buttigieg is set to speak. infrastructure is the real deal now. the $1.2 infrastructure bill passing both chambers of congress with bipartisan support. joining us now is cnn's chief congressional correspondent manu raju and cnn's senior white house correspondent phil mattingly. phil, the biden administration really needed this win. what does it mean for the american people, anded what are we looking forward to hear from serkt buttigieg in. >> it's significant for the administration for any number of reasons but i think what you'll here from secretary buttigieg and really white house officials over the course of the next several days and weeks is a focus on what's actually inside the proposal. $1.2 trillion infrastructure proposal, and it has real tangible meaning for average american people. $110 billion for roads, bridges and major projects. $55 billion for water infrastructure. you kind of go up and down the list, whether it's tens of billions of dollars for public transit. $15 billion for electric vehicles and charging stations. these are the types of investment i think or spending that officials really in both parties have been looking to try and accomplish over the course of the last several administrations. so much so that in the last administration it became a punch line which you kind of went after in your opening there, ana, and i think you're going to hear from american officials is they don't want to move on to the next proposal, they understand there's a significant amount of work left to go on the president's domestic agenda, $2 trillion bill that still needs ton negotiate and they still need to figure out a pathway forward between moderates and progressives. they don't want to shift the focus away from a very real legislative victory, a very real policy win and bipartisan one on that. the president delivering on two critical campaign promises, bipartisanship which a lot of people wasn't necessarily possible in washington and on on the policy side with infrastructure and guess what you're going to hear today. that's what the administration will highlight that the president is traveling on saturday. cabinet members including secretary buttigieg will be hitting the road. >> the vote only happened for this infrastructure bill when the moderates gave a commitment to the progressives said that they would support the broader big back better bill which is supposed to happen later this month. where do democrats stand now? >> the big question is can they meet their timeline? we've seen deadline blown after deadline blown and the new deadline is november 15th when the democrats hope there will be an actual official cost estimate saying how much the bill is estimated to be at $1.9 trillion. if it actually meets that target, and if it's actually fully paid for by a range of tax increases in particular. they wanted to make shower that that is actually the case. that's what the moderates had demanded in saying that they wanted to vote for this bill they needed to see the estimate which is the biggest reason why nancy pelosi was forced to delay a vote on the larger plan. assuming that comes back that's when it could come for a vote in the house and there's a very real possibility that even though they want a vote on this by november 15th the estimate could get delayed until later, running up to thanksgiving and then see if it comes back and meets the targets that the white house expects. assuming that it all does it. would get out of the house and the moderates and nancy pelosi can only afford to lose three votes and at that point it would go to the senate. there's major questions what this bill will look like, because joe manchin in particular has raised concerns about a number of provisions and suggesting the price tag at $1.9 trillion in the house could be too high for him there and also paid leave which nancy pelosi put in this bill for four weeks is family as part of this proposal. that will almost fall by the wayside if joe manchin has his way so there's a lot more nation to be had and a cumbersome process to give it out of the senate the it's going to take some time. joe biden got a big victory with the bipartisan pill. >> and there's big questions about when the american people will feel the impact of this legislation that has passed, especially the bipartisan infrastructure bill officially on its way to the president's desk. again, we will take the comments live from secretary buttigieg as soon as he begins speaking. manu raju, phil mattingly, thank you, gentlemen. our other developing story shock and horror in hues top of the right now a criminal investigation is under way as officials try to piece together what happened at the astroworld music festival on friday night. at least eight people died and dozens were injured after a massive crowd surged forward as rapper travis scott performed on stage. the youngest victim was just 14 years old. six people are still in hospital and five of them in intensive care. concert-goers describe the chaotic scene saying they couldn't get any air as people crushed against each other. the "new york times" is now reporting that the houston police cleve visited rapper travis scott hours before this show to discuss crowd control issues, a source telling "the times" that the chief was already concerned about the energy in the crowd and now at least one lawsuit has been