Law in texas which bans all abortions six weeks after conception took effect in that state. This after the Supreme Court and a federal Appeals Court failed to take Emergency Requests from providers to stop it. Many women do not even know theyre pregnant until after six weeks. Also, a disturbing detail, the new law would allow any private citizen in the country to sua Abortion Providers or anyone who assistS Pregnant women in texas seeking an abortion. Opponents argue the law immediately and catastrophically reduces Abortion Access in texas. All this as the Supreme Court is set to rule on another Abortion Case next month which could have implications for the entire country and, of course, the roe v. Wade ruling. Lets begin with Cnn Supreme Court reporter Aryan Deveaux and political Analyst Kirsten powers. Aryan, let me begin with you. The fact the Supreme Court did not act on this, does that signal their own decision on the merits or might they act today or at a later date . Right, thats a really good question. No matter what, this shows that roe v. Wade is in big trouble with this conservative court. But its important to show what the court did and did not do last night, and there is this caveat, right, so the Texas Law bars these abortions after six weeks, the most strict in the country. The clinics raced to the Supreme Court and they wanted to stop it. And it was set to go into effect at midnight. The Supreme Court didnt act, so that means they effectively allowed it to go into effect. But one of the caveats here is that the court still could act on that today. They could issue an order this morning, this afternoon, but they didnt, and the fact that they allowed it to go into effect, jim, that really is not good news for supporters of Abortion Rights. Its not for sure, they could still do it, but that is not good news for it down the road for them. I want to get to the Mississippi Case in a moment because that, of course, is before the court. But, kirsten, with you, texas, one of the largest states in the union now, extremely difficult for women to get abortions. Theyll have to go out of state frankly, many of them will. Tell us about the broad impact of this and about concern concerns among womens groups about what this means going forward more broadly for Roads Row row. Roe v. Wade. Reporter first, this is wildly out of the mainstream. This is out of the mainstream in texas. If you look at the university of texas, Texas Tribune Poll that was done earlier this year, they found that even among prolife, people who identify aS Prolife, they do want an exception for Rape And Incest, for example, which this does not provide. So this is not even within the mainstream of prolife people. Also i think it will have catastrophic effects in terms of how it will affect Abortion Providers. They already said they potentially could go out of business. It pretty obviously to me will lead to more laterterm abortions because people who cant get the abortions early on will have to go out of state, which means theyll have to get more money, theyll have to get time off from work. So its actually for people who claim to care so much about abortions later in the term, theyre actually going to be creating more of that through this law. Well, an important point you make, too, no exceptions for rape or incest. Imagine those circumstances. Someone is raped or impregnated by a relative, a male relative. They dont know theyre pregnant up until six weeks and they have to carry that baby to term. Its a remarkable fact to state out loud in plain english. Reporter right. And like you said, youre not even going to know basically by the time you would even know that you had missed your period you have two weeks to get an abortion. And what if you are, you know, a 14yearold girl who has been molested by her father i mean, this is really thats sickening to me. And this is in the same state where, you know, people are freaking out about, you know, their bodies are being attacked by having to wear a mask and you have the governor trying to ban masks as some in Fringement On Freedom and theyre perfectly fine infringing on the freedom of a 14yearold girl or a fullgrown woman for that matter. It doesnt really matter, right. Its who it is and making it impossible for them to have control over their own choices. Yeah, i mean, if youre looking for principle consistency, my right my body argument, masking Vaccinations Reporter dont look here. That blows up. Aryan, there is of course another case already before the Supreme Court, a Mississippi Law. Tell us what that decision means, what theyre considering there. And i also want to know for sure, by not taking this up, has the Supreme Court just okayed a no Exception Rule for Rape And Incest . It didnt rule on the merits. It didnt say anything. It didnt overrule roe v. Wade. It said nothing. By saying nothing it allows it to go into effect. I want to make one other really critical point. This law was written in a way thats going to inspire other states now. Its not the usual law. Usually you can sue texas and say, take them to court. This law allows any person to bring a lawsuit about someone who assisted an abortion. That means it could be a provider, somebody who paid for it, someone who drove you. Could it be a relative who drives you to the clinic . Exactly. Thats why this is interesting. So, the Supreme Court hasnt said that roe v. Wade is unconstitutional in this case. It just simply did not. But coming this term, they are taking up a separate case where theyre going to have Oral Arguments about a Mississippi Law. That time you should really look to see what it says about roe v. Wade. Tell me about what are the details of the Mississippi Law the Mississippi Law is a ban at 14 weeks. Right. So thats different. I see. From this law, and theyre differently situated. That one will have full briefing, Oral