Of course, it was the first major political contest since democrats took control of the white House And Congress just eight months ago. A potential Litmus Test for the partys messaging ahead of the midterm. Cnns Stephanie Elam is following it for us. They did not end the night with the typical celebration. Reporter no, he didnt. The fact he was in this position is note worthy in and of itself to many, erica and jim. If you look at how the counties performed, im in Orange County which traditionally has been a republican strong hold, that has been changing as the demographics have changed here. Just taking a look at what needed to happen for the republicans. They needed the republicans to turnout in this county. I can tell you 49 of the registered voters turned out. They have 1. 8 million registered voters here, and the numbers in this County Broke in gavin newsoms favor. That is not whAt The republicans needed. They needed more of that republican turnout to take this tide the other way. Thats why you see newsome walking away with a 21 victory in this case. Larry elder, of the people who voted here, he had more than 57 of the vote. If there was someone to replace him. So you heard larry elder, what he had to say, it was also addressed by Governor Newsome about whAt This means right now for where politics are in the country. Take a listen. We may have defeated trump, but trumpism is not dead in this country. The big lie, January 6 insurrection, all the Voting Suppression efforts that are happening all across this country. Whats happening, the fundamental rights, protected rights of women and girls. Its a remarkable moment in our nations history. Reporter its also worth noting here in Orange County the vast majority of the people voted by mail. We did see a lot of people who were standing in line Last Night to vote. They wanted to make sure their votes were actually counted. Thats why they wanted to do it in person. I spoke to one woman who didnt want to tell me which way she was going to vote. She thought the recall was a good thing. This way our elected officials are held accountable. When they dont do what people need them to do, they can make their voice known. Erica and jim . Kylie, how is the biden administration reacting to what we saw . Reporter well, the State Department this morning through a Spokes American is condemning the actions of North Korea. Of course, as you guys said, we had missile launches overnight from both North Korea and South Korea, but the united states condemning those by North Korea, noting thAt They are against all u. N. Security council resolutions with regard to North Korea. Weve also heard from endo papcom, Pentagons Arm in the region saying the missiles launched by North Korea dont pose an immediate threAt To u. S. Personnel or u. S. Territories, of course, but they are continuing to monitor the situation there. We should note that what North Korea did is an equivalent to what South Korea did. South koreas launches were much more advanced. They came from a submarine. That demonstrates how far advanced their missile program, their nuclear capabilities are over North Koreas, which has been trying to work on their program, of course, for decades now. Now, this does complicate things, however, for the biden administration. Things with North Korea hadnt been on the front burner when it comes to the Foreign Policy challenges of this administration. But what North Korea is doing here does put it front and center. And we should note thAt This comes just about a week, two weeks ahead of the u. N. Security council excuse me, the u. N. General assembly in New York. Thats when all World Leaders are expected to come to New York to discuss matters around the globe. Because of covid, all the World Leaders arent going to be there, but the conversations are going to happen. They will happen by virtue of North Korea doing this. It is asserting this self in the conversations and the days leading up to it to remind World Leaders North Korea shouldnt be something thats considered on the back burner. This is a very volatile situation right now. And it is one of the most dangerous areas of the world. Kylie atwood, appreciate it. Well continue to monitor. This Morning Joint Chief Mark Milley called to resign after a book by Bob Woodward and richard kosta. They were worried trumps actions to lead to war with china. He wanted to make sure there were no attack. Deeply shaken by the insurrection and trumps support for it, quote, were certain thAt Trump had gone into a serious mental decline in the aftermath of the election. With trump now all but manic, screaming at officials and constructing his own alternate reality about endless election conspiracies. Joining us now to discuss what was truly an alarming moment in our countrys history, cnn special correspondent jamie, former Nato Director wesley clark. Good to have you on. Jamie, we already knew this was a tense precarious time in the history of the american republic. And here you have the most senior uniformed Military Official in the country so concerned about trumps mental state that he felt the need to reach out to china to avoid a war. Tell us your reading of this. There are two things to keep in mind here, and that is that four days before the election, when the first Phone Call happens, General Milley, according to Woodward And Costa, is getting intelligence that china is worried thAt Trump is going to pull or wag the dog. Try to do something to cause chaos to overturn the election. The second Phone Call happens after January 6th where milley again understands that not only is china nervous. Woodward and Costa Quote Him as saying, quote, half the frigginworld is worried. This is not an unusual thing to do. He was not only talking to china. He was talking to allies. Everyone was worried about what was going on in the united states, and certainly after January 6th. You point out those concerns. We know that Woodward And Costa also wrote in the book that