spears released but isn't completely free yet. >> this is live from the cnn news room. in washington and a major development in the investigation into january 6. steve bannon indicted for contempt of congress. these charges reflect a steadfast commitment to the rule of law. some lawmakers say the message to bannon and others is clear. >> it sends the message that no american is above the rule of law. the same rules apply to everyone. i don't know why steve bannon thinks he shouldn't have to answer questions from the united states congress or produce documents to the congress when every other citizen would comply. >> the committee is trying to better understand what bannon was doing on january 6 and why he said this the day before. >> all hell is going to break lose tomorrow. just understand this, all hell is going to break loose tomorrow. it is not going to happen the way you thinks it going to happen. it is going to be quite extraordinarily different. strap in. the war room of posey has made this happen. tomorrow, strap in. >> more on the charges. and what's next in the investigation. >> bannon now facing two criminal charges. one for failing to show up to his deposition and the other for failing to produce documents. both carry from one month to one year sentence. he is expected to self-surraender on monday. it is not likely he will engage in a plea deal with the government. it is expected he'll fight this in a trial. one of the few people who have resources to fight charges like this. not everyone can go up against the department. if convicted, he could have the option to appeal. this is a win for the committee. this is certainly a deterrent for anyone else thinking about defying a subpoena. not everyone has the money, resources or desire to go through a criminal process like that. right now, we'd expect likely witnesses -- i've spoken to several. they were watching to see what happens with bannon to decide whether they'll continue to stole wall. now it is likely the committee will see more engagement from witnesses but likely they'll try to negotiate and narrow the topics they are willing to answer questions about. they have the option to show up and evoke the fifth amendment to any questions they object to. it is a win for the committee. we'll continue to support how much cooperation this victory yields. paula reid, cnn, washington. a simple message for others thinking about defying a subpoena. they wrote, steve bannon's indictment should send a clear message for anyone who thinks they can ignore the committee or stone wall our investigation. no one is above the law. >> all of this comes as newly released audio appears to show president trump who threaten then vice president mike pence. this is what trump told a washington journalist two months later? >> what lies ahead for bannon after he turns himself in on monday. one legal expert will explain the process step by step. >> he'll be arraigned on monday and formally advised of the charges. the judge will make sure he has a lawyer and they'll consider the question of bail. in some cases, they'll get locked up pending trial. i don't think that will be the case. because he has no prior convictions worth noting. he'll be arraigned on monday. he'll argue to throw the case out and we'll have a trial unless he pleads guilty, which i don't expect that. we'll have a trial. united states of america versus steve bannon. if convicted. he goes to veil at least one month, possibly a year. >> his case has been referred to a judge appointmented by former president trump. it could take years for the case to play out through the court system. a new draft of the cop 26 climate agreement. language on phasing out coal. joining me live now, phil. >> kim, we are going through an extra day here. we have this third draft to look at. its strengths and weaknesses and the question, do we get to go home this weekend? i'm joined by climate think tank e 3 g. there is still a reference to phasing out unabated coal and inefficient subsidies. is that going to survive to the end? >> that will be pushed back very hard by the usual suspects. the saudis, india, russia and others. this is the most prominence i've ever had. to have a debate on this. in 2009, they got the leaders to agree. we've been seeing very little progress on that. this would force a debate. spending $5 billion a year to something they call a threat. that's the definition of insanity. >> this spells out what the science says which is we have to cut emissions by 45%. we know we are nowhere near close to that. encouraging countries to come back next year with the targets. >> it is essential. we are on track to increase by 13 or 14% rather than reducing them by 45. we have to turn this around to have the effort to transform our economies over the next eight years. there is very little signal coming out of here that country's are treating this as the emergency it is. >> where do you think the sticking points remain? >> the majors will be around finance, which is usually where the sticking points are. there will be a debate over finance and the share of $100 million and the pledge every year to the developing countries. right now, about 25% of the total. three quarters to mitigation. the other big issue is about loss and damage, which is basically suffering. the damage countries are experiencing. hurricanes, floods, wildfires considering