So everything from ladders to ventilation to fire escapes, and covid kills people, and so the argument is that workers need to be safe from infection in workplace. So congress gave this power to the Href='https://vimarsana.com/news/department-of-labor'>Department Of Labor over 50 years ago. I think theres very, very scant chance of a federal Href='https://vimarsana.com/news/koucourt-ory-court'>Koucourt Ory Court stepping in and stopping this. Even with this u. S. Supreme court . Again, the way this works is you have to look to the power of congress. Congress passes off power to agencies all the time. So in the past when this court has tinkered with what president s have done like the Href='https://vimarsana.com/news/daca-program'>Daca Program under president obama, ultimately the court, this Href='https://vimarsana.com/news/supreme-court'>Supreme Court prior to Href='https://vimarsana.com/news/amy-coney-barrett'>Amy Coney Barrett uphold that deferred action against childhood arrivals plan that was quite controversial. But upheld it saying congress did give this power to agencies, and we can debate whether congress should be handing off its regulatory power this way. But the court has upheld that kind of thing as constitutional for almost a century. So when you drive tHrough washington, d. C. And you see all kinds of agencies that pass regulations, lots of those regulations derive from the power of congress in a statute. This is Href='https://vimarsana.com/news/bread-and-butter'>Bread And Butter basic Href='https://vimarsana.com/news/administrative-law'>Administrative Law that i would teach my law students. Ive never seen a body of governments so eager to hand over their power than the u. S. Congress because it enables them to not have to take tough stances. There are a number of republican governors who have vowed to fight this order. Texas Href='https://vimarsana.com/news/governor-greg-abbott'>Governor Greg Abbott tweeted texas is already working to halt this power grab. What case are they going to make, and how strong might that be . Well, i think theyre making a case in the Href='https://vimarsana.com/news/court-of-public-opinion'>Court Of Public Opinion or, frankly, i think its in sort of gaslighting territory here. Remember, there are multiple republican states that are actually banning private employers and schools from implementing measures to protect public health, including the health of children who in this moment under the age of 12, they dont have any agency over whether they could even get a vaccine. So, i think theyll argue, well, congress didnt give that much power to the Href='https://vimarsana.com/news/department-of-labor'>Department Of Labor, it was narrower. But the Href='https://vimarsana.com/news/department-of-labor'>Department Of Labor even regulates oxygen in the workplace. So its hard to say they can regulate oxygen but they cant regulate the coronavirus. They might say that Href='https://vimarsana.com/news/congress-shouldnt'>Congress Shouldnt have given this power in the first place to the Href='https://vimarsana.com/news/department-of-labor'>Department Of Labor. But as i said that goes tactualy back to the Href='https://vimarsana.com/news/roosevelt-administration'>Roosevelt Administration where congress, the power was pretty well established. And as you say, jake, the problem with all this regulation is that congress is passing the hot potato. Beyond that, i think they can file things. People can file whatever they want. The question is whether itll go further, and i dont think it will. I want to bring in the director of the robert a. Levy center for constitutional studies at the libertarian kato institute. Do you think that republican governors have a case here that can pass legal merit to challenge Href='https://vimarsana.com/news/president-biden'>President Bidens proposed mandate on businesses of Href='https://vimarsana.com/news/a-hundred'>A Hundred or more employees to have weekly testing or a vaccine . Well, im not sure the governors are Href='https://vimarsana.com/news/the-one'>The Ones that would have standing technically to bring the suits. But certainly any business thats affected and does not want to comply would have standing, and has a decent chance of success because, you know, just because congress doesnt pass the legislation doesnt mean the president or the Href='https://vimarsana.com/news/executive-branch'>Executive Branch gets more power. This is beyond anything on esha or the Href='https://vimarsana.com/news/executive-branch'>Executive Branch has ever done before. So were sort of back to arguing over obamacare and buying broccoli versus eating broccoli, what can the government compel you to do . I think this is beyond its power to regulate Href='https://vimarsana.com/news/interstate-commerce'>Interstate Commerce. Of course, whether or not i eat broccoli doesnt affect your health. But whether or not i get vaccinated or wear a mask, theoretically could. There