the final 12. prosecutors painted rittenhouse as an armed vigilante who provoked the violence, while the defense portrayed him as a frightened teenager who feared for his life when he shot the three men. take a listen. >> you cannot hide behind self-defense if you provoked the incident. if you created the danger, you forfeit the right to self-defense. >> every person who was shot was attacking kyle. one with a skateboard, one with his hands, one with his feet, one with a gun. hands and feet can cause great bodily harm. >> cnn crime and justice correspondent shimon prokupecz is outside the courthouse in kenosha. there are some procedural steps this morning and then the jury dives into deliberations. explain how it plays out. >> reporter: right, the first order of business here, jim, this morning is getting the 12 jurors seated. the final 12 jurors that are going to decide kyle rittenhouse's face. that's the first thing the judge does this morning. as you said, there are 18, they need to pick 12 for the final decisionmakers. once that is done, the jury moves into the deliberation room. they will be handed a verdict sheet, 14 pages, and they will go through sheet by sheet of the charges against kyle rittenhouse. some of those charges as you said having to deal with first degree reckless endangerment charge, the most significant charge here obviously is that first degree intentional homicide for which he faces life in prisonment. the judge yesterday agreeing to put two lesser included charges as part of that. that has to deal with the death of anthony huber. there is also, of course, the charge that has to deal with joseph rosenbaum. and then the surviving victim, gaige grosskreutz, that attempted homicide charge. so all of that is for the jury to decide, but the big thing this morning is to get those 12 seated so the deliberations can begin. it was a long day for the jurors yesterday, the longest day they had since this trial started. certainly you can see some of them getting tired as the defense attorney and there was rebuttal from the prosecution. today they come in, all fresh, and ready to work, jim. >> fresh and ready to work. shimon prokupecz, thank you. also with us, a criminal defense and law enforcement policy expert, host at the law and crime network. bob, good to see you this morning. as we look at what and listen to what we saw and heard yesterday, w who do you think had the stronger closing argument? >> stylistically the prosecutor did a great job. and i've been very critical of the prosecutors for some ethics in my opinion, violations. but he really put it together well for what he was trying to position. the defense lawyer got out with the defense lawyer needed to get out. but it wasn't stylistically as good. what the lawyers say in opening and closings is not evidence. the evidence is what came out on the witness stand. i would like to see the defense do a little bit more with what they had, because they had a lot to work with. one thing he did very well was talking about the rush to judgment. as a homicide prosecutor, myself, i've never charged so quickly had they didn't have all the evidence, the autopsies hadn't been concluded, witness interviews hadn't been done and he used that, we know this as prosecutors, don't give the defense an opportunity to use a rush to judgment as a reason for why the charges were brought. so he was pretty effective in that aspect. >> bob, let's talk about the law here. a key argument is this question of self-defense. that is the central argument of his defense attorneys, the prosecution in the closing arguments really hammering home this idea you can't hide behind self-defense if you created the dan danger. if you put yourself there, a 17-year-old traveling from out of state, tell us how the defense responded to that argument and where you think the standard lies in this case. >> great question, jim. i don't think the defense responded to it well. but the jury charge that i have in front of me right now does. what is very clear with regard to this issue of provocation and what that means is you can't provoke an attack and if you are -- if somebody responds to it, you have an opportunity to kill them. what this jury charge says is that the defendant had to engage in unlawful conduct that was likely to provoke others to attack him and who does provoke others to attack him and on top -- which really aren't the facts of this case. the facts in this case were he was being pursued. the prosecutor wants to argue because he brought a weapon, which many people have weapons out there, and, remember, this is wisconsin, not like in new jersey or new york, where the gun laws are so strict, that that was the provocation. but then even further in the jury charge, jim, it says that even if you're the initial aggressor, you provoke the attack, somebody confronts you with deadly force, you have a right to protect yourself. i don't see -- it is good the prosecutor got that in there, but there is a way that the law reads this jury, i don't see it applying to the facts of this case. >> thanks so much. so many questions resolved. we'll do what we got to do, watch the trial as it plays out. also breaking this morning, incredibly dramatic scenes, these unfolding at the border between belarus and poland. as tensions escalate between migrants and polish