Good morning to our viewers here in the united states and all around the world. It is friday, september 10th. Im John Berman with Brianna Keilar on this new day. President biden with new aggressive Vaccination Requirements that could affect as many as 100 Million americans. This is a new attempt to contain the latest Covid Surge and the president is clearly running low on patience. My message to Unvaccinated Americans is this. What more is there to wait for . What more do you need to see . Weve been patient, but our patience is wearing thin and your refusal has cost all of us. So please do the right thing. President biden announced that all unvaccinated employees at private companies with more than 100 workers, they have to do Weekly Testing. The way to get out of Weekly Testing, get vaccinated. Hes also implementing Vaccine Mandates for all federal workers and contractors, no option to test out, and for educators and all federally funded programs. Mandates also on workers at facilities that accept Medicare And Medicaid funding. President biden also calling out jerks on planes. Not the words he used, but thats what he was talking about. Also Conspiracy Theorists and politicians who refuse to implement common Sense Coronavirus Containment measures. There are elected officials actively working to undermine the fight against covid19. Instead of encouraging people to get vaccinated and mask up, theyre ordering mobile morgues for the unvaccinated dying from covid in their communities. Our elected officials are keeping us from turning the corner. These pandemic politics i refer to are making people sick. Criticism from some republican governors was swift as well as from some candidates. And the largest union representing federal workers is also raising questions, although some big companies like amazon are voicing their support. The president s actions all but certain to face legal challenges. Lets discuss all of this now with chief Washington Correspondent and anchor of the Lead And State of the union, jake tapper. With us now, jake, thank you for being with us this morning. You know, i just wonder after this announcement, all of these announcements really by President Biden, what you are making of these republican threats which are especially illuminated by something that j. D. Vance, the Senate Candidate has said. He said these must be resisted, these proposals. He said, quote, i have a simple message for americas business community. Do not comply. Well, i think first of all, there are legitimate constitutional questions about whether or not this mandate on businesses, not the mandate on the federal government, but the mandate on businesses will withstand a core challenge, which i am of course anticipating there will be. I mean, there are questions about whether this goes beyond oshas regulatory authority, whether or not this violates the interstate commerce clause. There is a supreme Court Case Jacobson versus massachusetts that would seem to suggest maybe there is a standing for this. One Persons Liberty can be Override Everyone elses liberty. But beyond the politics of this, and, of course, there is politics of this. A lot of people in the republican party eager to prove their Bona Fides by opposing President Biden. Beyond that, i mean, i think there are legitimate questions about whether or not President Biden has the authority to do this. There is also a real choice that the president has here. There is the question of coercion and there is the question of persuasion. And you see him moving from persuasion to coercion. He took on a Scolding Tone talking to the people who are unvaccinated, talking about how, you know, Peoples Patience is running out. Talking about this mandate. And i dont know as a matter of politics, unless, of course, the goal was to get all these republican governors and politicians to come out against this, i dont know that that was not predictable because obviously a lot of republicans who have been on the pro Science Side of this are eager to show their Bona Fides with the base by standing up to this mandate. It was absolutely predictable. And the answer may be that he was willing to take the blowback because he felt and the White House felt it would get that many more people vaccinated. Just one point on j. D. Vance and others. The through line here, jake, the actual mandate, the Osha Mandate on companies isnt vaccinations. The Osha Mandate is Weekly Testing. So what j. D. Vance is saying, dont comply with Weekly Testing . Dont force people who are unvaccinated to take a test before they walk in the door . He wants to preserve their right to walk into a place of work with covid . Im just again, if you get down to the basic intellectual through line here, its hard to follow on that, because thats what the mandate is. For federal workers theyre required to get tested, no opt out on testing. For other companies, get tesd. Im not saying its unconstitutional. There is a debate to be had. There are enough skeptics on the Supreme Court that anybody can stand here with any confidence this will withstand the scrutiny of this court, which is obviously more conservative and more inclined to agree with j. D. Vance on some of these issues than President Biden. Keep in mind j. D. Vance is in the middle of a republican primary for the senate in ohio where, again, theres a lot of politics afoot here, which is part of whats going on. One of the things that i find questionable or not questionable really, but something that is worth debating and discussing is the fact that we are in a world now, a society now where misinformation is part of the problem, right. And its not just on the right. Its not just conservatives, although this antivaccine, antiscience Hold On too many people in the republican party, too many people in conservative media is quite stark. But you see people on the