The statement from the Cosby Family says i want to thank the Supreme Court who saw the light and the truth. Mr. Cosby was given a deal by Bruce Castor in which he was granted immunity. He gave up his Fifth Amendment rights in hopes that he get back to work, back to life and showed up for any questions on his own accord. Charges should have never been brought against mr. Cosby. I want to thank the attorneys who successfully argued his appeal and especially mrs. Cosby who stood strong and was he every step of the way and supported every strategy from the attorneys and the team and always knew that mr. Cosby was innocent. Thats the crux of it. Essentially the Appellate Court deciding that this deal made with the then Montgomery County District attorney Bruce Castor, who may be a familiar name because he represented President Trump after the insurrection, essentially that happened back in 2005 with cosby which allowed him to then feel like he had immunity to then go forward and give these depositions where he incriminated himself. Then those depositions were then used against him when charges were basically brought forward more than a decade later. Thats what the Appellate Court is saying was that his Due Process was violated. So this is really just stunning at the moment. But what we are hearing is this 78yearold or hes in his 80s. Hes 83. 83yearold comedian who many thought that he would be in prison for the rest of his life is now going to be walking as a free man when we know during these court trials more than 50 women were coming forward. You have to remember, again, to put this in context, this was the first celebrity in the Me Too Movement that was accused and also convicted. This was like a pivotal moment in that movement to pave the way. Of course We Saw Harvey Weinstein after that and many others. So this was huge for women to say they can Come Forward and actually get justice. And now it looks like that thats all somewhat in question as to how much justice did they really get. Absolutely. Ive interviewed close to a dozen of those women personally. Ive spoken to some today already. And they are devastated by this. I mean they took the risk of coming forward and telling these hideous stories about what they say he did, and now his conviction has been overturned. So that feels like justice denied to them. Brynn, thank you very much for that reporting. With us now is cnn senior legal Analyst Elie Honig and laura coates. Laura, i start with the same question, how did this happen . Was this something that the former d. A. , not the one who got the conviction for cosby, the former d. A. , Bruce Castor, did he do something dubious here . Is this a result of some sort of back Room Deal that he did . Well, this is the result certainly not with the judges or the court of appeals that Bruce Castor would have had this sort of a deal. The deal he had was with Bill Cosby back many years ago. I think it was 2004, when he said, hey, listen, ive made a Judgment Call about the likelihood of being able to prosecute successfully Bill Cosby, who was alleged victimizing at the time Andrea Constand before any criminal trial had been brought. He made the judgment about the likelihood of success and offered instead for the opportunity not to prosecute him so she should pursue civil litigation remedies against him. Under that agreement Bill Cosby agreed to make statements under a deposition that provided for civil relief, not criminal prosecution. So this was actually argued a lot prior to the trial. Remember leading up to the criminal trial, Bill Cosbys attorneys were very adamant that he should not be prosecuted because they had this deal. They didnt want his deposition to be used against him in any way. They believed he had been guaranteed that it would never come or see the light of day. And remember there was a Trial Court Judge who said were going to change that. It will not only see the light of day, it can also be used in some Form Or Fashion in this existing criminal prosecution. And so this was teed up before the trial, but after a jury found him guilty, after a jury heard all of the evidence, after a jury weighed the testimony of people who actually were there and testifying in court and also of course the victim survivor, Andrea Constand, while the jury made their determination. So now you have to ask yourself to what extent the jury was relying on those depositionrelated statements as opposed to what else they heard in the trial. The Appellate Court seems to think that they never should have had the opportunity to hear any of it and the entire criminal trial should have been precluded. Its pretty shocking. Elie, just to remind people, i want to pull up the new York Magazine cover. These are the women who felt compelled to Come Forward and speak out about what they say Bill Cosby did to them. There are at least 50 socalled victims. And i say that because his conviction has been overturned so now its hard to know what to call them at this point. They