Arguments hear from the justices. Adjustment for Rape And Incest in that law . No. Thats remarkable. Ariana ariana, thats why we cover these. Thank you very much. Water, gas, medical supplies depleted, hard to come by in louisiana. Particularly the coastal areas, roads washed out. Right now power has been restored to a very small portion of the city of new orleans, but nearly 1 Million households in the dark across the state. That could last for weeks. Remember, each household might have several people. At least five people have died due to the storm so far. Officials are still conducting rescue operations. Crews have not been able to access some of the hardesthit areas yet, thats why there is concern about a rising death toll. Lets begin with cnns ryan young. He is in new orleans. Ryan, its a major city. Its been through this kind of thing before. The levees held. Thats good news. But power out possibly for weeks. Reporter good news, yeah. Yeah, when you have to put this together here, when you think about some of the storms that weve covered here in yearS Past, one of the good parts about this is theres no Standing Water in a lot of parts of the city. The power being out has rising frustrations across the area. Look at where im standing here. This is some of the Destruction Weve been able to find. You can see the Power Lines have definitely been hampered by the roof that has blown off the school that were standing in front of. As we go this direction, you can see parts of this roof hanging. But its the sweltering heat, jim, id say stands out at thiS Point. Youre talking about Triple Digit possible heat today. Youre seeing people try to come outside to get any sort of rest from that just extreme heat. And on top of that, theyre running out of gas. Theyre running low on food. And theyre running low on patience. In fact, take a List Tone this one woman who is running an organization trying to get food out to the people. Ive been working in Disaster Response for about 12 years and i think this one really just no one saw it coming. I think this was a really improbable scenario. But were going to do it. Were going to take care of Each Other. You know, new orleans is known for caring for our community, and a lot of The Ways we show love is food. Reporter so, if you think about this, jim, look, we talked to several People Yesterday who were waiting in line, not only for food, but for gas. This is not something they expected. When you think about it, a category 1 Storm Sort of sticking it to the city this way, thats not something people really expected at all. You have Power Line crews coming in from all across the country trying to get Power Back on. But i can tell you, patience is starting to run thin. When you listen to the radio, people are very upset because they obviously want Power Back. You put on top of that, theyre going to their cars sometimes to run the car so they can charge their phone. But if you dont have a lot of gas to make it through the rest of the week, you can start seek the issues that are going to start compounding in the next few hours. No question. Hours, days, weeks. First, can you describe the damage in new orleans right now and what that means for businesses like yours just trying to stay open . Theres just, i mean, trees everywhere, no power. Power lines, devastation, roads totally covered with trees, debris, flipped over vehicles, trees on houses, roofs flown off. Just reminds me of betsy in 1965, because i came through new orleans and we didnt flood, but we were out of power for about two weeks. So were going through pretty much the same thing. Thats why were here now. We had to bail out of town to get another generator to be able to get the Pizza Parlor back up. We had it for that first day and we had to come to centerville. After this interview were headed back to new orleans. Hopefully well find gas. Thats been our biggest problem. But well get some gas somewhere on The Way back to new orleans. And hopefully we should be open by 11 00 a. M. Central time. Well, im sure, im sure pizza is a little bright spot in the midst of all that there. How many people, you know, running that generator and doing all youre doing, how many people have you been able to feed these last couple days . Well, the day before yesterday was monday after the storm hit. So we opened with just nothing. We had to bring in lanterns and we had dough from we had previously made and stored. So we had that. We had to just run out of that, and it was only strictly Word Of Mouth because there was no power. There was no internet. Theres nothing. Fortunately we came to centerville, which allowed us to be able to have this internet connection. So, what do people do now i mean, you talk about blocked roads. If they cant leave, right . Theyre running their cars just to charge their phones. That doesnt help you when youre home and you cant turn the Air Conditioning or the lights on or anything. What are people doing . I mean, they cant come for pizza three times a day. Are people able to get food . Right. Well, now theyre slowly when i get back to town, ill find out for sure. Theyre slowly finally getting some of the general Grocery Stores open again because of their generators. So it just took a few days for us to get together. Well all privately be able to get our stuff together and like me, just doing my little thing for my restaurant, and everybody in the bigger scheme iS Pretty much doing the same thing. The city is working at clearing the roads. They had already started all that, so they are clearing the road. Theyre doing their job. Its good to hear. Listen, and on the good side, i wonder how much of a difference it makes to you that the levees did hold, unlike In Katrina in 2005. So you dont have the city under water. Tell us the difference that makes. Well, ill tell you, heres the big thing. It makes all the difference in the world. Were actually in centerville. 