filed over this incident are more and are expected. our rosa flores is live in houston. where's the focus of investigators right now? >> well, ana, the focus is criminal as you said. over the weekend this investigation escalated to include both the homicide and marcottics division, this after a security officer report that had while he was on scene he was pricked in the neck and went unconscious and he was administered narcan and he was revived and he wasn't the only one that received narcan that night. here's what we know about the timeline. at about 9:15 p.m. on friday night when there were about 50 n.o.w. people in this crowd that's when the crowd started compressing towards the stage by 9:38. this had turned into a mass casualty event with one police officer describing the scene as multiple people on the ground in cardiac arrest needing medical attention and, of course, medical personnel providing that attention. that concert ended at about 10:10. concert-goers, i've been talking to multiple of them, they tell me at some point it was very, very difficult to breathe. they didn't even have control of their bodies, they say, because of the massive crowd. take a listen. >> oh, definitely was traumatizing. i've never been in such chaos like so unorganized and just so many people like slamming into me. like there was -- it was just -- it was -- it was real hell. it was really hell. >> you could feel like everybody pushing behind you. you couldn't move your arms. you couldn't breathe. you can't see anything. it's like you were seeing the back of really tall people's heads and when everybody was moving. there were like 15, 0 minutes where we weren't in control of our bodies. we were literally like moving with the wave of the people and it was very claustrophobic. >> i got separated from my friends and i got pushed in the middle, and when each song was going on i saw like two people and they were literally behind me and everybody was moving out of the way with a whistle and they are like it's a dead body, move out of the way. it's a dead body. >> live nation, astroworld festival, travis scott have all issued statements saying that they are devastated. ana, back to you. >> thank you. let's go live to the white house and secretary pete buttigieg. >> when our communications team point about what we're going to be able to deliver. we are so thankful to everybody who has played a role in this. thanks to members of congress on both sides of the aisle. president biden's historic bipartisan infrastructure deal will now become the law of the land, and it couldn't come at a more urgent time. i can tell you in the ten months that i've been in this job i've traveled the country and seen the state of our infrastructure firsthand. i saw mesh nets hung under bridges to catch pieces of concrete that fall off from time to time. century-old tunnels corroded by sea water that hundreds of thousands of people depend on every day. roads where community members are installing memorials to lives lost in preventable traffic crashes. highways that have cut communities in two. infrastructure is so elemental to our society that when it's not there to serve of us in the right way, all of us are impacted, but when it is, when it's strong, every community large and small, rural and urban, privileged and marginalized, every community feels the benefits. when combined with the build back better act the bipartisan infrastructure deal which collectively i like to think of them as the big deal, an answer to the new deal or the square deal before that, they are going to create a generation of good union jobs. they will make historic investments in inequity and the fight against climate change. they will make sure that america can compete and win in the decade ahead. the lark e.investment in roads, bridges and highways since the intimate highway system including improvements in our bridges so we can avoid disruptive collapses including what we saw in tennessee and florida and far too many other places. it's also the largest investment in public transit ever with funding that will expand service to communities of all sizes, including improvements for seniors and for people with disabilities. it's going to replace thousands of outdated buses with clean zero emission vehicles and aging rail cars with state of the new ones. it's the largest creation itself and transform mif impacts in traffic safety will improve and it's going to dramatically increase funding for major products and help our supply chain. every year we have discretionary programs where we support projects that are vitally important for local economic development and the national supply chain. we are going through the current round of applications to raise right now and for every dollar we have to get out, there are about 10 in impressive applications coming in. this allows us to grow the programs that we can use in very direct ways to address the issues of our time. our example from the infrarounds, i was looking at a project in jaffe, it's an inland port helping people move on from savannah. it's used to create it faster to get terms out of the term and sort them so they could get on a shelf. . this helps us to change that. later today i'll be headed to glasgow and there look forward to discussion how this transportation i which is the biggest sector of creating greenhouse gases in