were accusers. And they came forward and told their story. And so for them, this morning its very confusing for whats happening. Explain how it can be that he could be convicted in 2018 but before that as laura was saying in 2004 or 05, the d. A. Could have promised him that he wouldnt be prosecuted. Yeah, its got to be so devastating for the victims. I know youve said youve spoken with some of them. Ive certainly dealt with some Sexual Assault victims Over The years. Its just got to be Heart Breaking for them. This is important. The court did not say Bill Cosby is innocent. The court did not say Bill Cosby didnt do any of this. What the court said is a deal is a deal. Going back to 2004, as laura said, the l. A. At the time, Bruce Castor, made a deal essentially the court found with Bill Cosby. That deal was the d. A. Said we dont think we have enough evidence to charge and criminally convict Bill Cosby. We can certainly second guess that but that was Castors Opinion at the time. As a result, because the d. A. Said we wont be charminging cri charging criminally, that forced Bill Cosby to testify in a civil lawsuit. Once the d. A. Says hes not charging you, you cannot take the fifth. Thats the deal that led Bill Cosby to give this Deposition Testimony which was then used against him. Then it doesnt matter what happened after that. New d. A. S came in and said were not living by that deal, were going to charge him anyway. But the Supreme Court said too bad, future prosecutors, later prosecutor, the deal that Bruce Castor made back in 04, 05, thats a deal thats binding. So its really awe legal decision here based on that deal that Bruce Castor made. It is not a finding that Bill Cosby didnt do it, that the charges against him were wrong, that the evidence was insufficient. This is a legal ruling only if thats any consolation for people to know. I dont know. Well be speaking to some of the survivors later in the program. I dont know if that will be any consolation to them because just hearing that hes going to walk out of prison this afternoon has been such a shock to them. And so, laura, about that deposition. What a lot of these women say is that he drugged them. He drugged them and then had sex with them and he never admitted that until a deposition. That deposition that he gave in 2005 where the attorney, Andrea Constands attorney says when you got the convequaaludes, wasn your mind that you were going to use it with young women that you wanted to have sex with . Bill cosby replies, yes. And that was part of what this hinged on, he admitted it in this deposition. But youre saying that now that that shouldnt have been allowed in his criminal trial . Well, thats what the court has now found, that it should not have been allowed. I want to be very clear in the language that we use here. It is one thing to show the Magazine Cover of all the women who have accused Bill Cosby. Its also a different leap to go to who actually was able to testify at the trial. We know that made a difference here, not to minimize anyones allegations. But it made a difference in how the Trial Court allowed people to actually testify to substantiate and buttress the credibility of the testimony of Andrea Constand, who was the one victim whose actual case was before that particular trial jury. And so its important to make sure we distinguish because its important for looking up a deposition in terms of when we talk about the admissions that he made. At all times Bill Cosby has denied, as we all know, that he was at all guilty in spite of that particular statement that he made but it did not preclude the jury from actually disagreeing from his statement and believing that he in fact needed to have accountability and they convicted him. Even as late as last week, he was denied parole in part because he failed to demonstrate remorse. He refused a Sex Offender Course while he was incarcerated, consistently professed his innocence, which is the right of people to do. But given the volume of what youre talking about and the volume of allegations, it seemed to belie Common Sense that he would not have remorse or have admitted something even at that point when he was serving in prison. And so right now a lot of this is in many respects for people confusing in part because it feels like a technicality. But it also shows you the underbelly of what prosecutors deals actually look like. Its about the Cost Benefit Analysis that prosecutors often make in deciding how theyre going to pursue justice for an accuser if they are unable to meet what they believe will be their burden of proof. As elie pointed out, we can quibble about what they could have proven ultimately. Obviously they were able to do so many years later in this trial. Now youre seeing him walk away because the court said im not going to look at what happened in the trial. Im going to look at the actual deal. You never would have had the trial had that agreement been honored. Now, Bruce Castor had to answer for that when he