Maybe he figured it out years ago when he was positioning himself to be a producer of jeopardy. Maybe this was a long game. But actually he has hosted Game Shows in the past for gsm, cw, Reality Shows as well. So he does have a Hosting Track Record and did get pretty strong reviews when he did fill in. I think something thats going on here, john, is interesting the producer of jeopardy im told want a fulltime host, somebody committed to the show, known for only doing jeopardy. Thats a hard thing when youre trying out some of the biggest stars in the world like iron rodgers, for example, who really wanted the job. The reality is a lot of people really wanted this job. Maybe choosing the producer is the easy way out. Maybe. Its hard to get the job when the producer wants it. Just saying. Just saying. No sour grapes. You were a great contestant. Brian, awesome to see you this morning. Thanks. And new day continues right now. Welcome to our viewers here in the United States and around the world. It is thursday, august 5th, and this morning, a critical shortage of Icu Beds and medical staff is pushing hospitals in covid hot spots to the breaking point. In arkansas, a Health Official tells cnn that only 25 Icu Beds are available in the state. In mississippi, that number is six. Six Icu Beds for an entire state. The u. S. Now on the brink of an unfortunate and avoidable milestone, returning to more than 100,000 cases a day. Theres an alarming rise in cases of children in arkansas. Cases among kids under 18 spiked 517 . Hospitalizations 270 . In icu admissions up 275 . Those are huge increases. The governor of arkansas, who banned Mask Mandates, has seen the data and since changed his mind. Our cases were at a low point. Everything has changed now. And, yes, in hindsight i wish that had not become law. We have reporters across the country covering every new angle of this pandemic. Im Nadia Ramiro in baton rouge, louisiana. The governor says they used to have about two deaths a day a month ago. Now theyre recording 103 deaths in just two days. Hes asking everyone to mask up. His mandate began on wednesday and also telling people to get vaccinated. Here at this site, we met plenty of people getting their kids vaccinated right before School Starts and even people who say they were vaccine hesitant, but now the fear of the Delta Variant outweighs their concerns over the vaccine. In arkansas daily new Coronavirus Hospitalizations have been skyrocketing while at the same time burn out amongst Healthcare Workers has also been on the rise. At the states only level one trauma center, theyre reporting over 200 Nursing Job vacancies they cant fill, despite the fact theyre offering 25,000 signing bonuses. Whats different this surge, most of their new patients chose not to get vaccinated. Leaving medical staff overworked, stressed and frus frustrated. Reporter more Georgia Schools reopen this week, but each district had a different approach as to how to do that safely. As concerns grow about the highlyinfectious Delta Variant. Some counties like Gwinnett County are opening with the reinstated Mask Mandate. Its there where last week a group of parents gathered to protest news of a mask policy, holding what they called unmask our children event. Some shouted that the decision to wear a mask should be left up to parents and children in rural georgia, students and teachers will have that choice. Another county reopened without requiring masks. Local principal told us that theyre honoring parents and students personal decision. The parent of a 14yearold says she wants her daughter to have the freedom to express herself, even if that freedom comes at the expense of getting herself or someone else sick. In florida, it is biden versus desantis. The republican governor of florida is hitting back at the president after he said governors who are not helping in the fight against covid should get out of the way. Joe biden suggests that if you dont do lockdown policies, then you should, quote, get out of the way. Let me tell you this, if youre coming after the rights of parents in florida, im standing in your way. Im not going to let you get away with it. So why dont you do your job. Why dont you get this border secure. And until you do that, i dont want to hear a blip about covid from you. What is happening with covid in florida . Its leading the country in new cases. Its seeing the largest number of hospitalizations since the previous peak in july of 2020. Accounting for 20 of Covid Hospitalizations in the u. S. Alone. Desantis has been fighting hard to keep companies from mandating masks or allowing them at all to issue vaccine requirements. Joining us now is political reporter gary who spent the past two decades covering florida politics and government and puts together politicos florida pay book. You are florida man, as far as were concerned this morning, gary. Thank you so much for being with us. Ron desantis, the governor there, you know, punching back at Joe Biden as the cases in his State Rise and hospitalizations hit record levels. What does he get out of that . Well, we had a conversation about this a couple of weeks ago. And