Heres a little bit of the video the sheriff posted on facebook this afternoon. Because we want transparency, we want the body Camera Footage made public. Some people have falsely claimed that my office has the power to do so. That is not true. Only a judge can release the video. Thats why ive asked the North Carolina state bureau of investigation to confirm for me the releasing of the video will not undermine their investigation. Once i get that confirmation our county will file a motion in court hopefully monday to have the footage released. Reporter so he says as early as monday to file a motion for it to be released and not only is the sheriff intending to potentially file a motion but the city council of Elizabeth City who is not involved in what happened on wednesday because thats a county event, incident the city council has also agreed to file a motion on monday in addition to that cnn is part of a group of 14 News Organizations that formed a Coalition Serving A Petition to file a motion to have that foot and released so you are getting this from multiple parties potentially on monday to see some progress being made about the release of this footage. Making it illegal to give food and water to people waiting in line to vote. This is the one part of the bill and a lot parts in the bill that people dont like but is the state really going to arrest people for that . In other words do people need to be aware of the Cookie Police there in georgia . Last year, we saw a surge in complaints about it. People in effect using it as electioneering and modeled the law after New York State and always illegal to politic within 150 people and people encroaching on that and the local election how many times did that actually happen . We had multiple complaints and ill get you an exact number. When you say multiple do you mean dozens, hundreds, just a few . What do you mean . It was dozens. And it really was primarily in the runoff race to spike up and thats when we hit the complaints. As you know some of these long lines copied New York States law. The long lines are in predominantly black neighborhoods and so im just wondering if people are standing in line for hours and we both know people stand in line for a long time in the elections and predominantly in minority communities, communities of color. Will the police show up and start cuffing people if theyre handing out water and snacks to people waiting in line . Sounds crazy. When theres an investigations brought before the election board people wont be handcuffed at that time but counties with the long lines in the past are run by democrats. With democrat controlled election boards. And so if theres an issue there its really in democrat counties run by democrats and the first thing and in the november election less than three minutes in the afternoon of november and first time put in the bills that lines cannot be wont you have a situation where if you do have long lines occurring people cant get a drink of water . I think thats what a lot of people are watching for now. It is a fascinating legal scenario because Derek Chauvin faces a maximum sentence of 40 years. However, minnesota uses Sentencing Guidelines and yeels somehow a recommended sentence of only 12 1 2 years for Derek Chauvin, largely because this is his first conviction. However, prosecutors are looking to increase that number by arguing what we call aggravating factors. George floyd was vulnerable because he was handcuffed and daufr used cruelty killing him with the knee and abused the position of authority as a police officer, the crime was committed in the presence of children and heard from minors as finally that the crime involved three or more people referring to the other Police Officers charged so it is up to the judge to find those factors. The stakes are really high here. I think its clear he has to go above 12 1 2. Thats a ridiculous number but will he go up to 40. We shall see. How does the conviction and eventual sentencing of chauvin impact the three other former Police Officers . They will be tried together in august. Thats more difficult for prosecutors. Chauvin committed the most obvious conduct with the nieto the neck for 9 29. Theyre charged with aiding and abetting meaning they knowingly and intentionally helped Derek Chauvin commit murder. Thats a legitimate legal theory. But the reality is its harder for prosecutors to prove because youre one step removed so keep an eye on the chauvin sentence because the higher sentence the more incentive to try to plead guilty. They will look and think i may not get that much time but im still looking at decades and will give them more reason to try to work out a guilty plea to cap the exposure. The Justice Department launched a probe into policing practices in minneapolis. So this is essentially a full audit of the Minneapolis Police departments functioning. Hiring, training, use of force. Looking for a pattern and prak test of discriminatory policing.
