That were seeing, the rate of the Testing Positives and the rate of hospitalizations based on what we are seeing, if we continue that trajectory within the next five to seven to ten days, i think were going to see failure of the Hospital System in mississippi. Hospitals are full from memphis to gulf port. Everything is full. Everything is full. That is just the reality now. And the virus is spreading at a terrifying rate. The state is requesting help from the federal government. A Field Hospital is now being set up in a Parking Lot that could be used to take care of older teenagers with coronavirus. And in texas, tents also going up outside of a Houston Hospital to handle an overflow of coronavirus patients. More children are hospitalized now in that state than ever before. Despite that, Governor Greg Abbott filed a Petition Yesterday to keep School Officials in dallas from protecting students by requiring masks. Now, some republican governors see things differently. In West Virginia, governor jim justice is warning if cases continue to climb, and he thinks they will, Mask Requirements in schools may be reinstituted. Now, one question out there has been given that more kids are getting sick, when will the vaccine be authorized for children younger than 12 . The Surgeon General says that could come by The End of the year. For some, well, that cant come soon enough. Over the last year we hadnt seen as many kids get acute covid Lung Disease as much as were seeing now that the Delta Variant is definitely hitting them a lot harder a lot faster than we had seen in the past. Its a game changer. It is. Kids are definitely sicker than they have been. Tom forman joins us now to give us a sense of exactly where these hospitals are having the most problems and what the situation looks like across the country, tom. It is, john, absolutely a crisis being driven by political leaders who wont grapple with the truth and people who in turn simply will not get vaccinated. Thats the reason this is happening. Look at Icu Bed Utilization by state. As reported by the hospitals here, health and human services. All of these in reD Down here, the dark red, theyre over 90 . The lighter red, theyre right behind them. Thats how much has been used up in these areas. Covid beds, look at this, every place that you see in dark red here is over 25 of the Icu Beds being used are being used for Covid Patients. Over 25 . So it could be 26 . It could be 80 . It could be 90 . And look where its really clustered right down in here. Florida, texas, louisiana, alabama, a lot of states that have had a lot of, a lot of loud, loud, loud talk from leaders saying were not going to let our freedoms be infringed. Were not going to engage in anything except say to the people you can do what you want and they are paying the terrible price right now. Really important to compare when you start off by talking the beds running out, look at the raw numbers here. If the statistics are too much, look at the percentages that are too much, look at the raw numbers. These are how many open Icu Beds are being reported in these various states. 668 beds in florida. A state of roughly 22 Million people. 368 in texas. A state of nearly 30 Million people. Look, mississippi, 0. Alabama, 112. Arkansas 12, louisiana, 206. Oklahoma 79. That alone is a critically low number of beds. Again, it is being driven entirely by people being unwilling to get the vaccine. Therefore, pushing this forward. Thats why this really matters because all these folks who are saying i do not trust medicine to get a free shot that has been set aside for them and that can save their lives are then tumbling into this system where they are basically pushing aside people who are there for traumatic brain injury, people there for Lung Disease, people there for heart disease, people would normally fill up these icus. These are not designed to be big, empty spaces, john. These are busy spaces always operating closer to capacity and now that capacity is being pushed Push Ed to the limits. These numbers are staggering and are driven by people who again are saying i dont trust the medical profession for this tiny little thing but now im going to lean on the medical profession for a huge, costly thing, not only in money but in terms of resources, in terms of medical staff that are already worn out and in terms of the lives of Everybody Else who would normally be able to use that icu. If the beds are filled with Covid Patients, they cant be filled with other people and has a Ripple Effect throughout the industry. And we expect to hear that the agency will authorize a thirD Dose for immunocompromised people. That group includes Organ Transplant patients, for instance, who did not have a robust immune response to the first and seconD Dose of the Pfizer Or Moderna vaccine. It could include Cancer Patients or hiv patients. Now, with the possible rollout of a thirD Dose, which again we expect could happen in the next 48 hours, that will start with the most vulnerable. So immunocompromised people, not the general public. So, for the general public, Health Officials say theyre still looking at when the right time for possible thirD Dose might be. Here Surgeon General dr. Vivek mur think on that. We