forces. keep in mind those migrants pushed by many accounts by the belarusian government. >> cnn's cameras catching the moment at the polish border when polish border guards used tear gas and water cannons on migrants on the belarusian side of the border. matthew chance was right in the middle of that chaos. take a look. >> being disallowed from getting back and getting into the european union. have reacted angrily. they started throwing stones. we're being blasted by water cannons from the polish side. tear gas has been thrown as well. >> you see it as it is unfolding there, hearing from matthew, matthew chance joining us live there on the border. migrants told you over the last several days they're fighting to stay alive. walk us through where we stand this morning. >> reporter: yeah, i was just drying myself off a little bit and warming myself up with these migrants here after the drenching by the polish water cannons earlier today. that situation has calmed significantly. you can see the migrants have decided to settle down here outside that border fence on the belarusian side. put the violence that ravaged this part of the border earlier today was really, really significant. you can see there is a hole in the border fence over there, where children are now playing. we're just back from there a few yards you see the polish border guards still standing on patrol, the other side of the fence. we saw migrants throwing stones, throwing sticks, running towards those polish guards, it was a kind of anger, frustration that boiled over after spending more than a week in these terrible conditions inside the camp. the worst of the violence took place over here, the main border crossing, between belarus and poland. here we saw incredible scenes of angry young men, migrants, running towards the barricades over there, which were manned by polish security forces. you can see the blue water cannon trucks still there. they were blasting those people back. so really some horrific scenes of violence earlier today. the situation has calmed considerably. we have been told by the belarusian border agency that they're moving to try and sort of separate the refugees a little bit. i don't mean separate families, i mean they're setting up a logistical center as they call it, where they move refugees back. that process, we're told, will start tonight. so they can get medical attention, some food, logistical center is indoors. which is a huge upgrade from the conditions in which these people have been living in for more than a week now. and -- but it is also a sign that the belarusian authorities seem to be moving to calm the situation. belarus has been accused of manufacturing this crisis, to create a humanitarian catastrophe on its borders, and to put pressure on the european union. they deny that, of course. it is what the u.s. and the europeans accuse them of doing. they now seem to be ratcheting down the pressure a little bit. >> we will continue to stay on it, glad you're there and hopefully you can also dry off fairly soon as you pointed out. matthew, appreciate the reporting, thank you. back here in the united states, dramatic flooding in washington state, forcing hundreds of people from their homes. also shut down a stretch of highway, knocked out power to thousands. >> the coast guard rescued ten people including four children from a flooded neighborhood near the town of forks. emergency officials along the canadian border conducted search and rescue missions after more than 500 people were told to evacuate their homes. in all, more than 50,000 people are now without power. this morning, 14 counties under a state of emergency. >> that's a lot of water. still to come this morning, the law yesterday before a rare showing in washington. that's right. a bipartisan group of lawmakers, senators and members of the house, at the white house. he will celebrate that victory and promote the one of the many projects they aim to fix. president biden held a high stakes virtual summit with chinese president xi jinping as tension escalates between the two nations. world leaders spoke for three and a half hours on monday. touching on a range of sensitive issues including trade, human rights concerns, and chinese aggression toward taiwan. joining me to discuss, the former u.s. ambassador to china under president obama, good to have you with us, mr. cz ambassador, this morning. as we look at and learn more about what happened in that hours long very high level zoom meeting, the white house says that president biden affirmed there has been no change to the one china policy. president xi was very clear in saying, and i'm quoting him here in regards to taiwan, whoever plays with fire will get burned. very tough talk from china on that. not necessarily matched by president biden. what does that mean moving forward? >> well, first, i think it is important to realize that the summit talk was three hours. that indicates that a whole range of intricate issues between the u.s. and china which are so intertwined in so many ways. one of the biggest hot buttons is taiwan, no question. i think the u.s. congress and to some degree the executive branch has been hawkish toward taiwan. that upsets china. taiwan, for china, is a core issue. i talk to president xi when i was ambassador over there, others in china, it