good morning. i'm erica hill. >> and i'm jim sciutto. we begin with breaking news. there's lots of it this morning and it's good use. pfizer has applied for emergency use for its covid-19 vaccine for children aged 5 to 11. this means we could be just weeks away from younger kids getting the shot, perhaps even before halloween. >> boy, would that be some good and welcome news. the white house is calling this a, quote, really important next step in the fight against the pandemic. here to join us is dr. leana wen. good morning. you have an article in the "washington post." you say, number one, shots for younger kids. this could be sooner rather than later, which, of course, is good news. in learning this, do you think changes could come? could this official request for an eua, could that change the time line at all? >> i really hope not because the fda has already said that they're approached authorization for the vaccines for 5 to 11-year-olds with urgency. this is the reason why they already set an advisory committee meeting for october 26th, pending pfizer submitting their application on time. submitting it now, today, gives the fda enough time to review the data, and i think there's a real possibility we could have the first shots going into arms by the end of october if all goes according to plan. we have to remember, too, in theory, it's possible the fda could come back and say, we need more data or that maybe only a smaller group of children, perhaps those with higher risk may be immediately proved. this is not a given, but i do very much trust the fda going through a rigorous and careful process to ensure safety and effectiveness. >> dr. wen, i'm eager for my children to get this vaccine as well as myself. it is understandable that some parents might be less in a rush to do so for their kids than they would for themselves. so for folks watching at home, tell us what the data has shown us so far for children with a vaccine at this age? >> right now all we have is the pfizer press release on it. we have not seen the data, which i think many of us as scientist s and parents are eager to see. it's tested at 10 micrograms less than that given to adults and 12-year-olds and above. there are no new side effects appearing in this younger age group. also they're finding there's a strong antibody response, and that's been found to correlate very well with immune protection. all of that is very good news, but we need to see the data. i think it's okay for parents to wait and see. we want to wait and see what the vaccine shows. let's let the patients who are eager to get their kids vaccinated get the vaccine once authorized. we want parents to live a normal life. there are many including me and my husband who are living unvaccinated because we want to protect our children. >> which is so important and so understandable. one of the things you talk is the importance of testing. this is the place as you know where the u.s. has lagged when it comes to accessible testing since the pandemic, the biden administration, of course, pledging another billion dollars. they're working on getting a rapid at-home test, making testing at home more readily available. how much of a difference would that make if more readily available? >> i think testing is the most biggest missing component. i think we need three things to get us past this pandemic. i don't mean for us to get rid of the virus, but to live with the virus. one is getting the vaccine, two, a pill, we have a potential pill by merck that may be able to do this, which is fantastic news. the only way early treatment works is if you have testing. you can't wait for days to get a test result. by then it's too late for treatment. the spread is by iowa sympts iowa symptomatic individuals. some countries have so much testing, they have it free if you want to. i would love to see the fda offer a moon shot and put as much testing as we did into vaccines and say every american should be able to get a test at least twice a week for free. >> that would be something. hopefully they're listening to you. dr. wen, good to see you. thank you. another big story we're following this morning. the senate judiciary committee has released a stunning report. it details over how many days and how many officials donald trump and a lawyer attempted to do this over the course of the election. this morning dick durbin tells cnn those efforts were almost successful. >> we were a step away from a national constitution, a full-blown constitutional crisis. >> this all comes as former trump aides are set to defy a subpoena. we're going to have more on that in just a moment. first let's talk about this new senate report. what else does it reveal? >> erica, it really gives a window into this extraordinary, really astonishing week and a half at the end of december, early january, when top justice department officials at the time were under tremendous pressure by the fort r former president to trite to get the justice department to weigh in, help his efforts in overturning election results in key states. among the things we learned is trump was calling in daily to the acting attorney general, jeffrey rosen at the time, richard donoghue, his deputy. trying to say his justice department found some irregularities even though they had not found that. we know mark meadows, his chief of staff was calling always well, trying to get the doj some outlandish actions. we have jeffrey clark who with as lower level official in the department and somehow got in touch with the president and was threatening to stage a coup of his own leaders. he wanted the department to send letters to georgia saying they found irregularities, all of this to try to find time and sow doubt before january 6th. one of the things we learned from the republicans is trump listened to officials. what that overlooks is how close we came. and if it was not for these people standing up and threatening to resign, for instance, perhaps january 6th could have turned out a lot differently. >> evidence is mounting. evan perez, thanks so much. jennifer, if i could begin with you, the ongoing frustration is you see a laundry list of the former president's efforts and advisers to overturn the election at every level. state legislator, justice department, and beyond. and yet none of the ringleaders have suffered any legal consequences