i inferred that i didnt think he was going to back down and hes not going to back down. This plays very well with the republican base. As we discussed before, if you see him as a potential 2024 contender, i mean, hes taking it to the president and hes firing up the people that are important to his reelection and to beyond. So, there are republicans, there are democrats and then theres covid. Right . And covid the situation in florida is bad by all accounts getting worse with hospitalizations rising and at record levels here. What are the risks for desantis here . Well, i think the risks are whether or not this thing doesnt turn around. Again, he has stressed repeatedly that this is a seasonal event. That he feels the numbers are go going to stabilize and go back down the next few weeks. The thing about it is that this wave is a little different than the one from before. You have some places where the hospitalizations and the number of covid patients arent as bad as last time, but then you have other places where its worse. And interestingly enough, there was a ceo of one Hospital System Yesterday who said point blank, well in miami dade its not as bad because we have a higher vaccination rate. You have Hospital Ceos drawing a correlation between, look, in our communities where there are vaccines, people taking the vaccines, were not seeing that as a problem. Whats interesting, yesterday the governor in his rebuke of President Biden suggest ed immigrants coming in from the border maybe its just as Big A problem as anything else. Right. Again. This is as cases are arising in florida. How about Potential Push back from parents in some of these School Districts where the School Districts are, some parents are Fighting Back and. And some where masks are not required parents are upset. Right. What you have seen interestingly so far and thats another point of tension the governor has made it very clear that he does not support any kind of Mask Mandate. Says it should be optional for parents to decide that fact. You have seen a couple districts that waded into, okay, we want to do this on our own. I mean, as i sit back and watch this, its going to be interesting, are they going to continue to stick to their guns and are they willing to fight the governor in his Executive Order dealing with masks he basically said, there is the potential of with holding State Funds if you impose a Mask Mandate. So do we have School Districts that will stand up to him . A couple are saying theyre willing to do that, but you know, we still havent seen that play out. People need to remember the political margins in florida particular for governors races are so small, so small the margins for victory and defeat. So, you know, who knows which way this pushes things over the next few years. Covid may have a lot to play in that. Gary, always a pleasure to have you on. Thank you so much. Thank you for having me on. Were seeing a growing list of companies mandating vaccinations for their employees as the Delta Variant surges, but some Labor Unions are not happy. Just this Week Tyson foods announced it will require all its workers to be fully vaccinated by November 1st. Tyson stating this, we did not take this decision lightly. We have spent months encouraging our Team Members to get vaccinated. Today under half of our Team Members are. The Labor Union is pushing back. They call this mandate concerning. Joining me now is the president of that union, the united food and commercial Workers Union which represents 1. 3 million workers in the Meat Packing and grocery industries and represents so many of these workers in iowa working for tyson foods. Mark, thank you so much for being with us. I do want to ask you why Delay A potentially Delay A Vaccine Mandate while you have delta surging . This is a very serious variant that is very different from the ones we have seen in the past. Good morning, brianna. Absolutely. I dont think the delay were talking about is very long delay. I think that what were concerned with is really two things, one that we dont have full fda approval. Its my understanding that its coming fairly quickly through the fda and were very interested in hearing that. And we feel as though that a lot of our workers, the ones we talked to, said they havent not got vaccinated, they got concerns about whether or not theyll have to Take Off a day to recoup from getting the vaccine. As you well know, what happens is your system reacts to the vaccine. It, in fact, prepares itself to fight off the virus, if, in fact, it comes in the future. And it has made people feel lethargic. Theyve had fevers, some people have had chills. As our body prepares to fight off the virus, if, in fact, that it comes. Those are the issues that were concerned about at this point in time. I think that well be able to resolve this very, very quickly. In a lot of our Packing Houses that we represent, were at over 95 vaccinated mark, i got to stop you there. Tyson says less than half of its Team Members are vaccinated. Were talking about the tyson mandate. You cant be talking about who youre Repping Writ large. Were talking about tyson, less than half. A lot of