our society would be a big factor. we've seen so much impact in americans lives on the transportation system as well which is why the funding electrifies our power grid and like our infrastructure more resilient to extreme weather and build out half a million vehicle charges and expand public transit which i mentioned earlier which is a huge part of the climate solution. it's of course beyond our transportation elements, lead pipes, cleaning up pollution and broadband and more. what all of these investments in common is that they will create jobs. pipe fitters to replace the pipes and electricians to install those ev charging stations and autoworkers to build the cars that plug into them. we needs mechanics maintaining transit vehicles and drivers operating them and construction workers rebuilding the roads and bridges and most of those jobs will be available whether you have a college degree or not which is why the president often talks about this is a blue collar blueprint for american competitiveness. and it's a generational investment in every sense of the word. something that means a lot more to me now as a new father because this is how we do right by the next generation before it's too late. so thanks again and eager to take some questions. >> all right. >> go ahead, jeff. >> secretary buttigieg, thanks for being with us and congrats on the birth of your children. a question about the bill. the bill gives your department an unprecedented amount of discretionary funds, $100 billion in competitive grants. can you spell out how you plan to prioritize that money and just give us a sense of what projects you see or we should expect to see and getting money and started first? >> our department has been gearing up hoping that this bill will pass. it's broken into two parts. part of it is handling for programs we already have like discretionary such as rays formering known as tiger and infra. there what you'll see within the frame wosh of the law put forward is an emphasis on projects taken together give us extra value in the priorities of this administration. economic strength, safety, climate, equity, preparing for the future, and we see a lot of projects that overlap in that sense. again, if you look to what we funded with the last round of infra, that will give you a sense and you'll see that when we announce the projects for this year, too. then we is there to stand up new projects. safe streets for all, never a project like that and reconnecting communities and responding to where it was sometimes federal dollars that divided a community often along racial lines. i think the intent of those programs is clear, but the mechanics of those, we've got to work very hard to make sure that we get it right, that the criteria are transparent. that is easy to understand how to apply were you're a big city with full-time staff here in washington, d.c. or a small rural community trying to navigate that federal process, and, of course, that all those dollars are spent accountbly because we're talking about a lot of taxpayer money. >> sorry, just a quick follow-up. do you have something in place to prevent miss management of that money and fraud? >> absolutely, yeah, and that's something that i know is happening at the administration level. there will be, you know -- and the president made this very clear to us in the cabinet when the rescue plan dollars came through. we know we'll be held to a very high standard by the president as well as the council so we have a lot of secretaries paying close to pay attention to how do we have the right controls, the right rigor to make sure these dollars are spent well. >> secretary mayor pete, can you give us the breakdown of justice 40 with the infrastructure pack and that's now passed and sign into law and also can you give us the construct of how you will deconstruct the racism that was built into the roadways. you talked earlier and broke that information to us. can you talk to us about how that will be deconstructed. >> so the principle of justice 40 is that 40% of the clean investments in this bill will go to benefit the communities that are overburdened and underserved so part one of that is defining those investments that are eligible and that's a lot of it, and we're working to map out kind of program by program, mode by mode what would qualify. for example, if we're buying clean buses, how do we make sure, in terms of where those buses go and also look at the business opportunity, the jobs created and the businesses that will have a chance to compute for and, again, we have a lot of guidance and oversight from the white house since that's an administrationwide initiative. we know we need to build our own internal kind of ways of aligning and defining that inside the administration. as to where we target those dollars, you know, i'm still surprise that had some people were surprised when i pointed to the fact that if a highway was built for the purpose of dividing a white and a black neighborhood or if an underpass was constructed such that a bus carrying mostly black and puerto rican kids to a beach or that would have been in new york was designed too low for it to pass by, that that obviously reflects racism that went into those design choices. i don't think we have anything to do by confronting that simple reality, and i think we have everything to gain by