>> i just really like listening to the stones. i will agree with you, he says he's a great showman. i think that counts for something. i really enjoy it. >> that explains why you like me so much. >> we'll agree to disagree some of these things, john berman. and "new day" continues right now. welcome to our viewers in the united states and all around the world. it is wednesday, november 17th. i'm john berman with brianna keilar. the homicide trial of kyle rittenhouse spent seven hours deliberating yesterday. they asked for more copies of the written jury instructions. the judge gave the defendant a role in the random selection of the deliberating jurors. rittenhouse, as you see here, reached into this drum and drew numbered slips that picked the 12 jurors and six alternates. also, new information about how the defense approached the jury selection process weeks ago with the help of a jury consultant who worked on the o.j. simpson trial. she helped them build a profile for selecting, quote, the right jurors. joining us now anchor of "early start" and cnn correspondent laura jarrett. >> laura, we read tea leaves. >> that's all we can do. the only smoke signal we got is they want jury instructions. >> some first of all, these instructions are really dense and hard to read. even for somebody month practiced law, these are really, really hard. they're repetitive, and not in a good way. the fact that they want them is a good sign for the defense. you want to take it seriously. you want to go through it. you can't say he's guilty, throw the book at him. i think they want to go through it and be meticulous. we'll see where it goes. for now, if i was on the defense team, i would be happy they want to take it seriously, take their time. especially it seemed early in the day they were focused on self-defense piece of this and wanted to focus in on that. . >> what about the judge involving rittenhouse in drawing the numbers. i have never seen that. . >> never. >> does it happen? >> i have never, ever seen that before. i have also never practiced in front of judge schroder. people say this is what he does. it's not clear why he thinks it is helpful to have the defense do it. so the defense can't say there was any sort of objection to who was chosen. to me it seems part and parcel of this judge enjoying the show of this trial, having the moment of him picking out each of the names that then get dismissed. it goes along with the hype of the trial. there's no reason for the prosecution to object to it. usually you have a court officer pick them on it of the hat. >> joellen tkpdimitri has been working with the prosecution. >> she has been there every day. having worked with them in the civil context, let me tell you, they get paid a lot of money to convince lawyers they are essential for picking the right jury. whether there's any evidence that they can actually do that remains to be seen, especially in kyle rittenhouse's case. the jury is picked. her work is done. what she can do and i'm sure what she did do is help the defense to help with a great closing argument. she can say, here, defense team, this is the type of argument you want to make to these particular people. she will hand the defense team a thick binder with all of these people, anything they ever went through in their life experience that the defense can pull on their heart strings about. . >> these are the arguments that will help with the people sitting in that box right there. that's interesting. laura jarrett, thank you very much. now, to jury, the defense will begin calling witnesses in the trial of the three men accused of chasing down and killing ahmaud arbery. there was emotional testimony from the medical examiner who said the wounds were so severe nothing could have saved his life. martin savidge has been covering this story live. he joins us from brunswick, georgia. >> reporter: very detailed, both visually and with his own words and just talking about the power of destruction to the shotgun blast to the body of ahmaud arbery. that will leave a lasting impression with the jurors and everyone else who heard that testimony. the defense is expected to begin its case in the trial of the three white men accused of killing ahmaud arbery. . >> your honor, at this time, the state rests. >> reporter: they called 23 witnesses over 8 days of testimony. the day began with the georgia forensic pathologist who performed arbery's autopsy. >> did you have occasion to perform an autopsy on ahmaud arbery? >> yes, i did. >> what was his cause of death. >> multiple shotgun wounds. >> reporter: most too graphic for television. he described the injuries. >> did it break ribs 5 through 10? >> yes. >> all right. so all the reudzibs over here a broken, 5 through 10? >> yes. >> what happens when you break all the ribs on the right lateral side? . >> well, it -- it becomes difficult and painful to breathe. and also the inter coastal arberys are on that side so you would bleed into the chest cavity. . >> wander cooper jones looking away and at one point leaving. her son was chased by gregory somic michael and his son travis while jogging in a neighborhood in 2020. travis mcmichael shot and killed him. their neighbor, william roddie bryan, allegedly hit arbery with his truck. >> we're talking about the torso, gunshot wound. what was your revised opinion having now seen the video as to the muzzle to torso distance? . >> 20 inches to three inches. so three inches, but as far as away as 20 inches? >> that's correct. >> near casualty or close range? >> yes. >> reporter: he said while three shots were fired, arbery was struck by two. one in the chest, another in the left armpit. >> well, it was my opinion the shot to the center of the chest and the grazing gunshot wound to the wrist occurred at the same time, meaning that the hand was in front of the chest and was struck first, and then it entered the body. it was my opinion that the second shot was a complete miss and did