think it is likely that boosters will be needed for a broader set of the population, what we are trying to figure out right now is the right timing for when to initiate those additional doses and also who those doses should be able to based on where the need is greatest. So you see, brianna, for the rest of us there is still this discussion of when the right time might be, but for now, again, we could see this possible phased rollout of thirD Doses starting with immunocompromised people. We already have seen other nations, israel, the uk, france, germany, they have all announced plans to roll out thirD Doses for immunocompromised populations as well as older adults. Now, i have to be clear, you were not personally threatened because you left earlier. I think because you were afraid of the direction things were going in. But whats it like for you to watch thats right, john. Whats it like for you to watch that video . It was shocking. I left. I left after the public speaking portion of the meeting. I spoke. I said my piece. And the energy in that room was hot. I knew that things were going to get a lot worse. And my wife was there. Shes a medical professional, too. So we decided we need to go during the recess. So we walked out. At the time we walked out, there was a crowd outside. They were chanting. They responded to us when we walked out. And it was intense. Before we walked out, we had to brace ourselves. I took my Wifes Arm and i said, just remember, no matter what they say, these are the lives were trying to save. And we walked out. And i was approached and someone put their hand in my face and called me a trader, which i dont see how thats how anyone can say that when ive been on the front lines of this pandemic since the beginning treating patients in rooms, unvaccinated for the vast majority of it, hoping i wouldnt take it home to my family. And for someone to say that is mind blowing. It wasnt until the next morning that someone showed me this video and i was shaking. I was very, very, very scared by that. Do you feel safe . I like to think that what you saw in that video was the product of a lot of bottled anger and a few people who lost control of their emotions. And its not acceptable to threaten people. Its not acceptable to harass people the way they did, but i was there. There were hundreds of people there that disagreed with me, that were on the other side of the debate. And i like to think that these were also concerned parents that cared about their kids that want the best for them that have different facts than i have. And i like to think that tempers will cool and i will be safe and my family will. I hope so. I hope so, too. They called you a trader. And youve been treating Covid Patients for 16 months, including one i understand this week of a 53yearold unvaccinated man. They called you a trader after that. But tell me about your experience inside the hospital. So, this is a new phase of the pandemic. It is something totally new. What were seeing now is truly is, as they say, a pandemic of the unvaccinated. And what were seeing is patients that are skewing younger, 30s, 40s, 50s. People in some cases like i said have no preexisting medical conditions and no business being as sick as they are, but theyre coming in very sick. And when they do, the vast majority of them didnt receive the vaccine. And at that moment, look, statistics dont lie. Most of the people that are getting sick are unvaccinated. And at the bedside, when you have a new patient thats sick and theyre going to require Life Support and you know they got this illness because they didnt take this free, readily available vaccine, then its easy for your empathy to falter. Once you see them, these are just people that cant breathe and scared and looking to you for help. And they got the young information or they thought their fertility might be affected or thought they would have a Side Effect or it wasnt effective, theres a Micro Chip in it or something along those lines. And its impossible to fight that kind of disinformation sometimes. And i saw that firsthand at this meeting. It was clear that you cant have a discourse with someone who doesnt share a common set of facts. Their facts are different than ours. How much of a toll has this taken on you personally, emotionally over the last year or so . I know you have a child who has some respiratory issues, so you have particular concerns about this inside your own house . Thats true. Its from the beginning you can ask any healthcare worker. Doctors and nurses were dying on the front lines at the beginning of this pandemic. We didnt know how easy this was to catch it. So, i felt at risk at the beginning and now my children are at risk. And thats why i went to this meeting the other night because my kids are too young to get the vaccine. They dont have the choice to take this vaccine. And their health depends on the people around them. And the safest way to have school and to keep school in session is for people to mask up. Thats why i went to that meeting. I certainly had no idea i was going to be part of a national news story. Listen, brit maxwell, youre not a trader. Developing this morning, a federal judge will allow three major Defamation Lawsuits to