acknowledging it and then dealing with it which is why they are reconnecting communities that billion dollars is something we want to get to work right away putting to work. >> but that's such a heavy lift. i mean, you have to reconstruct communities that this happened to. as you said, some of these beltways and interstates and roadways were built before the civil rights act, before the voting rights act and were made -- meant to be rates of, but how do you go about redefining and replanning these roadways and communities that are already settled in. >> yeah. >> since then? >> so, what's interesting it's going to vary but community, and we have to listen to the community. sometimes it's really the case that an overpass went into effect because it's so harmless and should to be underground. maybe the process is to add rather than attract and that's why we don't want a one-size-fits-all. we saw the local vision of how they want to get passes the vision and the local ideas will be taken very seriously as we try to meet the spirit of this law. >> you said this law and its passage did not come at a more urgent time. do you know when.will sign this plan? >> i don't know but i'll thereby with bells on. >> and can you tell me what the campaign to sell this bill will look like given that it will take time for some of these projects to go into effect and be completed and of the white house is one year out from the mid terms, of course, which they have tied this bill to? >> i exabout exthat that will be led by the president traveling to show where the need is and where the -- where the action, is but i'm certainly eager to be part of that effort. i mean, look. a lot of this sells itself because communities never needed to be persuaded that their bridge needed to be fixed or their airport needed an upgrade or their ports needed investment. they have been trying to get washington to catch up with them and i do think it's important to go out there especially in communities where members of congress and the senate played an important role and remember both side of the aisle presented this bipartisan win and i can't wait to be out there celebrating good nuts. >> thank you, mr. president as you pointedous this is a bipartisan bill. was this any discussion of the president not letting democrats oppose some of the republicans who were running or giving them a pass in the next election? >> nothing that i've been part of, but what i'll say, is you know, we're really proud of the bipartisan character of this bill, and, you know, the conversations that we had, it wasn't transactional like that. it didn't have to be because these investments were already so good for the communities that these members represented. you know, there are times that you ask somebody to take a tough vote. to me these provisions were so rightly popular that the only thing that was tough was some republicans to stand up to those who wanted them to choose party over ma what was right from the community. >> so there was no discussion from your side about the partisanship of it? >> i don't remember talking to any member of either chamber of either party talking about campaigns and elections in that way. what we talked about is how it would be good. of course, i believe strongly that good policy is good politics, and i think it's going to reflect well on anybody who voted to deliver these big wins and these jobs for their communities, but i think that's just clear on its face from being such good legislation. >> i wanted to ask about the money support in the bill. >> i'm sorry. >> the money reports in the bill. >> yes. >> how will that help the supply chain issues that the u.s. is facing right now? >> yes. >> i know that's something that you've said off when you said the chain supply will be helped. >>y will let me offer a couple of examples. we need to make sure our ports are as efficient as possible and there are cases where more technology, sometimes physical technology around the berths but sometimes it's more to do with the systems that help the different players talk to each other. remember, port is not a single entity. you have the port itself that's like the landlord and then you have the terminal operators and truckers and all of that is interacting with competing ship companies to efficiently move these containers. they need to move hand share data and we'll want to support ways to do that. some of that is important. the backup may not be because of something on the ships but inland. that's why i was pointing out example serving savannah where we have an inland port so we can rush them out and then sort them out so it will be more efficient and speedy. those are a couple of examples. a third thing, the idea of the healthy ports initiative. there's a lot of emissions around ports from the ships themselves and from the trucks and from the equipment and right now one thing that is tough is the neighborhoods that are close to them feel that impact including an increased asthma rates and what are disproportionately black and latino neighborhoods. we want things to go hand in hand with the efficiency drive. >> also want to follow up on truckers. have you thought at all about relaxing motor carrier regulations further to allow people 18 to 20 po participate and to be truck drivers? >> there's a provision in had legislation, yeah, exactly but we've got to be very