I am 63 years old. I have lived my entire adult life in public view. That is just not who i am, and thats not who i have ever been. Well, that is in stark contrast to the findings by New Yorks Attorney General, letitia james, who says cuomo sexually harassed current and former employees, creating a toxic workplace and violated state and federal law. The independent investigation found that Governor Cuomo sexually harassed multiple women, many of whom were young women, by engaging in unwanted groping, kisses, hugging and by making inappropriate comments. Investigators went on to detail the governors alleged conduct. Some suffered through unwanted touching and grabbing of their most intimate body parts. Others suffered through repeated offensive sexually suggestive or genderbased comments. A number of them endured both. None of them welcomed it and all of them found it disturbing, humiliating, uncomfortable and inappropriate. New York Senators Schumer And J gillebrand just released statements calling for cuomos resignation. Shimon prokupecz, the governor not resigning but offering a single apology to one of his accusers. He did. He basically in this recorded statement said that the way things were inferred, the type of activity that is alleged here just did not happen. Despite all of that, the Attorney General who released her findings after a monthslong investigation, interviewing 11 women who came forward to claim and to say that they had inappropriate contact with the governor, that they had inappropriate things were said, that there was groping, the Attorney Generals office saying that they found these women credible, including one, a State Trooper who was on the governors security detail. She came forward and raised allegations of inappropriate behavior, the Attorney General saying they found all of the women who came forward credible. The governor obviously saying he has a different view of this, defiant, and, at this point, has no intention of resigning. The thing thats very clear is that this was a very extensive investigation. The Attorney Generals office saying that they interviewed 179 individuals. They have 74,000 pieces of evidence, things from Text Messages, conversations, notes that some of the women took, some Text Messages between one of the women and other women raising what was going on, raising the issues of what was going on. The other thing that the Governors Office here from the Attorney General says was going on here was that this was a toxic workplace, that the Executive Chamber was filled with retaliation, that women had raised some of these concerns in their interviews, that they were terrified, that they feared in some cases these women said that they were afraid to come forward. So, in essence, the Governors Office here, the Attorney General says, violated state and federal laws. Now the Big Question becomes, well, what is next. The Attorney General says theyre done with this part of the investigation. Ultimately, it is going to be up to voters and Assembly Members, State Assembly, which is itself conducting an investigation and deciding on whether or not they want to move towards an impeachment proceeding. That is the Big Question here. Who will call for the governor to resign, and the other question is will the State Assembly decide to move in a direction where they would have to be forced to impeach the governor. Thats also very much unclear. The politics of this now is going to take center stage. The other thing thats important to note is that the Attorney General said in terms of criminal charges that it was not for them to investigate this in a criminal way. That if there are to be criminal charges it would be ultimately up to perhaps one of the das, the Albany County da where a Police Report was filed. We will be speaking to one of those Assembly Members about what their plan is in a few moments. Shimon, Thank You very much. Lets bring in cnn legal correspondent paula reid. Tell us more about what the women involved in this investigation alleged. Alisyn, what is so significant about the investigation is that it is not a he said she said she said times 11. The Attorney General says she believes the women. She says they were found to be credible, their statements corroborated by other evidence. They detailed in the course of the investigation, pretty shocking. Lets take a listen. Governor cuomo sexually harassed multiple women, many of whom were young women, by engaging in unwanted groping, kisses, hugging. Some suffered through unwanted touching and grabbing of their most intimate body parts. The governor hugged executive Assistant Number one and reached under her blouse to grab her breast. The governor held her so closely that her breasts were pressed against his body and he sometimes ran his hands up and down her back while he did so. There were also several occasions on which the governor grabbed her butt. The governor pressed and ran his fingers across the chest of a woman while reading the name of her company whose logo was on her chest. They also detailed how a State Trooper also made allegations. This is a woman who was assigned to protect the governor. She alleges that he touched her inappropriately on several occasions, including opening his hand and running it from her Belly Button to where she held her gun. Now, in his Apology Statement he opt opted to address some of the specific allegations. Again, it is not in a criminal court but in the Court Of Public Opinion. It is not clear going line by line, especially after the women were found credible, their story is corroborated, if thats the best defense. Thank you so much. Joining us now lets bring in Jennifer Rogers who is cnn legal analyst and former federal prosecutor. Also with us, cnn chief correspondent dana bash. Da dana let me start with you and pick up where paula left off. It is she said times 11, 179 witnesses including a trooper. The governor has tried to dismiss this as all politically motivated. It is hard to maintain that defense when you see the breadth and the specificity of this report. Not just that it is politically motivated, he went on with an