whether or not he went too far, right. He believed his actions were good faith precautions to make sure there was no accidental war. As we know this morning, there are calls for General Milley to resign, from both Senator Marco Rubio and lieutenant alexander vindman. We cant have the senior Military Officer Acting without any oversight, exceeding his authorities, without civilian control. The guardrail is not an individual. The guardrail is a system, an institution. Its multiple officers doing the right thing. In this case whats clear to me is frankly chairman milleys tainted by all these things Lieutenant Colonel, pardon me on parting with that one. When you look At This, his take is very clear. Putting all of this into context, im curious if you think he went too far or when is the right time, when is this check necessary . Well, look, the senior Military Leaders all talk to each other internationally all of the time. Theres continuing network of consultation just as jamie said. The ability to reach out to other Military Leaders, those who are friends, those who are potential adversaries, and check the temperature, tell them what it feels like to him, and keep that relationship going. We want our military to have international relationships. And so in this case, although i certainly respect Lieutenant Colonel vindmans actions in the impeachment issue, he just doesnt have the Experience And Knowledge to know how this works. I think milley was totally within his responsibilities and frankly, he would have been derelict if he hadnt done this. I think hes got a huge Support Base here among those of us who know how The System work. General clark, just on the same topic, the thing about that moment is it was not isolated. It was part of a pattern. When i was reporting out my own book a couple years ago on trumps Foreign Policy, i was told that during the tensest times with North Korea, but also with iran, that u. S. Diplomats reached out to their counterparts on the other side to calm things down, to say, dont listen to the tweets. In effect, were not going to war with you, North Korea. Were not going to where with you, iran. Given that pattern, right, i guess the question is does it matter thAt These were uniformed military as opposed to civilians . Because the famous Defense Secretary Schlesinger moment with Knicksing In nixon, the strike goes through me. Those are civilian leaders. Does it make a difference these are uniform as opposed to civilian . Military brought more weight than civilian leaders. General milley had more weight the way the chinese see the united states than had Secretary Pompeo called. In the u. S. , the military is always responsive to Civilian Oversight and control, but that doesnt General Milley, hes the chief military, hes the leader of all the militaries responsible. Not only to the president to provide Military Advice and the secretary of defense, but also the congress. So he was totally within his rights, so was House Speaker Nancy pelosi in that conversation thats reported in the book. Milley is doing the things he should be doing as an officer appointed in that position. So i think it is whats unusual about it is to have a Commander In Chief who is so out of control. I thought as i read the excerpt from the book, honestly, that milley was being generous with his assessment of President Trump as being someone who was mentally unstable. I thought it was more a pattern of someone who is simply very determined to have his way, doesnt have any respect for constitutional safeguards. When milley, who is a very thoughtful guy and a man who is well read in history, sees these events up close, of course, he relates them to other historical circumstances that have led to disasters for democracies. You talk about, general clark, the picture you see of someone like President Trump as someone who wants to get his way is further exemplified in this accounting of the meeting in the Oval Office on January 5th between him and vice president pence, jamie, where the pressure continues, right, from former President Trump to have Mike Pence do his Dirty Work on January 6, which he resists. One part that stood out to me, he says, no, no, no, trump shouted according to the authors. You dont understand, mike, you can do this. I dont want to be your friend any more if you dont do this. This is a remarkable scene, erica. We knew thAt This meeting happened, but Woodward And Costa have the details of the conversation. And just to give you the setting, the two men are in the Oval Office, and they can hear the maga, the trump supporters out on the street on pennsylvania avenue, laughing, shouting support. And trump repeatedly Pressures Pence to do something that is unconstitutional. It is just a fascinating dynamic between the two of them thAt Then Woodward And Costa report, continues the next day where he calls again weve known about The Call, but in The Call the next morning, he says to pence, youre going to wimp out. So, elizabeth, you have this debate about the necessity of boosters and its interesting because there is new data out that says its particularly the older or folks with comorbidities that see waning immunity. I wonder where you see this debate come down. Jim, i think its really anyones call right now. Talking to folks who are members of this Fda Vaccine advisory committee, they really dont know whats going to happen. They say thAt This has gotten pretty messy actually. Its becomes contentious, this Booster Shot program. And even theres some bitterness with President Biden saying essentially, lets start a Booster Program. And scientists saying, hold on a minute, dont talk out of turn, mr. President. We need to hear about the science first. So lets look at whAt The science says. So, on friday these advisers will be presented with studies from the u. S. In qatar that show they successfully prevent covid19. It says two shots prevent it well. Israeli data says its not so great protecting against covid19. Israelis