Martin savidge has been monitoring the situation. Martin, what do we know . Reporter well, we have some positive news coming directly to us now in the form of information from the county Sheriffs Department. They coresponded to this event taking place at mt. Tabor High School on the northwest side of the city. They report that one student has been wounded and that police and the sheriffs deputies are now actively searching for a suspect. They say that all the other students are safe. Now, that school continues to be in lockdown and authorities both from the city and from the county Sheriffs Department are methodically going through the buildings of this campus. Its about 1,600 students, grades 9 through 12. The initial report came in around noon according to local news reports. They say there was a Resource Officer who called in the shooting. But again, Forsyth County Sheriffs Department twieeting out that one student has been injured, the suspect is being sought but all other students are safe and sound, which is the best news you could hope for in this circumstance but its considered a very active scene. The students were initially taken inside of the auditorium and its expected from there that theyll be moved off campus so that parents will be reunited with those students. President biden calls the Law Extreme and says it blatantly violates the right established under Roe Versus Wade. The Supreme Court made the decision not to intervene to stop the texas Abortion Ban. This ban outlaws abortions starting at six weeks. Thats before most women know theyre pregnant. The law does permit an abortion under medical emergencies but not in the cases of incest or rape. Even more unprecedented is the way its enforced not by Law Enforcement but letting any private citizen anywhere in the u. S. Sue Anyone Who aided in the abortion, meaning a counselor who talked to a pregnant woman, an Uber Driver who gave a pregnant woman a ride. The head of Planned Parenthood fears other states may follow texas lead and that women of color and low income women in particular will not be able to get the medical care they need. Texas has literally turned back the clock 50 years so its an incredibly dark day, not just for the 7 Million women of texas but the 80 of americans who believe that there should be safe and legal abortion. Cnns Diane Gallagher joins me from austin, texas. Diane, just give us the details. How will this law be enforced . Reporter so, alisyn, in practice thats still kind of uncharted territory here in texas. Abortion providers and advocates say theyre not exactly sure because No One has ever seen anything like this. Now what makes this different from other laws is, as you said, this is a civil suit that is going to be brought on by private citizens who dont have to have any connection to the matter or even prove any sort of injury from it. And they dont even have to live in the state of texas. Now, we can talk about who they cannot sue and its a pretty short list. Its the patient themselves. Other than that, and i do want to read the exact language from the law here to let you know where theres a lot of confusion because its vague. Anyone who, quote, Knowingly Engages in conduct that aids or abets the Performance Or Inducement of an abortion. That person could be liable for a 10,000 fine for each abortion, alisyn. Heres the thing. They also would have to pay the legal fees. Curiously if a defendant wins that suit, they are not entitled to any legal fees. But its that fee there that the president talked about in his statement. I want to read a portion from it. President Joe Biden saying, quote, Outrageously Deputizes private citizens to bring lawsuits against Anyone Who they believe has helped another person get an abortion, which might include Family Members, Health Care workers, front Desk Staff at a Health Care clinic or strangers with no connection to the individual. Alisyn, some of the advocates that i spoke with, a protest just broke up at the capitol, told me that they are in some cases more concerned about a plaintiff who may have a connection to an individual, pointing out that this does not prevent someone who may have escaped an abusive relationship and that abuser from Filing Suit against their family and friends and furthering some kind of harassment. They also tell me they are concerned about what this may mean for cases of rape and those victims being potentially retraumatized in those situations. Some of these organizations just told me that they have been working to collect funds essentially to work on getting people who are pregnant, who need abortions in the state of texas, out of state so they can have the procedure done because it is just too risky for many of the organizations who provide abortions in texas to conduct them at this point. There are so many Ripple Effects that we cant even imagine at the moment. Diane gallagher, thank you for the reporting. So lets talk about that. We have reba martin, and laura coates. Laura, The Dark Dystopian Undertones of this just cannot be overstated. Let me get this straight. A woman in texas now has to carry her Rapists Child to term. Thats the new law . Its unbelievable, alisyn. Remember, one of the craziest things about this is how unnoticed its gone. This was a shadow docket. The Supreme Court has been silent. They were able to essentially allow roe v. Wade to in essence be overturned and they didnt say a word. They