Charge donald trump at the end of the russian investigation. Judge Amy Berman Jackson asking that a secret memo be made public. She argued this point. The agencys explanations obfuscate the through purpose of the memorandum and the excited portions belie the notion that it joining us now, make maggie haberman. Judge Amy Berman Jackson is suggesting the prosecution more than lied. Shes saying he used this legal memo to make this decision on whether to prosecute on Obstruction Of Justice and shes saying, no, i read this memo, thats not what it did, you lied to me about this memo. Whats the significance here . This is not the first time, john, that there has been a judge who has said that the Justice Department under bill barr was less than candid, to put it mildly, so it is notable particularly because of the way the Mueller Report was rolled out to the public by bill barr before, you know, he did his summary, before it was put out that basically framed the way it was seen. It caused tension between him and robert mueller, barr and robert mueller. That was a huge moment for donald trump because it framed the way this was seen. This memo relats to how that took place. The judge is underscoring that they were not candid and up front with the court and that they were not candid and up front with the public. Did any of this as far as you can tell put new jeopardy on those involved including the former president . Look. I cant speak to what the level of jeopardy would be. As far as i can tell, so far this is literally about a memo and how the doj interacted with the court. I dont see how we, unless we come up with something, we, meaning the public record, told bill barr to do that. I dont see how this touches on donald trump other than donald trump was obviously pleased with the way bill barr put out the Mueller Report and he has said so. At the moment, however, it raises for us Fresh Question about bill barr and his Justice Department and why they handled it the way they did, and thats not going to go away. It makes you realize in the history of this, youll now have this coming from a judge that this was whitewashed, so thats going to be a key point. I do want to touch on your repo reporting. You have new reporting that Rudy Giuliani, his allies want former President Trump to pay his legal bills. Hes Fighting Defamation and having personal devices seized. Why isnt trump world paying him . Right. Brianna, when they say they want trump to pay, what theyre talking about is the gop, the Trump Campaign to pay. As you say, its from the huge amount of money they raised. Their argument is it was raised for that purpose, a Legal Defense fund. It appears it was not spent on that purpose, and Rudy Giuliani was involved in those everies on Donald Trumps behalf, that his legal fees are not sometime in the future. Theyre already there because hes getting sued by Voting Machine Companies over, in his words, a conspiracy to flip votes bidens way. Trump, as we know, does not like to pay bills of his own, let alone someone elses. Hes adamant he should havent to pay for the legal work that Rudy Giuliani did between november 3rd and whenever it was, january 6th when the uprising happened at the capitol, but i think part of it may be because people around trump are concerned there could be opening up some level of, you know, not culpability, but certainly it could be problematic for trump because hes facing his own Legal Investigations because he paid for what Rudy Giuliani was doing. I want to put up this tweet from ted cruz who made a point of saying he went to maralago to have dinner with the former president. Now, clearly its become something of a pilgrimage where republican lawmakers go to maralago and feel like they have to get close to the former president , but he also added something that jumped out to you in particular. He said, he is in great spirits. So many republicans who visit with him say that. Thats something you say for someone recovering, hes in great spirits. John, i would put it slightly differently. I think for four years there has been this great tenor, hes in a great mood, hes really happy, and theres always been a need for his viers or people close to him to go see him to talk about how hes feeling. Sop of that is because he was frustrated by reportings that he was fuming or angry or acting in a way that sounded erratic. I dont think ive covered anybody where they would talk so much about what their mood was. Yes, that jumped out at me in that tweet. Certainly his emotional state has been so key to all of your reporting to the story of donald trump. And, maggie, thank you so much. Great reporting as usual on giuliani. Thanks for being with us. Thanks, guys. Liz cheneys days as the third ranking republican in the house appear to be numbered. A vote is expected next week to remove her. Minority leader Kevin Mccarthy calls her a liability because she can no longer, quote, carry out the message. It is worth noting its a message steeped