proceed against some of former President Trumps most loyal supporters. Rudy giuliani, Sidney Powell and my Dhs Pillow Executive ceo Mike Lindell sued for billions in dallas of damages by Dominion Voting systems which is the company they falsely accused of Election Fraud. Lets talk about this now with Cnn Law Enforcement Correspondent Whitney Wild and former Head Prosecutor from Morris County New Jersey and a host on the law and crime network robert bianci. Whitney, tell us what has happened in this its procedural but its important. Right, right. Robert can get into the meating of the procedural moment. But ill tick through the facts. Dominion is bringing this lawsuit against Sidney Powell, Rudy Giuliani, Mike Lindell basically saying the damage they did spreading this misinformation about their Voting Machines somehow rigging the 2020 election was so damaging that they should have to cough up 1. 5 billion, 1. 3 billion. That is in addition to the two other lawsuits that dominion filed earlier this week against these right wing outlooks perpetuating this election law, their machines rigged this election for joe biden, which is obviously not true. In those lawsuits theyre going for 1. 6 billion. So 3. 1 billion i guess between all of these five lawsuits is enormous. And right now the judge is basically saying i think theres enough information here, enough evidence to go on so hes tossing out this push by Rudy Giuliani, Mike Lindell and Sidney Powell to get the case tossed. Their argument is its free speech. Theres still not consensus what happened with the election. No, were moving forward, said the judge. Counselor, this is a trumpappointed judge, first of all, correct . So a trumpappointed judge opening up a world of potential hurt here for Rudy Giuliani and Sidney Powell and others. Whats the most threatening aspect to them of this now . The idea that they could have to sit for depositions . Robert . Oh, yes, absolutely. The biggest thing that we have going on here is that this was kind of a pro forma or typical motion that is filed in court. But this judge disdainly may i add said that dominion made out a case at this point in time. They can certainly dispute, but whats going to happen, john, its going to go into a Discovery Process they call it where they have to give not only sworn answers and interrogatories but more over, the nuclear bomb here for the three defendants is they have to give sworn depositions. In these depositions done with a Court Reporter under oath which attorneys are allowed to ask any question they want as long as its not privilege information, bleeds, all sorts of potential areas of corruptions where they have to give answers to questions. And the thing we used to love as prosecutors, we used to just sit back and love when there was a civil suit filed because all sorts of information were coming through when the depositions that otherwise in the Court World we would not be able to get because those individuals had the right to remain silent. This is a devastating blow. Theyll not only get into the issues with respect to Dominion Voting systems and the lies and the fraud that existed with respect to that, the nuclear bomb is theyll be able to get into all sorts of conversations about the meetings with the president , the meetings with the staff, what was said, what wasnt said in order to try to prove that they had no basis in fact whatsoever to make those accusations against dominion. So from that standpoint, as a lawyer, i always ask my staff, would you rather be on the lindell, powell, Giuliani Side or the Dominion Voting side. Theres hands down No Doubt there was a huge victory for dominion. I suspect prosecutors are watching very carefully about what those depositions reveal. Its potentially a Gold Mine and the judge is saying, proceed, explore as you wish. I also want to ask you, whitney, about d. J. Pok, talking to congressional investigators, he resigned in january as you had trump pushing the Big Lie and pressuring georgia officials to find votes. Whats going on here . The succession of events here is really important. Bj pok gave his testimony, it was three and a half hours. What he told lawmakers is that he knew he was falling out of favor with President Trump. He thought President Trump was going to fire him. You know what im out of here. Lets look at the date of that, january 4th. January 3rd the this Apprentice Style Meeting where Jeffrey Clark was trying to convince Donald Trump to put him as Attorney General making the case that he could take these Election Fraud cases to the finish line, not jeffrey rosen. In that moment, Cooler Heads prevailed but it was basically right after that meeting that one of the top doj officials called Bj Pok, call me right away. So after that call, ten hours later, Bj Pok resigned. Two days after President Trump had had that call with the Georgia Secretary of state trying to get him to dig up more votes, overturn the georgia election. One thing is notable that emerged from that Conversation Yesterday with congressional investigators, Bj Pok did say he didnt think it was unreasonable for trump to have concerns about the election in georgia based on the overwhelming allegations of fraud there, however, bobby christine, the