not enter any part of the body. and the third shot involved the left chest and exit. >> reporter: after the shooting there was nothing medical personnel could do to save arbery. >> so the gunshot wound to this torso, was that a fatal gunshot wound? if he had never gotten this one under the arm, would the one in the center have killed him? >> yes. >> was there anything medical personnel could have done to save his life? >> they could have put an owe collusive on the defect. they couldn't do anything about the bleeding as long as the heart was bleeding. >> so -- in other words, is there anything they could have done on scene to save his life? . >> no >> reporter: they asked about plant substances found in arbery's wound and to explain how arbery was able to fight back after being fatally wounded. >> once mr. arbery had been shot in the torso right here, how in the world did he keep moving? . >> well, this is what it called the fight or flight reaction. when you run into a situation that is stressful or that you are afraid of or have anxiety -- >> i believe you testified on direct examination that someone in the fight or flight mode, when they can no longer flee can fight. >> i did, yes. >> you didn't see any evidence that mr. arbery could no longer flee? . >> no, i didn't. >> so there was nothing physically preventing him from continue to go run, right? >> reporter: kevin gough. >> we did file a motion for the interfering with a fair trial. >> reporter: this coming one day after he complained about civil rights leader reverend jesse jackson being in the courtroom. jackson didn't enter the courtroom tuesday, sitting with arbery's father in another room. his mother saying it will be tough to hear the defense present their case. >> it will be difficult. but at the same time i think if i just keep what happened the way that the prosecution presented it, i think i'll be okay. . >> and the defense will start picking up the case at 10:00 this morning. the real question is will any of the three defendants take the stand to testify on their own behalf? getting back to the black pastors in the courtroom issue, which has been haunting this trial for over a week, there is a protest planned for tomorrow. several hundred pastors coming from all across the country are expected to be here to demonstrate support for ahmaud arbery's family. . >> martin savidge, we appreciate you being there. keep us posted. a lot going on. >> let's discuss it all with attorney eric guster. thanks for joining us on what is a pivotal day in this trial. what does the defense need to do here some. >> well, the defense has to try to reach jurors and try to put them in the same position as their defendants. race is a central issue to this particular case. you have three white men who killed a black man and one was filming. they want to say he was breaking into houses and doing something criminal, and that's why they chased him. they want to get the jurors to believe he was doing something criminal and the men had the right to chase him, which led to a self-defense case. it's a tough uphill battle. all they need to do is to get a hung jury to live another day. >> it seems they have not proven their primary assertion, which these guys, concerned about crime, were going to do a citizens arrest. there was no mention of that. how do they deal with that? >> now it is time for the defense to put up the case. in their case in chief, i expect one of them to testify as to why they went and pursued him. when you have a self-defense case, it typically takes a defendant to testify that he or she feared for their life. they need someone to say this is what we saw, this is what we did and why we did it. i expect people from the community to come and testify that things had been stolen and they were afraid and try to put the jurors in their seats to say these people did the right thing, which of course i disagree with but that's what i believe they will do. >> there have been a number of black pastors supporting the ahmaud arbery family. it's been a big issue. the lead defense attorney made an issue of jesse jackson's presence in the courtroom. let's listen to this exchange between him and the judge in the case. >> your honor, i would submit with all respect to the reverend jesse jackson that this is no different than bringing in police officers or uniformed prison guards in a small town where a young black man has been accused of assaulting a law enforcement officer or corrections officer. >> then we get into what we have now with individuals coming into the courtroom. i will say that is directly in response, mr. gough, to statements you made, which i find reprehensible. i'm not granting a mistrial at this point based on these arguments that are being made. >> is this issue, you think, going to affect this case? >> that's correct. you know, without using a catch phrase, there is a silent majority here in wyoming. they are true conservatives. they believe in ethics and morals and humility. they go to the polls. that's where they express their opinion. they don't want to be harassed. there is a lot of anger and extremists. if you express an opinion that differs from theirs, they will try to embarrass you, harass you, harass you on social media. you might even get censured by the state party for speaking out. there really is a silent majority who still believe in morals and ethics here in wyoming. . >> do you think people are afraid? >> yeah. a lot of people have jobs, families, private lives. they will express their opinions when it comes to the polls. >> well, is there a risk then that the extremists, as you kau them, that they're winning? if people are afraid to speak up, isn't that handing these people who they want? >> within our state party and a lot of county parties across our state. in that sense, yes, they are winning as far as organized positionings. but they are not winning with the common voter. if they agree or disagree with representative