Anthony, as we always have to say as situations like this unfold, there is very little information coming out from the county sheriff, but it is a very big Police Presence we can see from the aerials of the scene. We know its a Maintenance Rail Yard Light Rail Yard. When youre looking at this, can you just talk to me, what you can see in these images . You want to see a large response. You want to see police get resources to the scene and contain it as fast as possible. From there, you want time. You want to be sure that youre treating victims, youre triaging if there are those that are shot, and you have to then really look to confront the shooter. So far weve got the resources there, and now we fall into the Management And Supervision and Execution Phase of addressing the active shooter. Things that weve seen in the aerial images that have been coming in, weve seen a lot of Police Tape blocking off streets. It seems like its a maintenance real yard, so seems like it has the potential of being a very big scene that police are going to have to deal with. That might contribute to what were looking at. I lost count of all the Law Enforcement vehicles i saw on the scene. I will see in the images im looking at now, you dont see a lot of urgency in what looks like the Police Presence on the scene. Hopefully thats a good indication that at least the scene is somewhat calm and contained. Were watching kgo, their helicopters. That looks like Law Enforcement presence there. But talk to me about the challenges that a Maintenance Rail Yard, any kind of a Rail Yard, the size of an area, if that becomes the site of a shooting that presents for Law Enforcement. Signs of a Crime Scene, because right now this is a Crime Scene, an active Crime Scene really matters. If theyre not running around looking like theyre disorganized, thats a good thing. In a situation like this, you fall into an ics system, incident command system. This came from the fire issues in california in the early 70s. What you have is one person, an Incident Commander all resources are at the scene and the Incident Commander is asking what teams go where, who is at a point to cut off streets . Are we going to have whats the route for the ambos. How do we get people in and out to the hospital or continue the evacuation of any of those still trapped in this unfortunate Crime Scene. So if its steady right now and youre seeing organization, okay, thats a good sign that somebody, that we have people there that know what theyre doing. Anthony, stick with me. Cnns josh campbell, hes been watching us and tracking these developments since they just started coming in a few minutes ago. Josh is joining me now. Josh, any more detail coming out . Were still waiting for information from Law Enforcement. The initial report was from the Santa Clara Sheriff saying they were responding to this incident. Whenever we see a Mass Shooting, obviously officers has the duty to respond to mitigate the threat and the information will follow later. We know the area around the shooting, this is near the Light Rail Yard, is locked down to include a Middle School nearby, theyre in a state of lockdown as well out of an abundance of caution. This massive presence were seeing right now from first responders indicates theyre taking this very seriously. As you were just saying, its a good sign that were not seeing the influx of tactical resources and the like. Sadly, ive covered so many of O Ez these shootings, so many are over in a matter of seconds. We dont know know how many victims were talking about. We dont have information about the shooter. We know Law Enforcement has surrounded that location. One other thing, theyve directed the media to a particular area. So were hoping to get some kind of update. Im reading the tea leaves. Thats the last thing on their mind if theres an actual emergent threat. Look, josh, i think this is against the backdrop this is against is important. Theyre investigating a shooting. We dont know how many. We dont know if there are fatalities or injuries. When they come to brief reporters, we know well get more information. This is against a Backdrop Of, gosh i looked back, there were at least 12 Mass Shootings over the weekend. Every day this week there have been more reports of more shootings in america. Thats the backdrop against this. This has become and is all too familiar, the number of times you and i have been on together, the number of times Anthony Barksdale has had to talk about how this unfolds, the information that comes out slowly and what we learned. Its against the Backdrop Of such a deadly weekend of violence. It is indeed. As anthony was just mentioning there, the processes that go in place whenever theres a shooting, we discussed what the media will do when they stage. Basically this is an indictment of society that weve Route Niezed now, we know how to respond to these kind of ins accidents and what to expect. Thats the sad state, that we cover to cover these issues of Gun Violence over and over. We dont know what type of weapon may have been used here. Obviously those details will follow. Again, a serious situation, Police Officers taking it seriously. Its worth noting that this incidents where it took place is literally around the corner from the local sheriffs station. Even though you might have a large Law Enforcement presence staged a block or less away, again, with these Gun Incidents weve seen, they can be over too quickly to include the loss of life, to include injuries, a very serious deal we continue to see across the country. The Washington Post is reporting Manhattans District Attorney has convened a special Grand Jury as part of its criminal probe into Donald Trump, an investigation that has gone on for two years and is now taking a new turn. This Grand Jury could decide on any indictments against trump or others in the Trump Organization. The longtime focus for prosecutors in New York has been on whether the Trump Organization misled lenders and insurance