we've done much too little over the years to address the problem. they are demanding help in dealing with the issue and all the developing countries are offering are four years of dialogue. initial reactions i've heard from developing countries, that's not going to fly. >> is it reasonable for people at home to wonder how has it come to this? yes. the situation in hospitals is always a little later than the rise in incidents. we have a very strong rise around 1,000 cases seven-day incidents in 100,000 habitats. already it is bad and in many areas, there is not a single bed empty. they are full. the personnel working there is at the limit. i think it is an urgent situation that will really help to take new measures to alleviate this situation. >> the lockdown just of unvaccinated. how would that work. would police stop you in the streets and inspect your vaccination card? >> that's what they did in the normal lockdown. they would stop you in the street ask you where you were going or why you were outside. now they will ask for the vaccination card. this is an experiment. it has never been done. the classical lockdown, the drastic rediction of contact have been done previously and shown to work. a lockdown just for unvaccinated individuals. this is something new and we do not know if it is going to work. i'm not quite sure if we have time for such experiments. >> interesting. >> is 65% of austrians are fully vaccinated higher here and in the u.s. keeping the rate low is the vaccinations are heavily criticized. there is a clear link between republicans and conservatives and lower vaccination rates. is that going on in austria as well? >> yeah. we have a certain core relation between governments in certain areas. we have higher number of new cases. >> we have like in germany, a right wing party in austria and germany. both parties are very skeptical. they have not helped in motivating people to get vaccinated. >> i'm wondering. you might not know this. i wonder if this might cause a backlash because those will feel discriminated against. it is one thing not to be able to go to a restaurant but to feel targeted. >> it may not work certaining controlling the numbers but it has clearly already worked in getting people to get vaccinated. so the vaccination numbers have risen drastically. we've had many new individuals being vaccinated as in spring when everybody wanted the vaccine. at the moment, it looks like it is helping motivate people to get vaccinated. >> interesting. that is good news. you say it is an experiment. other people are watching this. is this something other countries will have to look at too? felony charges in the shooting of three people last year during black lives matter protests. we have more. >> a dramatic trial nears the final stages. marked by intense testimony from the accused. a trial where the judge commands seemingly as much attention from the defendant. admonish admonishing lawyers. the homicide indictment is receiving jury restrictions. prosecutors won a small victory when the judge said he would add instructions and arguing rittenhouse provoked one of those killed into chasing him. >> prosecutors asked them to give instructions to lesser charges. some of them less serious. the judge explaining what that could mean. having a lesser offense included, you are raising the risk of conviction and decreasing the risk you are ending up with a second trial. >> rittenhouse understood the ramifications and will likely allow some charges and not allow others. >> rittenhouse has pleaded not guilty to six charges including intentional homicide, wreckless homicide and the shooting of three people in protest in kenosha, wisconsin following the police shooting of jacob blake. two of those three people were killed. one wounded. the judge's behavior has loomed large over the trial. >> he's been accused of favoring the defense. harsh harshly admonished several times. you know very well the attorney can't go into these areas. don't give me that. >> he seems to be a narcissism. likes a lot of attention. engages in these realliout landish out bursts. a lot of focus has been focused on him. this is a serious murder trial. we shouldn't be talking after the fact about the judge. >> rittenhouse's attorneys have filed for mistrial with evidence. the judge has taken that into advisement. it is believed not likely the judge will declare a mistrial at this point. here is the background to the kyle rittenhouse case. it happened in summer of 2020. protests proek out across the united states following the police killing of george floyd and more demonstrations as more police shootings surfaced across the u.s. on august 25, kyle rittenhouse shot and killed two men and wounded a third. he says the shootings were in self-defense. another high-profile murder trial in the trial of three white men accused of chasing and murdering a black jogger a maud arbery. at one time, a complaint there were too many black pastors in the courtroom. in houston, texas several breeches happening throughout the day. thousands entered without scanning tickets. crowd surge in the evening would leave nine dead and 100 injuries. one of the victims services set to take place in houston a few hours from now. >> a california judge ended the 13-year conservatorship of britney spears and her father who oversaw her estate and controlled much of her personal