tried to, i believe, run for reelection. The public was not particularly amenable to the choices he made once they were exposed, i believe. So youre seeing the Fallout And Collateral effects. But naturally the people who have accused Bill Cosby are in the wake of all that Collateral Damage in effect now. Elie, very quickly, i know what the survivors will want to know is can he be retried now for any of this . So the only place to appeal an opinion from the pennsylvania Supreme Court is to the u. S. Supreme court. I dont there is no way the u. S. Supreme court will take this case. The court the pennsylvania Supreme Court here says they cannot retry Bill Cosby for the sexual Assault Allegation against miss constand, against this individual. If theres other bases to charge him for other potential Sexual Assaults, that could be in play, but the court says you cannot retry him for this particular victim. We know that the statute of limitations has passed for many of these victims, that was the whole point. Yeah. That was why they were just waiting with bated breath for him to get some sort of justice. So the likelihood theres any justice from here when you see the number of women on the new York Magazine is striking. I do want to mention that Deep Down in that opinion the judges did find sort of that theyre not clear on the second the retrial because, remember, he went to trial. The jury was deadlocked and so he was retried. In that first trial only one other accuser was allowed to take the stand. The second time around there were five women. The judges took some issue that that many women were coming forward. Was there a Character Assassination or were they providing proof of a pattern here. That is interesting to see that written down in an opinion because it makes you think, okay, whats going to happen moving forward because we have been seeing these other trials and other cases of men not just men but mostly select men being accused and being charged and facing trial. I dont know if Elie And Laura have a further opinion about that but i finding that striking. Hold your thought on that. Obviously well be covering it the next couple of hours. Well have much more on this Breaking News coming up. Also ahead of course we are live in surfside, florida, where the search for survivors is in its seventh day. The number of victims killed in surfside, florida, increased this afternoon. A short time ago officials confirmed four more bodies have been found in the rubble. There are now 16 people confirmed dead. But 147 people are still unaccounted for. Miamidade Countys Mayor explained why that number keeps fluctuating. Please join me in continuing to pray for those who have lost their lives in this unthinkable tragedy. We are conducting an audit of the list of those accounted and unaccounted for Over The last few days. Our detectives have been working around the clock to reach every single person who we have been told may be missing by a loved one. We need to verify every report and to remove duplicates wherever possible. Cnns Rosa Flores has been on site since the catastrophe happened last thursday. Rosa, whats happening at this hour . Reporter you know, alisyn, i caught up with the mayor after a Press Conference that just wrapped up to get the very latest, and she tells me about those tunnels that weve been reporting on. Now, the commander of the israeli team told our colleague, john berman, earlier today that they had discovered tunnels overnight. This, of course, is a huge development because throughout this search, that has been the problem. Just how this building collapsed is so compact. I asked the mayor about it. She says that this is definitely a sign of hope and that right now what is going on is that the Search And Rescue teams are following those voids. I also asked her about what is happening with the personal belongings that are being foundinfound in the middle of the rubble. We learned yesterday that the rubble, the pieces of concrete, that is being sorted. That is evidence and will be forensically analyzed for the investigation. Today we learned from the mayor that the personal belongings, those special pieces of jewelry, albums, photographs, will also be cataloged. Right now what theyre doing, the Search And Rescue teams are doing, is putting them in bins. Theyre going to be cataloged, theyre going to be sorted and then theres a process of identification to make sure that these precious belongings are returned to their Loved Ones after this investigation. Now, alisyn, the other thing i want to leave you with is just the emotion here. The Fire Chief today, emotional during the Press Conference, saying that its very, very tough, very, very dangerous the conditions here. You probably see this rain around me. Its been raining, the pile of rubble becomes very slippery. These men and women continue to risk their lives to try to save others. Alisyn. Rosa flores, thank you very much for all of that Reporting Today and all of these days. Now for an