companies, essentially potential fraud, potential financial crimes. Cnns Paula Reid is joining me now. Shes been tracking all these details and this new reporting. Paula, what are you learning . Reporter we know this is an incredibly powerful tool, a Grand Jury for prosecutors. Its going to allow them to do two very important things. The first, allow them to continue to gather evidence, subpoenas, additional documents and witnesses. Then theyll have the opportunity to potentially test their case before this group of up to 23 randomly selected people. Now, the fact they convened this Grand Jury two years into the investigation does suggs jest that they believe they have some evidence of a crime. Kate, the grand Jurys Work is done in secret. Its the prosecutors, the grand jurors and a court reporter. In order to understand whats going on, were relying on our sources. We know from our sources that at the heart of this investigation are questions about whether the Trump Organization may have lied about its assets, questions about whether they went to banks and lied about how much money they had, saying they had more than they did to secure loans and whether they told the government they had less than they actually did so they didnt have to pay as much in taxes. The crime that that could potentially suggest, fraud. Fraud is difficult to prove. Youre going to need documents. Youre going to need witnesses. The former president doesnt email or text. He doesnt leave much of a Paper Trail which is why witnesses are so key. And one witness that will be especially important if he is willing to cooperate will be the Trump Organizations longtime cfo, Allen Weisselberg. At this point theres no guarantee that the former President Or Anyone else will be charged. So what all does this mean. We heard last week that the Attorney General has joined forces with the da which suggests the ag is bringing meaningful evidence to the table that suggests criminal activity. This is another step forward they have to take in order to charge trump or the organization or any of the other executives. They just wouldnt do it if they didnt think they have enough to charge someone. Im not saying its going to be Donald Trump. They wouldnt go through this effort unless they believe they were going to ask for an indictment of someone. Thats why its so important at this point. What is the very latest that youre hearing . Thats right. We expect to hear more from authorities in about 11 minutes at a Press Conference. What were hearing is sadly, according to the San Jose mercury news, there have been fatalities in the shooting near this Valley Transportation Authority Light Rail Yard. Were told by the mayor that multiple people are being treated, in his words. We know from the Santa Clara County Sheriffs Department that the shooter is, in their words, down. We dont know if hes deceased if he or she is deceased or injured. We dont know if this person was fired upon by Law Enforcement or perhaps a selfinflicted gunshot wound. We dont yet know that. Were hearing the suspect is down which tells us they dont think theres a lingering threat from this person. Were hoping for additional details in ten minutes time from authorities. This incident occurring resulting in this large Police Presence. Businesses going into lockdown to include a Middle School thats nearby. Obviously authorities and people taking this very seriously. Sadly, were hearing there have been deaths according to the San Jose mercury news. Were hearing the shooter is no longer a threat according to the sheriff. Let me bring in Anthony Barksdale as well as andrew mccabe. Unfortunately, andy, back on talking about another Tragedy Unfolding in america. You see this, and what are the questions you have in this moment . Well, you know, kate, i was thinking the same thing. Your viewers are probably as capable of commenting on these incidents as we are now. The scenes were seeing from the Video Feed are very, very familiar. You see a very large Law Enforcement response to the scene which i should remind you could be folks who were some moned there to help out, tactical teams, those sort of assets. It also includes a lot of officers who selfdeploy to the scene. Each of these Mass Shootings typically provokes a massive response from Law Enforcement of all stripes. That might account for the number of vehicles youre seeing there on the video. The understanding that we have fatalities, but that the shooter may have been neutralized in one way or another also i think explains why youre seeing what appears from the video to be somewhat of a lack of urgency. People are standing around, talking, briefing others on the status, no doubt. You dont see tactical teams flooding into the building with guns raised in an effort to neutralize the threat. I think thats a good indication as well. Anthony, this seems like a very big response. There are a lot of officers on the scene. I dont have an issue with that. Its a large area, and you have to deploy your resources effectively in this situation. When youre dealing with a large building, a large area, you have to be methodical. You dont want to put your officers, put citizens in danger by just sweeping past. So i know it looks like a lot. It may even look like an overresponse to some, but you want those resources at your disposal to protect and prevent the loss of lives. Its okay, and today, its over for now from our understanding, but we are seeing this far too much. Far too much. Anthony, when a sheriff tweets out shooter is down, whats that going to tell you, she or he is dead . I would definitely say the shooter is incapacitated. I would wait for a ruling on the condition of the shooter. To me that means the shooter either with selfinflicted wounds or officer have engaged and incapacitated the shooter. I do want to say one thing. In situations like this, this is where Police Officers need military grade equipment, whether it be the rifles that they use or Ballistic Shields or even bulletresistant