big lie, the former acting attorney general. >> the big question today, will any witnesses show up? the former president urged aides to ignore subpoenas. one said overnight he won't show, effectively daring lawmakers to hold him in contempt. cnn's ryan nobles has more from capitol hill. >> reporter: laura, christine, thursday is a crucial day for the january 6 select committee. today is the day where they are expected to have those first round of closed door depositions from two key trump associates. steve bannon and kash patel. patel the former d.o.d. official, bannon a former white house counselor, someone working outside the administration in the lead up to january 6. the big question is whether either of these men will comply with the subpoena request, and the committee has made it clear that if they don't show up, that they're ready to take serious action to force them to comply, including up to criminal contempt referral which could happen before the end of this week if they feel like they aren't getting the compliance they're looking for. >> we're not willing to allow them to play rope-a-dope in the civil courts that way. that's why we're going straight to criminal contempt and expect the justice department, unlike the last one, to uphold the principle that no one is above the law. no one gets to say, i'm not going to comply with the subpoena because i don't want to and there's nothing you can do about it. there is something that can be done, they can be prosecute and had go to jail over it. >> reporter: while the committee is prepping for those interviews both thursday and friday, they're also continuing to cast a wide net of former trump officials who they are looking to glean information from. we are told on wednesday the committee met with jeffrey rosen. he, of course, the former acting attorney general, and they have also issued a subpoena for another high-level department of justice official, jeffrey clark. clark's role in all this is interesting. he, of course, was one of the main trump allies within the department of justice who was pushing for the d.o.j. to use the power of that office to try and investigate election fraud, even though there was no evidence of election fraud to be had. and clark even went so far as to reach out to some states to try and convince them to investigate fraud as well. rosen, of course, the attorney general at the time that clark was pushing a lot of this, rosen turned down clark's entries to try and make that happen. as did richard donohue, deputy attorney general, who has talked with the january 6 select committee. this promises to be a busy couple of days on capitol hill for the january 6 select committee, and we'll see just how serious they are about taking that step of criminal contempt in the days ahead. laura and christine? >> brian, thank you. this is all going to come to a head and fast because at least one witness has made clear he is not coming today. a lawyer for steve bannon, i should say, the former president's chief strategist, he's told the house select committee bannon will not cooperate on documents or testimony because trump told him not to. citing executive privilege. bannon, of course, wasn't part of the executive branch on january 6, making any privilege assertion even more suspicious. plus, the white house has formally rejected trump's request to assert privilege over a set of documents in the case, including white house visitor logs and phone records. it's now up to trump to go to court to stop the national archives from turn being over these documents to the committee very soon. >> as the former president tries to assert executive privilege he's left with a relatively small and inexperienced legal team. more than half a dozen high-profile lawyers who represented trump in the past are saying, no thank you, when it comes to doing so again. cnn has learned some of trump's go-to attorneys are concerned about his election lies and risk help tags for -- reputation for paying his lawyers. those who said no thanks, ty cobb and jay sekulow. they misread the threat leading up to the days of the capital insurrection. local police in washington, d.c. warned other law enforcement partners that january 6 rally attendees were being urged on social media to, quote, come armed. cnn has reviewed an fbi email passed along warning to the secret service about this threat. the document also reveals local law enforcement knew d.c. area hotels were sold out, indicating a large crowd would be attending the rally. all right. to inflation watch now, you have been paying more for just about everything for months, and prices aren't coming back to earth any time soon. the latest figures show consumer prices rose 5.4% in september. a 13-year high. stripping out volatile food and energy, price still rose 4%. gas prices up 42% over the past year. biggest rise in new car prices since 1980. just about every category. and this just in. the federal government saying get ready for winter. americans will spend more to heat their homes this year, especially if you live in a cold part of the country. and social security recipients, because of all these inflation numbers, they will see a cost of living increase of 5.9% in their benefits next year. that's the most in 40 years. so that's good. a bigger check for social security, but rising prices, of course, will offset that boost. the pandemic shutdown was so extreme and the economic boom after so strong that the global shipping web simply broke. the white house announced steps to ease that pressure, but president biden says more needs to be done. >> we need to take a longer view, though, and invest in building greater resilience to withstand the kinds of shocks we've seen over and over, year in, and year out. whether it's the pandemic, extreme weather, climate