait a minute, he might have been in immediate fear at the time and might have acted proportionately. but wasn't he the aggressor? wasn't he engaged in other felonies so we shouldn't give himself defense? a lot of questions to ask if they're following the jury instructions. >> joey jackson, shan wu, thanks for breaking that down. we know you'll be watching closely. developing this morning, an 8-year-old boy is now the sixth person to die after an suv plowed through a corroded christmas parade in wisconsin. the suspect, 39-year-old darrell brooks is being held on $5 million bail, facing five counts of first degree intentional homicide. more charges are expected. cnn's adrienne broaddus is live in waukesha, what have you learned about the young victim, the sixth person to die in this horrific incident? >> reporter: alex, that child was 8-year-old jackson sparks. according to a gofundme page, surgeons operated on his brain sunday. on that gofundme page, his family wrote they needed a miracle. but yesterday we learned jackson was the sixth person to die. his brother is 12 years old and was also injured. his brother, tucker according to the family has skull fractures but was expected to be released from the hospital this week. we learned about jackson's death on the same day 39-year-old darrell brooks was charged with five counts of first degree intentional homicide. the charges likely -- we know the charges will increase because of this sixth death. we also learned not 48 people were injured, but at least 62 people were injured, and the 39-year-old suspect brooks, his bond was set at $5 million. the prosecuting attorney said it was extraordinarily high, but she spent about ten minutes in court outlining brooks' extensive criminal history, citing those concerns and those reasons for the high bond. alex. >> all right, our thoughts are with the families of that young boy and everybody else who was affected in that horrible tragedy. thank you to adrienne broaddus in waukesha. coming up, holiday travel rebounding to prepandemic levels. thens of millions hit the roads and the skies for thanksgiving. we have live reports on what to expect. that's coming up next. >> reporter: alex, it looks a lot more like travel in 2019 did than what we've seen over the past two years. at this point there's a bit of a lull in these lines, but in part because the airport keeps opening up, new security lines moving passengers around saying they were ready for this increase in holiday travel. on friday tsa said it was the busiest air travel day since march of 2020. look, the numbers have continued looking more like 2019 numbers since, on both monday and tuesday tsa screened more than 2 million passengers. that's about 90% of what they screened on the same day two years ago which, of course, for a lot of people in the airport today is the last time they were at an airport. there's a bit of rustiness right now, something that airlines are saying go ahead and arrive earlier than you think you need to. arrive two hours earlier, make sure you're patient and make sure you wear a mask. you have to way them inside airports and airplanes. you mentioned the unruly passengers. that's something they're trying to avoid, especially with the staffing shortages and issues we've seen with cancellations last month and the month before. >> travel rustiness, but certainly relief for millions of people that they're heading to see loved ones for thanksgiving. dianne gallagher, thanks so much. developing this morning, san francisco's district attorney charged nine people with felonies in a series of brazen smash and grab robberies at a louis vuitton store and other luxury shops in the city's union square. 40 looters grabbed whatever they could before jumping into cars waiting outside and and taking off with more merchandise. at least 20 people broke into a nordstrom in los angeles monday night, smashing the window with a sledgehammer. three suspects are now in police custody after a high-speed chase with police. take a look at this. in oak brook, illinois, video capturing at least 14 people rushing into another louis vuitton store and making out with more than $100,000 of her whan dies there. unbelievable video there. coming up, a new warning to americans from the u.s. embassy in ukraine as fears mount over a possible russian invasion. those details next. no salesman there to help me pick out the car i need. how does anyone find a car on this site without someone like us checking in? (vo) buy your next car 100% online. with carvana. as i observe investors balance risk and reward, i see one element securing portfolios, time after time. gold. your strategic advantage. - san francisco can have criminal justice reform and public safety. but district attorney chesa boudin is failing on both. - the safety of san francisco is dependent upon chesa being recalled as soon as possible. - i didn't support the newsom recall but this is different. - chesa takes a very radical perspective and approach to criminal justice reform, which is having a negative impact on communities of color. - i never in a million years thought that my son, let alone any six-year-old, would be gunned down in the streets of san francisco and not get any