cheney, they still disagree with this type of behavior. a lot of individuals here in the state. wyoming is a pro-trump state. president trump won by a large majority here in the state. but there's a lot of individuals that really do support the policies of president trump and support representative cheney. in that since, yes, they are oppressing the voice of the individual by creating fear and essentially a larger group of individuals that don't want to participate. . >> they support the policies of trump and cheney because they are largely the same, except in so far as it relates to overturning an election, right? . >> here you go with facts again. don't let facts get in the way of a good story. if you look at the voting record of representative cheney, even right now in congress, she is one of the most conservative voting members of the house. when president trump was in office, representative cheney voted along with president trump more than most of the individuals who are attacking her in congress. they don't get brought up very often because they're not convenient. as a true republican, that's what you look for. you want a representative that represents your conservative values and someone will vote the way the party wants you to vote overall with principles. that's what we see. and the voting record, you can't question it. >> the vote was 31-29. which is actually pretty close. a lot closer than the censure vote. >> i was surprised how close the vote was. this time around, 31-29, that is sending a message. there's fatigue on the matter. even the reasoning of why you would say someone is not a republican. they know you can't do that. there is no power behind the vote. that vote was extremely symbolic and sent a sign that enough is enough. >> republican joe mcginley. don't let anyone tell you otherwise. we appreciate you being on this morning. thanks for getting up. >> thank you. the qanon shaman will be sentenced. they are seeking a prison term of 51 months, the longest for any of the rioters charged so much. whitney wild has more on this. that is a long sentence as we look at these charges. >> that's right. if you put it in perspective, there is a reason sentencing that brings more clarity to that. for example, there was another man sentenced to 41 months. prosecutors asked for 44 months. brianna, that was for a crime of violence. jacob chansley not convicted of a crime of violence. this is meant to send a message to anyone with any inclination to attack the deposit. he is one of the most recognizable figures from the january 6th insurrection. soon the case against jacob chansley, also known as the qanon shaman, may serve as a bellwether. he became notorious after parading through the senate chamber shirtless, wearing bull horns, with a flag. it is only a matter of time, chansley wrote. justice is coming. chansley pleaded guilty to felony for obstructing the electoral vote count and spent the last 10 months in jail. even behind bars, he has generated headlines refusing to eat nonorganic food. and conducting a jailhouse interview with "60 minutes" plus. >> that is incorrect, inaccurate. >> prosecutors disagree and are asking for more than four years in prison, followed by three years of supervised release. that is one of the most severe requests so far. . >> they argue he was a leader and under the federal sentencing guidelines, you can get a sentencing adjustment upwards for somebody who is a leader. they argue he was literally a flag bearer for those that stormed the capitol january 6th. >> reporter: the department of justice charged 660 people. so far 131 have pleaded guilty, 35 sentenced, 15 headed to jail. chansley's case ushers in a new phase of punishments for higher-level defendants after prosecutors let them plea to lesser sentences. . >> coordination is essential for the justice department both in handling the cases sufficiently and in being consistent and making sure you are handling them fairly and in a way the american public trust and find credible. >> reporter: investigators comb through thousands of hours of video footage taken inside the capitol, as well as images posted on social media. the number of defendants only expected to rise. chansley's attorneys are asking for time served, brianna. he should be sentenced around 10:00 a.m. >> all right. we'll be watching. whitney wild, thank you. could an innocent man be put to death tomorrow in oklahoma? what led them to this. there have long been questions about julius's guilt. he always maintained he had an alibi. one of his co-defendants in this case accepted a plea deal reportedly later confessed to being the actual shooter. that man is now walking free after serving a 15-year sentence. there have been a lot of questions about julius's guilt in this case. so many that even the victim's girlfriend has testified on behalf of him on the parole board. she said they would not want an innocent man to be executed. >> and there are questions about his defense and whether it was even close to sufficient. >> that's one of the big issues, did he get adequate legal defense. at the time it was being prosecuted, he was being prosecuted by one of the deadliest district attorneys, meaning one of the people who sent more men to death row. and in the face of the district attorney, he was presented with a defense attorney that did not cross-examine witnesses, did not present a defense. the fact that most of what they said was the defense rests. that was pretty much the spirit of his defense on a capital murder charge. so that's one of the big reasons that so many have now spoken out saying that even if there are questions that the sentence should be commuted from death to life. because you cannot undo an execution. >> so tell us, because i know you have been in frequent contact with the family, what they are saying to you. >> i spoke to julius last night. even though we are one day out from the scheduled execution, he has a tremendous amount of faith