havent stepped in. They havent issued an opinion. They havent asked for oral argument. This is a case thats been on the books for so many decades. They have the idea of a trimester framework totally uprooted. The woman being able to make personal decisions under roe v. Wade and its progeny, including the idea of when a fetus is viable, thats all upending upended now which essentially says if you have a problem with the law being enacted in the state, you cant sue the state. They have sovereign immunity. You usually sue the State Official whose job it is to enforce that law. A police officer, somebody who might be the Board Supervisor in some capacity. They dont have a state actor. It can be a private citizen who just says ive got a problem with what youve done and im not going to have to be beholden to a specific definition of what it means to aid and abet. It could be the Uber Driver. How about the donor to Planned Parenthood. How about somebody that suggests the person speak with an abortion care provider. All fair game. 10,000 bounties per hit. What will happen here . This has already gone into effect even before midnight because these providers already stopped knowing what was coming to them, knowing all of the different cases that they would have to defend against. All hope is not totally lost. If somebody were to be sued under this private civil action, well, they can then go to court and say i shouldnt have to pay this bounty, this fine, because its unconstitutional. But roe v. Wade was supposed to take care of all of this. An individual Person Or Somebody who aids or abets is not supposed to have to case by case at the whim of a private citizen have to defend against what roe v. Wade already said they could do. Before we get into what the Supreme Court may or may not do next month, just i dont even understand how it would work. If everyone is deputized to call in a neighbor, to call in some revenge hit on an exgirlfriend, to call in on a stranger, i dont understand how this can ever be enforced on the Uber Driver, the school counselor, et cetera. And thats the brilliance, the Wicked Brilliance, alisyn, of the law. These lawsuits may never come to pass. But the fact that that law is on the books now will have a significant Chilling Effect on Abortion Clinics in the state of texas. Weve already seen several of the biggest clinics saying they are no longer willing to provide reproductive care to women because they dont want to put their staff, they dont want to put Family Members and other individuals at risk of being sued. So we may never see this barrage of civil lawsuits where people can collect 10,000 and collect their legal fees. The fact that the law exists has effectively and immediately ended what some advocates say is 85 of all abortions in the state of texas. One of the jawdropping ironies of this, ladies, and laura, ill start with you, is that Governor Greg Abbott has banned Mask Mandates and vaccine mandates in his state trying to Battle Covid because he says he doesnt want the state involved in making medical decisions for your family. Heres what he says. Texans, not government, should decide their best health practices. I mean he obviously should have gone on to say except for women. Except for women because apparently just think about just how odd and absurd this is. Theyre saying the government should have no part in trying to tell you to wear a mask, even though it might negatively impact unvaccinated children. That same argument about the whether the government has a right to control your body or your Health Decisions in some form or fashion, that doesnt apply at all when youre talking about abortion apparently, even though the same logic should apply if youre speaking about concern for presumed children. So this notion here is so inconsistent. And why you also know that this is really not founded in logic. There is as reva so brilliantly said, the Wicked Brilliance of the litigation strategy, but that is obviously countered by the absurdity of the hypocrisy thats involved here. It should not go unnoticed that remember the Supreme Court has not as its current composition, has not demonstrated an overwhelming Love And Appreciation for roe v. Wade. The expectation is that they will continue to be hostile to roe v. Wade. Just note that without saying a word, they were able to effectuate what is presumed to happen if they do decide the next case on roe v. Wade. This is not how its supposed to go. Imagine if you will somebody in another instance says, you know what, ive got a problem with guns being purchased. Lets have a State Law that allows any private citizen to have a 10,000 fine and can Sue Anyone on Anyone Who aids and abets Gun Ownership in this country. People would be coming out of the woodwork in opposition, angered by what the Supreme Court has already said and individual rights and talking about the second amendment. But when it comes to women and their uteruses and reproductive rights, all bets are off. Reva, this is put in legal Nomans Land right now which is maybe the Supreme Court passed on taking it up. But what does this mean for Roe Versus Wade . What does this mean for next month when the Supreme Court reexamines all of this . Yeah, alisyn, i think the Supreme Court by not saying anything has spoken volumes about the status of roe v. Wade and the security of it. We know that the court has three justices that were appointed