This is an example of some of the stuff thats happening in many of our cities, and its absolutely terrible. Its frightening. Its by The Grace Of God thAt Those kids were actually shot, i home the city of New York is going to provide some child psychologists to be able to deal with those young people. Because thats a lifechanging, obviously, event. You know, this is a trend in violence were seeing across the u. S. , right . Even in the past few days, i cant keep up with all of the shootings weve been covering. Not just Mass Shootings. Of course, the Mass Shooting in arizona and the Mass Shooting in North Carolina that killed two people. Michigan a shooting on on a highway. Also, when you look At The statistics, charles, so far this year, we have seen a 40 increase in Mass Shootings compared to the same period in 2020. And this, of course, is data compiled by cnn and the Gun Violence archives. Whats going on here . Why are we seeing this spike . Well, listen, you got guns in the hands of people that should not have guns. And congress is doing absolutely nothing. Some State Legislatures are doing absolutely nothing. Texas just passed a law allowing anybody to carry a gun that wants to which in my opinion is exactly the wrong way to be moving right now. We have to find a way to get guns out of the hands of people who should not have them. I know people want gun checks, those are necessary, but people getting caught with guns, need to be in jail. Too many are caught and being let back on the street. And thats sending the wrong message as well so, youve got to be able to do both. There needs to be changes in the law but there has to be consequences for people committing the crimes. What about police morale. Especially in the past year when weve seen so much unrest on the streets and, of course, you know, calls to defund the police. And things of that nature. And just on thursday, you know, Mass Resignations At The Portland Police department. And we should say thAt They resigned from a specific team. The rapid response team. Were talking about 50 officers, and they are tasked with responding to protests and civil unrest. And that happened the day after a portland Police Officer was indicted for allegedly beating a protester. What do you make of an incident like that . I mean, does this go does it speak to morale . Well, it does speak to morale. You know, listen, first of all, i understand whAt The officers in portland were going through. I think they were deployed 150 straight days for protests and so forth. But having said that, you dont walk away, you dont quit. Listen, you take an oath when you take the job. That oath means something, even if in Todays World that oaths dont mean a whole lot to some people. But it means a lot to me and it should mean a lot to every single person who wears that badge. You just dont walk away. Theyre upset, i get that. Thats going to be decided in a court of law. Not only that, youre putting your fellow officers in jeopardy, now that void has to be filled by that officer in the field that may not have that level of training that you have. I also think its important that Portland Officers be equipped with Body Cameras. Notice this, once it gets back out over the atlantic, its expected to restrengthen back into a tropical storm as it slides off the east coast. So this is going to be a storm that well watch for several days. You do still have tropical warnings across several states, again, mainly because of those winds. Always greAt To have you, sir. The prosecution spent four days building their case. This man spent about 30 minutes on his defense. He was unhinged At Times. Shouting in the courtroom. Someone said that he looks mentally unfit to defend himself. If he winds up being convicted, couldnt he use thAt To appeal in the future, based on the idea thAt The judge made a mistake in letting him defend himself. Boris, good morning to you. The answer is no. Theres generally theres an Mrael Lit Issue called ineffective assistance of counsel. You cannot on one hand ask the court to allow you to represent yourself. And then on the other hand, if convicted say you were not competent to do so. What happened, 46 years ago, there was a case, that case really made clear, Made Plain it was the Perretta Case versus california. ThAt The defendant has the right to pretty much play counsel. And if youre otherwise competent to represent yourself. Theres a hearing thAt Takes place prior to the trial. Very briefly, whAt The judge does is assess your competence. Youre asked simple questions, Number One, you come to the conclusion that youre voluntarily doing it. The judge makes that attempt. Number two, its an intelligent waiver of the right. And number three, you under the consequences of selfrepresenting. As long as the judge is s satisfied with that, youre okay. Then the judge on the record made certain findings saying i realize having sAt Through this, that you appear to be competent to me. That you appear to have understood what you were doing. Knew the questions that you were asking and im satisfied with that. And i think its a tough case, very unique in as much as youre seeing a Father Cross examining his son. A father