the tyson plants are, in fact, nonunion and a lot of plants are located in the Southern Parts of the United States where we have extremely low Vaccination Rates. We have other locations where tyson is over 80 vaccinated. But it sort of varies depending on the locations. And so what were trying to do is have a reasonable conversation with them about what ultimately happens to these workers. If in fact they get impacted by taking the vaccine at least initially. And we think that weve done pretty well with them so far and weve done well with pretty much all of the companies that we represent. So i wonder the eu lets talk about the eua. As you mention, it sounds like thats a moot point. Why are you bringing that up . Because if the fda is expected to have full authorization for the pfizer vaccine, come Labor Day and this is a November 1st deadline, it seems like an issue thats being brought up thats actually a nonissue. Well, i think that it is an issue with the people that havent had the vaccine yet, brianna. In all fairness, i do believe that we do have some people that are still concerned and whether or not its going to impact them or not. A lot of people feel as though the vaccine was somewhat rushed. I dont have to be one of those folks. Most of my local president s around the country dont either. We did have, in fact, have a meeting with our locals yesterday. We had this discussion. It was raised and leads from the information that they received from their membership about the concerns that they had about it. So, i dont want to discount that, and while we certainly do. There are other people that need a little more information and we need to provide it to them and were trying to do that as an organization. Okay. So lets talk about that because youre saying that there are people you represent who have concerns, which quite frankly they arent based in science. And they arent based in what protects people which is vaccines. In may you represent Grocery Store workers, you told my colleague who came on to support Grocery Store workers who were concerned because the cdc relaxed Masking Mandates for vaccinated people. You had Grocery Store workers working in Grocery Stores going, theres people not wearing masks but how do i know if theyre vaccinated or not. And this is what you said. Now we have a situation where you really dont know whether or not somebody has been vaccinated or not. And youre going to change them from the Mask Police to the vaccination police. I think its very difficult. Look, i know youre in a tough spot when youre representing folks who have opinions about the vaccine thats not based in science. But in that particular case when it was Union Members versus customers The Union came out on the side of science. Now when you have Union Members versus other Union Members The Union is not coming out on the side of science here. They havent advocated for a Vaccine Mandate and youre talking about doing things to slow this because of concerns that people have that are not based in science. I want to be clear, look, were based all of our decisions that we had in conversation about science. Whether or not it was the Mask Mandate and we still believe that that is a Mitigating Procedure that we can all do in order to slow this virus. Sure. Masks are great, marc. But vaccines are better. And honestly, brianna, we dont think that its a one and done because now we have the variant resistant to some of the vaccines. We do, in fact, need to do a twopronged approach on this. I dont think theres any question about that. Resists, marc, we have to be very clear here, i want our viewers to know, first off, lamda is not as concerns as Dell Tarks but when youre talking about vaccine not yet. Lamda would have to be something else. You look at it head to head with delta, its not. When youre talking about resistance here, youre talking about this isnt thats the concern is that if people dont get vaccinated that there actually does turn out to be resistance to vaccines in a way that would hurt people. Right now the difference that youre seeing in the vaccine from the original variant compared to the Delta One is that people may be able to pass it on, but theyre still protected themselves from dying or from hospitalization and theyre less likely to contract it which means theyre still less likely to be a vector. So i just want to be very clear about what youre saying. Youre not getting a disagreement from me. Youre really not. Here is whats happening, though. We do have some members that have some concerns and were trying to address those. And we do think that one of the things that would help address those issues or whether or not, a that theyre going to get protected as it relates to if they get sick from the vaccine. B, that we think that it would be a better piece of information to give them if it was fully fda approved. And i think that all those things are coming very quickly. And you know, i dont think its going to take that much time to sit down and have a conversation with the company about it. The union will support the mandate if you have the i absolutely believe The Union will support that issue. Yes, maam, i