by Donald Trump and we know Donald Trump made it very clear when he was campaigning that he wanted to appoint justices that were hostile to roe v. Wade and would overturn roe v. Wade. Its not just this texas case. There is a Membersississippi Cat involves a 15week Abortion Ban and that case is also slated to be taken up by the Supreme Court. I think roe v. Wade is in jeopardy. I think women around this country need to understand that today is a huge Wakeup Call for us to talk to our senators, talk to our congress people, talk to the president of the united states because at this moment it is not clear to me that women will be able to make reproductive choices about their bodies because men, primarily men but legislators like those in texas and other states, have decided that they know better as it relates to what women should be able to do with respect to their body. As laura said, the hypocrisy is just nauseating. You cant wear a mask but you can decide that a Woman Cant make choices about her body. This is a Wakeup Call for women and men all over this country. Such a pivotal relationship of course with russia just given its proximity and history. Trying to reset that relationship. Right now President Biden is explaining his support for ukraine. Hes going through how the u. S. Has given some 2. 2 Million doses of the Covid Vaccine to the ukraine. Going through a litany of how they are supporting ukraine in its controversial and contentious relationship with russia. The question is will President Biden take questions and talk about afghanistan or is he trying to turn the page entirely from the withdrawal of troops from afghanistan. Medical services are seeing a 185 increase in calls and incidents. Half the Gas Stations in New Orleans and Baton Rouge do not have any fuel. Power has been restored to a very small portion of New Orleans. But nearly 1 Million homes and businesses in the state are still in the dark and still in the oppressive heat. Officials estimate the outages could last up to a month in some areas. Rescuers are still busy searching for people who need help. Our crews have not been able to access some of the hardesthit areas yet. Brian todd is live at a Gas Station in metairie, louisiana. Reporter people are still struggling just to get some of the basics a little more than three days out from the hurricane state. This Gas Station, the discount zone, check out the line over here. We talked to some people in the car gas line. You can see how it extends down this main road. Some of these people have been waiting eight and nine hours for gasoline at this stop. Even before the station opened, they were in line. Some of them are at their Wits End waiting for gas. They have a separate line for people coming in on foot just to fill up their Gas Cans. We talked to some of them. Some of them have been waiting on foot for two, three, four hours just to get their gas here. Now, the manager of the station told me theres a 30 limit hes got to put on everybody to make sure everybody gets the gas they want. I asked him are you close to running out of gas . He thinks he has enough to last through the rest of the day. They have other shipments coming but theyre coming from houston. They cant come from the refineries here off louisiana because they are not online yet so hes trying to get his gas from houston. He thinks hes got enough for the rest of the day but he has got to ration it. In a nearby neighborhood in kenner, louisiana, we were there a short time ago, roofs ripped off houses, people isolated, running out of food and water. Theyre wondering when the cavalry is coming to help them. We spoke to a lady there named patricia carter. Take a listen. We need help. Weve got elderly people that dont even go outside. You dont anybody knocking on doors to see if theyre okay or do they need medical, do they need food, do they need water. None of that, nothing. You dont even see a fema truck. We thought yall was fema. Reporter so she thought our crew was a fema crew. Shes really isolated. She has arthritis, migraines, high blood pressure. She said theres a lot of elderly people on her street shes worried about. They just need someone to come and check on them. They havent had anyone come down their street yet. Thats playing out in neighborhoods all around this area. Are fema trucks and the cavalry not able to get to people or whats the delay . Reporter you know what, in the sense that we have, alisyn, its not necessarily that the roads are impassable. You can get to these neighborhoods. There are just so many neighborhoods to get to. Turning now to Capitol Hill, House Minority leader Kevin Mccarthy issued a veiled threat, it wasnt that veiled actually, to phone and Social Media Companies that provide any information to the committee thats investigating the January 6th capitol riot. Mccarthy tweeted, quote, if these companies comply with the Democrat Order to turn over private information, they are in violation of federal Law And Subject to losing their ability to operate in the united states. If companies still choose to violate federal law, a republican majority will not forget and will stand with americans to hold them fully accountable under the law. Cnns Ryan Nobles is on Capitol Hill. Ryan, what is the Committees Response to this . Reporter well, the committee is not backing down. Mccarthys threat comes in the wake of cnns Exclusive Reporting on the fact that the committee