16 years ago we were here. Weve been knowing Each Other since 1990s, and let my wife and i and our three sons, dog, cats, All Of Us stay here 3 1 2 months during katrina. But now without the water in new orleans, were able to get back into the city, so im pretty confident that things ought to be Coming Up pretty soon. Now they did their job. They helped. New this morning, House Minority Leader Kevin Mccarthy issued a threat to private Cell Phone and Social Media Companies that might cooperate with the January 6 Select committee, warning, quote, a republican majority will not forget. This comes after the committee told the companies to preserve Phone Records of some protrump lawmakers and members of the former president s family who played some role in the stop the steal rally before the January 6 insurrection. Cnns Melanie Zanona is live here with me now. Melanie, is this a genuine threat . Does he genuinely believe hes got federal law on his side . Reporter well, it is a pretty stunning and remarkable threat from the top republican. Let me read the full statement from the Minority Leader here. He said, quote, if these companies comply with the Democrat Order to turnover private information, they are in Violation Of federal Law And Subject to losing their ability to operate in the united states. If companies still choose to violate federal law, a republican majority will not forget and will stand with americans to hold them fully accountable under the law. Now, a couple things to point out here. Its unclear what law Kevin Mccarthy is referring to claiming that theyre in Violation Of. We have asked his office for clarification and they have not got back to us. This is a duly authorized investigation. And panels have used their Subpoena Power in the past to obtain private information from companies. And second of all, the committee has not even requested technically these records yet. Theyre just asking that they be preserved in case they want to request them down the line. Okay. But i think what it really shows is that republicans led from the top are trying to throw as much sand in the gears of this investigation aS Possible. And Donald Trump himself has also said hes going to exert Executive Privilege when he can to block access for other documents and records requests. And ethics experts are already questioning whether Mccarthys Threat is in Violation Of ethics law. It is unclear at thiS Point do we know what he was threatening by a republican majority will not forget . Is he threatening to pass some sort of legislation to penalize the companies . If theyre in the majority, they could subpoena them, Pass Laws to penalize them. Theres a whole host of things they could do. But look, at thiS Point the committee, the select committee has said, we are undeterred by efforts to obstruct our investigation. Here is what the Committee Spokesman told cnn in a statement last night. They said, the select committee is investigating the violent attack on the capitol, an attempt to overturn results of last years election. We have asked companies not to destroy records that may help answer questions for the american people. The committees efforts wont be deterred by those who want to whitewash or cover up the events on January 6 or obstruct our investigation. The Bottom Line here is this investigation is really starting to heat up, and we are seeing republicans, including those Like Mccarthy who could be ensnared in the investigation, pushing back as hard aS Possible. To your point, mccarthy is one of those people who could be on the initial list. There is interest in his conversation with the president that day urging off the protesters. Melanie zanona, thanks very much. Joining me to discuss the law behind all this, Cnn Anchor and a lawyer herself, laura jarrett. So, mccarthy says if these Telecom Companies comply, they will be violating federal law. Is that true . Its not even clear what hes talking about because as melanie said, cnn has asked his spokes men and theyre just not replying, which is i think iS Pretty telling. The truth of the matter, jim, there is no law on point against what hes talking about. Theres no case on point. This would actually be a novel situation if one member of congress used a subpoena to try to subpoena another member of congresss records. Now, thereS Present of state and federal regulations that regulate the Telecom Industry, right. The Telecom Industry cant just go disclosing its users and customers data willynilly. What were talking about a duly authorized member of congress, a congressional body here that does have Subpoena Power. And the real effect here i think is a chilling one. Its the idea that you actually want to prevent these Telecom Companies from following the law, from following any subpoena that they may get. But were not even there yet because as you and melanie were just discussing, this is just a preservation order. This is highly routine and congress does this all the time, and all theyre trying to do is tell the Data Companies that you dont get to destroy the records right now. Okay. Melanie mentioned the possibility of an Ethics Investigation for issuing a threat and there are prior cases to that. From a legal perspective, from a leader, sitting lawmaker to say, we will not forget, a not so veiled threat i suppose the possibility of legislation. Is that legal . I think he has real Obstruction Of Justice issues. There is a law on point. 