elaborate Slide Show as part of his very carefully crafted response to say, yeah, i act in ways that people might think is inappropriate but thats just the way i am, thats the way my family is, thats the way i was brought up. So it is even more detailed and even deeper a defense than it is politically motivated. That is going to be, you know, what people who are going to be likely, even though there werent criminal or civil charges brought today, but it almost certainly will happen on some level in the state of New York, that will be what will go on in that court of law. But as paula said, in the court of opinion right now it seems to me that the fellow democrats who he serves with, never mind the people who look like theyre going to head toward Impeachment Proceedings in albany in the state capital, but here in washington, the entire delegation, fellow democrats in the delegation in the house, the two senators, two democrats including the senate majority leader, chuck schumer, they all renewed calls that they made earlier this year for him to resign. So he is up against that, and that is the reality. The one person we are still waiting to hear from is the actual head of the democratic party, the president of the united states, joe biden, who said earlier this year that if the allegations are true he should resign. Jennifer, i want to recap that Slide Show that Governor Cuomo used because i am interested, as a prosecutor, your impressions in the court of law and in the Court Of Public Opinion. He seemed to be saying this behavior that these women perceived as inappropriate, this is something i have been doing my whole life. I grab people, men and women, by the face, i kiss their foreheads, i kiss them on the top of the head. Thats what i do. I never meant any harm. So watch this for a moment. I have been making the same gesture in public all my life. I actually learned it from my mother and from my father. It is meant to convey warm litwarmth, nothing more. He went on to show at least a dozen photos of him doing that to men and women. Is that effective . It is funny, alisyn, you keyed in on doing things for the Court Of Public Opinion and doing things for a real court of law. You wouldnt be allowed to show a Slide Show like that in a court of law because in a legal court you are only concerned about the facts around the allegation thats being tried in that court. You cant come in as a defendant and say, hey, listen, i didnt assault this one woman by putting my hand up her blouse because i kiss a lot of people on the forehelad. That wouldnt be allowed as a matter of evidence. That Slide Show is for the political side of things saying, hey, it is just me, in the way you might here in the 19d70s or so, dont worry about it, i just like to pat a woman on the behind but it has no meaning. John, let me come to you not just on the accusations of Sexual Harassment but the culture there in the Governors Office. Theres a message and i think it is on page 64 here of this report that charlotte bennet, one of the accusers, sends to another, Lindsey Boylan after she goes public first time. What she says lets put it on the message. The verbal abuse, intimidation and living in constant fear were horribly toxic, dehumanizing and then he came on to me. I was scared what would happen if i reacted so i disappeared instead. My time in public service disappeared because he was bored and lonely. It still breaks my heart. Thats one of the things making it difficult hill for him to climb. He can say, it is not a toxic environment, it is a tough environment. But when you talk to people who worked with him for years, they will give him points for being an effective governor but he is tough, brusk and can be difficult to deal with. Thats one of the reasons theres not a lot of political capital for him to draw on at this time. It is one thing to say im a touchyfeely person and these are misunderstood, but you dont have misunderstandings with 11 different women in your office. As he heads to the next crucible, he will be going from denying to barging as they decide to impeach him. We only had one other governor impeached in New York history more than a century ago. Is he going to say, look, i wont run again, is he going to try to fight it and draw it out. You saw him give the Bill Clinton defense, i want to go back to work for the people of New York, but it is not enough. For the atmosphere around his office for all of its effectsiveness in some respect it reads credibly to a lot of people in albany unfortunately. Friends, stay with us because we want answers to that. Lets bring in New York State Senator who tweeted this. Tish james and her team have found that Governor Cuomo sexually harassed multiple women in violation of state and federal law. It is long past time for him to resign and face consequences for his actions. If he refuses, the assembly should impeach. The State Senator is here with me now. Senator, Thank You very much for being here. What were your thoughts when you heard what the Attorney General, the findings of this fivemonth investigation . Well, alisyn, Thank You. I was furious when i heard this because you have now the highest Law Enforcement Officer in New York state after an exhaustive, monthslong investigation by dedicated investigators as your panel reported, interviewing dozens of people, you know, countless people. They have found that the governor of the state of New York is a serial sexual harasser, that he broke state and federal Sexual Harassment laws, and we should not be comfortable as elected officials and as New Yorkers having somebody like this lead the state. He is not resigning. So now what . Thats what he says. So i think, as i said in my statement, i think the assembly now seriously needs to move forward with the prospect of impeachment. Under the State Constitution it has to come there and then the senate will take a final vote on it. I have seen enough. From what was reported publicly i called for him to resign in march, and the governor in response to the concerns said, lets wait for the investigation, see what it says. We waited, we have seen and