Well, first and foremost, the practice has to come to an end. All of our students should be able to be included in all of the classrooms. And there shouldnt be a designated black class period. The second thing is, its concerning to me that in addition to this, weve had other issues with the local administration at the school that are concerning. Because we raised these concerns, it was an onslaught of retaliation from on my family. And i feel as if there was, from the local school, there was no from the principal specifically, there was no remorse. This was something that she wanted to do, her personal vendetta. And unfortunately thats not what aps is paying her to do. There are rules and there are policies and procedures that she is to follow. And unfortunately that was not done and i think that because the administrative team, the assistant principal, the Math Coach and the lit coach were all aware of this practice and it was confirmed by the a. P. As well as top seniorlevel officials in the School District, that she did it, she admitted to it, they all need to be removed. They cannot make educational decisions for students. Just to be clear, kila, you pulled your kids out of this school . I have not. That is our school. This is our community. We should not have to leave because they cannot follow the rules. And sharees, at this stage we need to go, but where do you see the case right now . What has the School District promised you . The School District hasnt promised us anything. We have a complaint thats pending in the office of civil rights of u. S. Department of education. So, its pending right now. All right. Well, listen, please keep us posted as to this case. And kila, we wish you the best and hope that the School Year with everything thats going on is successful for you and your children. Thank you. I appreciate you having me. New day continues right now. Welcome to our viewers in the united states and all around the world, im John Berman alongside brianna keilar. The fda is expected to announce that it is authorizing Vaccine Booster shots for americans who are immuno compromised. That means a third of the current twodose third shot, i should say, of the current Twodose Moderna vaccines will be offered. The additional dose would be for immunocompromised people who did not have a good official response to the vaccination. Cdc Vaccine Advisers will vote tomorrow on these additional shots. This need for this protection is urgent because of the Delta Variant. There are hospitalizations that continue to rise nationwide. There are nearly doubling every two weeks, bringing some hospitals to the brink of collapse. Just take a look at the number of Icu Beds currently available in parts of the south. There are zero right now in mississippi. One medical director there warning the States Hospital System could fail by next week. A Field Hospital Opening in the State Tomorrow to handle the surge in patients. Temporary Covid Tents have also been set up outside Lbj Hospital in houston. Icu beds completely full there. Listen to the head of the medical group that runs the hospital testifying before texas lawmakers this week. If this continues, and i have no reason to believe that it will not, there is no way my hospital is going to be able to handle this. There is no way the region is going to be able to handle this. Can you just give us a sense of what it is like in your Hospital System . Good morning. Thank you for having me. Let me start as always by thanking all of our healthcare staff, doctors, nurses, teches, Everybody Else and harris Health System but also all other Health Systems here locally and also nationally. They are the true heroes and tired heroes after dealing with this pandemic for a year and a half. To answer your question, things are terrible. My hospitals are full. And it is really not so much that the hospitals are full, were used to operating our hospitals, being the Safety Net for hospitals in T Area for hospitals to be full, but what is concerning is the rate by which our covid positive patients are increasing. You know, i testified just a couple days ago that this time around, this latest surge of covid in my hospitals, when i look at my numbers, it took me about five weeks to get from the baseline of only 11 patients across my system to the peak that we achieved last winter during the previous surge. There. During the winter surge, it took me three months to get from the baseline to that peak level. And what i was trying to relay to folks is that this cannot continue. Five weeks from now if this continues to go at the rate it is right now and again, i emphasize that i dont see any intervention, any mitigating interventions being put in place to try to slow this down, this will be a disaster. Thats alarming. Youre saying youre accelerating in case numbers at more than twice the rate than you did during the winter. I understand youre setting tents up. Is that right . Thats correct. And let me be clear, we actually have the tents during the last surge but took them down because the numbers went down. So, this is the tent that were just putting back up again. Very specific reason for that, two weekends ago, Lbj Hospital, the hospital that you referenced, at one point had 130 people inside the Waiting Room and that Waiting Room is really not designed to hold more than 60 at most 70 people. And the issue is that when people screen positive for covid19 and increasing number of people are Screening Positive for covid19, there was really no place for us to send them other than just the corner of the emergency room. So, the idea of the tent is as people screen positive for covid19, we can send them to the tent for them to continue their diagnostics and treatments until we figure out what to do with them. We have heard from other health officials that these numbers are skewing younger. The patients are skewing younger, almost entirely unvaccinated. What are you seeing where you are . Exactly that. Thats a really important point im trying to make. Yesterday i think the cdc came out again and announced that 99. 