are at least five vaccines required for children to go to Href='https://vimarsana.com/news/school-or-daycare'>School Or Daycare in every state in the nation according to the national academy for state health policy. Mumps, measles, polio, rubella, chickenpox. Why would what Href='https://vimarsana.com/news/president-biden'>President Biden is attempting to do be any different than requiring children to get these shots . Thats an easy question, jake, because this is the federal government imposing a mandate rather than the thing in schools. The mandates in schools are state governments. So states and municipalities, that becomes a question about rights arguments. This is a question about powers and what powers the federal government has. Its not about whether the disease, whether covid affects me or you or how it affects vaccinated. Thats a discussion for statelevel arguments and litigation. This is about whether the federal government has the power. And since the pandemic or the spread of disease is not commerce, this goes beyond, again, the regulatory authority that the government has. And beyond that its trying to get businesses to do its dirty work. The federal government cannot directly require people to get vaccinated. And so it cant do the same thing by telling businesses to do it. As Href='https://vimarsana.com/news/law-professors'>Law Professors we know the Href='https://vimarsana.com/news/commerce-clause'>Commerce Clause is very broadly interpreted. And this clearly is affecting commerce. Its affected the ability of businesses to function in this country, the economy has been affected by it, the virus doesnt know borders. So, the Href='https://vimarsana.com/news/commerce-clause'>Commerce Clause has not to date and this moment been interpreted in those kinds of narrow ways. So the notion that somehow congress lacks the power to give this to the labor department, thats not accurate. And the argument ilya, one second, ill let you respond. The Href='https://vimarsana.com/news/asha-act'>Asha Act is broedly worded and it even allows Href='https://vimarsana.com/news/emergency-relief'>Emergency Relief that osha can pass Href='https://vimarsana.com/news/emergency-relief'>Emergency Relief to protect workers safety. So i think the suggestion that somehow this is unconstitutional is overblown, if not frivolous, frankly. Ilya, go ahead. Im getting flashbacks to these sorts of arguments that i was having over ten years ago over the Href='https://vimarsana.com/news/supreme-court'>Supreme Court mandate. This is why i keep saying that the federal Href='https://vimarsana.com/news/government-cant-force'>Government Cant Force businesses to do its dirty work. Its not necessary and proper for the enforcement of Href='https://vimarsana.com/news/interstate-commerce'>Interstate Commerce. Remember, unless chief justice roberts, now i guess you need kavanaugh, to decide that a Href='https://vimarsana.com/news/vaccine-mandate'>Vaccine Mandate is a tax, but remember the individual mandate failed as a matter of Href='https://vimarsana.com/news/commerce-clause'>Commerce Clause regulation. And i recall all these Href='https://vimarsana.com/news/law-professors'>Law Professors saying this affects the economy. Theres no limiting principle there. Let me hop in one second. We have a deadly virus, more than 650,000 americans, i believe, have died as a result. The number is actually probably much higher, not to mention all the people that have been injured and hurt. What could the president do to push people to get mandated . He would argue, Href='https://vimarsana.com/news/president-biden'>President Biden, that they have tried every persuasive technique. But what powers does he have that could push people to get vaccinated this holdout group, the 26 that are eligible that refuse to get vaccinated . Well, assuming congress has created a law giving regulatory authority over Href='https://vimarsana.com/news/interstate-commerce'>Interstate Commerce for things like interstate travel. Whether airplanes, ports. To be able to travel you could put in a date for that or the faa or the appropriate Href='https://vimarsana.com/news/regulatory-agency'>Regulatory Agency over things like that. Because that, again, involves Href='https://vimarsana.com/news/interstate-commerce'>Interstate Commerce. But the states can impose mandates. And then well be arguing over the rights protections and thats not about Href='https://vimarsana.com/news/federalism-and-separation'>Federalism And Separation of powers. But, again, this is about its important that we respect the constitution, we dont toss it out. And were in month 18 of the pandemic. This is not the first month where we dont know whats going on. Listen, obamacare had nothing to do with worker safety. So if the argument is congress doesnt have the power to regulate workplace safety, then we are going to see a lot of accidents. We might as well just roll back a few hundred years prior to the Href='https://vimarsana.com/news/industrial-revolution'>Industrial Revolution in terms of the kinds of things that are in the workplace to make workers safe. And 650,000 americans dead already does affect the safety of the workplace and workers. I really appreciate the respectful debate. When you dig into the numbers especially when it comes to the economy, americans say things are getting worse and its not just republicans, its across party lines. 