u. S. Attorney In Savannah came in to take Bj Poks spot, look, theres nothing here. It doesnt exist. So again, this is a really critical testimony. It is one of a series of we heard from jeffrey rosen. We know Senate Judiciary wants to hear from Jeffrey Clark. This is one more stop along this long time line well hear a lot more about what actually happened. The new york times reports that pok said it was investigated by federal authorities they and they found no merit to the claims that trump was making. He basically quit because he wasnt going to lie, he wasnt going to vocalize the lie that trump was insisting that he do. So, robert, what do you make of this . What do you make of this decision by him to quit rather than lie publicly . I dont think that people can understand as a prosecutor what is happening here to the rule of law. When i was the prosecutor, nobody would even think a politician trying to influence a decision i was making. Respectfully with regard to mr. Pok, i feel bad for his situation, but the fact of the matter is, he shouldnt have stood there and toed the line. He should have waited for trump to fire him. The fact of the matter is he indicated there was no evidence of widespread fraud. He was being asked to find corruption. He said he couldnt find any. When he got a whisper in his ear that trump may fire him, which he should have waited to happen in order to build a better case, he resigned. He didnt release this information to anybody and when you add this Data Point to all the other Data Points, corruption, just get me whatever 1,000 amount of votes for me to get over georgia, it shows a paernt of practice that prosecutors will put together to say this was not an innocent thing where the president or his people actually thought that there was real fraud. This was a strongarm tactic. You know what really bothers me about this, everyday, day in anD Day out we deal with clients that have minor infractions of federal law and the full weight of the government comes down on them like a ton of bricks but here we have something with a foundation of our constitutional democracy and it seems like were playing Tidlily Winks with regard to whether or not were going to really investigate it from the standpoint of something that could have affected the outcome of our democracy, put us in a constitutional crisis. Personally, i if it were me, i would have stayed in the position and waited to be fired so that i could show that theres another piece of evidence that theres undue influence, lots of federal laws, lots of State Laws that prohibit this kind of conduct and politicians have gone down for a far less than this. Well wait to see whether or not theres the Intestinal Fortitude to bring this forward anD Do what happens to all sorts of other american citizens right now today, everyday in every court around the country. Intelligence assessments now warn that the afghan capital of kabul could be cut off and collapse in one or two months. Cnns Kylie Atwood joins us now. This is a dire Intelligence Assessment for this city, which was supposed to be much more secure than the rest of the country, kylie. Thats right, john. This is not good news, right . If you look at this, 30 to 60 days, thats before The End of the year, that is some time in october when one Intelligence Assessment is saying that kabul could be isolated by the taliban therefore increasing the likelihood it could fall to the taliban. Now, another Intelligence Assessment is giving the time frame 90 days for when this collapse could come. There are multiple assessments out there, there are multiple time frames out there. But the bottom line is these are all giving a shorter amount of time for when afghanistan, for when kabul specifically, for when the afghan government specifically could fall to the taliban, then the Intelligence Assessments earlier this year were giving. This comes as the taliban is making these military gains across the country. Its happening at a faster rate, i am told, than many u. S. Officials expected it to happen. Now, the pentagon is not commenting on any Intelligence Assessments coming out of afghanistan. They, of course, say they are closely monitoring the situation. But the u. S. Military withdrawal is now more than 95 complete and president biden even as these military gains by the taliban are occurring is not at all backing away from his decision for this Military Withdrawal to happen by The End of this month. He was asked about it earlier this week. He said hes not going to change his decision. He said he has no regrets. And he also said that the afghan people have to fight for themselves. John . I didnt think i would be asking you this so soon, but can kabul hold . And until when . Yeah, im not certain kabul can hold, as you can see from this map where we are and remember we still have forces in Iraq And Syria doing some closeout operations. Not sure how long were going to be there. But i think whats really important to realize is that here Is Kabul. Here is where the government continues to control. So the point that everybody is making is that kabul might be isolated. I dont know that its going to collapse immediately. This is a city of 6 Million plus people. I mean, to take the city