at this point. you had dozens storm the capitol who are in jail. but nothing's changed. is evidence like this going to lead to charges? >> it's hard to say, jim. we know the more we know, the worse it gets. i think the problem is the only way for president trump or anyone to be responsible for this in a criminal sense is for the justice department to prosecute them. we haven't seen that merrick garland has had an appetite to do that. nor has he at least that we know publicly started any investigation at all into those people for what they did in trying to overturn the results of the election, which are potential criminal offenses. so it remains to be seen. there's still more to learn. i just don't know that merrick garland is going to do that. >> that seems to be the sense because there was concern about how any political action would look. i just sort of wonder what's the chatter in washington about this because i think jennifer las it out so well. that's the conundrum that we're seeing. and also that things get so cl close, but yet they're so far away. >> yeah. it's hard. he tries do so. the fact that it didn't happen doesn't dismiss the real attempt to overturn a free and fair election by a citizen of the united states. it's important, i think, as we look at this. this is not just a piece of history. this is still a live issue, right? donald trump is still out there selling the lie that this attempted coup is based on. he's endorsing candidates in local races and state races who will have control of the ma cheechbry. there are allies that are trying to change the law in states about how elections will be conducted. are we sure the next time around it will be a failed coup or will it work? >> he may run again. he may have a chance to win in the next election. which of the various investigations going on right now -- you've got the house select committee, in georgia at the state level. do you expect to deliver charges? >> that's a tough question. certainly the investigation in georgia seems the most likely to lead to criminal charges against donald trump. we of course, the manhattan d.a.'s charges. it's hard to say. the standards of proof in criminal law are very, very high. you really have to have proof beyond a reasonable doubt to proceed, and so it's just -- it's hard to say, and i think there's a lot of what we don't know. there may be more charges. we know right now he goes to the edge as far as the georgia call, he'll say, please commit this crime for me. >> to that point, too -- and this is what republicans pointed out. he never told anyone to do anything illegal. david, this is really a pattern of bank that the president had long before he held office. this is how he does business. >> without a doubt, erica. this was completely in line with his character. i understand from the legal perspective of whether ott not he climbed the line. when your own officials at doj and own white house counsel are basically calling this a murder/suicide act and all of these folks are going to quit and leave, to think the president is not discussing that's completely against the grain of our constitution would defy reality. i i do this there is this conversation about how do you avoid being come completely backward looking? i don't think we have a clear answer from that from biden's dj yet. >> we'll watch out for more fallout. thank you. up next, a federal judge blocks the new anti-abortion law in texas for now. how long could that ban last? >> reporter: immediate crisis averted for now, but the long-term issue is still going to be an issue come later this fall. what they've agreed to, according to senate majority leader chuck schumer is to expend the debt ceiling to december. remember, it could have had dramatic ramifications across the u.s. economy and the global economy. chuck shumer and mitch mcconnell have been discussing it. they've agreed to extend it to early december. what does that mean? the house then will take it up. the house is now on recess, so they may have to come back next week early. we'll see if they do that. vote on this. it will go to joe biden's desk and sign it into law. and then they'll have to figure out how to deal with it in the long term. the republicans and democrats have a disagreement about raising the debt creeling in the long term. they'll have to resolve that or we'll be become here in two weeks with the two sides staring at each other. at least there's not going to be a crisis right now. we'll see if there's a crisis in a couple of months. >> manu, the question is the conversation long enough to give democrats the chance to reach agreement on the infrastructure and their budget? >> reporter: that's what the democrats hope. they said this would give them some opportunity to get their larger package done, how to deal with this expansion, social safety net, the infrastructure bill, both of which they're trying to get done within the next month. if they're not able to raise the debt ceiling, there would be so much at stake. there are questions about how they would actually go about moving to increase the debt ceiling and go through a budget process that would require them to specify the level to which they would extend the debt ceiling. democrats don't want to do that. they would rather suspend it for a couple of years, but republicans don't want to give them the votes to do that. those are the questions they're going to have sort through. this is what capitol hill does often, guys. they kick the can down the road and that's clearly what they're doing here. >> that's one thing they do very well. joining me now, the former chief of staff to house speaker nancy pelosi and the former deputy chief of staff for senate gop leader mitch mcconnell. you know, just before the break, we didn't know if we had a deal, but here we are. we're still in the same place as manu just laid out as we were. so we're pushing this now, right, to early december. the reality is this could line up with issues of government funding. how important is this that it gets sorted in time? >> it's absolutely critically important. you know, unfortunately leader mcconnell has been on all sides of this issue. he's been on the side of we cannot play chicken with the debt ceiling. he's been on the side of i'm going to use all my power in order to extract something from democrats, and the latest is to be