change, cyber attacks, or other disruptions. pressure growing on the administration to maybe lift authorize tariffs imposed by the former president donald trump as the supply chain problems worsen. trump put tariffs on roughly $350 billion of chinese made goods and american consumers have paid the bill for those tariffs. no indication yet if that is something the administration is considering. >> it seems the white house knows they will get blamed politically for higher prices here, so they want to do whatever they can. >> there are 100 reasons why supply chain is so out of whack, right. but the bottom line is people want something to be done about it. >> all right, coming up for you, boosting the boosters. can you mix and match covid vaccines for a better result? >> elizabeth, thank you for laying that out. as many americans are thinking about getting their booster shots, many are wondering if it is safe to mix vaccines. a new study from the national institutes of health finds mixing boosters may be safe and triggers a strong response. those who got the j&j vaccine may be better off with a booster from pfizer or moderna. an idaho doctor on the front lines of the pandemic said getting covid fully under control is now simply a lost cause. idaho struggling with i.c.u. bed shortages, funeral homes running out of room to store bodies. after months of trying to get hold outs vaccinated, dr. stephenson is surrendering. >> sadly today i'm here to tell you we've lost the war, that covid is here to stay. and the reason it is here to stay is because we cannot vaccinate enough of the public to fully eradicate the disease. >> in arkansas, one of only five states that's seeing death rates spike significantly now, republican governor as a hutchinson is threading the needle on mandates. he says he won't sign any bills requiring covid tests for people who refuse to get vaccinated, but he also won't block them. >> i'm opposed to the mandate by the biden administration, but the solution is not to place additional mandates on employers at the state government level. the solution is not to place the employers in a squeeze play between the federal government and state government. >> all of this follows fierce blowback for texas governor greg abbott who signed an executive order banning all companies from using vaccine mandates in his state this week. all right, the cdc working with states to develop a test to stay covid strategy in schools. director rashel walensky says it is designed to keep students who may have been exposed to covid-19 in the classroom safely. >> rather than students quarantining after potential exposure, that they could potentially instead come back to school, but test so that we would know as they are returning to school on a frequent testing basis that they were safe coming back to school. >> walensky says guidance tonight promising new strategy will be forthcoming. the number of new covid cases among children remains exceptionally high according to the american academy of pediatrics. they account for 25% of the weekly reported cases. the chief of chicago's police union is calling for officers to defy the requirement to report vaccination status. if enough officers refuse to comply, chicago will have a police force operating at 50% capacity or less by this weekend. officers who do not report their vaccine status tomorrow will be placed on unpaid leave in a city where deadly shootings tend to spike on weekends. several prominent labor unions have stood in the way of vaccine and mask requirements, which is just such a shame given the rates of deaths from covid for police officers. >> it's a real challenge for law enforcement. infections and disease and dying of this disease. breaking moments ago, police have been in touch with the suspect in that murderous bow and arrow rampage in norway. we'll tell you why. i brought in ensure max protein, with thirty grams of protein. those who tried me felt more energy in just two weeks! bow and arrow attack in norway over concerns about radicalization. five people were killed. cnn's melissa bell following the story live from paris. what do we know about this alleged attacker? >> reporter: well, what we know is he was a 37-year-old danish national. and what we have learned, christine, over the course of the last hour from norwegian chief of police is not only was he known to police authorities because of his radicalization, although there had been no contacts in 2021 with him, but also that he was a convert to islam who had already therefore raised concerns as a result of that radicalization as i mentioned. that is the very latest. we have also been learning more about the people who were killed last night in this attack that lasted just over half an hour. the man armed with a bow and arrow went on a rampage from a local super market in an attack that spread further across the town to the southwest of the country's capital. five people killed between the ages of 50 and 70. four women, one man who died as a result of those arrow wounds. two people also wounded. this is a terror attack that is all the more shocking in a country where these sorts of attacks are extremely rare. you have to go back ten years to 2011 to that far-right extremist rampage that killed 77 people, another attack on mosques also by a far-right in 2019. this is not a country that is used to islamist terror attacks like we saw last night. we know, therefore, of his radicalization, waiting to find more about why he went on the rampage when he did, christine. >> melissa bell for us in paris reporting that story out. thank you very much, melissa. now to this. a possible hijacking and sniper fire on american troops. those are some of the more harrowing new details we are learning from the final days of the war in