exclusive that youll see first here on cnn. We have obtained a Voice Mail from a survivor. She left it calling her brother moments after she was awoken by The Building starting to come down last thursday. Rodriguez is a plaintiff in the first Class Action Lawsuit against the Champlain Tower South condominium association, accusing the group of recklessness and negligent conduct for not keeping that building safe. So youre about to hear this audio of the 59yearold Resident as she witnesses The Building beginning to fall around her and shes calling out to see if a neighbor is okay. Okay, youre also about to hear bangs that her attorney says indicate the moment of collapsing. Anybody Over There . Hello . Whos there . Yeah. You got him . Yeah eh . [ speaking foreign language ] i hear voices. I gotta check on these guys. Let me check. Oh, my god what the hell . Oh, my god the whole side of The Building has fallen. [ speaking foreign language ] yadi . Yadi . Joining us now is adam moskowitz, attorney. Adam, thank you very much. That was chilling listening to that Voice Mail. She was actually leaving a message while all of that was happening. Has she walked you through what she was seeing while we hear those screams and hear her yelling oh, my god . Yeah, its just been its hell. I mean its hell here right now watching all the priests and the rabbis. She didnt know what was going on, it was absolute hell. She called her brother. She loved her brother and she was trying to figure out what to do. And she hung up with her brother but what she didnt realize is that she was still on the phone with her brother. The recording was still on. So it still kept recording what she was doing. And she was going apartment to apartment because she was nervous that a lot of her neighbors were older and a lot of them couldnt move and some of them had small children. And she was so nervous, she spent 10 or 15 minutes just going apartment to apartment trying to save these people. Then she got in the stairway and it was dark and her brother just told her just go down, but she wanted to make sure that everybody got out. So its its just emotional. And he just found this on his telephone. She didnt know that he had this. He was going through his phone and she didnt hang up the call. And so, adam, when shes saying, oh, my god, The Building is gone, what has she told you she was seeing . What does that mean . Shes in The Building. So what is she seeing around her . Its like a movie. You look at your hallway and theres nothing there. Theres theres no building there. She couldnt figure it out. She was trying to consciously figure out what is going on here. But half The Building is gone. I mean the floors are just sheared off. Its not even like another building fell. Half of her building fell, so shes looking out trying to figure out where do you go down. She didnt know. You cant use the elevator. Shes been complaining for months, for months, for years, she has been telling The Building in photographs and video, shes been saying The Building is falling apart. She has video of the garage. Theres dripping on her car. Every week her and her friends are complaining and nobody listened to her. Nobody. And they said your building is fine, your building is safe, dont worry. This is just ridiculous. Thats why we filed a Class Action Lawsuit because it needs to start now. These people need to grieve, but we need to start preserving the evidence. We need to start getting a receiver involved if theres claims that the homeowners have. We need to make sure the Insurance Money is frozen and nobody take it, because this is just horrible. The conduct is so atrocious, ive never seen this. Adam, on the flip side, they did know something was wrong with that building as we now know. And in fact the Condo Board was presented it sounds like some of the residents were bristling at a number that high. So how can you prove that they were culpable when they were, it sounds like, attempting to raise the funds to do the needed fixes . To raise money for over a year to fix the facade of a building . Thats criminal. You think theyre going to cure a building so they can fix the pavement and fix the balconies . There was some serious structural problems with this building. Buildings dont collapse. A typical assessment for homeowners is not what was needed here. Somebody needed to dig deeper in 2018. And the Warning Signs were there. Were going to get to the bottom of who is responsible. It could have been a parade of horribles. It could have been the antenna, the roofing company, it could have been the pool, it could have been a Lot But Rosa rodriguez and her friends were raising this in 2018 to deaf ears because nobody was listening to her. That audio that you had to hear of the most horrible night of her life should not have happened. Were going to get to the bottom of it. I know theres going to be state and federal investigations, but theres also going to be a legal investigation, whether its our firm or some