i think the facts are very clear. It sounds like the speaker of the assembly has not seen enough. The statement that he put out says, we will now undertake an indepth legal examination of the ags report with the help of a legal firm. Why is that necessary . I think you would probably have to ask the speaker. As i said, i think i have seen enough. You know, i know the assembly judiciary committee, i have colleagues who are on there who have been working hard at this, but i think the time is now to speed this process up and to make sure we have a resolution and so New Yorkers dont have to go for months further with a governor who is so profoundly damaged and has really, i think his denial of these allegations is an insult to any woman out there. It is an insult to our intelligence and, you know, frankly an insult to the Attorney General and her investigators who looked into this and corroborated all of these allegations. How long do you think the State Assembly investigation will take . I dont know, but i hope that they will continue what theyre doing and wrap it up as soon as possible. If the governor has still not resigned, i would think that impeachment is an appropriate remedy at this point. Beyond impeachment, what do you think, what consequences do you think that he should face . So im not a lawyer and i dont want to speculate on the you know, the legal consequences he should face. I know the Attorney General was very careful in her statement to say she has tried to find the facts and is not trying to make any prosecutions. It certainly sounded like reading between the lines there that some of the women he harassed might have a case in civil court, which certainly they should file if this information is correct, which it seems like it is. But i think politically what you have to look at is he seems determined to cling to power no matter what, and he is using the Trump Playbook of denying everything, claiming to be a victim of politics, refusing to take responsibility for his actions. So i think politically New Yorkers at large and certainly my colleagues in the State Legislature have had enough, and it is time for him to move on. Weve got a wonderful and wellqualified lieutenant governor, kathy hochul, who could make history by being the first woman to be governor of the state of New York. It would be quite an outcome to all of this and a very fitting one i think. Senator melnyk, Thank You for your time. We will be watching closely what the State Assembly general does next. Thank you so much. Back to the panel now. Jennifer, you are an attorney. We heard from the State Senator that he is not. Do you foresee criminal charges ahead for the governor at all . We know that there is that investigation in albany. I really dont, victor. The one investigation that you reference in albany is the one that seems like it might fit within the definition of New York states forcible touching statute, but the other allegations dont seem to fit any definition that would be in criminal law. So the touching on the back, the kissing, the inappropriate comments, the hostile Work Environment are not criminal matters in New York state. So i do think the one pending investigation is likely the only possibility for criminal charges here. John, you heard that State Senator just talking. I mean hes ready, he feels, to move on to impeachment, but it doesnt sound like the speaker is. Well, this is not going to be a turnkey process. You know, Andrew Cuomo is a fighter. He is not going to resign. I do think there may be some Off Ramp where he says he doesnt run for reelection, but it wont be enough for a lot of folks in the assembly and the senate. You know, this is a very serious pattern, but we also need to acknowledge within the 11 women that made allegations theres a wide spectrum of accusations. Some are clearly inappropriate touching and worse. You cant spin your way out of that. Some are about an environment, a toxic environment, inappropriate comments, totally beneath the dignity of the office, but how those all get dealt with individually will be one of the many things. I think it is one of the reasons the Assembly Speaker is saying, were not going to pump the brakes but we need to do it the right way. How long is it going to tai . It is not going to be overnight, it is going to be weeks, if not months. Next year is an Election Year and it is further complicated by the fact traditionally in New York the Attorney General is seen as steppingstone to governor, and theres tension in there even though it was done by two expert individual prosecutors. If you remember back in march during an interview with Abc News the president was asked about the investigation and he said he believed if the allegations made against Governor Cuomo were confirmed then he should resign. Of course, Governor Cuomo is a longtime ally of President Biden, they go back decades, their families, so it is certainly a sensitive moment for him, a delicate moment. The dquestion is how is he goin to handle it this afternoon given what he said in march, and now what weve seen with the results of the investigation today. He did not answer questions with reporters when they were in the room with him and the Vice President and Community Leaders a few moments ago, but he said he would talk about it later when he makes remarks on covid19. We are indicating to see exactly what that is going to be. I should note the White House has said they have not had any conversations with the New York Governors Office at this time about whats going on, but President Biden is aware of the findings of this report. Of course, this also will be a topic that comes up, news of day that confronts the president , but he will be talking about coronavirus and the efforts his administration is making when it comes to vaccinations because, yes, the White House is pleased th getting 70 of adult americans with One Shot, but it comes a month later than they hoped to hit it. Nearly seven months after the Capitol Riot the deadly Human Toll of that insurrection continues to mount. Cnn has learned that two more d. C. Metropolitan Police Officers who