afghanistan. members of the air force received intelligence that five people aboard one of the evacuation flights planned to hijack the plane. now, it's not entirely clear how this issue was resolved or what happened to those five people. also at the kabul airport, an officer came under sniper fire as rescue squadrons helped secure part of the airport to provide medical treatment. okay. coming up, turns out even a seat on the u.s. supreme court doesn't mean you won't get talked over by a man. what one supreme court justice says the highest court is doing about it. next. welcome back. some call it a liberal fever dream. others say it should become reality. packing the u.s. supreme court with more progressives while president biden is in office. today a white house commission set up to study the court is set to relesion draft materials. the commission was established back in april partly as a compromise with liberals still angry that merrick garland didn't even get a hearing for his nomination to the court. and they want a more balanced approach on the court with a bench not dominated by conservatives right now. the white house has said that the commission's purpose goes beyond just the number of justices, but also examines term limits and altering the court's case selections, rules and practices. cnn's joan busasked justice bre about this yesterday. >> i've seen the court over 27 years to try to explain a little bit of its history so that people understand it's always been controversial. and how difficult it is to get people to accept rules, the decisions that they are really wrong, and yet if they don't, we won't have a rule of law and it will be harder to hold us together. before people make major changes in the court, i would like them to read or otherwise understand what i've written and to think about it pretty deeply. and it is an institution. i'll just repeat this. it's an institution that, fallible though it is, over time has served this country pretty well. >> supreme court justice sonya sotomayor said the court changed its format for oral argument after studies showed female justice were interrupted by male justices and advocates. sotomayor said the study had an enormous impact and led to chief justice john roberts to be more sensitive to make sure people were not interrupted. >> regrettably, that's a dynamic that exists not just on the court, but in our society in jen. most of the time women say things and they are not heard in the same way that men who might say the identical thing. >> a change in oral arguments has been clear now that the justices are back in person. so far even in conscientious cases, the justices have not cut each other off. >> even the supreme court justices. >> leave it our top stories to keep an eye on today. the house committee investigating the capitol riot serving a subpoena on one former top justice official who pushed then president trump's election fraud lie and interviewing another d.o.j. leader who pushed back against it. more on all this in just a moment. an fda panel of vaccine advisers is set to tackle the next round of questions concerning coronavirus booster shots today. they're going to focus first on the moderna vaccine which several studies show provide stronger protection. the tsa calls it a huge problem. record numbers of airline passengers trying to bring guns through checkpoints. most of them loaded. so far screeners have caught nearly 4700 firearms this year, 4400 were caught in all of 2019. yikes. and the expansion of wind farms along nearly the entire u.s. coast line. the biden administration now plans to lease federal waters to wind power developers to 2025. this is the first long-term strategy to reduce electricity using offshore turbines. there were nearly 97,000 drug overdose deaths between march 2020 and 2021. the first year of the pandemic. according to health data, that's a 30% increase from the previous 12 months and the largest single-year jump ever. four american gymnasts are asking congress to dissolve the board of directors for the u.s. olympic and paralympic committee over its handling of the larry nassar sex abuse scandal. simone biles, alley rice man, mckayla maroney and maggie nickels claim the committee learned of nassar's abuse in 2015 but did nothing about it. the usda urging packaged prepared foods to cut down on salt. the agency says 70% of salt intake comes from sodium that is added during the manufacturing process by salt consumption, can lead to cardiovascular disease and high blood pressure. the rolling stones will no longer perform one of their biggest hits, "brown sugar." stone's frontman mick jagger and keith richards say it depicts the horrors of slavery. it has not played it on its current no filter tour. one pushed the big lie. one stood in the way. both now of interest to the january 6 committee. house investigators have subpoenaed former d.o.j. official jeffrey clark. remember him? he's the guy who was so desperate to get in trump's good grace that he drafted a letter that no one with any sense would have signed, claiming that the justice department found voter fraud in georgia, even though it had not. one of those who stood up to clark and the former president, former acting attorney general jeffrey rosen. cnn has learned the committee interviewed him for eight hours wednesday. and today time is up for two allies central to this investigation. deposition for kash patel and steve bannon are on the schedule for today. bannon has already said he is a no-show, risking criminal contempt. it's time for three questions in three minutes. let's bring in cnn political analyst. margaret, the subpoena for jeffrey clark who pushed the nonexistent election fraud of president trump, what does this say about where this investigation is going? >> well, good