left, people who are apolitical also expressing skepticism about this. In 1977 there was this quack, Quackery Treatment of cancer called laitril. Berman, you might remember. Brianna, you might be too young. Peach pit was a way to treat cancer. The nonscientific community said this is crap. There was a big Hold On The American people left, right and center whether or not they could be taking this treatment that did nothing, did nothing to help people with cancer. This is part of The American public. This is part of the ethos in this country. People dont want big government telling them what to do. Now, the difference between now and back then is now the antiscience component of our society is bigger and it has there are grifters, people using this for ratings, for clicks, for votes. I havent yet really seen the biden Administration Talk or try to address this. I dont Think Scolding is the approach. There are these purveyors of misinformation out there and theyre not just on the right. Robert kennedy, jr. , is one of the most notorious ones. And i havent seen the President Or Anyone say, look, people look, hes scolding the people that are being lied to as opposed to the liars. Do you know what i mean . Like instead of saying there are a bunch of people trying to get your money, trying to get your attention, trying to get your votes, trying to get your views and clicks, instead of shaming the liars and trying to educate the people being lied to, hes scolding the people being lied to. And, again, as with the election lie, you can get mad at the people who believe the lies, but the villains are the liars. Yeah, no, i think its a really interesting point. Where does the Blame Lie . I do want to, look, here we are a day before the 20th Anniversary of 9 11, which has, you know, lets be honest, jake. When you look back on the last 20 years of your career, in a way so much of it has revolved around this moment and the aftermath of it. And you have a Special Report that im really looking forward to seeing called what went wrong in afghanistan. Tell us what you found. We started working on this after President Biden announced the September 11th deadline for the withdrawal of u. S. Troops. So weve been working on this for months. We did not know how it was going to end, but we have now interviewed most of americas commanding generals in the war in afghanistan. This is not just a look at the last month. This is a look at the last 20 years. How is it that a country as strong as ours, as, if you believe our own press as well as intentioned as ours, was not able to succeed in afghanistan the Way Anybody wanted to succeed. Im going to run this one clip for you. This is one aspect that gets into what the commanders of the war on afghanistan during the bush years, the problem that they began experiencing as soon as President Bush turned his attention from afghanistan elsewhere. Take a look. Its just he and i sitting in the oval office, and i had not been expecting this. I expected him to say, heres what i would like you to be able to do. But he said, what do you think you can do . I said, well, ill get the europeans outside of their wires, get a little more involved in patrolling and being amongst the african people. That will be good enough. Thats just the way he responded. What does that mean, good enough . I never tried to define that. But after that he said, and heres another thing. I want you to always tell me exactly what you need. Tell me exactly what you need. Youre not going to get it because ive got to take care of this right thing. I personally resented the war in iraq. When the jenna arrived in 2003, he had 57,000 fewer troops in afghanistan than were in iraq. 57,000. The following year, that gap doubled to about 115,000. We had a V8 Engine in iraq tuned up, and you had something much less in afghanistan. So everything was harder. I mean, Thats Something, jake. I know. General mcneil is the first one there. We should also note that the first time Secretary Rumsfeld, then Secretary Rumsfeld approached President Bush about wanting to meet with General Mcneil and general Tommy Franks who was in charge of the iraq effort, President Bush didnt know who General Mcneil was. He didnt know who he was. Rumsfeld said, hes commanding the war in afghanistan. And President Bush said, he didnt need to meet with him. So at least he got his meeting in that clip. But this is i want to just underline again, this is a look at all 20 years, not just the bush years. But when you think about the fact that this effort did not succeed, did not achieve what we wanted, nobody went into afghanistan thinking, okay, were going to be here for 20 years. Were going to spend 2 trillion. Its going to cost at least 6000 american lives if you include contractors, Tens Of Thousands of innocent afghans are going to die at the hands of The American people, in addition to insurgents. And when we leave, the taliban is going to take over right where they left, even stronger than before. Nobody would have believed it. So why did it fail . This was one of the original sins of The American effort in afghanistan, going in and then completely changing focus. Well, look, that clip was fascinating. I think it goes to show just i think i got caught honestly making a funny face on tv because we were to rapt by what we were hearing. They were so honest with you. Liberty, liberty, liberty, liberty new this morning, families of Nursing Home patients who were relocated to a warehouse during Hurricane Ida are filing a Class Action Lawsuit claiming they endured, quote, horrific and inhumane conditions. We have new video from inside that warehouse where hundreds of patients were held and where at least seven died. Joining me now is natalie henderson. She is a nurse who worked at that warehouse for evacuating Nursing Home patients. Thank you for being with us. You