do. Because we are, in fact, an organization that does, in fact, believe in science. Marc, its a really complicated subject. I know you have a lot of people with different views on this that youre representing. We really appreciate the conversation. Thank you. I dont think its as bad as all that. I do think we have some people that are concerned. That are what concerned . That are very much legitimatically have concerns about it. Marc, thank you so much for being with us. Thank you. So here to continue the conversation, former American Federation Of Teachers assistant to the president , also former reagan White House official. Linda, thank you so much for being with us. Look, ive been a member of three unions that have come up in my career over the course of my television career. Oftentimes unions just dont want to give anything away without a negotiation. And to a certain extent, i feel like thats what im hearing here. I didnt hear that, im opposed to mandating vaccines among our Union Members, just we have to be part of this negotiation. You have to wait for us to agree. What do you make of this . I think thats exactly right, john. I think this is more about union politics than it is certainly about science. You had marc essentially saying that he had some members who he thought had legitimate reasons to be concerned. Thats him playing to those votes when he comes up for election next time. Union president s are politicians just like legislatures and governors and everybody else are and i think its really unfortunate because this is an instance where it is the unvaccinated are jeopardizing the lives of people around them. And this is not a question of, you know, whether or not you have a 15 minute or 20 minute break. This is a question of whether you live or die. And these are workers, particularly in the poultry plants, i was also the director of pilgrims pride, one of the largest chicken manufacturers, and these are conditions in these plants where it is very difficult to avoid personal contact with others, very crowded spaces, the plants are very cold, and you really dont want people on those Lines Coworkers shut down the plant and infect their communities. And then you have issues with teachers. Where some teachers unions and locals and these are some of the same teachers and locals that said teachers wont go back until everyone is vaccinated now saying were not on board yet with requiring vaccinations among teachers. How is that justified . Well, i really adamantly disagree with Randi Weingarten on, the president of the American Federation Of Teachers. I really think its disgraceful. Look, employers do legally have the right to require vaccines. Weve had this litigated. The methodist, houston Methodist Hospital was one of the first to mandate vaccines. It went to court. And the judge essentially laughed the suit out of court. We have a long history in the United States. This goes back really almost to colonial times where it was decided that governments could, in fact, regulate conditions when it came to health. And here we have an instance, 611,000 people have died in the United States. We have a vaccine that can essentially stop those deaths from occurring certainly in great numbers. And for people to resist this is wrong and i think it is absolutely within the rights of an employer to allow those mandates. Theres no time for delay. Even if this is a Negotiating Thing to get in there and be in favor of a month, we dont have a month with the number of cases rising. Linda chavez, i appreciate you being with us. Thank you very much. Thank you. So, new evidence makes it clear that really Donald Trump and people supporting him inside the government were trying to pull off a coup. So what happens . How far was the former president willing to go to stay in office . According to internal Justice Department emails obtained by abc news, Trump Loyalist jeffrey clark, who was working at doj, circulated a Draft Letter urging top georgia officials to investigate trumps baseless fraud claims reading in part, quote, the department of justice is investigating various irregularities in the 2020 election for president of the United States. The department will update you as were able on investigatory progress, but at this time, weve identified significant concerns that may have impacted the outcome of the election in multiple states, including the state of georgia. Now, none of that was true, but it was being written by a Justice Department official on paper. Joining me now is former chief of Doj Counterintelligence Section david h. Loveman, also partner at a Law Firm and former Chief Of Staff to the Deputy Attorney General in the george w. Bush administration. I got to say, this letter i find it breathtaking. You have a senior Doj Official basically saying the Justice Department thinks the election is a fraud and urging georgia to overturn that states election. How do you read it . Its more than breathtaking. Its disgusting and dispeckable that a senior department of Justice Official was lending the weight of the department of justice to an effort to overturn a free and fair i election in the United States. And