in lies. Heres Kevin Mccarthy caught in a hot mic moment on fox. I think shes got real problems. Ive had it with her. Ive lost confidence. Well, someone just has to bring a motion, but i assume that will probably take place. So there those are comments by mccarthy edited by fox. They do not include questions by host. Its no longer whether cheney can revive, but who replaces the houses highest ranking female republican. Representative Elise Stephonic of new york is expected to replace cheney. Shes a an ally. On january 6th she objected to the results, in other words, bought into the big lie. A columnist rights in an oped, quote, to be a loyal republican, one must be either a sucker or a liar, and because this defining falsehood is so obviously and laughably false, we can safely assume that most Republican Leaders who embrace it fall into the second category, knowingly repeating a lie, and act of immorality is now the evidence of republican fidelity. Joining me now is michael gerson. Michael, this is some calling, right . You get biblical here . You write, whoa unto them who call the good evil and the evil good. Why are the stakes so high here . Ive been around awhile now. I worked in the white house, i worked on three republican president ial campaigns. Ive never seen anything like this where essentially an Act Of Irrationality becomes the defining evidence of loyalty, and it even goes further than that. The point of the column is really its not just irrational. Its immoral because those involved in politics know we had a fair election, and by making this accusation theyve done an immoral act after a founding commitment of the republican party, and i think tas ultimately not sustainable. Lets talk about that. You say this is a foundational lie. What exactly do you mean by that, and whats the significance . Whyassiduous . Because its a lie that creates and sustains a world view that says theres a huge conspiracy of republicans and disloyal democrats including the courtings s and the media that to get trump and his followers. This is the myth hes creating, and a lot of people are buying into this sincerely, but Republican Leaders are not buying into it sincerely. Theyre buying it out of fear or s sinysis. This is failure of leadership, moral leadership. Liz cheney is basically out. The decision has more or less been made, hasnt it . Yeah. I do think so. I think that Kevin Mccarthy, whos really a sniveling nonentity has made a decision to do what comes easy for him. But leaders like cheney, leaders like mitt romney are important. They show people like me who come from a different part of the party that resistance is still possible. So i think we all lob to cheney in this circle, but ultimately American Voters are going to have to punish those who hold these views. Republicans right now do not feel like theyre losing. They feel like they have momentum. And i think in order to really turn on this set of views, ultimately they have to fail politically. And americans are really responsible for that. You say resistance is possible. The question is resistance futile. You see the romneys, kinzingers, cheneys of the world tries to stand up. Theyre getting marginalized. Mitt romney was booed at a Political Convention in utah. Liz cheney. Were talking about a conservative as conservative can be being pushed out of a house leadership position. I guess the question for you is it time for the romneys and cheney is and kinzingers, and gersons to say, its time to give up . Its so deeply rooted in our form of government, not just our form of politics, that i think its going to be very hard. Ultimately there are Reform Movements that succeed. You had the party under bill clinton that pushed for persuasive policy ideas or tony blair with new labor in britain. You know, it was a party that was fundamentally committed to democratic socialism and he reformed it in fundamental ways. Its not as though this never happened before, but the reality here is republicans are going to have to understand that for their party to change, it has to lose. That means republicans are going to have to make the choice to vote against their partisan identity in, you know, certain cases and thats hard because of extreme polarization. Everyone votes their own, you know, party identification. But, you know, increasingly people are going to have to look beyond that partisan identification and say, is this building a healthy democracy or not. Michael gerson, appreciate the conversation. Thank you so much for coming on this morning. A motion for a new trial filed by the lawyer of former Minneapolis Police officer derek chauvin, this comes after a photo surfaced online that shows one of the jurors wearing a black lives matter cap and a shirt with a quote, get your knee off our necks. Omar jiminez is tracking the latest developments here. Omar, tell us whats happening. Reporter we knew the deadline for the chauvin team to file a motion for a knew trial was today. Some of the reasons