thought you were being evacuated to a medical facility, not a warehouse. Tell us what you saw inside and what the conditions were like during the storm. Like you said, i thought we were going to a facility. I didnt know it was going to be a warehouse. And when i arrived there, i arrived to the address and it was a green shack to the righthand side. Im like, oh, my god, is this where theyre housing the patients . Im like, where you know, where are we, like . So i called my supervisor and she told me that we were to the lefthand side, which was the yellow warehouse. And when i went in there and entered, there were residents already on the floor on mattresses. Im like, oh, my god. You know, i didnt know it was going to be housed in a warehouse. So they were all in a row on mattresses and air mattresses. I just thought it was like unbelievable. I couldnt believe that so many people were crowded in one place, you know. The first thing i thought about was covid. Im like, lord, you know, the virus is out, all these people cramped in one spot. Theyre going to catch the virus, you know, and possibly die. It just was unbelievable. And they kept rolling residents in, you know, through the acadian ambulance, the vans, they kept coming in and placing more residents inside the buildings. There was two other little side buildings over to the righthand side and it started leaking water, you know, as the storm was approaching as the days went by. We had to literally Cram Everybody in that big warehouse, in a big warehouse, and we had to move patients closer and closer together. They had no privacy. They were being changed in front of each other. They had portapotties to the lefthand side, im sorry, righthand side up towards to the facility. The kitchen was right next to the portapotties. It was full of feces, urine, it was just terrible. And they piled all of the linen, the Dirty Linen and diapers in the same corner and the whole place just wreaked of feces and urine. It just was horrible. Thats awful. Thats just awful. Do you believe people died prematurely because of what you saw . Yes. You know, elderly people, once you kind of transition them out of their normal habitat, you know, normal place of living and you place them somewhere like that, thats a shock to their system. I believe it does affect them, you know. They could possibly die from it, yes. I want to make clear, cnn has reached out to the executive for the Nursing Homes and the warehouse, bob dean, jr. , for comment. We didnt get a response. This is what dean told a cnn affiliate. I want to read it. It said, we only had five deaths within the six days. Normally with 850 people youll have a couple deaths a day, so we did really good on taking care of people. Whats your response to that . Terrible response. He shouldnt that was terrible. You know, we help patients. As they get older, were all going to pass away some day, but we dont expect, you know, people to die like that. I just feel he shouldnt have said that. That was so insensitive of him to say that. It really shouldnt have been any deaths, to be honest with you, to me. If they were in a better facility, a better place where they had air conditioning, it was humid up in there. It was just terrible, terrible experience. Natalie henderson, im sorry you had to go through it. Im appreciative of you coming forward and saying what you saw, and hopefully you will bring some peace and maybe ultimately justice to some of the families here. Los angeles is now the first major School District and the second largest in the nation to mandate vaccines for students who are 12 and older. This is happening as the highly infectious Delta Variant is causing a rise in pediatric Covid Hospitalizations nationwide. And joining us now to talk about it is nick melvoin, the Vice President of the Los Angeles unified School District board of education. Thank you for being with us. We talked about the decision to do this on the program yesterday, why l. A. Unified decided to go there. So i wanted to talk to you today about the response that youre now getting from parents. What are you hearing . Im sure some, at least, are pushing back. Yeah, the main thing im hearing from parents is an appreciation that were doing everything we can to keep kids safe and inperson for schooling. And thats the irony i think in this country right now, districts that have flouted Safety Precautions are the ones where the schools have to close either for a few days or few weeks at a time. L. A. Unified, weve been leading the nation with Weekly Testing, mask mandates, and Air Filtration upgrades. Now this Vaccination Requirement so that kids can stay inperson and schools can remain open. So most parents have been gratified that were doing that so schools dont have to close after the 18 months of trauma that kids have had. There are parents who are concerns. Some i think are in that wait and see approach, who wanted to see how the year shaked out. We have over 60 of kids in Los Angeles who are already vaccinated. And as they have been able to participate in extracurricular activities and not have to quarantine and close contact because they are vaccinated, more and more parents are availing themselves of that option. We have parents who havent had access. Over 82 of l. A. Unifieds parents are living in poverty. Many in communities that have been historically under served, and so were working with those families. Were setting up mobile vaccination clinics. Were bringing vaccines to schools. Some, brianna, are misinformed. There is a Misinformation Campaign out there. Were working collaboratively to situate this vaccine and other Immunization Requirements School Districts have insisted on for generations. You know, my grandfather was contracted polio later in life and was riddled with it most of his life. My generation didnt have to deal with that