it signifies how perilously close we came to the department of justice Being Weaponized in support of president trumps efforts to cling to power and subvert the election. We know that, david, as you say how perilously close we came but we know in the end it held, right . What was supposed to hold with a free and fair election held. But Weve Seen States weakened by Legislation State after state. Are you worried that wont be the case if this were to happen again . Well, im very worried about the development of State Legislatures acquiring power to alter the results of the ballot. I Cant Think of anything more shocking and dangerous to our democracy than that. Putting that power in the hands of politicians rather than State Election officials like what happened in the last election. But here is the question with respect to the department of justice, the department of justice is not in the Position Or Role of affecting political retribution in the United States. Its job is to investigate whether or not crimes were committed. I defer to the Career Prosecutors and the public Integrity Section of the Justice Department criminal division whether the facts here or facts deduced from an investigation whats a criminal charge, thats one thing. Its another thing all together to forego even taking a close look at the facts to determine whether an investigation should be pursued. And its my hope that at least that level of inquiry is being undertaken, whether the evidence rises to whether criminal charges should be brought is an entirely different question. But i would find it disturbing if the department of justice had some kind of corporate Policy Level had decided not even to look at the relevant facts that are already in plain view and they may know about that are not in plain view and determine that we just dont want to go there. Talk to me about that if you can clarify. What do you think it is that doj under Merrick Garland exactly should be looking at now in terms of criminal behavior within the doj . What would rise to that level . Well, theres two particular packages of criminal conduct. Again, i prosecuted national security offenses, not election crimes. But efforts to pressure State Election officials in georgia, personal Phone Calls by the president of the United States to lower Level Election officials in a given state, his agents like Rudy Giuliani making Phone Calls to these people. I mean, this is just astounding behavior at the highest levels of the united States Government to pressure State Government officials to overturn free and fair elections. And you know, whether the applicable facts correspond to the elements of a crime that the department of justice would have to prove beyond a reasonable doubt, thats a question left to Career Prosecutors. And they should have the time and space to evaluate that without all the White Noise or pressures being brought to bear by political commentators. But its another thing to forego taking that hard look because of concerns the department of justice will have the appearance of lending its weight to a partisan, political investigation. David, i wonder how you look back now on bill Barrs Resignation knowing that he knew about this. Well, you know, it certainly raises the question of whether he decided to get out of dodge before dodge got even rougher than it was even on his watch. That would not be an understandable reaction on his part. I will say, you know, that the acting Attorney General rosen and his staff to their credit were somehow able to hold the line amidst overwhelming pressure being brought to them by the president of the United States seemingly everyday to pressure them to pursue criminal investigations to say shea the president s political whims. So theres a lot by mr. Barrs tenure that is odious, to the extent that he was somehow kind of thin membrane of resistance against the president s efforts to overturn the election, you know, then credit to him. David, thank you so much for being with us. David laufman, we appreciate your perspective. New details on how the u. S. Is investigating the mysterious origin of the coronavirus. Back to school is here in full swing. Were getting ready for it and cnn is taking a closer look at the Vaccination Rates among children and teens. States in the northeast predominantly have the highest rates of vaccination than in southern states many of which have banned Mask Mandates. Vaccination rates are among the lowest in the country. Cnn Health Reporter Jacqulynn howard is with us now on this story. Jacqulynn, these numbers are showing the risk that students are going to face when they go Back To School. Its really going to depend on where they live. Thats right, brianna. It definitely depends on where you live. What really stands out, like you said, some of the states that have the fewest teens vaccinated, some of those states also have prohibited Mask Mandates in schools. So, for instance, in the state of arkansas, which has prohibited Mask Mandates, about 17 of 12 to 17yearolds are fully vaccinated and we heard recently from Arkansas Governor Hutchinson said he regrets banning or prohibiting Mask Mandates in