is nonnegotiable. it is nonnegotiable for the chinese. it is very important for president biden to reiterate over and over again our one china policy, meaning, hey, taiwan and china really one china, whatever that means, he decided to interpret that in his own way. very important as well as so-called shanghai communiques. our policy of so-called strategic ambiguity toward taiwan is part of all that. that's very important for biden to reassure president xi. >> you talked about outspoken members of congress, it is not just members of congress. there are a number of folks who say this is an issue, so are you saying that should not be discussed publicly because it could harm the relationship and so therefore does china have the upper hand here? >> i'm saying clearly we have to discuss it, because it is going to be an issue probably as long as we're alive. but it has to be discussed responsibly. carefully. not in a hawkish adversarial way. if eithers side gets adversarial, we respect each other, we don't get hawkish. either side. >> that issue is not going away. i want to get your take on a couple of other things. to that point, my colleague david culver in beijing noting this morning this is the first time in a long time he has seen such positive headlines from state media. what should we read into that? >> i saw those headlines too. i think that's positive. president xi wants to stabilize the relationship with the united states. he wants to focus on his country, on the economy. get more high paying jobs, chinese people address air pollution, water pollution and he knows that he's more able to accomplish his internal objections. he has to worry about a potential even military adversarial relationship which will undermine his efforts. the real question here for both sides is we both heard nice sounding words, but we know that actions mean a lot more than words. and i am concerned that this is -- actions may not follow as quickly as they should. >> there weren't real concrete actions that came out of this. it got me to thinking, as we look at this, look at the way the relationship played out over the last several years and where it is headed, president biden raising concerns with china, it makes me wonder who needs this relationship more. the u.s. or china. >> we both need it. it is clear. china is not going anywhere. it is always going to be there. it is going to have an economy that is not too many years going to be larger than the u.s. we're not going. we're going to be -- the americans are going to do the best job they can with all the values. we need each other. we need each other and the more we understand that, and try to respect each other, and not let either one take advantage ♪ ♪ there are beautiful ideas that remain in the dark. but with our new multi-cloud experience, you have the flexibility you need to unveil them to the world. ♪ new this morning, eight people are dead, dozens more have been infected with covid-19 on the heels of a severe outbreak at a nursing home in connecticut. >> so sad. it reminds you of the beginning of the pandemic. according to the gear village senior community, a total of 89 residents and staff, many fully vaccinated, tested positive for covid since late september. cnn medical correspondent elizabeth cohen has been following. we're hearing 11 residents and a staff member still in isolation. i wonder, vaccination, we know, gives you an enormous amount of protection, but how protected are these folks proving to be in the midst of this outbreak? >> jim, the issue i think is going on here is that the nursing home hasn't said, but i think we can safely assume the nursing home residents and the staff probably too were vaccinated pretty early on in the pandemic. january, february, march, sometime in that time frame because that's when they were supposed to be vaccinated was early on in the vaccine rollout. by then, guess what happens, we know that immunity wanes from the vaccine. let's look at the particulars here again. so there have been 89 cases among residents and staff in this outbreak at this connecticut nursing home. many of them fully vaccinated. eight of those people have died. we have learned from the nursing home that nobody here had received a booster because it was too soon. the outbreak started, they said the booster wasn't available. this tells you what happens when you vaccinate people, many of whom probably didn't already have great immune systems because they were elderly. you vaccinate people and nine, ten months later, this is what can happen. the nursing home says the folks will receive boosters soon. jim, erica? >> elizabeth cohen, appreciate it, thank you. new this morning, pfizer says it has reached a deal to allow greater global distribution of the antiviral pill. the treatment is greatly needed in many areas, especially as vaccines still not easy to access in many places. take a look. more thatn half of europe is fully vaccinated. less than 7%, that's the red line there on that chart, of people on the african continent have been vaccinated. >> just such a stark disparity in the numbers there. back here at home, a georgia paramedic is being held without bond after he allegedly crashed an ambulance, killing the patient who was inside at the time. then tried to get away, wait for if it, in an uber. police say 34-year-old