morning, christine. it certainly says that the committee is trying to piece together a time line of precisely how these efforts to try to create the notion of fraud or create that sort of doubt, how they came together. there's a couple interesting things to remember about jeffrey clark. one is that he's a lawyer, so he has met the bar, right, in various states and jurisdictions. he can't really play this the same way steve bannon would because he wants to continue working as a lawyer. he'll have to cooperate to some extent, but how full that cooperation will be we'll see. there was interest about clark installing jeffrey rosen as the acting a.g. in the waning days. there's another figure being called back by the committee. it's kash patel. we mentioned his name before. remember he was an intelligence official. trump had a plan as well in which they would have installed kash patel as the deputy director of the c.i.a. and this was so controversial internally as we have reported, regina haspel found out about this, was deeply concerned she would resign and they pulled the plug on that idea. >> i think the big question for the house is just how much do they want to drag this out, if these guys actually defy the subpoenas. it is unclear whether clark will come. we know bannon isn't coming. they want to hold him in criminal contempt, but how long do they want to drag this out. margaret, i want to pivot here to the governor's race in virginia which is heating up and perhaps something of a bellwether for the country. both sides pulling out their heavy hitters. president obama and others, of course, for terri mcauliffe, while president trump, the same guy who just told people not to vote, is calling in to rallies to praise glenn youngkin. clearly whether that's supportive of glenn youngkin or not, how do democrats frame their message in a way that is actually responsive to the threats of 2022 and going forward, if you will, if we actually think about democracy in peril? how do democrats convince voters this is a real issue? >> i think in virginia what terri mcauliffe hoped to do was make this about donald trump. they imagine trump pulling the strings. glenn youngkin tried to distance himself from trump just enough that he can capture that suburban kind of centrist swing vote. you'll remember biden won by a really big margin in virginia in 2020. and it was partly because he wasn't president yet, but largely because he wasn't donald trump. so, youngkin's successors say i'm not donald trump. he tells republicans to not turnout to vote, that is' not what glenn youngkin wants. terri mcauliffe will be glad to have it back. you'll see barack obama come in and try to turnout younger voters, voters of color, suburban voters with whom he's popular. it's a matter of turnout and saying, let's focus on government solutions and for youngkin it's a matter of trying to keep the focus on, you know, dissatisfaction with biden and dissatisfaction with school instruction right now. not donald trump. >> i think the democrats underestimated the school issue and how that was such a real, a real tinder box for people in virginia and elsewhere. margaret, the president, though, is in a bind now. covid wrecked the supply chain. inflation running at a 13-year high. it's not coming back. for now it's going to stay like this. gas prices have doubled. it's not biden's fault, but americans want relief and they expect him to do something about it. does he risk being blamed here for a lot of things frankly out of his control? >> of course, he's the president of the united states. it's like the buck stops here, right? so that's why you're seeing biden hold these summits or convening discussions on supply chain, pushing really hard for the ports to reopen 24/7 to allow the flow of goods. what he can do is limited but he can still do things and he needs to be able to show voters that he's trying. but all these, you know, you think about the economy as the driving force in elections always. all of this is about the pandemic, economy, and the hang over from the pandemic. plus, guess what, the pandemic is still around. a lot of people voted for joe biden because he said, i'm going to be able to exercise common sense and talk about science and the pandemic. and there is such a large resistance by just enough people that it's made it very hard to stop it as long as the pandemic lasts, a lot of these other lingering issues are going to last. unless he can turn around -- the only reason virginia might not be a bellwether maybe is if a year from now the country is in a really different situation in terms of infection rates, hospitalizations and the economy. but it is a warning. biden will get a sense of how people's frustrations about the economy and how it impacts the pandemic, how it impacts schools, health, being able to get stuff from stores that you want. we'll see the beginnings of that play out in this virginia race and it will be a warning for him for next year. >> it will be telling either way. margaret, thank you so much for getting up with us. appreciate it. >> nice to see you, margaret. >> thanks, guys, you, too. american airlines is taking a different approach to vaccinate their work force. they have 90% of delta employees now vaccinated. that's without a mandate from the company. >> we haven't done it with a mandate. we've done it working collaboratively with our people, trusting our people to make the right decisions for themselves, respecting their decisions. but at the same time, avoiding the divisiveness of what the mandate is posing to society. >> he says he expects delta's vaccination rate to rise to 95% by early november. united airlines took a different approach. you need the vaccine to keep your job at united. >> i wish we had gotten to 100%. out of our 67,000 u.s. employees, there