because were vaccinated. So there are a number of Immunization Requirements that will be new under them. Nick, let me ask you, what did you think about what biden proposed for schools . And did it go far enough for you . And, you know, he also basically said for head start employees, that they have to get vaccinated, but that was really it. Did he go far enough . I believe youll see a lot of other School Districts and states follow our lead. L. A. Unified edge indicates more kids than there are people in the state of vermont. We are the second largest School District in the country, and i think just as other districts and states have these other Immunization Requirements, youll see the same for the Covid Vaccine soon. So i would like to see support. Dr. Fauci said he supports the move. Other School Districts have this mandate like we do, and we believe others will follow suit in the coming weeks. If i can, i want to take you back to September 11th, bobby, because you were in pittsburgh. The mets were in pittsburgh when the attack happened. And in the days after, i didnt even know this, you had to move hotels because your hotel in pittsburgh was next to an fbi building. And you were nervous that it could be a target. And then you took the bus back to new York City. Tell me about that Bus Ride. Well, it was a long Bus Ride. 9 hours of anxiety, wondering what it was going to be like to get back to New York. But the key moment in the Bus Ride was while we were on that new Jersey Turnpike headed towards meadow lands, and we knew we were going to have a view of the skyline of new York City. And as we came around the corner, everyone pushed their faces against the window to look to the right, and there was no skyline. The entire skyline was covered with smoke. And from that moment until we got to Shea Stadium the next hour, that Bus Rode in silence. There was such remarkable absence. I mean, i remember being overwhelmed by the absence. I was at Ground Zero on that day. Joe, the yankees were supposed to play at home. Yes, we were supposed to play, i think it was the white sox. The night before we were rained out. Roger clemens was going to pitch against his former team, the Red Sox, and go for his 20th victory. We got rained out. And i had a commitment the next afternoon and a charity luncheon. And i hadnt even turned on the tv. I was upstairs getting my stuff together and All Of A Sudden i got a call from the car service, says well, i guess its called off. I said, what are you talking about . I turned on the tv and i see what Everybody Else was watching. And my thought initially went to my daughter. It was her first day of school, and she was 5 years old. So i went down stairs and my wife was maneuvering that situation. And then the yankees ended upstarting to play back on the road. You werent back. What was it like to be out of new York City during that period . Well, you know, we were in new York City after the day. The day. We did visit Ground Zero. We did visit the Staging Area and the javits center. Unfortunately when we went to saint vincents hospital, there were firefighters suffering from smoke inhalation. The armory was the heavy duty one. Thats where the members, Family Members were waiting for dna results, and i wasnt sure it was our place to be in there. And to be honest with you, john, i think thats where we realize when we did go in, that baseball had a job to do because we had to get in the way of their feelings. Baseball had a job to do. And all of baseball, the yankees and the mets especially did it. The mets were the first team to play back here in new York City. In that game, you mentioned even before the game actually started, you felt like it was a victory. What do you mean . Well, just getting on The Field, you know . Our Commander In Chief wanted the gamed to resume. He wanted it in New York for some reason. We could have easily played our games away and joe could have played their games away. But everyone made a conscious decision to play games in New York. Of course, our stadium was a couple miles from the airport. We always had planes flying over, landing and taking off. But the Atlanta Braves came up. They decided to brave it to New York and, thank god, The Good Guys won. The superhero prevailed. First of all, there were all the hugs before the game on The Field. It was so emotional seeing the players on The Field sharing that moment with the rest of the country. And then it was you guys were down in the 8th . Yeah, with he were down in the eighths. The hugs were that moment of unifying. We actually did show that, the bad guys of atlanta and The Good Guys of New York were hugging before the game, never before in a professional baseball game. But we were behind, and the crowd came to their feet wondering what could happen as Mike Piazza came to the plate. And somehow, some way he hit it was magical, it really was. He hit that ball with a sound and the repercussion from the fans, Elation And Joy was miraculous. A message to the world, were still here. Were here and were back. And then the yankees when you played at home, what was the 25th. Yeah, but, john, before that, you know, we played on the tuesday a week later after 9 11, we played in chicago. And, you know, when youre a yankee when youre a member of the yankees, people either hate you orl love you. Im option a, a mets fan. Strongly Option A. Dont worry, hell get over it. So, we come out to into chicago, and we come out and All Of A Sudden you look out in the stands. People are holding banners, we love New York, we love New York. It was such a different feel. And i had said to my players in our Pregame Meeting and after, you know, having gone to the armory and realizing that, as i said, we had a job to do, i just told them that the ny on the cap, it represents more than the yankees. Its going to represent the city of New