99 of the people who are getting hospitalized are unvaccinated. I want to emphasize the reality that the factuality of that. My numbers, harris Health System numbers since January 1 of this year, we have had more than 1,300 admissions to our hospital due to covid19 infections. More than 98 to be contact, 98. 3 of those patients were unvaccinated. Among the 128 people who have lost their lives to covid19 infections in my Hospital System, 128 deaths, not a single person was fully vaccinated. This is truly a pandemic of the unvaccinated. They are taking the brunt of this this surge, but their actions unfortunately is really impacting Everybody Else around them. And if i have a few seconds, i just want to really emphasize this fact that this is we dont live in isolation. This is not about personal freedom or individual choice. One persons personal freedom should not infringe on other Peoples Freedom and rights to being healthy and out of the hospital. A Persons Freedom to drink and drive does not negate our laws against drunk driving. Your personal freedom to smoke does not negate our ban on public smoking. Your personal freedom to wear a Seat Belt does not negate our Seat Belt laws and does not prevent parents from having to apply Seat Belts to their children who are unable to do so. So this is beyond a personal freedom and individual choice conversation. This is about us as a community doing the right thing. Thats such a good point and im so glad that you highlight all the contributions of the healthcare workers, what they are bearing right now after a year and a half. Its really unfathomable what your folks are going through. Dr. Porsa, thanks for being with us. Absolutely. Thank you. All right. Joining us now cnn chief medical Correspondent Dr. Sanjay gupta. I know youre moved along with all of us about what these doctors are going through and what theyre facing in all these hospitals around the country. Beyond that, the Cdc And Fda are trying to figure out how do we address this surge in cases. One of the things we learned is there will be authorization in the next few hours at this point for a third dose of the vaccine for some people. For whom and what does this mean . First of all, the surge, it is a problem as you talked to doctors all morning. Were seeing that in atlanta where i live as well, where Patients Cant come in for other things. You know, if you get in a car accident, you get shot, i mean, theyre having a hard time finding beds for acute trauma right now. Everybody is affected by this, as you guys have heard. What this means now specifically for people who have weakened Immune Systems who are immunocompromised, 9 or 10 Million people in the country. People who take Immuno Suppressant Drugs for Organ Transplants, hiv people, all these types of things, they are the types of patients were talking about. The issue is they were not mounting the same sort of Antibody Response to the vaccines in the first place. So third shot was a term you use, and thats probably the right term, its not so much a booster as a third shot. Let me show you a study they paid attention to. The left bar basically that red is what happened the antibodies they got after their first series of shots. They didnt generate a lot of antibodies. But look how much that improved after they got that third shot. They got a lot of neutralizing antibodies. The placebo with the blue. That is the data that influenced that were about to hear from the fda and subsequently by the cdc will recommend this for people with weakened Immune Systems. Maybe this weekend could see the third shot. 3 Million people . I think closer to 9 or 10 people. 4 or so of the population falls into this category. They have to define that, though. To be clear, exactly what immunocompromised means, but again generally cancer, Organ Trans transplants, hiv patients. You talk about Breakthrough Infections, that term. You actually have a new Essay Youve written. You dont agree with the term. You know, its interesting. I think this is a little bit of a trap, this term. Because Breakthrough Infection makes it seem like something broke through the armor of vaccine protection. Thats not really whats happening here. As you know, there are people who test positive and they are shocked to test positive because they feel fine. They have no symptoms. Its more that they had to be tested for Travel Or Something like that. I got tested five, six times when i went to tokyo, for example. I wouldnt have been shocked if one of those tests came back positive. But here is the important point, when you