on the side of reconciliation. look. this is not a game. they are attempting to use a political add here. they're trying to create a political ad against democrats while playing with the economy of the united states. i think it was wake jaup call for republicans and the senators were becoming a bit queasy about this. this fight should not be. democrats in the past have supported suspension of the debt ceiling for republican senates under republican control of congress, but now it seems like republicans really enjoy this to try to extract something. at least this crisis was averted. >> crisis averted for now. when you look at what happened, specifically what happened in the last 12 to 15 hours especially, what do you think it was for leader mcconnell, based on your experience working with him? was it all of a sudden he's concerned about default, or is this really about the filibuster? >> no. for a long time it was about who or what was involved. there was never a question that they would increase the debt limit. i think there's been a bit of a misunderstanding. ultimately what mitch mcconnell was looking for was getting debt limit across the finish line, which is typically what's done. and he wanted it to be done by increasing a number, voting for a hard dollar increase, and both of those will be part of this short-term exercise. the use of the reference to budget reconciliation was, quite frankly, a means to an end. by nature, they're a partisan skper sierks and you can only vote to change numbers. you can't vote to change dates. it's not the procedural hurdles that were of interest. maybe there was a plan to slow it down. it certainly wasn't going to get resolved next week. that wasn't going to get in the way of the broader fight. >> the reality is this is for both sides turning into a lot of politicings, a lot of americans at home frustrated for what's being used as political messaging. the can is being kicked down the road. the beautiful news is the hard part we lose a little time for our segments. that's all we have today. we'll have you both back. thank you. this issue not going away. jim? another big story we've been following in the last several hours. news from texas. women may once again be able to get an abortion in texas, this after a federal judge temporarily blocked the state's restrictive abortion law. that law prohibits abortions after a fetal heart beat is accepted. that's usually after six weeks. no exceptions for rape or incest. it allows private citizens to sue anyone who helps with an abortion. this motion is temporary for how long does it last. >> it's temporary, but it also means it's likely to be headed back to the supreme court. it's been months since women have been able to get this procedure. most women don't know they're pregnant. the department of justice brought this to full light. the judge went after texas for the way they tried to avoid judicial review, and then he had interestingly strong words. the appeals court. he said, from the moment sb-8 went into effect, women have lost control of exercises protected fwi u.s. constitution. others may find a way to avoid this conclusion if they decide. this court will not sanction one more day of this deprivation of such an important right, so it is going to be appealed now to the fifth circuit court of appeals. they could very well reverse this judge. >> so among the interesting things about the way this law was written, one was the idea that private citizens could sue. the other is this kind of retroactive dr if a clinic were to open today, what might happen to them later? >> well, the guard responded by responding to the lieutenant governor that they're not a law enforcement agency and no call for emergency support had been put out by the state of arizona. she tweeted a day after reminding people, no, i didn't order the guard or deploy the guard, and i asked for information. certainly when she knows the governor is going to be leaving the state and she's asking for that information, it's a loaded question, right? and so that's what she did. >> she appears to be outtrumping the sitting governor. i wonder. how do voters in idaho react to this? do they support her? >> there is a large swath from all parts of the state really. you see some of this divide between republicans playing out on school boards and at other more local politics across the state. they come from two very separate wings of the republican party. brad little is old school, moderate republican. his family has ranching ties to this state. he was lieutenant governor prior to winning the government election in 2018. and mcgeen is from idaho as well. she was the vice chair of the trump campaign here in 2016, and so that divide plays out all across the state and it will certainly be interesting to see what happens come the republican primary next may. >> that's for sure. they're running for those offices separately. is there support for her policies or support for, you know, we have, you know, more than one occasion where the governor has left the state and she is for obvious listens in charge and she makes these quick moves to exert power. is it the support for the power moves or the support for the platform, i guess i should say? >> i think it's a little bit of both. she did this previously in may. the governor went out of state on business to a conference and very quickly it seemed like mcgeean had an order red. it was repealed when he returned in 24 hours. he was shocked. describes it as tire tyranny. she fund-raised off that action several days after it was overturned. there's also support for those policies. people here have pushed back strongly in some ways on mask mandates. some have push backed on the vaccination main dates as well. >> that's the power, right? people? >> shooting them with 40s. >> those officers used 40 millimeter non-lethal rounds. meanwhile this body cam video that we just showed you is a clip from two hours worth of body camera video that was released by an attorney representing jaleel stallings. jaleel was acquitted on all charges of firing a gun at minneapolis police officers after he fired at them first with those non-lethal rounds. the attorney representing staal ling said he wanted to release this because it contradicted what officers initially said. meanwhile cnn has reached out to the minneapolis police for comment.