careful about safety so the way the provision works it's a mentorship type of apprentice type of initiative that tries to manage the potential for there to be a safety trade-off. we want as many people to be qualified drivers as possible, but never at the expense of safety and we'll always look at other steps we can take. we've got to just make truck driving a better job. truck drivers, there's a reason the turnover is so high, and the way they are compensated, they are often not compensated for their time which means that their time is wasted freely sometimes when they are waiting for a load at a port, for example. truckers have not had the option to work from home, the scene. they are the backbone of the process and they need to be compensated. >> several americans will see some of the effects in the infrastructure bill in two to three months. is that also your assessment and can you provide a more detailed timeline of when specific programs will go into effect? >> again, i would break it into the existing programs that we'll be able to plus up and then the new ones that we'll have to stand up so with something like intra, rays, that's more than a two-fold increase in the authorized funding so here you have -- by the way, they are not waiting on us in washington to invent these construction projects. the communities are applying with them and we can fund that many more and we're already -- even though i'm going through the applicants for this year's programs now we'll in very short order working on next year's and you'll see a notice go out. we need safe streets for all, reconnecting communities, healthy ports and that will take a little bit longer. remember this, isn't 2009. this is an era where it's about making sure we hit every shovel-ready program to try that immediate short-term boost for the economy. it's short term and long term and that's why the president talks about looking back on the moment from the 2050s. >> just to follow up on that, we were down in mississippi talking to farmers who have had bridges closed down in their air what for two or three years so when exactly can americans expect to see a difference in their lives? will it be two to three months or sometime sooner? >> that's the beginning, right. you know, the short answer is as fast as many of these agencies and workforces can be a southern those dollars, when the formula increases or when a new brand is available. this is something soon. this is about many, many years ahead. >> you can go first. quick follow-up on your question. when you're reviewing the applications do you have adequate staff at d.o.t. to review the applications? >> yes but we need to continue to grow and that's one thing we're working on to staff up properly and be organized properly. we'll have $660 billion over that stretch of years that we need to manage responsibly. there's an admin dimension to that to make sure we have the right staffing of human power. >> in erms of the highway money that will go directly to states, is there something that you can do to encourage that that money isn't used to just widen roads and encourage more people to drive? >> right. this is not just about adding. this is about being smarter in terms of how people move around. now, you know, the best way to allow people to move in ways that are better for congestion and better for climate is to give them alternatives, so i know our transit funding doesn't sound like a highway policy but part what have takes the pressure off the highways is the unprecedented historic funding for trance-inch. having said that, you know, we're certainly when there's any discretion involved, we'll think about what's going to help try to solve the problem. sometimes you add lanes to a road and get that many more cars and you're no better off in terms of congestion or pollution. also interested in some of the performance measures being contemplated and with this legislation we have the tools to make an answer on that front. >> going forward to the -- the house version of the social safety net includes paid family leave. the senate has indicated it will be stripped out and the president's framework a couple weeks ago. you just came off some family leave. talk to me about the benefits of that, number one and number two, given your experience do you think that it should be a red line for the president to keep that in there so that all americans have access to that. >> well, the president put forward a framework that he's confident can pass the house and senate and it's no secret how i feel about family leave and which is why the president campaigned on it and will continue to fight for it. the importance of it it's not -- you know, it's talked about as time off. it's time to do work good work, joyful work and time to do meaningful work but also let me say as a new parent thinking about the difference that will be made by what's in the framework, the universal access to 3 and 4-year-old pre-school, making child care affordable for families across the spectrum and that child tax credit. i mean, that's going to be huge and it will make such a big difference for new parents. >> last question. josh. >> thank you. can you circle back to your other half of the supply chain. on the trucker issue the teamsters have said these truckers should be treated like other stakeholders. do you agree with that? should they be able to unionize? >> we're very pro union. one of the things we're proud of is how this legislation will create more good paying union jobs and truckers who are unionized have more of those protections in terms of their health, in terms of their compensation and that has a lot of benefits in terms of their effectiveness. look, if you have an industry with 90% turnover. 