were actually brought up during the course of the trial, including concerns about trial publicity. During the trial the judge ruled at these various points there wasnt enough there to act on those concerns, but here we are, awaiting another judge ruling postverdict on whether theres enough here to actually grant a new trial. Derek chauvins lawyer requesting a new trial two weeks after the former Minneapolis Police officer was convicted of killing derek chauvin. His lawyer filed a Motion Including Grounds on interest of justice and a verdict contrary to law. Virtually every defendant convicted at trial asks for a new trial and appeal. Rarely do they succeed. Its a big deal for a judge to throw out a verdict. Reporter citing judge cahills motion for a new trial and the publicly threatening the fairness of the outcome. The judge has already reviewed many of these same points and has already determined there wasnt sufficient evidence presented by nelson or the motions to be granted. Reporter they also claim the jury committed misconduct, felt pressure and intimidation, and failed to adhere to instructions during deliberations, this as juror Brandon Mitchell faces some criticism for this picture showing him wearing a black lives matter hat and tshirt with the phrase, get your knee off our necks. Mitchell told the Minneapolis Star Tribune his uncle posted the photo on facebook after the rally last august commemorating Martin Luther kings I Have A Dream speech. It was not about a protest. Either way, u was going to this event. Reporter each jurors with asked in a questionnaire whether they Par Tticipated in a protes speaking of police brutality. He answered no. Both the attorneys and judge asked me all the question they needed. Reporter after filing motion tuesday, the office of the Attorney General in mchb said the judge has already rejected all m of these arguments and the state will vigorously oppose them. And on the potential drawing of the connection of the pictures that emerged and the jurors alleged misconduct, there are still others that we know nothing about. As we await the judges ruling on the motion, the next date is june 25th where essentially chauvin could face up to 40 years in prison. But because hes nod hat a criminal history, it could be much lower. The prosecution is pushing for more years because floyd was vulnerable and a victim. This is such a developing story. So weve seen it twice in recent weeks, republican lawmakers defending the infamous threefifs compromise, which declared slaves becounted as threefifs of a person. The latest on the floor of the Tennessee State house. Were joined now with more. I cant believe this. Yes, you can, and heres why. All these conversations are coming up right now as republican lawmakers across the country are pushing new bills to limit what schools can teach students about racism in this country, but now some find themselves in need of a history lesson. Tennessee state representative Justin Lafferty took to the house floor tuesday, delivering an impassioned speech during a debate over legislation aimed at limiting funding to public and Charter Schools if they teach critical race theories, a practice that sees race entrenched in laws and institutions and a prime target for some conservatives lately. Ive seen reference as you all have, the threefifths compromise. Pull out a piece of paper and find out why that was reached. Speaking off the cuff, lafferty went on calling what he called a bitter but is in compromise erroneously claiming it was the way to end slavery. The threefifths compromise was a direct effort to ensure the Southern States never got the population necessary to continue the practice of slavery everywhere else in the country. By limiting the population in the count, they specifically limited the number of representatives that would be available in the slaveholding states and they did tot end slavery. Yet it wasnt about ending slavery at all. It was baked into the constitution during negotiations in 1787 about congressional apportionment and taxation. What representative lafferty failed to mention is that the compromise meant that a state could count threefifths of its enslaved population toward its total population, even though enslaved people had no rights and certainly couldnt vote. That gave Southern States more representation and effectively more political power. Laffertys speech received a round of applause from some of his colleagues, something that Democratic State representative Antonio Parkinson told the New York Times was especially stinging. He went on, i thought it was horrible. I dont care if its policy or counting heads, theres nothing good about slavery. But laverty isnt the only one offering this ahistorical claim about compromise. Last year state representative ron hanks said this. The threefifths compromise, of course, was an effort by nonslave states to try to reduce the amount of representation that the slave states had. It was not impugning anybodys