representing himself and a father having been accused of killing his wife and his daughter thereafter with an ax. Yeah, just really an awful story to have to cover. And difficult to watch his son go through that. Joey, i do want to look ahead into next Weeks Sentencing of derek chauvin, the former Police Officer convicted of killing george floyd. Chauvin can face up to 40 years in prison. According to minnesota law, though, a person with no criminal history can find up being sentenced to a fraction of thAt Time unless there are aggravating factors. What do you anticipate might happen with his sentencing . So, heres whAt This looks like, boris. There have been aggravating factors. He was convicted of three things. Of course, as it related to the Felony Murder engaging in assault, murder assault. Thats the most serious count. Number two, he acted with z depravity, a depraved heart. And number three, he acted with negligence. At the end, you have Sentence Guidelines that account for 12 1 2 years. There was an aggravating finding, the judge found thAt There were other factors presence, right, those factors indicating that you acted with cruelty, that you acted with a gang of other people, three or four, that you acted to abuse your authority. So, with those findings, the judge could raise, right, elevate the sentence. And you could be looking more at 30 or 40 years. Of course, he has asked, that is, chauvin and his team for probation. Thats not going to happen. I suspect looking forward, that hell get a six Agnificant Amou of time, likely doubling that, 24 or more. Joey, you mentioned not acting alone. I wanted to ask you about the other three officers essentially tried next year. What are their attorneys going to look for during the sentencing . I think, look, weve reached the reckoning point, boris, as far as accountability. And no one is above the law. When you look At The case, you say why did this even go to trial. I think the answer is theres a real history of people who dont even get arrested. When they dont get arrested they dont get indicted. When At The dont get indicted, they dont get convicted. So theres an emboldened, lets take it to trial and see what happens. So with the other three, seeing how harsh the judge will be. In a new era, if you do wrong, whether you wear a batch, the thought that no one is above the law. Theres a state prosecution, but the federal government, of course, in terms of civil rights has a prosecution as well. And i think thats going to be important here, too. Look, the way that it was laid out i think is pretty straightforward. Which is thAt The Number One issue, every poll that weve seen has suggested thAt The voters are worried about crime and public safety. Theres a lot of disorder in the streets. Theres a 100plus Percent Increase in homicides and shootings and people are concerned. And that gives a tremendous advantage to Eric Adams because he spent 22 years in the nypd. Other candidates are trying to do whatever they can think of, either to change the subject or cut the cord in some way and that is the dynamic that is driving the race At This point. Candidates like Kathryn Garcia, another candidate, Maya Wiley are watching up in polls to Eric Adams. Its going to be a Photo Finish to tuesday. The fact that garcia and yang are campaigning together today. Obviously raising eyebrows for people not following the race so closely. We just saw yang criticizing garcia. They both want the same job. Whats the strategy here . Its interesting, amara, they both say, oh, im not a politician, yet, theyve made this alliance. I think the strategy is to try to see what weve seen in other rank Ed Voting jurisdictions. New york has never done this before but we had a situation in oakland where the Number One finisher ended up not becoming the mayor because the number two and three challengers had an alliance, and urged all of their passionate followers saying hey, if you dont want to vote for me, rank this person as your next leading person. By the time the votes were totaled, one of them could in fact prevail. I think thats a little bit of the strategy. Again, its new to New Yorkers. Ive been covering the city for a long, long time, ive never seen anything like this with two candidates kind of binding together, even though theyve criticized each other, and sort of asking their voters to vote for both one candidate, as well as one of their leading rivals. Fascinating stuff, isnt it . I have to ask you the obvious question. Especially because we know New York votes overwhelmingly democratic. Its a city that has become more progressive. Its fair to say thAt The winner of tuesdays primary will be the next mayor of New York . Thats the general assumption. But it comes with an asterisk. And that asterisk is if theres a winner thats controversial or seen as controversial, we could see extra innings if there are enough people out there who think that with a sixmonth lead time, they could maybe try and reverse the result of this primary until in november. We could see a fight. Its been known to happen. Keep in mind, we had an uninterrupted run of five terms of republican mayors in this very democratic city. It can in fact happen.