990% year turnover as the larger employers of truckers, clearly an issue with the quality of the jobs and one tool for improving the quality of that job is representation. >> and the president has been silent on the specific call for this. so you're endorsing the short haul truck drivers. >> i don't know if you're applying that to a particular employer, but what i would say is, you know, we believe in what unions can do to enhance the standing of workers in any industry, and -- but also for, you know, for independent truck drivers. i'm very clear that there's an issue with what happens when they get to the gate of a port, for example, and that largely has to do with compensation structures across the industry that are over and above what the union issue speaks to. >> do you think they are still in los angeles and long beach or are they moving in recent weeks as steps have been taken to ease the congestion? >> yeah. we've seen some steps that are making a big difference there terms of moving the containers, 249/7 ops bsz and the bottom line is, others may be following this. it's not that the ports are moving less goods, that they have somehow been less able. they are moving more goods than ever. it's just that it's still not keeping up with the demand. it's predicted an to be an all-time record high and that's enormous pressure and whenever you have enormous brush you'res on that system you'll find the weakest likes in the system and that's why we're focused on l.a./long beach because it has 40% of the containers coming in. anywhere including 1,000 places inland, anywhere in the country you can see these issues. >> are they not the bottleneck anymore? >> it's not a matter of the bottleneck, right, literally anywhere in our economy there's a relationship between a manufacturer, a shipper and a retailer. there are a thousand points in that chain where something can go wrong and we're sewing a lot of those points reveal themselves because of the enormous demand. the constraints on supply and the outdated infrastructure that it all runs across and then the fact that the pandemic is poking holes in all of the above which is why the other thing i think is important to point out, having seen shortages in, you know, started with toilet paper and then it was beef last year. the best way to end a pandemic-related shortage is to end the pandemic, and that's why the vaccine push is so important. >> great. thank you so much. >> thank you. >> thank you >> thanks again. really good being with you. asphyxia from being so packed in together. when there's spacing between individuals, you have individual room to determine where your body goes and to make sure, you know, can you move and sway and breathe comfortably. as crowds get more tightly packed together it doesn't take much for what's happening in one place to kind offal through the crowds so one person trips and falls or shoves against someone and that causes other people to fall and it kind of becomes this -- you know, this chain reaction and that allows people to get packed in each more tightly together until the compressive forces actually prevent you from breathing or sometimes people fall down on top of each other and that becomes kind of a pile-up where really hundreds of pound of pressure can be exerted to people on the bottom and they simply cannot take in a breath. they can't, and their chest wall and that -- that leads to asphyxiation. >> i think you touched on this and what is shocking to me, i should remind the viewers that we don't know yet the cause of death yet for those who died or those hospitalized but the fact that they couldn't believe and this was in a confined space. how are we to understand that in such a big outdoor venue that it can be so suffocating? >> yeah. i mean this, can happen in any setting where -- where you are not -- where there's just way too many people packed in in a small space. any time there's you know, we think of outdoors as plenty of air and plenty of space and as long as you have dead ends for a crowd where people can push up against each other. it doesn't really matter if you're indoors or outdoors. what matters is that bodies can get packed in very quickly. there's forces pushing from the back of our crowd to the front and being transmitted to people that are really up against a hard surface and really packed in there, and it doesn't matter where you are, but -- but if your chest wall doesn't have room to expand, you can't get the air in. >> another scary scenario that i keep envisioning is this description if you fell you probably couldn't get up. it was that tight. sounds like it was really difficult for medical staff to get to those people in immediate of help. if someone is described of oxygen as you describe with chest walls being constructed and/or being pushed down and having all this force on top, how quickly would you need to get to that? >> yeah. there's so many elements of this tragedy that you're pointing out so well which is, you know, what