humanity. Reporter just minutes before hanks spoke, there was a different approach. As someone who recognizes threefifths, we do need to understand each other when we talk about these things. Theres something to be said about the literacy of the power in this country and all the steps taken to keep people from it. Reporter Cnn Reacheds Out to representative lafferty about his response from the floor on tuesday, but we havent heard back yet. Interestingly, john, there are a bunch of bills on the table to stop schools from talking about systemic racism, but no ones pushing to teach about the legs of slavery. That might be helpful. Going sri lanka your friend. Laura jarrett, thank you so much for that. Joining me now is Democratic State representative sam mckenzie who represents knoxville, tennessee. You were in the room during this speech. What did it feel like when an elected member of your chamber went on about how great the three threefifths compromise was . Good morning. It was eerie and said as were from the same county. Theres nothing right about his conclusions. To hear the applause spoke to the lack of knowledge of the people who are elected to write laws for our state, and this was just a bad bill, and its unfortunate that it passed and it received those types of comments and applause. I feel like this is speaking to some larger issue in tennessee and around the country now, which is to somehow suggest that, you know, parts of slavery, not so bad. You know know, why are we goin of our way to teach these bad things about slavery . It got to the point you were making, and thats that somehow history has to remain the same history that our grandparents had, that getting to a point to say the ruling people did everything right and there was nothing systemic about 400 years of slavery, jim crow laws, that we cant even teach that and say that this is the way we arrive to where we are in 2021. Its unfortunate that we dont as a legislature dont want to teach our kids an accurate and full display of what the history is that make this country a great country, but with a lot of, lot of dark, dark days. So i understand you had a chance to speak with representative lafferty after his speech. How did that go . I would say uncomfortable at first. We had a very collegial conversation about it. Of course, we stand on two different sides of his conclusion, but, you know, his facts are correct. The south did want that. They wanted to compromise the threefifths, but thats a horrible thing. But it had nothing to do with slafbs. It gave them more power. I appreciate you being with us. In some ways im sorry you had to sit through that. Thank you. I appreciate it. Hopefully we can stop bringing these bad bills to the table. Governor andrew cuomo appearing to sow doubt on investigations and accusations against him. Despite the scandals surrounding the covid crisis and nursing homes. But hes also raising doubts about what the Ongoing Investigation by state Attorney General Leticia James will reveal. I did Nothing Wrong, period, and im not resigning, and im doing my job every day. Im not telling anyone to have faith in anything. I didnt tell the assembly to have faith in anything. Everyone makes their own decisions. Heres the governor two months ago praising the Attorney General. Whats determinative is what the Attorney General finds. Thats the factual finding. And the Attorney General has to do her job, and shes very competent to do that. Now, my next guest compares his approach to the repeated gaslighting of america by donald trump. Lets bring in cnn political commentator s. E. Cupp. This is a good column. You lay your case out with various points. Well, its a very obvious comparison, i think, if youve been watching the way cuomo has deflected and distracted over the course of these Duo Investigations into the Nursing Home Scandal and the allegations of Sexual Misconduct. For the nursing homes, hes called its essentially a partisan witch hunt concocted by donald trump. Its a very trumpian thing to do. In terms of the Sexual Misconduct investigation, hes thrown everything but the kitchen sink at it. Hes had his Team Reportedly try to did caret it one of the accusers. Hes blamed can sell culture for the scrutiny of him. And most recently, hes questions the integrity of not only the investigation but the investigator, trish james, one who he once endorsed and almost hand selected to run for a. G. , now floating a really uncorroborated rumor that she just wants his job. So, bri, to put it another way, the idea he would defend himself against allegations of Sexual Misconduct with women by discrediting by the way, the first africanamerican and first woman to hold the position of Attorney General saying, well, she really just wants my job . Its a new level of gross and despicable. But, again, its very trumpian. We saw trump basically use the same playbook through multiple lawsuits, allegations, accusations, and somewhat successfully. Yeah. You even mention