schools. So thats an interesting trend were finding. But overall, when you look nationally, these are the states leading the pack when it comes to vaccinated 12 to 17yearolds. Vermont, massachusetts, Connecticut Theyve all vaccinated more than half of their adolescents followed by maryland and Rhode Island at 49 . And then when you look at the states with the least, 12 to 17yearolds vaccinated, mississippi, alabama at 11 and louisiana, wyoming and tennessee. Then to give you a national snapshot of how were doing, brianna, about 8 Million 12 to 17yearolds nationwide are fully vaccinated. That number represents about a third of all adolescents across the country. So as a nation, we still have some ways to go as well. Brianna . Certainly do. Jacqulynn, thank you so much for that. So a School Superintendent in one Florida County is pleading with florida governor Ron Desantis to allow for a temporary Mask Mandate as new cases and hospitalizations surge. Desantis has threatened to cut off State Funding for schools that require masks. The School Board is now recommending masks but allowing parents to Opt Out following a contentious meeting with parents and community groups. Joining me now is matt heartily along with his 12yearold Daughter lyla. She wrote a letter to the School Board pleading on behalf of her 10yearold younger brother. Thank you both so much for being with us. Lyla, this was quite a letter. I know you have it with you. Can you read part of it for everyone . Yeah. My brother is 10 years old and i Cant Get and Cant Get vaccinated. Im still worried that if masks are not required my brother could go to school one day and the next be dying in the hospital. Were siblings so we have our rivalries but i dont know what i would do if he died. Especially if it was caused by a place that means so much to him. School. Youre sticking up for our Little Brother there, which is awfully nice. What inspired you to write this . Well, my dad has been doing that day i wrote this did a rally. I was really thinking about it. And matt, i know that Lylas Letter helped inspire you to work even harder. The School Board did vote 52, changing the rules to now strongly recommend masks but there is an optout for people. Is this enough . You know, yesterday i was feeling victorious and happy and like maybe this policy would be enacted in a way where many people would be wearing masks. But the last day i feel like the messages we have got have been very muddied from the School District and im worried that this could just be an empty gesture. Lyla, does it feel to you that the governor Ron Desantis in your state doesnt want kids wearing masks . Yeah, it does. It feels like he it feels like theyre not taking the precautions to keep students who Cant Get vaccinated or can still get sick safe. Matt, do you feel safe with lyla and your son going to Sc School . I guess, what, in a week, not even . Yeah. This is so heavy for me. Lyla is vaccinated, so she has that extra layer of protection. We want our kids to be in school learning. But will does not because hes 10 and hes too young and his classmates dont. Were worried about him but were worried about his classmates as well. And this virus in our area is like an oncoming train. Why arent we getting our kids out of the way of this oncoming train. Thats how i feel. And do you feel as if your concerns are being heard at least within duval . Again, we felt some of us ill say i Cant Speak for all parents, some of us felt victorious Tuesday Night with this policy that again, there would be much more masking in schools than there would have been otherwise, but the proof will be in the policy. And so were waiting to see that the School District will actually strongly enforce masks with the optout available. Lyla, youve been vaccinated. How glad are you that you were vaccinated . Im really glad especially before School Starts. So im like i can still get sick but i can have that protection. An important layer of protection for all of us. Lyla, matt heartley, thank you both for being with us this morning. Thank you, john. Thank you. Alcohol, drugs, Divorce And Car accidents, what does that have to do with the attack on the capitol . The city of wuhan, the original epicenter of the pandemic, is testing its entire population as the highlytransmissible Delta Variant spreads across china. This morning, we have exclusive cnn reporting on the effort by u. S. Intel agencies to uncover the origins of covid19. Cnns katie Bo Williams is with us on this. This has been very difficult and obviously requires chinas involvement. What are they looking for here . What the intelligence this lab in china was working on, the lab some officials believe may have been the source of the pandemic. Now, specifically what theyre hoping to find are clues that will help them figure out whether or not the virus leaked originally from the lab in some way or whether it developed naturally out in the wild as many scientists believe, like sort of specifically the nittygritty, theyre hoping theyre going to find a blueprint, genetic blueprint from a Virus Sample similar enough to our Sars Cov 2 that will help piece together the