look at how these vaccines work, i find this fascinating, the antibodies, specifically idg works more so at the level of the lung. So its basically trying to keep this virus from getting into your lungs where it causes severe disease, illness, hospitalization and death. It doesnt work as well in the upper air way. Now, you can be carrying the virus in your upper air way, test positive, have no symptoms because thats not what the antibodies really necessarily are supposed to be doing. I dont think probably my fault as well but i dont think we ever explained that that well. This vaccine was to prevent that particular action in the body. So, now youre going to have a lot of people who are Testing Positive who have been vaccinated and people are going to say, the vaccines arent working. Not the case. Vaccines actually are working. This makes the case that theyre working because those same people did not become severely ill. I dont think if it explained it well there even. Its like the death star. Youre not hitting the vulnerable area, the thing is not going down, right . Its a good star Wars Analogy here. Youre maybe giving people a cold, its true. But youre not taking them out of the game. Youre not taking it out of the game. Youre just dealing with a little bit of a cold or some minor symptoms, right . Thats right. The Bottom Line is people are freaking out other things like this new study says the Pfizer Vaccine the effectiveness of it goes way down over time. No. Its still over 90 effective at preventing hospitalizations and this study, 100 effective at preventing death. We have to pay attention to this even as we talk about the third shots. What are we really trying to accomplish with the third shots. People mostly that they do get minor symptoms and things like that, is that worth now giving a third shot to those folks . Or is this better these shots better spent around the world. Sanjay, last hour i spoke to dr. Britt maxwell, treating covid patients for 16 months in tennessee. And really is at Wits End emotionally and physically dealing with the trauma he dealt with over the last 16 months. He attended a meeting in tennessee where he advised for mask wearing in schools. And they called him a trader. Other people faced this after the meeting. No more masks no more Masks God abusers you are shot abusers theres a bad place in Hell And Everybody is taking notes, buddy. Keep that little smug. Put it back on. Put that Mask Back on. Put your mask on how do you like that huh . Huh . We know who you are. We know who you are. No more masks. Keep it calm. Keep it calm. No more masks. We know who you are. God abusers. Trader as the doctor we spoke to said he was called. You know, ive been reporting on this for a long time. I live in the south. I see some of this even before today. Theres a lot of obviously a lot of emotion on this. That particular area in franklin, tennessee, youre dealing with a community that has less than 40 of the population vaccinated and high Transmission Rate of the virus. Those are just the facts. Its not going to be something thats going to last forever. Viral transmission hopefully will come down at some point, but i think one of the things that coming up over and over again is that theres got to be criteria set. We are doing this because of x, because of low vaccination, High Transmission and when they get to a certain point, we may be able to lift some of those recommendations. Now is not the time. I mean, hospitals hospitalizations and hospitals becoming full are always going to be the biggest Driving Force of these types of recommendations. And you know, thats scary to see for frankly myself, but my colleagues who are taking care of covid patients. Its really frightening whats happening out there. Its terrifying and they shouldnt have to deal with it. Theyre the heroes on the front lines here. I do want to ask you on a completely different note, a lighter note, shall we, because you are a former Guest Host on jeopardy they just announced its two new hosts for the show, and i just wonder since i have you here, what do you think about this . Well, first of all, it was never going to be me. So this was not a surprise here. I think two hosts is a little strange, ill will honest with you. Thats the most negative thing ive ever heard you say, ever, about anything. Two hosts is like no host, i think. Theres an addage there. But i want to say this in all sincerity because i was asked when i did this who i thought the host should be and i said it should be John Berman. Im not lying. Im not do not take him away from me, sanjay. They dont want someone where its their hobby. He would have to leave and he cant leave his day job. Why . Why . No comment. I think the message they were sending is they could have 100 hosts and one of them would not be me. I think theyre trying to send me a subtle message there, sanjay. One of the hosts we should note is the Executive Producer of the show. Yeah. Yeah. And i got to know Mike Richards really well. Theres something to be said for someone who knows the game so well. There is a procedure to this game. Youre doing 61 clues in 22 minutes. You have to hit a clue every 15 seconds. Its the fastest game, thing, ive ever really been involved with. They say you do television therefore you can do this. Its like saying youre on