that the governor will step in and stop this. he is aware of the media attention. he said he spoke on the phone with kim kardashian. and he continues to be adamant about his innocence. and that is where he got very emotional. he began crying on the phone with me. and he said that he wants people to know that he is not a murderer. he also has a tremendous amount of empathy for the victim's family. he believes they deserve justice. and he said he wants justice for them, but he said he is not the man responsible for taking their loved one. >> kim kardashian brought pressure successfully in many other cases. how is the governor weighing this decision? >> it's interesting because we are running down to the last minute now. sororitiedly, he is said to be praying and seeking spiritual guidance on this. he has met with the victim's family, attorneys on both sides. he has met with some religious leaders. but he has refused now to meet with julius's family in person. they went to his office. they showed up. and a representative from his office said he would not be meeting with them. whatever counsel he is seeking, he's weighing and making this decision, he has refused to meet with the family at this time. . >> we'll be watching carefully. he is scheduled to be executed tomorrow. so this is coming up very quickly here. mara, thank you for that. . >> thanks, brianna. >> still ahead, how a woman who spreads election lies could oversee elections in michigan. >> and the partisan divide over vaccines. i'm not just talking about the covid vaccine anymore. this mania is spreading. what happens if you ever need to miss work for a long period of time? -easy? switch your xfinity services to your new address online in about a minute. that was easy. i know, right? and even save with special offers just for movers. really? yep! so while you handle that, you can keep your internet and all those shows you love, and save money while you're at it with special offers just for movers at xfinity.com/moving. huge potentially dangerous side effects from the anti-vax movement around the country. we see it every day with the covid vaccine. but now it is clearly seeping into other measures that keep us healthy. joining me is cnn senior data reporter, harry enten. we are seeing it in really troubling ways with the flu shot. >> we are, john. this is something that a lot of us would be looking at whether or not of the partisan divide would seep into other vaccinations. you can see it here. have gone or will likely get the flu vaccine. 68% of democrats, 44% of republicans. that is a 24-point gap. look at some recent flu seasons before the covid pandemic. you can see the gaps in 2019, 2020, four points. what you see here is democrats are now more likely to get the vaccination at 68%. look at that. higher than 58, higher than 55. republicans less likely. . >> it's spreading. it getting worse. >> they have been tracing this the last few cycles. we are talking about children, pregnant women. you can see this flu season 2021-2022, 34% of children compared to two years ago. 41%. pregnant women. now 41%. two seasons ago, 58%. >> in terms of measles and the normal vaccines yet -- >> we don't know yet. >> there is a correlation with people who are reluctant, hesitant or covid vaccine deniers. >> look at this. have gone or will likely get the flu vaccine. i should point out other data suggests it is even higher than that. look at that. just 17%. i should point out again this is higher than some of the other data which suggests a larger spread. you can see it very, very well. if you have gotten the covid-19 vaccine, you are likely to get the flu vaccine. if you haven't, you are not likely at all. . >> we have new data on the deadly partisan divide when it comes to the vaccine. >> we do. again, look, we know fully vaccinated adults by the 20th result. the average state that biden won, 75% of adults are fully vaccinated. the average state that trump won, just 62%. now, we could jump a little forward here and essentially give you an idea how much has this actually mattered. you know, essentially if we look here, covid-19 deaths per 100,000. since february 1, in the states biden won, 78. in the states trump won, 122. look at that. biden states, far fewer deaths. look at that. . >> and you just see it in the unvaccinated states, more people are dying. >> you know, i don't know if we can be clearer than that. the 25 most vaccinated states since february 1, 80 deaths per 100,000. 25 least vaccinated states, 119. before february 1, there was no gap between the 25 most vaccinated and 25 least vaccinated states, which you might expect because it wasn't fully in the population yet. but since that point, a clear spread with the most vaccinated states clearly seeing fewer deaths than -- fewer deaths than the least vaccinated states. it is clear the vaccines are working. we see it every way we look at this data, if you get the vaccine you are less likely to die. that is the goal. >> i imagine as far as the unvaccinated people who are dying. >> yes. the aggregate is mostly unvaccinated dying than unvaccinated. . >> these numbers should tell people everything. >> look, i study politics and stats for a living. there's a lot of things that make sense. not getting the vaccine doesn't make any sense. it can save lives. you see it here. you look at the data. >> thank you very much. >> we're going to take a look at how close the u.s. came to a coup in the last days of the presidency. her daughter is the sole survivor of a plane crash thanks to her husband who protected their daughter in his final moments. they will share their story next. >> lany is doing amazing. she is walking and talking. she is cracking jokes. when she came in, she was -- they didn't know her name, to they gave her the name orchid. and it means you can bloom anywhere. and she really is blooming in the hospital. so we're so proud of her. she's keeping us all going and she smiles and we all just get