over for the taliban to go block by block and to assume tight control, thats simply the physics of that will simply take a considerable amount of time. The estimates might be 90 days. No reason not to believe that. But certainly whats going to happen based on what we have seen on the map is increasingly the control of the country now belongs to the taliban. And whats going to happen Is Kabul inevitably will be completely isolated. Then its just a matter of waiting, which can happen. Some form of negotiation moving forward. Lets not destroy the entire city. Lets not disenfranchise everyone with an incredibly brutal campaign, which the taliban certainly can do. I would anticipate isolation and some form of negotiation and talks coming forward. Here in recent days, as berman was saying, we have seen seems everyday theres a provincial capital that is falling to the taliban, at least ten regional capitals. What does this mean for the u. S. That all of these gains have been made . What would it mean for the u. S. If this encroachment on kabul gets even more so . Primarily what it means over the course of two decades, and this is the tragedy of all of this, over the course of 20plus years, the United States has tried to create an Afghan Military, a form of security forces both Law Enforcement as well as military and we invested time, we invested money but most importantly weve invested the lives of Service Members on the ground in order to give afghanistan some time. Thats what thats all about. Look, will we the soldiers and the marines on the ground will fight as hard as they can and look over their shoulder and say, you get your act together. Were here for you. So we did that for 20 year. You think about that sacrifice, and now we have not only what were seeing on the ground, but also contributing to that is the United States left a good amount of kit, of equipment, of vehicles, after armaments that now the Afghan Military is walking away from and guess who is taking control of that to increase the momentum that theyre gaining. Its the taliban. Thats a very good point. The expectation and we seen it before is that it does fall into enemy hands. General, thank you so much for talking about this this morning. Is this an incentive to get vaccinated or Cost Recovery . This is about Cost Recovery. We have a collaborative Decision Making Process at our college, Faculty And Staff and students all weigh in on the processes that we and the eventually policies that we issue. And they are we got together this summer anD Decided that rather than spread the cost of testing and what have you across the entire campus, we would apply it to those who have decided not to get vaccinated. Its solely for the purpose of Cost Recovery. So right now i think its 90 staff, you say, are vaccinated, 80 of your students are vaccinated. You have international students who are thrilled to be coming and getting vaccinated. Are you hearing from the students who are not vaccinated, what are they telling you . Yeah, we hear from everybody. And so, obviously when you make a decision, some people are happy, some are not. The general consensus is that this is the right thing to do. The students have been even advocating for mandatory vaccine. The Student Leadership came us to with that proposal. We have not gone that route, as you said. Were looking to just make sure our costs are recovered. By the same token, if we find alternative sources of support for the testing, well go with those and the fee will go away. Can i ask you, will you require a vaccine if it is no longer Emergency Use and it goes to full approval next month . Yeah, thats a good question. We have told our community that we would look at that decision again once the fda approves it for nonEmergency Use. But that will be the next time we look at it. Again, we have a collaborative Decision Making Process. Students will weigh in. Faculty will weigh in and staff. And then well come together and make a decision. And she allows staff to select who what class their student is in. So, i made the selection for our family, our students. And she called me and asked if i wanted a different teacher. And i explained to her that i did not. I didnt think that those teachers would be a good fit. And she proceeded to ask about another teacher. And i said no. I think the one that i selected would be a good fit for her. And i began to ask whats wrong . Is the teacher not on the Grade Level anymore . And she stated, no, shes going to be on the Grade Level. I said, well, i think she should stay with that person. And she said, well, if she stays with her, she wont have anyone that looks like her in the classroom. And i said, thats odd. I said, where are all the Black Kids . What happened . And she said, well, thats not the black class. And i said excuse me . What does that mean . Do we have those . And she went on to say that she was only allowing the black students to have access to two of the classrooms when all of the white students have access to all six classrooms. And i explained to her why it was wrong. You cant segregate classrooms, a. B, as a black parent, that puts me in a really bad position because white parents have access to all of the rooms as black parents should as well.