orthopedic surgeon, opth molgist, you have to keep the pace of that going. He knows how to do that. I was surprised. I thought he was sort of helping move things along. I didnt know he was in the running for the job. But i think hell do a great job. Certainly when he Guest Hosted he was fantastic. He never said to you youre up against stiff competition, like say me. That was never mentioned to me. That was never mentioned. John. I told you, 1,000. We actually have 1,000 people on our list. Were going to have a different host every night and youre not one of them. But im saying it now on New Day, should have been John Berman. I appreciate that. He is very good at jeopardy. He is fantastic. Youre a good friend. Sanjay threatened by that obviously. I understand why. Sanjay, awesome to you here. Thank you so much. A Trump Appointed federal judge will allow three major Defamation Lawsuits to go forward against trump loyalists. Rudy giuliani, Sidney Powell and Mypillow Ceo Mike Lindell sued for billions of dollars in damages by Dominion Voting systems. The company they falsely accuse of election fraud. Joining us now jeffrey toobin. This is a big deal. This is huge. You know, ever since the 1960s, its been very hard for public figures, public companies like dominion to win lawsuits. However, the facts of this circumstance are almost perfectly lined up for dominion to win this case. In order to win the case, you have to show that a statement was false and that it was made either with knowledge of falsity that the person who said it knew it was false or Reckless Disregard for the truth. What these three have shown is almost textbook Reckless Disregard for the truth. Thats what the judge said the accusation showed. And i dont know what even the defense is in this case because what they said is so obviously false. And dominion has been damaged in a very big way by these accusations. So the damages, if this case goes to a jury and if the jury rules for the plaintiffs, the plaintiff, there could be billions of dollars in judgment. No question. Look, weve seen some odd defenses when it comes to these things what could the defense be, ignorance defense, could it be siloed off from information . An echo chamber, what could it be . What the three defendants tried at this stage of the case was sort of a first amendment defense, which is, you know, this was an area of public dispute. We should be allowed to speak freely. The problem with that is, you know, there are limits to that, especially when it specifically damages an individual. This isnt another case is well, this was just my opinion. Opinion is protected. If you said dominion was a terrible company, that would be protected under the first amendment. But these specific accusations they made about being owned by foreign countries, all that stuff is factually wrong and thats the basis of a libel suit. On another not unrelated note the Washington Post received a transcript of an Fbi Interview that was done with giuliani in 2018. This had to do with whether he knew that comey was going to go back and reopen the investigation into hillary clinton. Right. As part of this interview, giuliani basically admitted that he lies in public sometimes. Right . He says he throws fakes to the media. Its highly relevant to the lawsuit because as his lawyer points out in that interview with the fbi he says its no crime to lie to the press. Thats true. Its not lying to an Fbi Agent or lying to a grand jury. You two probably get lied to pretty frequently on this program by people who have an interest in cases. Its not a crime. However, if you are lying in public about a company, about damaging somebodys reputation, that can be libel. Thats a civil matter. And i am certain that the plaintiff the dominion lawyers are very interested in that statement because hes acknowledged that he lies to the press, which is what this case is all about. I just want to give everyone one update on Rudy Giuliani now on Cameo Selling customized videos. His rate has gone up to 375 which puts him in dolph, so a soviet fighter gets 350, Rudy Giuliani, someone known to meet with known russian agents goes for 375. Dolph has a cooler accent. He does. So one of the things you hear a lot in right wing media is the entertainers questioning the mental capacity of President Biden. This friday night, tonights sippy Cup President joey, well, hes unwilling or unable to hold china accountable for covid19. The Media Mob refuses to ask Sippy Cup the hard questions we all want answered. So i will do it for Humpty Dumpty and company. This is another Garbage Speech full of lies from a senile person who thinks that theyre in charge of america. But actually isnt running anything. Hes not a dottering old fool, an Egomaniac And Narcissist taking credit for work of Donald Trump and all these other people. So does the fact that biden seems to be getting stuff done that he said he would do, including working to get this bipartisan Infrastructure Deal passed in the senate, does that up end these ridiculous theories. Joinings now is michael smerconish. You hear that litany of stuff where theyre trying to portray him as incompetent, well, does this list of achievements disprove that . I hate to dignify the cheap shots by even discussing them. Me, too. I think this probably doesnt change that narrative. He deserves a victory lap. It was a huge achievement, 1. 