other firm. Somebody is going to get to the bottom of it, whether its politicians, whether its the state, whether its the federal government. Were going to freeze the evidence and make sure whoever caused this horrible hell is going to be responsible for it. Buildings dont fall. Adam moskowitz. We hear you, you appreciate your time and appreciate you sharing that audio with us. Its chilling and its just incredible to think what the residents inside were seeing and hearing at that moment. Thank you for being with us. Thank you. Sorry im so emotional. Understood, adam. Thank you. Well speak to you again. Still ahead, new concerns about covid in the u. S. Do you need to wear a mask even if youre vaccinated . Well talk about some of the new guidance. Com promo the cdc says the highly contagious Delta Coronavirus Variant now accounts for one in four cases in the united states, making it the most prevalent strain nationwide. The Surgeon General issuing this warning. If you are vaccinated and fully vaccinated, that means two weeks after your last shot, then there is good evidence that you have a high degree of protection against this virus. But if you are not vaccinated, then you are in trouble. This is, again, a serious threat and were seeing it spread among unvaccinated people. Heres another development. This variant is forcing Health Officials to rethink Mask Mandates, sparking Confusion And Irritation across the country. Dr. Jonathan reiner is a cnn medical Analyst And Professor of medicine at george washington university. Why, why after we have just been liberated from masks would doubly vaccinated people like you and i need to go back to wearing masks . Well, the short answer is you dont. But the problem is that we have 150 Million unvaccinated people in this Country And Delta is coming for them. And when we relaxed Masking Requirements for vaccinated folks in this country, the unvaccinated took that as an opportunity also to drop their masking habits. So where delta is on the rise, and where the virus is on the rise, those folks are in great danger. The only way to get them masked is probably in some places to repost Masking Requirements for everybody. So youre saying that there could be some local officials, state officials, governors who in the states where were seeing it spike, and the spike of coronavirus is directly related to the unvaccinated places, that you predict we could see some new Mask Mandates . Absolutely. So its really a tale of two countries. So where im sitting now in d. C. , the Positivity Rate is 0. 7 . In missouri, its 11 . In alabama its 11 . In mississippi its 12 . Theres a lot of virus in parts of this country. It corresponds to places where there are a lot of unvaccinated people, where the percent of adults vaccinated is less than 50 , 55 . So how do you protect the population when you cant get them to vaccinate . You have to get them to mask up. People need to understand that we have a solution to masking and thats to get a vaccine. We know that the mrna vaccines, for instance, are wonderfully effective. The Pfizer Vaccine is over 90 effective at preventing infection, about 96 effective at preventing illness serious enough to be hospitalized. So if you dont want to mask, great, but get vaccinated. But you cant have it both ways. If youre unvaccinated, with delta surging, you are very likely to get infected and this virus can still kill you. And very quickly, dr. Reiner, kids who cant get vaccinated, what should parents be doing for them under 14. Thats a great question. Those kids obviously need to keep masks on when theyre in public places, particularly when theyre indoors in public places. And, you know, although the vaccines are very effective at preventing infection amongst those who are vaccinated, theyre not perfect. And i think parents of kids who are not yet vaccinated should consider wearing a mask when theyre around other people, particularly those that they dont know the Vaccine Status of. Dr. Jonathan reiner, thank you very much. My pleasure. We have Breaking News. Bill cosby is now a free man. Were learning that he has been released from prison after the Pennsylvania State Supreme Court overturned the 83yearold former actors conviction today. They said that he was denied a fair trial back in 2018. Cnns Brynn Gingras is on the story with us. We also have senior legal Analyst Elie Honig and laura coates. He was just released. We wondered when it was going to happen. This is the fastest turnaround we have ever seen. So hes walking out a free man now. His conviction overturned. Im still trying to catch my breath just from reading the opinion. I cant imagine what these accusers are feeling right now. This opinion comes down and now hes out of prison right now. We are waiting to see if he will actually speak. There were some times during trial where he would say a few words. Not even sure if thats possible but well see. Of course well stay on this for you. We do know that his lawyer had said that he planned on