i'm john berman alongside brianna keilar on this "new day". the jury is about to reconvene in the trial of kyle rittenhouse. a verdict may not be far away. sorry, not sorry. that is from fan of violent anime paul gosar hours before the house is set to vote on censuring him. and a diplomatic boycott of the 2022 olympics. and my pillow guy saying to meltdown to make prison bars. and you'll never guess who is endorsing the idea. a very good morning to our viewers here in the u.s. and around the world. it is wednesday, november 17th. we are on verdict watch this morning. the jury in the kyle rittenhouse homicide trial reconvening in a few hours after seven plus hours on tuesday. the seven women and five men have already requested more copies of the written jury instructions. >> in an unusual move, the judge gave the defendant a role in the random process of identifying which jurors would actually deliberate. you can see it right there. rittenhouse reached into a raffle drum and picked 12 jurors and 6 alternates. and now the defense approached the jury selection weeks ago with the help of a jury consultant who worked on the o.j. simpson trial. she helped to build a profile for, quote, selecting the right jurors. shimon prokupecz joins us live from kenosha, wisconsin. what's the vibe there this morning? >> reporter: things right now so far, everyone is getting ready here. i can tell you that the jury will be in the deliberation room, in their jury room with all 36 pages of the jury instructions. after requesting late in the day yesterday, they requested all of them. the morning, a few hours after beginning their deliberations, they asked for the first six painless of the jury instructions. now, that has to deal with the death of joseph rosenbaum. it had to deal with the self-defense law, and also the instruction on provocation. later in the day, they asked for the other instructions that have to deal with the two other incidents. remember, prosecutors and defense had laid out a timeline of events. it would seem at this point that is how the jury is approaching and making their decision. as you said, they come back in about two hours or so. they will be back in the jury room. now, as to this new information we have about this jury consultant, joellen demetrius worked on the o.j. simpson case. interestingly enough, i have been in the courtroom 6th day. she has been present in the courtroom every day. in fact, sitting next to kyle rittenhouse's mother, consoling her at times. when rittenhouse was testifying, she had her arm around his mother as she was crying. she's been present, she's been in the court every day talking obviously to the defense attorneys. but seemingly seems to be very close to the family as well, john. >> very interesting. these jury consultants often talk to legal teams on how they should approach the case in ways that would appeal to certain jurors. shimon, thank you very much. please keep us posted. could be a very big day there. >> the prosecution has rested and this morning the defense begins its case in the georgia trial of the three men charged with chasing down and killing ahmaud arbery. prosecutors concluded with testimony from the state medical examiner who performed the autopsy on arbery. jurors were shown graphic x-ray images of the wounds he sustained from shotgun blasts. >> you see shotgun pellets on the lower portion of the chest, right lateral chest. shot gun pellets in the left chest and shoulder area. . >> was there anything ems or percent could have done to save his life from the torso shot? . >> well, they could put an owe collusive dressing on the large defect. but you would still have the exit defects in the pack of-- bk of the chest. and they couldn't do anything about the beating, as long as the heart was beating. >> in other words, is there anything they could have done on scene on save his life? >> no. . >> arbery's mother said the state presented a strong case and she is waiting to hear what the defense will say. and gough filed another motion renewing his complaint of the presence of black faith leaders in the courtroom saying it could influence the jury. new details about the attack on democracy from donald trump and his inner circle. a defense department official previously worked under him, he called and said we need you. flynn urged that he needed to get orders signed, that ballots needed to be seized and extraordinary measures needed to be taken to stop democrats from stealing the election. joining us is david fromm, former speech writer for george w. bush. he has a fascinating new op-ed called "steve bannon knows exactly what he's doing." this is the headline everyone is talking about. you had flynn fresh off a pardon making this appeal. . >> yeah. >> what do you make of this? . >> i think we are treating this attempt as if it happened in secret and we are only learning about now, rather than something that happened on television. a hurricane blew through your town. it is interesting to hear about the damage after on 123 maple lane. we were out there. we saw it happen. we saw the president himself, never mind the disgraced officer. he said i need the 11,000 votes to change the outcome of the election in your state. we saw a mob trying to get the vice president to do something he can't legally do, overturn an election. and the president cheering the mob on to this day. i would encourage people not to go hunting for new revelations. you have in your hands and have for months everything you need to know. >> i