have data that show a Booster Shot, third shot, does help protect against severe covid19. And there is a whole other layer here, and that has to do with infections. I bet, jim, erica, you two both probably know people who were double vaccinated, but still got covid. I know that i know people like that. But they didnt get very sick. And theres one camp that says, who cares about those people. Doesnt matter. Not who cares, but it doesnt really matter. They got a little bit sick. Theyre fine. They didnt end up in the hospital. Another camp says, wait a minute. Infections can portend hospitalizations. You get a lot of infections. You will later get a lot of hospitalizations. So dr. Rashel walensky, director of the cdc, talked about this yesterday. There was some waning with the vaccine effectiveness, just with regard to infections. People werent getting that particularly sick yet. Just with regard to infections and that foreshadowed we may be seeing this soon with regard to hospitalizations and severe disease. So on friday, expect to see a lot of debate among these Fda Vaccine advisers about the best approach. Should the u. S. Have a Booster Program or not. Jim, erica . All right, elizabeth, thank you. I do think we just are learning a little more about what were supposed to hear from pfizer on friday. Is that right . Thats right. We are hearing a little bit more. We know that pfizer will probably present data thats going to say, look, we gave a bunch of people third shots and their antibodies went up. And theyre going to say thats a good thing. Their antibodies went down months after the second shot, and we gave a third shot and their antibodies went up. Other people would say, antibodies arent everything. There are other parts of the immune System Pfizer didnt look at. All right. Elizabeth cohen, appreciate it as always. Thank you. Joining me to talk through it all, dr. Sanjay matthew, primary care physician. Doctor, good to see you as always. Look, were getting all of this different information. Elizabeth walked us through the different studies we Saw Rkts from the u. S. , from qatar, from israel. Are you concerned heading into the meeting on friday, that all of this information may perhaps keep people from getting the booster even if and when it is recommended for the general population . Yeah, good morning, erica and jim. Listen, i just think that we need to let the fda, you know, drive this whole discussion. Part of the problem was the White House i think jumped the gun by making this grand statement that starting september 20th, americans will start receiving Booster Shots. As elizabeth just mentioned, erica, there are a lot of behind the scenes players when it comes to the immune system. Its not just the antibodies. We know that antibodies wane over time. We also know you have these T Cells and B Cells that actually help the Bone Marrow produce Moran T more antibodies and help with protection. I dont think the question is if were going to get a Booster Shot. The question is going to be when. So, to be frank, im actually excited thAt The scientists can sit down, look at all these studies, and make a decision as to when Majority America will need thAt Third shot. So as we wait for that, you just mentioned T Cells. There is a study from swedish researchers that came out yesterday, and half of the people thAt They looked at had Preexisting Immunity to the coronavirus, but they had never contracted it. This had to do, as i understand it, with their T Cells. My question on that is any sense of how many people may have that Preexisting Immunity, and how effective is that versus being fully vaccinated . Yeah, so i think that is also going to be a really big question that scientists need to look at. Ive been excited about this whole T Cells and B Cells, you know, six, seven months ago, even before the vaccine rollout. And the reason for that is, like you just mentioned, there are people who have not been exposed to covid19 that actually show immunity. And i see this all the time at work. The husband who is exposed to covid19 goes to the i. C. U. , the wife doesnt fall sick. Its almost like Russian Roulette with covid19. Who actually is going to fall sick or who is going to just have a Breakthrough Infection after youre fully vaccinated. But this is something we absolutely need to look at. Thats also why, erica, there is this debate by a good number of the fda scientists saying, listen, guys, slow down. This vaccine is doing its job. The Justice Department is making a move against the restrictive texas abortion law. It is now asking a federal judge to issue a temporary Restraining Order to block enforcement of it for now. This comes after the biden administration sued the state last week saying the law, which bans abortions after six weeks, no exception for rape and incest, was passed, quote, in Open Defiance of the constitution. Cnn Supreme Court Reporter Ariane de vogue joins me now. How will they respond to the issue of a stay . This judge already ruled against texas once. This is a move by the Department Of Justice. They want this law blocked now immediately. Theyve already sued, but they want these clinics to be able now to come back and resume performing this procedure. Keep in mind as you and i have talked about, this law was written in a way to make it really hard to block. That was the whole point. And the Department Of Justice has said, look, this is a scheme and its meant to avoid judicial review. Heres whAt They wrote in papers Last Night. There can be no dispute that sb8 is contrary to government, banning abortions before fetal viability. In these papers, jim, they layout now whAt This law is affecting, how its affecting women on the ground. They say, for instance, one clinic provided something like 200 abortions in the week before it went into effect. Now its down to 60. They say clinics out of state are getting tons of Phone Calls and the women who cant afford to travel, those with the means, theyre