kevin mccorvey admitted to drinking alcohol, smoking marijuana, taking adderall before the ambulance veered off the road and rolled into a ditch. the patient was not restrained in any way in the back of the ambulance and died from his injuries. a second paramedic involved in the crash has not been charged. another big story this morning, court is back in session in south georgia this morning, in the trial for the three white men accused of killing ahmaud arbery. prosecutors may call the county medical examiner now to testify. >> yesterday civil rights leader reverend jesse jackson was in the courtroom with ahmaud arbery's mother, prompting calls for a mistrial. once again, from defense attorneys. the judge refused that, called the defense's objections, quote, reprehensible. martin savidge is live in brunswick. what is happening today in court? >> reporter: right now the jury is not in, so it is time when lawyers can begin to argue various things they want to talk about with the judge without influencing the jury. it seems now that the defense wants to bring in information or evidence pertaining to what they say was a crime wave that was going on inside of that community. and why that community was on edge. of course the state is pushing back and saying that that's an overstated argument there. we're waiting to hear what the judge is going to say in that regard. yesterday, it looked like this case was going to come to this very abrupt and ugly ending as a result of not something that was said on the witness stand, but as a result of something that was seen and heard inside the courtroom and that was specifically wanda jones cooper, the mother of ahmaud arbery, she broke down emotionally when she saw a photograph of her son presented in the case. and then right next to her, sitting there comforting her was the reverend jesse jackson, and that's when the defense objected. here is some of the exchange between kevin gauff, one of the defense attorneys, and judge timothy walmsley. >> your honor, i would submit with all respect to the reverend jesse jackson, this is it different than bringing informe prison guards in a small town where a young black man has been accused of assaulting a law enforcement officer or corrections officer. >> we then start getting into what we have now, with individual members -- or individuals coming into the courtroom. i will say that is directly in response, mr. gauff, to statements you made, which i find reprehensible. and not granting a mistrial at this point based on these arguments that are being made. >> reporter: so the judge essentially saying there, you're the one that created the problem, mr. gauff, you're the one now that is going to have to live with this problem. meanwhile, we do expect the medical examiner today and that could be some very graphic testimony. erica and jim? >> we heard some vocal judges in the last couple of weeks. that's quite a rebuke there for the defense. martin savidge, thank you very much. still ahead this hour, republicans in wyoming will no longer consider liz cheney a member of the party. it is all over her standing up to donald trump, his election lie. is trump still owning this party shaping in his image? >> well, look, you know, i can't speak for liz. liz does a good job speaking for herself. what i'll say to you is i'm all about our party. this book is all about our party moving forward from where we are now, to be an effective contrast to the democrats and the policies that are being put forward by joe biden and kamala harris. but to do that, we have to be truthful, we have to stop looking backwards. we have to stop grievance politics and vendetta politics and what we have to do is talk about the concerns of the american people. and when the republican party did that two weeks ago in virginia, glenn youngkin was elected governor. and came very close to electing another republican governor in my home state, but even in my home state we won seats in the legislature in both houses by talking about a forward looking agenda, not a backward looking one. >> okay. and by the way, right to note the different approaches that those republican candidates took in virginia and new jersey. but the national party is very different. as you know, two-thirds of house members, the day, the night of the insurrection still voted to decertify the election. it has become a new litmus test for gop candidates, particularly in the house, to continue that election lie. i get the point of your book here, to your credit, saying the party has to move on. it is not, though. so i wonder would you stay in the party if it doesn't move on? >> listen, i'm a republican, jim, i've been a republican my whole life. this is a fight worth having. it is a fight worth having to be a strong viable counterweight to the democratic party. and i just give you a bit of very recent news. in the des moines register poll that just came out yesterday, they asked iowa republicans and you know, jim, iowa republicans are some of the most conservative republicans in america. and they asked them, where is your primary loyalty to the republican party, or to donald trump? 