vehicles. This is a prime example of how these active Shooter Situations demand that the right tools are there and available for your Police Officers. Andy, while were waiting for more details again, well bring you the Press Conference when it happens live. What anthony is bringing up is the struggle when we talk about Law Enforcement and Police Reform in america, right . As anthony is saying, they need everything at their disposal when theyre running towards danger and dont know what theyre getting into. We juxtapose that in completely different situations, and its all part of the conversation about diverting resources from Police Departments in order to serve communities and put money towards communities in a different way. We dont have details about this. You and i are exhausted and saddened that we continue to see images of ambulances sitting there in an unfolding situation. We see it too many times. Im going to go back to, as im looking down at just the reports from this weekend, this could, again, be in ten minutes, another Mass Shooting in america. There were at least 12 Mass Shootings in america between friday and sunday. Every day this is happening, and people are just going to work. Thats exactly right. To put those numbers in context, weve become so numb to this wave of Gun Violence. Lets put those numbers in context. Where are the numbers that show how many Mass Shootings they had in canada or the United Kingdom or france over last weekend . I would be pretty confident in saying that there werent any numbers, or if there were, they were far less than what we experience here in the united states. We are in the middle of an unprecedented wave of Gun Violence. It is a wave of violence that none of our similar western democracies experience, and we have to start confronting the reasons behind why so many american citizens die at the hands of other citizens in incidents like these Mass Shootings, or even just the normal Daytoday Violence that we experience in many of our cities and rural areas. We continue to sweep this issue under the rug, and it just gets worse every day. If i could add one tling to what anthony said, i absolutely agree that police need the sort of tools they have to respond to these sort of Mass Shooting incidents as one of the primary findings that we came up after studying incidents like columbine and Virginia Tech to deploy these sorts of highpowered rifles for this purpose, so police would have the tools they need to respond. But there is a valid conversation around whether or not those tools need to be deployed to things like, you know, civil unrest and first amendment protest activity. There are ways to parse through these issues intelligently. And hopefully these are the conversations were having now. There is an intelligent conversation to be had. Those conversations largely are not being had. You cant ignore it anymore, you guys. Its happening every day. San jose, california, is now the site of another tragic shooting because now were getting reports of fatalities. We do not know how many. We will be learning a lot more hopefully very soon as they will be holding a Press Conference. The Sheriffs Department tweets out the shooter is down. The very latest, let me read to you as it was just handed to me, according to a Transportation Spokesperson because this happened at a Rail Yard in San Jose the suspect in the shooting is deceased, according to this spokesperson. Here is what they also said. Multiple casualties, extent of injuries is still being determined. This came in an email she said in an email, employees are evacuated. The Sheriffs Office at younger, which i assume is a street, is the Reunification Location for employees and their families, which is very important. Right now im sure there are a lot of families out there in San Jose who are also Searching For answers while we wait for the sheriff. Let me bring in josh campbell. Were waiting and watching for this Press Conference to begin. Josh, can you bring everyone up to speed, how this transpired and what we know so far this morning . Kate, authorities got calls this morning of shots fired near this Valley Transportation Authority Rail Yard josh, im going to interrupt. The Press Conference is starting right now. Multiple 911 calls, multiple shots fired calls in the area of 101 West Younger Avenue in the city of San Jose. This building is a Bta Control center, a Valley Transportation Authority control center, a hub that stores multiple vta trains. Multiple deputies including surrounding Law Enforcement agencies arrived to the scene for an active shooter investigation. The information i can tell you right now is very preliminary. I can confirm with you right now that we do have multiple victims and we have multiple casualties at this point. I cant confirm the exact number of injuries and fatalities, but i will tell you that there are multiple injuries and multd fatalities in this case. This still is an ongoing investigation. We do have multiple agencies here helping us out with the Law Enforcement side as well as the county fireside, City Fire Department and multiple agencies. I will tell you about the suspect right now. The suspect is confirmed deceased. I will not go into details as to what the cause of death is at this point. The suspect is deceased at this point. The public is safe at this point. This is still an ongoing investigation, like i was saying earlier. Well have another Press Briefing in probably about one hour and ill be able to give you an update. Is the victim tied to the Vta Or Family or employees . The victim there are vta employees that are victims. With regards to the suspect, i dont have that information at this point. I dont know if it was indoors or outdoors at this point. Semiautomatic . I do not have the information on that point. Can you tell us were there at least five fatalities . Theres a lot of speculation on injuries and fatalities. I dont have a number for you. Give me about an hour and ill give you an update. Everything