The new York Attorney Generals Office just announced its investigation of the Trump Organization is no longer purely a civil matter. Its now a criminal case. The a. G. Is working with the Mabt District Attorney on the expanding probe. Their office is investigating whether Trumps Business inflated the value of its assets for loans and for tax benefits, and separately the manhattan Dchl A. Has examined millions of pages of documents including trumps personal and Business Tax returns. Trumps lawyers have not yet responded. The former president in the past has called the investigations politically motivated and a witch hunt. The attorney Generals Office is now joining and teaming up with the Manhattan District Attorneys Office in the investigation. Le Tia James has been conducting a civil investigation into the organization since 2019 and they recently informed the Trump Organization thAt Their investigation is now turning criminal. In a statement thAt The a. G. s office gave cnn last night, they said we have informed the Trump Organization its no longer civil in nature. Were now acting on Criminal Nall capacity. In practice this means that a couple of very well informed extremely knowledgeable attorneys from the a. G. s office are now teaming one the d. A. s office, leveraging their knowledge in working with the d. A. This also, though, means that leticia James Office is going to continue the investigation. An attorney for the Trump Organization declined to comment but they have called this in the past a politically motivated investigation. Kara scannell, thanks for bringing this to us. Jennifer rogers joins us. What does this mean. First the d. A. And now the states in this too. I think the a. J. s office has found something new. Theres no reason to team up unless during the civil investigation thAt The a. G. Was conducting found something criminal, brought it to the d. A. , they found something new, and theyre going to join forces together. Thats what it suggests to me. Is there a Requirement Gotoinform the Trump Organization this is a criminal investigation . In a case like this where they have made clear writs only civil in nature, yes, they would definitely let them know that because they have confrontation clauses. So they would definitely want them to know that before moving forward criminally. Does this put anymore in any kind of legal jeopardy . Certainly criminal charges bring a different sort of jeopardy and consequences than civil charges do. We dont know whether this will lead to anything criminally and we dont know how serious it would be. There are plenty of businesses, Business Records violations. We dont know how serious it could be. But, of course, criminal jeopardy is worse than civil jeopardy. Whats the most important thing that could be the most treacherous for the Trump Organization . Its probably the Tax Fraud issues because thats where you get significant dollar amounts that bump up sentencing. I think thats still in line and in the lane thAt They were working on. We know the focus of this investigation has been alan wew wisen brg. How important is it getting to him . It certainly would be an incredible thing to turn him against the Trump Organization. He knows, as you say, where the bodies are buried. The Problem Sit has not seemed to work so far. They may have to end up going without him, which, of course, they can do. It may not be as fulsome of an investigation they wanted. Eric trump was interviewed when this was a civil investigation. That i spoke to him. I cant imagine he would have agreed to it had it been criminal At That point. What happens to his you know, his discussions with them . Yeah, so, you know, thats a really sticky issue. Theyre going have to separate out whAt They use that for. He ha as right to selfincrimination in terms of the criminal matters, so theyre going to have to carefully see whAt They can use those statements for and what other Evidence Theyll have to get. He brought up to the Supreme Court to get access to Trumps Tax returns, so i think we could look to see this investigation i mean it has been going on for a long time. I think we could see a decision on whether to charge this before Cy Vance is out of office. And, of course, Lit Have To Prosoap and likely be litigated. Any increased anxiety on the Trump Organization over the last days and weeks or is it hard to tell . I think its hard to sell. Theyre still getting incoming and the document requests. This morning we have Brandnew Cnn Reporting On why House Minority Leader Kevin Mccarthy decided to oppose the commission by one of his own. A compromised republican. Mccarthy was driven by fear over the scope of the investigation and his being subpoenaed potentially to testify about his communications on January 6th and after with former president trump. Last Night Mccarthy went On Fox to say a new commission would be one probe too many. You have two investigations going on. And there was given money with ways to skur it and now we want to put a political commission to go forward with it . But there was a time not so long ago when mccarthy wasnt so concerned about that. Everybody thought Hillary Clinton was unbeatable, right . But we put together a benghazi special committee, a select committee. What are her Numbers Today . Her numbers are dropping. Remind us how many times congress addressed the 2020 attack on the consulate in benghazi. Here we go. Brace yourself. Kevin mccarthy is going to look a bit like a hypocrite here. There were ten investigations of which one he mentioned the select committee was a big one. I want to throw a few numbers about that select committee. Ten congressional committees, eight investigations. One congressional committee in in two years. 7 Million estimated budget. Last one, this is important, im going to make it big, zero evidence that Hillary Clinton, the secretary of state At The time of the benghazi investigation, had done anything wrong chlg remember, that was about a 2012 attack during the early stages of the 2016 general election. So Kevin Mccarthy the idea there were too many investigations now, there were a lot more then, and this Price Tag and this amount of findings, blaming Hillary Clinton for wrongdoing, suggests hes being way hypocritihypocritical. I have a number for you too. Two reasons that you say mccarthy is really against this commission. You mentioned it, but i want to go through it here. So theres basically two reasons. This is the big one. Remember, January 6th, Kevin Mccarthy and Donald Trump talked. We know that from cnn reporting. We know the Phone Call was contentious. Maybe the people rioting At The u. S. Capitol care more about the election than you do, kevin. We know that happened. A week later, he goes on the House Floor and says this is Donald Trumps vote. He needs to deal with this, do something about it. Of course, all that has changed because the Trump Base