like bickering, right, the namecalling is very cuomo as well. Also you say he seems unencumbered by the truth, malleable and downright bendable. He may as well preemptively call the conclusion of the investigation alternative facts. Yeah. When you say im not telling anyone to have faith in anything, everyone makes their own decisions, im sorry, wheys the print of an independent investigation if not to get to the truth . If in the end everyone gets to make their own decision, then its meaningless and youre undermining the idea theres a truth to get to, and youre doing it right before the results even come out, both undermining the investigation and the investigator and telling people not to have faith in this system. Its one of the most deleterious things we think trump has done, and here is a sitting governor of a very big state, a member of the democratic party, once having thought to run for president , and hes doing all of the worst stuff trump did over the course of his presidency. S. E. , thanks for being with us. You lay out the facts in this column, and its a very interesting read. Thanks, bri. As more people are flying, it turns out more jerks are flying. A Police Officer in georgia has gone vie rar after posting this tiktok video saying hes tired of hearing after the negativity of Law Enforcement in america. Im tired. I am so goddamn tired. I wake up every morning and kiss my family goodbye knowing that theres a possibility i wont come home. I am tired of every time i wake up in the morning theres someone else polarizing the fact that maybe Law Enforcement is just not a good thing. All of us are not bad. I am not as they are. Most of us are not there are bad people in every career im so goddamn tired tired tired joining me now is the man that you see in that video, major calvin dingel. Sir, thank you so much for being with us. I think this resonates with people because they feel what youre saying. Tell us what led to this frustration and explain how your experience as a Police Officer has changed here in recent years. Well, first of all, this is truly humbling. What happened, it was not one thing that was isolated for that day. What it is for collectively the last year or so, Law Enforcement has really been getting truly shooken up, honestly. Also, going to and from my home, a lot of times i see a lot of negative stares, people actually frowning, people actually doing something to get my attention thats not positive, people actually flipping me off, and its just you know, its just heartbreaking now, and when i first started in Law Enforcement in 2001, it was nothing like this, but it is now. I dont know or im not exactly sure how to fix it, but i believe it needs to be fixed. Heres someone whos also served your country in the military. You say that all Law Enforcement is not bad. You say that in the video. Most Law Enforcement is not bad. But youve seen americans who have watched everything from the video of George Floyd Being murdered to the video of Second Lieutenant nazario being pe peppersprayed in virginia while he was in uniform, and they look at these things and have distrust. How do you look at the good Enforcement Officers to rebuilding that trust . I believe in rebuilding the trust, first of all, a conversation has to happen, it really does. I dont think na nothing or no one or no career is actually being held or should be held to a holistic point. I think everything is based upon an individual. Youve got to remember, were Law Enforcement officers, but we all have our own individual characters. Just because youre seeing bad things in the news, i guarantee theres more good than bad happening, there really is. If you take it at o than basis, at that time, that moment, that incident, youll get those results. Im not talking here where im at. Im talking globally across america. We need to sit down and we need to talk, but we need to listen, not to respond, but listen to understand. If you do that, i guarantee you it becomes a better place for all of us, Law Enforcement just as well as our citizens and our communities. Do you think Law Enforcement needs a Culture Change . I think Law Enforcement, like anything else, needs to be heard. I believe the conversation is not just on one side. Theres a lot of things Law Enforcement deals with on a daily basis that nobody knows their mindset, what theyre going through. The truth of the matter is everyone should be heard from, each side. Honestly, i believe its key to most things. If you teach somebody right from wrong, which we all know, i believe right will prevail over anything wrong, thats what i think. But its individualbased and instantbased, which means it can happen in an instant. Major, look. I appreciate you having this conversation with us. Your message resonated on tick tock. I know your kids told you youre too old for tick tock, but i suggest youre having a little laugh at them today as your message has gone viral. Thank you, thank you. I hope it makes a difference.