having to do that while covid is surging. So, again, another safety concern. Justice roberts, his dissent, not far off saying this is a scheme to get around. Big picture, though, this would be temporary if its issued. On the larger question as to whether laws like this violate roe v. Wade, violate precedent, where, when and how will that be decided . In the short term right now, things could move quickly depending on whAt This District Court Judge does. The District Court could enter some kind of temporary Restraining Order. Texas, then, would likely zoom right to that federal Appeals Court thats conservative. Then it might end up on the Emergency Docket of the Supreme Court where they would be looking at whether to allow it to go into effect or not. Keep in mind, the court as you said did allow it to go into effect in that other challenge that was brought by the abortion clinics, but this is different, of course, because its brought by the Department Of Justice, has the heft of the federal government behind it. And the Supreme Court this time could see it differently. Meanwhile, the effect on the ground, right, is that fewer women have access. Thats simply a fact. Ar ariane de vogue, thank you. Erica. They failed to launch a proper investigation into dr. Larry nassar. Next hour the Senate Judiciary Committee will look into the handling of the Sex Abuse allegations by nassar. Here you see moments ago, elite u. S. Gymnasts arriving to testify. Simone biles, maggie nichols, allea ali riesman. What ketel us . Reporter this is a riveting emotional hearing because those gymnasts who are olympic and world champions will be seated At The table. Initially you will have some remarks from senators and then they will give their statements, their testimony. You will hear from them. Following thAt The senators will be allowed five minutes to question each of them as who they want, and then following that you will have the Fbi Director Christopher Wray and also the Inspector General michael horowitz. They will testify, and then be asked questions from the senators. You know, this Hearing Today stems from the Inspector Generals report, and it was that report that from that came a statement from senators Richard Blumenthal and jerry Moran That said, this is scathing. What we are seeing is thAt The Fbi Indianapolis Office knew there were serious accusations against Larry Nassar, and they did nothing for more than a year. And once they did do something, they falsified the complaint. And when they spoke to the Inspector General, they did not tell the truth. And i think the best way to look At This is the time line because in summer of 2015, Usa Gymnastics went to the fbi In Indianapolis and said we have very credible accusations that Larry Nassar sexually abused some of our gymnasts. The fbi In Indianapolis, Why Indianapolis . Thats where Usa Gymnastics is based. They said, well take care of it. We have gymnast one, gymnast two, and gymnast three. They have never revealed themselves. They will today on the Senate Floor here. We would like you to interview them. The fbi only interviewed gymnast one. It was a telephonic interview, weeks later. The Inspector General said, thats not the way to interview a Sexual Assault Victim by telephone. After that, a few handwritten notes were made. No formal complaint, nothing was done over a year, but they said thAt They had sent it on to the fbi in lansing. The Inspector General said they could never find anything. They showed a Communication Or Complaint was sent to the fbi in lansing. Because of that, according to the report, more than 70 young girls, minors, were sexually assaulted by Larry Nassar, and im hearing it was even greater than 100 because the fbi didnt do anything. Jean casarez, thank you. If you wonder why it is so hard for victims to come forward, here is yet another example. Jean, appreciate it. Just in to cnn, we learned two key democratic senators will be meeting with President Biden today as he tries to push his 3. 5 trillion Budget Plan through congress. Thats right. Joe manchin, Kirsten Sinema expressed opposition to the Price Tag. Not just manchin, remember. Is the president willing to negotiate . Cnn congressional Correspondent Lauren Fox just got this information. So, what more do we know about these meetings . And are there proposals there to meet in the middle somewhere . Reporter well, i think were going to find that out, jim. These are significant players. Both Joe Manchin and Kirsten Sinema have made it clear thAt That 3. 5 trillion Price Tag to reimagine the Safety Net is simply too high, and they want to make sure thAt The level of spending that goes into this bill is really looked at, you know, people are going through it, making sure that every program that democrats are supporting is actually necessary. And manchin has made it very clear publicly that he has other concerns about just other than just this Price Tag. And that includes things like the tax increases that will be needed to pay for this bill as well as other provisions on climate. He wants to make sure thAt There is an Income Threshold that is a little lower than what it is now for an expansion of the child tax credit. Those are all issues that Senator Manchin has made clear are problems for him. And that list is very long. Meanwhile, sinema is someone who is much more private about what her concerns are, but she has said publicly that 3. 5 trillion Price Tag is a big Red Line for her. So i think this is really an opportunity for the president to make sure that he is working with these members. Its very important to give these members individual attention because as we have made clear in the u. S. Senate, every single vote counts. You only have 50 votes and you have to make sure every democrat is in line. Right now Chuck Schumer doesnt have every democrat, so the effort right now is to have the president speak to these members as well. Jim . Erica . Well be looking forward to what comes out of that.