don't disagree with you there, david. but there are, in some of these new revelations, things that describe to us just how outer space insane things were behind the scenes. jonathan carl reports sidney powell, who was giving legal advance to the white house, in the building where the u.s. is run, was concerned or asking the defense department to rescue gina haspel who she believed had been kidnapped and was in germany. i'm not even sure i understand the details. . >> seemingly ripped from the onion. but it happened, he reports. >> understand sidney powell, this goofball freelance lawyer, and the disgraced national former were not goof balls but people who had power. emphasizing the kind of exotic elements of the story risk distracting our attention from the core elements of the story which happened on this network, which everybody saw. the president was the center of the story. i think one of the things that has happened in the trump years, and we're still living them unfortunately, is people couldn't process that there's no secrecy. there's no coverup. there never was. in the trump years, there was no coverup. the president would tell a tv interviewer, yes, i fired the fbi director to shut down an investigation of my connections to russia. well, i guess if he admits it the story is over. we had no way to cope with the fact that, yes, he aadmitted it. you saw the mob. you saw the president egg it on. it all happened in front of your eyes. you need not new information. what you have is sufficient. >> we saw steve bannon go to the courthouse and seemed gleeful about it. >> he ya. >> in the op-ed you said this is exactly what steve bannon wants. but you said you have democrats in congress playing a legal game. he is playing a political fame, and it might be more powerful. >> i think this is, i guess, a reflection of what i was saying just now. if we can show you have defied a lawful subpoena, something has to happen, right? and this is -- this character who is like rock music video turning over the table, kicking the peaen know player, gnawing over the person in the wheelchair and say what are you going to do about it? not only did it do it in plain view ill do it again. his strategy is i don't respect all of this. i don't respect any rules, any process. you can accuse me of violating the process. i don't care. .. remember when kellyanne fitzpatrick, who is the president's counsel, was ought on her 11th violation of the hatch act, she was confronted by a journalist and said when does the jail sentence start. meaning, i know i broke it. i don't care. what are you going to do? . >> so what's the consequence of that, david. because i agree with you. steve bannon doesn't care if he is convicted of contempt of congress. he would end up in jail for a month and for entertainment value it would be the best thing that ever happened to him, even if it's in violation of the u.s. law. why does it matter bigger picture and what could or should be done about it? . >> i'm going to turn it pack to the people watching right now. in the bible god asked the question, who will go for us? and isaiah said send me. someone will do the job of protecting the american democracy for you. maybe it's special counsel mueller. maybe it's someone else. it's you. it's just you. you, your friends, your neighbors. because these are not -- there are not a few people operating in clandestine secret. the former president of the united states, likely next nominee of the republican party, backed by a quarter or third of the country. it is a challenge of the american democracy. and the legal system can't cope with a threat posed not by a few law breakers but a quarter or third of the country. . >> they seem to have a clear mission. what is the counter measure to that? morning, we expect this debate will begin in the house of representatives to censure representative paul gosar, the highest form of rebuke in the house, and he also the house committee on natural resources. this is not an unprecedented step. of course democrats have reviewed other republicans, representative marjorie taylor greene, from her committee assignment. but it is a good reminder that democrats are taking this very seriously. yesterday, after a republican house conference meeting, representative gosar came out and said he did not apologize privately to his colleagues. he had removed that video. you he said instead this. >> i did not apologize. i said this video had nothing to do with harming anybody. that's exactly what you're talking about. it's an anime. we were trying to reach out to the newer generation that likes these cartoons, fabricated in japanese likeness to actually tell them what is harmful in this bill that they're missing. >> reporter: and because of the violence in this anime video, we are not going to show the full video. but one thing to keep in mind here, steny hoyer, leader of the house, democratic caucus, told me yesterday, told reporters on a call that this was one of the most vial and violent things he had seen in his 40 years in public service, brianna. that's why democrats are taking this step today. that is why democrats think they cannot be silent. they are arguing they wish kevin mccarthy would have taken this own step for his member. they said they would do it if the vacuum is left by mccarthy. >> look, it is objectively messed up, just to be clear. it is unacceptable. but also another big thing developing there on capitol hill, lauren, is the price tag for the build back better