it is the final chance to address what was a dramatic and controversial presentation from defense lawyers that some say evoked racist images. this is what happened in closings. first, the lead prosecutor argued the defendants initiated the encould nter with arbery an were not, as they claim, alkting in self-defense. >> all three of these defendants made assumptions. assumptions about what was going on that day. they made their decision to attack ahmaud arbery in their driveways because he was a black man running down the street. >> now, lawyers for travis mcmichael, his father greg, and william "roddie" bryan painted them as concerned neighbors, worried about reports of burglaries in the area, and they blamed arbery for his death. >> told you of the thefts, the totality of the facts, why he believed what he did. he wanted to follow him, talk to him, stop him, for the police to detain him. don't be fooled by this word arrest. you don't have to announce, "you're under arrest." >> why isn't mr. arbery asking for help? why isn't he calling out, "hey, somebody call 911? there's crazy people after me." maybe that's because mr. arbery doesn't want help. >> turning ahmaud arbery into a victim after the choices that he made does not reflect the reality of what brought ahmaud ark arbery in his khaki shorts, with no socks, to cover his long, dirty toenails. >> joining me now, cnn legal analyst and criminal defense attorney joey jackson. cnn senior analyst and former prosecutor elie honig. we'll get to the long dirty toenails issue in a moment. first, i want to address what we're going to see this morning, which is a rebuttal from the prosecution. what exactly is that, and why is it important that it is happening this morning? >> a rebuttal is the final word. it's the prosecutor's chance to address and, hopefully if you're the prosecutor, correct all the things the defense lawyers in this case, three of them, just argued. now, i think there is an interesting tactical advantage to the prosecutor to getting to go this morning. when i was giving rebuttals as a prosecutor, i liked to stand up immediately, before the defense lawyer hit the seat, and said, everything that guy said is bogus. however, there is a practical issue with the 4:30 p.m. rebuttal. you have a jury that's been sitting there all day. they're exhausted. they've heard more information than any human can process. they're probably thinking, i have to get to the supermarket. i have to feed my kids. it's 5:15. what's going on? now, they go hope and sleep. you open today adds the prosecutor. you get the final word. judge instructs them. they deliberate. the most recent thing they've heard is your rebuttal. there is a nice advantage there for the prosecutors. >> joey, i want to address what we just heard from the defense there, the long, dirty toenails for ahmaud arbery. that was from a defense attorney. i spoke to arbery's mother, wanda cooper-jones, overnight. the moment caused her to get up and leave the courtroom when that was said. listen. >> it was very, very disturbing. i thought it was very, very rude. to talk about his long, dirty toenails, and to totally neglect that my son had a huge hole in his chest where he was shot with that shotgun. i sat there for the last two weeks and let them dehumanize my son, who wasn't doing anything wrong the day that he chose to go for that afternoon jog. >> deplorable and most unfortunate tactic. listen, i get and understand the defense has a job to do, right? that's the job i do. that's the job we do as defense lawyers. the reality is, though, you have to thread the needle and thread that line. this was just outwardly and blatantly, in my view, racist. you want to talk about dehumanization? that's what it was about. you have to look at what she said in the context of her larger argument. her larger argument was about our neighborhood. an interloper coming in here. we had issues with our neighborhood. we had curfews. we were on edge in our neighborhood. if you ask me, she's speaking to the 11-1 split. let's address the elephant in the room. we know there are 11 white jurors and 1 african-american, notwithstanding the demographics of the area, 75% white and 25% black. i believe she was really amping that up and trying to wrap her client up in, he is one of you. do not convict. certainly, you want to have the notion of not convicting my client, but to do it in that manner, i just think it transcends the bounds of decency and is not what we should be doing. >> how does the prosecution deal with that in rebuttal, if at all? >> i think the prosecution will deal with it in outstanding fashion. i think the prosecution all along has made the argument this shouldn't have happened, didn't need to happen, there was no basis in it happening. not just saying that, grounding it in law. why? you talk about citizens arrest law. citizens arrest applies when you're actually seeing a crime or you have immediate knowledge of a crime. the defense has been arguing about things that happened the week before, two weeks before, the month before. no, it's about what happened now. what did the prosecutor say in