The woman who filed a criminal complaint against him has publicly come forward, speaking exclusively to Cbs This Morning and the Albany Times Union she says cuomo gradually escalated contact with her and took an advantage of the power imbalance. Then there started to be hugs with kisses on the cheek. And then there was at one point a hug. When he went to go kiss me on the cheek, he quickly turned his head and he kissed me on the lips. What did you say . I didnt Say Anything. I didnt Say Anything. I didnt Say Anything this whole time. People dont understand this is the governor of the state of new york. There are troopers that are outside of the mansion and there are some mansion staff. Those troopers that are there, they are not there to protect me. They are there to protect him. We reached out to new York State troopers. Governor cuomo denies any wrongdoing, but even fellowturn. Polo sandoval is in albany. Reporter new York Governor Andrew Cuomo facing what will likely be another trying week. On Monday Legislatures returned to albany where theyre expected to meet with independent investigators related to govern cuomos impeachment probe. The governor has until this friday to offer evidence in his defense, an opportunity cuomos personal lawyer insists was not provided before the release of a scathing report in which several women accuse the governor of unwelcome and nonconsensual touching as well as making comments of a suggestive sexual nature. The Sheriffs Department confirms its investigating a complaint against cuomo that is sexual in nature. I had a female come forward and make an allegation of criminal conduct against the governor. Reporter that female victim is speaking publicly for the first time. Britney camisso, one of the governors current staffers coming forward. The governor needs to be held accountable. Just so im clear, being held accountable to you means seeing the governor charged with a crime . What he did to me was a crime. He broke the law. Reporter glavin did admit the governor one thing i will say about this particular trooper is i do know the governor has tremendous respect for her. To the extent that he believes that he did anything that violated her or was inappropriate, he feels very batdl badly about that. Reporter the governor has, however apologized to a handful of women who he recognized were made to feel uncomfortable by behavior he insists was well intentioned. He does slip at times. Hes not perfect. When you say he does slip, what do you mean by that . He said on his video statements, which is that he does make the mistake. He will say darlin, he will say sweetheart. He does ask people questions about their personal lives. He didnt think that was improper. We reached out to Governor Cuomos office and they didnt comment further on the cbs interview. The attorney for britney waited to come forward until after the Ags Report was filed. Lets bring in a cnn legal analyst and attorney. Governor cuomos personal attorney Rita Glavin questioned the credibility of two of the more serious allegations against cuomo, including from the woman who broke her Silence Today about her criminal complaint against Governor Cuomo, previously known as Executive Assistant one, who says cuomo reached under her shirt and groped her breasts. How is it corroborated . Its corroborated because she saw the governor speaking and started crying when he said he dip didnt engage in inappropriate behavior. This was five months after she alleged this happened. Does that undermine her story in your view that she waited five months . What undermines her story is that there is absolutely no corroboration at the time. No corroboration at the time. So my question to you,does the fact that she confided in colleagues months later undercut the Witness Corroboration here . Not at all. What we heard from Governor Cuomos attorney is the tiered, pathetic, attack the Witness Approach Weve seen in so many of these cases. They go after the witnesses. They try to undermine their credibility. What we know about Executive Assistant Number one that we now know her name is britney, is that investigators have said in this report that shes credible, that her demeanor is credible. That the statements and allegations she made is also corroborated as you pointed out in that interview. I didnt understand ritas argument. I was confused by her constant comments about the governor not being involved in intentional behavior. The standard here is not his subjective feeling, but its a reasonable persons feeling, what would a reasonable person know. Were talking about the highest ranking elected official in the state of new york. Were talking about someone who should have participated in hourhour hours and hours of sexual Harassment Training. He understand that his conduct was inappropriate, yet he continued to engage in it. For his lawyer to suggest he didnt do it intentionally and he made slips is offensive. You mentioned the defense being that he just slips at times. That is what she said. I followed up on that. That is basically what she is saying, that it wasnt intentional. How much of a defense is that . Zero defense. Someone like Governor Cuomo has had to participate in so many conversations with hr professionals, with Labor And Employment attorneys. Hes been a part of sexual Harassment Training for his entire staff. He knows what inappropriate conduct us. Its not enough to say im from a different era. We are in an era where oven knows what the lines are, what the standards are. So many high Profile Men who have had allegations against them that have been substantiated. So this notion that were somehow in the Dark Ages is just a an incredible argument and it shows he does not have a substantive, credible defense to these allegations. I want to bring up her argument about the report itself. There are two issues. There is the report and there are the allegations. She said this report had several key omissions. Shed heard from other attorneys what wasnt included in the report. She still hasnt seen the underlying evidence, the transcripts. Do you see that as problematic . If what rita has said is correct that there are omissions in statements people made that are favorable to the governor, yes, that is problematic. You should include all the information that has been presented during the investigation. If witnesses came forward and said statements these other 11 made, that investigation should have been included. We attack the credibility of the claims made by the 11 women that have come forward. She spent a lot of time talking about bennett and boylan. She wouldnt say much about the State