plan. democrats are expecting a cbo score. they have worries about that. tell us what the worries are. >> reporter: a lot is riding on this score. a lot of democrats are undecided on whether or not they're going to support the build back better plan. this is one of the president's key agenda items on capitol hill. it's a huge moment for democrats as they are bracing for the fact that this cbo score may come up short, specifically on one provision, which is irs tax enforcement. democrats are including money for the irs to go after people who have not paid their fair share in taxes. one of the differences of opinion is the fact that the white house thinks it raises more money than the cbo expects it to make. they have been preparing members for this. they have been having private conversations with moderate democrats for which they think this might be a problem for them. some democrats have been convinced. the representative from the state of oregon said it would not be a deterring factor to vote for the build back better plan. but elissa slotkin told me yesterday they are still undecided. and they are really going to be looking and portion over the score before they make a decision. a vote could come as soon as tomorrow. maybe it slips into friday. but a lot riding on that cbo score, brianna. . >> certainly is. lauren fox, thank you. so it turns out job growth has been significantly higher than government estimates for most of 2021, including a four-month period this summer which produced more than 600,000 more jobs than initially reported. cnn business reporter matt egan joins us now. we always have backwards revisions. about you this is something completely different. >> yeah. john, first off, this is good news because it men's the economy is stronger than we first thought. the sizes are staggering. this is like if you asked me what time it was and i said 6:20, but got the a.m., p.m. wrong, totally off. normally pre-covid, it was 30,000 per month jobs. that's the difference of what it was. now between june and september, the government underestimated job growth by 150,000 per month, five times the pre-covid average. those are the green bars. you can see it increased the amount of jobs that were added. 626,000 more jobs were added than initially forecast. we haven't seen that since the government started tracking in 1979. this is a tricky task in a massive economy and that's under normal conditions. we are not in normal conditions. covid set off all these shock waves. people lost their jobs, hired back, dropped out of the workforce, they're quitting their jobs. labor officials said this shows the system is working because as more information came in, theyup d -- they updated their figures. as we see the job numbers the first friday of the month, they will change dramatically. >> people arguing it was sluggish when it wasn't. it was strong. people arguing the spending the government was doing was deterring people from entering the workplace. it wasn't! they were. it reframes the entire thing. understandable given how the pandemic largely broke the way we measure the economy. let's talk about the now. because, yes, inflation is something hitting people hard. every day people have to teal with higher prices. however, there are more and more signs that come in everyday that the economy, by most and many measurements is doing well. . >> that's right. maybe some of the gloom and doom is overdone. first of all, the stock market, near record highs. job growth in october was really strong. it dropped to 4.6%. remember, it was nearly 15% in april of 2020. also, americans are quitting their jobs at a record pace because they are so confident that they can get a better job that will pay them more money and maybe with more flexible working conditions. also, we just learned yesterday, retail sales soared in october by 1.7%. little context, that is twice the pace of september. it's actually the best month since march back when stimulus checks were being handed out. it is a confusing time, though, when with we think about the economy. consumer sentiment down to a 10-year low. "washington post"/abc news poll said 70% rate the economy negatively. i think a lot of this has to do with inflation. consumer prices up in october by the most since 1990. people are worried about higher gas prices, food prices, clothing, used cars. you name it. a lot of people have never lived through a period like this. some are worried this will be a repeat of the 1970s runaway inflation. of course we're nowhere near there and economists don't think it is in the cards. another reason why inflation is here is demand is so strong because the economy has come back faster than most people thought was possible in the spring 20th. . >> people have money they want to spend. disposable income. these prices still hit people very hard. . >> especially low-north carolina. new violence erupting along one of europe's key borders as the situation turns even more desperate. cnn right in the middle of it. the mayor of washington, d.c. announced she is lifting the city's indoor mask mandate. why the would you say says they are still going to mask up. the sole survivor of a plane crash protected by her father in his final moments. her mother will join us live. what's strong with me? what's strong with me? what's strong with me? what's strong with me? with me! with me! what's strong with me? with me! with me. [gaming sounds] [gaming sounds] [gaming sounds] just think, he'll be driving for real soon. every new chevy