18 usc 1505 actually has to do with obstruction of congressional proceeding. What hes done here is a threat on twitter against the Telecom Industry. As you pointed out, a not so veiled one. There you go. Okay. Although the Track Record for prosecuting Obstruction Of Justice in recent years not particularly good. Fair enough. So what do the companies do here . The companies listen to what hes saying or the lawyers already preparing and preserving these records as requested or demanded by congress . Look, im sure they realize and their lawyers realize this is going to get caught up in litigation anyway you go. I think to protect themselves, theyre going to have to preserve the records. The real question and where the rubber will meet the road is if they actually do try to enforce the subpoena. Thats where this will end up in court and thats where things could get ugly. And thats where theyre trying to obstruct. The question is why . Why dont they want the records to come out . Why dont they want the american people to know what happened in those conversations with the president that day. Does the Delay Tactic itself work. Two senior leaders in the Fdas Vaccine Office will be stepping down in the coming months. The retirements coming as the agency works towards major decisions about Booster Shots as well as vaccines for children under 12. Cnn medical correspondent Elizabeth Cohen joins me now. Do we know why theyre leaving . Jim, we dont know why. We do know this is quite a loss. Together dr. Phil kraus and dr. Maryann gruber have more than 35 Years Experience at the fda. Dr. Gruber, she headed up the office of Vaccine Research or still does actually until she retires. And dr. Kraus was her deputy director. So this certainly is a loss. Now, cnn has spoken to a source who talked about frustrations at the agency that the White House haS Prejudged, has been ahead in some ways of the fda with Booster Shots. Sort of the Golden Rule has been let the fda make a decision, and then talk about something. But here several weeks ago, the White House coming out and saying september 20th, thats when were going to start boosters. And the Fda Hasnt said what they think about boosters or said when they think people should get boosters. These people are working very hard. We are told there are serious morale issues at an Agency Weve relied on more than a year and a half. Jim . All these decisions, of course, influenced by the data. And were waiting, for instance, on data for vaccines for children under 12. But cdc has new plans going forward for how it shares this data . Whats your reporting . Thats right. So, jim, the cdc says anyone who has been watching the cdc for years knows they are very careful, they are precise, and some people would tell you they are very slow at getting data out. They want to dot every I And Cross every t. Sometimes thats not good for public health messaging. Theyre just too behind the times. That criticism was there before the biden administration and it has been there since biden became president. So now what happened in the past two months or so, the cdc has decided to talk about data that theyve looked at and analyzed and vetted, but have not yet published. Before the cdc would wait for something to be published in its own journal, in another medical journal, but now the decision is, lets talk about it. We need to make guidelines. There are some concerns about this because it iS Possible to some people in fact, some people are saying, you know, i dont like vaccines, i dont like masking. Look at the cdc. So this notion that im ending a war that was happening for 20 years, boy, jim, i just cant agree with it because when we left, Al Qaeda is still in 15 provinces in afghanistan. Isis is on the move in afghanistan. And now we dont have anyway to deal with that, i believe, thats in our own national security interest. I think everybody wanted out, but nobody wanted to frame out why we should stay. Let me ask you this, because the president s argument, and youve heard this elsewhere, is that yes, Al Qaeda is in afghanistan, but Al Qaeda and groups like it are in many other countries now. Its spread, its metastasized, including in many countries the u. S. Does not have a deployment, u. S. Military presence on the ground and that the u. S. Can handle this from outside of the country. Do you buy that argument . Whats your response . I dont. A, we cant handle it outside of the country. Anything by Remote Control simply isnt going to work. I think the nearest fly over flight is something like seven hours over the horizon. Even if you got good intelligence where somebody was and you wanted to do an airstrike, i doubt theyre going to be there in seven hours. You lose the collection capability. Remember, this is where Al Qaeda planned, recruited, financed, trained to attack the united states of america. They didnt do it in those other countries. They did it in afghanistan. And they did it because the taliban gave them safe haven. And remember, the taliban has a lot more in common with isis and Al Qaeda than they do any western notion of governance. So some notion that thats all suddenly going to change i think is both naive and dangerous. So we leave, we have the same problem staring at us. And yes, we do have Al Qaeda and other countries. We do have methods were using very effectively and go after those and target pockets of Al Qaeda. So everything is different, but to say, well, we dont do it anywhere else so were not going to do it in the one place that we know that Terrorist Group that ran the country supported them and allowed them to attack the united states is going to walk away . Boy, i just dont buy it at all. So, another argument you hear from the administration and i will say i find it remarkable when i hear those words coming, for instance, from a uniformed general there talking about cooperation with the taliban after 20 years of fighting the taliban in that country. But the taliban has different priorities now. Running the place, right . Should americanS Place any Confidence Or Credibility in taliban claims that, well, were different now, right, and that agreements made with the u. S. On, for instance, continuing evacuation should be believed . I wouldnt take the word of the taliban for love nor money.