is still preliminary. It just occurred. We have investigators on the scene trying to figure out exactly what happened. Right now were trying to set up a reunification, get victims where they need to go and get medical treatment at this point. Thats the most important thing. One at a time, please. I dont know what kind of weapon at this time. Where can Family Members get information about their Loved Ones . Good question. Right now were staging our reunification at 55 West Younger Avenue at the Sheriffs Department next door. If anyone has any type of information regarding this incident, please give us a call. They can be anonymous in this case. We can get as much information as we can get in regards to what transpired in this case, that would help us as well. We have investigators on Scene Gathering Information to figure out what exactly happened. Do you know how many employees work here . I dont know how many employees work at this filled. These incidents unravel so fast. It is critical that police, Law Enforcement get to these scenes as soon as possible to end the threat. Whats disturbing to me is im hearing that the Sheriffs Office is right next to this location. This person is saying theyre going to do what theyre going to do. Could it be suicide by cop after theyve shot numerous victims . Its very disturbing. I definitely want to know more about this suspect. Im sorry for the victims and their families. This is horrible. Horrible. Andy, i think what anthony is hitting on is also going to be the Reunification Center for families is at the Sheriffs Office which is, as that deputy just said, is right next door to this facility. And still they have multiple fatalities that were talking about here. Yeah. The horror that must be going through Family Members, friends and Loved Ones of people who work at that facility, its just unspeakable. There are so many people in the San Jose area right now that are wondering if theyre friends, fathers, mothers, brothers, what have you, have been injured or killed in yet another Mass Shooting. This is the piece of responding to these events that i think folks dont normally think about. We see the tactical teams on television and the police response, and we, of course, are concerned for the officers safety. But its those absolutely horrific moments where you are having to tell that Loved One who comes to the family Reunification Center that theyre not going to see their Family Member again, or people have to wait while casualties and injuries and fatalities are taken out of these Crime Scenes to find out whats happened to their Loved Ones. Its just its heartbreaking. It never gets any easier and better. Its the reason why we as a society have to do something about this. Its been over time. Here we are again. How many more examples do we need . More details are going to come, but imality a little loss for words, anthony, because how much more do we need to know, is where i feel like im stuck at at this moment. Theyre going to have another update in an hour. The deputy seemed confident hell have more information to share. Im sure it will be just as tragic when he comes to report more news. He did say i believe he did say employees at the filled were victims. They did not say yet he said he did not have the information to know anything about the suspect in terms of was this person an employee, how did the person get there, did the shooting happen outside, was it inside. While i will say i think as a society we dont need to know those details anymore because it is so tragic, for an investigation in such a large Crime Scene, they do need to suss this out. They must know did the shooting begin outside, was it all inside, what happened, what did the suspect community kate, if anything, before shooting, and what the Security Situation is at that facility, right . Absolutely. Youre spot on with that, but we also need to look at the weapons used. How did this suspect, this killer, get these weapons . Then youre going to need to run that out. When i say run it out, Law Enforcement needs to figure out the chain that led to this individual being in possession should he or she have had a weapon, should they be banned from having a weapon, and we really, like youre saying, were seeing this over and over again, and its just become too commonplace. This facility is a really big one, a Maintenance Service Facility for the Light Rail Yard that runs throughout San Jose and i think throughout northern california. Its a very this is now a very big Crime Scene, especially when you talk about multiple fatalities. You focus a lot on your expertise is in Security And Assessment of security. This seems a tough one to secure a facility like this from a threat that theyve found, a threat that obviously just happened. Listen, i think one of the complicating factors here in trying to analyze the situation is we just dont know a lot of information. We know the victims were employees of this facility, but we dont know if the hostile actor was also an employee. If they were, they would have knowledge of what Baseline Security systems were in place, that they could circumvent those Security Situations to commit this tragic incident. What were all Searching For, in the moments of an immediate aftermath of any type of incident like that, we want to know why, why did this happen. I think that what weve really come to think about time and time again is thatmotivations f these type of actors vary greatly. Tragically, the outcomes are always the same. Theyre always a lot of human life. My colleagues on air right now are describing it. Weve described this for years. You and i have sat at the same desk talking about these tragic incidents. Theres a Couple Other complicating factors right now. Absent of a clear motive from the shooter who now we know is deceased, we Cant Interview that person, we have to understand what we know from a threat perspective. Thats something from a Security Design Point of view. We have to understand how targeted