2 trillion for infrastructure, Mitch Mcconnell among the 19 republicans. I think youve got to give President Biden his just due. Is it a oneoff . Does it extend to other issues . Thats really now what remains to be seen. And im a little dubious as to whether the president can replicate that, john, with Say Voting Reform or immigration or minimum wage or a plethora of other issues that hes seeking to address. So, its certainly not going to change the critics who are out there and just lying in wait for him. But its a big achievement and he deserves the victory lap. Really then i guess the question, michael, is can he move forward on some of these priorities that really appeal to his progressives . Because this is an achievement yes, of course, you have the Big Three some trillion Dollar Bill that is going to be democrat only, but the bipartisan bill in terms of bills that will require bipartisan commitment, hes kind of triangulated here in a way. He is. Brianna, he is. And triangulated within his own party, right . Hes now trying to herd cats and keep together both the moderate elements and im talking about Senators Manchin and synema and also the more progressive elements the Squad A. O. C. , et ul. They all want different things. Its not all put to bed. He has to make sure he can appease everyone, keep the republicans in the tent on the 1. 2 trillion and at the same time try and advance through reconciliation that bigger 3. 5 trillion. So, he still has his hands full. But its a big step in the right direction on infrastructure about which i think theres uniform agreement in the country. You know, we all know that our roads and bridges and broadband and our rails are in desperate need of repair. President Trump Couldnt get it done for all the talk. Joe biden has. Remains to be seen what else he can do. So michael, youve got these, at least, three republican governors who have taken positions in fighting covid, some places not fighting covid. Literally taking away the freedom of local governments and School Boards to make decisions about masks and other things. Whats the Risk Reward for these governors as they consider whether or not theyre going to run for president in 2024 . So, you know, to those of us who are in the i95 corridor, we take a look at this and say, wow, isnt that so at odds with the will of the country at large and with the science . But that overlooks the fact that they are each appeasing their respective bases. John, i think were beyond elections, national elections that come down to persuasion. It seems like national Elections Today are all about motivation. Its no longer, well, can you win the people who are the middle . Instead, its who is going to do a better job of motivating their base . So the specific answer to your question as to whats the calculus, they think im sure they think this is the right thing. Ill give them ill give them the benefit of the doubt. But i think politically speaking they believe this will motivate their base. And i would turn the table and say, can you win a republican nomination for the presidency because this is what youre really asking me if you go in a different direction. And if you embrace vaccination and if you embrace masks. Two things that i fully embrace. Could you sell that and win the iowa caucus, the new hampshire primary, can that carry you in nevada . I dont know. In this gop, in this incarnation of the republican party, probably not. Great way of framing it. Michael smerconish, great to see you. Thanks so much. See ya, guys. With coronavirus cases spiking nationwide, republicans and right wing media are blaming migrants crossing the Southern Border for spreading covid. We have cnns Maria Santana with us now with a Fact Check. You know, weve seen this before, migrants and immigrants being scapegoated by folks on the right. Right. This happens all the time. I think this is the least surprising thing that republicans and right wing media have done during the pandemic, which is ramp up their antiimmigrant Rhetoric And Blame immigrants, migrants for covid, which as cnn has reported is just simply not true. Public health experts have said migrants at the Southern Border are not responsible for the spread of coronavirus and the Delta Variant, which we are seeing across the country. It is not true that biden is allowing more covid carrying migrants into the country. More migrants have been expelled under this title 42, Trumpera Policy which sends migrants back to mexico instead of going through the process than in the last year of the trump presidency. But this is not even the first time that republicans have tried to blame migrants and immigrants for a deadly disease. In 2014, they were saying a very similar tune trying to pin the spread of ebola in the united states on migrants crossing the border. Then Senate Candidate Thom Tillis said the u. S. Should close its border to stop the spread of ebola. Not surprising Rand Paul was saying the same thing, ebola was coming into the country because of migrants. It just was not true. The largest the countries most affected by ebola at the time were in west africa. And the largest West African Community was in brazil, not in central america and not in mexico which is where most of these migrants and immigrants illegally