strength from lany. >> it is amazing to hear she's doing well, that she's in good spirits and she's talking to you. what has she been able to tell you about that happened? >> her memory is coming and going, when we anticipate, but she is -- her last memory, one of the last things she remembers is just being hugged really tight by dad and mike, if you knew him, gave the best big bear hugs. and so we just know that he just -- we anticipate he probably saw something was going wrong and just hugged her and squeezed her as tight as he possibly could, and, you know, a lot of her injuries are mostly on her left side and we think maybe she was, like, snuggled in on dad on the other side. so in my heart of hearts i know that he truly did save her. and he protected her. >> and i imagine that gives you a lot of comfort, you know, even as you're mourning his loss, you know. he's been taken from you. but he saved your blessing. >> he did. it was such a day, it is a miracle and tragedy all in one day. it is hard to balance all those emotions. but he would have -- i know that he would have jumped in front of a bus for her. so not surprised at all one bit if you knew mike that this is what he did, and he was just such a beautiful human and loved his community and he loved beaver island and just i'm not surprised at all that he did that. he sacrificed and he was her hero. >> what are authorities telling you, christie, about what happened at this point? >> truthfully we haven't talked much with the authorities at this point. but the airline has been in business for 76 years. and i have flown on that airline since i was 3 days old. so we just -- we know this was just a tragic, tragic accident at this point. and we don't know details. but such a loving and important business for the island, and we know that we'll have answers some day, but we also know that it was just a tragedy. >> so your never husband expressed any worries about flying? this was something he regularly did? >> oh, my gosh, never. we would jump on planes left and right to get to the island. it was his favorite place in the world. he never hesitated one bit. in fact, he would take -- i have -- i was going through all my pictures and i have all these pictures of mike as he's on the airplane because he was, like, so excited to get to the island, he would start taking pictures. he was a big picture guy. he would take pictures on the airplane and on the way over and so never once, we never once. as you look back on memories, we actually considered sending lany for her first flight over that day by herself actually, and to go see a family friend and stay for the weekend, and mike just said, i think i'm going to go with her. i think i'll go a day early, go with her. so just, you know, how life works, but he was with her. and that was really important. >> and thank god he was with her. and, you know, he sounds amazing. we know he's a good hugger. >> so great. >> we know he's a good dad. >> he's a great hugger. >> can you tell us a little bit about mike, how you want him to be remembered? >> you know, well, first of all, i have to say he loved baseball. so if anyone knows mike, you know he loved baseball. he loved his family and his faith and he was a really great human. and he loved to have conversations with people and talk about beaver island and his kiddos, and he just -- he loved so deeply and showed people that love, and he was just an amazing human being and will spend the rest of our life just honoring his memory and i have two little boys, two twins, bo and hendrick, they're going to know him and they're going to love him and they're going to get bear hugs from our entire community because we're all grieving, we're all grieving mike. it is two communities, actually. dallard and beaver island, we're all grieving. we'll take it one day at a time. but his memory and his love and his strength will get us through. i just know it will. >> i know you're going to keep his memory alive, certainly when it comes to your children over the years here. what are you going to tell them that you miss most about him? >> oh, well, so, he's a calming presence. he was always such a calming presence. and i might not be the most calming presence, so it was a good balance. he could help us all just relax and in any situation he would, like, crack a mike joke or just kind of bring us all back to earth. he -- there are so many things that will be missed. but when i look back on our last text, the last thing i said to him was headed home. and i feel like he's home now. it is a different home than what i thought, but he was headed home. i know he's with our god and i know he's safe and i know he's protecting us, i know his hand is on our shoulder as we walk through this crazy journey. >> well, christie, we are so sorry. i'm sure you heard from so many people who are so inspired by what your husband did. and i hope that gives you -- i hope that gives you some comfort as you enjoy lany and she hopefully has a very speedy recovery here. so thank you so much. >> thank you. >> for sharing your story about mike with us. >> thank you. thank you for including us and for helping us to share this amazing story. and i just want to thank everybody who has donated and sent letters and cards and lany reads every card. she loves it. and it gives her such strength and i want to thank everyone at the hospital. and everyone in the world. and all the dads out there who sent us notes that, you know, the dad and daughter story. thank you, all. it means so much. it lifts our spirits. >> and before i let you go, i want to make a note, because i know our viewers are going to ask, you have a go fund me called prayers for perdues and that is up. i know that is something that is greatly assisting your family and so, you know, hopefully that's something that may be reaching out to you with. christie, thank you so much. >> thank you. thank you. thank you so much. >> he was a good hugger. i have to say,