justice. - chesa's failure has resulted in increase in crime against asian americans. - the da's office is in complete turmoil at this point. - for chesa boudin to intervene in so many cases is both bad management and dangerous for the city of san francisco. - we are for criminal justice reform. chesa's not it. recall chesa boudin now. also developing this morning, china is accusing the u.s. of, quote, sending wrong signals after president joe biden invited taiwan to a democracy summit next month. tensions between the united states and china remain strained. >> i'm steenk jhung in beijing, just a week after the virtual summit between president biden and his chinese counterpart xi jinping, taiwan has become a source of contention with beijing accusing washington of, quote, unquote, providing a platform and sending a wrong signal to separatist forces on the island after the white house invited taiwan to a summit early next month. china expressed firm opposition to this move with a foreign ministry spokesperson saying taiwan has no status under international law even though the two sides have been governed separately for seven decades since the end of the chinese civil war and the ruling party has never controlled the island. tension has been rising across the taiwan strait for months with the chinese military sending a large number of warplanes into airspace around the island and with u.s. warning a rising threat of chinese attack against the democratic island. taiwan's government has welcomed the invitation and recognized the island's status saz a promoter of human rights and democracy, values president biden has vowed to put at the forefront of his agenda as he tries to block the rise of authoritarianism around the world, a trend very much led by china. >> our thanks to stephen jiang. the u.s. embassy in ukraine issued a security alert warning american citizens of what they call unusual military activity by russia near the border. it comes as mask troops have been mask and concerns growing of a potential invasion by russia into ukraine. fred pleitgen is with us. you've been spending time with the ukrainian mill stair. what are they telling you? >> reporter: they're extremely concerned about the situation in the east of ukraine, not just in the east of the country, but also the northeast of the country with the border at belarus. we have to keep in mind that alexander lukashenko also an ally of vladimir putin. near crimea and the sea of asaf. they said they understand down there at this point they are outgunned. they do say they plan to stand their ground if an envision does take place. the other thing they're doing that's very important, they're building a new naval base. the defense minister has just called for the construction of that base to be accelerated and to happen as fast as possible because the ukrainians realize they need to stage more ships out of there. this comes as the u.s. and ukraine believe there's up to 100,000 troops amassing near ukraine. satellite images seem to show that as well. a very concerning situation. the ukrainians do say they plan to stand their ground. >> a very worrying situation along that border. fred pleitgen, thanks very much. joining me to talk about these two major foreign policy challenges is david sanger, cnn political and national security analyst, also a correspondent for "the new york times." david, thanks so much for joining me. >> great to be with you, alex. >> i want to get into both of these big topics that very much has the focus of the biden administration. let's start with china. you heard stephen jiang say president biden had this virtual summit with xi jinping. in that summit he said any support of taiwanese independence would be what he called playing with fire. what do you make of president biden inviting taiwan to this democracy summit? >> frankly, alex, i don't think the president had a choice. if you have framed the issue as the future struggle is between autocracy and democracy and you don't take the one democratic element of china, even if you believe in the one china policy, and invite them, what message does that send about one's support for taiwan or for the future of democracy in china, remote as that may seem under the control of the current leadership of the communist party? i don't think he really had a choice at all. it is interesting when you look at the rest of the guest list, he didn't invite turkey, a nato member which has turned autocratic. he didn't invite egypt, a major ally in the middle east, only invited the israelis and the iraqis. just in setting up the meeting, he's had to create a good number of controversies with our adversaries and tensions with our allies. >> david, i want to turn to what we were just talking about with fred and russia and ukraine. we have been reporting that president biden is considering sending military advisers as well as weaponry to ukraine amid this buildup. of course, the u.s. does supply ukraine with weapons. what do you think the administration believes that vladimir putin's end goal actually is here? >> alex, you put your finger on what's the really hard issue which is figuring out putin's intent. there's one argument to be made he's putting people on