are 232 who haven't been vaccinated and they are going through the termination process now. >> earlier this week a federal judge in texas temporarily put united's vaccine mandate on hold for employees seeking medical or religious exemptions. roughly 2,000 of united's employees requested an exemption. now to a disastrous situation for parents in indiana. the walgreens mistakenly gave their children covid vaccine instead of flu. they took their 4 and 5-year-old kids with them to the pharmacy for their yearly flu shots. they later learned from walgreens the entire family had been in jjected with adult dose of the pfizer vaccine. the pfizer vaccine not approved for kids as young as their kids. for the parents the extra dose was basically just a booster shot. but the family's attorney says the children have had to see a pediatric cardiologist for a rapid heartbeat. elevated blood pressure and other things. walgreens has not commented on how this mix up happened, but it is not good. >> no. all right, 40 minutes past the hour. into the lion's den for sanjay gupta. he navigated an extended conversation with podcast host and avowed skeptic joe roggin. he refuses to be vaccinated. the two talked for more than three hours. roggin revealed he was prepared at one point to get the shot. it got delayed. rare issues emerged with johnson & johnson and he changed his mind. >> sanjay confronted him on covid issues and kids. challenging him on common misconceptions out there right now. >> we can know long term stuff for certain. that's terrifying for parents. >> it is. >> the idea your son could get vaccinated and most likely he would have been fine if he got covid, and that your son could catch myocarditis and have permanent hafrt problems. >> well, i don't know that we can say the person will be fine if they get covid, joe. >> a young boy? most young boys with no comorbidities -- >> you say fine, you mean they're not going to die? >> like me, i had covid. i'm fine. >> you look like you're as strong as an ox. i give you that. but you get teenagers who will have these long covid naps. you get -- >> what does that mean? >> they're tired all the time. they get these sort of long hauler type symptoms. less so in kids. you talk about 33% of people having persistent symptoms that last months, i feel like -- i think we're allowed to have ainuanced conversation about this. >> sanjay and joe roggin may seem like an odd mix. he needed to go to a less comfortable place to share with people who may not have already >> reporter: well, the reason is russia is the biggest single supplier of natural gas, household gas to most european countries and most european households. and that natural gas price spiked upwards of 250% in the last several months. the home heating costs is having an impact on industry as well. factories that produce steel or anything like that, they use electricity, energy for gas-powered stations for the most part. an enormous amount of spike in costs and derailing to a certain extent the post-covid recovery. in terms of russia's responsibility, the finger of blame is pointed at moscow for sometime to increase pressure on the europeans to make it more dependent on russian energy. it's all linked with the production, with the implementation and the building of a new very controversial russian pipeline called north stream 2 which has already been built between russia and germany, bypassing some transit countries that would have benefited from that pipeline in the past like ukraine. critics say that will increase the energy dependence on russia. they say nonsense, it's just a business deal. they said if the pipeline is approved by european officials when the spigots are turned on, then the european gas crisis will essentially be alleviated. and so they're saying they're not using this energy as a threat, but they are also reminding europeans just how much power the kremlin has when it comes to supplying the european nations with their natural gas, laura. >> matthew chance, thank you so much for breaking that all down for us. time to look at markets around the world thursday morning. hong kong closed for a holiday. european shares opened higher. on wall street, stock index futures at this hour are moving higher as well. stocks closed mixed after a key inflation report showed prices for consumers are still rising. the dow fell slightly, the s&p 500 and the nasdaq closed higher. we also saw minutes from the fed reserve's last meeting showing it will likely start cutting back on bond purchases later this year. more earnings rolling in this morning. bank of america and citigroup, morgan stanley will report results. foreclosures are resuming across the country. lenders started the foreclosure process on more than 25,000 properties last quarter. that's up 67% from a year ago. relief programs allowed borrowers who are having trouble making their payments to delay them for up to 18 months. those programs are now ending. one executive at realty track said foreclosures are still far below normal, but hundreds of thousands of borrowers are scheduled to exit their forbearance programs in the next two months. that could lead to a higher number of people defaulting on their loans. a newly we had couple has a real beef with southwest airlines when southwest canceled more than 2,000 flights last weekend. the bride's family including her mother and father missed her wedding in nevada. instead, kimberly romano's parents had to watch their youngest daughter get married via face time. the new bride and groom will be guests or "new day" in the 8:00 hour. all right. brooklyn nets star kyrie irving defiantly refusing to get vaccinated for weeks now, and he's breaking his silence. andy scholes has more on this morning's bleacher report. andy, what is he saying?