acts of violence typically occur. A lot of times were seeing that the response the act in and of itself, is in response to some sort of grievance. Its either a Workplace Violence grieve vence, grievance between relationships, and tragically weve seen it in schools. How do we start addressing and understanding what is the meddle for these hostile actors to engage in these violent acts. Also, the common denominator is the gun. We have to bring that into the conversation as well and really start thinking about how do we defend workplaces, schools, places where public where the public gathers to start pre preventing these violent acts. The common thread in all of these shootings, especially Mass Shootings is generally the weapon. It is generally the gun, jonathan. When you look at how close this facility is to a Sheriffs Department, how they had multiple, multiple calls coming in of shots fired, and this many people dead in an instant, this leads you down the Path Weve been led down so many times before about the weapon. Correct. Listen, weapons, whether theyre a semiautomatic handgun or a rifle, in the hands of a trained individual, can cause mass devastation. We know that. Weve seen that time and time again. I think the question is, why are people who we know should not have weapons, why do they have access to these weapons, how are they getting them and how are they then taking possession of that weapon to enact these violent acts. These are the things we have to get ahead of. This is the challenge for Law Enforcement. Theres a lot of guns out there. Thats the thing. It is a challenge this is a threat to Law Enforcement. Officers say all the time, you all have said to me, you dont want people to have these kind of guns, whatever we learn the gun is, in the hands of bad people, in the hands of people who shouldnt have guns. The buffet of options of how to begin tackling this is out there and has been. And the problem is people apparently dont see enough tragedy to do anything about it. Theres a fine balance here, protecting constitutional right to have weapons by some, but then we know that tlr bad actors, hostile actors that could care less about the constitution engaging these acts. Thats what the challenge is for Law Enforcement, how do you protect constitutional rights on one side while enforcing the law on the other and preventing these acts of violence by those who really could care less about the laws that we have. Theyre focused on the violent act. Thats exactly right. Let me bring in josh campbell. Josh, there are more questions than answers, of course. One thing that Law Enforcement is clearly wanting to get at is motive. We heard the deputy during the Press Conference say, if you have any information, it can be anonymous, please contact the Santa Clara Sheriffs department to provide that information. They dont have a suspect that they can interview now because the suspect is dead. So what are they doing right now to get at this question . Thats the key point. Weve seen incidents where a suspect is taken alive. They can be interviewed. Sometimes Weve Seen People that are proud of what theyve done, and theyll admit to officers. In this situation with him or her being deceased, they cant glean that information. Theyre going to be looking at witnesses, investigating any writings, Social Media and the like that this person may have had. But even in the immediate incident, any utterances that this person made. Was this person known to some of the witnesses that can be interviewed . That is what authorities will be doing now to try to get to that motivation, again, because this person obviously is now deceased. Then the question comes up, once they identify this person, Law Enforcement will be looking to see was this person known to them, were there any past encounters with Law Enforcement, any criminal history, anything that may have indicated that something like this would transpire. And then the final piece, which this is almost less frequent but nevertheless Law Enforcement will be doing their due diligence, theyll want to ensure that this person was acting alone and this Wasnt Part of a possible conspiracy which, again, is almost always not the case. Those are all the boxes that Law Enforcement officers are trying to check. They call it circling the target. Youre going Tro Try to learn everything you can about this individual and learn why they went to this particular Location Today and engaged in this loss of life. Were just so sorry for the families we dont know how many employees work in this facility or how many people were working on the job when this all started playing out. You know there are so many people who are trying to look for answers now and there are multiple families that are going to get the worst news possible. We know this happened at a workplace. At a railway maintenance facility. What does it change in an investigation if they find that the shooter was also an employee . If the shooter was an employee that obviously opens up the possibly that the motivation for the shooting was somehow work related. The grievance that jonathan was talking about. Maybe there was a prior dispute between employees or between a supervisor and the shooter. Those are all possibilities. Nose are important to Law Enforcement and investigators because as soon as we can identify a credible motive we can begin to rule out other possible motives. The very rare possibility that there are others involved or that the crime was ideologically motivated. To be clear we dont know that about this shooting. But as we get more circumstances, as we get more facts and begin to build that picture. If that shows us that it was related to a Workplace Dispute or grievance we can rule out the other possibly more troubling answers. We always want to know why but of course it doesnt matter the motive. There are still multiple lives lost, multiple families shattered because of what happened when they got up and went to work like any other day. Thats right.