43 of democrats think the economic conditions are poor up from 28 . Independents grew from 50 to 60. I think a lot of what biden is trying to do is focus on the economy just as much as it is saving lives. And if these requirements work, and i think they will to some degree, and we will come out of it anyway because of natural forces, so to speak, to some degree. And the economy a year from now we wont have runaway inflation. The federal elections arent for over a year. So this is a good time to have people become more worried if you are confident that things will be better six or nine months from now. Bidens overall Href='https://vimarsana.com/news/approval-rating'>Approval Rating stands at 52 , which is at least above water for him. But some troubling numbers for him. Theres been a rise in his disHref='https://vimarsana.com/news/approval-rating'>Approval Rating among independents. If you were at the Href='https://vimarsana.com/news/white-house'>White House right now, what would you take away from this . Those independents are going to be key for democrats in 2022, in 2024, and so some of the democrats that ive spoken to in congress have said that those are troubling numbers that they are worried about, that they want biden to work on. These new steps, you know, the mandates are popular, in a lot of states like georgia, arizona, when its been pulled, do you support corporations mandating vaccines or mandating masks . A lot of voters, a majority of voters in those Href='https://vimarsana.com/news/swing-states'>Swing States say they support it. Now, this is the federal government mandating that those corporations do that. But thats why the Href='https://vimarsana.com/news/white-house'>White House is taking this step at this time because, yes, his Href='https://vimarsana.com/news/approval-rating'>Approval Ratings are down, his disHref='https://vimarsana.com/news/approval-rating'>Approval Rating is down. And they know that these mandates are popular. So they decided that this is the moment to take it as well for the economy, like you said. So how are his whats the view of these mandates, do you think, among independents who can be a fickle bunch . They can. It depends on if theyre vaccinated or not. I think one of the biggest risks with this mandate is that it really enlivens the republican base and really the loudest among them. And theyre very enlivened. [ laughter ] trust me, i be know some of the. I dont know if there can be more enlivened antivax fanatics. And also the people who maybe voted for biden this last election and might be inclined to vote for a republican in the swing districts. I think polling, watching how polling for biden in these swing districts, in these majoritymaking house members and senate members, Href='https://vimarsana.com/news/thats-something'>Thats Something that i know im going to be watching to see how hes faring there. And let me ask you. Do you think there is any part of this, of these mandates . Because biden you heard Href='https://vimarsana.com/news/ilya-shapiro'>Ilya Shapiro say in the previous segments, it would be constitutionally a layup to require domestic Href='https://vimarsana.com/news/flights-everybody'>Flights Everybody be vaccinated. But he didnt do that. He went right to something that is at least debatable. Do you think he was bading republican governors to overreact . As laura notes, these mandates are broadly popular, not among the republican base but among the american people. A federal government can mandate for all citizens, period. He has that power. Youre talking about jacobson versus massachusetts . 1905 . I went to law school. [ laughter ] yeah. It was a guy who didnt want to get vaccinated for smallpox, and the Href='https://vimarsana.com/news/supreme-court'>Supreme Court said im sorry, you have to. Right. By the way, if youre interested, as my conservative friends are, in the intent of the framers, Href='https://vimarsana.com/news/george-washington'>George Washington was the chairman of the constitutional convention. Before that remandated that every soldier in his army be inoculated. Soldiers dont have any rights. Thats not debatable. Federal employees are more like a soldier than a private Href='https://vimarsana.com/news/sector-employee'>Sector Employee in that they dont have to work for the federal government. I dont have a right to a job at cnn. But if i dont abide by its Href='https://vimarsana.com/news/health-policies'>Health Policies at work, i can get fired and thats well within the power of this company. Its