getting Bill Cosby into his car and then bringing him to the cosby home. In the meantime, were still sort of digesting exactly what did unfold here just within the last few hours. And that is that the Appellate Court there in the State Of Pennsylvania overturned his 10year conviction of Bill Cosby, stunning so many people. The reason for it, according to the Appellate Court, was that Bill Cosbys Due Process, his rights were violated. Essentially saying a deal that was made with the former Montgomery County District attorney many years ago, which said essentially that he could not be criminally prosecuted, which then led the way for Bill Cosby to sit down in a civil deposition and give incriminating testimony, which then was part of the reasons why he was brought forth with criminal charges later and eventually convicted, that it wasnt fair, that his Due Process rights were violated here. Im sure the legal analysts will spell this out better than i did but were just now getting reaction from accusers. Gloria allred who represented many of his accusers called this devastating. She said my heart especially goes out to those who bravely testified in both of his criminal cases. Despite the pennsylvania Supreme Courts decision this was an important fight for justice. Even though the court overturned the conviction on technical grounds, it did not vindicate Bill Cosbys conduct and should not be interpreted as a Statement Or Finding that he didnt ten years was sentence that he obliged, he said he would take so he wouldnt have to incriminate himself and admit to what he was being accused of doing. Of course were getting more in. But i think everyone at this point is just trying to catch their breath, its incredible. I know thats how the accusers feel. By the way, were watching one of our affiliates here following this white vehicle. We know that Bill Cosby was just released half an hour im sorry, ten minutes ago, according to the department of corrections. But we have not been able to confirm who is in that white car or why our affiliates are so convinced that this is connected to Bill Cosby, but were working on that. Elie, i want to bring you and laura in right now. Im hearing from all of the accusers, this is obviously a huge blow to them. Its been a very emotional couple of hours for them. They basically wanti to know whose fault is this . How did this happen . How is it that they lived through a trial and he was convicted and he went to prison and now its been overturned . Alisyn, this just has to be devastating for all of the victims. You have to think of them first and foremost. This is important. Bill cosby has not been exonerated. Nobody has said he didnt do it. Nobody has said he is innocent. The people to blame here are the prosecutors. Theres two aspects to that. First of all, Bruce Castor, the District Attorney who made this deal back in 20042005 where he essentially said i dont believe we have enough evidence to prosecute him criminally. That enabled Bill Cosby, forced Bill Cosby to testify in his criminal deposition. Thats the deal that Bruce Castor made. Can he be faulted for that . Absolutely. He bears blame for that. And then part two is that future prosecutors came along after Bruce Castor and said were not playing by that deal. Were not observing that deal. Thats what the pennsylvania Supreme Court said is the legal problem here. They said once Bruce Castor made that deal, were not going to prosecute you, like it or not, good deal or bad deal, future prosecutors that came after him were bound by that. When they went back on that deal and tried him, thats what they say violated Bill Cosbys rights and thats what this decision was about. Laura, as brynn was just pointing out, hes never Bill Cosby has never admitted guilt and always maintained his innocence. However, in the deposition in 2005 when he thought that this was a civil case and he was never going to be prosecuted, he did admit what he did. So all of these accusers, i mean the vast majority, say that he drugged them unknowingly and then had sex with them against their will. In that deposition The Question from Andrea Constand, one of the accusers, from her attorney was when you got the quaaludes, was it in your mind that you were going to use these quaaludes for young women that you wanted to have sex with . Bill cosby replies yes. And so this is why it is so maddening for the accusers. Not only do they say they lived through it but he did at one point admit it. Well, and Thats Part of the conundrum here. Remember, the attorneys for Bill Cosby fought Tooth And Nail talking about how to interpret that oneword answer, yes. They were very keen to say that he did not make an admission to having committed Sexual Assault against multiple women, that he was simply answering a question. These were the arguments they were making. In fact the arguments that he made at the time also found their way towards the criminal trial with an eye towards being able to even use that. The Defense