evolutionary history of how the virus came into existence the way we know it now. But this is a lot of data so its a little like looking for a needle in a haystack. Several scientists we spoke to said, look, its possible not just possible, but we believe we already know all of the viruses that the wiv was working on, so for some scientists the chances theyre going to find kind of the key that unlocks the mystery here is, is small. But that said, almost to a person, every source that we spoke to says, you know, look, if there is an answer to be found to this question of natural origin, escape from a lab, its going to come from traditional scientific inquiry like this rather than sort of traditional intelligence work. Is that why its taking so long because it is so much to pour through, a needle in a haystack . Yeah, they said the challenges they had is processing power. This is so much data that they need really, really big computers to be able to process it. Thats where the national labs, 17 Elite Research Institutions under the Department Of Energy comes in. They have the big computers. Theyll kind of push all that data through. The other issue is you need specialists to interpret it. Not only do you need scientists that have security clearance. You need scientists that have the sort of specific expertise to be able to interpret this data and they have to speak mandarin. And not only do they have to speak mandarin, they have to speak technical Sciency Mandarin which has a specialized vocabulary. Theres a few sort of reasons this is taking awhile. That Vin Diagram was getting very tight then you threw in technical manned trin. I man adrenaline. Im sure it squeezed out some people. Republican Congressman Mo brooks saying he is immune from prosecution in a civil lawsuit in his role before the rally before the capitol attack. In a Court Filing brooks said he thought he was acting as a member of congress when he spoke at the Elipse Rally for trump on January 6 because it was about to certify the vote for presidency. He should note his defense has been rejected by the department of justice and here is a quick reminder of What Brooks said that day. Today is the day american patriots start taking down names and kicking ask. I want to bring in Phil Andonian who has sued brooks, Rudy Giuliani and former president Donald Trump. We talked about several steps in the process. You were arguing he doesnt have immunity. The d. O. J. Agreed with that. Hes still saying he has immunity. What do you make of that . I dont really know what to make of it, to be honest. So, the d. O. J. And the House Administration Committee both concluded properly that he was acting outside the scope of his employment as a congressman because he was engaged in political activity, and notably the reason they concluded that is because brooks himself said that in an affidavit he filed in support of his petition. So theres no dispute that political activity is outside the scope of a members employment, and so with brooks admission, as far as were concerned its an open and shut case and thats exactly what d. O. J. Concluded. All right. So why is he doing this, then . Well, i dont know. To delay things . What do you think . You know, to be totally candid, i think this is a pretty good example of why you should hire a lawyer when youre in legal trouble because even though brooks is a lawyer, hes emotionally involved in this case. He clearly is not understanding the implications of what hes saying. And i just dont think he gets it. He doesnt in his Filings Yesterday, he did nothing to rebut anything he himself said in an earlier filing in which he specifically states that hes talking about the 2022, the 2024 election. He is there at Donald Trumps request. Instead throws a whole bunch of nonsense about allegations were making in our complaint which at this stage are accepted as true. And other conclusions that the d. O. J. Drew. Its just simply boggling what he might be getting at. Hes pro se. Hes representing himself. Yes. Just to followup on the point youre saying, he started out his argument here, his motion in a kind of bizarre way, saying that he hasnt, you know, he hasnt been a drinker. He hasnt done drugs or smoked tobacco, hes never sped, never cheated on his wife. What does that have to do with . My favorite was hes never been in a Car Wreck that somebody accused him of being at fault at, which then begs the question how many no nonfault accidents has he been in and why are you including this in a pleading . I dont really understand, other than in all seriousness, to say that what hes doing is really would be really disingenuous given hes a Tough On Crime former prosecutor who you suppose, as far as i can tell doesnt have sympathy for people accused of wrongdoing. Here he is admitting his wrongdoing with verified burks acts. Its totally irrelevant and his Filings Yesterday completely missed the point that his own admissions of political Campaign Activity are at the core of the d. O. J. s decision, and we certainly hope the judge is going to uphold the d. O. J. s findings. Another bizarre twist in this sort of legal Time Line that were seeing here