well within the power as the president as an employer. I think its going to be popular with voters. I think the fact that republican governors and the rnc are taking a point against this is just political morons. With the affordable care act, the contraception case, who sued . The little sisters of poor. Nobody loves Href='https://vimarsana.com/news/ron-desantis'>Ron Desantis or greg abbott. Theyre hard partisans. The independents are not as moved by them as plaintiffs. I think what independents are more like looking at is how covid and the economy are linked in the competence. The competence argument. If hes competent to wrap up some of these crises, get the economy back where it should be, then maybe the democrats will be in good shape. If hes not seen as competent, well, thats going to be problematic. I need to jump in because Href='https://vimarsana.com/news/cHris-cHristie'>CHris CHristie is thinking of possibly running for president in 2024, he is now trying to create some real distance between him and the man he endorsed for president in 2016 and 2020, donald trump. Take a listen. No man, no woman no matter what Href='https://vimarsana.com/news/office-theyve'>Office Theyve held or Href='https://vimarsana.com/news/wealth-theyve'>Wealth Theyve acquired are worthy of Href='https://vimarsana.com/news/blind-faith'>Blind Faith or obedience. Thats not who i am, and thats not who we are as republicans no matter that we tie our future to a pile of lies. See, we deserve much better than to be misled by those trying to acquire, hold onto power. For the record, he didnt mention donald trumps name. [ laughter ] but hes obviously talking about donald trump. CHris cHristie says no man no man are worthy of Href='https://vimarsana.com/news/blind-faith'>Blind Faith or obedience. Thats not who we are as republicans. Is that not who you are as republicans . Not you necessarily, but is that not who the republican party is . The republican party, to me, according to polls and according to the majority of house republicans, they are tieing their future to a pile of laws. They are. If cHristie wants to genuinely depart from the party that is tied to trump and to trumpism, he needs to say a bunch of things. He needs to say that he wouldnt Href='https://vimarsana.com/news/support-trump'>Support Trump in 2024. He needs to support the Href='https://vimarsana.com/news/january-6th'>January 6th commission. He needs to say i wouldnt Href='https://vimarsana.com/news/support-something'>Support Something like j. D. Vance or Href='https://vimarsana.com/news/josh-mandel'>Josh Mandel if one of them becomes the republican nominee in ohio. And one of them probably will. For me thats the test. Otherwise its cheap talk. Hes trying to get into a lane thats not quite where Href='https://vimarsana.com/news/liz-cheney'>Liz Cheney is but a little bit more respectable than desantis or other possible successors of trump. But on the other hand im unimpressed. Ive gotten ten emails and texts this morning from sort of friends and sort of Href='https://vimarsana.com/news/nevertrump-world'>Nevertrump World saying, Href='https://vimarsana.com/news/isnt-cHristie'>Isnt CHristie great . Boy, electricHristies stepping. They want to come back to the party. They still want to believe in the republican party they can support. CHristie may tap into that. And there may be a little more support for that than i think he deserves. What do you think . Courage is contagious. Liz cheneys been the most courageous. But youre seeing more and more. In a new cnn documentary, americas longest war, what went wrong in afghanistan, i spoke with most of the Href='https://vimarsana.com/news/commanding-general'>Commanding Generals who served in afghanistan over the last 20 years for some candid conversations. What was our mission . To prevent Href='https://vimarsana.com/news/al-qaeda'>Al Qaeda from attacking the Href='https://vimarsana.com/news/united-states'>United States, preventing afghanistan from being a sanctuary and also the mitigate the risk of mass migration. I believe over the course of 20 years that was achieved. We shouldnt confuse the outcome with saying that we did that in an appropriate level of investment. Would i like to have seen this accomplish that mission with fewer young men and women having watched their lives, families suffering, casualties . Theres no question about it. But at the end of the day, im not willing to say it wasnt worth it. I think we had to retaliate in afghanistan with the attack on the Href='https://vimarsana.com/news/united-states'>United States of america. Now, for the 20 years after that, have we done it the smartest, best way . Probably not. Probably lots of things we could have done differently. My first impulse is to say, yes, it was worth it. But i no longer am certain of that. But before i go to my grave, ill have that question answered. If anyone had said on the 12th of september, 2001, when we knew that the attack had come