her initial argument? the rebuttal is this morning. he was killed because he was a black man walking down the street. she'll say, "i told you so." the fact of the matter is when she talks about, the prosecutor, the issues of self-defense is not warranted, why? he wasn't engaging, ahmaud ar arbery, in any felony. they were the aggressors. this is part and parcel, the prosecution will argue, of an issue that didn't need to happen. it was predicated upon race. the defense lawyer told you so. they'll slam them. >> do you think the prosecution needs to address that controversial, some would say, deplorable comment? what else does the prosecution need to do? >> i agree. if the prosecution shows up well, they can turn it around. they can argue, you heard a lot of things from defense lawyers that was, i think, explicitly almost racist with the long toenails but also coded stuff with the neighborhood. there was talk from the defense lawyers about the panic, the worry, the concern of the people in the neighborhood, that their way of life was being threatened. you can say, that's why they overreacted, folks. that's why this was not a legitimate citizens arrest. they were not acting rationally, the defendants. they were acting unfairly. that's why they jumped to conclusions, getting back to the prosecutor's decisions. it's worth noting the grace of ms. cooper-jones. sitting through the trial, to see her son attacked like that, and put on the demonstration of grace she showed in the interview was remarkable. >> one thing i noticed in the defense yesterday that we hadn't seen directly before, three separate defendants here who have three different sets of interests. the attorney for roddy bryan at the end, in his closing, seemed to be suggesting, you know, my dl client is a different matter. my client was just filming it. in fact, you wouldn't know there was a crime if my client wasn't there. if i'm in the jury, i might be thinking, is this one of the defense lawyers saying the other guys are guilty? >> well, it is. the problem, john, is that that should have been dcapitalized a the outset. what you do as a defense lawyer or a prosecutor is you have a theme or theory. i thought the theory at the end resonated. my client had no intent. he was there in the neighborhood. no one knows him. he saw something happening. didn't have a gun with him. he didn't have a rifle with him at all. he happened upon a scene. he filmed it. he cooperated. what is he doing here? those guys did it. he didn't make an opening statement. had he put his theory out there, right, and repeatedly, every witness, "so it is fair to say, you knew my client came after the fact, right? you knew he filmed it. he cooperated with you. is that true also?" so if you have that out there as a longstanding matter, i think it would have been more effective than at the end, to say, "oh, by the way, he was just there." you know, we'll see how it rez n nate -- resonates at the end of the day. it was a lost opportunity. >> thank you both very much. we do have some new details that are coming to light about the suspected driver behind the deadly car ramming at a christmas parade in waukesha, wisconsin. the suspect was recently freed on bail following a domestic abuse incident. now, they say, maybe the amount was inappropriately low on the bail bond release. adrian broaddus is live from waukesha. what have we learned about the suspect? >> reporter: good morning to you, prixiabrianna. this was not his first interaction with members of law enforcement. according to a criminal complaint cnn obobtained, darre brooks, the 39-year-old suspect, was involved in some other incidents earlier this month. the criminal complaint shows a list of charges, including disorderly conduct and battery. the complaint also alleges brooks, quote, intentionally and without consent, ran another person over with his vehicle while they were walking through the parking lot. as investigators try to determine what happened, how that 39-year-old was able to drive along this stretch of main street, injuring nearly 50 people and killing five others, this community is trying to come to grips with what they saw and heard. >> one police officer asked me if i had something he could use for a gurney because they didn't have the ambulances here yet. i went and got plywood out of my garage. over here, they were trying to revive a woman. they needed plastic gloves. i said, okay, i got them. you know, latex gloves that i use for painting. i got them some gloves. i was ready to jump in. i'm cpr trained on that. i was ready to jump in, but i didn't have to. four of the five people passed away. one 2 feet away, 20 feet away, one up the block. >> reporter: many businesses along this stretch of main street, including the business owner you heard from, will remain closed until after the thanksgiving holiday. later this afternoon, the 39-year-old suspect has his first initial court appearance. the chief of police here in waukesha is recommending to prosecutors initial charges should include five counts of first degree intentional homicide. as far as his arelease stemming from those