responded to the Capitol Riot on January 6th have died by suicide. Officer Gunther Yashida was found in his home last week. Officer diatag was found deceased on the 10th. Those make four who responded to the capitol that day. What do we know about these officers . We know that kyle joined the Police Department in d. C. In 2016 and that he was assigned to the fifth district. We know that Officer Gunther Hashida joined the department in 2003. He was assigned to the emergency response team, a division within the special operations division. Both men according to the Metropolitan Police department responded to the capitol, both men took their own lives in the month of july. We cant know all of the conditions that would lead someone to such a tragic decision, however, they now join this list of men who share this one terrible day in common which was responding to the capitol. The other officers who took their own lives following their response to that attack, officer jeffrey smith, also a Metropolitan Police department officer, and officer liebengood. This is tragic and the news follows calls from their own colleagues who went to lawmakers in late july last week to tell them about the extensive trauma they underwent on the day of the insurrection and to call for more resources and to remind officers that if they need help they must seek it. It is a reminder of the immense Burden Law Enforcement takes on, takes on willingly when they run into an attack like what happened at the capitol that day. It is also a reminder that Mental Health resources are a matter of life and death, victor, alisyn. It is just so horrible, whitney. I want to ask you a related question about misinformation. So Wisconsin Senator Ron Johnson is at it again. He has become a walking misinformation machine. He is now suggesting, without evidence, that the fbi had Advance Knowledge of the January 6th riot but did nothing about it. What is he trying to suggest and what was the context for where he made these comments . So this is according to the washington post. This was a piece of video that they showed in a story in which he is caught on camera suggesting that because the fbi deeply infiltrated a plot to kidnap michigan Governor Gretchen Whitmer and eventually brought those men to justice in october of last year, because they knew so much about that case that surely they would have known so much about the people who attacked the capitol. He was suggesting it is unlikely the Fbi Wouldnt have known a lot about the people who were planning an attack as immense as what happened at the capitol. There is no evidence to suggest this. This is a Conspiracy Theory. It is built on this idea from, you know, the right who are suggesting that the fbi was somehow deeply involved and much more involved in the Capitol Riot than theyve let on and, in fact, the criticism of the fbi up until this point is that they werent involved enough, that they didnt take a lot of the threats seriously enough. But, again, this is a Conspiracy Theory promulgated by some people on the right and, apparently, at least one republican lawmaker. You know, you started this during the last administration because you thought that the administration, the cdc there was not being clear enough about the guidance for families specifically. Weve seen some confusion over the last couple of weeks now returning to guidance on masks. Do you think this administration is doing a better job of advising parents especially on covid and what to do . I certainly think theyre doing a better job. I think we could always improve. I think some of the guidance last week was broadly pretty confusing. I think theres widespread agreement maybe that messaging was not ideal. I also think they havent been very clear with parents and they havent done a good job differentiating between unvaccinated adults and unvaccinated kids with biden making clear that unvaccinated kids are low risk, not that we shouldnt Hope Vaccines or we shouldnt vaccinate them when we have access to it but it is a somewhat different Risk Profile than, say, an unvaccinated 85 year old. I wish the cdc was doing more to help parents navigate the complicated tweets in this difficult time. Emily, has the Delta Variant changed your thinking at all . The reason that i ask is because louisiana is a mess right now. In fact, one of the doctors at, i believe, the largest hospital there is saying that theyre just seeing more kids now. I mean we all, you know, a year ago believed that kids were pretty resistant to covid, but i want to play for you what that doctor is saying he is seeing now in the hospital. Were seeing children as young as a few days that have covid up to teenagers. Some of them need Breathing Tubes and some of them even just putting the Breathing Tubes this is not enough. I mean hes gone on to say that were seeing twice the amount of children hospitalized than we did during the original surge. Does that change the equation . You know, i think that we have seen still with delta in the uk, in other locations that kids are not getting more seriously ill. Of course, when they have more cases you are going to see more kids and some kids tragically do get very sick with covid. However, the best thing we can do to protect kids is to vaccinate adults. Theres a good thread this morning noting we are not seeing a lot of kids in massachusetts even though theyre unvaccinated and thats because the adults around them are vaccinated. I think we cannot emphasize enough the best way to protect kids is for adults to get the vaccine. Let me ask you before you go on the book, the family firm, that the data is the way to go. So the book has a bunch of data but it also has a way to approach difficult decisions so you can be confident you made the decision the right way as a family, even though we have to understand with this kind of uncertainty it is hard to be really sure about all of our decisions. I think it is true in a lot of parenting, not just in the coronavirus. I like to make decisions out of sheer panic, and so reading her book has changed some of my own thinking because you just you write it down.