is asking for the Phone Records of a number of members of republican members of congress to be preserved in the event that their investigation gets to that point that they want to see exactly who these members were talking to in the leadup to the January 6 insurrection. The committee said after Kevin Mccarthy sent out that threat via tweet that theyre not going to be deterred to whitewash the events of January 6th and theyre going to continue to move forward and ask for this Information And Work with Social Media and Tech Companies to get whatever they need to complete this investigation. But the question is does something like this just interrupt the flow of information over the course of the investigation . Does it slow the process down . Its already expected that there could be a lengthy legal battle to obtain this information, that some of the individuals who could be whose records could be asked for could say that this was a violation of their personal rights and abilities and they may try to step in the way of this. So this could be a long process to begin, with alisyn. If you have the House Minority leader putting out a threat which is basically what he did last night telling these companies that if they comply with a duly impanelled congressional committee, that could make them nervous to be involved in this process. Now, the Tech Companies, the Social Media Companies, they havent responded to mccarthys claims. The question, though, is will democrats on Capitol Hill take the next step of accusing Kevin Mccarthy of obstructing this process . One democratic member of congress, eric swalwell, has said this is something that the Department Of Justice should look into. The doj not commenting on that right now. Could democratic members ask the house Ethics Committee to look into this and offer up some reprimand of Kevin Mccarthys conduct in all of this. We should also point out that Kevin Mccarthy said obtusely that there is some sort of federal law that these companies could be in violation of but he has yet to say exactly what that statute is. He just threw it out there as something that could be very bad and he said could force these companies to cease their operations in the united states if republicans come to power. Again, he wont even say what that law is. Ryan nobles, luckily we have an expert who will tell us all about this. Thank you very much. Joining us now, cnn senior legal analyst, elie honig. So what federal law prevents Phone Records from being subpoenaed . Spoiler, none. Hes making this up. Theres no federal law . No. Heres the way it works. Its really quite the opposite. It is the most normal thing on the planet for these phone providers, verizon, at t, they get subpoenas all day long. They have entire divisions of their companies, all they do is turn around these subpoenas for Phone Records all day long unless a judge steps in and says thats an inappropriate subpoena. Thats very rare. Thats their job, the law says they have to comply. Theres nothing extraordinary here. Mccarthy is basically talking smack, trying to throw a Monkey Wrench into this procedure. Do we know what the committee is looking for in these Phone Records and why would Kevin Mccarthy be trying to block Justice Or Block potential criminals from being prosecuted . Thats the question, right . These Phone Records are going to be really valuable information for the committee because theyre going to give a Road Map to this investigation. Theyre going to show you, me, investigators, who exactly spoke with who at exactly what minute of what day. That is where you start an investigation. As a prosecutor, as an investigator. Once you know who had what conversations with who at the critical times, then you go talk to those people. Maybe you subpoena them. Maybe its Kevin Mccarthy, maybe its Jim Jordan, maybe its mark meadows. That results in subpoenas and thats going to get potentially really ugly for Kevin Mccarthy and others around him. Just so i understand, the committee thinks that some lawmakers spoke to some of the Capitol Rioters . Theres two possibilities here. That could be. You would see that in those Phone Records. The other possibility and i think this is clear, they want to know who was in contact with the White House when, how many times, antds then for each of those contacts, you would naturally ask the person, you called the White House three times on January 5th and January 6th. Who did you speak with . What did you speak about . I think thats whats got Kevin Mccarthy worried. We do need to know why the president s response and white House Response was so belated and so delayed when it became a deadly riot. What could be more down the middle of this investigation. This is one of the core questions here. There is nothing political about it. Lets remember, Jim Jordan for one, has said ive got nothing to hide. Lets see if theyre good for that. If they have nothing to hide, they should be behind this effort to get the real facts. So Kevin Mccarthy put this statement out on twitter. Are there any possible legal ramifications for him . Is he obstructing justice . What it means to obstruct justice or in this case a congressional proceeding is to make an inappropriate threat, an improper threat. I think we agree its not much of a veiled threat. It was a direct threat. He said when we take over, assuming the republicans take over, we may shut you down, verizon, phone companies.