are the things that should have been done to prevent this from happening? how could that have been recognized very quickly by security or event staff, and then did they have it set up so that emergency personnel could be alerted and get into them quickly because you really need to decompress a crowd like that within a few minutes and then you need ways. you need ways, paths in, paths out for personnel to get in and transport out injured people should you get to the point where people are injury, and you're totally right. we don't actually know what happened just because of the crowd dynamic and the way that people who were there described it. i'm guessing some people were injured by traumatic asphyxiation, but it's also possible that there were some -- some blunt trauma injuries that people had simply because of the falling in the crowd pressure, but it would certainly sound like some people were crushed and not able to breathe. >> yeah. we heard people were passing out standing up in fact. those are some of the reports. it sounds like it could have been even worse than it was, and it was so incredibly tragic. doctor tore, thank you so much for your expertise and helping us understand how this happened. >> thank you. still to come, it's day two mm-mmm. no insurance. no. when employees can't enter and manage their own benefits enrollment information, it can be a real pain. not even— nope! with paycom, employees enter and manage their own hr data in a single, easy-to-use software. visit paycom.com and schedule a demo today. in fwampt, more testimony in the trial of three white man accused of killing black jogger ahmaud arbery. gregory mick michael and his son travis along with their neighbor ronny bryan are charged with felony and malice murder and the second prosecution witness, a crime scene technician took the scene today as photos of arbery's body were introduced into evidence. his mother sobbed as video of his killing was shown in court. cnn's ryan young is covering this trial in georgia. ryan, update us on today etestimony. >> reporter: obviously very tough video to watch on friday. today seems like it was just as hard but it was done differently. these are all the backbones of this investigation. obviously you had one crime scene investigator on stand for about an hour talking about how she collected evidence once she arrived on scene. she didn't even realize that trucks were involved when she arrived on scene. we did see some of the graphic photos of ahmaud arbery on the ground and some of the wounds that he suffered from the gunshot and that obviously gave people in that courtroom time and since then there's been a bulk of time being spent with the first officer ricky menchu who arrived on scene and a lot of questions to him how he processed everything as he arrived. one thing you notice from the body camera he didn't put anybody under arrest. he didn't render aid immediately after arriving on scene. he says the reason why he didn't render aid was because he wanted to make sure he was safe because he was the only officer arriving, is and in fact during the break that we just hadshe w wasn't rendered aid until the second officer arrived. and then we saw some more video being played in the court. so that was part that we saw in terms of the turnaround of the truck, the speed up and the shots being fired. the audio was played and that shotgun sound could be heard reverberating through the area. at this point they're going step by step through the process of the officer arriving and initial conversation with everybody when he got there. he started reading back some of the things that he noticed. but take a listen to right now about what he had when he first had a conversation with the three men as he arrived on scene. >> did he say, specifically, that he blocked ahmad during this chase? >> yes, ma'am. >> did he see specifically that he cornered ahmad during this chase? >> yes, ma'am. >> how many times did mr. bryan say that he blocked ahmad or cornered him during this chase? >> after going back and reviewing the transcribed body camera it appeared to be approximately five times. >> reporter: one thing clear so far is none of the men saw ahmaud arbery breaking the law before they started chasing him. we're watching this court cases it plays out and some are getting to the specific questions. >> thank you. the defenses claim that it was an act of self-defense as te tried to make a citizens arrest. let's get some insight from joey jackson. we just heard from one witness in that sound bite. there was another witness today, a sergeant who worked for the glynn county pd and she took photos and the prosecutor shows 60 photos including a bloody sheet covering arbery and that he didn't str anything in his pockets, no weapons no, phone, that combined in the clip from ryan, who is the prosecutor laying out their case with the first couple of witnesses. >> good afternoon to you. i think it is compel testimony. if you look at the graphic evidence depicted there, you want to bring the jury to the scene. they need to be there. they need to sense and see what actually happened. i think that has a major effect. number two, you want them when they see that to hold someone accountable. but i think ultimately if you look at what the prosecution is doing, they're trying to even nullify, right, they're trying to take off the