other charges earlier this month, that pbond the district attorney is saying was, quote, inappropriately low, it was set at $1,000. >> thank you so much for the very latest there. more trump allies subpoenaed by the house january 6th committee. what we are learning about roger stone and alex jones' alleged roles. plus, stunning, new video of insurrectionists attacking police as they defended the capitol on january 6th. what did you think of the film "the last duel"? >> lawmakers are targeting trump allies who were involved in the planning and financing of the stop the steal rally. what we're reminded about with this list is the fact that investigators are not just focused on the violence on january 6th, they're also focused on the days leading up to that, the messaging being pushed out, the money that was being raised, and how it was being spent. they're looking at potential coordination with congressional officials or folks in the white house. as you noted in terms of who is on the list, it includes dirty trickster roger stone and alex jones. in addition to steve bannon, these were three of the biggest voices pumping out these lies and conspiracy theories after the 2020 election. in addition, lawmakers targeted three other people, including rally promoters, jennifer lawrence -- not that jennifer lawrence -- and trump spokesman. to what end? they've sent out the subpoenas. what are they getting out of this? it is not expected these five people will roll up and share everything they know. it's expected to be a process. you can negotiate a way to maybe cooperate on some things or, of course, you can always show up. if you have any reasonable belief that you could potentially face criminal repercussions, you can plead the fifth. or take the steve bannon route and stonewall. as we saw, there were criminal implications for him taking that route. when you look at people like alex jones, roger stone, they'd wear it as a badge of honor. stone has convictions of lying to congress. we'll see how it plays out. the committee is asking for documents by december 6th. >> stockton and lawrence, not that jennifer lawrence, are in a different category that's jones and stone are. they've indicated some willingness to maybe talk. we'll see. the house committee also filing documents with the court, saying they need to see trump's papers now. what's the argument? >> so this is such an interesting case. the question is whether you have a right as a former president to claim a privilege when the current president, in this case president biden, says, "no, i'm not going to invoke privilege to protect your white house records." here, we're talking about trump white house records related to january 6th. the former president wants to block some of them, keep them from the committee. the current white house says, no. january 6th wuas an extraordinay circumstance. this is not what executive privilege was meant to protect. we see house lawyers arguing to the court she shoulthey should to wait until this is all complete to get the records. the attorneys would like this under seal until it is resolved, keeping with the litigation strategy. keep filing suits. run out the clock. all these questions go before the court of appeals next week. it is a historic case. really fascinating questions. so far, at least one federal judge sided with the house. >> it'll be a hugely interesting hearing, just one week away, which is quick as far as these things go. paula reed, nice theo see you i person. president biden is planning to release oil from the reserve to battle high prices, but he needs help from other countries to make a difference. >> the hope is there is. there is debate in the administration as to whether that would be a deterrent or escalation. that's why part of the question here is, do you send them into ukraine proper or to the region, right? the choice has been made in recent years for u.s. and nato partners to increase the military presence in and around eastern europe but not in ukraine. ukraine, by the way, is not a nato partner. there's no treaty obligation there. still, even to be close, right, is a notable and substantial message. >> could be both. that'll depend on russia i think. jim sciutto, thank you for the report. director ridley scott is pointing the finger for his recent box office failure. scott basically blames you. it's your fault, millenials, he said, so glued to their phones and reluctant to venture to the theater and experience matt damon and ben affleck in "the last duel." >> i think what it boils down to, what we've got today is the audiences who were brought up on these [ bleep ] cell phones, the millenials don't ever want to be taught anything, unless you're told on the cell phone. this is a broad stroke, but we're dealing with it right now with facebook. >> right. >> there is a misdirection. this has happened, where it's given the wrong confidence to this latest generation, i think. >> all right. he used a whole lot of words there, just threw them into one bucket to explain things, and i'm not sure it means what he thinks. >> so, brianna, when the fda advisers meet one week from