equinox comes standard with chevy safety assist, including automatic emergency braking. find new peace of mind. find new roads. chevrolet. this morning, right before our eyes, the humanitarian crisis at the poland/belarus border is turning violent. desperate migrants fighting for their lives, trying to overrun guards to make it into poland and beyond. all of them have been pushed back by water cannons. matthew chance is at a refugee reception center now in belarus. matthew, why tonight you explain what happened. >> reporter: hey, john. yeah, you remember those really desperate scenes that we've been reporting from the camp on the border in the freezing conditions. there's very little in terms of facilities. that camp is being slowly emptied out by the belarusian authorities and they are bringing the migrants here to this huge facility a mile back from the polish border. it is indoors and heated, which is a massive upgrade to the situation they're in. and people are being given blankets, big duvets, pillows, new clothes to keep them warm, one hot meal every day. and this hot tea and bread being given out and biscuits and things like that. it is a much better situation for these migrants than the one they were in previously. now, of course, you know, the belarusian authorities have been accused all along of orchestrating this crisis to put pressure on the european union and exploiting these vulnerable people for political ends. but you have to remember this could have been done earlier. they could have set up this facility earlier. they didn't have to push them right to the border. that is circumstantial evidence if you would like about the culpability of the belarusian state. the big question now, of course, is, you know, what's going to happen to these people? because they are still being told there's a possibility they could two to germany and enter the european union. but there's been no indication by the poles that they will open the barricades. belarus has said that decision in germany has not yet been taken. the fact is if they are not given a passage into the european union they will most likely be deported back to their country of origin, which the majority of people say they are from iraqi kurdistan. >> what's their plan, matthew? >> that's right. the reason why, there is more examine more evidence that immunity wanes six months after you get your second shot. there has been reporting of this data and the data has changed of time. it has come from places like israel, where they have a lot of experience and keep very good track of these kinds of things. immunity wanes and also cases are going up. let's take a look at a map of the united states. you can see here that 21 states are in red. red is bad. red means the cases are going up. yellow means they're stable. green means they're going down. and if you take a look at the nation as a whole, if you put all of this together, if you look to the far right, it is going slightly up. it was just the end of october we said finally, after the summer of delta, the cases are finally going down the end of october. now we see them going back up. you see this call for boosters. we will hear from the fda today or tomorrow and the cdc on friday. >> some places are doing better, some places doing worse. they are all different approaches as we learn more and more people get vaccinated. d.c., the mayor of d.c. announced they will lift the mask mandate indoors on monday. what does that tell us? >> so that tells us that some places are feeling like they are able to do that. here's a little twist. the white house is saying we are keeping our mask mandate even though we are in the district of columb columbia, even though we are in the city. really at the end of the day cities can do what they want. plates of employment and other places can also do what they want. and they can say, well, we're going to listen to the cdc, which is what the white house says, and keep our mask mandates. dr. fauci talked about a mixed bag of cases. i think we will see a mixed bag of different requirements. >> file that under news for brianna keilar. elizabeth cohen, thank you very much for that. . >> thank you, elizabeth. american officials may be absent from next year's winter olympics in beijing. the biden administration considering a diplomatic boycott of the games in rights to china's human rights abuses. joining us is the reporter who broke the story. josh, you're further along on this. you say this is very much under way, this announcement. we are reporting there is no consid conclusion but this is under consideration. >> reporter: within the next couple of weeks, the president will approve the consensus of his senior staff to implement a diplomatic boycott of the beijing olympics. it is a serious move with beijing's genocide of uighers. it's a move that was supported by people like nancy pelosi and mitt romney. it's kind of a half measure. it's a compromise. it won't back the activists calling for a full boycott completely happen and won't satisfy the chinese communist party which doesn't want any mention of its genocide at all. but i think for the biden team, it's a way they can signal they're standing up for human rights. at the same time they're not completely boycotting the games like jimmy carter did in 1980. this sends the message that beijing won't be able to burnish its legitimacy without somebody mentioning the fact that there is genocide going on there. >> it sends the message. how is the message received by china?