crossing into the country are from. Every second of it looked unbelievably difficult. Joining us now the highly decorated seventime olympic Gold Medallist and three time olympian Katie Ledecky. Thats a lot. Thats a lot to get through just to say hi. Yes, well, its great to be here. I did do a lot of racing in tokyo. I was really happy to represent Team Usa and have that experience. How does that feel . I mean, when we talk about your accomplishments, youre also part of i mean, i think part of the legacy of this olympics is going to be how well women performed. You are on the leading edge of that. Yeah, it was so neat to see the women across Team Usa do so well in so many different sports. Just to be a part of that was incredible, and im really proud of my teammates. What do you do after something like this, you know, what brianna called slaying. What do you do after you slay so hard, how do you spend your time . Like kids say, how do you slay so hard . Youll start training again for the worlds. Whats life like . Im just enjoying the time with my family and seeing some friends i havent seen in a while. I hadnt been to the East Coast where im from since christmas of 2019 just because of the Pandemic And Training and all that. So im enjoying just getting home and seeing my family and enjoying the time with them. I think that, you know, we focus a lot on the olympics and how the pandemic changed it. But for you it really changed your training. You were very much stuck at Stanford Training and there wasnt any chance maybe to go home for a visit. You hadnt been home since, what, christmastime in 2019. Yes, i was very focused on my training and didnt want to get sick, of course. Didnt want to get others sick. So stanford is not a bad place to be stuck. Palo alto doesnt i love my teammates, my Coaches Greg and tracey, they were great. They really became my family during that time and, of course, its really great to see my family now. But stanford is not a bad place to be stuck. Look, so impressive, Everything Youve done and continue to do. But i didnt know how important, you know, Science And Education s. T. E. M. Stuff was to you and how much time you devote to that, which i think is amazing. Yeah, i have a great partnership with panasonic where we have a s. T. E. M. Education program, kind of a combination of digital and inperson. Weve been able to visit a number of schools across the country. Even during the pandemic we were able to meet with students in tokyo twice. Just if you look across the board, so many careers now involve s. T. E. M. Skills. Its really important for young students to learn those s. T. E. M. Skills, maybe get inspired to pursue those careers. I just love visiting schools. Im really passionate about education. Just completed my degree at stanford. Something that i love to do, and will continue to do. You majored in psychology. Yes. A minor in polysci. We promised we wouldnt quiz you. Mental health has come so much to the forefront with what we saw with simone biles, in the wake of naomi owe saka. Michael phelps. Youre for protecting this and other people. We have been talking so much about any Cal Health the last year, also mental health. The two go Hand In hand. Majoring in psychology, ive learned a lot over the past five years in my journey to get to tokyo. Its great to see so many athletes having that conversation, talking to Each Other and supporting Each Other. I think even just within the Swim Team, as you said, michael phelps, Allston Schmidt have been such leaders in talking about mental health. Just within the team ive noticed conversations, people discussing their feelings more and more which is great. Lives will be saved from all this, which i think is wonderful. One of the problems i notice from earning so many metals is all the clinking that goes on. How do you deal with the clinking . Its a good problem to have. My neck is getting stronger, so even though im out of the pool for just a couple weeks, im maybe getting a little bit of training. Im sure you need the workout, right . Absolutely, you know. Listen, it really is such an honor to meet you. Its been so fun watching you over the years. And then i think there are hundreds of millions of americans who have grown hoarse cheering for you. We didnt have any fans so, it was nice to have support back home. I would say there is something very special about just being able to see you after having been at the olympics and performing well. It is a very special feeling that i wish our viewers could feel that. They can hear it for sure. New day continues right now. Good morning to viewers here in the united states and around the world. Im Brianna Keel alongside John Berman. And Katie Ledecky. She cant walk off the set because shell clink. Shell wait a moment. It is thursday, august 12, and we are following serious news today. Unvaccinated americans are filling up i. C. U. S this morning. They are actually leaving hospitals on the brink in some parts of the country. Mississippi, there is a dire warning that hospitals are potentially days away from failure. The number of new positives that were seeing, the weight of the Testing Positives, and the rate of hospitalizations based on what we are seeing, if we continue that trajectory, within the next five to seven to ten days, i think were going to see