today to look at merck's anti-viral pill, they'll be looking at efficacy and safety. i think there's going to be more discussion about safety. that's really because the efficacy is, as one doctor put it to me, quite dramatic. let's look at efficacy, then we'll talk about the safety in a sec. 762 participants, early stage covid, first five days of symptom onset. the folks with the placebo, 45 were hospitalized and nine died over the course of the next month. folks who got the drug, the ones who were lucky enough to get the drug, only 28 of them were hospitalized and none of them died. those are very, very dramatic results. here's the issue, this pill uses a somewhat uncommon mechanism. it actually goes into the virus' rna and stops it from replicating. that's good. you see the results that merck is reporting. however, there are concerns about off target effects. off target meaning maybe it might affect something in the human body's genetic system and not just the virus' genetic system. experts tell me we don't have reason to fear this, however, it is hypothetically true. some experts told me they predict the fda will say not to use this, for example, for pregnant women or to use it cautiously with pregnant women for fears of the effect that it might, and i use the word might very strongly, might possibly have on a developing fetus. >> still concerning because there are questions that need to be answered here. elizabeth, i also wanted to ask about studies showing booster doses produce more immune response than the two vaccine doses alone. this is good news for people who are considering their booster or who have already gotten this. >> that's right. right now, all americans 18 and up are eligible for a booster if you're at least six months away from your second shot. in other words, it happened six months ago. there's been a lot of debate. which is better, natural infection or a vaccine? this was a very small study. 33 people at northwestern university. the results were quite interesting. there are other studies showing similar results. so what they found is that a booster response, when you looked at antibodies, when you gave a booster, the antibodies went up 25 times higher than when people had just two shots. it was 50 times higher than when people had natural infection. i think it's becoming more and more clear, as many infectious disease experts said to me. this appears to be a three-dose vaccine. those exist. parents know that. this may not be a booster, it may be the third part of what will be a three-dose vaccine. it doesn't mean we'll necessarily have to get it every six months or every year, it may be a three-dose vaccine. we're not sure, but it is a possibility. >> really interesting. i'm getting my third dose then, as you put it, tomorrow. i cannot wait. elizabeth cohen, thank you. >> there you go. german chancellor angela merkel said the latest surge in covid infections is, quote, worse than anything germany has been through. she's calling for tougher restrictions to check the spread of the virus. cnn reporters are covering developments all around the world. >> reporter: in germany, the pandemic could force the worst-affected parts of the country to triage patients in the coming days. the president of the medical chamber warning there might not be enough beds to treat everyone. just over two-thirds of germans are fully vaccinated, one of the lowest vaccination rates in western europe. after reporting record high infection numbers in recent days, germany is tightening restrictions, limiting pub hick -- public access for the unvaccinated. >> reporter: i'm in vienna, outside austria's largest vaccination center where there is a huge rush of people waiting to get immunized. the operating manager telling us 20% of those here are getting their first shot. finally coming forward despite being eligible for months. across the country, hospitals are a different picture. an influx of covid patients. austria recording the highest seven-day incident rate since the pandemic began. if you hate getting emails from your boss after work, which is not me, eric, you can consider moving to portugal. the country made it illegal for your boss to text or email you after regular working hours. companies with more than ten employees could face fines if they disregard this rule, which is part of a new law regulating working from home. can you opt-in? >> luca chooses a very little tree that's about the size of luca. honestly, i wrote it in part because i wanted to, you know, try to raise semi-normal kids in this big city who don't just value lots of big material things. he told me last night, and i quote, bri, little trees are boring, mom. i want one that touches the clouds. so i don't think this worked for my kids, but i hope it works for your kids. >> i bet you one day the book about him, he will appreciate the moral of the book you wrote about him. even if he doesn't now. and i noticed -- look, i love the theme of the book, i really did, it was touching. he gets the little tree, then he hangs a baseball hat on it. we see two pictures with the hat hanging on it. where is the hat from?