obviously doesnt care. Now Kevin Mccarthy is saying, i dont want to do anything. The reason hes saying that is he doesnt want to testify under oath in front of the committee about the Phone Call. Hes trying to rewrite history. Remember, we have the receipts and the clips. We know hes trying to dodge it. One other thing. This gets to the issue of why hes trying to dodge it. I call it mccarthy issue 2. The republicans stand to lose six seats. Midterm elections are not usually controlled by those who are behind the Prez Den see. How does he keep that role . Simple. You stay on Donald Trumps good side. Its not terribly difficult. The way you do that is say January 6th, this commission, its all political. You rewrite the history of it. Kevin mccarthy is doing this for political reasons. He threw him under the bus. He said, times have changed. I dont want to be on the wrong side of Donald Trump even in the wrong said says maybe we should look into the fact thAt There was an nurks At The u. S. Capitol and the capitol was overrun and we saw multiple people lose their lives. Thats whats going on. Look At The bipartisan effort. We deserve answers and an investigation by congress into this. Jennifer, what could be gained by having Kevin Mccarthy testify under oath considering the unique position he was in on the day of the insurrection . Well, brianna, one of the key questions, whether or not youre talking about a true connection or a civil suit and wherever someone was harmed is what did the president know and did he do anything to stop it. We know there was a key conversation between Kevin Mccarthy and the president. The question is what did they say to get that into the record. Mccarthy has not been forthcoming. Hes been evasive about whats happened. We know a little bit from Congresswoman Herrera Beutler during her second impeachment trial, but we need to have mccarthy in the Witness Chair talking about whAt That conversation entailed. If youre Questioning A Kevin Mccarthy, youre not expecting hes going to be as forthcoming as he could be. What could be an effective strategy as he might try to protect some information or talk around information that reflects poorly on him or trump . So theres certain things you want to do. One, the first one, you focus in on your key issues, three or four key questions. You want to keep it tight. The second thing is you only ask yes or no questions, only leading questions. You want to structure the question for the witness and ask him to confirm or deny. Its not why did you call Donald Trump on January 6th. You called to ask for his help in stopping this insurrection, didnt you. Third, you really ontario want to ask questions of which you know the answer. You know because youve done other investigations, looked at other Things Mccarthy has said and Phone Records and so on. Thats going to be the focus and you have to have all the evidence At The ready to hammer him on the impeachment side. So thats the how. What whats the what . What would the key questions be . The four questions, of course, theres a whole bunch of leadup with a set of rapidfire questions to get there. The key questions are did mccarthy Tell Trump what was going on At The capitol . Did they tell them thAt They had breached the capitol . ThAt They were violent . ThAt They were threatening his colleagues, threatening him, there was Property Damage . We really want to know. At thAt Time Donald Trump knew what was happening there. Number two, did he ask for help . Did he say, you need to help us, you need to send the military, you need to tell the police, get the people to back down, go home, and sftop the violence. You want to know if he asks for help and how much time went by and what he actually did. Third, did mccarthy Tell Trump thAt The people committing these crimes were his people . Were told by Herrera Beutler that is the case. Trump said its Ante Fachlt Mccarthy said, no, these are your people. We want that on the record. Fourth, this unbelievable quote we got about what Donald Trump said when he heard what was happening At The capitol, the violence, the damage, the threats to peoples lives, what did he say . Well, i guess they care more about the election than you do, kevin. ThAt Tells us in the moment when hes asking for help and peoples lives are on the line, hes concerned about whos more loyal to him about the Big Lie. So the fact there are republicans in Leadership Standing in the way of the January 6th commission, what do you make of it . Well, i was thinking about that when the prior block was talking about benghazi. I think the better comparison was the 911 commission, which was a huge attack on the United States. It may have been even bigger because it was inside the United States, January 6th. The 9 11 commission was formed without a lot of fanfare. The key author was a conservative House Member from virginia, and it was truly bipartisan. The two cochairs were Lee Hamilton who was a Mentor And Friend of mine and actually the president of the Wilson Center before i succeeded him in 2011 and tom kane, a well respected governor of new jersey. It functioned flawlessly. It did a huge investigation. It came up with a series of findings and recommendations, one of which was to all author the director of national intelligence, which i worked on in the 2004 with a bipartisan group that was then enacted. The point was we reformed the Intelligence Community after two fai failures, one, 9 11, and the second, iraq w. D. We did it based on the recommendations of a bipartisan commission. Thats the kind of thing we need right now. Ive been in a group calling for this. I understand the problem solver caucus which is getting a lot of traction has come out and endorsed this, which is going to be much harder to retain republican support including the Ranking Member on the Home Hand Security commission. He and Bennie Thompson introduced this. And i think its going to be hard for katco to walk back. What does it tell you about Kevin Mccarthy, that hes standing in the way of this now . I think this is a sad chapter for mencht its like my chapter 7, the incredible shrinking congress. Even in the republican caucus in the house, you can see all the fractures, the and this is just another example. Kevin mccarthy, he would have to agree, has taken some contradictory positions since hes become the Minority Leader in the house, and this is just another one. And the influence of the Trump Support in the republican caucuses is enormous, and what you were Reporting On in new York Yesterday just adds to the anxiety, you would think, by the forter president. I think Kevin Mccarthy probably agrees and disagrees with your last statement in true Kevin Mccarthy form. I want to ask you about your book which has a terrific title. New evidence this morning of the effectiveness of Coronavirus Vaccines. They work really well based on data from cdc and johns hopkins.