Attorneys believe that that statement alone did not somehow transform into an admission that could be used at trial. They did not have a particular Reference Point to the actual victim whose case was being litigated and tried at that time, Andrea Constand, and teed this issue up. Thats why this is not surprising it was an appellate issue but the outcome is very shocking for the reasons we talked about here. Remember, one of the reasons that the newer prosecutors decided to bring this matter in spite of what elie and i have been talking about, about that former deal, is because they believed the circumstances had changed to such a degree because of additional accusers, because of the pattern of evidence here, because it appeared to be his m. O. And they made the Judgment Call to say in spite of that earlier agreement, because there had been new developments in the form of the Deposition Testimony now being allowed to be used, the idea of other accusers having Come Forward, they believe they had enough then to transform that otherwise iron clad deal into being, you know, fungible. Of course what the courts are saying here is, look, one prosecutor leaving does not essentially absolve or give you a clean slate for the future prosecutors. If it was the government that took action, if it was the actual commonwealth that decided to bring the case, not an individual lawyer or the commonwealth itself made the deal, then the commonwealth will be bound going forward. Now, this can have effects in other cases, of course. You can imagine outside of the context of Bill Cosby, the idea of why if a prosecutor was allowed to renege on a deal, it would have a chilling effect on the ability of cooperators to Come Forward or cases to be resolved in other facets. So the Supreme Court was probably looking at this in a way not simply toward this case which of course is devastating for all involved but with an eye towards future cases where a prosecutor makes a deal, attempts to renege and then tries to prosecute nonetheless. This is what the Supreme Court of pennsylvania had to grapple with and they decided that the deal was the deal. Brynn, i just want to remind people of the amount of accusers who came forward. We have a picture of some of the accusers. We interviewed, i personally interviewed many of these women, and it was incredibly painful and emotional for them to Come Forward after all of this time. Here are just some of the ones that i well, there are at least well, there are at least 50 that we know of and i interviewed probably a dozen. And the point is, is that some of these were from the 70s, some were from the 80s, some were from the 90s. This was one of these cases that kind of opened all of our eyes and changed the way We Saw statute of limitations with rape and Sexual Assault because sometimes, particularly if you are sedated and drugged as these women say they were, you dont remember what happened for several years. It comes it pixelates back. So the idea that there was a sevenyear statute of limitations, the women said thats not fair, were just figuring out what happened to us. Right. So as youve pointed out, this was kind of a landmark decision. It was in the Me Too Movement. It was courageous of these women. Honestly listen, ive never been in that position myself, i cant imagine the emotions that theyre feeling right now, but i hear deal and immediately my mind goes to jeffrey epstein, the deal he made, the Sweetheart Deal Everybody was talking about. What is it with these deals that are being made thats just basically we have to say theyre separate cases, separate circumstances, but when you were victimized, does that really matter. I just cant imagine what theyre feeling, thinking that they had some sort of, you know, justice to them and then all of a sudden now its like gone. Again, in minutes really. This happened we were breaking this on the air just a few hours ago and now we believe that might be his car that hes riding in possibly. Yeah. Im just hearing from some of the accusers and how hard this day is for them and how emotional it is. So, elie, what now for them . Where do they go now for justice . Yeah, im afraid i dont have great answers for them on this case. This is a decision by the Pennsylvania State Supreme Court. The only place you can appeal that is to the united states Supreme Court. The united states Supreme Court only takes a fraction of a fraction, Well Under usually under 3 of the cases brought to it. I dont think its particularly likely the u. S. Supreme court will take this case, even if prosecutors make the decision to try to get it to the u. S. Supreme court, which itself isnt particularly likely. The court here, the pennsylvania Supreme Court, also said Bill Cosby cannot be retried on the charges relating to this victim. So prosecutors are going to have to sit down, take a hard look at what they have from all the other victims, all the other people that have gone forward and decide whether theres a different case relating