Trooper involved, but there are nine other women. To suggest 20 of these claims may have some credibility issues, what about the other nine . She has every right to raise questions about the completeness of this report. If it lacks in some areas, absolutely, lets get that investigation out. Lets listen to what the State Trooper was to say. Thats not criminal conduct as far as i know. If he did that, is that acceptable behavior . Depends what the context of the circumstances. I just want to be clear because the governor has said he hasnt done anything inappropriate. Are you saying depends on whether it was consensual or not . What im getting at is the governor may have very well touched the State Troopers back and she may have understood it one way and he understood it another way. So i asked you how was that appropriate . What was your reaction to her response . That was an idiotic response. Lets set the stage here. You work for the governor, the highest ranking official in the state of new york. The Power Dynamic that exists between an employee and their supervisor and not just any supervisor, the governor. And he touches your back. Under what circumstances would it ever been appropriate . Maybe theres a fire and hes trying to rescue her. Yes, there are some circumstances under which your supervisor can touch your back. That dipldnt happen in this ca. When youre dealing with Sexual Harassment, youre talking about severe and pervasive conduct. Youre not talking about a stray comment or a casual remark made by someone. This conduct has to be so severe and pervasive that it changed the Condition S of the work environment. Were not talking about a casual touch because maybe an elevator skipped a floor. This was intentional conduct on the part of the governor that was unsolicited by the women and the Governors Lawyer knows that. The first waive of american children already back in the classroom. The republican governor of arkansas, who signed a Law Forbidding School Districts from Mandatie Ie Ing masks has rever himself. I asked the legislature to redo the law that prohibited those options from the School Districts to protect the children. It was an error to sign that law. I admit that. Maybe the answer is another thing that Senator Durbin told me which is what the former president was trying to do was find whomever he could in the Justice Department who agreed with him, which is why he ended up with somebody who does environmental law and not Election Law and trying to subvert the actions of these states that were really critical to Joe Biden winning and him losing, which is what happened. What the Judiciary Chairman said this is seven hours of testimony that Jeffrey Rosen gave yesterday. The takeaway that Senator Durbin had was that the president was trying as much as he could to find whomever he could to stop it and there were people not just in the Justice Department like rosen but even in the White House who surprised him who were trying to put the guardrails back up. Were going to clearly learn a lot more that we did not know about the very deliberate actions, according to durbin, that Donald Trump was taking in order to stay in office. Percent positivity is up and hospitalizations are up. The good news is that our population is increasingly vaccinated. For those in the most vulnerable population, 65 and older, 99 of them have received one dose and 84 are fully vaccinated. We have 75 of those 18 and over are also fully vaccinated. This is as a ceo of one of the largest public hospitals in the country said, this is certainly the pandemic of the unvaccinated in many cases. A large percentage of people being hospitalized have not been vaccinated. We know some cant be vaccinated. Kids under the age of 12 cannot be vaccinated right now. Theyre not eligible. Your states Governor Ron Desantis is against Mask Mandates, especially in school. Is that the right move . You know, the schools are about to open in the next couple of weeks and unless something changes dramatically and so far trends are not in a positive direction. Whats important is the local superintendents, many of which are local elected officials, be empowered to make some of these decisions. Every city is different. I think the governor at the beginning of the pandemic did a wonderful job of allowing the cities and local authorities to make these decisions. Thats actually a very conservative principle to allow local authorities to make this. He pivoted away from that later on. I think now given the new Contrac Construct and realities, it may be something he may want to return to. So youre saying you are in favor of Mask Mandates if its necessary in certain places in florida . Yeah. Look, with our Government Weve already implemented that. In the schools. I should clarify. Yeah. For our government, we implemented, for our employees that they have to wear masks unless theyre vaccinated. Obviously as you said with children, theyre not. I can tell you many private schools are opting to have children wear masks. My children wear masks and they do it. I have a very very young daughter and she she does it very, very well. Its something that certainly parents need to weigh in on, but if it gets to a point where this doesnt change in the next couple of weeks, they made need to be mandated. New York City mayor De Blasio said he is going to require people to show proof of vaccinations to enter restaurants and movie theaters. Do you think miami should do the same . I think private businesses should have the right. Were seeing this play out right now with the Cruise Industry where the Cruise Industry in order to sail safely is being told by the cdc that 98 of the passengers and 98 of the Crew Need to be vaccinated and the Cruise Industry cant demonstrate that threshold without asking the passengers to prove their vaccination. I totally support the Cruise Industry and private businesses having the right to be able to determine kwhether they want to take on the risk of people who are not vaccinated being inside their establishments. Youre a republican. Theres a lot of Vaccine Hesitancy among republicans. Every night there are Fox News hosts like Tuck Ker Carlson spreading misinformation. Do you think that is killing people . I just focus on the facts. The facts are that 99 of the people that are vaccinated, if they get covid a second time, theyre not experiencing severe symptoms, 99 . 99 of the people being ho hospitalized are not vaccinated. Its difficult to argue people should not be vaccinated. I like to stick to the vaccinates and advocate for what the best position is which are for people to get vaccinated.