62% of iowa republicans said to the republican party, only 26% said to donald trump. and, look, there are many things as you well noted at the top, i supported the former president, i was the first one to come out and do it, i supported many of his policies. but when we had disagreements, i was his friend for 20 years, and i told him what those disagreements were, privately and publicly. des moines register poll, jim, it tells you something different, we need to win elections again and to win elections again we have to start speaking directly to the concerns of the american people, not about the past. >> that poll notwithstanding, i should note national polls show a large majority of republicans support trump as the nominee. i want to note some of your fellow republicans have taken aim at you. i'll note adam kinzinger, he tweeted this saying you're playing both sides. chris christie pretends to be both anti-trump and pro-trump. on fox news, you said you're still friends with trump, but you're a friend who tells him the truth. and as you know, trump is an all in or all out guy. we have seen this with a whole host of folks who pledged loyalty to him, but he in effect exiled when they got on the other side of him on even a single issue. i wonder what kind of compromise do you plan to strike with trump? >> that hasn't been my experience. i've been friends with him for 20 years and we disagreed any number of times, privately and publicly, and we remained friend s over these 20 yearyears. it is not my experience. with all due respect to adam kinzinger, he doesn't know donald trump the way i've known him over the years and had the experience i had. in the end, what i'm saying is the former president needs to understand that the election is over, and that exacting vendettas and revenge for people who don't believe that the election was stolen and the facts prove it was not, that's not the way for us to win elections in the future. >> he has not done that. >> we need to be talking about the issues and we should be talking about the issues that joe biden and kamala harris are putting forward right now as their prescription for the american people, because if you look at polls there, jim, american people aren't loving that either. >> i get it. but to your point about trump, trump has not given up the big lie by any means. he spreads it every day. doubles down. by the way, he attacks people, you and he had a very public disagreement just last week when you went before the republican jewish congress and made the same point and he came after you. right. so my question to you is, if trump does not change his tune on that essential claim that the election was stolen, will you withhold support for him? should he choose to run in 2024? >> i may choose to run in 2024. so who knows. i may choose to run in 2024. who knows what is going to happen. yes, the president sent out a negative statement about me last week after my republican jewish coalition speech and look at me. i'm still standing, alive and on your program. and so, you know this is not a death sentence for anybody. it is a disagreement. and i have a disagreement with him on this issue. we have agreed on many more issues than we disagreed and that's the way we need to judge politics in this country. we have to stop making it be whether it is any political candidate, or figure making it this way or the media making it this way that you have to be all in or all out. i can tell you, jim, the only political candidate in my life i've agreed with 100% of the time is me. otherwise, if that's the litmus test, we'll never find anybody that way. >> if you run in 2024, if you follow through on that, trump runs, trump beats you for the nomination, do you support him in 2024? >> you know, who knows, jim. who knows. and, you know, my -- >> you have fundamentally different views of the paefrt a party and the country. you have fundamentally different views about the state of american electoral politics. it is a basic question. could you support that? >> i'm afraid we may be. i'm afraid that the u.s. has really been not sensitive enough by russia and china's efforts so we're reaping that decision, but we want to retain our own freedom of action. you know, then you get other people copying you. so, yes, there have been tests of space weapons since the 1960s, but fortunately until now, there hasn't been sort of, you know, deployed operational systems. this thing yesterday, the russian test, again, was just a test. there's a slim chance we can get some kind of international agreement to not do this kind of thing. it's terrible. it puts the astronauts and cosmonauts at risk and expensive satellites at risk. >> i want to talk about the risk in terms of some sort of national agreement. is there the will, do you think, among these nations to agree to something? >> i think there's potential. there's been more productive discussions recently in international disarmament forums about rules of the road in space, how you might agree not to interfere with other people's space activities. it's over 50 years since the outer space treaty was signed, which bans weapons of mass destruction in space, but we need to go further than that as space gets more and more crowded and more commercial, so there's a lot more money involved. >> we've been showing images of how many shiites there are. folks don't realize how crowded space is and you throw in all the debris. how dangerous is it to drop 2,000 pieces of debris into space traveling at 17,500 miles an hour?