to a different victim that is still within the statute of limitations. As you said, a lot of this happened in the 70s, 80s, 90s, that they can charge against Bill Cosby. Laura, we are just getting in a new statement from the District Attorney. I want to read it now for the first time for everyone. This is from kevin steele. He had previously prosecuted Bill Cosby. He says the Majority Decision by the pennsylvania Supreme Court orders the release of william h. Cosby jr. From state prison. He was found guilty by a jury and now goes free on a procedural issue that is irrelevant to the facts of the crime. I want to commend cosbys victim, Andrea Constand, for her bravery in coming forward and remaining steadfast throughout this long ordeal as well as all the other women who have shared similar experiences. My hope is that this decision will not dampen the reporting of Sexual Assault by victims. Prosecutors in my office will continue to follow the evidence wherever and to whomever it leads. We still believe that No One is above the law, including those who are rich, famous, and powerful. Those are my thought goes back to prosecuting Sexual Assault cases. The deck is stacked against those who are victimized by Sexual Assault. Let alone those delayed in their reporting and theres a whole host of reasons why somebody may delay in the reporting. Theres a psychology involved. There is victim blaming thats involved. There is the ideas of people believing that they themselves were at fault and then theres hurdles like this. When you believe that youre using your voice. You have reclaimed it. You are advocating. You have the attention of the prosecutors and they have Exercise Or Discretion to prosecute and now it feels like its been transformed into an exercise in futility where people will believe, not only do i risk become public about this, but now at the end of the day, even if i have some semblance of justice, it might be fleeting. One thing to keep in mind here is his sentence was a range, 3 to 10 years. He was approaching the three Year Nmark and he was denied parole. You probably had survivors who believed they Wntsere Continuou vindicated. Its not been arrested with his release. Yes, that is what they thought. I spoken to some who thought he at 83 years old would never get out of prison and this would be a Life Sentence for him. Thats not the case and he has just walked free. Were keeping an eye on Capitol Hill where the house is set to vote on a select committee to investigate the January 6th insurrection. Well bring you the latest from there. I wouldve called yesterday. Any moment we expect the House Of Representatives to vote on establishing a collect committee to investigate the January 6th insurrection. Youll remember senate republicans killed the bipartisan commission last month. Several republicans did vote in favor of forming that commission but some of them now say they will vote against. House Speaker Nancy Pelosis panel today. We know some members of the d. C. Police and the capitol police are invited to the gallery to vote today. Reporter that group of Police Officers both from the Capitol Police Department and the metropolitan d. C. Police department are seated in the gallery as we speak watching the closing minutes of the debate on this bill which is expected to be voted on here in the next few minutes. You saw House Speaker Nancy Pelosi Wrapping up the debate on the House Floor a few minutes ago. It will be interesting to see how this vote plays out today. It will pass. Theres no concern about it passing. Because its a house only action, it does not require the approval of the senate. That will allow the House Speaker to begin the process of forming the collect committee right away. Unlike the independent bipartisan commission We Saw quite a few Republicans Vote for. We dont expect nearly that much support from republicans this time around. Some of those key players like the Ranking Member on the Homeland Security Committee who has been very critical of former president President Trump, he said this select committee does not accomplish the goals he hoped the independent bipartisan committee will do. That doesnt mean there wont be some republicans that vote for it. Were watching to see what Liz Chaney will vote for or Adam Kinsinger of illinois. Both of those players are important as well because Nancy Pelosi said she may appoint a remember as part of the eight members of the committee that shell have complete authority over as to who appoint. Their votes could be critical. They could be one of the two that she ends up appointing to this ecocommittee once it gets moving. This will be an interesting vote to see how it plays out. Watching both republican and democrats go back and forth why they believe the economy should be in place and republicans say it was unnecessary. Well figure out exactly where this goes here in the next few minutes. Ryon come back to us as soon as you have more information. Our Breaking News coverage continues.