York. You know, thats our responsibility. And President Bush that was amazing. He comes out of the dugout in game three. We had lost the first two games in arizona. Im at The End of the runway. He says, are you going to kick their Butts Tonight . I said, were gonna try. And with that, he just jumped up the steps and waved to the fans and made a bline for the top of the mound, which, by the way, Derek Jeter said, you better throw from the top of the mound, otherwise people are going to boo you and then he threw a strike. I was at the White House covering bush the september before. He had thrown a game out, first pitch in milwaukee. He practiced all summer long. He wanted to throw a strike no matter what. I promise you throwing a strike was so important to him. You know, when you look back, what do you think the legacy of that will be this moment in baseball, and in American History will be, bobby . Well, the legacy is that if you come together, if you have trust in leadership, that you can have teamwork and the whole country came together following the teams on The Field. Joes team that went to the world series, our team that won that dramatic game. And with teamwork, we had victory. And i think thats the legacy. And the lesson to be learned. Joe . Well, i feel the same way. I mean, any time something happens, you know, New York gets a bad rap. Theyre cold. They dont have time for anybody else. Everybodys in a hurry. But when things happen, they look to embrace you. They open up their arms and their homes to you. And doesnt matter politically, everybodys working together. And i think its just a reminder of how we are united states. And id like to have hopefully, you know, people keep that in mind. One Mans Tribute to his Firefighter Brother has been a journey of several hundred miles that ends saturday in lower manhattan. Cnns Jason Carroll joins us with that story. Reporter you know, brianna, this is really a story of dedication and determination. It has been 20 years since frank lost his brother and he wanted to do something to mark the day. He knows that hes always loved walking. Its something that hes always done. And so he decided to set out on something called The Never Forget walk. One might say that with every step Frank Siller takes, he comes one step closer to honoring the memory of his brother steven. Everyone thought he was the best friend. You want to know why . Because he treated everybody that way. Reporter he sounds like a wonderful man. Steven siller was a new York City firefighter who, on the morning of 9 11 had finished his shift with Brooklyn Squad one. He went back to work after learning a plane had crashed into the World Trade centers north tower. Siller grabbed his gear and went toward manhattan. When he saw the Brooklyn Battery Tunnel was closed. He got out and went through the tunnel with 60 pounds of gear on his back toward the twin towers. Steven was one of more than 300 new York City firefighters killed that day. Way to go reporter now his brother frank is paying tribute to him by trekking more than 500 miles through six states in six weeks to honor not only his brother, but all the heroic first responders from that day. How did you get the idea to do something like this . Well, i was i know i was going to do something with walking because reporter why walking . Because walking is very therapeutic. And i like to only do things if it has meaning. It just has to be the right thing. Once i thought of that, i said, oh, my god, thats it. I didnt know how many miles its what, i didnt care. But i knew it was the right thing to do. Reporter on August 1st siller began his journey at the pentagon. Our first mission is to make sure we never forget what happened 20 years ago. Reporter 20 days later he made it to shanksvilleville, pennsylvania. The week after that, hershey, pennsylvania. Thank you, god bless you. Reporter where word of his journey had started to spread. Emotionally, im wondering how this walk has affected you. Look, every day was very emotional. Many times ive broken down and cried privately, you know. I just Cant Help myself because and i dont know what moment its going to be and i dont know what little thing is going to trigger it. Reporter last week morristown, new jersey. This week its new York City. I like that. Lets be happy. Lets be happy. Reporter throughout it all, never missing a step, walking a little every day, sometimes with a group, or alone. And when the weather was not so great, at times talking to his brother steven. I laugh at the rain. He laugh at the heat. Whatever my brother wanted to throw my way because he was a big buster. Reporter really . He liked to bust chops. So whatever he threw my way, i laughed. I said, steven, i know what youre doing. I know what youre doing. Reporter the final and most challenging leg comes this saturday, September 11th. What do you think youll be thinking about when you walk through the tunnel, the tunnel that your brother walked through on that day . Ive been, ive been looking forward to it dreading it at the same time. Because i know how much ill be overcome with emotion. Reporter but he says hes ready to complete his walk and carry the memories of his brother and the other men and women who lost their lives that day. And a lot of folks supporting him on that journey, which will end right here at Ground Zero on saturday. Now, brianna, in addition to his never forget walk, siller also started a foundation, a Nonprofit Group called the tunnel to towers foundation. What they do is they set out to help first responders who died that day and first responders who died later of 9 11 related illnesses, helping them buy homes. The foundation also sets out to educate people, making sure everyone remembers what happened on 9 11. Brianna . I love that, he said his brother is busting his chops as he makes his way to New York.