the border to be disruptive, remind everyone that he could do what he did with crimea in 2014 but doesn't actually plan to take the risk and the sanctions reaction it would create of doing a further invasion. there's a second argument to say that, while the troops are there, what he's really planning to do is more kind of, short of war activity, like the cyber actions he's taken against ukraine in the past. you'll recall on two separate christmas-to-new year's weeks in recent years, the russians hired hackers to turn off the power in parts of ukraine. so that may be it. the third argument is that he really just plans to go do it, that he thinkts the u.s. demonstrated with afghanistan that we really don't have the stomach for this, that we didn't let ukraine into nato in the past seven years and won't any time in the near future and, therefore, there really isn't a commitment to go to ukraine's defense even if the administration says it's steadfast behind the ukrainians. >> so we know the two sides, the u.s. and russia, moscow and moscow, just yesterday the two top generals spoke with each other, in the case of the u.s., chairman of the joint chiefs david millie. this is not happening in a vacuum. they clearly saw the u.s. does not have an appetite forward through that withdrawal from afghanistan. so what is the signal that washington is hoping putin is going to receive if military advisers and weapons are being sent to ukraine? >> you'll remember during the obama administration we sent defensive weaponry, but president obama didn't want to send potentially offensive weaponry including anti-tank equipment. president trump did send those, and those have continued to flow since trump left office. sought i think the question right now is how do you balance further support for the ukrainians without giving the russians a pretense for some kind of deeper action? [upbeat music] the congressional house committee issuing the capitol insurrection has issued a new round of subpoenas. investigators want information from right wing extremist groups the oath keepers and the proud boys as well as their leaders. cnn's kaitlyn ponce is here in washington. kaitlyn, what does this select committee want to get from these groups and their leadership? >> reporter: alex, the house has been very aggressive lately in spending out subpoenas. in this particular group yesterday they had five subpoenas to groups and individuals that led those groups, this is the batch that hits at the nexus between the trump political world and actual rioters and groups that had rioters on the scene on january 6th going to the capitol orality rallies. so who was subpoenaed? it's the proud boys and oath keepers, two right wing groups we've heard a lot about, their leaders, enrique theriot and terry rhodes and robert patrick lewis, from a right wing first amendment group. why the committee is interested in all of these, the commonality between these is that all of these people were providing some type of security to the rallies before january 6th or even to vips around the trump political spear at the willard hotel up to january 6th. we know from them, too, that the justice department has looked really closely at tarrio and rhodes and the groups they're affiliated with, the oath keepers and proud boys and charged dozens of people in those groups with conspiracy for obstructing the congressional vote to certify the presidency. all of this put together, this is an aggressive move by the committee to seek information from them. but like all of these subpoenas that the committee has been sending out recently to them, to people like roger stone, alex jones, we don't actually know how much they're going to be able to get out of them because a lot of the people who have been subpoenaed are saying they might plead their fifth amendment right to not self incriminate themselves or they might not have document to turn over or they can't. we know enrique tarrio was in jail, so he might not be able to sit for a deposition. his lawyer said he doesn't believe the proud boys have documents after 2018 that he can turn over. >> interesting to see whether that shot across the bow, as we've called it, steve bannon getting these people to testify. katelyn polantz, thanks so much. thank you. a missouri man is now free after spending nearly four decades in prison for a crime he didn't commit. kevin strickland was exonerated 43 years after an all-white jury convicted him of a triple murder. cnn spoke to strickland this morning hours after his release. cnn's brynn gingras is joining me. what's strickland saying? >> he gets to spend thanksgiving with his family members. the 62-year-old set free after 43 years behind bars. as you mentioned, it was a capital murder conviction for a crime that happened in kansas city back in 1978. three people were murdered, a fourth person survived. that woman is the one who identified strickland being there at the scene, even though she made that identification a few days after the crime was committed, even recanted it several times, even tried to held set him free. he had a chance to go before a judge, testified on his own behalf. the judge threw out that conviction of life in prison. guess what, alex?