from afghanistan, were going to be there now from this point on for about 20 years, and its going to end with us leaving taliban back in power. Can you imagine the reaction of the american people . Was the Href='https://vimarsana.com/news/war-in-afghanistan'>War In Afghanistan ultimately a failure . The 20year Href='https://vimarsana.com/news/war-in-afghanistan'>War In Afghanistan was for the results that we have achieved were not worth the cost. That will just an excerpt of our documentary. And cnns Href='https://vimarsana.com/news/nic-robertson'>Nic Robertson joins me now from kabul. Youve been covering this for us since the beginning. I have to say i was taken aback when a twotime Href='https://vimarsana.com/news/commanding-general'>Commanding General in afghanistan and also former u. S. Ambassador to afghanistan, when he said the 20year Href='https://vimarsana.com/news/war-in-afghanistan'>War In Afghanistan was for the results that we have achieved not worth the cost, id never heard a Href='https://vimarsana.com/news/commanding-general'>Commanding General Href='https://vimarsana.com/news/say-anything'>Say Anything like that about afghanistan. What do you think . You know, the cost has been incalculable. I remember running laps around the helicopter past the night Href='https://vimarsana.com/news/pat-tillman'>Pat Tillman was killed. The medevac scrambled out of there. And i didnt know why but in the next few days i did. Its hard to grapple with so many heroes dying and what did it really bring . I remember two, you know, one of my british friends, he served in afghanistan. His brother, his younger brother was the first british muslim soldier to be killed in afghanistan, and he had to face his mother and explain to her why he had convinced his younger brother to follow him into the military. The pain of many families. But what did it bring . The economy here is better. Ive seen schools being built here. The education is better. Theres a constitution brought here that has put women in government. There are so many things, prosperity and prospects as a generation here now that understands what democracy is. They havent made their imprint on the world or the country. But they have an idea of what they might be able to achieve. The taliban are back in power, and this is a Href='https://vimarsana.com/news/dark-cloud'>Dark Cloud over all of the good thats been created here. But is it worth it . Could i look a parent in the eye of somebody whos lost somebody here and say does your Href='https://vimarsana.com/news/pain-and-suffering'>Pain And Suffering count, you know, for the potential here . You have to believe in the imperfect world of imperfect democracies that any step forward is a good step. And this country is a critical part of strategic success of the Href='https://vimarsana.com/news/united-states'>United States across the world. That investment has to be worth something, if not now, then in the future. And in the documentary there is an afghan former ambassador to the Href='https://vimarsana.com/news/united-states'>United States who makes that argument about Href='https://vimarsana.com/news/life-expectancy'>Life Expectancy in afghanistan going up, the tangible improvements for the lives of the afghan people because of nato and the Href='https://vimarsana.com/news/united-states'>United States occupying and trying to improve things in that country for so long. How are afghans feeling now, however, now that the u. S. Troops are gone, now that the taliban is in charge . Is there any optimism that these gains can persist . I think were in this really in between phase. People are absolutely panicked when the taliban came in. And those that can got out got out. Those that want to got out are still trying. On the streets here today you can see this sort of unease. The men still shaving even though the taliban say get into more religious clothes, get into more traditional clothes. Women not wearing the full burqa going out with just scarves on their heads. Theres a little space right now and people are feeling out whats possible. But i think its going to close in on them. So theres a sense of a real impending downturn in their fortunes, whether its just in their lives or the economy. But also i think to be realistic, you have to say Href='https://vimarsana.com/news/united-states'>United States and nato gave it a shot here. And many afghans feel that they didnt deliver. There was corruption in the government, the elections were flawed and fraudulent. And for them the Href='https://vimarsana.com/news/united-states'>United States had become a burden, and not a bearer of a better future. Thats a perception. But for many afghans its a time to try something else, not the taliban, i think has to be said. It had come to a point where it doesnt seem things were getting better. But the outcome that were looking at though is, for the vast majority, the wrong one. Nic robertson in kabul, afghanistan, thank you so much.