table that there was even this need to use this archaic law of citizens arrest, how. there are three real problems the defense has, you have to demonstrate there was a crime committed. the prosecution is say what was ahmaud arbery doing but milling about at a construction site. what crime are you referring to. if the prosecution is able to blunt the notion there was even a crime, you don't get the benefit of using that law so that is problem number one. problem number two, what the prosecution is doing, is they're indicating that really was there a need for self-defense. that the going to be a critical portion and that is a real hurdle the defense has to overcome and the third hurdle that the defense is going to have is this notion of they needed to do this. well if you are the actual initial aggressor and you start a fight for example and you start a deadly encounter, you don't have the privilege of using self-defense. so those are the three problematic areas that the defense has and i think the prosecution is really bringing the jury to the scene and casting real issues as to whether or not he should have been looking at, or stopped chased or much less a deadly confrontation. >> thank you so much for laying out that context and that perspective and how we could view what we've learned so far. we'll check back with you as more developments happen. and now i also want to update our viewers on another step forward toward normal after 20 months of covid related travel restrictions, starting today international travellers could visit the u.s. for the first time since early 2020 provided they are fully vaccinated. the requirement applies to those coming into the country by air, by land, or by boat. airlines are across europe reporting full or nearly full flights as pent up demand is released. and at jfk, balloons as the first british airways flight landed there earlier today. now to the growing backlash against aaron rodgers after he defended not getting the covid vaccine despite pr-- previously saying he was immunized. he quoted from martin luther king as part of his explanation. >> and i respect his attitude toward being an individual. but this is a team game. and in all honesty, i'm disappointed in his play on words for his explanation. i'm disappointed in some of his selfish actions. unfortunately we have players who think only about themselves and i'm extremely disappointed in the actions of aaron rodgers. >> this is not the time to quote martin luther king. this is deceptive and wrong. >> with us now dr. peter hotez. >> he gave all kind of reasons for not getting the vaccine, if aaron rodgers walked into your office right now, what would you say to him? >> well, i think, one of the worst things he said was he ascribed this to wokeness and he was tone deaf oblivious to the fact that, ana, since june 1 we've lost 150,000 americans who have died from covid who are unvaccinated. 150,000 unvaccinated individuals whose lives could have been saved and not this disinformation and some of the terrible things that aaron rodgers said. and i think the way i look at it is that there is a vacuum here and what is happening is because the national basketball and national football league have been silent, they've not mounted a supportive pro-vaccine message and campaign out there that there is a vacuum. so this is why we're hearing from people like kyrie irving or aaron rodgers, these are becoming the voices of the nfl policy on vaccines. and so i also put at fault the nba and nfl commissioner, the team owners, that they're not stepping up and really putting on this vigorous campaign to talk about the importance of vaccinations to the american people. so there is a gap there. and this is why statements like aaron rodgers' become of inflated performance. >> he's said he's not a anti-vax earther and called himself a critical thinker. but it sounds like he's misinformed? >> well two points. when someone said they are not anti-vaccine, it is like the guy that said toss not about the money and it is all about the money. he's anti-vaccine number one and two he's not critical thinking. he's gone down a rabbit hole of people like joe roggen who tooks about ivermectin and false fake cures so that is exactly the point. he is not critical thinking about any means. he's touting far-right extremist views that if this is not an academy argument, this is loss of 150,000 americans since june 1st who did not have to lose their lives. >> and doctors like yourself have also talked about the questions around fertility that some have expressed as their reason for not getting the vaccine and have suggested that that is just not an issue at all. whatsoever. there is no danger about becoming not able to have kids after having a vaccine like this. but let me turn -- >> well what happened was, the anti-vaccine lobby copy pasted their fake assertion for cervical cancer and which they also said it doesn't have any evidence at all and doesn't make sense. >> and there is evidence to the contrary of people who have gotten pregnant after getting vaccinated. >> yes. >> assin flewen shall people tout this, they find that the covid death toll divide between red and blue america has grown faster over the past month than at any previous point during this pandemic. so this disparity is apparently getting worse, not better. why, and how do you change that?
